LETTER ONE I have received a letter dated XX/XX/XXXX from a company, possibly a law Firm, called Jonathan Neil & Associates , Inc. with California address. The letter stated that, if I do not respond to the letter within 7 business days, they may request to suspend my driver 's license and remove my license plate registration. The letter affirmed, which later turned out to be FALSE and INVALIDATED, that I had an accident, presumably an auto accident, with a person ( no name was given ) insured with XXXX on XX/XX/XXXX. It also stated that they will immediately stop any efforts that they may have begun suspending my license or registration IF I PROVIDE my auto insurance and the PERSONAL information to the Firm. It further stated, and threatened, that they will review this case to possibly seek a judgement to SUSPEND MY LICENSE and/or MY CARS LICENSE PLATE REGISTRATION after the 7 day period Knowing I was not involved with any accident with anyone on the date ( XX/XX/XXXX ) shown on the letter, I thought the letter was sent by mistake. I did not respond to the letter because I also thought the letter could be a scam aiming unlawful activities. Also, there is no need to provide my insurance and the PERSONAL information to any random 3rd party, whether it is a person or a company. There was no further communication or activities from the said company, Jonathan Neil & Associates , Inc., until they sent out the second letter a month later. LETTER TWO I have received the second letter dated XX/XX/XXXX from the same company, Jonathan Neil & Associates , Inc. ( the Firm ). This time the letter identified the Firm as the collection agency and stated that if I do not respond and dispute the debt of {$1300.00} within 30 days, they will obtain verification of the debt or a judgement. Even if there is no evidence or verification of the debt is provided, the Firm THREATENED that they WILL file a suit against me if I do not make the payment and that they WILL seek to recover such court costs and attorneys fee as ALLOWED BY LAW Being concerned that I was falsely accused of a debt which I do not owe, I responded to the Firm 's letter by sending a certified mail dated XX/XX/XXXX. In the response letter, I have specifically requested them to provide verification and documentation that there is a valid basis for claiming that I am required to pay the debt to their Current Creditor ( XXXX ). For example, I asked them to provide a copy of the written agreement or any legal documents executed by 1 ) us, or 2 ) a person with a power of attorney acting on behalf of us, or 3 ) a government official with proper authority within the jurisdiction of this matter, that created the original requirement to pay. My response letter further requested the Firm to prove the Firms authority to collect the debt in the state of CA and CO, by providing 1 ) debt collection license, 2 ) license number, and 3 ) the name, address and telephone number of the state agency issuing the license. LETTER THREE I have received the third letter dated XX/XX/XXXX from Jonathan Neil & Associates , Inc. ( the Firm ) for the Firms response to my letter sent on XX/XX/XXXX. For the requested proof of the Firms authority in collecting debt in the state of CA and CO, the letter from the Firm simply stated, We represents the above referenced client ( XXXX ) for matters or subrogation, and for that stated purpose, we have the right to speak on their behalf. No further information on the Firms authority to collect the debt such as 1 ) debt collection license, 2 ) license number, and 3 ) the issuing state agency was provided. With regards to the verification of the debt, the Firm provided the following. ITEM ONE ( 1 page ) : A letter from the XXXX ( my insurance company ) DENYING any and all coverage against the claim filed by the Firms client ( XXXX ) implicating the claim raised by XXXX turned out to be FALSE AFTER INVESTIGATION IS CONDUCTED ITEM TWO ( 10 pages ) : A random automobile repair bill written for a person named XXXX, XXXX ( possibly XXXX insured ) for a XXXX XXXX XXXX, with NO INFORMATION PROVING THE DOCUMENTS RELEVANCE TO ME. ITEM THREE ( 2 pages ) : A bill from a rental car company, XXXX XXXX, for a vehicle rental by the person, XXXX XXXX, again with NO INFORMATION PROVING THE DOCUMENTS RELEVANCE TO ME. The ITEM ONE, the letter from the XXXX, clearly states that the incident occurred on XX/XX/XXXX is not applicable to my auto insurance policy and hence denied for any and all coverage. In addition, in the letter from the XXXX which the Firm itself has provided to me, the date of the incident shows a different date from the Date of Loss the Firm has specified in all their letters. Both of the above facts, along with the fact that the Firm retained the copy of this letter from the XXXX, indicate the Firm KNOWS or SHOULD KNOW the debt they made the accusation against me is FALSE. This is clearly in violation of the FDCPA and the FCRA rule. More importantly, it can be inferred that the XXXX already had, or was able to get, the information about my auto insurance policy from the Firms client, XXXX, or by directly contacting my insurance company, XXXX. Hence, it can be further inferred that Firms first letter dated XX/XX/XXXX, WHICH DID NOT DISCLOSE THAT THEY ARE THE DEBT COLLECTING COMPANY AND THAT THE PURPOSE OF THE LETTER IS TO COLLECT THE DEBT, INTENDED, PURPOSELY, TO DECEITFULLY LEAD me INTO providing my insurance information so the Firm can use it against me to collect the debt I DO NOT OWE. I allege that this is an UNLAWFUL activity committed by the Firm which allegedly practices law, or a MALPRACTICE at its minimum. ITEM TWO and ITEM THREE, as I stated above, appear to be random bills which DO NOT SHOW ANY INFORMATION PROVING THE DOCUMENTS RELEVANCE TO ME as the person responsible for the debt the FRIM is trying to collect against me. Even if the documents provided by the Firm as the verification of the debt indicate the exact opposite, in that the debt is falsely imposed against me, the Firm still tries to induce me to make a payment stating Attached is the verification that you requested. The balance of {$1300.00} is now due and payable to our office. Contact our office immediately for remittance instructions. In response to the Firms third letter dated XX/XX/XXXX, I have mailed a certified letter, with return receipt, to the Firm on XX/XX/XXXX. In the letter I have advised that the Firm is violating the FDCPA and the FCRA if they report a debt that they know or should know to be false. I have also provided the copies of my response letter to the Firms client, XXXX, and the XXXX. However, not all the information I have stated here is provided to the Firm, especially the speculation of the possible break of law by the Firm, which I am in the process of having the case reviewed by the States regulatory commission and the States Attorney Generals office. It is in this stage I am respectfully submitting this complaint against the Firm for your review and consideration. I have attached all correspondences between the Firm and myself, and the letter from XXXX to XXXX ( ITEM ONE ) to facilitate your investigation process. The ITEM TWO and ITEM THREE are not attached due to the large number of pages ( 12 ) and, more over the documents irrelevance to me. However, they can also be provided if needed and upon your request.

