After receiving a letter from the Department of Education, XXXX XXXX XXXX in regards to the extension of your student loan flexibilities. On XX/XX/XXXX and XX/XX/XXXX, I requested for a validation of debt in pursuant to 15 U.S.C. 1692 ( g ). Because, I never received any initial written documentation or notification that disclose it was an attempt to collect a debt. I received two letters from a debt collection agency name XXXX XXXX XXXX contracted by the Department of Education on XX/XX/XXXX and XX/XX/XXXX in regard to an alleged account # XXXX concerning student loans declared in default of {$67000.00}. According to the two letters I received from the XXXX XXXX XXXX this balance includes {$38000.00} in unpaid principal and {$18000.00} in accrued interest. For this reason, the account was transferred to another third-party debt collection agency name Immediate Credit Recovery , Inc., which is entitled by its contract to a commission, {$10000.00} for collection costs, and additional finance charges. Along with the two letters were the alleged copies of the master promissory notes that did not disclose it was an attempt to collect a debt. It did not provide key details about the loan amount ( violation under 15 U.S.C. 1605 determination of finance charge ), finance charges including interest rate, loan fee or similar charge, other charge or any guarantee, fees paid directly to the schools, any amount payable under other systems or additional charges. These promissory notes alleged that I was the borrower, and it did not state if a consumer would owe a debt. Again, these promissory notes do not disclose any adequate amount of the finance charge, the amount to be financed, the total of payments, the number or amount of payments. Whereas none of the promissory notes do not state that such consumer owes any debt in pursuant to 15 U.S.C. 1692 ( b ). Any form of communication received through this correspondence concerning this student loan account with the U.S. Department of Education, Federal Student Aid do not indicate that the debt collector is in the debt collection business or that the communication relates to the collection of a debt. This unfair or deceptive act or practice committed by the assigned college or university which failure to disclose the actual cost on the promissory notes and failure to disclose in the initial written communication with the consumer that the debt collector is attempting to collect a debt and that any information obtained will be used for that purpose. These promissory notes provided were documents authorized, issued, or approved by the Department of Education use for deceptive means to collect or attempt to collect any debt. These letters alleged that I owe multiple debts XXXX XXXX # XXXX, XXXX, XXXX, XXXX, XXXX, XXXX, XXXX, XXXX, XXXX, XXXX, XXXX, XXXX, and XXXX ) and threaten to take negative or legal action. Again, the master promissory note do not include any loan amount, or finance charges that were included. In pursuant to 15 U.S.C. 1692j-Furnishing certain deceptive forms, it is unlawful to design, compile, and furnish any form knowing that such form would be used to create the false belief in a consumer that a person other than the creditor such as the consumer is participating in the collection of or in an attempt to collect a debt. Therefore, this complaint is intended to protect my federally consumers rights and to ensure that it protect the consumer against inaccurate and unfair practices, such as cease unfair or deceptive acts or practices involving student loans and financial aid. In pursuant to violations under 15. U.S.C. 1605 the determination of finance charge shall not include improper fees and amounts, accrued interests, late charges, unpaid principal balance, loan fees or similar charges and amounts imposed by third parties collecting additional finance charges. I never received any loans ; I entered an open-end consumer credit transaction which I extended as a natural person in pursuant to 15. U. S. C. 1602 ( j ). On top of all the false, misleading, and deceptive acts, the Department of Education disclosed nonpublic personal information to affiliated or nonaffiliated third parties ( XXXX XXXX XXXX and Immediate Credit Recovery , Inc. ) repeatedly and violated my consumers rights to privacy under 15 U.S.C. 6802 the obligations with respect to disclosures of personal information. In both letters received from thXXXX XXXX XXXX XXXX, they are urging me to contact the Immediate Credit Recovery , Inc., for repayment options for the alleged balances transferred to this debt collection agency. I have no idea who either of these debt collection agencies are after or before the account was transferred to them, nor do I have any affiliation with these third-party agencies, and I did not enter any consumer credit transaction with these debt collection agencies ( XXXX XXXX XXXX nor Immediate XXXX XXXX XXXX XXXX. or a like ). Again, I did not enter a contract with Immediate Credit Recovery , Inc. Therefore, a third-party debt collection agency who purchase defaulted loans can not lie about improper amounts that consist of finance charges, accrued interests and additional collection fees that I do not owe. On XX/XX/XXXX I sent a cease-and-desist letter to Immediate Credit Recovery , Inc., as I was instructed to by the other debt collection agency name Default Resolution. I demanded for Immediate Credit Recovery , Inc., and all affiliated financial institution to cease all forms of communication with me through any and all mediums, relating to the federal financing, capitalized interest rates or accrued interest, increasing unpaid principal balances, collection fees, loan fees, commission charge or other system or additional finance charges and account number XXXX. Violation under 15 U.S.C. 1692 ( e ) ( 1 ) false representation or implication that debt collector is vouched for, bonded by, or affiliated with the United States or any State. Violation under 15 U.S.C. 15 U.S.C. 1692 ( e ) ( 2 ) the character, amount, or legal status of any debt or finance charge, amount financed and displaying a positive balance. Violation under 15 U.S.C. 15 U.S.C. 1692 ( e ) ( 11 ) the failure to disclose in the initial written communication with the consumer that this is an attempt to collect a debt. Violation under 15 U.S.C. 1692 ( e ) ( 14 ) the use of any business, company, or organization name other than the true name of the debt collectors business, company, or organization. The Department provided more than one debt collector names who was hired to collect this alleged debt. Violation under 15 U.S.C. 1692 ( f ) a debt collector may not use unfair or unconscionable means to collect or attempt to collect any debt. Violation under 15 U.S.C. 1692 ( f ) ( 1 ) the collect of any amount ( including any interest, fee, charge, or expense incidental to the principal obligation ) unless such amount is expressly authorized by the agreement creating the debt or permitted by law. Violation under 15 U.S.C. validation of debt- the promissory notes do not provide the amount of the debt, a copy of the judgement against the consumer, and these debt collecting agencies refuse to provide all pertinent documents. Violation under 15 U.S.C. 1692i legal action by debt collectors. In pursuant to the federal Fair Debt and Collection Practices Act 15 U.S.C. 1692 ( FDCPA ) Immediate Credit Recovery, Inc and a like shall refrain from attempting to collect on these defaulted school loans and violating my consumers rights. Violation under 15 U.S.C. 1692 ( d ) ( 1 ) can not threaten to ruin my reputation by reporting to consumer reporting agencies improper finance charges, accrued interests and amount to collect additional fees. Violation under 15 U.S.C. 1692 ( d ) A debt collector may not engage in any conduct the natural consequence of which is to harass, oppress, or abuse any person in connection with the collection of a debt. These are a few out of the many violations under 15 U.S.C. 1692 Chapter 1692. Along with the cease and desist I sent exhibits for 198 Federally Protected Consumer Rights Violation Under 15 U.S.C. Chapter 41 ( FDCPA, FCRA, Truth in Lending Act and XXXX XXXX XXXX XXXX and to pay the invoice for {$590000.00} for all the violation presented in the exhibits.

