I have 4 private student loans that show up through Iowa Student Loan on my XXXX credit report only. The other two credit reporting agencies ( XXXX and XXXX ) have removed these loans because they are no longer collectible, but XXXX will not remove them for some reason despite indisputable proof. These loans have been inactive for nearly 9 years, 7 of which show on the credit report, and the statute of limitations on such loans for collections in the State of North Carolina, where I reside is 3 years on installment loans and promissory notes. In every other state where the loans were taken out or where I resided, the statute of limitations was 5 years. I made requests to have them removed in XXXX of XXXX, but XXXX changed the status to disputed by member, but they are still listed as collection accounts. They are still being reported as collection accounts as well ( see below ). I also believe they ( Iowa Student LoanXXXX XXXX ) have likely charged off these amounts, yet they still are trying to show me as the responsible party for the debts. My private student loan lender, Aspire Servicing Cen ter ( XXXX ) i s an immoral company, and I am sending my complaint here so that hopefully their policy will change regarding accrued interest. In summary, I am drowning in student loan debt ( around {$60000.00} in loans, and {$35000.00} in interest across all private & public lenders - and yes, I have already consolidated as many loans as possible ). I am not asking anyone to pay back my loans on my behalf, or pay back the accrued interest on my behalf ( although that would be amazing ). What I am asking, is that I am offered a re-payment plan that treats me like a human being. That is all. Specifically, I have been making regular student loan payments for years. Initially after I graduated college, I was forced to put my loans through deferment since I was still trying to find work in a slow economy. I eventually found a minimum wage job and was able to get out of deferment and start paying my loans back. I was then given a couple options from my loan providers to repay my loans. Option # 1 was to have high monthly payments and start to pay down the accrued interest ( 9 %, variable rate for my Private loans through Aspire, 5.5 % for my government consolidate loans ), and eventually the principle balance. Option # 2 was to have small monthly payments that I could actually afford to make, without being forced out on the street no being able to pay rent. Obviously I could not afford Option # 1 because I was n't making enough mon ey, so I was forced to go with Option # 2 rather than continue to accrue interest within a deferment schedule. Fast forward a couple years later and I have made great strides in my career, however my student loan re-payments are still not big enough to pay back the interest. I unfortunately can not afford the high priced repayments that it takes to pay off the interest completely. Instead, all I do every month is pay the interest that has accrued in the past 30 days. The result, is that I have paid back 4 thousand dollars in the last two years to Aspire, but my account balance has n't changed one cent. I ' m still XXXX XXXX dollars in debt despite my best efforts and XXXX XXXX dollars paid to this private loan corporation. I then called them and made an impassioned plea for them to stop accruing interest on my account. All I want is to take my lumps with the $ XXXX in interest I 've already accrued through them and begin to pay that back. My heated exchange with thei r loan specialist ended up bringing me into a conversation with middle management where I simply asked, " At what point to you as a company, Aspire, say to yourself, we 've already squeeze d out $ XXXX in interest of of this kid, let 's let this human being actually start to pay off his loan. '' The managers response : " We do n't provide settlement options because then we 'd have to do it for everybody. '' This is also the case for my public loans, but I can only fight one battle at a time, so its Aspire that i want to come to an agreeme nt with first. Therefore, I 'm asking you here, XXXX XXXX and this one compet ent government agency, can you please pass a law that puts a cap on how much interest these loan providers can accrue? I 'm making my best effort to pay them back but not even seeing my account balance go down is the most demoralising feeling in the world. At what point can I actually pay my debt? That 's all I want to do! This demoralising feeling has lead to XXXX for me personally and I have, in all honestly, had thoughts about how my only way out of this situation was to kill myself. I know I should n't say that, but I 'm really trying to express the defeating feeling this has on me, and people like me. I 've been on my own since I was 17. I had no cosign ers on my loans, but decided to go to college anyways because I was told it would be the best way for me to make money in the long run. However, I feel like I have been conned into a lifelong re-payment scheme that I can never get out from under. Please please please, I just need someones help. I do n't know what else to do. I have filed multiple CFPB complaints on this issue, that supporting documentation will be attached. I had a series of private school loans through Iowa Student Loan/Aspire . The loan breakdown is as follows : XXXX XXXX Loan Date ) - XXXX XXXX {$2000.00} original balance XX/XX/XXXX ( Loan Date ) - XXXX XXXX {$6600.00} original balance XX/XX/XXXX ( Loan Date ) - XXXX XXXX, {$8500.00} original balance As provided in the attached documentation, Aspire issued me a 1099c for the XX/XX/XXXX & the XXXX loans, they issued this 1099c to me in XXXX ( attached. ) After a long delayed battle with Aspire, they FINALLY updated the 1099c to reflect the correct indefinable event code. As XXXX XXXX points out in her response to CFBP, she notes that Aspire had right to write off this debt as it was time barred and Aspire was in legal right to do so because of their " administrative policies. '' However, in XXXX Iowa Student Loan/Aspire filed small claims against me for the XX/XX/XXXX loan, which held the EXACT same characteristics as the other two loans - it was time barred and had not received payment in over 10 years. XXXX XXXX is yet to identify how/why the XX/XX/XXXX loan could have further action taken against it in XXXX yet the remaining XXXX loans ( XXXX XXXX XXXX ) bearing the SAME account standing was not written off, but further pursued for payment. What " policy '' does XXXX XXXX have that supports that choice that is in legal compliance of state and federal law? To quote XXXX XXXX 's response, " XXXX XXXX signed a promissory note and agreed to the terms as outlined in the credit agreement when she applied for the private education loans. Copies of the signed promissory notes and credit agreements were sent to XXXX XXXX in XX/XX/XXXX notifying her that the balance on the loans had been written off, but we are resending them directly to her again along with a copy of this response. The credit agreements were issued under Iowa law, and they clearly identify the provisions for default. Under Iowa law, the statute of limitations for collecting on unpaid debt that stems from a written contract is 10 years.Because payments were not received from XXXX in that time period, the debt went out of statute. As a result, Aspire Servicing Center wrote off the loans on XXXX XXXX XXXX At that time, the IRS required the issuance of the 1099-C. The 1099-Cwas provided to both the IRS and XXXX XXXX for theXXXX tax reporting season. XXXX XXXX has stated that Aspire Servicing Center has refused to provided documentation of the reason for the 1099-C. The1099-C is used for the cancellation of debt as stated on the form itself and on the XXXX form issued by Aspire Servicing Center. XXXX XXXX contained student loan as the debt description and provided the date of the identifiable event in XXXX XXXX. This further support that Aspire/ISL took action - by issuing me a XXXX 1099c to hurt my credit by placing me in arears with IRS yet fails to state what policy allowed them to do so, yet take legal action on debt that was older?

