Claimant allegedly became obligated for a loan on XX/XX/XXXX, however, the alleged NOTE was not signed until XX/XX/XXXX. An alleged, loan servicer was assigned on or about XX/XX/XXXX, to collect payments on the alleged loan, and claimants made " good faith '' payments under the assumption that a valid debt existed. Claimant sent NOTICE to the President of the company that was the alleged lender on the NOTE on XX/XX/XXXX, by certified mail, requesting clarification of the NOTE terms, no valid clarification was received. See Exhibit A Claimant sent a second NOTICE to the President of the alleged loan company, by certified mail, on XX/XX/XXXX, seeking clarification of the alleged debt, no valid clarification was received. See exhibit B Claimant sent Notice to the Title Company that performed the Closing on the alleged Loan on XX/XX/XXXX, requesting specific information about the alleged loan for verification purposes. No response was provided. See Exhibit C Claimant sent a second Notice by certified mail, to the Title Company for a response on XX/XX/XXXX, no response was provided. See Exhibit D Claimant sent the alleged Servicer a Qualified Written Request ( QWR ) by certified mail on XX/XX/XXXX, the debt was not validated nor did the Servicer provide the name and address of the NOTE HOLDER. See Exhibit E Claimant sent the current alleged Service a QWR on XX/XX/XXXX, by certified mail the alleged debt was not validated nor did the Servicer provide the name and address of the current NOTE HOLDER. See Exhibit F Claimant sent a Notice of Error and Demand for Proof of Claim by certified mail on XX/XX/XXXX, to the current alleged Service. No valid response provided. The current servicer who is a third party " debt collector '' failed to send notice of claimants right to dispute the debt in accordance with 15 U.S.C 1692 .The current alleged servicer is sending threatening letters of acceleration of the debt and foreclosure for unpaid alleged loan payments.

my wife and i left an Ernest money on XX/XX/20 with KB Homes to build a house. according to XXXX XXXX the Sr.Sales Manager of the loan company we have been approved on XX/XX/20. apparently loan company was trying to resolve the issue of me having another mortgage and i clearly signed a contingency form with them to sell my home prior to closing. finally on XX/XX/20 the loan company ( KBHS home Loans ) notify me about the status of the loan and carrying two mortgages in the same time. I just ask them what are you guys so concern about the second mortgage while i signed a contingency form. now a month and half passed my Ernest money which was a cashier check was never cashed out, their sales department which is the builder had no communication what so ever about the status of the loan. my wife and I decided not to do business with kbhomes due to lack of interest and care to sell us a home. Its interesting to let you know when i called and asked for my refund they gave me the same cashier check that i gave them. my check was never cashed at all. and they agreed to cancel the whole transaction without any argument. thats odd. it sounds like they know they made a mistake. i called and asked XXXX nicely to remove those inquiries because of their mis-communication with the builder and wasting my time. she just emailed me and said we cant. this is her info. We ( my XXXX year old mother and I ) have been trying to buy a house since XX/XX/XXXX ( date of the earnest money check ). We are buying a KB Home and financing with KBHS. This financing company has been so incompetent. The loan officer did not know why I wanted to know the APR. I had to tell her several times how much money we wanted to put down before she got that correct on the closing disclosure. We were supposed to sign on the XXXX of XXXX. We were told all the papers were on the underwriters desk and that all we were waiting for was a signature early on the XXXX, only to be told later on in the afternoon that the closing would not happen until the XXXX of XXXX - no explanation given. We signed on the XXXX and were told we would get the keys to the house on the XXXX of XXXX. Now the finance company wants a covered policy binder from my insurance agent who sent them " evidence of insurance for mortgagee '' on XX/XX/XXXX. So now I have no access to the house, furniture arriving, and utilities scheduled to be turned on, and they are quibbling over a date on an insurance policy. I can not believe this is not something that should have been resolved a long time ago.