My wife and I were attempting to purchase a home using my VA loan benifits. Everything looked good according to our Finance Officer ... nothing to indicate the loan would not go thru ... so it was sent to Processing before being submitted for underwriting. Processing got a hit on my wife on XXXX regarding my wife defaulting on her student loans. Backtrack a little ... ..In XXXX my wife defaulted on her student loan due to us having financial hardships. She was contacted in XXXX stating that her wages were going to be garnished and she acknowledge this. They were garnished from XX/XX/XXXX until XX/XX/XXXX. In XX/XX/XXXX, my wife left her job working for XXXX XXXX XXXX in the State of Texas. She sent the XXXX XXXX XXXX XXXX notice to stop the garnishment of her wages due to being unemployed, to which they acknowledged receipt. About the same time, my wife and I were working with an outside 3rd party loan adviser, XXXX XXXX XXXX XXXXXXXX, XXXX, trying to see if there was any way to reduce our student loans ... .I attended XXXX XXXX and they were in trouble for being a 'For Profit ' school and they had escalated my student loan debt as well as used my entire XXXX GI Bill, and my wife, having been with the State of Texas for 10 years, was told that they could file a Public Service Loan Forgiveness ( PSLF ) tXXXX would remove her from having to pay back her student loan. Step forward a bit ... .We paid XXXX XXXX XXXX XXXX for their services ... my payments ended up increasing but we did not hear anything on my wife, however, we also no longer heard anything from the XXXX XXXX XXXX XXXX XXXX nor from the company the XXXX XXXX XXXX XXXX had given her loan to. Additionally, there were no further reports on my wife 's credit for delinquencies or whatnot. In fact, the last report on my wife 's credit was from the XXXX XXXX XXXX XXXX on XX/XX/XXXX where it stated that the highest balance on the subsidized loan was {$35000.00} and the current balance is {$0.00}, and her unsubsidized loan 's highest balance was {$40.00}, XXXX and the current balance is {$0.00}. It also states that both loans were closed and says that they were closed due to transfer. These reports were from when she originally defaulted on her loan. Nothing had or has been reported since. Apparently, after my wife had sent in the notification to stop wage garnishment, her loans were immediately placed in double default to which they 1 ) were reported to XXXX, thus blocking any chance of us ever using my VA loan or an FHA loan, and 2 ) have been accruing an interest of $ XXXXday that is has been in double default. Now, we had filed this paperwork for the PSLF, my wife had also informed the XXXX XXXX XXXX XXXX to stop garnishment ( not that they can garnish nothing ), and the last report on her credit stated the balance owed was {$0.00}, had been closed and had been transferred. We naturally assumed that it had been actually forgiven and the transfer had meant it had been transferred to closing. Our complaint is this ... .after my wife sent in the request to stop wage garnishment due to her being unemployed, at no time EVER did either the XXXX XXXX XXXX XXXX XXXXXXXX nor whomever was holding the loan on their behalf after XXXX reach out to us to make payments separate from the wage garnishment, nor did either of them EVER report ANYTHING to any one of the 3 credit bureaus. As a result, we had no idea that her loan had in fact not been forgiven and we were still required to pay. As a result, we ended up getting blindsided after we had made an offer on a house, finding out that I will not be able to use my VA loan, and worse, my wife 's student loans are now in excess of {$110000.00} due to a $ 10.82/day fee/interest/penalty being charged over the span of 18 months, all because no one ever contacted us to let us know the debt still existed, nor to attempt to make payment arrangements with us. After all, we pay my student loans, so why would we not pay hers? We have reached out to the XXXX XXXX XXXX XXXX about this matter and they automatically refer us to Immediate Credit Recovery ( ICR ), the current holder of her loans. When my wife called ICR, she was informed that her loan would not come out of default until she either 1 ) paid the entire debt in full, or 2 ) paid $ 115,000+ and made payment arrangements on the remainder, both of which we can not do. They then told my wife that they might be able to make payment arrangements of a lesser monthly amount upon receipt of proof of mine and my wife 's income ( last 2 pay stubs for each ) and proof of my student loan, to which we did, and that after 9 payments, they could remove the default loans from XXXX. When I called, I was pretty much told the same but instead was told that the loans could come off after making 6 payments. I reached out to XXXX XXXX and explained the situation to them and they replied for me to contact the XXXX XXXXXXXX XXXX XXXX XXXXXXXX and request to have the XXXX report suppressed. My wife then called the XXXX XXXXXXXX XXXX XXXXXXXX and eventually managed to talk to someone who told my wife that they could not suppress the report until she had made 3 payments, or else paid the debt off in full. She requested to speak to an administrator or supervisor and was denied. I asked my wife if she informed them of who it was that told us that we could request for the to suppress the report to which she replied that she did not think of doing so. I then contacted the XXXX XXXXXXXX XXXX XXXXXXXX requesting to have the report suppressed and was told that the report could not be suppressed until I had paid all but {$25.00} of the debt. If I could pay all but {$25.00}, why not pay that last bit and have it removed from being paid and forgo suppressing it? I was then told that there was no such thing as suppressing the record. I was also told that the loans would remain on the XXXX report until they were paid off. When I asked to speak to an administrator or supervisor, I too was denied. I reached back out to XXXX XXXX and was told that a suppression does exist but only an administator or supervisor has the authority to do so and to reach out to one of them. I informed him of what happened when we did and he stated again that they were the only ones who could do so. Now, can the report be removed from XXXX prior to being paid in full? If so, how many payments must be made ... ..3 months, 6 months, 9 months? Can the report be suppressed? If so, how can we get in touch with a supervisor to have it done? Immediate Credit Recovery has since informed us that the payments that they have decided we could make would equal just over {$450.00} per month. With a $ 10.82/day fee/penalty/interest being assessed, in a 30 day month, I calculated that we would only be making payments towards my wife 's student loans in the amount of exactly {$110.00}, all the rest would be going to pay this ridiculously high daily charge. We are on the XXXX report due a series of unfortunately events but more so due to them not contacting us to inform us that payments still needed to be made. Had they done their job, in the very least, and reported the loans on my wife 's credit, we would have known the loans still existed and needed paying. Neither the XXXX XXXX XXXX XXXX nor ICS can explain to us the absence of reporting, why the last report was in XXXX of XXXX, nor why no one ever reached out to us via email, phone, or US Postal mail correspondence. ICS did however state that they sent a letter to us in XXXX of XXXX. The problem, according to one of the people I spoke with at ICS, the envelopes do not state the sender and only contain a XXXX XXXX address. Unfortunately, when I see mail in this format, I toss it as being junk as more than 90 % of junk mail I receive comes in this format. Had they had their name on the envelope, I might have opened it and addressed this issue sooner.