Aspire Loan Servicing company has taken over the payment process for Iowa Student Loan. My private loans hold a grace period, this was established with Iowa Student Loan early on in my loans. I have spent countless hours with Iowa Student Loan reviewing options, understanding payments and understanding the loans process. I am aware of what I can and can not do and how my decisions will impact my loans and/or my credit. I have also flexed my payments based upon when paychecks are provided ( as do most consumers ). This was NEVER an issue until Aspire got involved. Aspire contacts me, by phone, if my loan is even 5 days past due. They call me from an unknown number ( which I believe is very underhanded ) and the representative attempts to force a payment over the phone. I previously explain to these representatives that payments are scheduled and I do not wish to make one at this time. They continue to push for payment telling me that since my loan is past due it may be reported to the credit reporting agency and I should make a payment today to avoid this. I again state payments are already scheduled for the upcoming payday week. I have NEVER been more than 10-12 days ( Iowa Student Loan explained 15 or more days is where there could be some additional issues with fees and reporting to credit bureaus ) late with my loans in over 10 years, they always receive payment EVERY MONTH. It is a constant battle and I feel harassed and exhausted every time I deal with them. Yesterday, however, they crossed a line and I feel action needs to be taken. The representative that called my phone from an unknown number AGAIN, identified herself as calling from Aspire Student Loan Services, explained the call could be monitored or recorded ( all the standard ) and then she proceeded to tell me that she needed to inform me that she was " DEBT COLLECTOR. '' This is insane, intimidating and misleading language. My bill was six days past due with a scheduled payment ( visible on their website ) for THIS Friday. She is not a debt collector and I do not appreciate being called in the middle of a work day from an unknown number with someone referencing DEBT collection as if I am months past due, or that I must pay immediately because I am in some sort of trouble. This company is getting FAR too pushy. I know that I am not the only customer that has issues with their aggressive actions for loans that have ALWAYS been paid. A letter after six days -- MAYBE, a phone call referring to a DEBT COLLECTOR is UNACCEPTABLE. Even mortgage companies do not harass you in this manner and they hold loans MUCH larger in capacity than this company, and allow the 15 days grace. I feel harassed and mistreated as a customer that pays EVERY month. I understand reminders, I understand follow-ups to make sure, but 6 days is uncalled for.

I attended XXXX XXXX from XXXX. My student loans were disbursed by XXXX XXXX ASPIRE SERVICE CENTER AND XXXX XXXX XXXX XXXX beginning in XXXX. I filed for bankruptcy to which XXXX XXXX XXXX XXXX/Aspire filed a claim in my case. They filed a claim on XX/XX/XXXX for the amount of {$23000.00} with the court and was paid through the court system. XXXX XXXXAspire was acquired by XXXX XXXXXX/XX/XXXX XXXX When my case was discharged, Aspire began trying to collect from me under XXXXAspire for the amount the court did not pay through the case. When I spoke on the phone with several representatives previously with the last one being today, different things have been told to me. The rep today ( XX/XX/XXXX ) told me that payments have not been made and that they did not file a case in a bankruptcy, so I sent her the printout from the XXXX to show proof of payment. She then found the payments in their system but stated that they pulled the debt back and billed it under the gaurantor which is XXXX. XXXX was not the guarantor when XXXX XXXX/Aspire filed the claim in the case on XX/XX/XXXX, they did not become the guarantor until XX/XX/XXXX to which at that time Aspire had already began receiving payments from the court. Payments were made by the court on the following dates below : They are now trying to make me pay for the loans under the new owner when they filed a claim and were paid under the old owner. This is in reference to complaint. XXXX XXXX XXXX also asks about the IP address used to take out the private student loan. The IP address used to sign the promissory note and to access the account was XXXX. XXXX XXXX asks why he didnt receive the cosigner information back in XXXX. This loan does not have a cosigner, so Aspire Servicing Center is unable to provide information about a cosigner. The results of Aspire Servicing Centers investigation was provided to him with the XX/XX/XXXX, ... ... ... ... ... ... ... ... ... ... ... ... ... ... ... ... ... ... ... ... ... ... ... ... ... ... ... ... ... ... ... ... ...... The statement above is from Aspire Servicing Center. I just have a few more questions. Aspire Loan states the IP address used to sign the promissory note and to access the account was XXXX... I have attached the document the shows the IP Address. This is pretty straight forward. Pull the IP address, location, etc. Why can't aspire loan take the effort to do this and provide the results to myself to review and then give an explanation on how it relates to my ID Theft? Also, Aspire loan states there is no information on the Cosigner. I have attached a document that states there was an application for a cosigner. Don't you think this is relevant to my ID Thief? What else is Aspire Loan withholding? What's relevant in this matter is how the application was processed, the IP Address of where it was processed and signed at, the COSIGNER application and denial letter, and everything that was done from the start of the application to the disbursement of the last amount. I want every transaction, document, and explanation of what happened. Can aspire loan pull detail information on the IP Address? Businesses have to cooperate and provide all information that is requested and related to the Victim of ID Thief as required by FTC and XXXX. I have a legal document stating account XXXX with XXXX XXXX was dismissed for evidence of Fraud and Frogery in XX/XX/XXXX. This account was opened and used at the same Bank location of XXXX in XXXX IA. XXXX. I have not lived in XXXX IA since Fall of XXXX.There 's no po Another point is my attorney at the time XXXX XXXX wrote a letter to Aspire loan service in XXXX asking about this loan as it relates to my ID Thief. In addition to my Police report I filed in XXXX stating fraud in my loans. I did access it in XXXX b/c I wanted to look into this account and see what has happened. That doesn't mean I opened the account and took out the loan. That just means I was investigating my ID Thief.

