XX/XX/XXXX The lies stop today. The deception and the fraudulent practices stop today. I initially contacted CashCall Mortgage ( DBA Impac Mortgage, XXXX XXXX XXXX, XXXX, CA XXXX ) on XX/XX/XXXX to apply for the refinancing of three of my properties. My credit was run but I was not contacted until three weeks later on XX/XX/XXXX by XXXX XXXX, to let me know that the processor assigned to me was XXXX XXXX. A week later, XX/XX/XXXX, XXXX XXXX also emailed me to tell me the same information. I waited until XX/XX/XXXX and when I heard nothing from Ms. XXXX, I reached out on XX/XX/XXXX to ask if we were on track to close on XX/XX/XXXX. Again I heard nothing so I reached out again on XX/XX/XXXX. Mrs. XXXX said she would call me on XX/XX/XXXX to review my 3 files. She assured me all ( 3 ) files were in order and even set up a notary appointment for Saturday XX/XX/XXXX. That appointment never happened as she claimed that she needed to " fix some things. '' And since that date it has been a non-stop endless cycle of asking for documents, promising me we were ready to sign, asking for documents that I already sent, telling me the files were in Underwriting, asking for more documents, telling me Underwriting needed more ( even though ALL documents were immediately supplied ). Finally, on XX/XX/XXXX, upon XXXX telling me that Underwriting had decided that they needed an appraisal after all, I demanded that I be sent a copy of the appraisal that was ALREADY done on my property on XX/XX/XXXX. She seemed to have no idea that the appraisal - ordered by Cashcall in XXXX was ever done. She found the appraisal and sent it to me, as well as cced a copy to a Manager named XXXX XXXX, whom I had insisted form a part of all emails since nothing had gotten done for 90 days XXXX 3 months XXXX time. The appraisal came in at {$290000.00} and I was told we were good to go now. But yet no signing dates were set. The comments from Ms XXXX were always It is in Underwriting. On XX/XX/XXXX I was sent an email at XXXX XXXX from a XXXX XXXX stating that she was my new processor assigned to my case. She also sent me a list of REQUIRED documents and when I stated that those documents had already been sent XXXX multiple times, even ) she stated that she had NO access to XXXX files and therefore I would have to resubmit all the required documents. At this point I became very suspicious of a request for additional documentation and demanded to know where all of my HIGHLY CONFIDENTIAL documents were and why she was not able to access them. She alluded to the mental state of Ms. XXXX XXXX ; leaving me even further concerned. Mrs XXXX took a tone with me and told me that if I did not supply the documents then I was essentially backing out and did not want to proceed. She stated that there was a looming deadline of XX/XX/XXXX and time was of the essence to finalize the loan or else we will need to run your credit again. I stated, again in no uncertain terms, that I would absolutely NOT be running my credit again due to their inaction and sitting on my 3 loans for 100 days. She also wanted a copy of my divorce proceedings to which I absolutely said I would not send over. I asked why in the world anyone would want to see my divorce papers when I have been divorced for 17 years and during that time have purchased 8 properties and even refinanced properties without ANYONE requesting divorce papers. I became suspicious that my identity and financial documents were being stolen and/or not protected. I immediately contacted the supervisor I was working with, Ms. XXXX XXXX, and she assured me that they would NOT have to see my divorce papers. At that point she said all that was needed was my XXXX W2- a document that I had submitted multiple times already, and did so again. I was told that was it and my files would go back to Underwriting and be done. Enter XXXX XXXX on XX/XX/XXXX who said he was brought on to close the deal. I explained to him that absolutely nothing had been done and no deals were finalized because of unknown reasons. He assured me that he would get to the bottom of it and that the deals would close. He explained that Underwriting has decided after all that they NOW needed an appraisal of the XXXX property. I explained in no uncertain terms that once again that appraisal had been done over 3 months ago. I also explained that Ms XXXX had a copy as did Ms. XXXX XXXX. He claimed there was nothing documented and wanted me to send him MY copy, which I did. He then entered it into the portal on XX/XX/XXXX. I thought that would be the end of it, as promised, and that we would indeed finally be signing our documents today. But NO. I just received a phone call today ( XX/XX/XXXX at XXXX XXXX ) from XXXX XXXX who informed me that my file can not be finalized until I RUN MY CREDIT AGAIN. I told him that my credit is frozen, and that I would absolutely NOT be running my credit again due to their own ineptness and inaction. They have literally sat on my loan for FOUR MONTHS ( 120 DAYS ) and at this point they have lost all credibility with me. But it is worse than that. I can only think at this point that it goes beyond ineptness and inaction. At this point I am concerned about the privacy of my financial documents, as well as the very real threat of fraudulent and deceitful practices on behalf of CashCall Mortgage ( DBA Impac Mortgage ). Their misleading actions have now caused me to miss out on refinancing all 3 of my properties at rates that are lower than the current market rates. This deal should have been done FOUR months ago, as I am someone with impeccable credit, access to all of my documents at my fingertips, and someone that has answered every single email, phone call, document request immediately and accurately. I applied for a cash out refinance loan with CashCall Mortgage ( DBA Impac Mortgage ) on XXXX on my house. I was told by XXXX XXXX that the interest rate would be 3.625 % with XXXX pt and no fee. I agreed to start the application which included having my credit score pulled from them and have the rate locked in. However, on XXXX I was told the rate was 3.75 % and not 3.625 %. I asked why the increase of 1/8 % and I was told he " made a mistake and misquoted me '' but he would be willing to adjust the rate if it goes lower before the closing date. During the conversation I got the feeling that it was a bait-and-switch scheme because I kept getting the pressure to do this refinance and kept being told " I would never be able to find another lender with this rate '' ( well, only this rate never existed to begin with ). Because they already did a credit inquiry on me which had an impact on my credit score and also because I already started the process, I agreed to what he said so that the application process could continue. On XXXX the rate went down to 3.625 % for a short while and I immediately notified XXXX ( I even attached the rate sheet in the email ). On XXXX I was told by XXXX XXXX that his manager XXXX XXXX refused to lower the rate unless I pay cost for it. XXXX XXXX and I had a few heated discussions and even though I had email proof that the rate would be honored and adjusted and I had rate sheet to prove it, he still refused to adjust the rate unless I pay for it. I told them I would file a formal complaint with different government agencies and only then XXXX XXXX reluctantly honored the rate of 3.625 %. But then things quickly went downhill and it was clearly retaliation - first I was told by the loan processing officer ( XXXX XXXX ) I would need to contact my HR to fill out a Verification of Employment for employment proof and income proof and after I did that, I found out that as a borrower I was not supposed to handle this kind of forms because it was clearly a conflict of interest and would potentially make the application illegal - in other words, I was trapped into doing something that appeared to be helping the application but it was complete opposite. Then, on XXXX when I signed a new set of disclosures after the adjustment of rate I noticed my SSN is wrong. I followed up with XXXX XXXX and I was told there was nothing wrong with the SSN number but then when I sent him a screenshot of the disclosure forms I received that contained the incorrect SSN to express my concern, he replied and told me the SSN was corrected and in the email he quoted my SSN in CLEAR TEXT. It is an unsecured email channel and so now my SSN is out exposed to the public. This is absolutely unacceptable and a complete violation of privacy! I asked both XXXX and XXXX why they did that and that they did not care about information security and I was just told this is the normal process in CashCall Mortgage and " it is what it is '' ( I honestly believe they did that on purpose as retaliation ). And as if that was not the end of a nightmare process yet, CashCall Mortgage ran another credit check without my consent on XXXX. It was a " hard inquiry '' which negatively impacted my credit score. I caught it because I have credit monitoring service and when I asked CashCall Mortgage I was told they " had made a mistake in entering my SSN '' in the application and had to re-enter and do another credit inquiry. I would imagine it is against the law to run any credit inquiry without the consent. And again, another retaliation towards me for asking for the rate I was promised. After the loan closed towards the end of XX/XX/2019, I sent an email to the CEO ( XXXX XXXX ) and Chief Administrative Officer ( XXXX XXXX ) about my experience with CashCall Mortgage that includes the bait-and-switch business practice and the retaliation towards me including disclosing my SSN in public and running credit inquiry without consent and the only response I got was a few phone calls from a paralegal ( XXXX XXXX ). XXXX XXXX pretended to be a nice person at first but then he quickly became extremely aggressive in every call with me in an attempt to intimidate me so that I can let this go and not pursue any further. It is clear to me that they know within their company all these questionable business practices and potentially illegal activities done by their staff ( also confirmed by the numerous complaints other people filed with CFPB on Impac Mortgage/CashCall Mortgage ) but they simply don't care. I am hereby asking CFPB to look into this company - they have clearly violated a few regulations ( TILA, for example ) - and to evaluate whether this company should have the license to continue doing business in the mortgage lending industry.

