I've filed a complaint regarding this loan before and was told that because the lender had moved to a different firm and the firm he was at was now out of business, that there wasn't anything I can do. I'm trying again here. The two horrible lenders are : XXXX XXXX XXXX # XXXX LENDUS and now at XXXX XXXX Mortgage XXXX XXXX XXXX # XXXX XXXX XXXX Both should be locked up! I closed on my home located at XXXX XXXX XXXX, XXXX, TN XXXX. When I closed, I was forced to use a stranger for my loan because the realtor here in XXXX wrote in the last counter offer that I must use XXXX XXXX, a lender with XXXX XXXX. Although this was illegal, my lender in CA told me to make him provide the same loan he had already prepared for me. I closed on my home on XX/XX/XXXX, for XXXX, and when I showed up to the law office to close, I noticed the interest rate was XXXX a point higher than I'd been provide in documents, I waited a Limestone Title and Escrow until the corrected paperwork was sent to the officer and we closed. That was the second XXXX XXXX, the first being that the Seller 's realtor thought he could force people to use his lender. The lender who put me in this horrible situation started off with me with a XXXX FICO Score and no debt, and I was bring XXXX with me as a down payment on my new home. The lender XXXX XXXX, at the time was the Area Sales Manager for LendUS in XXXX XXXX, CA. He looked over my credit and down payment and told me that he thought I should do a high balance, conforming loan, using all of my cash from my sale as the down payment, to get me below the XXXX, which I was told was the maximum for conforming loans in XXXX, TN. I closed with the XXXX XXXX, with XXXX so I didn't lose the house in the counter offer stage, and per XXXX XXXX 's recommendation. As per XXXX 's plan, after closing on the loan and buying the house, XXXX 's plan was to immediately take out a HELOC with all of our build in XXXX and use that to do some renovations. I reached out to XXXX after closing and confirm I cold start the renovations and he said yes, go ahead. I had XXXX weeks to complete the renovations before moving my family into the house and so off I went. A week in I needed to use my XXXX and XXXX XXXXXXXX cards to get kitchen cabinets and other building materials and I called him and he said, no problem. I just pulled you credit and its good and I will use this report for your HELOC. I charged XXXX for kitchen cabinets, and XXXX to get the contractor started. I thought everything was going great and house was moving along and I called XXXX to see how the HELOC was going and he said I can't do one for you in Tennessee. We are not licensed to do them there so go to your bank and get one. I soon realized that I was in trouble. I'd gutted the kitchen and master bathroom and used XXXX to get the renovation started. To make matters worse, when I tried to find a HELOC provider that I didn't know they told me an inspection would be required. But with the Kitchen and Master Bath gutted, we couldn't go that direction. XXXX stopped answering my calls and I stood him that he had gotten me into this mess that he had to find a way out for me. XXXX did he, I ended up borrowing from friends and family members to do a poor mans renovation to get the house prepared for a inspection. I'm sure you have heard this before. I ended up getting a cash out refinance from XXXX at an interest rate of 5.83 % in XX/XX/XXXX when interest rates were 2.65 %. My family and I were supposed to pull XXXX, then it dropped to XXXX, and then to XXXX and finally we got XXXX out of our cash out refinance loan. Our payment went from XXXX per month and now is XXXX per month. We were told that we didn't qualify for any of XXXX XXXX Financials programs because we hadn't missed any payments so XXXX told me to not pay XX/XX/XXXX, I didn't pay is and then the help they were able to offer increase my loan balance by XXXX dollars and took my interest rate and payment down to 5.45 % and my payment to XXXX per month. We struggled to pay back family and friends and to partially finish our dream home we just did what we had to do to get by. In XXXX on XXXX I switched jobs to make more money and I thought we might have a chance until and for the next year I just tried to get everything paid so I could refinance out of this horrible loan. My credit was hit with a few late pays due to the the new job and no commissions so it made refinancing impossible. Then Covid-19 hit and I lost my job, causing me to miss another payment. I got on track with payments and have now made them each month for 26 months but now my credit score is XXXX. This is because each month I have paid my mortgage, XXXX Mortgage assigns the payment to the month 2 months ago, and so I get charged a XXXX late fee each month and the report me 60 