I received a collection notice from XXXX XXXX XXXX XXXX and on XX/XX/2017 I mailed them a dispute via certified letter which made it a legal document. In the dispute I requested the following : XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, NY XXXX RE : Account XXXX XXXX To Whom It May Concern, This letter is regarding File # Account # XXXX, which you claim I owe XXXXXXXX. This is my formal notice that your claim is disputed. I am requesting validation, made pursuant to the Fair Debt Collection Practices Act and the Fair Credit Reporting Act, along with the corresponding local state laws. Please note that I am requesting validation ; that is competent evidence bearing my signature, showing that I have ( or ever had ) some contractual obligation to pay XXXX XXXX XXXX XXXX. On XXXX XXXX, XXXX, I received a letter from Immediate Credit Recovery dated XXXX XXXX, XXXX on Department of Education letterhead, stating that I had 30 days to address a potential wage garnishment - either through a hearing or making arrangements to consolidate or pay the debt. It is the first letter of any kind that I have received from the debt collector. Prior to receipt of the letter, I was garnished by the Department of Education for over 3 years to pay back student loans that fell into default after I was diagnosed with XXXX XXXX in the fall of XXXX. I was doing well financially and attending XXXX University at the time. I had great credit, credit cards and a car loan that I paid on time each month prior to diagnosis. Needless to say I feel behind on almost every bill and my credit plummeted. I soon fell into default on my student loans. I never resumed schooling at XXXX University and ended my pursuit of a degree during my junior year. Fast forward to the present time - I can say that I am still recovering from my illness and the stress and trauma over my lack of financial adequacy. I feel that I have been beaten down by creditors and collection agencies for years, only to fall victim by their many tactics and deceitful practices. With regard to the letter from Immediate Credit Recovery, it stated that the Department of Education would initiate a wage garnishment if I did not act within 30 days to either contest the debt or make arrangements to pay based on income. I made a call within the week to address my concern and to also address the untimely mailing, which did not allot me 30 days to comply. After speaking with XXXX XXXX XXXX on the phone, it was my understanding that I would receive correspondence with guidance on submitting income documentation, bills etc. to support a payment arrangement. I never received a correspondence. However during the time that I was waiting for a letter via U.S. mail or at the very least, an email, I began working on gathering the income verification, lease information and billing information requested. While doing so, I ran into constraints around getting the requested paperwork. I reached out to XXXX XXXX on several occasions to request either an adjustment to the types of documentation needed or more time to gather the information. I was not able to make a second phone contact or any further contact with the Immediate Credit Recovery representative, XXXX XXXX within the 30 day time frame. I feel I was intentionally given the run around by other service representatives in and outside of the AWG department. I had been informed on two separate calls to the collection agency that XXXX XXXX 's team was in a meeting and would handle calls soon after. I never received a call. Because of how quickly things transpired to move against me, I feel that Immediate Credit Recovery acted unfairly and in a way that ensured I would be moved into administrative wage garnishment. They would stand to gain over 6,000 in fees for managing the debt collection, so I believe it was in their best interest not to counsel me fully, nor give me the necessary tools and guidance to avoid wage garnishment. Therefore, I believe there was incentive not to send letters to me prior to wage garnishment notification and not to correspond with me via telephone or send me emails to help me send in the needed paperwork to stop garnishment. After much research, I found that I could potentially have my student loans discharged if it was determined that I had a XXXX XXXX XXXX XXXX I immediately initiated the process on the eve of XXXX XXXX, XXXX, as I new a wage garnishment would be a burden to my family - as I had been garnished for over 3 years for student loans just prior to the notification from Immediate Credit Recovery. I also did research to find that the end of a 30 day notice can not fall on a Sunday, so I felt I would be safe with initiating an application for XXXX XXXX XXXX XXXX on XXXX XXXX, via XXXX. XXXX was quick to respond and begin the process, with a first step to request that the Department of Education and Immediate Credit Recovery cease collections until my application was received and reviewed. I received a letter from XXXX on XXXX XXXX, XXXX - approximately one week after their dated correspondence of XXXX XXXX, XXXX. The letter enclosed an application and next steps to follow for processing. The letter also noted all loans and amounts outstanding, the creditor ( Dept. of Ed ) and that the loan holders were contacted and instructed to suspend collection activity on the loans for a period of 120 days beginning XXXX XXXX, XXXX and ending XXXX XXXX, XXXX. It also stated that I would not be required to make voluntary payments and that the suspension will give me time to complete the TPD application and return for processing. It also stated that any wage garnishment payments already in will have to continue until a decision is made to discharge the loan debts. Receiving the notification gave me a sense of relief and I felt a burden lift. It was n't until I received a letter for the Department of Education today, XXXX XXXX, XXXX, that my stress and fear returned. The letter is dated XXXX XXXX, XXXX and is a FINAL Notice of Wage Garnishment for Debt Owed to U.S. Government. The language stated that garnishment would begin and my employer notified. I immediately called Immediate Credit Recovery and got an automated system. I could not connect with my representative XXXX XXXX or an alternate representative, as I was not directed to any other person for assistance. I then called XXXX and was met with great concern about the process. XXXX stated that the followed through with due process and that the Department of Education and Immediate Credit Recovery may be acting in a way that could be deemed unfair and not in keeping with timelines and fair collection activity. Seeing that I have gotten little relief from Immediate Credit Recovery, I am writing to you to throw myself at the mercy of your office and plead for more time to resolve this issue or at the very least find out if I am eligible for loan discharge. A wage garnishment would be a hardship on me and my family. I am also exploring bankruptcy as a last attempt to keep my financial situation as stable as possible. On XX/XX/XXXX, I filed a complaint with CFPB. I explained in my previous complaint how a collection agent was garnishing my wages and that the debt was not even valid. The response from CFPB was to contact the assigned collection agent. I spoke with XXXX XXXX, Manager with the Wage Garnishment Dept of Immediate Credit Recovery. She gave me the address where to send my Request for Hearing at the Dept of Education 's Wage Garnishment Hearing Branch. I send my ink-signed letter requesting to stop the Wage Garnishment along with my budget information and supporting documentation showing my budget was already in the " red '' prior to the garnishment and that the garnishment was causing extreme havoc on my finances. Near the end of XXXX, a rep from ICR called me to say they had received a response from the Dept of Education Wage Garnishment Hearing Branch - there were two parts to the response : 1. one document was poor quality and I needed to send a better copy ; 2. Nothing else needs to be done was the response from Dept of Ed. I resent a better copy of the document requested, which was received on XX/XX/XXXX. I called on XX/XX/XXXX and was told they needed 21 days to review and that I should call back on XX/XX/XXXX. I called back on XX/XX/XXXX and a rep with the XXXX XXXX XXXX sent a fax to request to stop the Wage Garnishment. The following Friday, my pay was still reduced so I called later that afternoon ( XX/XX/XXXX ). I was told the fax was stopped and did not go to my Payroll Dept because I did not have a Hardship on file. I explained that I did have a Hardship on file and that a decision had already been made. The XXXX XXXX rep told me that I did not have a Hardship on file because I did not use their particular form. I explained that I was told by XXXX XXXX of ICR that the only problem with using this form was that I would be agreeing to the debt. I could not sign and send that form since I do not agree with the debt as my loan was fraudulently refinanced prior to XXXX ( that is when I first learned of it ). I also explained that I had sent an ink-signed letter requesting the Wage Garnishment be stopped and also sent a detailed budget along with supporting documents. I asked how could I not have a Hardship on file when the Dept of Education Wage Garnishment Hearing Branch requested a better copy of one of my documents. I also reminded them that you will see notes in my file from XX/XX/XXXX which say " Nothing Else Needs to be Done ''. I have spoken with countless reps of XXXX XXXX XXXX. None seems to scroll/read the notes all the way down and just copies what the last person said which is that I do not have a Hardship on file. I am not able to reach the Dept of Ed. When I call the Dept of Education, I am required to enter my SS number. Once my SS number is entered, I am automatically transferred to the XXXX XXXX XXXX. This entity is a contractor hired by the Dept of Education and they are undermining the Dept of Education 's decision in the matter. My financial situation has deteriorated even more since this garnishment started. I now have a new credit card which is almost at its limit and my other two are at their limit. I also have a new medical debt since this garnishment has started ( not even included on the budget I sent ). I am making payments to the XXXX XXXX Hospital as I had to have a XXXX due to a large XXXX XXXX. I am XXXX and can not even keep funds in my 401K. I have no regular savings or retirement savings and I am trying to get my grandson through school. I have sent another letter of complaint dated XX/XX/XXXX directly to the Dept of Education Wage Garnishment Hearing Branch recounting what has happened and asked if someone could contact me - nothing to date. I have asked two different employees of the XXXX XXXX XXXX to send me the Hardship form to fill out ( I will cross through the part which says I am agreeing to this debt ) and was told twice it was sent - to date, I have not received a copy of that form by mail or email. I asked to speak with a supervisor and asked that supervisor to escalate my case to her manager ( since she said I could not speak with a manager ). I was told they could not call me back, they could not email me back and they could not send a response in the regular mail. The only way for me to learn what the manager said about my case was to call back and check. That supervisor said to call back in two days. When I did, the rep on the phone said there was no note of my request to be escalated to a manager. I am now starting to think they are playing games with me because I filed a complaint with the CFPB - they are going to show me. My request is for someone with the CFPB to inquire and find out exactly what is going on with my case - where do I stand - when will this garnishment stop. I am making a complaint against Immediate Credit Recovery, XXXX XXXX XXXX and XXXX XXXX XXXX. Immediate Credit Recovery, XXXX XXXX, and The Department of Educations XXXX XXXX XXXX has stated that I have 3 unpaid student loans that were obtained in XXXX to XXXX to attend the University XXXX XXXX. I never signed for or received Federal Direct Stafford Loans when I attended the University XXXX XXXX. I did attend the University XXXX XXXX in XXXX and XXXX with student loans that I obtained through XXXX XXXX. Throughout the rest of this document I will be referring to XXXX XXXX by their new name XXXX. The Federal government is currently garnishing my paycheck and collecting my tax refunds for some additional student loans I never signed for, received, or agreed to. The legal basis for my claim falls under The Fair Debt Collections Practices Act, 15 U.S.C. 1692e, et seq. Immediate Credit Recovery, XXXX XXXX XXXX, and The Department of Educations XXXX XXXX XXXX violated FDCPA 809 Validation of debts [ 15 USC 1692g ] ( b ) disputed debts. If the consumer notifies the debt collector in writing within the thirty-day period described in subsection ( a ) that the debt, or any portion thereof, is disputed, or that the consumer requests the name and address of the original creditor, the debt collector shall cease collection of the debt, or any disputed portion thereof, until the debt collector obtains verification of the debt or any copy of a judgment, or the name and address of the original creditor, and a copy of such verification or judgment, or name and address of the original creditor, is mailed to the consumer by the debt collector. Collection activities and communications that do not otherwise violate this title may continue during the 30-day period referred to in subsection ( a ) unless the consumer has notified the debt collector in writing that the debt, or any portion of the debt, is disputed or that the consumer requests the name and address of the original creditor. Any collection activities and communication during the 30-day period may not overshadow or be inconsistent with the disclosure of the consumer 's right to dispute the debt or request the name and address of the original creditor. I disputed this debt on three different occasions by mail on XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX & I have copies of the proof. I mailed in a request for hearing packet to dispute this debt & requested to be called over the phone for the hearing. I did not receive a phone call for the hearing. I only received letters in the mail from the debt collectors ignoring my dispute & evidence that I supplied for my only loans that I had through XXXX XXXX. When I asked the collection agencies to supply me with the information of the original creditor the customer service representative with Immediate Credit Recovery responded, " I dont know, during multiple phone conversations. These collections agencies then started to garnish my paycheck & tax refunds. The collection agencies have not been able to prove the validity of this debt. The only thing these collection agencies have is data of when I went to college, the year, the school, & the cost of what my tuition was at the time from the NSLDS website. They have not provided any evidence showing that additional money or tuition was disbursed to the college I attended from another loan provider. I however, was able to supply school account records, my student loan servicer Navient records, a copy of the check & debit card payments, that covered all of my tuition cost to the University XXXX XXXX. Also, I provided proof of bank records showing proof that my only student loans through XXXX were already paid in full. The collection agencies are still claiming I owe on a debt that I never signed for or agreed to. I contacted the local police & filed a police report for a copy of a master promissory note that I never signed for or agreed to. The collection agencies have not been able to prove the validity of this debt. The forged document from the collection agencies is for the William D. Ford Program. Exhibit D was to big to attach in my supporting document section. While Immediate Credit Recovery may say that there were phone conversations about this debt in question I never once said, that I agreed to this debt or that I owe on this debt. I asked as many questions as possible & had conversations with the agency about the debt in question. As I needed to make sure that I had as much information as possible to make sure that the next steps that I took were the correct steps in resolving this issue. A phone conversation between me & the collection agency about a fraudulent debt in my name with my social security number no way implies that I agree that this debt is valid or that I even owe on this debt.