Around XXXX of XXXX, my mortgage service provider, Cash Call, sold my loan to XXXX. The problem began when Cash Call sent a goodbye letter to me to an incorrect address. I never received notification that the loan had been sold to another company. XXXX sent the welcome letter to an address that was not my mailing address and both letters were returned to XXXX as non-deliverable. XXXX then went on to try to contact me using a phone number that did not belong to me. When Cash Call sold this loan, all of my contact information was and still is, current. However, XXXX didn't bother to utilize the correct contact information that was in my file. When I tried to make my XXXX mortgage payment, Cash Call said my loan was paid off. At first, they asked me if I was in the process of refinancing and said it looks like the loan was paid off by someone else. Cash Call did not tell me who paid off the loan. At that exact time, I was in the process of refinancing my loan. It is important to add that in the 23 years I have lived in my house, I have never been 30 days past due ... .EVER. I contacted the refinance company and they let me know that they may have paid off the loan but they would send me paperwork to close out and inform me of my new payments. Almost 60 days had past when I contacted the refinance company again, and it was then they disclosed they did not pay off the loan. I contacted Cash Call on a recorded line and the rep told me my loan was paid off and there was nothing due. She said it was PAID IN FULL. Not transferred, not sold, but paid in full. I immediately contacted the refinance company and told them what was going on. They had their title company run a check and the title company stated there was no lien on the home that it appeared to have been paid off. I had no idea who paid off this loan but in XXXX, I did lose family members to XXXX. I then asked the refinance company run another check and they sent me an e-mail stating the loan was paid off with Cash Call. In XXXX of XXXX, I received a call from XXXX XXXX of XXXX. He contacted me via telephone and stated XXXX XXXX had contacted him as XXXX Mortgage said my loan was delinquent. That was the very first time I had even heard of XXXX. Mr. XXXX and I discussed this turn of events and he scheduled a conference call between him, myself and XXXX. On XX/XX/XXXX, XXXX sent the welcome letter which contained my new loan number with XXXX, a mailing address and monthly amount to me and Mr. XXXX of XXXX. That was the very first time I had been notified that XXXX was servicing my loan. Several E-mails have been exchanged since and as such, XXXX is now threatening foreclosure on my home stating I am behind in payments despite the fact that they do acknowledge in writing that they failed to notify me. Both myself and XXXX XXXX of XXXX have asked XXXX to either defer the payments or come up with a plan that will not impact my credit since they did not notify me per the guidelines but as evidenced by the attached e-mail chain, they are not going to assist in rectifying this issue which was solely due to their negligence in handling this account. It is also important to note that upon receipt of the welcome letter from XXXX which was received via e-mail to both myself and Mr. XXXX on XX/XX/XXXX, I immediately sent in my first mortgage payment as I was now informed of my loan number and remittance address. It took XXXX almost 3 weeks to cash my check. I have already sent in my XXXX payment as well. The issue remains that XXXX claims there is a balance due from XXXX to XXXX which is during the time they failed to notify me of their acquisition of the loan. I believe a fair solution would be for them to defer what they feel is past due ( even though the e-mail letter was received on XX/XX/XXXX and I paid immediately the XXXX mortgage upon notification ) XXXX was severely negligent in handling this loan and contacting me. XXXX and Cash Call entered into an agreement which did not include me in the process of transferring this loan. I was not there when this loan was transferred thereby it is the responsibility of both parties to notify me that the conditions of my loan had changed. How am I not know who is servicing my loan when the party responsible has not contacted me or filed the proper paperwork for a title company to even find therm on the deed. I am the party being punished for someone else 's negligence. I can not come up with {$15000.00} that XXXX is demanding because they didn't handle this account ethically. I would appreciate your assistance with this matter. I know there are guidelines that lenders must follow. Certainly, notifying a customer and ensuring they are aware that the conditions of their loan have changed is one of them.

