Without prejudice, the company HomeLoanServ is and has been harassing me for the past 3 years in regards to a mortgage loan and are now attempting another foreclosure attempt on my property if I do not pay them within the next 35 days. I have claimed fraud in the past and have now compiled enough evidence for the Consumer Financial Protections Bureau to hold an investigation, proving without a shadow of a doubt, the company has been extorting me, and now that I have recently completed my investigation that my assumptions regarding the company were true, I have evidence from the State that the company, never has infact held any perfected, legal, legitimate interest in the property, and that they do not in fact have any interest in the property by proxy. The company is practicing predatory lending, unaccredited, and is part of a large web of organized, white collar criminals, preying on innocent homeowners with fraud for profit. I have contacted, and confirmed with the Texas Secretary of State UCC office, and they have no perfected lien filed, no UCC Filing Statements filed, and nothing recorded at the county level in XXXX XXXX XXXX XXXX XXXX XXXX, and HomeLoanServ has no record of any debt recorded under my name, or property and this entire time I have been terrorized, family ruined, unable to work and, I have been scammed, and my entire life turned upside down on a fraudulent real estate transaction by predatory lenders, as a first time homeowner. The company HomeLoanServ conspired to trick me into an unlawful agreement and consent, and has made their claim of interest towards the property merely by invasively accessing my tax records before I could, stating they are paying the taxes as part of escrow, but when I visited the tax office in person in downtown XXXX, Texas, the clerk said to me anyone can pay the taxes but that does not give them any rights to the property. This one deceptive action is what made me believe they had interest when they never did. The company has stolen my identity and used my information, and accessed my information to infiltrate these various organizations to appear to be my mortgage company, but this was all done in complete fraud and used as a way to attempt to swindle me out of my property. When I questioned them, and protested, and disputed the amount, I was met with threats of foreclosure, and given I was not familiar with real estate that much, I was terrified and was then their slave. The amounts fluctuated, the terms adjusted, but I was a XXXX. This caused me great anxiety and stress and ultimately caused me to lose everything, my family, my career, and my physical and mental health. The company HomeLoanServ, has repeatedly sent me documentation claiming that they are the legitimate lender, mortgage servicing company, and now they are claiming to be a debt collector. The company is acting in fraud and using deceptive practices to intimidate me and try to force me into foreclosure again. They attempted to foreclose on the property in the past Notice of Foreclosure, forging documentation Assignments, using fake names, and people XXXX XXXX and are trying again and I can not deal with this anymore. I had no choice but to try and work with the company because I was a first time homebuyer and had no idea how the process worked but now I am aware of my rights, and the fraud that has taken place and I am notifying the Consumer Financial Protections Bureau, the Federal Trade Commission, and all government and regulatory agencies of this company and the crimes that they have committed against me and authorizing immediate administrative enforcement for the crimes committed and a detailed report regarding the findings, including but not limited to, the investigation notes, a forensic analysis of the documentation presented by both parties, and the final determination. Under The Fair Debt Collection Practices Act As amended by Public Law 111-203, title X, 124 Stat. 2092 ( 2010 ) I am attaching evidence of 1 ) mail fraud, 2 ) forgery, 3 ) falsifying documentation, 4 ) harassment, 5 ) backdating documents, 6 ) defamation of character, 7 ) fraud for profit, 8 ) extortion, 9 ) trust fraud, 10 ) bifurcation, 11 ) deprivation of rights, 12 ) malfeasance in office, 13 ) numerous banking crimes, 14 ) Notary fraud, 15 ) mortgage fraud, dozens of Uniform Commercial Code Violations, USC violations, and the Fair Debt Collection Practices Act, specifically : *802 Congressional findings and declarations of purpose ( a ) Abusive practices. *805 Communication in connection with debt collection ( c ) Ceasing communication *806 Harassment or Abuse, *807 False or Misleading representations, *808 Unfair practices, *809 Validation of debt *821 Furnishing certain deceptive forms The company is to verify or dispute all the allegations made regarding the violations and any allegations therein of this Admissions Requests. This will serve as the best way to verify the complaint. No signed contract exists between I and HomeLoanServ and they shall have no contract, and never will, and they, along with their parent shell company, Idaho Housing and Finance Association, and the original lender XXXX XXXX XXXX XXXX XXXX XXXX ( fraud ), and the XXXX XXXX XXXX XXXX, conspired against the first time homebuyer in fraud for profit. Admit, I was a victim of fraud and tricked into paying for a property I had already owned as collateral to issue out any security interest. Admit, I was fooled and lied to at closing by the title company, and not provided full disclosure to the contract and the entire transaction was made to discriminate against me with improper grammar, syntax errors, misleading language, illegal provisions. Admit, the company HomeLoanServ only mails generic letters, none of which are signed by an actual member of staff, meaning, none of the documentation is authenticated and is not enforceable by law in any court or jurisdiction. Admit, none of my considerations, requests, questions, or concerns in the many letters I have written are addressed or answered by a member of the company with a name and signed. Admit, if HomeLoanServ and I did have a securities interest contract ( which we dont ), this would be a breach of the contract, thus making it void in the first place. Admit, breach of contract occurs whenever a party who entered a contract fails to perform their promised obligations. Due to the frequency of breaches of contract, a robust body of law has grown to resolve the ensuing disputes. Admit, the overarching goal of contract law is to place the harmed party in the same economic position they would have been in had no breach of contract occurred. As a result, the default remedy available for a breach of contract is monetary damages. Admit, consideration is a promise, performance, or forbearance bargained by a promisor in exchange for their promise. Consideration is the main element of a contract. Without consideration by both parties, a contract can not be enforceable. For instance, if a person used the money to purchase an apple, the apple is the merchants consideration, and the money is the persons consideration. Admit, I does not and have not consented to any of the offers of fraud, only by being lied to, threatened, fooled, and force and given there is no statute of limitations on fraud, any implied, perceived, tacit, stated or unstated agreement that we may have had, made in fear, ignorance, or through deceptive means and fraud, is now, and forever void, and retracted. Admit, the company, HomeLoanServ has stolen thousands of dollars from I, on a lie and stolen government funds from programs designed to assist homeowners in their time of need. Admit, ANY contract that may have been assigned illegally, under the table, is now voided. Admit, I has requested a perfected lien numerous times over the past few years and never received one, and if the Consumer Financial Protections Bureau is unable to get one, then your office has no choice but to rule in my favor or you will be in malfeasance in office, willfully negligent, and you will be aiding and abetting criminals against the United States of America, which is Treason, and violating your oath which is perjury. Admit, a UCC Financing Statement : Perfection can be obtained by a creditor by filing a UCC Financing Statement with the Secretary of State. Admit, a qualified financing statement should include : Debtor and secured partys name, Collateral describing, and A creditor or other person authorized by the debtor in their security agreement files it. Admit, the company HomeLoanServ has not provided a qualified financing statement. Admit, if there are some errors or omissions that do not comply with the above requirements of the UCC, the financing