I needed to finance my home that i live in out of my sisters name because she's getting married and i need to get the home in my own name. I started working with a loan officer last year and paid to have someone help me fix things on my credit. The loan officer told me that i needed to get my student loans in good standings because with them in default in wouldn't qualify for any home loan having a student loan in default. So back in XX/XX/2018 I contacted immediate credit recovery to see what i needed to do to get my student loans in good standings so that i could be eligible to get my home loan. They told me that i could do a rehabilitation loan and after 9 months of consecutive payments then the loans would not be considered in default any longer and it would be shown in good standings and then i would be able to get my home loan because it wouldnt be considered a student loans in default. So i setup and sent in the documentation that they required and then every month they would send me a reminder that said the {$5.00} will come out this day. So my sister has given me the 9 months to get that in good standings so that i would be eligible to have the house in my name. The loan officer has all the paperwork that i needed to get in order to close on the house. One of the required Documents was a document from immediate credit recovery showing the account numbers and the rehabilitation amount. Well i called immediate credit recovery and told them what i needed, the first person that i talked to told me that the rehabilitation was only on 2 of my loans and the other 6 were not eligible. So i said no that must be a mistake, there would be no reason i told the lady to rehab 2 of my loans while the other 6 were still in default. That would still block me from getting a home loan and make absolutely no sense for me to have done that and have waited 9 months. She agreed and then said well i would have to listen to the phone call to determine if i was mislead to believe that it was for all of my loans and not just 2 of them. After a couple days of calling back she had finally listened to the original phone call and said that she apologized that i was not made aware that the rehabilitation was only for the 2 loans, she said that this was a mistake and i should have been told 2 were going to be out of default but i still had 6 loans also serviced by them that were going to be considered negative. Every month the {$5.00} letter i received would say total amount due at the top and would have like {$64000.00}. The lady said im not sure how i can make this right all i can offer you is a consolidation of all your loans at this point. I feel like they mislead me from the beginning and that should have been offered in the beginning, or should have even mentioned that it was only for a couple of the loans. So now my sister is going to have to sell the home that i have lived in for 5 years so that she can buy herself a new home. I have all the approvals for the home loan and was supposed to close on XX/XX/XXXX, but now having 6 student loans in default still i will not be able to get the home loan and will be put out of my home. So i tried to fill out the consolidation to see if there is any way that would help my situation after being mislead for 9 months, but they gave me the wrong amounts of the loans that i needed to consolidate and they gave me the wrong account numbers as well. So im not sure if in the beginning they included all the loans only to find out that 2 were eligible and just didnt tell me but the fact of the matter is they made a mistake either in the beggining or when i called 3 weeks ago for the account numbers of the loans, and then they realized that i had been told misleading incorrect information. In the end they can apologize and that still doesnt help me keep my home, someone needs to be held accountable and they should not be able to mislead anyone else into something that is not what was even asked for. They should not be able as a debt collector to not provide me with false or inaccurate information with no repercussions in the end. The lady from immediate credit that i spoke with said that she had reported the issue to whomever that may be, however that does not help me now.

