Hello my name is XXXX XXXX, In XXXX, I opened an account for a XXXX XXXX issued by XXXX XXXX XXXX XXXX XXXXXXXX and XXXX XXXX XXXX. After making all payments on time, I fell behind on a few and had a balance of {$780.00} as of XX/XX/XXXX. XXXX wanted a minimum payment of {$300.00} and I informed them I could not make that payment. I received a call from a women named XXXX and she was my case manager for XXXX, and she offered me a settlement offer of {$620.00} in two payments of {$310.00}, and i accepted the offer. She gave me a confirmation. number of XXXX, and i sent in two separate money orders for {$310.00} each. She said once she received both payments my account would be considered paid in full and closed. Fast forward to XX/XX/XXXX, XXXX I am sent a letter from a collection agency called XXXX XXXX claiming that I owe {$470.00} to XXXX XXXXXXXX XXXXXXXX XXXX XXXXXXXX and XXXX XXXX XXXX from XXXX XXXX XXXXXXXX XXXX The letter says XXXX XXXX XXXX has placed the above referenced account with our office for collection. They have date of last payment as XX/XX/XXXX. As the letter stated, I had 30 days to dispute this claim and i did just that. I called XXXX XXXX and explained to them that I had accepted a settlement offer form XXXX XXXX in XXXX and paid the {$620.00}, and I do not owe the {$470.00} they claim I owe. They would not take this message as the answer and kept on harassing me. On XX/XX/XXXX, I wrote XXXX XXXX a cease and desist from contacting me letter, and in the letter, I also wrote that if XXXX forwards or returns this supposed debit to another company they need to inform them to cease and desist any kind of contact with me as well. XXXX XXXX ignored my cease-and-desist letter by turning over this ridiculous and false claim to a collection agency called XXXX XXXX XXXX, XXXX, who continued to try and make me pay the {$470.00} that I do not owe. I called XXXX and informed them as well that I had settled this matter in XXXX and I do not owe any more money. XXXX XXXX XXXX eventually stopped contacting me until they turned me over to yet another collection agency. On XX/XX/XXXX, I received my first email from the collection agency XXXX XXXX XXXX XXXX A person named XXXX says they were hired to collect on my XXXX XXXX Credit Card balance. This account was originated by XXXX XXXXXXXX XXXX XXXX XXXXXXXX and the current creditor is XXXX XXXX XXXX. XXXX are still trying to collect the {$470.00} for the account ending in XXXX. Now I have been dealing with this issue that I was told was concluded in XXXX of XXXX, and I need your help in bringing this issue to a close. I do Not owe {$470.00}. Thank you for your time, XXXX XXXX

My name is XXXX XXXX. I am a real person. I am not a credit repair team. I have been handling my responsibilities and Ive come across people that have made it harder for me by violating my federally protected rights. Ive been harassed, threatened and violated by this company about debt that i do not owe. They have communicated with me without my prior consent through emails, mail, and calls. They have annoyed me. I sent a letter to XXXX asking for : Validation of the debtthat is, actual accounting. Verification of their claim against you ; that is, a signed invoice. A copy of the contract binding both parties ( you and them ), in a letter by Certified mail so that there is an independent witness to it having been delivered. In XXXX XXXX XXXX, I entered into a debt settlement arrangement for multiple debts via XXXX XXXX. Majority of my accounts are now settled and have been paid in full. Two accounts remain that I am paying via a direct debit from my account every two weeks, which is added to an account with XXXX, and from XXXX, they send payments to the two creditors that I have settlement agreements with. Both of these companies are reporting to my credit as being in collection and delinquent. However, they have been in a settlement and repayment status for over a year. Most recently, the larger of the two appeared on my credit report and caused an alert to come up at my job. I have tried disputing the information via my credit report, and I have also sent letters to the companies requesting that they cease reporting this information as it is inaccurate. It is quite frustrating to be doing everything I am supposed to be doing, holding up my end and making my payments to make these things right, only to be harmed and put under question in my career due to false information being reported. How can these companies claim I am not up to date, when I have a company submitting payments to them regularly? Even when I uploaded the proof that they are in active settlements to XXXX, the results remained the same. What is the point of me having been in this program for three years now, getting charged all this money every month, to be treated as if I have simply ignored the debts and be punished as if I blew them off when that is the farthest thing from the truth? I sincerely hope you can help me get this resolved. I am more than willing to escalate my complaints to the state Attorney General 's office as well if that can help me. I have attached a copy of my XXXX XXXX XXXX summary which I have highlighted the two accounts in question, one with XXXX XXXX XXXX, the other with January Technologies, which shows the original balances, the settlement agreements with fees and what I currently owe as of a week ago.