On XX/XX/XXXX, I signed for a student loan with Iowa Student Loan. In the document I signed, it states my interest rate will be the Cost of Funds IV Index + 4.10 %. It also states if a third party buys the loan they can charge 90 % of the 3 month Libor. ( See attachment ) On XX/XX/XXXX, I received an amendment from Iowa Student Loan ( which I do not have a signed copy ). This changed my interest rate calculation to 3 Month Libor + 4.20 %. I am not sure when the loan was changed to Aspire Servicing Center. In XXXX of XXXX, I realized I was being charged even more interest than agreed to. I was being charged 3 Month Libor + 1.3 % + 4.2 %. I called on XX/XX/XXXX and spoke with a representative for 1 hour and 11 minutes trying to find out why they were charging me an additional 1.3 %. I asked to see the original Cost of Funds Index IV to compare. On XX/XX/XXXX, Aspire Servicing sent me a letter that they state I received. The letter ( attached ) says they are changing my interest calculation to 3 Month Libor + 1.3 % + 4.2 %. However, upon reviewing this letter in XXXX of XXXX, I see that this change, unlike the previous change, was not an amendment that could be mutually agreed upon. They did not send the Cost of Funds IV Index. On XX/XX/XXXX, I called Aspire again trying to find out the original interest rate calculation and why it changed. That was a 23 minute call with XXXX. She was going to send me a letter with more information. On XX/XX/XXXX, I called Aspire again and asked the same questions. I was told they would send another letter. On XX/XX/XXXX, I called Aspire again to inquire about the information I was to receive. They said they would send the letter that I should have received earlier in the month. I received that letter ( attached ) a few days later. It states they did not need an addendum to change my interest rate calculation. They will not be providing me the Cost of Funds IV Index as the changes were not optional. I then contacted their student loan advocate department to try to understand how they can just add on an additional 1.3 % to my loans without my consent, as we had a binding agreement. I was sent another letter dated XX/XX/XXXX stating all the same information they had said before. My question is how can a loan provider arbitrarily change the terms of the agreement. I can not go to a bank and just tell them I am paying less interest because I say so, that is not how a contract works.

This complaint is for how the customer service of XXXX XXXX XXXX handled a recent issue with their online payment system. Payments made online during the date of XXXX/XXXX/15 faced system issues where the payment was triplicated instead of processed only once. I became aware of the issue only after checking my online bank account ( XXXX/XXXX/15 ) and saw the reoccurance of the transaction and the overdraft they were causing. In following up with Aspire customer service on XXXX/XXXX/15, they informed me that they knew of the problem and were working hard to correct it. During the conversation, the process of how to handle the overdrafts for refund also occurred. The second representative I spoke with informed me that their company became aware of the problem on Monday, XXXX/XXXX/15. I asked if there was any thought of notifying the people affected by this problem - via mail, email, or phone number ( all of which they have ). The representative had no answer as to why they did not attempt to notify the people this would cause hardship for. I explained that this was, in my eyes, some of the worse customer service possible - to not even attempt to notify customers of unauthorized charges their company was making. I explained that they have my contact information and that is wrong to not notify and allow the customer to find out on their own. The represenative said they could see my point. They explained they are working on the return of funds and working on solutions to prevent issues like this from reoccurring. I am, mostly, satisfied with how I was treated on the phone - my complaint is with their policy/lack-there-off in regards to notifying customers of issues they have caused. The returned money may take up to a week to return to my account and I will have to go through a claim to get refund for the additional fees and fines caused by this oversight in their systems. They did not have an answer regarding how this would create additional hardship for weeks or months to come - handling the refund process will take 5-10 days, then wait for a check to be issued and received. They did not have an answer for the impact this would have on subsequent bills with their own company and explained they had not discussed any way to assist those they caused negative impact for. They had the information to provide to myself and the countless other customers impacted by this situation and did nothing.

CFBP Complaint Committee : Three years ago, XXXX, I signed a legal document with Aspire Servicing Center since I was very behind on my payments giving them permission to obtain their funds in any way they wanted if I failed to not make payments again. Since then I have made regularly payments but they have been reporting my credit as accounts closed, in collections, and past due. There is nothing in the document I signed that gave them permission to misreport my credit. I have spoken with them numerous times and they refuse to stop. My loan will be paid off in 6 months, XX/XX/XXXX, and they have told me that they are going to keep these inaccuracies on my report stating that I have been in collections and past due every month for all this time. I filed a request for this to be corrected with XXXX twice and they have not done so. They say they are reporting what Aspire is telling them is true and will not listen to me when I tell them it is incorrect. My XXXX XXXX score keeps changing from XXXX to XXXX as I file these requests with XXXX It was XXXX and then it went down to XXXX because XXXX stated that Aspire was reporting past due amounts. I filed the requests informing them that I have not made a past due payment in years and they replied that Aspire said they are reporting correctly and left it misreported. I then hired XXXX XXXX XXXX XXXX to help me and we filed and looked at my reports together. We sent letters requesting them to correct my information. My score went back up to XXXX for a couple of months and then back down to XXXX and there it remains today. XXXX is incorrectly computing my score and evaluating my credit. Aspire Servicing Center is misreporting my on time payments as past due and stating my account is closed and in collections when it is not. I want my Aspire accounts to reflect that they are not past due. I also believe that they should not be reflected as closed and in collections. Mostly, as I pay off the Aspire student loans I want all my accounts to show as being paid on time for as long as they have been and not have to start from closed XXXX accounts with past due, in collections inaccurate reports that will reflect negatively and impact my credit for 7 years. I have experienced apartment rental rejections because of these accounts not showing correctly. I have been making on time payments for years and my credit should be reported as such. Thank you.