The main reasons for my complaint are described in the fourth and fifth paragraphs below. On XX/XX/2018, I received a letter, dated XX/XX/18, from Jonathan Neil & Associates , Inc., XXXX XXXX XXXX, XXXX XXXX, XXXX CA XXXX, telling me I had seven business days to respond to the letter or they " may request SUSPENSION OF YOUR DRIVER 'S LICENSE, and also REMOVAL OF YOUR VEHICLE LICENSE PLATE REGISTRATION .... '' The letter also indicated an auto-insurer 's claim number and an amount of damages. The contact person listed was XXXX XXXX, at extension XXXX. The letter I received concerns an automobile accident in which I was involved in XXXX of this year. The matter was resolved by my auto-insurance company. I do not owe any money to anyone from this incident. Later on XX/XX/XXXX I faxed a copy of the letter to my auto-insurance company. On Monday, XX/XX/XXXX, my insurance company emailed me a copy of a letter that they had faxed and mailed to Jonathan Neil & Associates asking them not to contact me anymore and to contact them if they continued to have any concerns. Also on XX/XX/XXXX, I received a voicemail at my home at XXXX XXXX from XXXX XXXX telling me it was " imperative '' that I call him before the end of the day about an important matter. The number he left for me to call was XXXX, extension XXXX. The main reason for my complaint is that also on XX/XX/XXXX I received an email from my elderly mother-in-law who lives on the opposite side of the country from me. In that email and a subsequent phone call, she told me she had been awakened from a nap by a phone call from a man who I assume was Mr. XXXX, asking to speak with me. She said I wasn't there. He asked her for my cell-phone number. She said she didn't have it. When she asked him what the call was about, he said it was a " private '' or " personal '' matter. ( She's not sure which of those words he used. ) He asked her to tell me to call him " today. '' She doesn't have the name of the person who called, but the number and extension he left with her match those of XXXX XXXX that were left on my home voicemail that day. I do not know how Mr. XXXX found a connection between me and my mother-in-law and then found her phone number, but I assume it was through some internet sleuthing. I am furious that he called her at all, and that he disturbed her rest, and that he caused her worry. She had no knowledge of the incident about which he was trying to contact me. He never should have contacted her. To top it off, on XX/XX/XXXX I received another letter from Mr. XXXX, dated XX/XX/18, identical to the one he sent on XX/XX/XXXX and containing the same threats about my driver 's license and license plates.