days late each month. I am trapped by these horrible people. At one point XXXX told me he was sorry, but he hasn't offered or helped me and my family out of this XXXX he created. On top of all of this, my loan allows high interest payments to the owner ( s ) of the loan, a sister company to LendUS and XXXX again is getting paid monthly out of my almost XXXX mortgage payment. I can't do a modification because they will add XXXX to XXXX to my principle, And the interest rate will not change. I can't take the balance I'm behind and split it to 12 months because it increases my monthly by over XXXX dollars and I can't afford it, and I can pay it off because I've used all my XXXX saving, regular saving and don't have the money to catch up the loan. Can anyone help. This is what XXXXXXXX XXXX XXXX looks like, when dishonest Lenders can XXXX over clients and have no remorse or responsibility for the damage they have caused. Please let me know what I can do or if there are programs that will help me. Make me believe in America again. Thank you,

I applied for FHA mortgaged on XX/XX/XXXX, requesting that the lender apply for the Chenoa down payment Assistance-Program.. The loan officer, XXXX XXXX ( XXXX XXXX LENDUS/AMERICAN EAGLE MORTGAGE, NMLS # XXXXNMLS # XXXX ), insisted that a VA Loan was the best option, with zero down. I kept informing her that I had reduced entitlement due to a previous foreclosure ; however, she insisted that the new VA program, granted me full entitlement to the Full County Limit, of {$510000.00}, even after I sent her my VA Certificate of Eligibility, showing prior usage and reduced entitlement. She informed me that she sent my info to the VA, and got confirmation of my full entitlement to the county limit of {$510000.00}. Lendus issued me a preapproval letter indicating a maximum loan of {$510000.00}. I signed a binding agreement and paid out {$550.00} for a home inspection, {$170.00} for radon testing, and {$3500.00} in earnest money. The lender order the appraisal which came back at {$460000.00}, {$1000.00}, above the asking price. Now the lender informs me, more than 35 days later, on the final day of my Financing Contingency, that the VA will not go the full amount of {$450000.00}, but only {$420000.00} with zero down, and that I will have to apply for a 2nd mortgage, or find another property. My real estate agent XXXX XXXX XXXX ) was at a lost for words, when she called him after XXXX on the last day of financing contingency, and asked if the seller would do a 2nd mortgage. However, the Lender informed me on XX/XX/XXXX, of the following : XXXX XXXX Fri, XX/XX/XXXX, XXXX XXXX ( 12 days ago ) to XXXX, XXXX, XXXX, me, XXXX XXXX afternoon, Giving quick a quick Friday update on your loan status. Your loan is conditionally approved and the processor will be working with you on your clear to close. I will be getting with you on your final cash to close as well. Please let me know if you have any questions. Thank you, Then my Real Estate Agent contacted me, stating ; I contacted XXXX yesterday for the official decline letter. The letter that she sent was just a summary on a letterhead. I do not want the agent/seller to dispute the validity of the letter so I requested the official letter of Statement of Credit Denial, Termination or Change. We have 7 days to provide it to the seller but if she doesn't give me one today, I'll send them what she gave us. Just so you know I did send the denial letter as requested asap and I did correct the letter to show that you were not approved for the loan amount that you requested, I am not sure what you are talking about as far a corporate! This email is completely inappropriate and unprofessional! Just so you know I did not send the 2nd letter corporate did as it was requested by your agent and a loan can certainly be denied for insufficient funds to close, you are way out of line! XXXX, do you have what is needed based on the correct letter of denial? XXXX XXXX Georgia XXXX XXXX The loan officer then sent me this email, indicating her incompetence, as follows ; XXXX XXXX Tue, XX/XX/XXXX, XXXX XXXX ( 1 day ago ) to me I am going to pay for the appraisal on your new home and give you a XXXX lender credit for this mistake! I sent the following email to the Mortgage Company 's agent ( XXXX XXXX ) ; Please consider your actions, as everything that has transpired is part of the record. Also, XXXX XXXX has informed me of the 2nd letter you sent, regarding me not having sufficient funds for closing, which is a lie, and a violation of Federal Law, in relation to VA loans. Furthermore, I know that you think that you're getting back at me for going to corporate on you, get over it, you little child ; in fact, I have already commenced legal actions against you, and everything you have corresponded, is part