On or about XX/XX/XXXX a XXXX XXXX came to my house and installed a water softener system and told me that they have in house financing for their systems and it would only be {$70.00} a month for 96 months with no interest or fees. I was never given any account information or terms just a yellow paper receipt with the cost of the machine and the additional price for the platinum maintenance package. The technician had a little cell phone that I signed the installation agreement but I only signed that XXXX thing. I started to immediately have issues with the water softener system and tried multiple times to obtain assistance in repairing the issues. The original company ( XXXX XXXX ) never followed through, falsely changed their address with the XXXX and won't honor their part of the deal and when I did speak to a representative I told them I wanted to cancel the contract and have them take the machine back, at which point they informed me they don't hold the money part - it was a CREDIT CARD!!! ( not what I was led to believe at all ) and I would have to dispute it with the credit card company ( ISPC ). So, on XX/XX/XXXX I sent ISPC a letter disputing the validity of the debt since I was never told I was opening a high interest, low balance, incurs monthly fees, credit card. I sent ISPC a letter of refusal to pay, requested that they stop contacting me completely by phone or text, and disputed the validity of the debt. On or about XX/XX/XXXX - ispc sent a response that included an agreement that they would not communicate with me via phone or text. They also sent copies of the alleged agreement with my alleged signature - however, every single spot is the exact same signature. The technician from XXXX used my first signature for the original contract to fraudulently apply me for this credit. After this letter from them arrived, they continued to call me and leave voicemails and refused to remove the info from my credit report. On XX/XX/XXXX I received another letter that is the opposite of their first response but still does not solve the fraudulent opening of this account problem. I have already reported the XXXX XXXX XXXX to the XXXX and the attorney general for fraudulent and deceptive practices and neglect of follow through for their unkept promises. I am still getting phone calls from ISPC.

I do not know where to start with this account. This Account is incorrect, inaccurate and inconsistent, this item has 2 different Dates open - 3 Dates of last Activity that do not match on all 3 bureaus - 3 different Dates it was Last reported - 2 Different Dates of last payment and shows a balance and past due balance which is inevitably affecting my Debt to credit ratio. A inconsistent High Credit limit on all 3 Bureaus. A High credit limit of {$9700.00} on XXXX but XXXX shows no credit limit ( {$0.00} ) While XXXX shows {$9700.00}. The credit limit of {$9700.00} and {$9700.00} is questionable at best - Reason being is because the credit given to me originally was {$9200.00} its not as if they ever gave me additional credit for a water pump or I Added an additional {$580.00} - So this addition of {$580.00} was never credit it could have been a charge that occurred due to the account being charged off Which is not credit. This Account also does not comply with the metro 2 reporting requirement - CHARGE OFF should be coded under " OTHER '' or " O '' not as a REVOLVING ( " R '' ) account. The ARGUMENT I CONTEND is that this MISAPPLICATION of the proper Account Type creates a DECEPTIVE REPORTING DEROGATORY and in effect MIS-REPRESENTS the consumer 's TRUE CREDIT UTILIZATION RATE! See, for a " O '' mark, the AMOUNT of debt would NOT MATTER as a $ XXXXdebt would be EQUAL the negativity weight as a $ XXXXdebt ( given ALL OTHER aspects similarly reported that is such as age ). However, misappropriating a CHARGE-OFF under the " R '' type for REVOLVING as opposed to " O '' for OTHER as it should be allows for the AMOUNT of the debt to matter DRASTICALLY where a $ XXXXdebt would have near XXXX effect on the consumer 's CREDIT UTILIZATION RATE whereas a XXXX DOLLAR DEBT would SIGNIFICANTLY XXXX that client 's CREDIT UTILIZATION RATE there also SUBSTANTIALLY and NEGATIVELY more effecting the DEPTH OF THE DEROGATORINESSES of the reported claim ( s ). If you don't comply with the Metro 2 Reporting Standard which is the responsibility of every creditors thats uploads an account to a credit report, How can i trust that you comply with anything else?

XXXX The account was paid in full via the XXXX XXXX XXXX arrangement for a payoff date directly with them they agreed to. How can anyone continue a security hold on a paid item- duh? That hold needed to come off once the account was paid. Never was I advised I was closing the account. At minimum the account should be moved to good standing paid. This is beyond comprehension that it should remain in the negative side of the report causing me untold financial harm!