statement may still be effective unless such mistakes make the statement substantially deviating and seriously misleading. Admit, as the only party in possession and control of the property, I, I, solely hold the only perfected security interest and reserve all my rights to the property at XXXX XXXX XXXX XXXXXXXX XXXX XXXX, Texas, XXXX. Admit, the company HomeLoanServ conspired and stole, and forged the Notes, and forged Is name on the Note, in company of the other predatory lenders that will be filed on it as well. Admit, the company HomeLoanServ, has acted as though they are the 1. mortgage company and 2. the mortgage servicers and 3. Debt collector. ( see attachments ) Admit, when the property was attempted to be foreclosed on I, HomeLoanServ was nowhere to be found on the documentation as a debt collector and they used another debt collector, XXXXXXXX XXXX XXXXXXXX. Admit, HomeLoanServ is an out of state company as a shell company to evade liability, using deceptive trade practices named Idaho Housing and Finance Association. I confess that I have paid them but it was in ignorance and fraud and under threat and duress in fear of losing my home and having numerous correspondences requesting authenticated statements of accounting and all those actions were made in fraud. Admit, the company HomeLoanServ attempted to make I actually sign a promissory note, during a loan modification, notarized in an attempt to give them interest in the property. Admit, the company HomeLoanServ has stolen my identity and made bonds in the background utilizing my information using my trust information. Admit, the company HomeLoanServ has also committed fraud against the government by taking my online payments and taking the payment coupons as well and redeeming them, essentially double dipping the payments and pocketing the money. Admit, the company HomeLoanServ has not reported all earnings to the Internal Revenue Service for the payments I have made and the bonds created to my knowledge from the numbers that have been missing or wrong. Admit, under UCC 3-104. NEGOTIABLE INSTRUMENT. ( a ) Except as provided in subsections ( c ) and ( d ), " negotiable instrument '' means an unconditional promise or order to pay a fixed amount of money, with or without interest or other charges described in the promise or order, if it : ( 1 ) is payable to bearer or to order at the time it is issued or first comes into possession of a holder ; ( 2 ) is payable on demand or at a definite time ; Admit, under protest, threat and duress, I sent the company a conditional acceptance letter and a negotiable instrument as tender of payment coupon from their mortgage coupon for the value of {$420000.00} ( XXXX XXXX XXXX XXXXXXXX XXXX XXXX XXXX ) in error, in an attempt to pay the debt, certified mail that was endorsed on the back to cover the alleged loans, and requested that they either accept it or send it back and it was accepted and not returned. Admit, I sent another negotiable instrument as a tender of payment coupon from their mortgage booklet for the value of {$200000.00} ( XXXX XXXXXXXX XXXX XXXX XXXX ) certified mail, return receipt, with a conditional acceptance contract that I signed and notarized and was delivered certified mail, with a return receipt sign accepting the payment and the offer, in order to have them cease all harassment. Admit, according to UCC 1-308. Admit according to UCC 3-603. Admit, if tender of payment of an obligation to pay an instrument is made to a person entitled to enforce the instrument and the tender is refused, there is discharge, to the extent of the amount of the tender, of the obligation of an indorser or accommodation party having a right of recourse with respect to the obligation to which the tender relates. Admit, numerous attempts were made to tender payment the company in fear and arranged for them to be paid off to get the company out of my life because I did not have enough time to think of a better strategy to prevent them from attempting to steal my home again and the payment coupon was accepted with the contract and they kept the payment coupons. Admit, the company HomeLoanServ redeemed both coupons and still turned around and asked me to pay them or they will foreclose on my property instead of updating their accounts. Admit, the company HomeLoanServ is to complete a " Request for an accounting '' Admit the company HomeLoanServ is to complete a " Request regarding a statement of account ''. Admit, I has sent letters requesting they cease and desist and they ignore the letters and continue to harass me and I have all the scanned copies attached, along with the envelopes and postmarks. Admit, the company, HomeLoanServ has yet to produce not one single shred of evidence that can be authenticated by a member of staff or the executive team, verified by Notary, and enforceable by the government or any court to prove that we have a financial relationship. Admit, HomeLoanServ works by using intimidation and fear by filing frivolous foreclosure nonjudicial documentation with XXXX XXXX XXXX that does not verify the information. Admit, the company had a member of their team, pose as a member of another company and had their own XXXX, XXXX XXXX, notarize the Assignment document, which is fraud. Admit, the only thing that HomeLoanServ can provide are forged, unsigned, unauthorized, doctored, falsifying documentation, which serves more than anything else that they are a fraudulent company and conspiring with the other parties to drain my trust and to steal the property after writing bonds against the trust. Admit, the company HomeLoanServ is not even registered to do business in Texas. Admit, the company HomeLoanServ is not accredited according to the XXXX XXXX XXXX which means they have no business even attempting to engage in lawful commerce with the consumer protected by the Consumer Financial Protections Bureau, and now that the agency has been notified, it is the duty of the investigative staff and the Director, XXXX XXXX, to do an investigation into this company and ensure that the proper enforcement action is taken to protect consumers from them in the future. Admit, the company HomeLoanServ, has an F rating with the XXXX XXXX XXXX Admit, the company HomeLoanServ has literally sent I, numerous letters to intimidate me in the last 7 days, with different amounts due. Admit, the company HomeLoanServhas no rights to the property and is threatening the property owner with foreclosure. Admit, the Company, HomeLoanServ stole money from the XXXX XXXX XXXX XXXXXXXX XXXX XXXXXXXX XXXX. Admit, none of the numbers add up and the accounting is in two separate ledgers, one for HomeLoanServ and one for Idaho Housing and Finance Association. Admit, the starting balance on the company HomeLoanServ accounting is not the same as the amount on the contract I signed according to their ledger. Admit, the Statement of Account was sent certified mail, return receipt, notarized, addressed to HomeLoanServ Chief Executive Officer, XXXX XXXX XXXX XXXX, and the next week I received a threat of foreclosure. Admit, if the consumer notifies the debt collector HomeLoanServ in writing within the 30-day period described in 209 CMR 18.20 ( 1 ) that the debt, or any portion thereof, is disputed, or that the consumer requests the name and address of the original creditor, the debt collector shall cease collection of the debt, or any disputed portion thereof, until the debt collector obtains verification of the debt or a copy of a judgment, or the name and address of the original creditor, and a copy of such verification or judgment, or name and address of the original creditor, is mailed to the consumer by the debt collector. Admit, a debt collector shall provide to a consumer or any attorney for a consumer within five business days the following : ( a ) All papers or copies of papers and electronic records, in the possession of the debt collector which bear the signature of the consumer and which concern the debt being collected ; and ( b ) A ledger, account card, or similar record in the possession of a debt collector, whether paper or electronic, which reflects the date and amount of payments, credits, and charges concerning the debt. Admit, the failure of a consumer to dispute the validity of a debt under 209 CMR 18.20 may not be construed by any court as an admission of liability by the consumer. I am ordering for an immediate investigation of the facts presented and for the company to confirm or deny each matter. After they respond and confirm, if they are found to be in fraud, I am ordering that the Consumer Financial Protections Bureau file handle the matter against the company, with the appropriate enforcement actions.