of the record. Also, my Agent had secured an additional {$2500.00}. in closing cost, to cover some minor items which came up in the inspection, so the total " Buyer 's Contributions came to, {$9600.00} ; ( see the attachments ). This entire process has been an illegal and fraudulent process, starting with you failing in your due-diligence in obtaining the correct VA entitlement amount, to process my loan application. Yes, I have your ore-approval letters and emails and text, which will establish your incompetence, along with other fraudulent actions and activities. Finally, you don't know me, or who you're dealing with, my background in these matters is extensive, you don't know what you're getting yourself, into, because that 2nd letter you sent to XXXX XXXX, was a violation of your oath as a State Licensed Mortgage Professional, and maybe a violation of the Law. I will send this to your corporate office, also ... The loan officer respond with a XXXX retaliatory email, as follows ; I feel unsafe and threatened personally by this email, I have contacted the law enforcement, to say to me in writing I dont know who you are and what you are capable of I feel very attacked personally! On XX/XX/XXXX, XXXX XXXX ( LendUs LLC ) wrote a pre-approval letter to us for a mortgage for a second home ( 56.7 % LTV XXXX. We signed a purchase agreement with the sellers on XX/XX/XXXX to purchase a condominium townhome. Closing was set for XX/XX/XXXX with a mortgage contingency deadline of XX/XX/XXXX. On XX/XX/XXXX, XXXX XXXX told us that the income reported on our XXXX Federal tax return does not qualify for the pre-approved mortgage. Instead, they recommended that we switch to an investment home loan at the same interest rate but with {$9400.00} in points. XXXX XXXX told us that if the appraised rental income were to exceed a minimum calculated requirement, then personal income would not matter and rental income would support the mortgage. We felt we were negotiating under duress and in a " bait and switch '' situation, but believed we had no other choice but to agree to the points. On XX/XX/XXXX XXXX XXXX told us that our revised loan was again ( pre- ) approved, pending the appraisal report. Due to appraiser delays, we had to extend the mortgage contingency deadline to XX/XX/XXXX. To get the sellers to agree, we had to forgo a negotiated seller closing credit of {$5000.00}. On XX/XX/XXXX, XXXX XXXX received the final appraisal report with appraised monthly rental income exceeding the required amount by {$220.00} per month. With three days to underwrite the pre-approved loan and a qualifying appraisal in hand, we felt that we were in good shape for closing on the transaction. On XX/XX/XXXX XXXX mortgage contingency deadline ), XXXX XXXX failed to complete the underwriting process and could not promise completion. We were forced to sign a purchase cancellation to protect our substantial escrow deposit. The sellers refused to grant any extension because they preferred to put the house back on the market at a {$30000.00} higher asking price. On XX/XX/XXXX, one day AFTER the mortgage contingency deadline, XXXX XXXX gave us a list of ALL NEW requirement requests related to business income and business checking accounts. It was clear to us that XXXX XXXX was no longer underwriting our loan as an investment loan, but as the original second home loan -- and keeping the {$9400.00} in points for themselves. On XX/XX/XXXX, three days AFTER the mortgage contingency deadline and three days AFTER the purchase cancellation, XXXX XXXX officially approved our mortgage. However, the sellers still preferred to put the house back on the market. We missed out on the house and incurred substantial losses ( actual out-of-pocket costs as well as lost income opportunity ) due to missing the closing. XXXX XXXX GUARANTEES " Home on time '' on their website but did nothing to help us, We did not even receive an apology or a " too bad. '' Their guarantee apparently has no value and is all marketing hype. We believe the transaction failed because XXXX XXXX shenanigans in sales/underwriting choose to try to keep the points for themselves and qualifying us for better mortgages while recklessly missing the clear and important deadlines. We now believe that such bait-and-switch shenanigans are the standard practice at XXXX XXXX ( LendUS LLC ). We wrote a XXXX letter to XXXX XXXX ( LendUS LLC ) CEO, senior counsel, and compliance director complaining and requesting compensation. Our letters and follow-up phone calls were ignored. In our opinion, XXXX XXXX is guilty of false advertising ( on-time guarantee ) and unethical, bait-and switch business practices. They should not have a license to sell or process mortgages anywhere in the US. Anyone needing a mortgage should AVOID XXXX XXXX ( LendUS ).