My broker is using a new type of loan that can be helpful for me.Because I do n't qualify for regular type of loan we used the12 OR 24 bank segment programs with XXXX XXXX XXXX ( 10 % downpayment ) and after that we went with XXXX XXXX XXXX ( 20 % downpayment ) for the 12 month statements. This was my worst nightmare because even if I qualified for everything they denied my loan with no reason.Idid not receive no disclosure why I was refused from XXXX XXXX and IMPAC MORTGAGE bererly answers the emails from my broker. So let me start with my story.Around XX/XX/XXXX we found a nice house lets say house number 1 and we done everything what IMPAC MORTGAGE asked us to do or submit.All the time IMPAC MORTGAGE was changing the interest rate from 5 to seven and above.For us was like, whats the bank doing? We got the deal for 20 % downpayment and around 5 % intrest rate.If we wanted only 10 % downpayment then the interest rate would escape up to 7 % and thats why we choose 20 % down with lower interest rate.IMPAC did not care about that.The bad thing was that the inspection went wrong, the house had some issues and we said no to that house and we start looking for other ones. After 3 weeks we found a lovely house ( house number 2 ) for XXXX $ and we called our broker and told him that we are ready for the new house and contact IMPAC and this time to make sure that things are gon na be correct-downpoayment/intrest rate.He told us about XXXX XXXX who want only 10 % downpayment with a interest rate around 6 % and we said lets do it.Of course they did not do it and we made extension to disclosure date and they wanted additional papers.we submitted everything and no problems at all.Before everything was done they said why is my employee listed in my business account and I said because he has to make some payments and I gave him a debit card for transaction.Im the solo owner for this business ( with proof from secretary of state ) .XXXX tells me that he has to sign the loan also and be on the loan.So how can you add a employee on your loan?? XXXX XXXX DENY the loan and I did not receive no disclosures and why they did that.Im mentioning that Im new to the States but have a very good credit score and good business history. We call our broker and he tells us to go back to IMPAC MORTGAGE because they are more flexible but they want 20 % downpayment for the 5 % interest rate.We said d ok and lets do it again with IMPAC.We told them that we found a different house ( number 2 ) and we want to proceed with the loan.FROM NOW THE HORROR STARTS.EVERY WEEK THEY CHANGED MY INTREST RATE UNTIL WE LOCKED IT DOWN ( VERY HARD TO DO IT ) .WE GOT ANOTHER EXTENSION FROM THE SELLER BECUASE THEY WERE NOT COOPERATING WITH US AT ALL.THEY TOLD THAT ALL THE PAPERS ALL ALRIGHT AND THATS IT.THE LOAN OFFICER WAS IN VACATION AND WE COULD NOT FINISH THE LOAN.WE HAD TO WAIT FOR HIM TO COME FROM VACATION.THE APPRAISEL THAT COST US XXXX $ CAME WRONG.THEY SEND THE APPRAISEL TO HOUSE NUMBER 1, THE ONE THAT WAS LONG FORGOTTEN AND ALSO THE PRICE WAS LOWER.WE GOT OUT OF CONTRACT AGAIN.HE WAS IN VACATION AND NOBODY CARED.WE GOT THE SELLER TO SIGN A EXTENSION WE WERE WAITING.ONE DAY BEFORE CLOSING THEY DID NOT SENT ME ANY DISCLOSERES TO SIGN FOR THE PAPERS TO GO TO ESCROW BUT LATE AFTER XXXX XXXX PACIFIC TIME I RECEIVED ONE BAD CLOSING DISCLOSERE WITH EVERYTHING WRONG ON IT.FROM the SELLERS NAME TO NUMBERS AND ADRESSES.EVERYTHING WAS WRONG BUT THEY TOLD ME TO SIGN IT LIKE THAT. THE SELLER GAVE US A ANOTHER EXTENSION.AGAIN XXXX XXXX DID NOT SEND US THE CORRECT CLOSING DISCLOSERE, AND CONTRACT IN THE RIGHT MANNER.THEY MADE ME AN ONLINE ACCOUNT FOR ME TO SIGN PAPERS.ALL THE PAPERS WERE WRONG AGAIN.NAMES, AMOUNT OF MONEY, SELLER NAME ETC.WE LOST THE CONTRACT AGAIN.THE DAY AFTER THE CONTRACT WERE LOST BY ME WITH THE SELLERS THEY TOLD MY BROKER THAT I DONT QUALYFI FOR THEIRE LOAN .NO REASON YET.NOTHING.JUST THAT SOME CHECKS WERE MISSING FROM MY RENT.WELL THE THING IS THAT I NEVER MISSED RENT PAYMENTS.NEIGHTER FOR PERSONAL HOUSE ( XXXX WAS THE LANDLORD AND THEY GAVE THEM ALL THE DOCUMENTS ) AND BUSINESS WERE I PAY RENT AND DEBTS.SO AGAIN NO REASON.BUT THIS WAS AFTER WE LOST THE CONTRACT.THEY MADE ME LOST THE CONTRACT ON THE HOUSE BECAUSE FOR THEYRE PERSONAL REASON WOULD NOT GIVE ME THE LOAN.BECAUSE OF THEIRE NEGLIGENCE WE LOST OUR DREAMHOUSE AND NO ONE CARES. In middle of XX/XX/2020 I began the process of refinancing my mortgage. I was with Cashcall Mortage for years without incident and called and emailed them to give them to opportunity to keep my business. I didn't hear back from Cashcall until I was down the line with another bank who were going to refinance my mortgage. Around XXXX as well, Cashcall sold my loan to XXXX, so I was aggressively pursued to go back to Cashcall. The Loan Agent XXXX XXXX, called me dozens of times in a matter of a few days when I told him I was going with another company ( you can check his phone records around XX/XX/2020 and I can show my phone records ). He promised me that since Cashcall had my mortgage for a few years ( never sent a late payment ) that I would have less paperwork to process going back to Cashcall then if I went to another company for a refinance. So a week or two later, I stopped going with the other loan company and went back to cashcall to process my refinance since I was promised a quick and easy process. I was upfront always about having a baby in XXXX of 2020 and that I was XXXX XXXX and that my income would be about 2/3 of what it has been the past few years. I was told it wouldn't be a problem. XXXX was very persistent and worked with me very well. I gave him everything he needed right when he needed it with no indication of any upcoming problems due to making less income in 2020. Throughout the process was never told once that my income being less this year would be a problem as I mentioned it to make sure ( the year isn't over and in my industry the last quarter is when my influx of income normally comes ). Cashcall sent a notary to my house on XX/XX/XXXX. They asked me for a few more pieces of paperwork on Sunday the XXXX of XXXX ( the loan needed to go through on XXXX of XXXX ). I was told by XXXX XXXX in an email that the additional paperwork being asked from me which I had sent was " Rcvd and the loan is good to go thank you ''. I have the via email. I signed the notary paperwork, and after not once being told in advance that there would be a problem with my income being less this year then the past few years, was denied my loan. My credit rating is XXXX XXXX XXXX XXXX at the time of notary signing. I have never missed a mortgage payment ever. I have enough money in my savings account to pay for 10 months of mortgage payments as well as enough money in my business and personal for another 4 months. My only other outstanding loans are a small car payment and very small XXXX bill ( which by the time of this email now is XXXX ). I was told I was denied because my income is " half '' of what it was last year. Which isn't correct. Again my loan agent knew about the birth of my daughter and that would result in a slight decrease in XXXX XXXX income this year. I was open about my income that will come in at 2/3 ( not half ) at the end of XX/XX/2020from what it was the past few years. I'm told not to state certain numbers on here but 2/3 of my normal income is still a sizable 6 figure income that can more then pay for the mortgage payment. My complaint is a variation of predatory behavior, time wasted when I could have been getting a loan from another company, the persistence that my refinance request with Cashcall who said I would be okay as a XXXX XXXX person ( who I had been a customer with for years, who I never missed a payment with ). And obviously the big thing which I have in writing is that I was told via email that my loan had gone through -- before a few days later I was told it hadn't gone through. In the days since I have called cashcall and my loan XXXX and left 5 messages and asked to speak to someone before reporting to CFPB. I emailed asking for someone to speak to, called and called and no one has responded so I'm posting my complaint here and waiting for someone to get back to me. I want my refinance to be reviewed by another underwriter. I want to be able to speak to the someone above the underwriter who denied my loan. After all the months of paperwork I need answers and reasons that aren't arbitrary like my income for XX/XX/2020 being the reason-where the year isn't over and I wasn't able to let them know about my income projections coming in at the last quarter of the year. My account was originally not escrowed. I requested to escrow my account for property taxes only. On XX/XX/18 I made a payment for {$1300.00} over the phone because I could not make an online payment since my account was not set up as an escrow account. This payment was applied to my escrow account corretly. I made an additional {$500.00} payment towards my escrow account onXX/XX/XXXX and it was applied to my late charges. I have called about 10 times to get this corrected and it's been about 1 month. I have emailed 5 times and every email and in every call I'm told they are sorry for their mistake they are going to fix it and it's still not corrected. I have not option but to dispute the charge with my financial institution. I can not get them to fix their mistake. I fell behind on my property taxes and now that I'm caught up I started an impound account to ensure this never happens again. Below is the last response but they never make the correction. I included the payment history below also so you can see I made the payment and it was not applied to my escrow account. I noticed they reversed my XXXX payment. At this point I'm not sure how to fix it or who to ask for help. They are just doing whatever they want with my money. We have having trouble with the investor for the two mortgages on this property. Both mortgages are owned by XXXX XXXX XXXX XXXX XXXX XXXX ( XXXX ). I need Impac investigated as they are not complying with either the CFPB guidelines OR California 580e. Problems with the 1st Trust Deed, serviced by XXXX. XXXX received this short sale on XX/XX/XXXX. On XX/XX/XXXX, we were told that the investor required commissions to be cut to 5 % and change relocation incentive to {$3000.00}, and to send utility bills to prove owner occupancy. We sent those items back to them on XXXX. On XXXX, we were then asked for the payoff from the 2nd lien holder. We had sent that to XXXX on XXXX, the rep we were speaking on XXXX was able to find it and forward to underwriting. XX/XX/XXXX XXXX stated that the payoff we sent was not what they wanted, and asked us to send a current full payoff demand with the UPB showing. We sent that back to them on XX/XX/XXXX. Nothing was mentioned about utility bills. XX/XX/XXXX XXXX rejected utility bills as they were in his wifes name. Explained this was a blended family and the borrower split his time between 2 residences, one with his relatives, and this property address where his wife and new family lives. Ombudsman escalated the issue to get it resolved. XXXX XXXX denied relocation stating the utility bills must be in his name in order to receive relocation, they could not be in the non-obligable spouses name. We removed relocation from settlement statement and send back to XXXX XXXX. XXXX no response from underwriting, ombudsman escalated. Letter sent to borrower stating they needed an additional 15 days to review file for decision. XX/XX/XXXX sent to investor for approval. XX/XX/XXXX ombudsman stated they expected response by end of business XX/XX/XXXX. XX/XX/XXXX ombudsman stated no response, sent inquiry to investor. XX/XX/XXXX still no response from investor. Ombudsman stated their inquiries to the investor have been ignored. XXXX send a 2nd letter to borrower stating they needed an additional 15 days for decision. I have never seen XXXX have to send TWO 15 day letters before. Underwriting on this was painfully slow, and document requests were consistently miscommunicated by XXXX front end. Once the file was in the Ombudsmans hands, communication was clear and concise, and were able to get this submitted to the investor. Now the investor is ignoring the request for decision. This is extremely concerning, as evidenced by the below interaction on the 2nd. While it is serviced by XXXX, the investor is the same. The short sale file for the second Trust Deed was sent to XXXX on XXXX. XX/XX/XXXX XXXX needed some housekeeping changes made to the contract and XXXX, sent to XXXX XX/XX/XXXX. XX/XX/XXXX XXXX countered us to {$6400.00}. Corrected settlement statement and sent back XX/XX/XXXX. XXXX XXXX asked for buyer proof of funds, sent back on XXXX. XXXX XXXX marked file complete. XX/XX/XXXX XXXX forwarded file to investor for final approval XX/XX/XXXX no response from investor XXXX no response from investor XX/XX/XXXX Impac denied file and per letter from XXXX no short sale would be allowed and they required a full payoff. Impac took nearly a month to get back to XXXX, and then denied the short sale after we were issued a counter offer and that counter was met. Impac apparently feels they do not need to comply with state and federal law. I want them investigated and fined. It is important to note that Impac is also known as XXXX, who has been fined quite a lot for violations of the law. We have contacted the investor directly and they are refusing to respond. We will be cross-filing a complaint with the CA State Attorney General. I expect Impac to comply with state and federal law. I expect a reasonable response to the short sale request.

