I filed a complaint with Consumer Finance on XX/XX/XXXX due to Kirkland Financial resistance to work with me for a modification and/or willingness to work with NJHHF program. I was initially denied by the time Kirland Financial decided to participate due to income, but due to unforeseen circumstances I had to take a position with lessor pay. I reapplied for the Hard Hit Fund program and Kirkland did not want to do loan modification. I then advised them that we could recast the loan. All while we were in the process of doing the loan modification I received court papers for the transition of the foreclosure from XXXX to Kirkland dated XX/XX/XXXX and they sold my loan to XXXX XXXX, XXXX on XX/XX/XXXX. This is the third sale with 9 months. Not one of these companies have tried to help. XXXX, Kirkland and now this XXXX XXXX, XXXX. I spoke with XXXX of XXXX XXXX, XXXX on XX/XX/XXXX and asking for a mortgage statement. I advised him that XXXX XXXX Kirkland said they do not provide mortgage statements to people in foreclosure. XXXX advised me to resend the same email requesting a mortgage statement that I requesting from him, so he can ask XXXX for it. XXXXF is requesting this information so they can quickly bring my file to closure. Kirkland Financial is by far the worst company ever. Clearly they never had any intentions on trying to help me. They prey upon customers is bad situations. They sold my loan to a company who prepares your homes for sale, and who is not an actual servicer and/or back. They quickly get homes ready for sale. These are the email thread from XXXX stating my loan was sold and that XXXX from XXXX XXXX, XXXX would be willing to reinstate my loan with NJHHF. Ms. XXXX : Your loan is being sold today. To Whom It May Concern : I am contacting you due to a predatory lending matter that we are the victim of for some time now regarding our church mortgage. Due to the highest and best use of the property, located at XXXX XXXX, XXXX, Alabama, the current lender, " Kirkland XXXX, '' is exercising a strong-arm tactic, more commonly referred to as predatory lending, to foreclose our property. The mortgage was originally with the lender, XXXX, and was unbeknownst to us up until the time of transfer, sold to another establishment, Kirkland XXXX. I have compiled a timeline of events that I think may give more reflection to my complaint. In XX/XX/XXXX, I wrote the President of XXXX, XXXX XXXX XXXX, concerning some concerns I had regarding our mortgage and payments ( see enclosed ). After writing the President of the Bank, XXXX XXXX XXXX, VP of XXXX, came down to visit us and took over our account. I have enclosed our payment history for your review. Initially, I believe the locals had a plan to try and take our property due to the current growth of our city. Our property is fixed between XXXX major companies that have moved to this area, XXXX and XXXX. We have more than XXXX square feet on XXXX acres of land. In association with these new companies are other companies that will supply them. That 's why I believe they started trying to take our property. Our church is located in a nontraditional facility ( used to be a shopping center ). We have been here as an active part of the community since XX/XX/XXXX, and since that time, XXXX, and more. We are truly a XXXX. Enclosed are the documents/letters I signed, up until the time of the sale in XX/XX/XXXX with XXXX, along with correspondence ( including letters and email communications ) from XXXX Investors. This has been a long and arduous process. It has been very stressful, due to the purchase of our loan, for one, by another lender ( XXXX to Kirkland XXXX ). This was due to XXXX selling our loan to Kirkland XXXX. They did not communicate with us at any time until they said our payments were in arrears. We are looking for immediate guidance and assistance in combatting this predatory behavior. Thank you for your assistance and support in bringing a positive and amicable resolution to this matter. In XX/XX/XXXX, I became severely ill and had prescriptions that were not covered by my insurance, which resulted in me paying out of pocket. By XX/XX/XXXX I was out on XXXX until XX/XX/XXXX. I returned to work part time and because full time in XX/XX/XXXX. I went back out again in XX/XX/XXXX for surgery, and returned back to work in XX/XX/XXXX. During that time my loan was transferred from XXXX XXXX XXXX during the process of my modification to XXXX XXXX. I then applied for a modification from XXXX and they advised me that they were reverting back to my original loan of 7% at $XXXX a month. My current loan is at 2% and the payment is $XXXX. They transferred my loan after two months to Kirkland Financial Group. I contacted Kirkland Financial for a modification and they denied me stating the payment they came up with is not affordable. They came up with a payment of $XXXX. I then applied to the Hardest Hit Fund in NJ and was approved for the assistance to bring my loan current. Kirkland declined to participate and adviced me to reapply for a modification. This was the email and terms that were offered: Based on the documents provided, it appears we can get something done. As of XX/XX/XXXX, per the attached payoff, you owe $XXXX. You are currently over $XXXX past due in payments alone from XX/XX/XXXX to date. We can offer a 6 month trial modification beginning XX/XX/XXXX. You will need to pay your own Home Owner’s insurance and Property Taxes. Payments will run XX/XX/XXXX thru XX/XX/XXXX at $XXXX monthly. You will also need to make a $XXXX “good faith payment” which can be split into 2 payments - $XXXX due on XX/XX/XXXX (along with the 1st monthly payment of $XXXX) and $XXXX due on XX/XX/XXXX (along with the last monthly payment of $XXXX). Assuming you comply with the terms of the trial period, your loan would be modified as follows: $XXXX Balance (currently owe $XXXX)5.00% Rate (currently at 2.00%)180 month term (currently 455)$XXXX P&I payment (currently $XXXX)$XXXX Total Payment Please let us know if you accept this offer. This is our best and final offerThis company is clearly not willing to assist me with saving my home. They raised my interest rate from 2% to 5% and shorted my term. What kind of mondification is this? They don’t even want me to pay any utilities to keep me warm.
