I signed a purchase agreement contract for VIN # on XX/XX/XXXX on XX/XX/XXXX. I have been the victim of harassment, predatory lending practices, and unfair and deceptive trade practices at the hands of Instacredit Automart. An auto sales dealership in the state Illinois. I am requesting that this contract and all amendments thereafter be thrown out or null with all payments you have received for the said contract be returned to me in full. I am arguing several reasons that I feel this is a practical request. First, I was misinformed about the value and history of the vehicle. I was not informed that the vehicle was previous used as a rental for a rental business. Had this been disclosed, as required by law, I would not have agreed to the purchase of the vehicle. I have only recently become aware that my rights as consumer, per the Consumer Financial Protection Bureau Mandated by the FTC, have been violated. The first complaint I have actually occurred on XX/XX/XXXX, but was only recently made evident during a phone call conversation I had with XXXX during XX/XX/XXXX. I asked her if I could have my sentimental belongings back that were inside the vehicle when it was previously missing from my apartment complex parking lot unbeknownst to me, XXXX stated that my belongings were destroyed after only three weeks of being in the companys possession. This is a complete violation of Illinois state consumer financial protection law. Most of the items were sentimental and are therefore irreplaceable in monetary value. This is disheartening and has caused a great deal of grief. My second complaint has to do with the companys debt collection practices. As I feel that these too have violated my rights. They were both harassing and deflating to my character per several witness accounts. When a friend of mine, who luckily happens to be a licensed financial adviser, decided to help me get the loan made current, she was shocked because the collections representative XXXX made derogatory statements that were defalcating to my character! As upset as I was still seeking to bring my loan current. I was denied any correspondence from company that they claimed was sent to me and I had never received. I was then transferred to the supervisor XXXX of their legal department. I calmly relayed my concerns of the full obligation not being satisfied upon return or repossession of the vehicle, as the value of the vehicle only covers approximately 10 % of the actual {$10000.00} purchase price. This is without the preposterous 25 % interest rate that I am currently being charged. I was only XXXX years old when I signed the contract last year and admit I had no idea what the given interest rates were had it been through an unaffiliated, more prominent lending source : such as a bank or a credit union. I was not provided with any 3rd party interest rates and was made to believe that XXXX XXXX XXXX, the companys subsidiary, was my only option for financing. This being said, and the fact only their company benefited from this, there is no denying that I have been taken advantage of and this company has committed unfair and deceptive trade practices as well as unfair and deceptive lending practices. Had I been presented with interest rate options that should have been legally made available to me perhaps this would have been a purchase that I could have afforded and not defaulted on. After informing XXXX of the XXXX XXXX XXXX quote of ~ {$1000.00} on the vehicle, in which he replied, I could sell this car for much more than the actual value to another buyer, I am certain repossession is not an uncommon practice for your company. However, this is an unfair trade practice and harmful to any consumer. There were also witnesses to this conversation that are willing to testify.

I entered into a contract with INSTA -AUTO # XXXX on or around XX/XX/2016. I was entered into this contract without a full disclosure of my right to rescind. This is a visible violation of the Truth In Lending Act. If they had presented me with a full discloure of TILA I would have seen the finance charge. Pursuant to 15 U.S. Code 1605 the finance charge in connection with any consumer credit transaction shall be determined as the sum of all charges which was never disclosed to me which is another visible violation of the law. Which leads to another visible violation of FCRA ( 1692e ) seeing that I was given false and deceptive information. Seeing that I was told that a down payment of {$2000.00} was needed in order to drive off of the lot. Pursuant to 15 usc 1605a - a finance charge is sum of all charges. The finance charge does not include charges of a type payable in a comparable cash transaction. This is under the FCRA. This is the law and a clear violation of it. I have written Insta-Auto myself to try and resolve the situation, but they have continued ignore the consumer whose character they are damaging by continuously reporting negative and false information on me ( the consumers ) credit report. I know they are not able to provide these proper documents because they were not presented to me as they should have been under the law. They can not prove that they provided me a full disclosure of TILA and they knowingly took CASH down payment as that is a violation. Also according to 18 U.S.C.8 The term obligation or other security of the United States includes all bonds, certificates of indebtedness, national bank currency , Federal Reserve notes, Federal Reserve bank notes, coupons, United States notes, Treasury notes, gold certificates, silver certificates, fractional notes, certificates of deposit, bills, checks, or drafts for money, drawn by or upon authorized officers of the United States XXXX stamps and other representatives of value, of whatever denomination, issued under any Act of Congress , and canceled United States stamps.