I have had a XXXX loan that I have disputed based on a default date of XXXX. I appealed this repeatedly in the past because I had documentation stating that my loan was deferred until XXXX. After being passed around to several agencies, I was told that my loan was repurchased by XXXX and in good standing, which turned out to be false. Although I fought this for years, I ended up paying off my XXXX and XXXX loans with no issues. The XXXX loans continued to haunt me. I'vetried resolving this for many years, but kept getting passed around to different agencies. I have never seen any offsets or garnishments applied to the loan balance since XXXX. Fast forward to XXXX XXXX, I found my loan information on XXXX and saw that my loan was with XXXX XXXX XXXX XXXX at the XXXX. I paid off the amount listed and sent it to the agency. One month later, I receive a letter stating that they had received the funds and forwarded it to XXXX. XXXX in XXXX and all future payments should be sent there. Two days later, I received a document stating " Congratulations! You have expressed an interest in the Rehabilitaion Program '' requesting my financial information. It had Immediate Credit Recovery at the top of the page. There is no identification of who they were representing, nor had I requested any service. I thought it was a fishing scam and ignored it. But when I called the XXXX, I found out that my loan was with Immediate Recovery and I still owed thousands on my loan! I was told that if I 'd contacted ICR prior to paying the loan, I would not owe anything nor would I have had to pay the full amount! I explained that I 'd never heard of/from this company but asked to be transferred to ICR to resolve my loan. Each representative that I spoke with at ICR told me that I should have contacted them first before paying because I could have negotiated a payoff lower than I sent. Again, I explained that I never heard of/from them. No contact whatsoever & XXXX XXXX was listed as the owner of my loan. They proceeded to tell me that I now must pay several thousand more to satisfy my loan. I asked why and they stated " because you already paid the balance. '' Confused, I asked why I would have to pay extra to satisfy the loan, especially since a negotiated payoff would have been less than I already paid? I was told again that because I already paid the loan, I was being penalized and that it could no longer be negotiated. I asked for a balance statement and was told that they could not give me XXXX since I planned to dispute the balance. I contacted the XXXX ( XXXX ) again requesting to dispute the remaining amount based on several factors. I sent my dispute & supporting documentation were delivered on XXXX XXXX ( USPS delivery confirmation receipt ). On XXXX, I called XXXX and was told it had not been received and that I should not send certified mail to a XXXX XXXX XXXX I was told to re-send the request by regular mail. I spoke with a supervisor to find out if there was a delay or backlog in the mailroom or any way to check. She offered no solution, cut me off and said the loan was old. I requested a payment history and was told to write to the same address that I have been requesting this info from for years at XXXX XXXX XXXX Texas, the same XXXX that says they 've never received my correspondence ; the same XXXX that never responds to my written requests. I was also told by this supervisor that my loans went into default on XXXX/XXXX/XXXX not XXXX ( when I started getting collection calls & letters ), not XXXX, XXXX or XXXX ( as listed on nslds.gov )! Affidavit of truth of a matter stated and object of verification is to assure good faith in averments or statements of a party. What this means is that your company must be willing and able to produce a document in your files that proves the account in dispute belongs to me and the information is accurate and you must be able to do this in a court of law if I file a lawsuit against you. Someone in your company must authenticate the documents in your files that were used to verify the disputed account and to do this they must have 1st hand knowledge of the alleged account and all that has ever transpired for the alleged account, under oath and under the penalty of perjury. You have ignored my request to provide me with the documents that you have in your files that you used to verify the disputed account which means that you have NOT validated at all. The law is very clear as to the Civil liability and the remedy available to me for negligent noncompliance ( Section 617 ) if you fail to comply with this Federal Law. On XX/XX/XXXX I noticed that my paycheck was short {$220.00}. After speaking with my HR dept. I realized that I was being garnished for my student loans. I called my student loan servicer, the US Department of Education. They told me that since I was in default they transferred my accounts to a debt collect called Immediate Credit Recovery , Inc. So I contacted Immediate Credit Recovery. A represented answered and as soon as I mentioned that I was being garnished I was placed on hold and blind transferred to their garnishments department. No one answered so I had to leave a voice message that went to a general mail box. When no one returned my call I called them again the next day. The next day XX/XX/XXXX I spent my entire lunch hour and even ended going over by 45 minutes trying to get someone to discuss the situation with me. To make a long story short I called 4 different times. Each time the rep that answered would just transfer me directly to the garnishment department and no one in garnishments ever answered. By this time I was extremely upset and I called my original servicer, the US Department of Education. I asked to speak with a manager and I made a complaint letting them know that their sub-servicer Immediate Credit Recovery , Inc. was not returning calls and that no one in the garnishment department was available. on XX/XX/XXXX after many more days of trying to get through I begged one of the reps to walk over to the garnishment department to see if they could get someone to talk to me. That worked. I spoke with a woman in the garnishment department who was pleasant and told me about the loan rehabilitation program. She told me that she would email the info I needed to get started and that I needed to set up the initial payment over the phone with her. I told her that I would call her back with the debit card info later that day and that I would wait for her email. I never received her email and I was never able to get a hold of anyone in the garnishment department ever again and it has been several months. The garnishment rep told me that the 1st date of my rehabilitation plan would start on XX/XX/XXXX. And that I needed to make sure that I got my 1st payment in on that date. ( Mind you the whole time I am still being garnished a total of {$430.00} per month. ) But I digress. So on XX/XX/XXXX I attempted to reach Immediate Credit Recovery, Inc. for hours while NO ONE answered at all. I decided to call my original servicer again to complain. My original servicer ended up having to take the payment from me. Today is XX/XX/XXXX and I am still being garnished and Immediate Credit Recovery , Inc. is still not returning the voicemails that I leave on a daily basis. The one and only lady I spoke with in the garnishment department told me they are not allowed to call me, that I need to call them only. But yet their voice mail states that someone will get back to me and no one ever does. Plus the customer service reps state that they can not give me any information about my account because my account is with the " garnishment '' department. PLEASE HELP. XXXX XXXX XXXX assumed my student loan. In XXXX they contacted me stating that my loan was in default and no longer on deferment and I had a balance of {$10000.00}. They stated I could not make payment arrangements and had to pay it in full because it was in default. They suggested that I take out a personal loan or borrow from a family member to pay it. I couldnt do anything like that so I was at a loss. They submitted a garnishment order to my employer that I had just started working for and never provided a 30 day notice on XX/XX/XXXX. I got the notice from my employer a week before garnishments were to start. The order stated that I owed {$10000.00} and I was going to be garnished for {$16000.00} ( added fees ) until it was paid. I was then contacted in XXXX by XXXX XXXX stating that I could reduce my debt if I made additional monthly payments of {$5.00}. If I made these payments for 12 months then they would remove the collection fees and consolidate the 3 loans I had so that the debt would pay down faster. Additional payments started XX/XX/XXXX. I was not aware how much had been paid out in garnishments yet. XX/XX/XXXX my employer was sent a garnishment cancellation notice. I was contacted shortly after stating that my has been paid and that my employer was notified to discontinue garnishments.They stated they would forward the information to the department of education and they will contact and provide me with my release. The last payment was XX/XX/XXXX. They continued to automatically deduct the {$5.00} additional payments though until XX/XX/XXXX. I was contacted 2 months later stating they were calling in regard to my student to set up payment arrangement for the remaining {$3000.00} balance. I stated my loan was paid, they said this is what they got from the servicer, after a back and forth they told me to make {$50.00} payments to keep it out of default while they figured out what was going on. called every month to check the status and they said that I did a loan recovery agreement to get out of default. I told them no I didnt sign anything for that it was out default because it was paid off. The recovery agreement is where you pay 9 additional payments during the garnishment for 10 consecutive months. If that is successful your garnishments will stop and they will take your loan out of default and set up a payment plan. I made additional payments from XX/XX/XXXX to XX/XX/XXXX. Thats 16 months not 10. Also I payed through garnishment and additional payments a total of {$17000.00}. Thats {$1000.00} more than the garnishment order. They also never consolidated the 3 loans. I refused to keep paying and now the {$3000.00} is in default. Immediate Credit recovery has now submitted garnishment. I just found out. I never got a 30 day notice. When I called to tell them I dont owe this they stated that I submitted a no contact order so they couldnt send me notice and cant talk to me about it. I never contacted them and thats not even legal for them to do. Im entitled to a hearing to stop the garnishment from happening thats why Im suppose to be given notice. Ive been trying to clear this up for years and they finally in XXXX XXXX XXXX XXXX sent me my payment history after stating they didnt have that information.