On XX/XX/XXXX I received an email from XXXX I had a loan with XXXX XXXX XXXX XXXXXXXX had sent the account over to XXXX. I was on a payment plan of {$62.00} 12 weekly payments starting on XX/XX/XXXX when I went and put in my debit card invalidated a XXXX cent charge, so the payments began on XX/XX/XXXX I thought I was on the right track and then. And the debit card I had on file last four digits XXXX. I had to cancel that card because it had gotten lost and I had to order a new debit card. Because of that I had a payment on XX/XX/XXXX. I had to skip that payment on XX/XX/XXXX to avoid the card getting charge because that card was already closed. I got the newdebit card on XX/XX/XXXX ending in XXXX. I tried to update it on XXXX but there was an issue with the website updating the debit card. I sent out an email and a representative from XXXX had reached out to me and said that there was an issue with the website and now I can update the new debit card. I updated the new debit card on file on XX/XX/XXXX. I checked back this morning and its saying the next payment is XX/XX/XXXX so Im assuming OK I have been on track so far. Find out what the balance is the remaining balance. Out of curiosity and an agent told me when I spoke over the phone that my balance is still the same and that nothing has been taken out and Im like how is that if I the debit card I had on file had no issues but I had to close that debit card because I had to get a new one because I lost it so I dont know whats been going on and Im in a bind already as it is and now its like I dont think thats fair so this entire time nobodys been charged and youre not charging I dont know whats going on here, but this is shady. I am in fixed income and Im barely making it.

About 3 months ago I started receiving text messages about a debt that was owed for an installment balance from a company called XXXX. I completed payments on an installment account back in XXXX of XXXX. I had not heard anything from this company since my last payment in XXXX. In XXXX of XXXX, I began getting text messages from a January Technologies from a Solutions Specialist named XXXX. I had never received a text from a debt collector, so I brushed it off as SPAM. The first email I received was XX/XX/XXXX, which I replied to XXXX and asked her what this debt collection was regarding, this representative did not reply. I got another email in XXXX of XXXX and followed the link to which it showed there was a balance from XXXX although this account was paid in full in XXXX of XXXX. I have my XXXX and my XXXX report that both verify the amount and payment was complete in XXXX of XXXX but XXXX says it was transferred in XXXX. At this point it is illegal to sell my information and report inaccuracies after the account was paid in full. This account was not charged off and should not have been sold without the company first reaching out to verify any additional payments. I sent a request to XXXX in XX/XX/XXXX asking for information and was told I no longer had an account with them so they could not help me. XXXX has illegally sold my information on an unverified account. This creditor has illegally reaged my account from XXXX. I have disputed this information and sent emails to both companies as this sell of information was illegal and not within limitations of my rights.

In 2023, I was notified by a company called January Technologies for a debt that was not mine. They kept emailing me and calling me, harassing me about payments that I did not owe.I sent a letter on XX/XX/2023 via email to the agency disputing the debt in question and requesting verification as per my rights under the FDCPA. According to my records, this letter was received by the office on the same day because they acknowledged it was received by the office and should have triggered the 30-day timeframe within which they were obligated to provide the requested verification. However, to my surprise, I received a response from your agency on XX/XX/2023, which is well beyond the 30-day period mandated by the FDCPA I sent a letter XX/XX/XXXX to ask for verification of the debt and where it came from. This delay in providing verification is not only a violation of the law but also raises concerns about the accuracy and legitimacy of the alleged debt. Additionally, it has come to my attention that there are strong indications of falsification of the debt by your chosen debt collection agency. The FDCPA explicitly prohibits debt collectors from using deceptive, unfair, or unconscionable practices when attempting to collect a debt. Falsifying or misrepresenting the existence, amount, or nature of a debt is a clear violation of this law. They have provided a log in lin which does not work. They have yet to provide information that is valid.

This debt collector engaged in abusive, deceptive, and unfair practices of the FDCPA which it prohibits. According to XXXX XXXX, January Technologies is the servicing agency and point of contact. XXXX XXXX/January Technologies furnished this account that we didn't agree upon, and I didn't sign an agreement on. A legal contract is signed by two parties, and I did not participate in any of it. The balance on my credit report is not the same balance that the original creditor is reporting. I had taken a loan from XXXX XXXX XXXX around XXXX. This loan was discharged in XXXXr XXXX bankruptcy. The company ( XXXX XXXX ) also received proceeds from the bankruptcy. They then sold the loan to XXXX XXXX, XXXX and they attempted to collect on the debt. I notified them server times that the loan was discharged in bankruptcy. I provided the bankruptcy case number with every interaction I had with them. I then just received notification from January XXXX XXXX agency that XXXX XXXX hired them to now attempt to collect on discharged debt. I also provided them with the bankruptcy case number. I then attempted to contact XXXX XXXX also on XX/XX/2024 and was unable to speak with anyone. I also called XXXX XXXX to attempt to contact their corporate offices and was informed that they no longer have the loan with them because it was sold to XXXX XXXX.

