I submit my claim to XXXX about a predatory lender reporting an account as charge off and incorrect 28 late payments. XXXX have ignored all the evidence i had submitted in 3 different occasions.
Below a recap of the claim.
I am writing to inform you about an error I noticed on my XXXX credit report ( account number # XXXX ).
This item ISLAND FINANCE LLC # XXXX identified as an Unpaid Balance/Charge off is type is inaccurate. This account was paid accordingly to the terms of the loan.
On XX/XX/XXXX as I tried to make my regular monthly payment, I was advice to my surprise and knowledge that the account that was from Island Finance LLC # XXXX was charge off as bad debt on XX/XX/XXXX of XXXX by Island Finance LLC. This account was transferred from XXXX XXXX XXXX to Island Finance LLC and all payments were made by XXXX XXXX XXXX ' payment platform until XX/XX/XXXX as instructed by Island Finance LLC ( Attached emails with payment confirmations ).
When I called on XXXX, XXXX to make my monthly payment to XXXX that was provided to me when the account was transferred to Island Finance LLC that is not the same from Island Finance LLC, for payments, I am told that the account was sold to another company and that I should call the company # ( XXXX ). When I contacted XXXX XXXX XXXXXXXX XXXX on XX/XX/XXXX they claimed none of my information was on their system and I had to wait for Island Finance LLC to transfer the file. For around three weeks I called Island Finance LLC multiple times ( Mr. XXXX ) attended me most of the time ) to pay and the other company named XXXX XXXX XXXX XXXX and no one could take my payment because at Island Finance LLC the account was already closed and in the new company they had no record of my account, I request several times to talk with management and they reject my petition and never answered or called me back as requested on several occasions.
On XX/XX/XXXX the file finally arrived at XXXX XXXX XXXX and I was forced to submit the full payment in the amount of {$770.00} ( attached bank statement and letter evidence ). Finally, on XX/XX/XXXX I get a letter ( dated XX/XX/XXXX, a month later after they claimed to transfer the account to the new lender ) stating that the account was acquired by another company named XXXX XXXX XXXX XXXX. The letter in itself contains several errors. The first is that it indicates that " Transactions reflected after the date of loss : NA/NA '' ( attachment letter to record ). None of the payments made and debited from my checking account and with email confirmations apparently were applied. The remaining balance of payment of {$770.00} " at the time of loss '' is correct but reflecting the account as a charge off is incorrect and inaccurate.
This account had a monthly payment of {$180.00} when it belonged to XXXX XXXX XXXX, at the time of the account transferred to Island Finance LLC I still made the same payment, but, around XX/XX/XXXX, payments were adjusted by Island Finance LLC to {$69.00}. ( Attached credit report where it reflects the new payment ). This without any notice from Island Finance LLC to me. I then started paying that new amount and some months even higher amounts to speed up the payment of the remaining balance. I respectfully request XXXX for a thorough investigation of the account and that the following be provided expeditiously by Island Finance LLC : Detailed account analysis with statements and payments applied.

Apply all payments to the account made thru XXXX finance platform.
Correct XXXX XXXX credit report and report the account paid off and " good standing, without " write off '' or lost as recently reported.
As a financial institution Island Finance LLC is legally mandated to follow local and federal laws ( FCRA ) to correctly report on all credit agencies. In addition, they are required to follow the OCIF regulations for lending institutions and the Fair Debt Collection Practices Act.
I am requesting that the item be removed and corrected as paid and the account be reported as satisfactory.
Enclosed are copies of all my payments records, email to the Director of Risk ( XXXX XXXX, dated XX/XX/XXXX ) of Island Finance LLC submitting my claim to them, letters of paid off thru their unlawful debt collector ( XXXX XXXX XXXX XXXX XXXX XXXX ), bank statements reflecting all my payments that match the payment receipts and letter from Island Finance incorrectly charging off the account supporting my position. Please reinvestigate this matter and delete the charge off and correct the status of the account to paid as agree and satisfactory as soon as possible.

