AMERICAS BIGGEST SCAM TO EACH CREDIT REPORTING AGENCY, XXXX, XXXX AND XXXX XXXX RESPECTIVELY : A scam is being presented to each credit reporting agency in millions of cases. The Federal Trade Commission agreed years ago that the debt collection business is broken, and now, because of a loosely held Supreme Court decision, the debt collection industry has gone off the charts on illegal activity of the transfer of trade for personal credit matters. Each of these violations where proof of ownership is not sustained is a serious breach of an implied agreement between the collection agencies and the credit bureaus through the subscriber agreement between the parties. Your credit reporting agency needs to investigate this abusive practice and the Consumer Financial Protection Bureau ( CFPB ) must initiate a serious investigation on this abusive practice. My files should be purged permanently as the fraud has already been committed, and I am subject to my rights to sue for damages. I am one of millions of American consumers who has been entwined into a scam by various collection agencies in America. Attached is a document known as a qualified written request or QWR. There are seven posted collections on this QWR, all with account numbers backed by copies of collections from Investment Retrievers , Inc.. On each of these collection notices it specifically states that Investment Retrievers , Inc. is the new owner of a debt or debts that were originally with another creditor. However, a fully completed QWR on each of these debts will prove that not only is Investment Retrievers , Inc. the new owner, but that any transfer would have been illegal unless said transfer came from a securitized trust agreement. All of these debts were sold off into a trust, and the QWR for each debt will prove so. Now Ill explain how this scam originated in the United Stated over the past year. On XX/XX/2017 a decision was handed down in the United States Supreme Court on a case called XXXXXXXX XXXX XXXX v. XXXX XXXX XXXX XXXX. This 11-page decision comes right to the point on the application of the Fair Debt Collection Practices Act ( FDCPA ), the rights consumers should have under this act, and the tracking of new ownership. This decision left a window open for the debt collection agencies and their counterpart original creditors to pass off charged off debts without the proper documented trail. The decision states that a buyer of debt ( s ) can work outside the FDCPA protections guaranteed to consumers. The problem is becoming a giant problem pertaining to trade rights for Americans who should be protected under FDCPA. Im making the claim that each and every one of these collection has perpetuated a fraudulent activity that should be beyond a civil complaint, but more criminal in nature. Investment Retrievers , Inc. has never acquired these debts legally. There was no tracking of the debts from originality to a securitized trust, and from a trust with multiple signatures to Investment Retrievers , Inc.. This process is not only fraudulent, but a process that has caused me great damage to my personal credit history. This agency is now doing this process to virtually millions of Americans amounting to hundreds of millions of dollars in fraudulent collections. XX/XX/XXXX, I voluntarily returned a XXXX Nissan Sentra to XXXX. After the car was returned and labeled as a voluntary repossession the car was then sold at auction and collection for the remaining balance was sent to me for payment. Some time passed and no payments were made toward the collection and the balance was sold to Investment Retrievers. Investment Retrievers attempted contact with me regarding payment on the debt. I did advise at the time I have been unemployed was unemployed and had no additional funds and was looking to file for bankruptcy. Additional time passed and I was served with a document and it was a notification that I was being sued by Investment Retrievers. I later received a notification of a judgement filed. Still not in contact with Investment Retrievers I later discovered that on XXXX XXXX, XXXX there was an attempt to withdraw {$11000.00} out of all my bank accounts with XXXX XXXX XXXX XXXX. This attempt was made on all three of my accounts for the same amounts and all are on hold leaving me no access to any funds to live. The only notification that I received was on Friday XXXX XXXX, XXXX that was a letter for a XXXX XXXX notice of garnishment. That is a violation of his privacy to have his private information and data be sent to me in error, I suppose. I believe that they have no right to garnish my assets and all holds should be removed. Nearly all debts I have are outstanding due to my financial situation so it was not intentional to not make a payment when able. The opportunity never arose to where I was in a position to do so. Also, had I been able to maintain the payments on the vehicle, I would have kept it, so there is surely no way I 'd be able to pay the total amount owed on the vehicle. The debt collection process was far too aggressive to even go as far as trying to retrieve funds out any bank account of mine. I did n't keep the property of XXXX, I volunteered it because I could not afford to pay any longer. Please see the attached documents of what I received from them regarding this garnishment that 's not applicable to the open case I have with Investment Retrievers.