In XXXX Iowa Student Loan ( Aspire ) issued me a 1099c. The identifiable event code was blank. After many months, ISL finally sent a SECOND 1099c it listed the identifiable event as XXXX XXXX - a discharge of indebtedness under agreement between the creditor and debtor. To be able to appropriately address tax liability I have requested a copy of the agreement that triggered this event. ISL/Aspire refuses to provide such documentation and also refuses to update the 1099c to correct the identifiable event because no settlement agreement exists. After filing a prior CFPB complaint about this issue, Aspire provided the following response : XXXX XXXX signed a promissory note and agreed to the terms as outlined in the credit agreement when she applied for the private education loans. Copies of the signed promissory notes and credit agreements were sent to XXXX XXXX in XX/XX/2018 notifying her that the balance on the loans had been written off, but we are resending them directly to her again along with a copy of this response. The credit agreements were issued under Iowa law, and they clearly identify the provisions for default. Under Iowa law, the statute of limitations for collecting on unpaid debt that stems from a written contract is 10 years. Because payments were not received from XXXX XXXX in that time period, the debt went out of statute. As a result, Aspire Servicing Center wrote off the loans on XX/XX/2018. At that time, the IRS required the issuance of the 1099-C. The 1099-C was provided to both the IRS and XXXX XXXX for the XXXX tax reporting season. Box 4 contained student loan as the debt description and provided the date of the identifiable event in box 1. If XXXX XXXX has additional questions, she should contact Aspire Servicing Center at ( XXXX ) XXXX between XXXX XXXX and XXXX XXXX ( Central time ) Monday through Friday. As you can see the XXXX 1099c issued does not list the CORRECT indefinable event code that aligns with Aspire 's response to my prior complaint. IF what they are stating is accurate and the 1099c was issued because the debt went out of statue than a CORRECT XXXX 1099c needs to be issued to show an identifiable event code of C ( Statute of Limitations ). As a result, ISL/Aspire is purposefully and willfully damaging my credit and causing severe tax consequence as I have had to set up a payment plan with the IRS until this is resolved.

I have 2 Service Loan Providers for my Student loans. On XX/XX/2023, I received an email from U.S. Department of Education regarding " Approval of Your Borrower Defense Case Under Exhibit C of the Sweet v. Cardona Settlement ''. This letter indicated the discharge of my loans from XXXX XXXX, Refund of payments made, and delete credit report associated with loans. It also stated my loans with fall under a forbearance for the duration until discharge of loans were completed. I had contacted XXXX which they assured me they would handle everything else and there wasn't anything for me to do. XXXX had done a great job on honoring the request. I had contacted Aspire LLC and they were an entire opposite of the type of response and treatment. They had told me they could not honor my statement. I emailed them the letter received from Department of Education and still they could not honor that either. About a week later, I get a notification from my credit reports that I had gone down about 70 points. I had called Aspire to see my status and they put my account as 4 late payments on 2 accounts. I tried to explain that I had been talking to them for weeks and not one mention this was going to occur. I had thought my account was in some forbearance but it wasn't. After speaking with another representative, they had finally put my accounts on a 90 day hold until entire Borrower 's case goes through. I don't understand why this wasn't done in the first place. I am now 70+ points lower on my credit report. I have worked very on getting where my score/points had been and this just sets me back even further. I am in the process of moving and trying to find another place. This low score definitely is affecting my ability to get a decent place with lower cost. This also puts my job at risk because I work with the U.S. government and having a low credit score can be deem a risk. I understand these loan and credit score will eventually be wiped out and disappear but as of today when I need whatever score I can get for my credit, the help I need isn't there. I believe the company Aspire LLC decided to report my account on the basis of retaliation. It wasn't until I reported about the Borrower 's case that my status drastically changed. I was offered a XXXX XXXX, marketed to me as a " student loan '', to participate in a Software Engineering Intensive course at XXXX XXXX XXXX XXXX XXXX XXXX at XXXX XXXX XXXX from XX/XX/XXXX to XX/XX/XXXX. XXXX was acquired by XXXX XXXX XXXX, who then shut down the program effective XX/XX/XXXX, a week after I finished the program. I struggled to find work making the income I needed to make to pay off this loan in the terms I agreed to before entering this program. Because the program was dismantled promptly after my completion of the program, I did not have access to any of the resources I was promised when taking the XXXX XXXX to pay for the program. As a result of XXXX, I was allowed to put off this debt through the emergency measures put in place. But now the monthly payments of the loan would be about 65 % of my monthly average income. I learned after completing the program, that the XXXX XXXX I took to pay for the program is not a student loan backed by the Dept. of Education, it is a private consumer loan debt. I have attempted several times over the last 3 years to negotiate reasonable repayment options with Aspire Servicing Center, the lender that services the XXXX XXXX that financed the XXXX XXXX program. Aspire has refused to negotiate reasonable repayment, and has told me that refinancing with a bank or defaulting are my only two options for repayment. Aspire has refused to provide me with any information regarding default proceedings prior to defaulting on the loan in 80 days, if I do not pay the balance of {$2000.00} to avoid default. Aspire also services two of my federally backed student loans from XXXX. They have offered an income based repayment plan for those two loans. I am currently completing the paperwork for the XXXX. Because the brick-and-mortar school was dismantled, the program 's website is no longer available. In XX/XX/XXXX, I received a letter that informed me that my student loans were forgiven and that I was NOT to make another payment towards the loans. " The Department of Education ( " Department '' ) has determined that the loan ( s ) you received to attend a school owned and operated by XXXX XXXX XXXX are eligible for full loan discharge. This means the remaining balance on the loan ( s ) will be forgiven. You do not have to make any more payments on the loan ( s ). '' I followed the instructions and did not make further payments to Aspire Servicing Center. Prior to the announcement about student loan forgiveness for these schools that misused and abused students, I contacted them to provide verification and then to validate that this was even my loan that I had been paying on for years. They did not respond, nor did they provide me any proof of how this loan was even associated with me. Years prior to this, I had been paying this loan because I was told that if I didn't, they would mess up my credit. I felt I had no choice but to pay it. I found out that they violated my rights and when I began to question them, they never responded. I stopped making the payments for this reason as well. There was no recourse for the non-payments but then in XXXX XXXX I started getting letters saying that they put my loan with them in deferment. I never asked for this, never signed anything, never even spoke to them. A forgiveness was filed and granted for my student loans, yet they are still trying to collect this debt. In XXXX of XXXX, I get a notice for payment, and I get an alert that they had reported this account as negative to my credit that dropped my credit score. They have violated my rights for the last time. I am filing this complaint because they are abusing the system and never has shown proof of the debt. The debt belonged to XXXX XXXX as shown above from the email that I received in XXXX of XXXX, clearly a school that misused federal funding and mislead students. As provided in the prior response from Aspire/Iowa Student loan ( see below ) they provide various reasons and dates of payments on accounts in reference to statute of limitation. However, as you will see in the attached account statements for each account the information provided by Aspire/Iowa Student Loan is not factual as it relates to the last payment made/date on each of the loans in question. XX/XX/XXXX Loan has a last payment date of XX/XX/XXXX ( had a balance of {$2400.00} ) XX/XX/XXXX Loan has a last payment date of XX/XX/XXXX ( had a balance of {$8000.00} ) XX/XX/XXXX Loan has a last payment date of XX/XX/XXXX ( had a balance of {$9900.00} ) As you can see, in comparison to the inaccurate information provided by Aspire in their XX/XX/XXXX statement- they are not practicing the " law '' that they reference in their response. They are purposely damaging my credit and putting me in arears with IRS. ISL STATEMENT XX/XX/XXXX Although XXXX XXXX states in her complaint that the three loans were of similar age and account status, the actions taken were in compliance with federal and state practices. The state of Iowa has a statute of limitations on a written contract of 10 years. The last payments that satisfied a minimum monthly payment for loan sequence 2 ( disbursed XX/XX/XXXX ) and loan sequence 3 ( disbursed XX/XX/XXXX ) were received on XX/XX/XXXX. The statute of limitations for these two loans expired in XXXX. The last payment that satisfied a minimum monthly payment for loan sequence 1 ( disbursed XX/XX/XXXX ) was made on XX/XX/XXXX, extending the statute of limitations for that loan into XXXX. In XXXX, loan sequences 2 and 3 were written off due to being out of statute. At that time, the IRS required a 1099-C be issued. The 1099-C was provided to both XXXX XXXX and the IRS. Before the statute of limitations expired for loan sequence 1 in XXXX, the defaulted loan was turned over to a law firm for collection. Loan sequence 1 was subsequently charged off on XX/XX/XXXX, as part of a settlement between XXXX XXXX, the law firm and the loan owner.