XXXX ) For 11 months they have not been applying any amount to the principal, they have been taking the {$170.00} payments and applying them all to interest. I tried calling the call center to request assistance, who told me i had to visit the offices. When i visited the offices they told me i had to call the call center. Which i did once again and in multiple instances. Then they said that this is due to the payment extensions ( They offered payment extensions for 3 months which I did in XXXX, XXXX & XXXX of XXXX ) this was offered because of the COVID emergency. I would understand if they did it for 3 months, but 11 months is basically a year which i have been paying only interests. Because of the emergency i did request the extensions they were offering because i could not pay for that months and i specifically requested to know what were the repercussions of getting these extensions and what they told me was that those months would just be moved to the end of the payments, so I would complete my loan payments 3 months after the original end date. If this situation is truly due to these extensions then they lied when i asked what the repercussions were for having them. This still would not explain why this has been happening for 11 months, which I believe is just stealing.
XXXX ) I asked for an amortization table which they provided and it clearly shows a difference on how the interests are supposed to be charged vs the interest they have been charging me. With these types of loans, payment amount towards interests go down and payment amount towards principal go up. This is not what they are doing and they sometimes apply a very small amount of the payment to the principal and the majority of the payment on interest. This way i will never complete payment on this loan. I have tried on several occasions to speak with someone but they just say that I'm in the wrong without even attempting to understand what I'm saying, and that their system is correct. I just feel like they are trying to steal my money and lying for their financial gain. This loan was done on an emergency situation and i feel like they are taking advantage of that.
XXXX ) On their tables ( attached ), they say that they will charge me a total interest of {$5600.00}. As of XX/XX/XXXX they have already charged me {$4200.00} in interest ( again per their table ) this would mean that when i am charged the remaining {$1400.00} of interest they should not charge me additional interest and the full amount should go to the principal, which i doubt will happen. This loan was made in XX/XX/XXXX for {$5000.00} and they allege that as of XX/XX/XXXX i still owe {$4200.00}, with payments of {$170.00} that just isn't accurate at all.
XXXX ) They have a unusual way of calculating interests, while talking to the different institution employees i receive inconsistent information as to how they accrue the interest which is very alarming to me.

I have applied recently like two or three times and continuously Island Finamce XXXX XXXX denied me personal loans from {$11000.00} and {$9200.00} to buy an essential product an used car a ls a replacement for a lost property in a car accident. The first time they said the required credit score is XXXX and my credit score went from XXXX then XXXX, the last time I applied in XXXX XXXX that they have had and the application returned me the application number : XXXX, i contacted them by phone and they said they reviewed my application and denied again the loan. Yesterday a coworker named XXXX XXXX commented me that in Island Finance XXXX XXXX the associate named XXXX approved and gave her a loan of {$4400.00}. She has the same salary and the company have the same time working here she have 3 kids and I dont have dependants. She said call XXXX. When I called to verify the information to XXXX to Island Finance XXXX XXXX located at XXXX XXXX XXXX XXXX XXXX, XXXX XXXX, the associate named XXXX XXXX treated me in a discriminated way, she said that the application XXXX XXXX was not considered and the last call they reviewed another application number XXXX and was denied because they received my score with XXXX and my score in XXXX was XXXX, and before that XXXX and XXXX. But not XXXX. I edlxplained to her that after declared disaster XXXX hurticane XXXX, XXXX, XXXX XXXX i did not received any aid neither any loan to fairly recovered from declared disasters. I DID KNOW THAT CREDIT DISCRIMINATION IS ILLEGAL. The associate named XXXX XXXX lied to me without any motives in the phone call, they are false and misleading advertisement and clearly not equal treatment. I need thwt they removed the credit inquiry because they have misleading information and there associates are treated me in less favourable conditions that other applicants, credit discriminqtion is illegal, discrimination by gender, by age and for social status is illegal too. She assumes my backgeound and another informatiom and discriminated against me. She said that I have other accounts recently in XXXX, and of course I did not fairly recovered XXXX XXXX disaster neither declared disaster XXXX received any XXXX XXXX I have a economic injury per declared disaster and the Island Finance and their associates discriminated against me several times.They should removed the island finance credit inquiry from my credit reports in XXXX, in XXXX, and XXXX. And they should stop misleading advertosements and stop their associates discriminations agains applicants.