Received letter from XXXX XXXX at Jonathan Neil & Associates on XX/XX/2018 indicating I owed {$2400.00} in damages from a hit and run that I was not involved in and in a car I did not own. The letter was non-specific other than a date and dollar amount. There was no invoice or proof provided. The letter was not sent by certified mail. The letter was dated XX/XX/2018. The letter was postmarked XX/XX/2018. Six attempts were made to contact XXXX XXXX at the number provided on letter on XX/XX/2018 but there was no answer. A message was left requesting a return call to explain above information. A return phone call was received on by phone with XXXX XXXX on XX/XX/2018 from a blocked caller. The caller ID indicated Unknown. XXXX XXXX accused me of rear ending a car and they are seeking payment from a unspecified California association. I asked what is part of their information obtaining process and if a police report is a part of that. She indicated that they had it. I explained to her that I did not possess this car on the date that was indicated on the letter and the police report would indicated that I was cleared because I did not own the car. I inquired what bar associated they are affiliated with. I was not given a response. She said she was going through 100 pages. I requested she call me back when she has all the facts because I was at work. XXXX XXXX told me that I was being snotty and that she was trying to help me. I made mention of them sending legal documents by certified mail as I received the letter XX/XX/XXXX and the letter provided only 7-days to respond. XXXX XXXX continued with derogatory comments and I told her i would be getting off the phone. I received, again, another call from a blocked number and caller indicated it was Unknown on XX/XX/2018, again, while I was at work. She was seeking payment for the hit and run she was accusing me of. I asked if she remembered the previous conversation we had. She said, how you sold it? I replied yes. She said she ddint have any proof of that. I indicated to her that I did not feel like she was legit and that I did not feel like she did her due diligence even if she is. I told her I was hanging up now. After the first call, I contacted my insurance company. I was instructed by a licensed agent in Oklahoma to not provide my insurance information and that it is the dealierships responsibility to transfer necessary documentation to the new owners. Below are the provided documents, including the copy of emails between myself and Sgt XXXX with the Hit & Run Division clearing me of any involvement.

HELLO Since XX/XX/XXXX I changed my company to follow you, an XXXX executive told me that at any time I wanted, I could change without problem and after a year and a half of being with them I decided to change, the policy payments were in automatic to my bank account. From those dates I changed my address and did not notify the XXXX of the change because I no longer had any dealings with them. Since that date I was covered by auto insurance with XXXX ( my new company ). A few days ago they told me about the previous address that had some letters and I went for them realizing that they already had me in a collection because I owed XXXX, ( I had not found out about all this until a few days ago ) I am not refusing to pay what that is owed but it is not fair that they send me to collection without first notifying me of my debt. I also do not understand why the XXXX, having direct payment to my bank, did not charge the month and a half supposedly due if the direct payments are canceled in XX/XX/XXXX, and I do not agree, it is unfair that they want to charge me for a coverage that I did not want nor was it necessary since since XXXX I left the XXXX I was with XXXX, this new car insurance company, they assured me that when acquiring the new policy between the insurers there is communication to know the changes and it is not necessary for me to be communicating to the XXXX this change. The XXXX were so aware that they sent my bank a notification of the change in auto insurance company. As you will realize, these people are acting fraudulently, because they have no reason to send me to a collection and harm my credit if I never fail with the payments, I only decided to change the company to suit my interests and it is completely legal. I was involved in a motor vehicle accident in late XXXX of 2020. I was the driver at fault, and in XXXX, my insurance company reached a settlement with the other party 's insurance company. I received a letter from an unknown debt collection agency named " Jonathan Neils & Associates, Inc '' in late XXXX. In the initial letter, it stated in large print : " SEVEN DAY NOTICE '' regarding an accident in XXXX. I initially thought that it had to do something with the accident I had in XXXX. It stated that I owed " {$1600.00} '' in remaining damages to an insurance company I had never heard of in my life. I told JNA that I did not have that much money, that I am low-income, that I am too young and a XXXX XXXX. They sent me a " contract '' to sign and pay {$140.00} a month, so I made my first payment of {$140.00}. After further analysis with my insurance company, they said that the claim was settled a long time ago and that I had no liens or debts charged against me. I even faxed JNA the property release form and they claimed that they " did not understand '' what it was about. I realized that JNA was a fraudulent debt collection agency and that I wasn't the only victim in this. Several others fell victim to this agency as I was looking at the reviews of JNA online. I talked to my legal provider and I had them write a formal cease and desist letter for them to refrain any contact with me and to drop all " charges ''. Their claim number and stories were bogus, and when I called them, they switched their stories from one insurance company to another. None of their information was true. I want this agency to be held responsible for their federal crimes. These people almost made an XXXX pay almost {$2000.00} to pay for nothing. Unbelievable people that exist.