I am a surviving spouse of a XXXX XXXX XXXX who died from XXXX XXXX XXXX I have a VA homeloan and I am having finacial issues over errors made by the mortgage servicing company that my loan transfered to. They gave me an escrow shortage over a year after they had my loan transfered to them. They claimed the shortage was from the loan I got over a year prior for the purchase of the property. The shortage is over XXXX and was never explained to me in full details and every employee gave me different explanations and no details or paperwork showing the problem. Several said they weren't sure and made hypothetical possibilities. I was told it was taxes, but it was from the purchase of the home over a year Prior. The tax amounts didn't add up at all and I called my county tax assessor office and they on 3 occasions told me to contact the mortgage servicing company because they were wrong. On a publicly available receipt from XXXX it lists me as owner of the home and that I paid the taxes. I didn't own the home until XXXX. The servicing company were very rude to me and told me that I probably paid them out of pocket. Which is absolutely untrue and a terrible excuse. I did not own the home in XXXX and was not accountable for them in any of my loan agreements. The taxes that were required of me were from XX/XX/XXXX to XX/XX/XXXX and it was only around XXXX. It looks like I paid those taxes at closing but I am unsure on that exactly. However it wasn't either of the conflicting tax amounts from the mortgage servicing company. I have been constantly shut down when I ask for better explanations and detailed answers from the mortgage servicing company. They are now very rude to me and even ignored my correspondence. I discovered that they are charging for taxes I didn't owe. They have my amounts wrong and the County Tax Assessors have my disabled exemption and my homestead exemption documented from XXXX until now and still currently active. The mortgage servicing company does not and they are computer determining on their own what my taxes should be. I purchased the house XXXX. Once they informed me of the escrow shortage that I had to dig and dig to get them to explain why my escrow went negative by a massive amount and nearly doubled my house payment every month. However the explanations weren't thorough explanations and conflicting and then they shoved me away for simply trying to get a visual reference for this problem. I have found many many issues that violate my VA loan regulations. They also violate my closing documentation of my agreed upon loan details in my closing documents. They are intentionally ignoring me and my evidence of the problems I solved as best as I could from months of my own research and studying everything.. I don't know exactly how many things are wrong in full detail from their error. But it's more than one. The XXXX shortage was unbelievable and far in the past for me to understand. Then their behavior and shutting me out and ignoring me only caused me to keep digging harder. From my research and number calculations, they charged me a shortage that was my CLOSING COSTS. Which were paid at closing. Which is Clearly noted on my closing documents. They charged me for multiple fees already paid at closing or before. They lied many times about the reasons behind the shortage. Then just ignored me when I presented evidence of these things. This caused my note to nearly double which resulted in me currently in the process of selling my home. I am heartbroken because I was happy to have my forever home. Since I receive XXXX and surviving spouse benefits from the VA my income does not provide me with the assets for this increase. From my conversations this is a necessary thing for them to look at. My taxes went down and then decreased more the following year. It's a multitude of other fees and things being illegally stolen from me. I have recently accepted an offer to sale my home because I could not afford a note that doubled. So now I am very sad and disappointed because my husband died from XXXX XXXX XXXX that got me and our child a home. He died from serving his country and I was lucky for him to be able to provide me and my child with a home of our own to have forever. But that opportunity was stolen from us. I now need them to fix these issues to at least allow me to receive a fair amount to myself and my child to be able to rent a place to live since we had to give away our warm and comfy home. They even charged me a penalty for the house payoff and that is against my VA loan regulations.We have lost everything in this world at points in time. We were happy to be able to have a blessing of a home. I asked the company to freeze my escrow and suspend my payment or at least charge only a partial payment. This is what the title company told me to do for the sale. The servicing company has ignored that request as well. No one will help me. It's hopeless. I want to be able to afford a decent rental for me and my child. Our hope was ripped away by their error. It's unbelievable they are holding me accountable for closing costs and fees I paid at and before closing. Along with added fees and costs that are not eligible for me to have to pay per the VA stipulations. And not included in my closing closing agreement and some specifically showed them to be Incorrect on their shortage claim. They have ignored me when presented with this evidence. I want them to fix this so that my proceeds cover my expenses and owed money to payoff and have enough back. We will be living in an extended stay hotel until I get the proceeds from my sale so I can have money to rent. Basically we will be XXXX. And not receive our fair money. They can not do the things they are still doing to me. I need this fixed and refunded. And contact seems to be impossible. Even the VA homeloan office employees tried to get contact and were treated very unprofessionally and shut down as well. Please help me. I am so hurt and confused and scared. I can not buy a new home and am very scared to ever try again after this experience. This now is an intentional error and behaviors from this company. But I will never be able to do this for me and my child again. Please help me.

I sent a letter to Idaho Housing and Finance Association ( HomeloanServ ) on XXXX XXXX, XXXX as it relates to servicing my loan. HomeloanServ responded per their letter dated XX/XX/XXXX but blatantly refused to provide all the information I requested, including failing to comply with RESPA. I have attached the letter I sent to them dated XX/XX/XXXX with very specific request. I am attaching their one page response dated XX/XX/XXXX that did not address my requests properly. HomeLoanServ unlawfully withheld legally mandated pandemic protections, wrongly imposed fees, and reported false information to credit reporting companies. In addition, HomeLoanServ misaplied payments, falsified my Tax return statement by not reflecting all the forborne interest payments that was made in XXXX when I paid off the loan. HomeLoanServ has over collected on the account and refused to acknowledge it hence the refusal to provide the account details I have been requesting for in the past 8 months. Below are the specific requests HomeloanServ refused to address : A. Refused to provide critical loan account information : 1 ) HomeLoanServ refused to provide the amortization schedule which has now been requested 4 times. 2 ) HomeLoanServ refused to provide the sum of total monies received from me as specifically requested in my letter. Only provided a transaction statement that does not provide sum of total monies received from me to date. 3 ) HomeLoanServ refused to provide a written explanation as to why the letter dated XX/XX/XXXX, showed an amount due of {$10000.00} but the deferral agreement shows {$11000.00}. What exactly is the difference and how was that determined? 4 ) HomeLoanServ refused to provide the monthly breakdown showing, principal, interest and escrow for the amount deferred per the deferral agreement dated XX/XX/XXXX ( Principal + Interest = {$8100.00}, XXXX {$3.00}, XXXX ). I wanted this breakdown by the actual deferred months and asked that you show Principal, Interest and Escrow by month separately. I specifically asked that you do not provide one lump sum which is exactly what you did in your response letter dated XX/XX/XXXX, as I wanted this broken out by month for transparency. Fyi below is what a breakdown should look like. Forborne Months Principal Interest Escrow XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX Total 5 ) HomeLoanServ refused to address the {$270.00} that is still sitting in suspense and unaccounted for. 6 ) HomeLoanServe refused communicate that they were unable to complete the payment deferral on time and was going to add an additional month. Again, not sure why this was needed since it took over 8 months to process the deferral and I already resumed making payments in XX/XX/XXXX. B. Credit Reporting Inaccuracies : 7 ) HomeLoanServ illegally furnished information to consumer reporting companies that my account was delinquent, rather than current, even though the account was current entering forbearance and even though they received a signed covid deferral agreement. HomeLoanServ was informed of the errors on multiple occasions but refused to update the inaccurate credit reporting. 