I spoke over the over phone with XXXX XXXX, XXXX Island Finance XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX and with their Island Finance Assistant Manager named XXXX XXXX XXXX, because no matter I did not authorized the credit inquiry at their Island Finance website, no matter I never clicked the submit application button, and closed the web page, the Island Finance website submits the application in a potential client started to fill their online application as I did, no matter like in my case, I never clicked the accept they can make a credit inquiry box, or much less submitted the application by clicking the final submit. XXXX XXXX informed she will submit the claim where this is going to be explained just as I told her over the phone, because I was sure that if the final submit is not done by a potential customer and the boxauthorizing the inquiry was not selected either, if the web page is closed, there was no way the application can be submitted but that is not the case, this is one more thing against online transactions. The asistant manager Miss/Mrs. XXXX said my claim is handled by a different department and that they will call me tomorrow, or if not, I have to call them.
No matter her over the phone explanations, I found this online procedure incorrect, unfair, and there is no justification to make a hard inquiry if the customer decides not to submit the application and closed the web page. Also, the assistant manage said clearly this is on the hands of other department, without giving any time frame to solve this. Is a practice that has to be eliminated by any financial institution, There is no justification, no matter the client started to fill the application as I did, if any potential customer decides not to submit the application, the application can't be submitted and much less, the hard inquiry can't be made because it was not authorized.

On XX/XX/XXXX I went to the financial institution to ask for the payoff quote of my loan. I knew my last payment was on XX/XX/XXXX, I just didn't know how much would be the amount. When I get my letter stating the payoff balance, the amount was {$2300.00}. When I asked the assistant Manager, she stated that it was in result of the loan extension that was automatically applied to my account due to the Hurricane Maria emergency and that was the amount to be paid. I was not able to analyze the information at the moment of receiving the payoff letter due to my agenda. After reviewing the letter and seeing the outstanding balance being almost half of the initial unpaid principal balance ( {$5000.00} ) at the beginning of the loan back in XXXX, I realized that this was an unfair, deceptive and abusive practice. Once I went to the branch to discuss this high amount of the last payment, on XX/XX/XXXX they advised me that the interest for the loan extension had been accruing interest for all these years even though I never agreed to the terms and conditions of the alternative and it was automatically imposed on all customers. I never had the opportunity to refuse or sign any document or contract that stipulates that I was in agreement to the loan extension, and never got any letter stating the same terms and conditions being applied to my loan account. They advised me that there was nothing they could do to solve the matter and advised me to request the loan history with the customer service department but they could not provide details regarding balances of the account.

The XXXX XXXX company located in XXXX XXXX PR calls my work 2 to 3 times a day, goes to the home of my son 's grandparents and leaves letters with them or the people living there notifying them that I should call them. that's something private no one has to know that I borrowed a loan also they communicate with the people that I referred telling them about my case I think it is a lack of respect from the company to do this to ask about me and about my debt. I am receiving almost on a daily basis a call from Island Finance trying to collect a debt from a person that I do not know. They say that I'm a reference contact and I have never consented to being a contact for anybody. Moreover, I not know who the person they are trying to contact is.
I have told them this and the collector refused to believe me and keeps calling. I called their customer service line and reported the situation and the caller, they told me they would investigate and remove me from their calling list. Yet I still receive calls. I am currently blocking these calls but the collector keeps leaving voicemails asking for this man that I do not know.

Mrs XXXX at Island Finance frequently attempts to contact me at work after Ive told her on many occasions for months now that Im neither able to attend her calls during business hours and that my employer prohibits personal calls while on duty. Ive been clear that all communications must be made through my personal phone number and voicemail but she still insists on contacting me at work in spite of my requests.