In or about XXXX of last year ( XXXX ), we signed up online for paperless statements in which the mortgage company, XXXX ( dba XXXX , XXXX ), was supposed to send monthly email notifications that the current statement was available for payment. We have never received email notification, but we have been keeping current with our mortgage payments despite this. Starting last fall ( XXXX ), we were calling XXXX on a monthly basis to try and resolve this issue. Each time, the representative assured us the problem was fixed and that we should get an emailed statement notification. This never happened. We often escalated each call to the next supervisory level and, again, we were assured that the problem had been resolved. On XX/XX/XXXX, I called and was escalated to XXXX XXXX ( sp? ) whom I was told was " upper management. '' She reviewed our account, changed something, and assured us, once again, that the problem was resolved. I asked her how I could get in touch with her in case there were still problems which, based on our history with this company for the past year, were a distinct possibility. Ms. XXXX gave me her direct line ( XXXX ). We received no email notification in XXXX nor one for XXXX and I called the Customer Service line and the person with whom I spoke walked us through the XXXX website saying we had to click on a certain box which y was our permission to XXXX to send notifications by email and this rep, whose name I do not have, said this was the reason for our not receiving the monthly statements. ( You would think that Ms. XXXX in " upper management '' would have reviewed our account for this factor, but she did not. ) We have now, once again, not received our statement for XXXX. On XX/XX/XXXX, I called Ms. XXXX and left a message on her voicemail to this effect and since it was possible that she was out of the office on Friday, I told her I would give her until Monday, XX/XX/XXXX at XXXX to respond before filing a formal complaint with the appropriate regulating authorities. She had no " out of office '' message on her outgoing voicemail message and so I had no reason to believe that I would not hear from her in that two-day period. I never received a phone call and so we are writing to the CFPB to try and resolve this year-old issue. XXXX 's website does not make it clear how to sign up for online statements. We followed the original instructions but over the past year, as we have called on a monthly basis to get this resolved, we have found that there were " extra '' tasks that were required to make electronic notification work, even though this was not apparent in their instructions. Even if their instructions had been crystal clear, we have had problems getting our monthly statements and each representative with whom we have spoken has made a further " tweak '' to our account, assuring us each time, that this was the final step in our making their system work. We have been very patient despite the yearlong struggle, the long waits on " hold '' when we call to find out, yet again, why their system is not working, and we are extremely frustrated. Additionally, if this is not working, it makes us nervous about what else in this company is not working the way it's supposed to. If the interest rates were better, we would move our mortgage to another lender. Unfortunately, we are stuck with them for the time being. Thank you for your kind attention.

I contacted Cash Call for a refinance 30 year conventional fixed rate loan. I had several issues with the company that I believe violate certain laws, as well as a few unscrupulous practices that may only flirt with legal boundaries. I 'll start from severity of voilations ... 1 ) I was XXXX documents for me to sign and look over including disclosures. As I was reading through these documents I arrived at XXXX pages of loan application/tax request forms etc for someone other than my wife and I. They sent me a Cash Call completed ( typed and printed ) copy of a couple whom I 've never met. It has their SSN on multiple pages as well as bank accounts, Debt, Credit and a " Request for Transcript Tax Return ''! I fear that my wife and I 's identity sits in the hands of a company that does n't have the system in place to mail the correct and crucially important information to the proper recipient. I have no idea where my information could possibly be landing and the scary part is that I doubt they know either. In the wrong hands, identity theft or Tax fraud would be very easy. I brought this up to them in an email and they did not respond to it ... it was ignored. I even told them that I believed this was a violation of the CFPB, RESPA, and/or FTC and still, ignored. 2 ) We started the loan process as usual, filling out forms etc and it was n't until later that I saw something that said they were going to pay off our XXXX car lease. Cash Call moves incredibly fast and we spoke and/or emailed on a daily basis and I was never told that we would be paying off a car lease. The lease was due XX/XX/XXXX and around XX/XX/XXXX I was asked told that the car would be paid off. How can a company decide what car my family will purchase? I believe that they structured this to their benefit without consulting with the needs of the consumer and hoped to not meet resistance. In summary, they told me that without the XXXX car lease being paid off, the deal could n't happen. 3 ) I was told that the rate was locked, but many of the documents emailed ( including the ones XXXX to me ) said that it was not locked. When I asked them about it they told me that it was and emailed me a copy that had the " rate lock '' box checked off. Later as I was going through the documents that were XXXX to me, I saw in BOLD writing that the " rate will be floating in the market and will be locked when we draw closing documents ''. I brought this up to them via email on XX/XX/XXXX and it was ignored. It just seemed odd to me that all the documents I was getting were inconsistent. Toward the end I asked several questions, calling them out on the inconstancies and I was never responded to in email. I even asked to be responded to in email, but all I got were several requests to call them. I find phone conversations about these kinds of issues to be disadvantageous for the consumer since there will never be a record of what was said. in fact, I have a couple other minor complaints, but there is no way to prove them so I 'll let those go. I have evidence of all the above via an email chain as well as the actual paperwork that was sent to me along with the XXXX envelopes they were sent in.

I discovered that he ran up debt on my mother 's credit cards, then took out this loan against her property to further defraud the credit card companies and XXXX. XXXX has asserted that it was relying on a valid Power of Attorney issued to XXXX XXXX. However, my mother revoked the POA given to my brother because she issued one to me after the one given to my brother. Therefore, any actions taken by my brother under the POA were invalid. Again, if XXXX had done any diligence on my brother, XXXX would have discovered his credit history. A copy of the POA issued by my mother to me is enclosed. You will note that it is dated after the one issued to my brother. Please note that on information and belief, my brother has fled the country. In addition, he is over $ 17K behind in his child support payments. I have put her house up for sale. She needs the proceeds from the sale to pay for her care in the XXXX XXXX. XXXX 's fraudently originated loan will leave little if anything to pay for her care in the XXXX XXXX. We would hope that XXXX would see fit to investigate its origination decisions and practices related to this matter. In XXXX, XXXX XXXX XXXX XXXX XXXX, filed a foreclosure action against me and my husband. A Final Judgment of foreclosure was entered since we did not get notice of the hearing date. My husband and I were able to reinstate the loan in the amount of {$56000.00}, made payable to XXXX XXXX XXXX as the loan servicer. We were given the amount to reinstate the loan from Impac Mortgage Company since they were the trustee for this loan. The Final Judgment was vacated on XXXX/XXXX/XXXX, ( attached ) and we kept waiting to get the new payment amount, which never came through, despite repeated requests. ( attached ) Despite not having a new payment schedule, we kept paying whatever was requested initially : XXXX XXXX, XXXX - {$4100.00} - online payment XXXX XXXX, XXXX - {$5600.00} - online payment By XXXX of XXXX, the payment had gone up to {$19000.00}, which we could not pay. We kept receiving notices from Impac Mortgage Company to assist with the loan modification, and since we were getting nowhere with XXXX, so we contacted Impac Mortgage for the modification assistance. On three separate occasions, Impac Mortgage requested a fee for the modification, which was paid on the following : XXXX/XXXX/XXXX - {$2300.00} modification fee - {$1400.00} on a credit card and {$900.00} on another credit card. The loan modification actually went through and the paperwork was signed and submitted to XXXX XXXX XXXX with a payment amount of {$2200.00}, which was accepted as well as the second payment of {$2200.00}. I made the third payment of {$2200.00} ; however, XXXX XXXX XXXX refused to accept it. XXXX/XXXX/XXXX - {$2200.00} modification fee - credit card payment XXXX/XXXX/XXXX - {$2400.00} modification fee - paid by check ; everything was submitted as requested but Impact kept changing their mind of how they wanted the funds received. One letter stated the funds could be sent by check and then another correspondence was the funds had to be certified and/or wired. Even though a check was sent, it was then refused. By XXXX XXXX, another foreclosure action had been filed. We attended mediation where we were to submit the required documents. We then went to trial on XXXX XXXX, XXXX and we were given 150 days to complete the modification. Despite from the time of the first mediation in XXXX XXXX until XXXX XXXX, XXXX, we submitted the modification packet no less than 15 - 16 separate occasions Despite all of our efforts, we were notified on XXXX XXXX, XXXX that loan modification was not approved. feel as though I have been completely scammed by both XXXX XXXX XXXX and Impac Mortgage. Both kept dragging this process out and increasing the interest rate and the fees to make it impossible for us to keep our home.

***My complaint does not deal with me having a loan at CashCall , it has to do with the unethical practices at CashCall Mortgage , Impac Morgage and its past employees*** My last complaint the company responded with a deflection tactic, pointing out that my screen name was not in their database as a customer. Please investigate the matter below. Impac never actually investigated anything, if you review their response it is clear they just deflected from the issues below and DID NOT address any of the practices aforementioned ie loan churning. Please be advised that a large number of employees at CashCall Mortgage, under Impac Mortgage Corp NMLS id # XXXX have held a long secret, which is churning mortgage refinance applications over and over. I have seen this occur since before XXXX and I do not feel it is fair to the American public or to GSE 's like XXXX XXXX and XXXX XXXX and it is time that CashCall and key violator loan officers at CashCall be held accountable. The managers would look the other way when they knew loan officers were " retreading '' mortgage refinance applications. XXXX loan officers like XXXX XXXX XXXX nmls id # XXXX would use his cellular phone so that no call could be recorded showing he solicited the client in order to avoid issues with XXXX XXXX and XXXX XXXX. He also hired his wife to call out and solicit and churn loans over and over every 6 months some loans every 3 months. The matter was brought to the attention of VP at the time, XXXX XXXX and he sweeped thee issued underthe rug due to XXXX XXXXXXXX XXXX seniority at the company. Later, XXXX took 1003 applications with client 's confidential information and solicited clietns that XXXX refinanced while he worked at XXXX XXXX, then at XXXX XXXX and now where he is working at XXXX XXXX XXXX XXXX XXXX. There were other violators of the comapny 12 month retread policy ( to keep things smooth with XXXX XXXX XXXX but many of the managers looked the other way when guys like XXXX or XXXX XXXX XXXX XXXX XXXX churned loans to fatten their pockets while costing XXXX XXXX and XXXX XXXX XXXX XXXX but by far the biggest offender and most unethical, cunning mortgage loan officer of all time that anyone will encounter is XXXX XXXX XXXX I assure the CFPB if you investigate this mortgage officer 's history, obtain a warrant to search his home or computers you will find that he has confidential borrower information including social security numbers, date of birth, addresses and names illegally obtained from every company he has worked at.