8 ) HomeLoanServ is still showing inaccurate payment amounts, not reflecting all the payments that were made by me and now showing three months late ( it was two months as of the last complaints I made ). 9 ) HomeLoanServ also put a " A Temporary Update Freeze on File '' on the credit file. ( See exhibit 1 - Letter received from XXXX related to the recent updates made by HomeLoanServ as of XX/XX/XXXX ). In addition, I would like to see how what is being shown on the credit report tie back to the so-called transaction report HomeLoanServ provided in their response dated XX/XX/XXXX. Clearly not reflecting all the payments made in the following month XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX ( Incorrect amount reflected ), XX/XX/XXXX, XX/XX/XXXX, and XXXX. 10 ) HomeLoanServ refused to provide evidence of specific updates that were made to the credit reports, instead sent me their response to the CFPB which clearly did not address all the issues I raised. C. Deceptive acts or practices under the Consumer Financial Protection Act in connection with mortgage forbearances 11 ) HomeLoanServ provided contradicting information and failed to address the fact that their letter dated XX/XX/XXXX, stated that the forbearance period is due to expire on your loan within the next 60 days, which means the forbearance credit suppression should not have been removed on XX/XX/XXXX as mentioned in their response later dated XX/XX/XXXX. Why would the credit suppression be removed on XX/XX/XXXX? 12 ) Based on the tax return statement ( Exhibit 2 HomeLoanServ Annual Tax and Interest Statement ), HomeLoanServ only applied {$7000.00} to the forborne principal and interest and charged me {$8100.00}. This shows HomeLoanServ incorrectly reporting tax information and clearly highlights overpayment made by me on the account. In addition, total interest received in XXXX is incorrect, it should reflect actual interest received considering these amounts were not already reflected in XXXX and XXXX tax return statement. HomeLoanServ have not been able to provide detailed back up for the forborne amount which is also why HomeLoanServ is refusing to provide the amortization schedule. 13 ) HomeLoanServ charged interest on the forborne escrow amount which is not in compliance with the CARES ACT. 14 ) Lastly, per the CARES ACT, I should not have paid interest on the deferred amount but based on the way you applied all my payments, you have ineffectively applied interest to the deferred amount. D. Mortgage Accounting Error 15 ) In addition to above, I have completed my analysis and I have overpaid the mortgage account by {$1000.00} at a minimum. Final amount will be determined once I get the amortization schedule. I want my money back immediately including interest.

> My mortgage loan was transferred to HomeLoanServ in XXXX of 2020. I thought I set up an electronic account and autopay to begin automatic payments in XXXX. When I checked in to it at the beginning of XXXX, I realized that no payment had been made for XXXX. I spoke with a representative on XX/XX/XXXX. I asked that rep to help me with my online account and to make sure my electronic payment was good to go. > XXXX. XXXX. School Closures. XXXX. I am a middle school teacher. XXXX -- OMG! The mortgage had not been paid. I called HomeLoanServ for help. I received a message encouraging me to use their online resources instead of waiting for a representative. I waited. Another message told me that I'd be charged for using a real person instead of going the online route. Still, I waited. This was bad. I am not accustomed to missing payments. The elevator music stopped playing. I thought I had been disconnected. Nope. Now, I think the company hopes people will hang up. > The repXXXX who took my call on XX/XX/XXXX was very helpful. She informed me that I could not make late payments and sign up for future auto payments on the same date. That information had not been passed on to me in XXXX. In XXXX, I had been told I was good to go. My visit on XX/XX/XXXX was productive. I thought. In my XX/XX/XXXX convo, I told the rep I was especially concerned about these late payments affecting my credit. She led me to believe that I needn't worry about that -- it was all fixed. > The XXXX payment was on time. Auto payment occurred on time XX/XX/XXXX. XX/XX/XXXX, a lender informed me that a previously approved loan could not go through because my XXXX XXXX had dropped significantly. Once again, I called HomeLoanServ. XXXX XXXX XX/XX/XXXX, today, I first spoke with XXXX. She was kind and helpful. She listened to my story and admitted she could do little to help me, perhaps her team lead could. She passed me on to XXXX. ( I think that was her name. ) XXXX seemed on the defense as soon as our conversation began. I admit that paying the mortgage on time is my responsibility. I asked if she could somehow help me convey to the loan company that it was not a shortage of funds or a refusal to pay that led to my late payments. It was a misunderstanding of information given to me when I requested help in XXXX. I asked if she could help me inform the loan company that I am currently in good standing and paid in full. I don't know how many times she repeated, " we have done our due diligence '' and did our best to inform you of your account 's standing. > She said they had tried to call me. They might have, but I did not speak to anyone. If a phone number came up that I did not recognize, I'm sure I did not answer it. There were many warnings of scams and cons during the pandemic quarantine. I did not receive any written notices on time because the company did not have my current mailing address. I agreed with XXXX that they had done what they could with the information they had, but I still needed help. Could she provide any information to my loan officer that would suggest I had the means to pay on time, but not the where-with-all? Again, she reminded me that they had done their due diligence. She said I could talk with her supervisor. I said that would be great, I'd like to do that. Maybe the supervisor could send an email? She put me through to a voice mail that said someone would do their best to get back to me in the next XXXX hours. Ugh! Not a person. > I took a little breather and tried again. From the start. I called HomeLoanServ, listened to the menu, pushed zero, listened to the menu ... hello? I now had XXXX on the line. I received a similar, but polite line of reasoning and help. I asked if I could get the transcript of my previous phone conversations. I would like to read them and see if I was just remembering the conversation incorrectly. The ones on XX/XX/XXXX and XX/XX/XXXX. She put me on hold while she checked with her lead. Do you think it was XXXX? When XXXX returned she told me that I'd need a subpoena to have access to the transcripts. Seriously? > I do not feel like this financial company provided me with the help and information I needed when I asked. I feel that the misinformation I was given, led to more problems and late payments. Those late payments led to automated negative credit reports that have seriously screwed with my life. When I turned to the company to help remedy the situation, I found deaf ears. > I did not request forbearance during our nation 's crisis. I budgeted appropriately and was able and willing to make my payments. I just needed guidance. The guidance that I sought and then was misled. I do not think the representative that initially helped me meant to send me down this miserable wormhole. Perhaps I misheard her. The quarantine was a tiresome window of time. I don't think the rep I spoke with when I called the second time in XXXX meant to give me false hope for my credit. I think my efforts to reach out for help and willingness to be paid in full attest to the sincerity of my dilemma. I do not think the leaders of this financial institution care beans about my XXXX XXXX, me as a person, or the predicament I have been placed in due to their careless guidance. I think that is sad. > I know making the payment on time was and is my responsibility. I fell short and did my best to remediate as soon as possible. I also believe that painting an accurate picture of one 's payment history for their credit is one of HomeLoanServ 's responsibilities. They take no ownership for the part they played. I asked for help and a dismissal instead.