On XX/XX/2019 I reached out to my loan officer to discuss the loan product I was given. I had a problem with the interest rate and APR. I felt that based on my credit profile, I should have been given a better rate. I was advised to submit a competitors offer to match. I did submit a second offer, however I still was not being treated fairly. On XX/XX/XXXX I reached out to the office manager to reach a resolution. I was told that my competitive offer would be considered and that changes would be made to my loan product in order to keep my business. Minor changes were made on XX/XX/XXXX, however I am still unsatisfied with the loan product I was given because unfair lending practices are still being used in order to manipulate me. On XX/XX/XXXX my loan officer called me and told me that I can go with another lender or take the unfair terms of the financial product that is already in place. At this point I am less than a week away from my closing date and I do not have sufficient time to find another lender. If I do not stick with this unfair loan product that was comprised using to predatory I will loose my deposit money and the home that I am trying to purchase.

I went to XXXX XXXX this past weekend on Sat XX/XX/XXXX to purchase a new home. They stated they would have to cross qualify me. I did not authorize or sign anything for them to run my credit. I did fill out the basic paperwork and contract which did include my ss #. However, I told the lender I would have my lender send them all the current information I just gave them. I had the lender from XXXX XXXX XXXX call me on Sunday XX/XX/XXXX stating he would need some information. At that time, I told him I was on vacation until a week more and told him not to run my credit as my current lender would send him all my recent information. I received notification today from my credit company that a hard inquiry was made on my account. I spoke with him and he admitted to running my credit today and said he thought he had the form. I am super upset that this person XXXX XXXX took it upon himself to do this. This has now lowered my credit report number. His information is below. The moment I was told I had to pay off my car, and did do us when things started to drift. Which they where trying to make it seem like I was criminally or illegally getting money from else where, when they specifically have all my assets and banks statements shows I do have the funds to pay it off, plus I received gifts from family members to help on my big accomplishment. It just felt like as a XXXX woman or individual I wasnt suppose to be able to payoff my car that easily or Im not suppose to be successful and XXXX. I felt so discriminated against and this needs to be brought to the light on how these lenders do XXXX American people. Its sad, because I have worked so hard to get where Im at to be push down and stomped on. This company KB Home Loans needs their racism and discrimination again XXXX brought to light. The individuals I have experience this horrible experience with are XXXX XXXX, XXXX XXXX, and XXXX XXXX.

I availed of the XXXX XXXX ( XXXX XXXX XXXX ) through XXXX. XXXX practically lost the documents that came with the closing packet and was not able to submit my applic in time to XXXX. Now, I can not avail of my {$2000.00} ( or 20 % of interest I paid ) yearly tax credit up to the life of my loan ( 30 years ). After lengthy follow ups, XXXX offered to restucture my loan, but i still need to pay {$3000.00} plus to close. I refuse to do that. They also refuse to recompense me the equivalent of what I should have receive as tax credit for XX/XX/2017 and this year up to when we will finally restructure, had their company, through its agent done their due diligence. NOt only I am not able to avail of my tax credit but they actually expect me to shell out MORE money! Preposterous.

I am reporting XXXX XXXX XXXX XXXX XXXX, Mortgage Loan Originator for false and deceptive practices and for harassment. XXXX has emailed and called me multiple times stating that he needs documents from me to complete a mortgage loan application of which I never applied to or agreed. XXXX and/or his team members emailed and left voicemails on XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX requesting financial documents. I notified XXXX via email on XX/XX/XXXX to stop contacting me because I am getting a loan with XXXX XXXX XXXX He and his team continues to contact me requesting documents in order for my loan to be approved after my written request. I am getting harassed by XXXX. He is not respecting my request to stop contacting me to complete a loan mortgage application.

XX/XX/XXXX KB Homes ran my credit without my consent and caused damage to my credit score. I spoke with the lender who ran my credit without my consent and he said that " I'm Sorry '', he just did what the other lender told him to do. He felt bad about my situation but he never resolved the situation. He said dont worry is only a few points, I'm very disappointed and I want to make sure my credit is the same as before their ran my credit and most important alert others about what they are doing.

Kb homes issued a pre-qualified that tied me up for months on a home they couldn't close now is priced XXXX higher than before. Now all homes are priced higher as a result of there negligence and I took a big lost.. they should have been honest from the start about the inability to close the deal they had very poor communication and I did everything in my part to make it possible. They kept telling me that the loan was okay and everything was fine to in the end canceling purchase.