To Whom This May Concern, My tax return was taken and given to the department of education without prior. One rep said then sent it to my current address, one said that they sent it to past address. I never got the notification to set up a payment plan or else I would have! I am in significant economic hardship and about to be homeless with my XXXX kids .... but because my mother will not file a court order eviction they will not let me process the form to get my income tax reimbursed. In this move I lost everything including most personal belongings, household belongings ( washer/dryer/bed/dressers/refrigerator, etc ), and home. I was forced to temporarily move into my mothers house with my XXXX children and stay with a friend on weekends/holidays to decrease stress and burden on them, until we could afford to find a house to live in. I received a letter from the U.S. Department of Education that I owed in full payments on student loans for the University of XXXX. The only student loans that I had with the University of XXXX had already been paid off in full as of XXXX. XXXX XXXX XXXX Federal Direct Loans was the program and my loan servicer was XXXX as listed on the .gov chart website for the Federal Direct Loan student loans servicers. I have provided bank records, payments made to XXXX, my account information with XXXX & the University of XXXX school records matching my payment records from XXXX. In addition to the master promissory note with XXXX XXXX XXXX Federal Direct Loans & XXXX promissory notes that the loan servicer required. The U.S. Department of Education is refusing to accept my proof that the only loans I had were through XXXX & they are refusing to accept that my loans were paid in full. They stated that I never had loans serviced with Navient even after I provided hard evidence and records from XXXX showing my student loan account history with XXXX and the school the loans were with which was the University of XXXX. When my personal student loan information was transferred from XXXX to XXXX XXXX apparently none of the payments that were made are even being credited because again they want to state that these loans arent the same as my XXXX student loans. I never signed a contract or agreement with the Immediate Credit Recovery XXXX XXXX. Immediate Credit Recovery XXXX XXXX can not collect any amount of money that is not permitted by law or by agreement. " The Fair Debt Collection Practices Act states that the debt collector can not collect any amount of money that is not authorized by the agreement creating the debt or permitted by law. Because there is no agreement between the collector and the alleged debtor, no collection can be sustained. Whereas no relationship exists between Immediate Credit Recovery XXXX XXXX and me, and whereas I never signed a contract or agreement with Immediate Credit Recovery XXXX XXXX, I cite Lack of Privity. Just because an assignment clause exists in a credit agreement does not mean that it is sufficient to create a new obligation with the Immediate Credit Recovery XXXX XXXX. The assignment clause merely takes away the rights of XXXX XXXX College to collect if they decide to assign it to another company, in this case Immediate Credit Recovery XXXX XXXX. Immediate Credit Recovery XXXX XXXX would then have to offer me a new contract, I would have to agree to its terms, and I would finally have to sign this new contract. If I have not signed a contract with Immediate Credit Recovery XXXX XXXX, I owe them nothing. I know my rights, and I am fully prepared to exercise them. You have already admitted in writing that you do not have a contract with me. Therefore, you have no proof that you have ever provided any services to me. There was no meeting of the minds, a necessary element of a valid contract, no contract exists. Since there was no meeting of the minds between me and Immediate Credit Recovery XXXX XXXX, which is a necessary element required to create a legal and binding contract between the two of us, your claim is repudiated. I received a Notice of Proposed Wage Garnishment dated XXXX XXXX, 2016. The letter indicates that I have 30 days to request hearing and/or agree to a voluntary payment arrangement equal to XXXX % of my " disposable income ''. In an effort to avoid garnishment on XX/XX/XXXX, I contacted Immediate Credit Recovery, the current servicer of the loan. I spoke with an agent, XXXX at extension XXXX. Initially I was advised that my loan did not qualify for rehabilitation. I inquired why I was eligible two months prior but not eligible now, she double checked and determined that the loan was eligible for rehabilitation. She proceeded to capture financial information ( gross pay less taxes, insurance and expenses ) and calculated a potential monthly payment amount, contingent on confirmation of the financial information provided. The proposed plan amount {$920.00}, my calculated disposable income is $ XXXX/month. I was also provided an option to settle the balance for approx. $ XXXX however am unable to settle the balance. On XX/XX/XXXX I reached out to XXXX to confirm how the proposed rehab/plan amount was calculated, she indicated that it is based on XXXX % of my AGI. She also indicated that there was another repayment plan which takes expenses into account, she referred to this as a " reasonable and affordable calculator '' however again, is not based on XXXX % of my disposable income as indicated in the letter. I asked XXXX to clarify that the option which was written in the letter, 15 % of disposable income, is not an option for repayment - she confirmed. On XXXX/XXXX/2016, I called the Dept. of Ed and spoke with someone in customer service who referred me back to Immediate Credit Recovery, Special Assistance Unit, explaining my concerns and requesting a call back. I called again on XXXX/XXXX/2016 and left message. To date, I have not received a response to either message and indicated in both that I am attempting to respond timely to avoid garnishment as indicated in the letter, action is required by XXXX. My concern is that the letter is clear, I have an option to avoid garnishment and by agreeing to repay XXXX % of my disposable income. I wish to repay XXXX % of my disposable income however Immediate Credit Recovery is not providing this as an option and is non-responsive to escalated calls. Re : School loan Account # XXXX I am writing to ask your help in resolving my efforts to pay off my son 's school loan. Please note that I am not an account holder or co-signer. He has given me his written permission to negotiate on his behalf with the Department of Education, Immediate Credit Recovery Inc. ( the collection agency ) and any other interested party. My attorney advised me that, by statute, a payment of 90 % of the amount then due would satisfy the loan and end the garnishment. When I first spoke to Immediate Credit Recovery Inc., I was instructed to fax my son 's permission before they could speak to me. I don't have a fax, and they refused to accept an email with attached photo. I tried calling the Department of Education. It required all my persistence just to get the correct phone number, and then I was greeted with an insurmountable phone tree. The tree did tell me that as of XX/XX/XXXX he owed {$68000.00}. ( What about my XXXX check? What about his garnishment and tax returns? ) On XX/XX/XXXX, I sent appeals to both the DOE and ICR for correction, and included XXXX XXXX permission and documentation. I had a student loan that went into collection with Immediate Credit Recovery twenty or more years ago. The original loan amount was {$10000.00} and the interest rate 10 %. I set up automatic payments of {$250.00} a month that were deducted twice a month for at least ten of these years. I believe it was XX/XX/XXXX when they disclosed to me they could no longer make automatic deductions, so they began calling me to authorize payment. The original servicer was extremely rude and nasty and I had to speak to a supervisor in order to get someone humane. I also reduced my payments to once monthly, or {$120.00}. In XX/XX/XXXX I asked to settle the account for {$5000.00}. I was told that amount would never be authorized and I needed to make a payment of at least {$6200.00} to reflect 50 % of the remaining balance ( {$12000.00} on a {$10000.00} loan ). I called the school directly ( XXXX University ) and after several back and forth conversations between ICR, XXXX and myself the school authorized {$5000.00}. By this time however I had discovered that my payments to ICR had reached nearly {$30000.00} -- three times the amount borrowed. ICR could not explain to me why on-going payments were needed or even a lump sum to pay off the loan. In addition the school agreed that a 10 % interest rate on a student loan was now considered exorbitant ; however the school only communicated with me through ICR, which told me the offer to settle would expire within three business days. I called the CFPB three times for advice on whether or not to settle the account but was told there was no representative who could listen to my situation and guide me, and that I could only file a complaint. I did not want the collection agency to make my life any harder so I made the payment. After the payment was made, the servicer called to ask me to put in writing that i authorized each and every payment made on the account, which is in fact untrue. This is evidenced by the fact that i immediately cut my monthly payments in half when i was contacted by a live representative in XX/XX/XXXX. At this point I decided to make a complaint.

I XXXX XXXX have attempted to resolve my defaulted student loans, however, Immediate credit recovery is refusing to process my XXXX paperwork based on me being unable to supply my wife 's income information. I spoke to them in regards to this matter onXX/XX/XXXX( previously as well, sent Rehab docs back inXX/XX/XXXX but never heard back and confirmed onXX/XX/XXXX they were calling an old number ; the paperwork emailed to them had all my correct information on it though ). They are currently garnishing my wages, I have provided them my financial disclosure and 2 pay stubs, for myself, as they have asked. ICR is still seeking to obtain my wife 's income but we file separately on our taxes ( have been and will continue to do ) and she refuses to furnish any income docs as we keep bills/income separate due to her not wanting to be a part of my personal debts acquired prior to our marriage ). I do not have access to her paystubs as she can only access those via online with her secured log ins ; which she is refusing to furnish. My understanding of all the department of eds programs are that because we file separate and she is unwilling to provide me the information, I will be treated as separate. Please review this matter and assist me with the Rehab as I can not afford the garnishment and would like to rectify that by entering into a Rehabilitation with the collection agency.

Originally I had attempted to consolidate out of default inXX/XX/XXXX, that was denied once ICR placed a garnishment 3 weeks after the application was submitted. the garnishment originally should not have taken place as the loans were being paid via consolidation prior to a garnishment ( my feeling is that the XXXX was denied and the garnishment was placed once ICR received notice of the intent to consolidate ; which is unethical and illegal practice ).

Please help me resolve these matters as this is causing undo stress and hardship on myself and children.

On or around XX/XX/XXXX I received a call from Immediate Credit Recovery advising that they were initiating wage garnishment and recently mailed a letter to my home address ; I advised the agent that I was willing to make voluntary payments to avoid garnishment and ask the agent what address the letter was mailed to as the letter was not received. She confirmed the letter was mailed to my home address, when I ask if she could resend ( so I can understand the letter content and what options, if any are available to me ) she indicated that XXXX had fulfilled their obligation by mailing it and that they are not responsible for USPS. The agent proceeded to collect personal and financial information - after approx. 20 minutes on the call I had to leave, as I was at work. The agent indicated that her office hours were M-F, XXXXEDT ( which are the same as mine ). I request the agent provide her contact information ( XXXX ) and callback at XXXX to finish the call - I did not receive a callback, nor was I able to reach the agent when I attempted to return the call. I have since made multiple attempts between XXXX and XXXX and also leaving voicemails for the agent. If my recollection of my conversation in XX/XX/XXXX is that I have 30 days to take action - I am unable to take action without the letter and if my voicemails have not been returned. I am not disputing the debt however I find it frustrating that I continue to have issues with this agency - in a prior complaint the agent the agent erroneously advised that voluntary payments were not an option, since this complaint ( to my knowledge ) there have been no additional attempts to contact me by phone or in writing. I understand that my loan is defaulted, I am willing to pay however it seems unfair to impose deadlines when I am at the mercy of the agent answering the phone/responding or at the mercy of the USPS.