Purchased the home in XXXX XXXX.I have XXXX XXXX as home owners insurance : The claim was filed on XXXX, denied for Wear and Tear, and long term leak. The area of the home was new, built 6 months prior to purchasing. Water bill showed water leak in XXXX only. XXXX XXXX would not communicate, I had my agent get involved, finally in XXXX they had another adjuster come out an admitted the first one, had done it incorrect. The check they sent on XX/XX/XXXX was to the wrong mortgage company, finally got corrected check on XXXX XXXX. I had a plumber assist the first adjuster, and paid extra for him to take the pictures, ect. I had them redo the plumbing, to avoid any other issues. I was more than cooperative, and even went above and beyond to help. This was a horrible experience, one that has cost me a lot. The issue was a HOT water leak, and it had ruined the subflooring ( particleboard ), causing mold, my daughter is severally XXXX, and ended in hospital twice. During the insurance experience I had to rip out the flooring and get the mold out of my home. Mortgage company : Home Loan Serv, XXXX Id I did not contact them until the first WRONG insurance check came in made out to them and myself. I did not realize I had too, so I spoke to them and sent them an email. I explained in my first email on XX/XX/XXXX that I did not know to contact them, the insurance company had dropped the ball causing a 3 month delay, mold was an issue and it had put my daughter in the hospital. I had already started the work, so my daughter could breathe again. I was half a month behind, because the plumbing and cost to start the work had caused some financial stress, plus I was diagnosed with a XXXX, and could not work any longer. The insurance adjuster said to tell them to put it towards mortgage since most the work was already done. I did so and the mortgage company stated that was ok, knowing how the situation was unique. She had sent an email stating I needed a contractor because I was behind but since most of work was done they agreed to let me proceed. I have emails to the insurance dept of the mortgage company and the payment center so they were all kept up to date, and new the check was going to pay it, I would continue with repairs. The payment center accepted the terms. We had discussed an inspection but I ended up having to take care of my sister for 2 weeks that died of XXXX XXXX, she was on home XXXX and I was taking care of her, she passed XX/XX/XXXX. I was keeping contact through this time also. Then out of the blue, they send me an email stating I could only do some repairs, but had to have a contractor, after a month of saying otherwise, and since all the subflooring was in, and the only thing left is my trim and flooring, knowing the mold was an issue, and the insurance disaster, they recanted a month later. How do you hire a contractor on work already done?? The email read as if we had never spoken before. I called and spoke to a supervisor and XXXX who stated that they would not accept my pictures for completion proof, and or any thing else, it had to be an inspection. They both told me if the inspection came back over 75 % it should not be an issue. The inspector did a detailed write up line by line, and it was 85 % complete. Above the amount needed per Home Loan Serv. I received the insurance check and emailed/spoke to XXXX again and she stated if at 85 % we were golden and to mail in the check, otherwise I was going to cancel the insurance claim and just finish the work myself, and pay the mortgage. I would not increase my insurance premium and then absorb all the cost while they continue implying and misleading me. No trust at all and this XXXX, claim was becoming too much. Since she said we were golden and the amount would go to my mortgage that was now more behind, I mailed the check. Then for 10 days I was ignored as I emailed asking for a status, to receive an email asking for the exact information the inspection gave them, and I was not allowed too before. I only had XXXX to finish the job as far as materials and only flooring, but we wanted to paint, and do other things prior to flooring ( owners change this all the time without permission ) and part of the insurance claim was my water bill that I paid due to leak, that they claim as theirs too?? I am now being told none will go to my mortgage and I have to catch it up, or no reimbursement. I am XXXX, and they know this, the social security office, has approved it and the monies from that will pay for mortgage. But now that they have lied, deceived and developed unethical practices, they are foreclosing on me. I even sent the info they wanted that was on inspection report and still, nothing. They wont release it. They want all flooring in and that was not part of any deal at all, and I am not ready to do it. This is horrible and I have been in the hospital with XXXX trouble, my daughter twice with XXXX, 3 medical bills. I believe they are doing this because I am XXXX now. What can I do? I also, Have recieved letters that i have a certain time frame to pay my mortgage and possible forcelosure letters. I told her why were my late payments not adding up. XXXX said, " that's what happens when you're late ''. My issues were not being resolved and i was not getting any closure. I also, brought up that around XX/XX/XXXX there was a lady banging on my door demanding my mortgage payments saying she was from HomeloanServ and left a note. I was in XXXX as of XX/XX/XXXX. I was able to see it on my XXXX Device. HomeloanServ said " It was an inspection most likely ''. but, that they do not send people to do that. Yet, i do not see any Inspection Fees in XXXX time frames.

I need help with HomeLoanServ. I have put in two complaints against them and they have consistently lied and given me conflicting information. In my last complaint, I described their explanation of events as follows : Completion of all steps to end forbearance happened in the second half of XXXX, XXXX - then I was advised that it may take up to 120 days for this doc to come back - then as 120 days approached, they had no updates or movement - I put in a complaint because I was unable to get get and useful information from HomeLoanServ, we appeared to be waiting indefinitely - after the complaint, the document gets expedited to me, I fill it out, and send it back to them - they receive the document, and for some reason they have been sitting on this for going on an additional three weeks now - when I called about two weeks ago, HomeLoanServ stated that the documents were at the title company waiting for recording. This was the basis of their lie that I caught them in. Because after several days of my document being " at title for recording '', I asked HomeLoanServ for a reasonable time frame, and again, they were unable to give me any time frame. I asked them for the name of the title company and for the name of an appropriate agency to report them to since our document had been at title for almost a week with literally no updates or movement. After I asked for the name of the title company to complain against, HomeLoanServ put me on two seperate 15 minute holds to figure something out. The first time, the manager tried to trick me by telling me he'd just call me back around the middle of the following week ( I made this call to them last Thursday if I'm not mistaken ), and the second time, the lady on the phone told me that they " just uploaded the modified doc to the portal for XXXX XXXX to approve '', which confirms that this company responsible for servicing this federal loan is literally lying to me, giving me misinformation, being deceptive, and is being avoidant of accountability. The reason that this proves that they are lying is that they told me some two weeks ago that the doc was at the title for recording - that's the very last step- but then when I wanted to put in a complaint against the title company, HomeLoanServ all of a sudden told me that the doc is waiting for XXXX XXXX. This proves that HomeLoanServ intended on delaying me by using one of their preferred clients as a scapegoat, thinking I wouldn't try and reach out to them or complain against them. I did put in a complaint for this very situation, and the following Tuesday ( Tuesday of this week ), a rep from HomeLoanServ called me and apologized, stating that the modified doc had been completed and recorded, and that it was unable to be sent to me now, but that she would send it to me once it was done. I told her on Tuesday that I wanted an email updating me, and she agreed. She never emailed me. My new lender has been sending them documents for them to fill out to move us towards our closing and they are blatantly ignoring them. When I called in yesterday, the rep who spoke with me earlier in the week was CONFIRMED AVAILABLE by two different HomeLoanServ employees when I called them, and TWICE I was either hung up on, or sent to her voicemail. Then the third time when I called, I was told that the rep was in a meeting with the " big boss ''. We can all only guess what's happening, this company is lying to me straight to my face after I complain against them so that they can hide this issue. They are forcing me and my current lender delays, they are intentionally causing problems and being highly deceptive, and they are acting in ways that are unaccountable. Frankly, we're just a single family, and we need help holding HomeLoanServ accountable. They are abusing their powers as an FHA mortgage lender, they are being highly deceptive, and they seem to be somehow benefitting from forcing me to wait, and forcing me to sit idly with no information available to me to plan for. They are purposefully keeping me in the dark and have been, and they are purposefully giving me loose and empty promises. I've literally caught them in a lie, which shows that they have intentional and purposeful involvement in causing these delays. They even tried to hang this blame on their partner Title Company to hide this trail - I will gladly leave a review with both companies stating exactly how this has happened if this is not resolved. I already know the name of the title company, and I see it both my responsibility and my duty to leave a detailed review on both company 's pages citing exactly what HomeLoanServ has been doing here, and I will especially cite that HomeLoanServ specifically tried to hang the onus of this delay onto the title company if this is not resolved today.