In conformance to my rights under the Fair Debt Collection Practices Act ( FDCPA ), I am requesting you to provide me with a validation of the debt that you talked of earlier. I have attempted to communicate with Investment Retrievers on numerous occasions dating back to XX/XX/XXXX. In XX/XX/XXXX, I retrieved a copy of my credit reports and noted that this company was reporting an entry on my credit reports that had inaccuracies. To that end, I submitted a letter to them dated XX/XX/XXXX. I did not receive a response from this company. Please note that I have never did any business nor have I ever signed any contracts with this company. My second attempt at communicating with this company was as recent as XX/XX/XXXX. In the letter that was sent, I again requested that the company provide documentation to support what they were reporting was validated. To date, I have not received a response. Also note that I have disputed this entry with XXXX and XXXX alike, yet they confirm that it is verified. My question and concern is how are the bureaus receiving notification from this company to the extent they are able to verify the account entry, yet the company has failed to respond to my disputes on multiple occasions. Additionally, duly note that ALL correspondence I sent was sent certified with a return receipt. Investors Retrievers did indeed receive the letters, yet they did not respond and have not responded to date. As such, my request is for this erroneous, inaccurate, unverifiable entry be deleted from my XXXX and XXXX reports. XXXX deleted this inaccurate entry in a previous dispute, which again raises concern as to how and why these other two bureaus are still reflecting and reporting. DELETE THIS ENTRY IMMEDIATELY!!

Investment Retrievers states that they will " recommence attempts to collect '' on a debt that has been disputed previously ; the letter states " attached is verification of debt '' but no attachment is present, i.e. they have no actual information other than my name and some bogus account number. Regardless of what information they may or may not have, they were previously informed that this debt is time-bared based on the date of first delinquency of the original creditor of the linked account # reported on my credit ( XX/XX/2010 ) and my state of residency ( NV, 6 year statute ) and told not to contact me further per the FDCPA. Despite the information on my credit report, I continue to assert that the debt is not mine. Specifically I am invoking 805. Communication in connection with debt collection - " If a consumer notifies a debt collector in writing that the consumer refuses to pay a debt or that the consumer wishes the debt collector to cease further communication with the consumer, the debt collector shall not communicate further with the consumer with respect to such debt ... These items appear on my credit report. Theses items were discharged in my bankruptcy years ago. These companies insist on trying to keep their information on my report. They are being spiteful. We had military orders to move but they still sent us to collections and harassed us non-stop, called us liars even though we were stationed XXXX mil es away ) XXXX XXXX XXXX ( medical bill ) I filed for bankruptcy due to post divorce debt that I could not handle on my own. I did this to restart my financial situation and these collections agency are too vengeful and spiteful to take their garbage off my reports. I do n't care if these do not affect my score, they still show as XXXX OPEN collections when they are NOT OPEN and have/show a balance of {$0.00}. Disputes through the credit agencies have done nothing.

I was sued by investment retrievers for a debt that was not mine but was not able to afford a laywer so I lost. They have been attempting to collect the debt owed by a judgment. They have enforced it by seizing my property. The problem I have is there threats I know legally they can do this but I dont think they can tell me things like Ill have your CA state XXXX XXXX. Revoked and youll be calling me back begging to pay your debt. They are very rude on the phone and have threatened my livelihood of me and my family. They have many times said they were going to do things to me that later on I find out they cant do. I just think its a shame that they have a judgment against me and they have to resort to theses tactics. Im a XXXX veteran with an XXXX XXXX and this is too much. I know they are enforcing a debt owed legally but can they really threating me with things they cant do and threaten me and my families livelihood.

Debt Collector, Investment Retriever 's has manipulated accounts that have been reported as Identity Theft accounts from my credit report and re-reported them multiple times on my credit reports issued by XXXX , XXXX , and XXXX . By slightly altering the original account information on file including account numbers and account names and dates certain accounts have been re-reported or duplicated to appear on my report as another account with a different negative status. The original accounts are in fact closed, but by altering the date info the accounts also report as newly opened accounts that are past due. The purpose of this decietful act is done deliberately to damage my credit reports. As a result there are accounts reported that do not even exist that are essentially replacing the accounts that have been reported to the FTC as being Identity Theft.

They will not email any documentation. They would not speak with other dealership to get a payoff. In my opinion this was all done to keep you in there loan to make money as well as make it difficult to make payments for late fees and repo. I understand that many companies use outsourced for customer reps but this was the absolute worst I have ever experienced. So pay some random person on the phone hundreds of dollars a month and hope it gets to your account. Good luck trying to escalate to a supervisor or another department. They just hang up over and over. They are crooks and XXXX. As you can see from their form letter response that they just insert a name they clearly are clueless. They spelled the name of an aggravated customer wrong. Cut and paste is too difficult for them to get right. This company and every employee is completely incompetent