In XXXX 2017 I applied to have all my student loans consolidated and was notified that XXXX of my loans were about to default and I needed to fill out a for to add the XXXX borderline defaulted loans to my consolidation, which I did. In the process of waiting for the consolidation to be finalized and the XXXX loans added into the consolidation, I am told the XXXX loans defaulted and went into collection but I was also told that it was within the 180 day rule and that I could still have the XXXX loans consolidated. The amount of the defaulted loan is a little of {$2000.00} and I am being garnished for $ XXXX and told the only way out is to pay in full up front or have the Department of Education send a Stop Notice. When I contact XXXX XXXX , I 'm told I must get the Debt Collection Company to agree to release the garnishment to have them added into the consolidation and the Debt Collection company, Immediate Credit Recovery tells me that it is no such action, once in garnishment always in garnishment until paid off or enter into a rehabilitation program which is additional monies on top of the garnishment, which has already put me in a financial hardship and no way out ... XXXX Can someone tell me which information that I was given is correct and the steps to take in order for me not to be destitute?

I took out student loans totaling {$19000.00}. At the end of school in XXXX, I started paying on my 15 year loan. I paid for 7 years. When it came to my attention that the balance was not going down any longer ( around XXXX ), I contacted XXXX XXXX. I was told I had refinanced my loan into an Interest-Only Loan. I DID NOT do that so I asked for paperwork to show me when I asked for this and show me my signature. It never arrived. I stopped paying on the loan until it could get this resolved. These communications went on over the years and the loan went into default in XXXX. In XXXX, it came to my attention that I had an entry on my credit report in the range of {$90000.00}. After going back and forth again, I finally made a Complaint with this agency, the CFPB ( I think around XXXX ). The entry was removed from my credit file. Later, I received more communication in the mail. I sent two certified packages ( with 32 or 33 pages each ) to the address provided. When I followed up by phone, they would say they never received the package. Nothing became of it and I did not hear from them any longer. Now, they have send a Wage Garnishment to my employer. When I called my Payroll Dept, I was told this was from the Dept of Education. I asked for copies ( I will send to you ) and they are not the Dept of Education - they are a collection agent posing as the Dept of Education. It is a different collection agent than before. I did not have a student loan even close to {$90000.00}. Is a Collection Agent allowed to collect " late fees '' and garnish my wages? Account # XXXX I have written all 3 credit bureaus and Immediate Credit Recovery about placing my student long account in forbearance or deferment because of the Covid-19. ICR, Immediate Credit Recovery garnished my husband 's wages for {$320.00} each pay period ( every two weeks ) without proper notification. I was not aware of any money owed until I received paperwork for the garnishment from my employer until 8 days prior to the funds being deducted from my pay. The amount being deducted has adversely affected my family and my credit, I can not meet my basic living needs and I have XXXX XXXX children at home. Both are in need of summer clothing to fit them, and we have a combined school expense of {$800.00} that was due XXXX XXXX, and we ca n't afford to pay it. I have had utilities turned off, not able to pay for groceries and media actions needed because we have an {$11000.00} deductible.

We are incurring late fees on our financial obligations and never had the opportunity to dispute or set up affordable payments.

I need help ASAP as ICR has failed to respond to faxes, email, and phone calls. When I call I press option 3, them get a recording and disconnected. I requested a hearing on XXXX XXXX and was told they were wating for a response as to the date of the hearing only to find out 6 weeks later ( XXXX ) that they never sent it so we wait another 30-60 days for a hearing date while they continue to take money from my husband 's pay.

We do not qualify for any type of assistance because they look at gross income, they do n't take the garnishment in to consideration. This company had contradicted themselves and made it impossible for us to meet our basic needs.

I received a notification of a possible offset last year around XXXX from the United States Department of Education. I immediately contacted Immediate Credit Recovery to setup the payment plan. I called the United States Department of Education again to confirm there would NOT be an offset on my taxes. The representative indeed confirmed since there was a payment plan setup that I would be just fine and there would not be an offset. I made my first payment of {$25.00} on XX/XX/XXXX via checking account and it has been coming out consistently and on time every 2 weeks. I happen to call the Treasury Offset line on XX/XX/XXXX to see if anyone requested my refund and guess what! The United States Department of Education requested my refund. I called them and waited over 2 hours and spoke with XXXX. He agreed that Immediate Credit Recovery indeed messed up with the payment plan by starting, stopping and restarting again. A while back they also submitted a wage garnishment for me when I NEVER received the notification because they had the incorrect address. I called Immediate Credit Recovery today and spoke with XXXX XXXX who agreed they made a mistake, but she did not seem knowledgeable enough to assist with my issue. I requested a manager by the name of XXXX XXXX ( garnishment manager ) and she assured me she would send " up '' a complaint to the compliance division and then they would forward it to the Department of Education. Since XXXX I have been trying to settle a debt that the college says I owe. There was a glitch in THEIR system ( I have emails of them admitting error to the errors ). They issued my my student refund before settling my book store account, which came to about {$1200.00}. The college refused to give me my transcripts. I have since had a no asset bankruptcy discharged ( XXXX ) and this debt was listed and discharged as well. They also sold this debt to a collection agency, a couple of months after being notified of the filing and discharge. The same collection agency states that they did see that this debt was included in the bankruptcy and sent a request to the university that I be given my transcripts. However, the college is still requesting the balance from me before I receive my transcripts. It is ILLEGAL to attempt to collect on a debt that was discharged in a bankruptcy proceeding. The college attempted to tell me that the debt could not be discharged because I took out a student loan. However my student loan provider is in the process of discharging this loan due to the negligence and mishandling of student loan funds by the college in my case. The fact that I am unable to pursue a higher education ( which the same colleges should want ) at another university due to this college negligence is causing me a great deal of mental and emotional distress.

I have a federal student loan that is in default and placed with Immediate Credit Recovery as a private collection agency. It appears they try to contact me and do not leave voicemails. I have discovered, through my own investigation, my defaulted loan is scheduled for treasury offset with my 2018 tax return. I have been trying to contact the correct Department for loan services in regards to consolidation or rehabilitation/ whatever other options may be available however every time I contact the business I am rushed to be transferred and once I am I am told to leave a voicemail to a mailbox that is full and will not accept a message. I have tried contacting other departments of the business to see if they have a way of contacting the department to find out what is going on but everyone is rude and of no help saying they are totally unaffiliated with that department which I do not exactly understand if this is all the same business. I have tried to contact the US Department of Education directly for the issue and they have also submitted a complaint to the collecting company but they are unable to help me. I am trying to do the right thing by getting in touch with these people to correct my debt and they have made it extremely difficult and frustrating. I do not know where else to turn besides possibly seeking advice from a lawyer at this point.

Hi, I have been unable to get a valid response from their collection team. I am at the end of a very long rope. I have logged complaints on their site, with the department of ed and with FASFA. I understand that their business model requires that they maintain exuberant fees. However, I would hope that would not be at the cost of integrity. Several things keep occurring and I can not get the correct resolution. 1 ) All my requests for accountability have been ignored. This should include any computer calculation programming ( to validate for errors ) and the itemization of how numbers were applied. 2 ) Several documents uploaded to their portal were removed by their company 3 ) The initial contact person was okay, but massively misquoted the payments. If the ONLY way you communicate is phone, then why is that person 's system so radically different from the office staff? 4 ) Why do they refuse to make contact via e-mail? I have extremely limited phone use. 5 ) I have now made 4 payments of {$370.00} to the dept of ed and my loan has not been released. Furthermore, they have stolen these payment to apply to their fees instead of the loans. I am trying to work with what now appears like a corrupt company. Is this the image they are striving for? They will not provide me with an officer 's name at the company to discuss how to correct this.