I applied for a Forbearance or a Modification of my home to HOMELOAN SERV on XX/XX/XXXX due to loss of job due to my sons XXXX XXXX XXXX issue at school which had to to due with a fatal error due to school officials disregard for my sons life due to medical reasons and not following his XXXX plan and the XXXX guidelines. They almost put my son in the hospital or he could have died due to their negligence. So I had to step in and take this to the board and that needed full time consideration. I reached out to the which I have full proof of documents. Then I get ignored for almost 4 months. By the time Coronavirus happened I had just applied again in XXXX and found out the person XXXX was no longer on my case without no communication or paperwork ever sent to me by them. I was then shoved onto XXXX this individua at HOMELOANSERV who has messed up my file so bad to this date because his lack for paperwork and his clerical errors this has caused me to now be denied because of him. He didn't do his job or follow through with anything. While I applied again in XX/XX/XXXX. I ended up in the hospital from XX/XX/XXXX with XXXX and XXXX XXXX and almost died. I was in the hospital up until XX/XX/XXXX. I literally tried calling them multiple times for months. I was ignored and shoved under the rug like my file didn't matter or just ignored all together. I have tried on several emails, several phone calls etc. These all went unnoticed for months. Then XXXX goes and sends me a letter on XX/XX/XXXX to some wrong address that wasn't my house address where my file is on my mortgage. When I got out of the hospital and when I got to feeling better after XXXX in my body with another XXXX XXXX in my body and a I had a piccline in my arm for 2 weeks after I left hospital XX/XX/XXXX. I had a nurse for 2 weeks coming to the home that I own my mortgage through and on a daily basis she placed antibiotics through my piccline for me. After I finally had this removed I was ablt to be myself again. Which was 2 weeks into XX/XX/XXXX. I finally reached out to XXXX my perosn I sent him an email sauying I havent heard anything I never recieved one paperwork or documentation for anything since XX/XX/XXXX. He sdaid well we need some paerwork on your end. Then I tried talking to him and once again he ignored me. Then I get a letter not at my house and was returned to post office from my house. I was given it at the post office. I was told that I was denied for all of this because I wasn't living in my house with my mortgage and I was denoised for not getting them paperwork. I gave them everything according to all my records which I have proof of. But I never once received response 's to anything for months. I have so much email proof. So basically I get denied because they say with no knowledge or proof that I am not living in my home. But yet I have proof that I have been since it was built, from my nurse, from my kids schools, from my work, from my w-2 's, from my tax for they sent me, from my taxes I paid to the city, from my alarm company, from my neighbors, from the hospital/ Because where on earth else would I be if I don't have a job and was in the hospital all of last year XXXX?? That is there excuse.. So how on earth can I get denied for this when it makes no sense??? I am just so mad as I am finally feeling good enough after a long year I have had to deal with and the this. I didn't need this. With all the help with my HUD loan and the Modications out there. They want to mut me a single mother with XXXX young children in the cold. I have to have another major XXXX in XX/XX/XXXX next month. I will be homeless for my XXXX and be out another 6 weeks because of there lack for any regard to my health or not being able to work, not having no income, not having a house is a huge deal after a major XXXX coming up. I just want everybody to know about how awful HOMELOAN SERV is. I am just so sad that they don't care. I am reporting them to the Federal Government since I have a HUD house. I will report them to the XXXX.

I originally completed all of my steps to end my forbearance on XX/XX/XXXX. At that time, I was told that it could take XXXX days for the " paperwork '' to be processed due to XXXX, but I was told to expect 120 days. Right around 120 days, I put in a complaint to CFPB about this company and low-and-behold, they immediately responded by sending out the document needed via expedited shipping. I filled this out, notarized it, and sent it back with expedited shipping. I BELIEVE HomeLoanServ received this modified doc as early as XX/XX/XXXX but I for sure know they had it on XX/XX/XXXX because I called them to confirm. They stated that the doc would be sent to Title for recording. When I went to my XXXX XXXX, a man who has been in the industry for XXXX years, he said that this is good news, because this was the LAST STEP before being sent back to the new lender ( we're doing a cash-out refinance ) and he mentioned that usually recording at the title takes a few days. I had actually called a few days prior to Friday XX/XX/XXXX to get an update and they told me that it just takes some time at the title company, but they weren't sure how long it would be. Come Friday XX/XX/XXXX, I called back and spoke with my rep XXXX, and I reminded her that I started this process in XXXX of XXXX, I also mentioned again to her that I am in the process of not only refinancing, but I'm trying to close on a new primary residence for my family. The Realtor already extended once out to XX/XX/XXXX, and HomeLoanServ 's delays here have more than put this closing in jeopardy, not only potentially costing us money, but setting us back ANOTHER month or two at the earliest. My complaint here is that when I spoke with XXXX on Friday XX/XX/XXXX, she told me that the title company MAY take another 30-60 days. I told her that this was unacceptable, and I asked for the name of the title company and told her that I would be putting in a formal complaint against them, because SOMETHING strange is happening. She put me on hold for about XXXX minutes, and came back saying that HomeLoanServ 's XXXX would be willing to call me in XXXX to XXXX days. I told her that's fine, but I still want to put in the complaint. She put me on hold again for XXXX minutes, came back, and said that the modified document was " just '' uploaded in XXXX way or another so that XXXX XXXX could " approve it '' ( I'm not using the right vernacular here ), a process that takes a couple days. This means that HomeLoanServ was LYING about having this document at the title company because they told me this was at the title company for recording. Turns out, this wasn't even approved by XXXX XXXX, so that means it was not waiting for recording. Recording comes after XXXX XXXX. It is my belief that HomeLoanServ responded because I was willing to complain against the title company, a company that had NOTHING to do with these extreme delays. These delays have been purely HomeLoanServ doing what they can to delay this process. I'm not sure why they would want to delay this process, my hunch is that there must be some federal assistance or award or relief that they are getting paid for as long as the account is in forbearance. My hunch is that they are operating unethically and they are trying to benefit by keeping my account in forbearance. I've already acknowledged to them about the closing date on the proposed new residential for my family and I've also told them that my mom put in for her retirement so she can work for me starting in XXXX. XXXX SHOULD have been a highly conservative time frame, but I am unable to account for unethical and deceptive practices. HomeLoanServ needs to acknowledge the impossibility of this document beign at title for XXXX weeks only to be uploaded to XXXX XXXX 's portal. This is clearly them lying. They used the grey-area of the accountability of the title company as a cloak, and when I told them I'd be complaining against the title company, they were immediately able to solve this.