I received a notice from ASPIRE that I needed to recertify my income for my income based repayments. I went to the department of education site and tried to go through there but there was a HUGE notice saying I was not required to recertify my income on loans for another year, nor were they supposed to be charging interest during the Covid -19 Pandemic. The first time I called the customer service agent gave me a one month forbearance for XXXX and told me that I would have to recertify on paper instead of electronically if I couldn't go through DOE as that was a separate website. I do not understand how ASPIRE can require me to recertify my income when the DOE says it's not necessary. I have not received anything from my other loan holder as I think they are following the rules. The second time I called I was given the same runaround that I would have to recertify through the mail. I do not own/have access to a printer to print relevant documents, and there is a requirement when you sign that you agree to provide relevant documents. They have not provided an electronic means and the closest printing service to me is a 3 mile walk as I have no car. I finally tried to email them through their website and I received a form email saying please call customer service ( hard eye roll ). Yesterday I received a bill stating I owe a {$150.00} payment by XX/XX/XXXX, an amount I can not afford to pay. I have worked very hard to rebuild my credit score and don't want it ruined by this. Today I am sending in the paper form with notations that I can not provide documentation if they do not give me an electronic means to do so. I would like two things to resolve this : 1. Either provide me with electronic means to submit documentation OR, even better, just recertify my {$0.00} income based repayment for another year as required by DOE. 2. Stop charging me interest when they aren't supposed to and remove any interest they have charged me during this pandemic. Thank you.

I received my XXXX degree in XX/XX/XXXX. I began paying monthly installments on my student loan sixty days later. In XX/XX/XXXX, I received a XXXX certificate and I consequently took out another student loan. In XX/XX/XXXX, I was having financial difficulties. I called to see if my payments could be reduced. Iowa Student Loans, now Aspire, has consistently called us and our daughter regarding her outstanding loan from XXXX College. As was necessary, she obtained several loans over the period of four years. As her parents, we co-signed her loans. After college we made repeated attempts to consolidate her loans. The response was " not possible ''. The result was XXXX loans, each due on different time of the month, all accruing interest. We attempted to set up a regular schedule, and, new to the workforce, she did her best to meet the loan payments. We helped as we could to offset the payments. Since 2004, we have consistently received letters and harsh, demanding phonecalls, sometimes threatening, even though we know the amount was regularly late, but paid in accordance with her and our pay checks. Had we known a student loan from Iowa Student Loans, now Aspire would be so physiologically demanding, we would never have used them. Even the credit card companies have been willing to work with us on consolidating and paying off a card. We have attempted numerous times to talk with the Iowa Student Loans, now Aspire to consolidate and make it easier for our daughter, and now us, to repay the loans. They are unrelenting, offering no options and constantly sending letters and telephone calls. We know the loans are being paid, however, if they are off by only a few days, even due to holidays, the phone calls and cautionary letters arrive. We have come to simply tossing the letters and hanging up on the calls. There seems to be no solution outside of obtaining a high interest private loan to get them off our back. That is not fair to the intent of education. Something must be done.