I spoke to the Collection manager XXXX XXXX which, at the beginning he seemed helpful in trying to resolve a matter, the next day I e-mailed and called him to let him know I got XXXX to commit to a settlement, he then turned and said he ca n't do it and he started saying he would take legal action against XXXX, I tried to warn him he can not use threats and he proceeded to say this is what he does all the time. He violated numerous FDCPA infractions and compensation is warranted for these actions. Collection Managers should never conduct themselves the way he did. I 've contacted his compliant officer and they can not obtain the call recording. They have asked me to provide it for them and they are hoping there is no evidence of this call. Please help

I could not list all the complaints I have on this company and the employee, but this employee has called numerous times my cell and work phone. This debt was over a repo that was resold a month or two after it was picked up from my possession in XXXX. So this is over 7 years old. He has put a lien on my bank acct and now threatening to call the county that I just purchased my home in and put a lien on my home. He hasn't used bad language, but has talked verbally abusive to me and my boss. Also gave more info ( PHI ) to my boss then need to conduct his work. I co-signed for my sons XXXX business which went bankrupt shortly after I settled all of the debts except for a vehicle that was being used by my sons business partner who kept the vehicle while they were trying to locate him.When they finally did get the car back they sold it at auction for considerably less than market value declaring I was responsible for the balance which was XXXX dollars which I didn't think I was, this was in 2008 .never received any correspondence until recently, when they say I now owe them almost 50.000 dollars which was interest added, I can not meet this financial burden as I am XXXX years old and still working to pay a mortgage and other household bills. Investment Retrievers faxed my employer a request for information with their identity letterhead that my Employer inquired about and I could not explain because I was not aware of the company. My employer could easily look up the company and see they are a debt collection agency. When I called the company to let them know this was not acceptable and could effect my employment, the Rep I spoke with told me they were attempting to collect a debt for XXXX XXXX XXXX XXXX and if I did not plan to work out payment they would recommend my case to their legal department to file a lawsuit. I have never heard of Investment Retrievers Inc before until just recently. They are counting on people being too busy to take defensive action against them. If you look at just a few of the cases they have won, you will find that most of the cases went uncontested from start to finish. As a result of this, Investment Retrievers Inc has been successful in filing and wining ( mostly by default judgment ) hundreds of court cases throughout South XXXX. Soon, those judgments will materialize in garnishment of peoples income and/or a lien on their bank account - unbeknownst to them right now during a Pandemic period.

In XXXX 2011, I was involved in a car accident. The car was financed by XXXX. During that time, I never received any documents that the car was being sold for scrap. The car debt was sold to a collection agency. it is now with a new collection agency and the agency is threatening to sue. Investment Retrievers is a collection agency that continues to report an account that is a result of identity theft. I did authorize the account they're are attempting to collect nor do I own or have the vehicle connected to this debt. On Monday XX/XX/XXXX, I contacted Investment Retrievers Inc. to let them know that the debt which is showing 'open and past due ' was included in my XX/XX/XXXX ch.XXXX discharged bk. I spoke with a cs rep. who was not able to assist me. I was forwarded to a supervisor who never answered the phone. On XX/XX/XXXX I left a vm explaining what my issue was. My call was never returned. I called the following day and left another vm. The call was never returned. This discharged debt is being reported by all 3 credit bureaus as open and late.

I do not have a business relationship with Investment Retrievers nor have I attempted any business with them but they keep attempting to put hard inquiries on my credit report. They originally placed a hard inquiry on XX/XX/2018 without my permission or knowledge. They attempted another hard inquiry today as an " installment loan inquiry '' and was blocked because I have my credit report frozen. I am not sure why they continue to try to place hard inquiries on my report without a permissible purpose or notice.

This collection agency has been reporting my collection as an open account and reporting monthly late payments as an open account instead of a collection account in order to maximize damage to my credit report. I have disputed this several times through the collection agency and through the credit bureaus. This account should be removed from all credit reporting bureaus as it has called me measurable damages from negative credit decisions that can not be over turned.

I spoke to a supervisor XXXX XXXX for investment retrievers XXXX about a previous call to settle debt but decided they wouldn't honor the credit removal, that the rep said I would receive. He said he clearly heard the rep say that they would remove off my credit after payment and they aren't willing to honor why they previously said yes to. my car was repossessed while i was in forbearance with XXXX. this should not have happened the car was almost paid off the loan amount was orginally for XXXX and i paid it down to XXXX ( XXXX payments left ). i lost my job while pregnant and notified XXXX immediately. no repossession fees and interest fees from 2013 have been added and are in collection on my credit report as if its a new debt. this isnt owed and it is unfair.

XX/XX/XXXX- Just sent me another email threatening me they are going to contact my landlord and other companies that I have worked with. Yelled at me ( ALL CAPS ) in an email asking me why I don't file bankruptcy and commenting on my financial situation.