This company is full of lies and extremely unethical in their practices. I have had nothing but headaches with this loan servicer since I asked for the covid deferral in XXXX after loosing my job. Once I got a new job about 4 months after, I called them multiple times and they refused to remove me from the deferral plan by giving me some XXXX reasons. I got very frustrated and resumed my payments in XXXX of XXXX. Someone called me in XX/XX/XXXX and I told them I asked to be removed off the plan in XXXX, XXXX, XX/XX/XXXX, XX/XX/XXXX and finally spoke to a counselor in XX/XX/XXXX where she processed the removal and I made it clear I want the balance to be put to the back of the loan. I also made it clear when I spoke to the counsellor in XX/XX/XXXX, that I want the deferred amount to be put at the back of the loan. Both conversations were on a recorded line. Fast forward to XX/XX/XXXX, they started sending multiple letters which I thought was in error since I already had it processed the deferral on the call back in XX/XX/XXXX and resumed making my payments in XX/XX/XXXX till the loan was paid off in full XX/XX/XXXX. I also signed two covid deferral letters which the first one, they claimed it was the most recent even though the most recent was sent to an incorrect address. The second one, they claimed they did not get it timely but thankfully that was tracked, and I was able to evidence the exact time it was received. The main issues I am reporting currently are 1. XXXX XXXX XXXX XXXX XXXX ( XXXX ) did not accurately report my loan as paid off in XX/XX/XXXX and still showing the account has a balance of {$170.00}, XXXX and showing that I am 2 months behind. In addition, they are not showing all the payments I have been making correctly ( for example showing that there was no payment made for XXXX XXXX XXXX XXXX XXXX XXXX This is in addition to showing incorrect amount for the actual on XX/XX/XXXX and for the scheduled amount ( scheduled amount should be {$1300.00} and not {$1300.00} ) 2. I contacted them to tell them about this in-accuracies and instead of correcting the error immediately, I was informed I needed to file a credit dispute first ( see response from their credit specialist ). Why would a servicer not correct the error once I informed them? In fact, they verified in XXXX to the agencies that current status is being reported per below which is a complete lie IXXXX XXXX AGENCY THIS CREDITOR HAS VERIFIED TO OUR COMPANY THAT THE CURRENT STATUS IS BEING REPORTED CORRECTLY. THIS CREDITOR HAS VERIFIED TO OUR COMPANY THAT THE PRIOR PAYING HISTORY IS BEING REPORTED CORRECTLY. THE FOLLOWING FIELDS HAVE BEEN MODIFIED : ADDITIONAL INFORMATION, HISTORICAL ACCOUNT INFORMATION, ACCOUNT HISTORY IN REFERENCE TO YOUR QUESTION REGARDING THE INVESTIGATION PROCESS : XXXX. In addition, they sent a letter on XX/XX/XXXX copying CFPB that they corrected the past due on the reporting ( see attached letter from them ). This is incorrect, because that was not done. In fact, they are updated the reporting in XX/XX/XXXX and still showing the account as late. To resolve this, XXXX. XXXX must correct all the inaccurate reporting to all credit bureaus ( must accurately show all the scheduled and actual payments I have made to date ) XXXX. Remove all the delinquencies and late payment reporting because no payment was not late. It was deferred as part of the XXXX deferral. XXXX. Report the correct paid off status This must be done immediately, and I want evidence of the correct reporting done, since all they do is lie to hide their negligence. In addition, CFPB really needs to investigate this company as it relates to how they handled the COVID deferral process and the fact they did not comply with the CARES ACT. Please be advised that it is our intention to help the best we can with the issues presented as the servicer of the mortgage in question. XXXX XXXX has stated in this complaint that he has attempted communication with HomeLoanServ on numerous occasions but has not been able to connect with an individual person to address his concerns. XXXX XXXX spoke with one of our representatives on XX/XX/2021, and was advised that his loan was not reporting to credit at that time. On XX/XX/2021, a supervisor thoroughly reviewed XXXX XXXX loan. This review confirmed that HomeLoanServ requested a one-time courtesy correction to have the months of XXXX, XXXX, XXXX, and XXXX reflect as on time. Please be advised, XXXX XXXX loan shows delinquent at this time and will report as such until delinquency is cured. In addition, a supervisor reached out to XXXX XXXX by phone to offer assistance for the XX/XX/2021 complaint. However, XXXX XXXX refused to speak with this supervisor. XXXX XXXX has previously filed formal complaints via the CFPB Portal on XX/XX/2021, with complaint XXXX, on XX/XX/2021, with complaint XXXX, and on XX/XX/2021, with complaint XXXX. HomeLoanServ responded to each of these previous complaints on XX/XX/2021, XX/XX/2021, and XX/XX/2021, respectively, and filed each response on the CFPB portal. This has been the most diluted issue that I have ever delt with. This account is " Delenquant " Why.? One the payment skyrocket over 500 + dollars a month and when I reached out to ask why i got nothing from you all literally not a thing till someone from collections called wanting the balance and when she couldn't give the answer a supervisor XXXX was involved who said he is sorry that you all are poor at your jobs and could not tell us why. He adjusted the amount which was odd then I informed him that I was going to refi as this is an issue he stated that he would have credit hold up on any reporting for 60 days. Yet in the process of getting this done what happened but a late that was due on yalls part. Then I reach out again and nothing I had to use the CFPB and finally got the most detailed response as to why yet you all sent a check for that same amount and that still makes no sense as to why there was not a BIG bright red flag about this nor convened at the time I enquired about it. But still nothing from anyone I have spoke to 2 so-called supervisors who stopped all communications after the 1st email XXXX being one of those so-called supervisors. I have repeatedly used this platform as this is the only way you all communicate as well as the XXXX and now the TX attorney general 's office as what you all are doing has got to be illegal. This last one where Cherish the supervisor who called was not denied to speak with I told her that you are the manager who quit communicating and then acted as if there is nothing wrong with that. I told her that I did not want to speak to her that I wanted her supervisor as what has been happening is I'm just being passed around. She stated that her supervisor would call me that same day XX/XX/XXXX and here it is the XXXX and none of that has happened other than you all stating that I am refusing This is why the account is delinquent you all have no communication process you are holding my account hostage so that I am just stuck with you all you were not supposed to report a late for 60 days you did I would have been happily gone and with another company and away from this sham of a business. On XX/XX/22, I called my mortgage company, HomeLoanSer. My last mortgage payment was on XX/XX/22. This was with a repayment plan and went to XX/XX/22 late dues. I stated to the mortgage counselor my recent XXXX XXXX and XXXX with an XXXX XXXX in XXXX. I wished to work in tandem with them and that I am XXXX XXXX away getting XXXX XXXX, staying at my parents home and going back and forth between the two properties. The counselor asked if the home was vacant, and I again stated for the moment and unsure when I will be permanently, full time back home. I agreed to the offering of a lockbox for peace of mind while away. I believed it was to avoid any additional distress to my XXXX XXXX and treatment and all more secure from intrusions as with my XXXX home security since hours away for days to weeks at time. To avoid any financial hardships for either party by renting out, a repayment plan, or even worst a foreclosure. I informed my desire to sell the property as I sadly had XXXX XXXX needs and wished for a smooth transaction of the sale.I was instructed to write a request of this while on the phone and ask for the lockbox access codes. I stated my desire to work in tandem with the mortgage company, my realtor, and myself on a resolution that secured all assets with little to no losses. They were informed of all details and the relator acquired with an update given on XX/XX/22, when getting the home ready for open houses and viewings. The mortgage company had changed locks which I did not think was meaning to a lockbox, they left garbage and debris all throughout, hardwood floor scratched from thier decision to change my doors, and the back gate entrance slats were broken. I was never given any inclination of work performed or services rendered to my home which still had my clothes, bed, couch, and other furnishings still there. Only after requesting a payoff statement and several more communications from myself was when I was informed of a {$7000.00} fee added to XXXXXXXX XXXX mortgage payment and overall payoff. Their was updates of the sale agreement, home viewings, and more from myself. It took several emails and calls to get any details on what this additional fee was for and still no full disclosure or itemization for the {$7000.00}. To add they have only avoided my inquiries only emailing over a packet on short sale. I never rendered the allowance of any home alterations nor improvement desired. This violation to RESPA/TILA and gross neglect to openly communicate with the home owner seems highly illegal since no court ordered foreclosure, or voluntary given up all ownership and responsibilities to my property. In fact its brought about damages to my property, loss of the sale to my home buyer, and made repayment/ payoff no only thousands of dollars higher than the loan origination but the need to now seek short sale. In working with HomeLoanServ with aid to loss mitigation lead to grave distress to my XXXX and XXXX needs to a possible foreclosure damaging my credit entirely. I never abandoned the home, nor wanted any of this. They only continue to avoid communications from all my calls and emails asking for more details to this unfair and deceptive practices. The only response within 24 hr.+ of request is sending a short sale packet. I fear they purposely did not direct myself to a HUD counselor for loss mitigation or my legal rights.