Hello, I recently closed on a home using American Eagle as my lender. Throughout the process, I encountered many headaches and what I believe to be clear TRID violations. Before making my final decision on what lender to go with I asked American Eagle to confirm what my interest rate and APR would be if I locked the loan at that time. After delayed responses from them, we agreed to lock the loan with an interest rate of 3.125 % and APR of 3.2 % with XXXX points on XX/XX/XXXX ( this is documented through email ). Despite my negative experience with them up to that point I decided to proceed with American Eagle as my lender because I believed with these loan terms and the builder 's incentive to go with them that they were a good deal. Unfortunately, when they sent the CD to me before closing they had reneged on our agreed APR of 3.2 %. The CD had an APR of 3.49 %, which is obviously not what we agreed to. When I asked them about this, they refused to honor the APR of 3.2 %. This was shortly before the closing and at that time it was too late to change lenders and close on time. Changing lenders and missing the scheduled closing date would have forced me to incur major extension charges. As I previously mentioned, I agreed to proceed with American Eagle on XX/XX/XXXX due to the APR of 3.2 % we agreed to lock at. Needless to say, Im very upset that they decided to not honor the terms they clearly agreed to. In the interest of closing on time and avoiding expensive extension charges, I decided to proceed with American Eagle despite their shameful behavior. Before closing, I informed them that I viewed them not honoring the 3.2 % APR as a breach of a legally binding agreement and that I planned to consult with an attorney and file a complaint with the CFPB after closing. I happen to work in the mortgage industry and noticed a few other things that I believe to be violations as well. Early in the process of applying with them one of American Eagles representatives ( XXXX XXXX ) discussed and negotiated interest rates with me via phone and email despite telling me earlier that she was not licensed to do so. Also, I believe they ordered the appraisal before I ever signed the intent to proceed. Although, I can not confirm this for sure since I do not recall for certain when or if I signed the intent to proceed and their system doesn't show this information to me. Also, we agreed to lock the loan on Saturday XX/XX/XXXX and they didn't actually lock it until XX/XX/XXXX. Its my understanding that this delay is a violation as well. Also, as previously mentioned, they reneged on the APR we agreed to.

My family and I will be moving to XXXX XXXX, CA near the end of the year ( XX/XX/XXXX- XX/XX/XXXX ) due to military orders. We started speaking with a local realtor who referred us to XXXX XXXX of the XXXX XXXX XXXX LendUS LLC in XXXX XXXX, CA. My wife clearly stated that we would not be moving or be obtaining financing until we actually make the move, dates previously stated. XXXX even confirmed that a hard credit inquiry for the purposes of securing a home loan would make no sense with us being 9-10 months away. My wife was merely calling to get an idea of rates and current market conditions. She did provide the financial information needed to run a report so that it would be on file. At no time did my wife authorize XXXX 's firm to run our credit, and it was clear on both sides that it wouldn't make sense this early in the process anyway. Upon hanging up, XXXX immediately ran our credit without permission. I was notified through credit monitoring services that I use. When my wife called to inquire, XXXX simply stated a ) that he assumed it was okay and b ) that I could just travel ( from Alaska ) to XXXX XXXX months ahead of schedule and buy a house. I'm not only cutting ties with XXXX as a lender, I've filed a dispute with XXXX, and am reporting this issue to you. I've put many years of energy and focus into building a strong credit profile, and reckless business practices like this work against all that effort. I have no documents to upload because this was all initiated by a phone conversation - nothing was filled out or signed. I submitted the application for a mortgage pre-qualification letter to the broker XXXX XXXX XXXX Highly of LendUs in XX/XX/2021. Initially she was very responsive. I told her that