Aspire student loans changed their reporting guidelines and didnt not notify their customer base. I kilt I work for XXXX and monitor my report daily. I was delinquent with my account but started repayment in XXXX of XXXX. Since then they have changed the payment status from on time, to late multiple times over the last year. Even though I am in repayment, they told me that the choose to report that the account is still in collections or over 120 days past due although I am making my payments. That is issue number one I have, my credit took a huge hit ( over 100 points ) because of them changing the payment status multiple times. I filed a dispute with three credit bureaus but the damage to my score has already taken place. I have made payments on time on an automatic payment plan though I am still being penalized while in repayment, that doesnt seem fair to me. Also, this company confirmed when I called in that they did not alert their borrowers of their changes in reporting so I fear there are thousands that have been negatively effected by their changes they kept secret. This needs to be addressed, they should be held responsible for not informing their clients of these updates. So two issues with this company, even though you are in repayment and current on those payments, they still report you in collections or over 120 days past due negatively effecting our credit and not providing a true representation of my credit behavior. And two, this company made reporting changes that effected their consumers credit reports and they failed to alert or notify anyone of these changes. If I wouldnt have called in and talked to over 5 people I wouldnt have know either.

The laws of FDCPA 15 USC 1692 states that every time you mailed me a notice or bill it was a violation of 1692b ( 5 ) as they have logos that would allow anyone included but not limited to my mail main or relatives knowing that someone from this company is communicating with me concerning an alleged debt owed. I have five ( 5 ) documents that have been sent to me, each were sent with this violation on the envelope. Please see Attachment 3 for example. The law of FDCPA 15 USC 1692e, 807 ( 9 ) and 807 ( 11 ) - False or Misleading Representations.. .have both violated since - 807 ( 9 ) - there is no author, no one signed the letters.. .and - 807 ( 11 ) - they failed to disclose that the communications is from a debt collector as seen in the included Attachments 1 & 2. Aspire Servicing Center is in violation of 15 USC 1692e.. .as they are telling me an amount is due on my account that has a positive credit balance balance which is false and misleading as I can not pay something that is already positive. I have reason to believe and do so believe, pursuant to 15 USC 1666d.. .if there is a credit of account balance with surplus over 1 dollar in accordance to the journal and ledger entries described in IRS Publication 583, the amount balance should be credited and the remaining balance must be directed to, I the consumer by check. The documentary evidence must be provided to clarify this amount as this a formal instruction in accordance to 15 USC 1666 ( b ) ( 2 ) to provide the documentary evidence which includes books of account in accordance with 15 USC 44 to resolve this billing error. Iowa Student Loans ( now Aspire Servicing ) is harassing myself, my family, & friends even though I am up to date on my payments. They are currently calling anyone I have ever put as a reference in a very creepy manner, refusing to say why they are calling. This is scary to my loved ones as I am currently going though a custody battle & they have been worried for my son & I 's safety. I am personally receiving calls up to XXXX times per day on my phone while I am at work. I had to block their phone number as the constant calls was disrupting my life. I do not see the need for constant calls when I am up to date on payments!!!!!!!!!! Now they are calling from other numbers. When I answer they refuse to say what company is calling. For my safety I can not play these games, as it could potentially be my ex up to no good again. Again, this is irrational & harassing as I am up to date on payments. When I call their XXXX number to get to the bottom of this, when I finally get a human on the phone they are confused as to why they are even calling. Yesterday I was told " we would never call you like this unless you were behind on payments. I have tried multiple times to resolve several issues with Aspire Servicing Center. But they have refused to make changes after multiple contacts and efforts. The company still has old references on file that I requested to have removed or updated several times. Some of these people are deceased or no longer would be available for contact references. I made two attempts to request these updates/removals by phone and two by writing, but have not heard back after three months. I need a new reference form to add new updates, plus a complete history of references listed/removed since my loan inception, how they were added or removed. The company also has several errors with contact information. I have always been active in contacting center online or by email, giving my updated information. But they have added several phone numbers that aren't mine. I need a complete history of contact information, and for company to only use the same phone number and email on file in record now. Calling for past due loans has been sporadic and highly bothersome. Calls are always conducted when at work. When I have answered and asked the representative if we could schedule a different call time, they have continued with call to the point I have had to hang up due to work. Process for deferment or forbearance is highly inconvenient in time of pandemic crisis. Several times my forms have been invalid because company still requires a written signature. No online option for requesting forbearance makes it difficult for many who don't have access to printer or fax.

I recently came out of bankruptcy and began making payments on my loan for almost a full year. The loan company, Aspire, keeps adjusting my variable interest rate upwards. I have called and spoken with them about my monthly payments and keeping it affordable, as well as paying them off as soon as I can. I have begun paying my loans a little earlier to help with paying it off sooner. However, my interest rate has steadily increase and make it difficult to lower my principal. I am the mother of a child with a XXXX, and I can not afford for the company to keep raising my interest rate and making it impossible to pay it off. I have never missed any payments nor paid late. My other private loans have remained stable in interest rate, and the company has not given me any satisfactory reason as to why they specifically have continued to raised my interest rate. Furthermore, it seems to me that they are attempting to gouge me. The last time I spoke with them XX/XX/XXXX, I changed my payments so that I would be paying off the loans sooner and they attempted to offer me ways to add more interest to my loans and making it seems like a good deal. I have also asked about refinancing options, but these are more expensive. I hope that this can be resolved by lowering my interest rate and keeping it stable. The most recent raise was to 3.73 %. When I started repayment, my loans were at 3.26 % just 12 months ago. Please help me get this resolved to keep my rate stable.

