What happened is my XXXX mother wanted to get her roof done. The house was paid for and was value at {$500000.00}. A flyer was put in the mail box from a contracting company ( XXXX ) and my mother called them. My mother entered into a contract with XXXX them to do her roof. Once the roof was done this is when the games began. The contractor told my mother that she did n't have to pay for the roof. He told her that President Obama started a program that senior citizens can get this work done and not have to pay for it, He said in fact they can also get paid if they enter this program. My mother was very bright but her eye sight was all but gone and her hearing was very bad. In fact the ear doctor want her to use a hearing aid but she just would not except that. The contractor told her he would get her the papers. My mother not able to see what the papers said call my sister to help her. My sister came down and these man told them that if she went into this program that she could not only get her roof paid for that they could do the hold house and she would not have to paid a dime. They told them that the program was called a reverse mortgage and that how it worked is that money would taken from the house and that it will not have to be paid back. He told them that when my mother passes that the reverse mortgage will then go to my mothers next child that was XXXX or over and lived in the house. He looked my sister in her eye and told her that when my mother passed that the reverse mortgage will then come to my sister and since she at that time was XXXX that she could live in the house until she passed and she also did not have to pay anything. He told them that my other sister who was XXXX and my brother who was XXXX who was all living in the house would be able to live out there lives in the house without paying anything under this program.
My mother at that age was taking care of my XXXX XXXX XXXX sister because she was in bad health. She was in and out of the hospital. She had XXXX. My brother had suffer XXXX and my mother was also taking care of him. When this man told her about this program that would guarantee her children would have a place to stay after she passed. All they would have to do was pay the taxes and the homeowner insurance she thought it was heaven sent. My mother believed them and enter into contract with them. The next thing you no is the contractor is redueing the kitchen the basement the front step the sizings of the house. The thing is that none of this work needed to be done and most of it was not done right. You can send a inspector and see for yourself. They charge my mother over {$300000.00} for this work. Every cent was taken out of the house. My mother passed XXXX XXXX, 2011. The XXXX companies that was involve in this from the start XXXX bank and J.B.Nutter have been trying to put us out the house ever since. XXXX XXXX who own the mortgage have foreclosed.
XXXX who was suppose to council my mother called her on the phone and my mother could not hear them. A My nephew just stop in and he took the phone to tell her what they was saying. He said that he did not understand what he was repeating. I have been told that when my mother could not hear on the phone that XXXX should have stop the counseling and counseled her in person. My mother and my sister was believing what these people told them and that why my mother took the reverse mortgage.
What i am trying to do is to get them to honor what they told my sister and my mother. Let my sister and brother who was XXXX was in the house when this all happened live out the rest of there live in the house. My sister in now XXXX and my brother is XXXX and XXXX of them is in poor health. I left my job XXXX to come back XXXX to take care of my mother because I realize that she could no longer continue.

I have tried twice since XX/XX/XXXX to refinance my loan. The first time they indicated I need to be at my job 2 years before I can apply for refinance. In XX/XX/XXXX I had completed two years of employment. I was out of work for 4 weeks from mid XX/XX/XXXX to XX/XX/XXXX. First 2 weeks I was out due to XXXX with no short term XXXX offered with my employer. The last 2 weeks I was out due to XXXX. I totalled my car in XX/XX/XXXX, rolling the car in an ice storm. I suffered back injuries and minor cuts and bruises. I missed alot of work due to my back injury. My refinance was denied. I have completely drained my 401k, currently had a {$200.00} balance. I explained all of this to my mortgage company. Not once was I offered forbearance. I was in tears by the end of the call. As I am single and can not get help from anyone.
I was fully vaccinated for XXXX in XXXX. I contracted XXXX a second time in XX/XX/XXXX.
These last two months have been even more difficult as I am without a car, due to mechanical failure. I owe the IRS over $ XXXX and am trying to file bankruptcy. But I don't have the extra money for any of this. A personal tragedy, my granddaughter was stillborn two weeks ago.
If my mortgage company would have offered a forbearance I would have been able to put some money back. I specifically asked if there were any programs available that could help me... I was not offered any of the available programs at the time. And of course at the beginning of the year my mortgage payment increased.

Currently on XXXX XXXX. This company has failed to : 1. Assess for loss mitigation after 4 months as required by HUD0 regulations.
2. Given erroneous and false information about loss mitigation that it claims I do not qualify for. I requested documentation- it failed to provide.
3. Refuses to correct my mortgage statement address despite repeated requests to change my address on the statement that is incorrect.
4. Refuses to provide loan reinstatement amount needed to bring loan current 5. Routinely provides inaccurate bank statements reflecting incorrect loan balances 6. Failed to give proper credits for money paid. Repeatedly attempts to steal money 7. After identification of accounting errors, continues to credit for incorrect amounts 8. Refuses to provide updated loan information requested by borrower 9. Refuses to specifically breakdown charges assessed for legal fees, late fees 10. Payoff information was requested last week, said it would take 30 days to provide payoff-information on the loan.
11. Fails to change mortgage statement address to give appearance that I do not live at my home. It has known since the inception of the loan my home is owner occupied and is my primary residence.
11. Bulk of its customers are XXXX XXXX its repeated abuses are outrageous and systemic. Denial of relief programs available to qualified customers is unacceptable. It exploits and cheats XXXX customers repeatedly without consequences nor repercussions.