I received a letter dated XX/XX/23 from Jonathan Neil & Associates , Inc. XXXXXXXX XXXX XXXX XXXXXXXX, CA XXXX. I am writing to file a complaint against Jonathan Neil & Associates , Inc. for violating the Fair Debt Collection Practices Act ( FDCPA ). Specifically, I am concerned that the company failed to meet the FDCPA notice requirements in its attempt to collect a debt from me. On [ Date ], I received a notice from Jonathan Neil & Associates , Inc. regarding an unpaid balance due on my policy with XXXX XXXX XXXX. The notice failed to include the mandatory " tear-off '' dispute form required by the FDCPA, which makes it difficult for me to dispute the validity of the debt. Additionally, the notice did not provide me with detailed information about the debt, including the amount owed, the original creditor, and any proof of my agreement to pay this debt. I have already sent a dispute letter to Jonathan Neil & Associates , Inc. regarding the validity of this debt, but I have not received any response to my request for validation of the debt or the " tear-off '' dispute form. Therefore, I am filing this complaint with the CFPB in hopes that your office can intervene and require Jonathan Neil & Associates , Inc. to meet the FDCPA notice requirements. I am also concerned that the company may be engaging in other unfair or deceptive practices in its attempt to collect this debt. I request that the CFPB conduct a thorough investigation into Jonathan Neil & Associates , Inc. 's debt collection practices and take appropriate action to protect consumers. I joined the military and was unable to receive mail for 5 months and in this time I did not get any notification that I had a debt to be paid to Jonathan Neil and associates. During this time I was in the middle of an address change and started basic training. this means I did not have access to electronics of any kind or my home mailing address for 5 months at the 6 month mark of me being in the military I was finally notified by dot of Washington state that my license was being suspended due to unpaid debt towards an insurance company. This was the first I heard of this debt and even though I contacted Jonathan Neil and associates immediately after being notified by XXXX Jonathan Neil would not take the license suspension off my license with a payment plan in motion. By this I mean I already signed documents stating I will pay XXXX a month to this debt until it is paid in full with XXXX payments completed and a down payment. I have now paid off XXXX dollars of the XXXX owed. They will still not release the suspension. As my intention was never to run away from this debt I have consulted base legal to discover that this is considered very uncommon and before legal action is taken on my behalf the cfpb should be utilized first. I now have to repay for my license, motorcycle endorsement and will not be able to get a job in the automotive industry due to my now present negative driving record as I had before I joined due to the simple fact that I did not have access to my mail.

This debt is in regards to my XXXX vehicle insurance and assigned to a collection agency. On XXXX/XXXX/XXXX my vehicle was recovered by the lender because I was no longer in a financial position to pay as I lost my job around XXXX of XXXX and I began to receive unemployment benefits. I called XXXX to cancel my insurance policy and remove me from the recurring payment system but it seems that they failed to do so. I also moved from the home XXXX had on file. My home address was never updated either even though I called a local XXXX office to make them aware of a change of address. Recently I started to receive all the mail that was being returned to XXXX. If they would have updated my address I probably would n't owe the amount the collection agency is attempting to collect. The collection agency is attempting to collect a debt that is not valid. My XXXX XXXX XXXXXXXX XXXX was no longer in my possession, therefore, I did not need coverage. I made XXXX aware of my vehicle being taken away from me and requested to remove this vehicle from my policy. According to XXXX I am being charged all the way to XXXX XXXX XXXX but my vehicle was taken XX/XX/XXXX. I should not have to be responsible for insurance coverage on the XXXX XXXX XXXX. I need assistance resolving this matter with the collection agency.