Couple of years ago, my student loan was transferred to XXXX. I was enrolled on an XXXX XXXX XXXX XXXX. As requested by XXXX, I was making my students loan payments on a timely manner. 1 ) Every. Single. Time. I call ISL/Aspire from my phone I am routed DIRECTLY to XXXX XXXX XXXX XXXX. I am NEVER given the opportunity to speak with customer service. This is illegal and not proper " servicing '' of my current and active student loans. I have called every single day this week and every single day ( XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX ) I am routed to XXXX 's voicemail immediately. I had to call from an alternative number to be routed to an actual customer service rep, who I had to wait on hold for 15 minutes and HEAVILY ESCALATE until A LIVE PERSON would talk to me about my account. Again, illegal. 2 ) In XXXX Iowa Student Loan ( Aspire ) issued me a 1099c. The identifiable event code was blank. I won't belabor with the struggle I endured to get a 1099c with a identifiable event code, but when ISL finally sent a SECOND 1099c it listed the identifiable event as CODE F - a discharge of indebtedness under agreement between the creditor and debtor. To be able to appropriately address tax liability I have requested a copy of the agreement that triggered this event. ISL/Aspire refuses to provide such documentation and also refuses to update the 1099c to correct the identifiable event because no settlement agreement exists. ISL/Aspire is purposefully and willfully damaging my credit and causing severe tax consequence as I have had to set up a payment plan with the IRS until this is resolved.

I took out some partnership loans when I was first out of high school to help assist with tuition and book expenses for college. I have five partnership loans that were opened in XX/XX/XXXX and XX/XX/XXXX. I never did finish college, however, I have been paying on my student loans for over 10 years. I have never been late on payments. I have five partnership loans that are all 8.4 % interest and most of the payments have been going to interest. I did file bankruptcy in XX/XX/XXXX, which I knew it would not discharge the student loan debt, so I continued to pay these loans. It has been enough time that my bankruptcy should be close to if not already removed from my credit reports. I have tried three times now to consolidate these five loans into one, so I am not getting robbed on all the interest. I understand interest needs to be paid, but I have been seeing not very much movement in over 10 years and I am just tired of it. I can afford the payment, that is not the problem. I, like most student loan borrowers, were under the government forbearance ( still in place till XXXX ) so did not do anything to stop my payments from being active again. I found out just this month that my loans were not under the mandated forbearance and my loans are now in default over 90 days. Apparently my federal loan had been sold/purchased by Aspire and they did not tell me that my loan did not qualify - I still have not gotten a straight answer from them as to why my loan does not qualify. I did, in early XXXX, file a forbearance on my own on top of the mandated forbearance just to be covered once it ended, but Aspire does not show that my request was ever processed. When I discovered my credit reports show 90 days late, I immediately called Aspire to have them undo it, they refused and said I should just dispute it with the credit bureaus. The total amount of the loan with Aspire is {$7300.00}, credit report shows that I am XXXX days late in XXXX and XXXX days late as of XXXX of XXXX ( current for some reason in XXXX ). Again, Aspire did not ever tell me that my federal student loan did not qualify for the government mandated forbearance and they did not process my submitted document to request my own forbearance!

I applied for private student loans in XX/XX/XXXX with my parents as cosigners. My parents were denied, but the loan was approved for me at a higher interest rate than I had applied for with an additional 9 % origination fee. I signed the money over directly for tuition. Durning the COVID 19 pandemic the Presidents have enacted a bill to postpone federal student loans. I have federal student loans with 3 services which 2 services have postponed my payments due to the COVID relief bill. Aspire Servicing Center has not postponed my payments they have been reporting them as past due. I recently got an alert to my credit report that my credit score dropped 153 points from XXXX to XXXX. I then found that Aspire reported my federal student loans as being 113 days past due placing me in a delinquent status and now threatening default status. I called XXXX on XX/XX/21 and the representative stated that Aspire does not have to follow the mandatory automatic postponement of repayments that the President and Department of Education put in place from XXXX and that I had to apply for assistance. I have federal student loans, not private loans or other loan types that may be exempt from this relief bill. Aspire should not be denying us this right. The negative impact to my credit is having devastating affects to my every day life and has placed me in dire straights from affecting my employment and purchasing power to securing financial assistance with every day basic living.

One is active, payments on time, one is involved in a lawsuit brought against them by myself and the others have been closed/paid in full or charged off. My husband and I have a Joint Spousal Consolidation Loan. The DOE has informed us that the separation process wont be available until the end of 2024. On the student aid.gov website there is guidance allowing borrowers an Administrative Forbearance until the DOE creates the separation process. Our loan was recently transferred from XXXX to Aspire. We were denied this Administrative Forbearance from Aspire because they have not received notification from the DOE that they have to grant us this Administrative Forbearance. It is not our fault that the DOE does have the process available for my husband and I to separate our loans. We both qualify for PSLF and are only waiting for the DOE for the separation process. We have made over 120 payments. We have also submitted all the proper documents. This is an injustice to us as loan borrowers. Congress has passed the law allowing the DOE to separate. We should not be penalized because the DOE is taking so long. Please help us get Aspire to grant the Administrative Forbearance until the Separation process is provided to us by the DOE. Thank you!