I viewed a property that I liked and wanted to know if it qualified for the loan. She completely stopped responding to my calls and text messages for three weeks. I even asked if she stopped worked at the company. Ive never had a professional person just disappear without any explanation in the middle of us working together. I later saw someone recommend her in a XXXX XXXX XXXX group and I responded in the comments that I had a poor experience with her. She heard about my comment and texted me that night saying sorry she couldnt help me. No explanation as to why she disappeared or that she even wanted to assist me. I told her that her apology was dismissive and she did not take any ownership for not responding for 3 weeks during a critical time and her conduct is very unprofessional. She wrote me back that she doesnt have to respond to me. As long as Im contacting her in an appropriate within the context of her job, I would assume that her employer requires that she respond to me as a potential client. Im a XXXX woman with XXXX credit score and XXXX XXXX salary. I more than qualify for most mortgage applications. I dont know if her actions had a discriminatory intent but I want to document this experience in case any other people of color experience this treatment from this mortgage broker.

I mailed in my mortgage payment XX/XX/2020 for initial payment to be applied XX/XX/2020 instead of XX/XX/2020. I have sent several emails requesting receipt and to acknowledge my request to apply payment XX/XX/2020. I called LendUS twice at XXXX XXXX XXXX and the response that I get is that the check has not been received and payment is not due until XX/XX/2020 ignoring my request to apply payment XX/XX/2020. I expressed my concern that the check mailed in XXXX was not received and Im expected to mail another payment for XXXX as there is no online payment process. The agent went on further to say if they receive 2 payments LendUS will apply one payment to the principal again ignoring my request for payment to be applied XX/XX/2020. All Im asking LendUS to do is to apply my payment sent XX/XX/2020

OnXX/XX/2018 I resigned as a Loan Officer with LendUS ( XXXX XXXX XXXX ). Per my Loan Officer compensation plan for 2018, I am due 100 % commissions for any loans closed within 30 days, for which I had 2. That equates to roughly {$10000.00} ( pre-tax ) owed to me before any deductions. I was due payroll payment today-XX/XX/2018, but did not receive anything. No information was provided either on the lack of payment. I did also notify the Labor Boards for both California and NH ( the state I work and reside in ) of this wage payment failure. 40+ other LO 's are also in the same horrible situation due to LendUS 's disregard to pay separated employees. We applied for a Mortgage Loan with LendUS starting XX/XX/2020 and we gave them everything they asked for and now it's time for our XXXX payment and they told us that we have to wait 15 days to sign loan documents which will make us have a late payment on our current mortgage. We asked why does it take 15 days when everything is complete. They told us Purchases take priority over refinance loans. That seems like discrimination to me. Whether purchasing or refinancing we both are customers so why are we treated differently. I just don't think it's right. Please advise.

We recently purchased an investment property in XXXX ( GA ) and got a conventional loan from LendUS , LLC ( through XXXX XXXX XXXX ). We have two complains to the loan company : 1 ) the loan cost was too high, there were clearly duplicating charges, see below : A. origination charge $ 2332.66 % point of loan {$0.00} Doc review fee {$690.00} Origination fees {$780.00} Process fees {$350.00} Underwriting fees {$500.00} 2 ) the loan officer was behind schedule, did not leave us time to question and shop around.

I was forced by XXXX XXXX realtor XXXX XXXX to use XXXX XXXX XXXX. I told XXXX I already had a mortgage company. she said if i didnt use XXXX XXXX, the builder wouldnt give me the contract. I used XXXX XXXX believing they would pay XXXX in closing cost. they didnt because my sscore was a XXXX. XXXX XXXX at XXXX XXXX has been close friends with XXXX XXXX. I feel their personal relationship affected me. I wasnt able to choose my lender. further more when i complained to XXXX she went back and told XXXX.