To whom it may concern, I am being charged twice by a company which is attempting to collect a debt. They said I did not pay a bill to XXXX. I had been a long-time customer with XXXX and I gave notice to cancel my car insurance some time around XX/XX/XXXX in XXXX prior to moving to XXXX full time. To my knowledge, after cancelling with them, I never received any further bills from XXXX. On XX/XX/XXXX I received a notice from : XXXX XXXX XXXX XXXX XXXX. XXXX XXXX XXXX, CA XXXX XXXX ( they dont answer their phones I left many messages explaining I never received a bill. Since I live in XXXX, I did not want to hassle with this nor did I want anything to effect my credit rating in the states so I and went ahead and paid {$69.00} ( which is what they claimed I owed ) on XX/XX/XXXX. I used my XXXX XXXX XXXX. They cashed it *see below and then, they recently sent me another notice to pay them the same debt. They sent that notice on XX/XX/XXXX. In 2021, I gave my XXXX XXXX to my partner 's brother. The title and registration were transferred to my partner 's brother in his home state. Later, my partner 's brother got into an accident and a file was claimed. I have confirmed with the XXXX that the XXXX was not in my name at the time of the accident. The XXXX was never, at any point, registered under my partner 's name. Since then, my partner has been sent to collections and he has been sent threating letters from Jonathan Neil & Associates claiming they will attempt to have his license suspended. We contacted XXXX XXXX from Neil & Associates, but he attempted to place the onus on us to ensure my partner 's brother pays his debts. He blatantly stated that there was no point in us calling and did not state that his firm would stop pursuing legal action. We have contacted our own insurance company, the insurance company used by my partner 's brother, and the insurance company of the person who filed the claim against my partner 's brother. On Saturday, XX/XX/XXXX, I received a letter from John Neil and Associates, Inc, a debt collector, attempting to collect a debt stemming from an auto accident the company states I was involved in. I have been continuously insured with my insurance agency for years, with no lapse in coverage. I have never been the involved party in any auto incident, nor have I ever been ticketed or cited for traffic violations. In said letter, they threaten to " review the case '' and seek judgment with the State of Kansas to suspend my license for damages relating to said incident. In the letter that was sent, no mini-Miranda can be found anywhere stating that the communication is from a debt collector. On Monday, XX/XX/XXXX, I received another letter, this time from the " Law Offices of XXXX XXXX XXXX, XXXX '', with a return address listed as a private residence in XXXX XXXX, California. The letter is *exactly* the same as the previous letter, albeit supposedly coming from a different law office. This second letter also does not disclose that the communication is from a debt collector.

XXXX Johnathan Neil & Associates, IncXXXX sent a claim to my step son in the form of a letter that states he owes {$3900.00} in regards to a car accident last year. This firm stated that they would send/obtain a copy of judgement against our son. Our son is a minor. In addition they threatened to file suit against him. XXXX My husband and I on behalf of our minor son wrote back to Johnathan Neil & Associates that neither he or us owes this debt. I stated we would report this company to the FTC as well as the California State Attorney General if communication does not cease to exist. XXXX Our son received another letter from Johnathan Neil & Associates Inc. stating our dispute is invalid. In addition, there is a copy of a letter this firm wrote to the Washington State DMV asking administrative action to be taken against the " uninsured party '' .Also included in their accident report is clearly the name of the legal registered owner which is not our son. XXXX Our son wrote to Johnathan Neil & Associates stating he is not responsible for the debt.

They sent me a letter on XX/XX/2019 stating I owe them a debt. They have since been very disrespectful and harassing towards me. One specific person Mr. XXXX XXXX has told me on multiple accounts that he will have my drivers license suspended, that I am irresponsible, that I am a child, I am immature, I have poor financial responsibility. He is very rude. Today (XX/XX/2019) he called me 6 times from a blocked phone number. He left me an anonymous message stating his name and that he “suggests I call him back by close of business today” intending a threading “or else” message. I’m very sick of it. I tried to be kind and work out a payment arrangement with them and he has done nothing but make threats and be disrespectful and belittle be as a person. They should not even be allowed to practice given the fact that they have horrible reviews everywhere. Be aware of them! They are violation the fair debt protection act!

I received a letter from someone that appeared to be an attorney 's office ( Jonathan Neil & Asociates ) advising that I owe them {$1600.00}. The letter threatens to suspend my drivers ' license and vehicle registration. This is a fraudulent claim. I spoke to an insurance company previously and advised of what had happened and that I was in involved in an accident. They advised that they would be in touch. I never heard anything back and then received this letter from a company that appears to be a law firm threatening to suspend my license and registration. I have written them asking that they send any proof they have or do not contact me.

a ) The company that the firm represents had already collected via my insurer b ) Company have no license to collect a debt in this particular jurisdiction, nor any cause of action in any jurisdiction. It employs a scare tactic form letter. My wife and I called and made payments arrangements for {$100.00} per month until XXXX was paid. We received verification and acceptance of payment arrangements from Jonathan Neil & Associates in letter dated XXXX/XXXX/15. We mailed our XXXX payment on XXXX/XXXX/2015 and we received another letter dated XXXX/XXXX/2015 from Jonathan Neil & Associates with a new balance of XXXX. We believe this consititutes unfair practices because we made payment arrangements on one balance and after first payment, the balanced was increased.

Calling during work hours after stating that Im not allowed to accept personal calls during working hours. I 've given hours that he can call but does not call durning these times.
