I purchased a XXXX XXXX XXXX from John Gibson Auto Sales, a buy-here-pay-here dealership located in XXXX XXXX, XX/XX/XXXX in XX/XX/XXXX. This vehicle was financed by XXXX XXXX, which is the finance company that owns this dealership. The total cost of the vehicle was {$27000.00}. The terms included a down payment of {$2700.00} and remaining balance of {$24000.00} was financed over 60 months. Approximately 2.5 years into this contract, I received a call from XXXX XXXX asking for proof of insurance. I was at work and I advised them that I did not have this information available. I had not had to provide this information previously, because this finance company had always verified insurance information directly from the insurance company. I added my wife 's name to the insurance policy and was unable to drive the vehicle personally due to medical reasons. My wife drove the vehicle periodically and I continued to make every payment on time. In XXXX, XXXX, without notice, my vehicle was repossessed by John Gibson Auto Sales, even though the payments were up to date. I contacted the finance company the next day. I found out that the vehicle was repossessed because of their inability to verify the insurance. I informed them that the proof of insurance ( a copy of the policy ) was in the glove compartment of the car. Even though the payments were up to date, the finance company advised me that I would have to do a new credit application in order to get the car back. I went to the dealership on a Saturday and was told that they were too busy to do " any kind of renewal application over the weekend '' and I needed to come back during the week. I was allowed to submit my application online, the next step was for them to verify the credit application before releasing the car back to me. I called the dealership back a few days later to check status on the credit application and was advised that the vehicle had been sold at auction. Approximately one month later, I received a letter from the dealership requesting payment arrangements from me for a final balance on the contract. This vehicle, a red XXXX XXXX XXXX XXXX XXXX : XXXX ) was seized from my residence, XXXX XXXX XXXX XXXX, XXXX XXXX, XX/XX/XXXX, in early XX/XX/XXXX. At the time of the seizure, monthly payments were current on the vehicle and the automobile was insured by XXXX XXXX ( documented ). As a condition of return, you requested a copy of my bi-weekly paystubs, a copy of my residential lease and new loan application. These items were forwarded to you on XX/XX/XXXX at XXXX XXXX ( documented ). Prior to this most recent correspondence from you, I received a letter from you indicating the remaining balance on the vehicle to be less that {$1800.00} and according to your letter dated XX/XX/XXXX, I am given fifteen ( 15 ) days from that date to contact you to establish a payment arrangement for this remaining balance. Hi, the consumer went in back in XX/XX/2020 for a consumer credit transaction with John Gibson Auto Sales. I went in going for a car and left with a debt. I was directed to pay a down payment of 2200 $ in cash and I had a deferred down payment of 500 $ to pay as well in a later date. On top of that my amount financed would be XXXX XXXX This was a violation of my consumer rights pursuant to 15 USC 1605 " the finance charge in connection with any consumer credit transaction shall be determined as the sum of all charges '' This was also a violation of consumer rights pursuant to 15 USC 1605 " the finance charge does not include charges of type payable in a comparable cash transaction. They also violated my consumer rights pursuant to 12 CFR 1026.2 ( 18 ) " A deferred portion of a downpayment may be treated as part of the downpayment if it is payable not later than the due date of the second otherwise regularly scheduled payment and is NOT subjected to a finance charge. I have also have yet to receive any direction on how to receive any notice in regards to my right to recession. This is a violation of my consume rights pursuant to 15 USC 1635 ( a ) " the obligor shall have the right to rescind the transaction until midnight of the third business day following the consummation of the transaction or the delivery of the information and recession forms required under this section together with a statement containing the material disclosures required under this subchapter, whichever is later. The creditor should also provide, in accordance with regulations of the Bureau, appropriate forms for the obligor to exercise his right to rescind any transaction subject to this section.