Dear Sir/Madame it may concern : I have had Cash Call Mortgage is my currently mortgage on my primary home. My credits and all documents disclosed my assets in detail had been approved in excellent status that I qualify for the refinance at the lower rate and cash out. On XX/XX/XXXX, I told the loan officer to lock the rate at 1.75 %, Point Fee is 1.112 %, with NO Closing Cost ( It meant lender credit and no charge me for 3rd party ). He told me he locked the rate and transferred my document to the underwriter approve. I supposed that we will close the loan in XXXX. However, in XXXX the loan processing told me that she waited for the loan officer locks my rate. I called loan officer and he told me he forgot to lock the rate and he would wait for the rate goes lower like the date XX/XX/XXXX, he would lock it for me. However, I did not hear he called me. On XXXX XXXX, I called him and said the Cash Call mortgage was lower the rate and APR rate is the same as on XX/XX/XXXX. He should lock the rate for me. I got a call from Cash Call on XX/XX/2016 and was offered to refinance my mortgage at XXXX % with no costs and no appraisal ( I had recently gotten an appraisal with them, but was given a " bait and switch '' to a higher rate, so I declined that loan. ) This time, they said the previous loan handler screwed up, and they would help me make this one go through. I filled out all their paperwork, emailed them copies of all supporting documents they wanted. They then said they were waiting for a response from the credit union that was holding the loan for my solar panels, which needed subordinating. I waited and waited and kept calling them and asking why the loan was being held up. They kept saying the credit union did not respond. I then contacted the credit union and I now have proof that Cash Call did not notify the credit union until XXXX ( and they promptly responded on the XXXX. ) In other words, Cash Call dropped the ball and did not get the subordination they needed until almost XXXX weeks later - at that time, rates had gone up, so they no longer wanted to honor the offer they made me. Meanwhile, my credit score has the ding of the extra credit score pull, I have wasted all that time and effort getting them docs, and they want to weasel out! It was their fault! They dropped the ball -- not me! To make matters even worse, this is the second time!! The first time ( a few months ago ) I even went through the entire hassle of going through a home appraisal. I kept telling the loan agent that I would only refinance for a no cost rate of 3.75 % and they kept saying " we will work something out. '' After completing everything, filing for the loan, getting the appraisal, etc, they did a bait and switch and came back complaining saying " Come on! After all that work, you wo n't accept a higher rate? We ca n't do the lower rate we had mentioned. '' -- - I reminded them that I had been telling them all along I would not agree to a higher rate. They cancelled that loan, and my credit score plummeted. Now they are at it again!!! What is going on? Do they get money for getting people to agree even if the loans do n't go through???? If you need proof, I have all the phone calls recorded myself ( and they do too ) for which I can provide you the XXXX files, and I have all emails.

1. On the basis of CashCashcall web ad, XXXX XXXX/XXXX/2015, I filed the application online for 15 year fixed 2.75 % mortgage loan with no closing cost. 2. Cashcall sent me the confirmation but without the rate lock. Then again changed the loan rate at 2.875 % for 15 year fixed with {$990.00} Cashcall Lender fees but again no lock-in rate. 3. on XXXX/XXXX/2015 I talked to XXXX XXXX XXXX XXXX Cashcall and asked to match the rate & terms offered by Quicken loan i.e. 2.875 % fixed 15 year mortgage with {$170.00} lender fees. He asked me send their e-mail so that Cahcall will match XXXX Loan rate & terms. 4. My e-mail of XXXX/XXXX/15 indicated to Cahcall that even though Cashcall Ad shows 2.75 % 15 year Mortgage with no cost, why their disclosure shows it at 2.875 % for 15 year loan with {$990.00} fee cahcall total fees. 5. How ] ever, e-mail of XXXX/XXXX/2015 indicated that the total money required at closing would be {$140000.00} while the title company XXXX Form shows these as {$130000.00} which exclude the Cashcall fee plus the home insurance cost which would definitely be much less than {$15000.00}. I asked the loan processor XXXX XXXX XXXX to provide the detailed explanation for this difference but so far he has not provided me the detailed explanation. 6. Cashcall e-mailed that they did approved my loan but so far failed to provide me the final commitment letter with their promised fees of only {$170.00}. They are using the delaying tactics of asking the XXXX forms of the stocks which I do n't even own now. Well, they e-mail me of XXXX or XXXX at a time asking for the same documents copies which I already gave before. Thus filing to provide the final commitment and the detailed expenses as per their oral promise and making sure that just couple of before the closing they would jack their fees extensively and forced us to p [ ay much higher expenses that their initial disclosed XXXX plus failing to match the promised quicken loan rate and terms. I believe that such practices are not only unethical but may be even illegal. Hence, I seek your immediate help on this matter.

Please be advised that a large number of employees at CashCall Mortgage, under Impac Mortgage Corp XXXX id # XXXX have held a long secret, which is churning mortgage refinance applications over and over. I have seen this occur since before 2016 and I do not feel it is fair to the American public or to GSE 's like XXXX XXXX and XXXX XXXX and it is time that CashCall and key violator loan officers at CashCall be held accountable. The managers would look the other way when they knew loan officers were " retreading '' mortgage refinance applications. Shiesty loan officers like XXXX XXXX XXXX XXXX id # XXXX would use his cellular phone so that no call could be recorded showing he solicited the client in order to avoid issues with XXXX XXXX and XXXX XXXX. He also hired his wife to call out and solicit and churn loans over and over every 6 months some loans every 3 months. The matter was brought to the attention of VP at the time, XXXX XXXX and he sweeped thee issued undre the rug due to XXXX XXXX 's seniority at the company. Later, XXXX took XXXX applications with client 's confidential information and solicited clietns that CashCall refinanced while he worked at XXXX XXXX, then at XXXX XXXX and now where he is working at XXXX XXXX XXXX XXXX XXXX. There were other violators of the comapny 12 month retread policy ( to keep things smooth with XXXX XXXX XXXX but many of the managers looked the other way when guys like XXXX or XXXX XXXX XXXX XXXX XXXX XXXX XXXX to fatten their pockets while costing XXXX XXXX and XXXX XXXX money , but by far the biggest offender and most unethical, cunning mortgage loan officer of all time that anyone will encounter is XXXX XXXX XXXX I assure the CFPB if you investigate this mortgage officer 's history, obtain a warrant to search his home or computers you will find that he has confidential borrower information including social security numbers, date of birth, addresses and names illegally obtained from every company he has worked at.

In XXXX 2015 I refinanced my home through Cash Call Mortgage Lender for {$280000.00}. Subsequent to this, the loan was purchased by XXXX and servicing was initially provided by Impac Mortgage Loan Servicing Division. The first payment was due XXXX/XXXX/15 and Impac serviced the loan through XXXX/XXXX/15. For some unexplained reason when I reviewed my payment history online, {$83000.00} had been added to the principle. It is obvious that something was wrong as the note and all my docs clearly show the borrowed amount as {$280000.00} ; Even Impac Mortgage account history shows the initial {$280000.00} as well as the addition of the {$83000.00} about 2 weeks later. I brought this to their attention and after many, many communications they said they resolved the issue and adjusted my account accordingly on XXXX/XXXX/15 ( I have included a copy of the payment history from Impac ). Their explanation was that somehow my loan docs had been mixed up with another and caused the addition of the {$83000.00}. About the same time they said the matter was resolved, they coincidentally transferred the servicing of my loan to XXXX XXXX XXXX ( XXXX ) which began on XXXX/XXXX/15. In reviewing my account with the new loan servicing company XXXX, the {$83000.00} has been suspiciously attached to my account again. On top of all this, XXXX now has my property confused as being in XXXX County instead of XXXX XXXX County for my escrow account tax payments. SLS customer support told me they will look into it, but something is just not right. I feel like someone is trying to hide this {$83000.00} back at Cash Call or Impac, which are both part of the same company. I am very disturbed by all of this and would like some help in finding a resolution. I have attached an account summary from SLS to show the current amounts they list as well as the payment history from Impac Mortgage to show the suspicious addition and deletion of the {$83000.00}, Thank You.