Their retort- When an account closes, ISPC has an obligation to report that accurately, using the format set by the credit reporting agencies. To report an account as closed ISPC must either indicate the account as closed by consumer or by credit grantor. Since it was not our decision to close your account, but rather you through your mortgage lender, we reported the account as having been Closed by consumer.

1 this was a requirement of the Title Company when a home closes. It was not my request to close the account as they stated it was THEIRS- and that should reflect on the account pas paid in the positive column. 2- I was advised by them verbally the account would remain open. So much for Oral agreements! ' The key word accurately! I never closed the account- it was by nature of another lender and they never asked the account be closed just the security hold removed from public records. [ as closed by consumer or by credit grantor. ] If this is the companies policy then let them report accurately as they openly state they are required to do. How can they post this in the negative when they were involved in the account payoff?

On XX/XX/XXXX My ex husband and I entered into an agreement with ISPC for the purchase of a water system for my home that I had just purchased. We signed the dotted line but there was no explanation that there would be a XXXX filing ( lien ) against my property, if I had known I would have never agreed to buy the system. My husband and I got divorced in XX/XX/XXXX and I was left with the payments, In XX/XX/XXXX, I filed for bankruptcy and I included ISPC in it. I did not find out about the XXXX filing until XX/XX/XXXX when I saw a physical copy that was sent to my lawyer 's office. In my statement of intent, I declared that I would be returning the financed equipments because I was no longer financially liable for it. At my hearing, the trustee asked me to call the finance company ( ISPC ) so they can approve the vendor ( XXXX XXXX XXXX XXXX ) to pick up the financed equipment. Well, XXXX which is an employee in ISPC legal department has been giving me the run around since XX/XX/XXXX. On XX/XX/XXXX, I called the company ( ISPC ) again, telling them to pick up the financed equipment because that was the reason why they filed a XXXX on my property, I was told that even though I am no longer financially responsible, my ex husband was. I provided them with my ex husband address and phone number, he relocated to a different state since XX/XX/XXXX, I do not have contact with the man. ISPC is guilty of unfair and deceptive tactics, no homeowner would agree to jeopardize their home over an overpriced water system that is faulty.

ISPC, Independent Savings Plan Co has violated numerous federally protected consumer rights under the FDCPA 15 USC 1692 in an attempt to collect an alleged debt of {$7400.00}. 15 USC 1692b ( 2 ). Pursuant to 15 USC 1692c ( C ). On XX/XX/XXXX a certified letter was delivered to ISPC, it notified ISPC in writing with a notarized sworn affidavit of truth stating facts and citing each violation line by line. I sent a cease and desist demanding that they cease all forms of communication with me through any and all mediums and that I refuse to pay this alleged debt. ISPC Compliance Manager has used obscene and language and has threatened me the consumer through harmful and unfair practice. ISPC has been reporting to consumer credit reporting agencies without my written consent and I never was provided a disclosure on if I wanted that to take place. I never gave ISPC permission or authorized ISPC to send me a bill. I am a natural person. Pursuant to 15 USC 1602g I am the original creditor and I extend credit to any financial institution.Please see the attached. In response to ISPC I sent another response which was delivered on XX/XX/2020 as ISPC is continuously violating me under the FDCPA and Truth in Lending. Please see attached

False and not agreed upon information was reported to the XXXX & XXXX that hows now affected me and my husbands credit in a negative way. On XXXX, ISPC reported that the account we have with them that was " paid as agreed '' with the agreed upon amount by them and us was reported as a negative/adverse account. It was wrongly reported as " closed & not paid as agreed ''. They also reported the same negative/derogatory incorrect information with the date of XX/XX/2017 to XXXX. All the information reported to both of these credit bureaus is wrong and was not what was agreed upon after they received payment for the account. I believe there intent was after receiving their money, they wanted to ruin our credit maliciously which has now affected us in a negative way. I have made numerous attempts to reach out to them to have them correct the information on out credit and they have stated they will not change the information. They are sharks and scam artist with the goal of ruining peoples lives and credit with " 0 '' understanding and do not keep their agreements after payment received.

XXXX report remains incorrect due to incorrect reporting by the Lender ISP. We never closed the acct. Our reverse mortgage lender paid them by agreement disbursement. We only requested they remove the lien on the water conditioner. They stated " due to that they are required by the Fair Debt Reporting Act '' to fil e that way? That remains a negative on XXXX , has handicapped our ability to finance our additional debt and placed us in significant financial harm. XXXX report # XXXX .