My husband and I purchased a truck and camper trailer from John Gibson Auto sales in XXXX AR. My husband was laid off work a few months later and we were unable to make the payments. The truck and camper were repossessed. On XX/XX/XXXX I called John Gibson Auto and asked if they would be willing to settle up our debt with less than full balance and report as such to the credit bureaus. They were willing to work it out with us. The same day I paid the amount we settled on with my debit card over the phone. I received the receipt and letter stating the agreement. I went to our local bank to obtain a loan in XX/XX/XXXX the debt was still showing in our credit. I spoke with John Gibson auto at that time, they agreed to fix the problem. I found it was not correct again on my credit and filled a dispute with XXXX. Again in XX/XX/XXXX we find the same information on our credit report. I reached out to John Gibson Auto again they said the issue had already resolved. XX/XX/XXXX issue is found again on credit report. I have spoke with John Gibson Auto, ( XXXX XXXX ) she said the issue was being resolved. XX/XX/XXXX I received a alert from XXXX XXXX telling me I had a missed payment on my account with XXXX XXXX XXXX which is the finance Co used by John Gibson Auto they are a buy here pay here auto sales. John Gibson and XXXX XXXX are both listed on my credit and only XXXX XXXX on my husbands credit. I spoke with XXXX on XX/XX/XXXX so the issues could be disputed once again. I called John Gibson Auto on XX/XX/XXXX and was told nobody was in the office to take my call I should call back on Monday.

John Gibson Auto Sales XXXX XXXX XXXX XXXX XXXX AR XXXX XXXX I filed a XXXX XXXX Bankruptcy in XXXX listed John Gibson Auto Sales as a creditor. John Gibson Auto Sales credit account was not reaffirmed nor did the company show up or file a motion to take the vehicle back into its possession. My XXXX XXXX bankruptcy was discharged in XXXX XXXX John Gibson Auto Sales is continuously reporting the account as a current account to the credit company XXXX XXXX as 60 days past due. The account was paid in full in XX/XX/XXXX by insurance company, XXXX resulting from a car accident which the vehicle was totaled out, zero Balance. John Gibson Auto Sale is committing fraud by report incorrect information to the credit company XXXX XXXX on purpose. The account had been disputed several times and John Gibson Auto Sale report the same information. In XXXX, John Gibson Auto Sales report false information to another Auto Dealership by reporting the account was reaffirmed in the XXXX bankruptcy when in fact it was not. John Gibson Auto Sale admitted the error after the damage was done by nor being able to submit a sigh document affirming the account.

I went to XXXX XXXX in XXXX XXXX XXXX a week prior before purchasing a XXXX XXXX XXXX when I made it I was looking for a suv the salesman there said they really didnt have a selection but he remembered he had 2 XXXX in the shop and wanted me to go take a look I asked what was they in the shop before I went to look so they told me it was in the shop because of the radio thats it so Im like ok well when will it be done they told me in a week so I came back on XX/XX/XXXX and purchased the vehicle for XXXX so a hour into me going home the vehicle started jerking would change gears speed up slow down so i called the salesman and he told me that they would pick the vehicle up and fix it yesterday XX/XX/XXXX was the day they could pick it up a month later so I called to see did they find out whats the problem and they informed me that the transmission is no good and the auto company will not fix it or refund me no money at all.

I wrote John Gibson Auto, to let them know I recently noticed late payments on my account that I did not approve, also let them know I went over my contract and never opted in to anything to be reported. 15 USC 1681 stats a consumer reporting agency can not furnish an account without my written permission. 15 USC 1681 a # 2 consumer reports SHOULD NOT INCLUDE transactions or experiences between consumer and person making the report. Most importantly reporting an account as late that I never even receive statements for, because that would be mail fraud and they know all debts are an obligation of the UNITED STATES per HJR 192 of 1933. My car was paid in full when I signed my signature.

I SENT THE CREDIT BUREAUS AND XXXX XXXX MULTIPLE OF DISPUTES ASKING FOR VERIFICATION OF ALLEGED REPO THAT THEY ARE REPORTING ON MY XXXX ACCOUNT. I have tried to contact company and resolve the issue and they are refusing to resolve. The agent have also been very disrespectful and rude. I have tried to resolve and they are refusing to acknowledge the request. Why are they put this on my credit XXXX, and can not verify that this is me? I want this removed immediately. There was a hard inquiry on my credit by XXXX XXXX XXXX XXXX out of XXXX XXXX Arkansas. I did not give them permission nor did I sign any documents giving them consent to rum my credit on Thursday XX/XX/2018. This is unlawful and I want this reported from my report ASAP.