I have had automatic mortgage payments set up on my account for years with XXXX/XXXX/IMPAC Mortgage. I have not cancelled them nor has my bank account information changed nor has my account contained insufficient funds at any time. Yet XXXX/XXXX/IMPAC has not drafted payments for multiple months now due to unknown reasons starting in XX/XX/XXXX. I was first made aware of the problem after receiving a condescending letter in the mail in XX/XX/XXXX scolding me for not paying my mortgage - no voicemails or emails were received prior to this. I called XXXX 's customer service on XX/XX/XXXX, made all payments over the phone that I was advised to in order to bring my account current. I was told automatic payments were set up correctly and would resume. I also asked if there had been any negative reports made to credit bureaus as a result of their error and was told they would look into it and make sure it was rectified if there had been. Automatic payments did not resume as I was told, and I again received a letter on XX/XX/XXXX saying my account was past due. I AGAIN called, sat on hold, and made payments over the phone that I was told were necessary to bring my account current and again I was told that automatic payments would now resume this time. I was also told that there has been negative reports from XXXX to credit bureaus regarding my account but customer service was unable to do anything about it on the phone. I asked to speak to a manager and the manager told me I would have to open a support request to fix this. I opened a case on XX/XX/XXXX and still have not gotten a response. I contacted the company again on XX/XX/XXXX without a response. Meanwhile my credit score has plummeted from XXXX to XXXX all due to this companies negligence and no fault of my own. The amount of time and effort I am being forced to spend to rectify this company 's errors is not acceptable.

I was approved XXXX XXXX for a loan modification by Impac, the investor of my loan and XXXX XXXX XXXX is the servicer of the loan. I got a step rate and it was going to increase to 3 % in XXXX XXXX. Therefore, prior 3 months prior to that date, I contacted Impac once again to ask that they extend my modification and keep me at 2 % interest rate for another 3 years. On XXXX XXXX, XXXX, I was approved for another modification, in writing, which was accepted and executed by me. At the time of the approval on XXXX XXXX, XXXX, XXXX XXXX informed me that I should continue making my normal payments at the 2 % interest rate. XXXX further informed me that XXXX XXXX XXXX would take up to 8 weeks to send me the final modification documents. After 8 weeks, I called XXXX XXXX XXXX and they confirmed with me verbally over the phone that my rate was at 2 % but when I would ask about the final modification documents, they acted as if they didnt know what I was talking about. I sent the modification to XXXX XXXX XXXX 3 times and they still claimed they did not receive it. They even received it from Impac and XXXX XXXX XXXX is continuing to refuse to honor the modification. XXXX XXXX XXXX is playing games with me I am so tired I have been dealing with this for months. Why is XXXX XXXX XXXX not honoring the modification that the owner of the loan granted me and that I accepted. Now, because XXXX XXXX XXXX is refusing to honor this modification, I am considered delinquent because they now changed the terms of my loan to the 3 % when in fact pursuant to the terms of the modification agreement I accepted XXXX XXXX, my rate of 2 % is extended until XXXX XXXX. Please I pray that you help me with getting XXXX XXXX XXXX to honor the loan modification that was offered to me, XXXX You.

My mortgage was being transferred, I made repeated calls to CASHCALL to ensure that there would not be an issue with my monthly payment as the transfer of loan was to occur shortly after the normal auto-draft takes place. The auto-draft was set up for the XX/XX/XXXX of every month my loan transfer was to occur on the XX/XX/XXXX. ( XXXX EST ) I spoke to several people at CashCall who assured me that the payment would go through without issue and then the new servicer ( XXXX XXXX XXXX ) would take over. On the XX/XX/XXXX I called CashCall as the auto-draft was not taken out of my checking account, I spoke with XXXX ( ID # XXXX ) who informed me that because the XX/XX/XXXX happened on the weekend that it was delayed but not to worry as it will be taken out and the information would be transferred to XXXX. On the XX/XX/XXXX ( XXXX EST ) I received a debt collection call from XXXX asking for a payment. I confirmed that no payment had been withdrawn from my checking account. On the XX/XX/XXXX I called CashCall ( XXXX EST ) again and spoke with XXXX who had no sympathy for the situation and just said that I needed to set up a new payment with XXXX. I was then transferred to XXXX who had a little more compassion but was only able to reiterate that she could offer no additional solution. The fact that I was assured that the payment situation was being taken care of makes me believe that the transfer of the loan is set-up to require additional work for the customer in the hopes that payments are late so that additional fees/APR can be garnered from the individual. I understand that there is a grace period where fees and APR issues can not occur but without additional checks by the customer this period could have easily past. This practice needs to stop.

On XX/XX/XXXX we closed escrow on our home with Cash Call Mortgage/Impac Mortgage. We funded our escrow account with {$310.00} for homeowners insurance. XXXX sent a bill for homeowners insurance to cash call for {$940.00}. On XX/XX/XXXX Cash Call paid {$1000.00} to XXXX for our homeowners insurance. Cash Call sold our loan servicing to XXXX XXXX XXXX in XX/XX/XXXX. We received an escrow activity report from Cash Call on XX/XX/XXXX stating that {$1000.00} was paid for homeowners insurance and leaving a transfer balance of {$770.00}. On our XX/XX/XXXX mortgage bill from XXXX XXXX XXXX was a {$99.00} charge for escrow. When we inquired about this charge we were told by XXXX XXXX XXXX that Cash Call stated that they were owed {$1000.00} on the account. As a side note. In our purchase there are 9 parcels of land. Cash Call paid property tax of {$99.00} and {$77.00} on 2 of the parcels on XX/XX/XXXX. This does not show up in their escrow activity report from XX/XX/XXXX. We contacted XXXX XXXX Loans about paying our property tax for all 9 parcels. They said they were only aware of 2 parcels and would only pay those. At that time we chose to close our escrow account with them and pay our taxes and insurance ourselves. When talking with XXXX XXXX XXXX they said we had to contact Cash Call Mortgage. When we contacted Cash Call Mortgage on XX/XX/XXXX they said XXXX XXXX XXXX has to resolve it. In summary, our questions are : 1 ) If our homeowners bill was {$940.00} why was {$1000.00} paid? 2 ) Why is Cash Call saying 4 months after they sold our loan that we owe them money? 3 ) Why didn't XXXX XXXX XXXX notify us of this claim by Cash Call and add it to our bill? 4 ) Why can't either of these companies tell us what it is for?

We received solicitation from our mortgage lender Impac to contact them regarding extending our loan modification We called were sent an application and submitted all requested documents. We then received a letter stating that the Loan Modification had been approved on XXXX XXXX, 2015. We signed the letter agreeing to the terms and were told the documents would be delivered within 1-3 weeks. We called Impac and emailed several times as documents were never received. We were told that there was a back log at the servicer XXXX and to wait. We were then called and advised that XXXX was caught up and wait. Then we were told that in order to get the documents we had to apply on the XXXX web site and to submit the approval with the documents and they would push the file through based on the approval. We did as instructed with XXXX who kept asking for the same documents over and over stalling the process and submitting the file under programs we never requested. We attempted to reach Impac several times with no return calls. Impac then stated that the approval was not an approval it was a proposal even though the document does not have that listed anywhere it clearly states " Approval '' Impac is doing a bait and switch here. Also XXXX then suggested we do a short sale which we have found is a clear violation of the Home loan Bill of Rights as a short sale can not be suggested after an loan approval has been granted. To date we have no loan documents for the approval of our loan modification. The approval will be attached.

On XX/XX/XXXX of 2019 we signed loan documents in front of a Notary Signing Agent at a XXXX in XXXX XXXX. Those papers stated that our new Refinance Mortgage Payment was going to be {$2300.00} and that we were going to receive at closing {$1900.00}. I called and contacted XXXX XXXX the Processor at Cash Call Mortgage many times to ask him about when was the loan closing because it was taking so much time and he was finding many silly excuses to close the loan late, one time we wrote in one of his emails that every time I ask a question I hold my loan 1 day and the they were low in workers that was why he was taking forever to close my loan. It took about 2 weeks to close my loan after we signed the Loan Documents. Everything was legitimate in our end, paperwork, employment and credit but he was finding the minimal excuses to make the loan late. we were never told that the mortgage payment was going to increase and that we were going to receive less money at closing that we had agreed. We received {$1700.00} instead of {$1900.00} and they also charged some fees that were not disclosed on the signed documents. The fees were {$250.00} one was {$120.00} and it said QCD and the other was {$120.00} for Transfer Tax. The purpose for us to refinance was to lower our mortgage payment from XXXX of $ 2500ish and at the end Cash Call mortgage gave is the same payment. Their practices of doing Loans is not professional at all and they do wherever they please with their clients.