A consumer credit transaction in which a finance charge was involved. 15 USC 1605 defines a finance charge as the sum of all charges in a consumer credit transaction. The finance charge does not include cash, but UNIVERSAL CREDIT ACCEPTANCE , INC. d/b/a/ INSTACREDIT AUTOMART in fact took cash. The finance charge is supposed to include insurance, but UCA, INC d/b/a INSTACREDIT AUTOMART made me purchase insurance separately. UCA, INC. d/b/a INSTACREDIT AUTOMART did not present me with a Right of Rescission in this consumer credit transaction which is a violation of 15 USC 1635. Upon violating my rights as a consumer under Truth & Lending Act, this same company also committed fraud under the FDCPA. These FDCPA violations include invading my privacy, contacting me multiple times that were inconvenient to me, continuously harassed me, used profane and obscene language, hurt my reputation as a consumer, sold the alleged debt to coerce payment, illegally repossessed my vehicle twice, used unfair and unconscionable means to collect the alleged debt, furnished misleading and deceptive forms, and has caused a tremendous amount of actual damages behind these fraud acts.

Hello I recently brought a XXXX XXXX and have been building credit from it, Everything was going good untill somewhere between XXXX of XXXX I looked into my credit report and told me I was removed from file. XXXX XXXX Is who I brought the car from im still paying on it also havent missed a payment or late so I was confused on why.I went to XXXX XXXX and was told they stop sending credit to the credit bureau and ask if they could just leave my file on records but not update it so I wouldnt lose my credit, I went from a 667 credit to 0 within a month because I was took off file instacredit automart and Im very very upset about this and just want me credit to be restored Sincerely XXXX XXXX XXXX

Insta Credit Auto Mart has reported invalid information to all 3 major credit bureaus. ( XXXX, XXXX, and XXXX ) this action will constitute fraud under both federal and state laws. My vehicle has never been repossessed. My car has been refinanced through another lender. I reached out to INSTA- Credit Auto Mart they said they are to behind to deal with my problem. I wrote them a letter and they still have not responded. I will be sending them another letter XX/XX/2022 and pursuing legal action. My credit score has dropped tremendously since this fraud has taken place.

I previously disputed a repossession on my credit but the results from XXXX were that the information was stated as accurate by InstaCredit Automart. Today I spoke with XXXX at InstaCredit and have documentation that I have XXXX XXXX balance and owe nothing for the repossession. InstaCredit Automart stated i need to dispute it with the credit bureaus but the credit bureaus states InstaCredit said its accurate but I have documentation from InstaCredit that proves otherwise.

The account reporting in my report is result of fraud and I'm just getting aware on how to clear my credit ... the knowledge was not there on my end ... now I'm asking for the company to show the burden of proof and prove that this is not fraud I have even wrote goodwill letters before I tried online with the main reporter 's of my credit which was not look at nor handled right

Insta credit auto mart in XXXX Illinois will not take the car loan off my credit report. It is paid off I have called them numerous of times disputed it and went up there. The account was paid off over a month ago and when I spoke to the man at the facility about it he hung up after being rude the while time. I have proof it is paid off.

I have a car loan showing on my credit report as " in good standing ''. I have tried multiple times to dispute this account through transunion since XXXX. This auto loan was closed back in XX/XX/XXXXdue to repossession. The original creditor refuses to update the information causing me to be unable to obtain a car loan.

I previously disputed the repossession on my account through XXXX and it came back that it was accurate but I have paperwork that shows that the balance is {$0.00} and the account was cleared off XXXX XXXXXXXX XXXX credit and she was the primary account holder so it should be cleared off my credit!