In XXXX of XXXX and XXXX of XXXX Iowa Student Loan/XXXX loaned me two amounts {$5800.00} and {$3700.00}. No problems with that but as I learned about repayment and and interest rates when reviewing things I learned that my interest rate was 8.4 % fixed rate. The Dept of Education and XXXX have listed multiple loans out in my name with derogatory remarks on all of THEM. On XX/XX/2019 I enrolled at digitalcraft bootcamp, skills fund advertised student loans. I was under the impression i applied for the XXXX XXXX XXXX student loan. According to credit agreement, the funds will not be disbursed unless the school is in compliance with its funding obligation. The school certification would determine if I am eligible for the loan and for how much. Skills fund recently stated they only do unsecured consumer debt loans, not student loans for bootcamps, and I do not generate 1098 forms. First of all, i borrowed around {$73000.00} for college and graduate school. After paying in an XXXX plan for over a decade, I owe almost {$200000.00}! Because I could not afford to make my payments, borrowers counciled me to default, whereupon they capitalized interest, in order to get into an XXXX plan. This student loan was in a repayment plan up until XX/XX/XXXX when I was told that the remaining debt was considered satisfied for less than the full balance following the plan completion. My parents received collection letters beginning in XXXX for an outstanding balance but I was never directly contacted. When I contacted Aspire Servicing Center about an outstanding balance of over {$1100.00} spanning 3 accounts in XX/XX/XXXX, I spoke with a representative and informed them that I had already paid off the balance following a repayment plan ending in XX/XX/XXXX. I have a XXXX student loan serviced by XXXX since XXXX of 2022. I XXXX XXXX from the XXXX at that time and applied for and received an XXXX XXXX. This strangely only lasted for two months and ended on XX/XX/XXXX. My account then became due without my knowledge. XXXX did not attempt to call me until XX/XX/XXXX. I received a bill for XX/XX/2023 student loan payment for private student loans held by Aspire Servicing. I paid the amount due on XX/XX/XXXX and specified the amount to be applied to each loan. I looked at my account and the payment was not applied to specified loans so I made another payment on XX/XX/XXXX and again specified the specific loans for payment. Aspire applied my payments to loans they no longer owned. My co-signers received a letter on August 28th that I was in default on my loans. However, I had made the payment twice for XXXX. I called and they said they would get the amounts paid moved towards the specified loans but will not send a letter to my loan co-signers that the original letter was sent in error. If I had not called, I would have received late fees and a report to the credit bureau. This has damaged the trust between my co-signers and myself.

Aspire Servicing Center told me and also reflects that I have zero interest on my two loans I have remaining with them yet every month after I make payments, my balances go up. Why does my balance go up if they say and show I don't owe any interest? I have had these loans for a very long time including during a bankruptcy period in which I was told I did not have to pay on them. After that bankruptcy period ended, I called to get back on track. They kept me in a defaulted status the entire time hurting my credit as well as building amounts owed. Finally I work out a plan with zero interest to pay every month and my balances are still going up after every payment. This is what is wrong with these student loan companies! You should not be allowed to say and display one thing on your account website then charge in the background. This is not ok.

My student loan was converted to FFEL with Aspire Serving, and several years ago I inquired about PSLF and was told the loan was not eligible because it was taken out in the XXXX ; I was not told that I could consolidate to make the loan eligible. I also called sometime within the last two years about refinancing to a lower rate and was told we dont refinance our federal loans. I have been paying this loan for 20 years. I no longer respond to the many phone calls I get daily from Aspire as I don't understand how my federal student loans magically turned into private loans. They call everyday telling me that my loan has been in default since XX/XX/2022, which is incorrect because my federal loans were in forbearance for the past few years. We paid {$10000.00} in XXXX on Student Loan managed through Aspire. Aspire is reporting us 90 days past due but our credit report for XX/XX/XXXX as well as XX/XX/XXXX shows the student loan status as current. This 90 day delinquency has resulted in a XXXX point drop in credit score. Upon seeing this on the report, I made payments to bring the account current and sent in an auto-pay authorization form to prevent future late payments. I contacted Aspire to ask them to rectify this inaccurate reporting of my account standing as my credit score has been significantly diminished. But they have refused to remove the lates from my report. I have had impeccable payment history on this account as well as my credit card accounts for many years.

I paid off my student loan on XX/XX/2017. I logged in on XX/XX/2017 to ensure it was paid off and there was a balance of {$5.00} for unpaid interest. I called to explain this to aspire and was told I would have to pay it and they would not back date the interest to XX/XX/2017. I spoke to a rep as well as a manager. I finally offered to pay the balance via a credit card and they told me the minimum payment would be {$10.00}. I hung up and paid the balance because I was told they would not freeze interest while I submitted a complaint to them and would be responsible for daily interest accruing. My payment was made online. This is a scam had I not gone into check I would have accrued interest for who knows how long because their system is broken.

The collection agency Aspire reported to all XXXX credit bureaus that I was over 100 days delinquent in scheduled payments to them for XX/XX/XXXX, XX/XX/XXXX, and XX/XX/XXXX. I never made any payment arrangements with them nor was I contacted by them to schedule any payments or to inform me that I was being billed. It was not until I checked my credit score that I realized what they did. On the date of XX/XX/2021, Aspire Servicing center added a derogatory mark on my credit report ( XXXX ) per XXXX XXXX. Upon further research, the debtor has not provided original contract nor signatures. This account has transferred/sold and I am no longer responsible for the account. Debtors creditor did not verify this collection. There hasn't been no written form of communication or contract for this accused debt at all. Lender withdrew XXXX payments from my account when they were only authorized to take 1. They had a computer glitch and mistakenly took XXXX extra payments. I was not notified by my lender about this issue. The only reason I found out is because I was issued a Non-Sufficient Funds notice from my bank due to the extra payments they took out. Once I found out the error, I called them immediately. It was at that point that they notified me of the glitch that caused the error. I feel this was completely negligent behavior to not even notify me. Now I have to prove that they were the cause of the NSF to get the fees repaid.

For the last 6 years I have been paying this loan on time and have never had a payment go past 30 days, however, if I have a payment that is 5 days or more late, they begin to call my personal phone, both of my parents phones, and have even reached out to my brother. Reached out to Aspire loan company because interest rate has changed and yet repayment terms has changed again. I have made 14 years worth of payments however, only being credit for 10 years. Application and contract said 20 years or 220 payments. Lender told me they will not honor two years worth of payments because they were interest only payment. We switched banks, so we had to change the checking account that the automatic payment was made from. We requested the form from Aspire and then submitted it with the new information. Aspire cancelled our current payment ( even though we did n't request a cancellation ) prior to setting up the new payment so 1 monthly payment was missed.