I have reached out to this company multiple times about this situation and at this point Im about to bring it to court. I have emailed and called informing them that I was not the one who signed up with their plan or whatever it is. I also told a week prior to that my personal information had got out including my social security number, phone number and email. I have did two forms now saying that someone stole my information and I spoke to a representative about it and they told me that it would be taken care of because I was able to prove it wasnt me because they didnt have my correct address. I stopped receiving emails from them after I did the second form and the man said the account would get turned off. So you guys need to stop associating me with whoever did this to me and reach out to the company.

Ok. So this original creditor was XXXX, I looked at the program and due to my health limitations, I seen it wasn't going to work for me. I have XXXX, and I have XXXX limitations. I emailed them, they wouldn't come up with a compromise, so now it is in collections with the company January. I have sent several messages to them about disputing and they say its a valid bill. I have deleted everything once XXXX would not work with me. I haven't received nothing in the mail. Until I started going through some of my email.. I have a lot. I can't get to. A-lot of junk email. And On top Of that, On XX/XX/XXXX I will be out of work for XXXX month due to XXXX. I have a lot of things I am trying to get done. I am living paycheck to paycheck. Like I said, I don't believe I should pay XXXX for a program never used.

In 2020 i sent a negotiable instrument to municipal credit union to settle a credit card debt for {$5200.00}. Which was settled, but XXXX XXXX XXXX sold the debt to January Technologies Inc. Then then contacted me by email to collect the debt again. I then sent a negotiable instrument for {$10000.00}. January Technologies Inc said it would take 45 days to process. About 35 days passed they sent me correspondence that they could not process the instrument and it was shredded. They did not have any authority to shred my instrument. 15 usc 1681 and 18 usc 2071. They have done unfair practices and have mutilated the instrument without my consent. The account has not been settled and they are stating i still owe the amount. XXXX was made to this company according to state law pursuant to UCC 3-603B.

The company January has started emailing me repeated threats in an attempt to force me to enter into a contract with them. I have never provided January with my personal and private information including email address, phone, or any information regarding my private credit transactions past or present. This is a formal notice of dispute and a cease and desist. I find this very embarrassing and humiliating to be contacted on my work email that are harassing. This is a violation of my consumer rights. Per the Heroes act, I should not be targeted, punished, or have my credit profile negatively affected by an agency who is clearly breaking my right to privacy.

Debt collection agency has called repeatedly alleging I owe money from various different loans pertaining to my social security number and has also mentioned same thing in an email. Unsure of how information was obtained in the first place, but I have made it very clear that none of this makes sense to me and to please stop immediately. Instructions have not been followed and harassment continues. I have even received text messages as well from them. XXXX/ seems to be an automated service, nonetheless bothersome. I would love some assistance to A. Get this information out of their hands and B. Harassment to stop immediately Thank you

On XX/XX/2022, I contacted XXXX XXXX for job search services. However, I was compelled to sign a contract halfway without an adequate explanation of their services in English, which is not my native language. The contract was for {$5900.00}. Subsequently, the welcome letter, when I finally saw it, was illusory, and contained a NON-DISPARAGEMENT clause. I have canceled and not used their useless service at all. While I was negotiating with XXXX XXXX and Affirm, I was eventually able to secure a 50 % refund on XX/XX/XXXX, but I still owe the remaining 50 % to a fraudulent entity from whom I did not receive any services.

On XX/XX/2022 I checked my XXXX credit report and noticed that I had a past due loan from affirm that was sent to collections. I did not take this loan out. This was fraudulent activity. When I tried to log in to XXXX, the account associated with my social security number did not reflect my phone number, email address, or physical address, but it used information associated with my ex-wife. I never received any notice of a debt accrued, nor did I receive information regarding my right to dispute the charges. I just caught the fraudulent activity today, XX/XX/2022 or else I never would have known about the debt.

Please see the attached letter regarding the account that is not mine due to identity theft. I have filed all of the necessary forms including the FTC online form and affidavit. This is all equivalent to a police report as well. This is my second request to you to remove these fraudulent accounts from all three of the credit bureaus before I take legal action. Send the validation of these accounts as well with your response back to this complaint. I want the account name, account balance, past due amount, and date of last activity verified and provided to me as well.