Dear CFPB, please assist me in collecting my proper pay from XXXXmpac Mortgage Corp, XXXX # XXXX. I worked for Impac from XXXX - XXXX and from XXXX - XXXX. On XX/XX/XXXX they furloughed me when I had a XXXX loans in process. The company then made a back handed deal and got paid for my loans by a company called XXXX, and tried to pawn me off to XXXX to re-do all my loans for a second time. I asked Impac to pay me for my loans, and they refused. I was even willing to accept a {$15000.00} lump sum for my loans which would have paid over {$40000.00} had they not furloughed me and Impac became very aggressive and cruel in how they responded to me. Their legal department made threats and accusations against me and even tried to get me fired from my job at the time at Owning. Their CFO reached out to the owner of Owning and requesting that he fire me. They have now began making false statements claiming that the CFPB took a position in their favor when I raised my issue in the past. I have attached the emails between myself HR and counsel for Impac. Please take the corrective action to persuade Impac to do the right thing and compensate me for the loans I originated, most of which had final loan docs drawn, signed or generated. They have had many complaints from former employees against them as they are very anti prior employee and utilize a lot of bullying in their tactics of dealing with prior employees.

I refinanced with Cash Call Mortgage in XX/XX/2021 and received a letter XX/XX/2021 that my loan would be transferred to a new lender. Sometime in mid-XX/XX/2021, I received two mortgage statements. One from Cash Call and the other from XXXX XXXX XXXX. Both statements were due on XX/XX/2021 and were nearly identical and had the same loan amount and interest rate. The only difference is that XXXX did not include escrow payments. When I spoke with a representative from XXXX, they informed me that the loan was transferred to them on XX/XX/2021. When I spoke with Cash Call on XX/XX/2021, they are denying that the loan was transferred to XXXX and that there was no transfer of the loan at the time. Both parties were requesting payment of the mortgage on XX/XX/2021. I have spoken to Cash Call customer service representatives multiple times but no one has resolved the issue as to why I have two nearly identical mortgage payments due. I am now concerned because I believe that Cash Call could be committing fraud by collecting on my loan that was transferred or they may have released my private information to a third party. I have called XXXX and Cash Call multiple times to clarify the issue with no concrete response. As of XX/XX/2021, the issue still has not been resolved and Cash Call representatives have not informed me as to why XXXX has my loan info and why they are requesting payment.

I refinanced my home with CashCall Mortgage in XX/XX/2019. They transferred loan servicing to XXXX effective with the first payment on XX/XX/2019. I set up autodraft for the payment, and the first payment was successful. Two weeks later I received notice that the loan had been sold to XXXX, and the servicing was now being transferred to XXXX XXXX where I also set up a new autodraft. The notification from XXXX states in bold letters across the top : No action is required on your part. On XX/XX/2019, the prior servicer, XXXX, pulled a payment in the amount of {$3300.00} for a loan they no longer held servicing rights to. On XX/XX/2019, XXXX pulled their regularly scheduled payment as they now hold servicing rights to the loan. I contacted XXXX, authenticated in the IVR, opted to speak to an agent ( who required full authentication AGAIN with the same information! ), shared the information above and asked how this would be resolved. He said that since this was no longer showing as an active loan in the system, he had no information including the payment drawn on XXXX XXXX. He recommended that I write to XXXX to request a refund. I have reached out to XXXX as directed, and am also lodging a complaint here as this should not have been necessary on my part based on the formal letter received from XXXX.

I presently have a loan with Cashcall, which was completed approximately 4 months ago. As interest rates have improved, I decided to go back to Cashcall for a refinance. After completing the necessary paperwork, I was told I had loan approval. In fact, I signed the loan documents with a notary. Loan number is # XXXX. After loan documents were signed, Cashcall indicated that XXXX and XXXX loan requirements had changed, stating that my Roth IRA account could no longer be used as qualified income, as I had used in the first loan. ( I submitted a letter from XXXX, showing the monthly distribution, which I offered this time as well ) After researching this " new '' requirement from XXXX and XXXX, I was unable to find anything online to support this statement. I believe this is untrue. XXXX XXXX and XXXX XXXX from Cashcall indicated to me that an automatic IRA distribution for persons over XXXX could only be used as qualified income. I notified Cashcall that I only have a Roth IRA, which does not require an automatic distribution. This is the same Roth IRA that I used for the first loan with Cashcall! I made numerous attempts to reach them, both in phone calls and emails, with no response whatsoever. I believe they are discriminating against me because of my age.

I started a loan with Cashcall XXXX Escrow through XXXX XXXX file # XXXX. After several hours of calls emails and a written request from an attorney I finally received a completely different closing statement however the figures are still all off. I would like my money as soon as possible. My loan at $ XXXX I was given a lender credit of {$1000.00}. I made every payment and my loan payoff was only {$380000.00} so where is the {$1500.00}? I received one check for {$650.00} on XX/XX/XXXX and a second for {$19.00} on XX/XX/XXXX from title, therefore where is the {$890.00}? Escrow and closing costs are resolved, this is purely on the loan issue. The various closing statements Ive received do not match as follows : XXXX XXXX ( prior lender ) they paid through XX/XX/XXXX and paid you more at {$380000.00} which is {$140.00} missing. Per your closing you are charging form XXXX which is another {$400.00}. Therefore I see whereas I am owed {$1400.00} minus 2 days interest at {$40.00} a day is a total of {$1300.00}. I have spent so many hours on this getting the run around for months. To the point whereas I had to have my attorney send a letter. I expect clear and concise records and a refund with interest for my missing funds.

I am writing to lodge a formal complaint about the theft of funds from my escrow account from my XXXX Mortgage. I had a previous mortgage with XXXX and did a cash out refinance with XXXX that was effective XX/XX/XXXX. When I received my final settlement escrow papers from XXXX XXXX XXXX there were extra fees include in it that was not disclosed in my signed Closing Disclosure Documents. Because of the additional fees, XXXX took the {$1400.00} from my prior escrow instead of refunding the amount that was in my prior escrow. I did authorize that to be done that way and I certainly did not agree to any extra fees that were not disclosed upfront. In my signed Closing Discloure Document, my loan amount was to be {$270000.00}, when I received the Escrow statement in the mail the amount is now {$270000.00}. I certainly did not agree to that amount. I have attempted to contact my loan servicers XXXX XXXX and XXXX XXXX at XXXX and neither of them has gotten back to me to discuss this issue. I also attempted to contact XXXX XXXX from XXXX XXXX XXXX about this issue and have not heard back from her. The tacking on of the additional fees and stealing the funds from my prior escrow represents fraud and outright theft.

Cash Call contacted us to see if we wanted to refinance the mortgage loans we have with them for a noticeably lower rate. They said that it would be very simple and not difficult since they could use the prior applications they have on file to approve us. We went through this and throughout the process it was not as simple as they initially stated. They then drew up the loan documents and had us signed them stating that the loan was approved and therefore with the signing of the loan documents it would close within 72 hours. We signed the documents. A few days later we get a call stating that there were several other pieces of information that they needed with additional information being on items not relating to the property being refinanced. Totally unrelated documents were being asked for such as rental agreements on other properties and documents of other properties. They never closed the deal. As signing the loan documents there was a clear agreement and commitment on their part. Cash call always has documents signed and then comes back for more documents/information as they know people will more than likely submit more information versus saying no after they say no further documentation is needed.