I had a student loan in 2007. I was unable to continue to pay after a certain point. The XXXX XXXX XXXX XXXX put a lein on my tax refunds and took the balance. The loans have been paid. Now there is a credit company trying to threaten me with court. I responded with a cease and desist until they sent a verification of debt because the loans are paid. they show payment on my credit reports ( which I monitor ) and this debt collector is reporting the same accounts that the XXXX are reporting and screwing up my reports. Immediate credit recovery which is contracted through department of education is attempting to collect debts of the wrong amount. A garnishment was sent to my employer with a specified amount to be garnished. After reviewing the final payoff letter mailed it appears that Immediate credit recovery is reporting incorrectly the amount paid. I had a garnishment in the amount of XXXX sent to my employer. I have since paid XXXX. This would leave a balance of XXXX. Immediate credit recovery continue to report that a current owed amount as XXXX. The website XXXX shows a current total debt balance of XXXX. When speak with immediate credit recovery they stated that balance is not correct. At no point on garnishment paperwork did immediate credit recovery state the balance may change based on interest. No disclosures of interest or balance adjustments for collection fees, ect. This should all be detailed for the employers and for the employees whos wages are being garnished. I wish for an update for requirements of these agencies to disclose balance and debt amount changes due from collection fees and/or interest. Instead of falsely reporting a set amount and making it extremely difficult to find out the correct balance or access correct payment information.

I received ppwk today from my payroll department who sat on my notification since XX/XX/2020 for Wage Garnishment started XX/XX/2020 for {$100.00} per pay period. This account is being collected by Immediate Credit Recovery , Inc. and this company has now almost tripled the amount that I am required to pay back. The loan was originally for right around {$11000.00}, but the 3rd party collection agency is now charging me {$36000.00}. I will repay the loan through wage garnishment, however, the interest I what I have an issue with and will not pay the interest. The original creditor is U.S. Department of Education XXXX. I do NOT want to deal with Immediate Credit Recovery , Inc., because they are too much of a hassle and want entirely too much information which is difficult for me to obtain and takes too much time to deal with as they call, constantly. I also never received anything in writing from them, before this notification, over the last year. In XXXX my student loan was forgiven by the lender. On XX/XX/XXXX I received a demand letter from a 3rd party Immediate Credit Recovery , Inc. ( hereafter ICRI ) of XXXX Ga. and use a XXXX Califonia address. In this day of Identity theft it is hard to believe anything that demands personal information in the mail particularly when you can not contact the company with the telephone number provided by that company. I have written them a letter. Contained in the letter they sent me referenced another company which I am informed and believe and thereon allege that they are an extension of the collection agency and not a valid company for complaints against that agency. 1. without my knowledge or consent ICRI obtained my credit report, and information in violation of FCRA 609 ( e ) ( 15 U.S.C. 1681g ( e ) et.seq. 2. Then as an attempt to resolve this I made 3 separate phone calls on 3 separate days to the number provided and was disconnected without being answered each time. 3. I have now written a letter telling ICRI that this debt was forgiven over 19 years ago with the help of the Veterans Admin. A couple of weeks ago I received an email from my payroll department that they were going to start garnishing my wages at 15 %. My payroll department was noticed of this on XX/XX/XXXX. I called the company that now has my student loans, Immediate Credit Recovery, yo ask about this garnishment and was advised they sent me a letter to set up a payment plan but they sent it to an address Ive never lived at. They advised me I can fill out a financial hardship packet and hope that they dont garnish my wages. I filled out the packet and mailed it in with all my bills then on XX/XX/2019 I received a letter in the mail from the US Department of Education to set up a payment for plan for the debt I owed. I called them to set that up but was advised to just disregard the letter I received and it was sent out in error. Regarding Federal Student Loan. In XX/XX/XXXX, the US Dept of Education told me if I paid {$350.00} per month for 18 straight months, the penalties and some of the interest would be removed from what I owe. I complied with the request and when the 18 months was up, I found there was nothing removed from the interest or penalties. I called them on the phone and they sold the loan said they sold the loan. I called the new loan servicer who stated " That has nothing to do with us. '' I was totally at a road block. Many things happened in my life that have been very hard to take on but then I started a job 13 years ago at XXXX. For the last several years, Immediate Recovery has been garnishing my checks for {$530.00} per month and if there are three pay periods, {$790.00}. I have been late on mortgage since the garnishment and have contacted ICR several times trying to take it out of default as it still accrues interest all the time. Also they have my tax returns. I received a letter from Immediate Credit Recovery stating I owe them {$74000.00} In student loans. I called XXXX The department that manages my student loans and they confirmed that I only have XXXX in student loans total. There is XXXX in interest. There are two problems here. 1. I do n't owe XXXX and there is another company already garnishing me for XXXX. Between the two companies they are taking XXXX every two weeks from my pay. That 's XXXX per month and XXXX in the 2 months that have 3 pay dates. How can two different collection agencies garnish you for the same money. Immediate Credit Recovery has also reported double loans to the credit bureau so that now it looks like i have twice the loans in default than I actually have. My credit is bad enough without it doubling up on default payments. i spoke with them back in XXXX about lowering the garnishment amount and they refused. I made arrangements to make payments from my credit card but they have not been taking the payments. I have called and got put through to a voicemail box and no return call. I received a Notice of Wage Withholding at 15 %. I have been trying to call the company for four days. Saturday, Monday, Tuesday and Wednesday. By Tuesday the number I was initially given to call, voicemail is full. I contacted the Dept of Ed to inquire and was told at the time that ICR 's main phone system was down and that if I dial the last four digits of XXXX instead of XXXX I will be able to reach them as that number ( XXXX ) is working. I called that number both Tuesday and Wednesday. It's the same message as the XXXX number but in a different voice, again, directing calls to voicemail ... and nobody returns them! I contacted the Dept of Ed again about the new number they provided to me and was told, " We don't have any other phone number to give you so just keep leaving messages. '' I made just XXXX above the poverty level of XXXX for 2017 and this year my hours have been cut by 5 a week. An acquaintance at XXXX XXXX University ( XXXX XXXX ) suggested I attend his XXXX program, ( back in 2017, I think ). I could not attend or enroll in any of his classes at XXXX XXXX University because I did not have the money to do so. He assured me that I would not be charged any tuition fees and that I would not be enrolled in or owe money for any of his classes. I asked for the name of the company that was calling me and was told I could n't get that information until after I had verified the last four. I started being garnished in XXXX of XXXX for a student loan. I was not advised of any collection activity for this account and didn't receive notice of garnishment until the day it was applied to my pay check ( via my employer ). When reviewing the documents, I observed that the address of record was from a residence that I vacated more than a year prior. In XXXX of XXXX, I attempted to dispute the debt/garnishment via the company 's website and did not receive any type of response. I called the company on XX/XX/XXXX, and was advised by a representative that disputing the account was pointless and the only form of action that I could take to alleviate the garnishment was to file a hardship request, which would be reviewed and approved/denied by a judge after I provided receipts for all of my monthly expenses. I have a US Department of Education loan debt. I 'm forced to use a company called immediate credit recovery to process my collection amount for the period of 11 months so that I can get out of default status and work out a different payment arrangement. I 've had ongoing issues with this company and the Department of Education about my loan. I have been paying the monthly obligation and yet the amount that I 'm paying is not showing on my credit reports as of today XX/XX/17 correctly and on the statements from the Department of Education the amounts are showing past due when they are not past due they are automatically taken out of my account each month. A representative from ICR Inc ( Immediate Credit Recovery , Inc ) has called multiple times over several days, refusing to provide anything but a first and last name as identification without *me* providing the last 4 of my social security number. I repeatedly refused to identify myself without verifying what company the representative was calling from was legitimate. The representative finally said " Fine, I'll verify the last 4 digits we have on file and you can tell me if they are correct. # # # # '' and gave my correct last 4 without having ANY idea who was on the other line. I filed BK and when it discharged I got a letter from them in XX/XX/2018. I called and spoke with a representative about rehabilitation. She was not performing the rehab correctly and was not very helpful in trying to get this worked out. My wages have been garnished to pay this defaulted loan through Immediate Credit Recovery. I applied for Economic Hardship ; and regulary went to website ; saw status messages I did n't understand ; called Immediate Credit recovery they did n't return calls. I complained via myeddebt.gov. within the past week I called & was told garnishment was suspended & set up voluntary payments. I received several calls and later a printed statement by mail, regarding an old student loan from a Collection Agency that indicated they were contacting me on behalf of the Department of Education. I have been garnished without notification from Immediate Credit Recovery. I notified the company upon the garnishment and informed them that they must notify me within 30 days prior. I recently received a collection noltice from Immediate Credit Recovery Incorporated saying that I owe {$1200.00} for a previous student loan debt.