XXXX XXXX, XXXX first communication was an introduction of who she was, her appointment, threat that she would be taking my mother 's property to sell, threat that if I do not agree with holding open house she would seek permission from a court to sell my property, threaten if I do not agree with her demands the house would be sold at a lesser price because of my non compliance and last she urged me to call her if I did n't want those things to happen.

my mother in law got an reverse mortgage in XXXX XXXX for loan was for XXXX which is alot more than the property is worth. well she was in her XXXX when she got this. she is now XXXX.she now needs her son and my help with her finances. XXXX XXXX claims they have sent her XXXX thats on paper that they send her each month.my husband, her son tried to get an 3rd party but XXXX turned him down. they gave no reason. we have power of atty, what we want to know is when did they send this money, how much each time and where were these checks cashed. also she was paying XXXX a month for house insurance. we are completely shocked at that.that house isnt worth XXXX,. we were going to sell it, but nutter is giving us trouble. they want XXXX for an appraisal on the house.the realtor had a buyer. what we want is 3rd party and an itemized statement of when where and who cashed them. mom doesnt have any money at all in her account. there is no way she could have spent that much. the realtor can only find XXXX he cant find about XXXX of the loan. he suggested we get an lawyer. i hope you can help her. she work all her life for that house and now she has no money to take care of her. she should have more than enough for the rest of her life.thank you

On XX/XX/XXXX I paid my XXXX 's mortgage payment at XXXX XXXX. I called the company to let them know that the payment was made as well. On the company 's website there's a statement " If you pay after XXXX XXXX. CST it will be considered late. '' However, the receipt they send seconds after submitting payment states it will be applied on the effective day or shortly after. The statement shows effective day as the XX/XX/XXXX. I believe James B. Nutter receipt showing effective date of the XX/XX/XXXX means that my payment should take effect for the month of XXXX. When I called on today, XX/XX/XXXX there was nan named XXXX ( who was rude ) that advised that it will go on my credit. I told him that I have paid after XXXX in the in XXXX and it did not. He then told me well if you made it a couples I can't help that, it's going on your credit today. This is an unfair practice by this company and they are choosing when they are wanting to place things on consumers credit reports. Also, the receipt does not have the statement of paying after XXXX. on it. I'm really needing help because the employees at this company are diffult to deal with and really rude. I'm attaching two payments where I paid after XXXX and have a couple of more.

At the beginning of obtaining this reverse mortgage my understanding was I was to pay the taxes of the property which I agreed to do. At the time, my property taxes were already behind and the default amount was not cleared or paid up current by the reverse mortgage company. What happen my default amount became an issue, because a clause of the reverse mortgage agreement states property taxes must be kept current which I was not advised nor aware of before I sign the contract, otherwise I would not have sign it.
Thus, the reverse mortgage company contacted the tax office and paid up the default amount fully on the property and provided me with a monthly repayment plan to repay them as well as the ongoing current amount, leaving me with XXXX tax payments obligations to handle, which became overwhelming to handle, considering the others house up keep that also must be kept up as well. I carried it for as long as I could until it became impossible to keep it up.
So this is were we are now. The reverse mortgage company has file to foreclosure on the property

James B Nutter reported a missed payment on my account for XXXX 2020. I disputed this missed payment because of military orders prevented me from sending payment in on time. I disputed the missed payment information and never heard from the bank until I sent an email to them asking what happened with dispute. The representative told me to send the military orders in via email and they will work on it next month. I did that, but then was told via email that the missed payment will stay and was given a link to a XXXX XXXX handbook that does not say anything. I asked what page or paragraph I should be referring to and no answer. They are treating me very badly. I know they broke the rule by not appyling within 30 days which I have email proof of. I will attach email showing that letter was sent to a random address and never picked up. I can submit military orders, but would do so in a more secure way. I will be going to XXXX/News Outlets as well unless CFPB can help me.

After speaking with a CFPB agent yesterday, XX/XX/2022, I asked the question ; Should I have been offered a formal written Forbearance Agreement in order to negotiate my delinquent mortgage payments instead of a general mutual acknowledgment of intent to sell the property on my own terms?
The conversation I had with XXXX XXXX XXXX in the loss mitigation Dept @ JB Nutter makes no mention of Forbearance, only relates to a Short Sale that is described in the attached paragraphs. This conversation took place approx 6 months prior to to the litigation filing.
The CFPB agents answer to me was YES, that should justify the filing of this complaint to the CFPB pertaining to this issue.
Extensions of time to file for pre trail hearing has delayed the litigation process for one year. I am not clear on exactly why these extensions of time were requested. It occurs to me that this delay is not related to any of my conversations with the bank, or my personal situation.

Debt collector is a replacement of a previous debt collector who withdrew from an illegal court action, after being demanded to validate the alleged debt in which they could not.
Present debt collector has not validated or verified the debt. I have repeatedly demanded validation and verification to no avail..
Debt collector has been demanded to cease and desist but continues to use private information, nonjudicial action to dispossess consumer of personal property, communicate harassing letters threatening to evict and take property, and mail communication with envelopes printed with law firms return address.
Debt collectors has been demanded and noticed of a lawsuit to compensate consumer for violation of FDCPA, till today I have not receive a response or any communication in regards to matter.

I have been trying for the past five to submit a request for assistant for my client who has a reversed mortgage with James B. Nutter & Company. I submitted all of the information requested by the Mortgage company including an authorization to release client information from my office. I was told that they would not use my Authorization, I have to use their own authorization. They forwarded to my their authorization and I completed. Thereafter, I was told that was the wrong authorization, to resend them a letter with my company letterhead that I represented the client along with the original authorization that I sent them the first time. Again, It has been over four months I am yet to be approved by James B. Nutter to get information on behalf of the client. At the present, the property is pending foreclosure.