XX/XX/2016 started loan application with CashCall Mortgage. By XX/XX/2016 I had provided them with all requested documents. The appraiser they selected cam out XX/XX/2016. The agent was telling me he had locked our loan at 3.625 % no fees and cash back loan 30 yr fixed. Said he needed all docs signed and sent back. I informed him he had not sent me anything. He tried to send them by XXXX XXXX, but said they were having problems with the software. The processor was able to send them to me and we electronically signed them and got confirmation from her that she received them the same day XX/XX/2016. The agent then calls me and tells me they are not going to fund the loan because the lock is going to expire and I did not get them the docs back in time. They sent us a XXXX with the same docs that we signed electronically, and we sent it back also the same day. I argued and asked to speak to his manager. I contacted XXXX XXXX at Cashcall Mortgage for a HELOC to consolidate three bills. He asked me for all of my documents to verify my income and then on XX/XX/XXXX ; he asked for my permission to run my credit for a HELOC. XXXX XXXX told me that the payment for the HELOC was just {$590.00} per month. I told him that I could pay this standing on my head and for him to proceed. Instead of XXXX XXXX putting in my HELOC application ; he put in a false application for a refinance. A licensed broker can not intentionally put in a false application! This broker committed fraud when he filed a phony application to refinance my home! I make additional principal payments every month. I also run a loan payment program to assure my numbers agree with the XXXX XXXX XXXX statements. The lender and I disagree most months by one cent, always in XXXX 's favor, but in XXXX of this year there was a significant discrepancy in the balance. Impac Mortgage dba XXXX XXXX is my lender and servicing company. Over the last 6 months I've had to call and fight with them about a late fee that they hit me with. I have a grace period through the XXXX of each month. I make sure that the payment is in the mail like last month was on the XXXX. The address that I send my payment to is XXXX XXXX XXXX XXXX XXXX XXXX, CA XXXX. I live in XXXX, CA and have a father in law that lives in XXXX XXXX. We send him mail on a regular basis and never has ever taken more than 4 days for delivery. I have an Insurance co in XXXX XXXX that I mail payments to and it never takes more that 4 days to deliver, but for some reason Impac Mortgage takes 10 days. I then end up with a late fee that I have to fight about. So XX/XX/XXXX I mail the payment and it was not processed until XX/XX/XXXX. I feel this a way for them fleece their customers. We are attempting to get a refinance on our house to pay off a higher-interest mortgage and perform some home improvements. We chose XXXX, part of XXXX. We are approaching the THIRD time we have had to sign papers because of constant blundering by XXXX. First it was because, even though the waiting period of 3 years from a " deed in lieu of foreclosure '' on our previous house, for some reason it was not recorded for a month and XXXX had not even checked, delaying our signing a month, but they didnt notify us until AFTER we had done the first signing and were expecting the cash out from our refinance. THEN they told us, AGAIN after signing and on the day we were expecting the wired funds from the cash out, that with an FHA loan no extra cash could be taken out. AREN'T THEY SUPPOSED TO ALREADY KNOW THESE THINGS? Now, after signing TWICE they are requiring proof of my latest pay raise, after which I'm led to believe the loan will have to go back to the underwriters for approval ... which will require ANOTHER signing! After four months of being lied to and thousands of dollars spent ( because that was the only way we were going to refinance through FHA ) XXXX XXXX dropped the ball. This has been a horrible experience. They asked us to give the a foundation certificate ( among other items we have provided ) that we gave to them months ago. Then at the very end of our loan ( 4 months ) said we needed to re-due the foundation with in a week or they cant help us per FHA. FHA does not require this. It comes down to the fact that we have a manufactured home ( in great shape ) and instead of telling us at the beginning of this four month process that they weren't going to refinance manufactured homes any more, they gave of a list of items that they were in hopes we could not provide. This last item would cost several thousand dollars, they new this. They have ruined our credit ( we had to max out all credit cards and spend all of our savings to replace roofs, windows, etc. I have emails and documentations to prove that they told me several things that were not at all true.

Just discovered that we have been misled and lied to by Impac mortgage/Funding group who is the investor of our mortgage serviced by XXXX XXXX XXXX. Just yesterday I spoke with XXXX XXXX XXXX who assured me that the denial of the loan modification was actually made by Impac and not XXXX XXXX XXXX. Since XXXX 2016, I have been in contact with Impac Funding group and each time we were told and reassured that XXXX XXXX XXXX is the problem., by failing to send them a packet for Impac 's review Someone is not being truthful. We need this investigated because there has so many violations by both Imapc and XXXX XXXX XXXX. Impac carries the note and should be able to override XXXX XXXX XXXX but they have refused to do so. We have been charged an interest only loan which is illegal which will reset twice in six months. It was reset in XXXX 2016 and our payment increased {$1000.00}. from {$2900.00} to {$3900.00}. In XXXX the payment will be {$5800.00} which we can not afford. All interest only which is an illegal product.

On XXXX my wife and I executed a contract with Cash Call to refinance our mortgage. The Closing Disclosure forms that we signed indicated a total closing cost of {$2100.00} and cash to the borrower of {$11000.00}. When the everything funded and closed, the closing costs had nearly doubles to {$4000.00} and the cash to the borrower was reduced to {$9400.00} These changes occurred without Cash Call informing my wife or me of the change. We were not asked to sign or execute a new contract or an addendum to the contract. As a veteran, specifically of the XXXX XXXX , I received what I thought was playful teasing about XXXX 's and their relative intelligence as compared to a someone in other branches. I now wonder if this was in fact a true bias that has resulted is disparate treatment. Bottom line is that I simply do not understand how a lender can make material changes to the closing costs and our cash out amounts after we signed/executed a contract.

I refinanced my mortgage with cashcall mortgage and was told there would be no costs at all to me. The loan officer insisted that they needed to add the amount of my next tax payment into the loan amount and that they would pay this payment even though I would be paying all future tax payments directly. This is all well documented in the closing settlement statement, but when I called to check the status of them paying this tax payment, I was told that they were not paying this as it was not an escrow account. I finally spoke to a supervisor ( in XX/XX/2017 ) and he acknowledged that something was not handled correctly and that I would be informed of their resolution by XX/XX/XXXX. As of today ( XX/XX/XXXX ) there still is no resolution, just stalling by this same supervisor who says that there is no person above him that can help me and there is nothing he can do. On XX/XX/2019 the amount of {$3700.00} was taken from my escrow account with Cashcall XXXX Mortgage and never applied to my property taxes. I have called multiple times to try and resolve this situation. During my calls the operators have acknowledged that this appears to have been a mistake on their part as my taxes due were in the amount of {$3600.00} and the incorrect amount of {$3700.00} was taken from account allegedly to pay my property taxes which did not happen. I have received a letter in the mail stating our loan has gone into initiating a forclosure. I signed up for bank draft on XX/XX/2018 via email. I filled out their bank draft form and mailed to the address stated on the form. I thought this amount was being drafted every month. I received no phone calls telling me otherwise. Im now going to over night a check to this company in hopes of repairing the state of this loan. Also, I spent XXXX minutes on the phone with my loan care/cashcall. I finally hung up. XXXX minutes is a ridiculous amount of time to spend waiting. After my XXXX minutes waiting I decided to see if there were other numbers I could use to contact someone and it was the same music, the same prompts, the same wait. I hung up on these numbers also. Hello, I worked for a mortgage lender, XXXX XXXX XXXX, NMLS # XXXX from XXXX - XXXX and from XXXX - XXXX. On XX/XX/XXXX they furloughed me when I had a 67 loans in process. I asked them to pay me for my loans, and they refused. I was even willing to accept a {$15000.00} lump sum for my loans which would have paid over {$40000.00} had they not furloughed me and Impac became very aggressive and cruel with me. Their legal department made threats and accusations against me and even tried to get me fired from my job at Owning by reaching out to the owner of Owning and requesting that he fire me. I made a payment to my mortgage company online on XXXX / XXXX / XXXX . The online instructions said that because the payment was made on a Saturday, it would not post to my account until Monday XXXX / XXXX / XXXX . On XX/XX/19 I made two mortgage loan payments however, the payments were misapplied to the same property. I contacted my mortgage servicer ( Cashcall mortgage/XXXX ) to resolve the error. I was told the reversal was being done however, any credit reporting would have to be requested online via email. Unfortunately, it took approximately 30 days for the matter to be corrected because the initial customer service agent made an error which closed the task ; the second agent did as well. As a result, a second negative late payment was generated and sent to the Credit Bureau. I was instructed to contact them by email to generate a ticket which I have done but the site does not generate a ticket. Mortgage was transferred from IMPAC MORTGAGE CORP. DBA CASHCALL MORTGAGE to XXXX XXXX XXXX I receive notification of transfer on XX/XX/XXXX that the transfer would happen on XX/XX/XXXX. In XXXX of 2020, CashCall Mortgage transferred the servicing of my loan to XXXX XXXX. On XX/XX/2020, CashCall withdrew {$1500.00} ( a mortgage payment ) from my account. XXXX XXXX just kept making errors in calculating the P & I payments they deducted directly from my bank acct, they were doing right for the first 2 months, until I paid $ XXXX to the principal, and again another $ XXXX to the principal, and since they kept making the XXXX up errors! Refinanced my house with Cash Call Mortgage ( CCM ) First payment made on XX/XX/2020 Principal {$480.00} + Interest {$740.00} + Escrow {$410.00} Total {$1600.00} with additional payment of {$500.00} towards principle. When I began to refinance for my house last year, I was told that after the refinance was done that I could have my insurance and property taxes impounded monthly in an escrow account WITHIN A MONTH AFTER THE CLOSING OF THE REINANCE. I was doing a refinance on my home. A family member told me cash call was giving a 3.25 interest rate. So I call. I go through the whole process and even got the paper work notarized. I though it was a dont deal. Boy was I wrong they call me yesterday and told they will not finance my loan. We refinanced our house and included payments to our creditors in the amount of the new loan. The lender, Cash Call Mortgage, wrote checks to pay the creditors directly, but one of the creditors did not receive the check. We have requested a new check for two months now since now we are technically paying for this debt twice at this point- We have already started making payments to Cash call including the amount that should have been paid to the creditor as well as making payments to the creditor until we receive the new check.

Cash Call Mortgage has consistently booked my monthly payments incorrectly resulting in excess interest being charged on a monthly basis and an incorrect outstandling balance on the loan. Cash Call made some " corrections '' to the account but those " corrections '' are erroneous also. They have been uncooperative during the entire time I have dealt with them regarding these problems. I have requested multiple time that my mortgage servicer create an escrow account for me. I have provided all of the information they need both by email and by fax.