I purchased a home with a VA loan as a qualifying widower of a XXXX veteran. I signed this home loan purchase at the documented monthly payment at a much lower rate than what it currently was. In XXXX of XXXX I was sent a notice of change in monthly mortgage payment. To be due 1 year and 2 months after I purchased my home, I was sent a change in mortgage monthly payment amount, due by XXXX/XXXXXXXX only the month prior. They also didnt include the property tax exemptions for being XXXX into the increased note. AND I was told the payment was going to be due on the XXXX of the month. Which is around my payment date. It is due on the XXXX monthly. They increased my monthly mortgage payment from {$1200.00} TO {$1900.00} They approved and signed my loan at XXXX $ a month. Then told me they didnt add something into the loan at purchase agreement which caused the increase to XXXX XXXX That is their fault. They approved and signed the same papers I did. I entered into forbearance on my investment property in XXXX of XXXX. I called to make arrangements and started paying my mortgage in full starting in XXXX of XXXX. I formally submitted all documents to my lender HomeLoanServ on XX/XX/XXXX ( and I have a letter from them declaring this as fully completed ). To formally end my forbearance, I have been instructed to submit documents as I have and I've been instructed to keep paying my mortgage. I have to date paid four consecutive on-time mortgage payments and will be paying my fifth in about a week. The final step to ending my forbearance is my receiving, signing, and notarizing of a government-generated ( not sure if state-level or federal ) document to being mailed to my address here in XXXX, IL. Once I get that document signed and notarized and sent back to the mortgage company, I will be officially out of forbearance. The issue I am running into is that this document should have arrived at 30 days after submitting all of my documents, only to later hear from my lender that it would likely take 60 days - that would have been the very tail end of XXXX for the 30 day estimate, and the tail end of XXXX for the 60 day estimate. Its now approaching XXXX. After speaking with the finance company in follow up, they told me that they have been advised to tell folks to " expect this to take 60 days instead of XXXX, but it will in reality be closer to 120 days '' 120 days from submission would put this document in my house this coming week and I have no reason to feel assured that this document is going to be produced any time soon. I am currently in the process of refinancing this home so I can purchase a new home, and I currently under contract to purchase a new home. If this document continues to be delayed ( and it has already been delayed by a quarter of the year ), I will lose my opportunity to purchase this home and I will lose my earnest money. I already have an extended proposed-closing date set for XX/XX/XXXX. Having fully submitted all documents and fulfilling my obligation in full for going on five months, and with this document being delayed without explanation for almost a quarter of the year, I am starting to grow very worried that I'm going to suffer financial consequences and I am going to lose out on purchasing this home because of this delay. I can't do anything about this, all I can do is stay in limbo and keep paying my mortgage. This home is the dream home for my family at this stage of our lives and we can not risk losing our opportunity to move here, given that we are fully qualified buyers and we have an accepted offer to purchase. I brought the house on XX/XX/XXXX and during the closing, an escrow account was estimated {$550.00} monthly to cover my property taxes and insurance. My loan was to HomeLoanServ./ Idaho Housing XXXX. XXXX XXXX XXXX, ID XXXX for servicing of the loan. On XX/XX/XXXX Loan # XXXX I received an escrow disclosure statement from XX/XX/XXXX to XX/XX/XXXX showing the disbursements of escrow payment and showing in XX/XX/XXXX they paid my taxes of {$2200.00}. and they are going to recalculate my monthly payments $ XXXXand refund {$5900.00} because this would be large surplus and they can't keep it. I decided to call HomeloanServ to figure out why there was such a large surplus, and they said not to worry about it this happens all the time. I made them aware this was a new build home so the taxes will go up XXXX year so I don't think they have this worked out correctly, they basically ignore my concerns. I decided to check my property taxes with the county and notice there was two mortgage companies paying my property tax - HomeLoanServ./ Idaho Housing and XXXX XXXX. On the payment history, I notice HomeLoanServ./ Idaho Housing was refunded the property for the 2018 year. I called and asked what happen they ignore my concerns and did nothing. I called again and they did nothing. In XX/XX/XXXX I decided to follow up again on the property for XXXX and notice again my taxes were paid by HomeLoanServ./ Idaho Housing and XXXX XXXX again and HomeLoanServ./ Idaho Housing received another refund of {$5000.00}. I contact HomeLoanServ./ Idaho Housing again and question the issues and was ignored. She started telling me I should contact freedom mortgage and figure it out. I told her no I wouldn't be doing this because I have no affiliation with XXXX XXXX this is a new build home and HomeLoanServ./ Idaho Housing is the owner of the loan whom I make monthly payments too so they should figure it out. After months of back and forth, I was told there was an error with property information by XXXX XXXX from HomeLoanServ./ Idaho Housing . XXXX XXXX handles the taxes escrow account for HomeLoanServ./ Idaho Housing , so she should have notice this error from XXXX when she received the first refund for the XXXX taxes but she ignored it didn't do anything to fix it instead she misrepresented the information on escrow analysis that was provided on XX/XX/XXXX and recalculate my escrow in error to {$550.00} to {$370.00}. For some six months past the due date, XXXX Housing and Finance Association ( IHFA ) failed to pay the XX/XX/XXXX property taxes on a home purchased from me XX/XX/XXXX. This resulted in interest and penalties being imposed ; the permanent slander of my name and financial status ; the loss of a property tax deduction for the buyer ; and many hours of labor by myself and others to rectify the situation. Elaboration : IHFA 's client XXXX XXXX XXXX purchased a house from me on XX/XX/XXXX. XXXX realtors, a title company and an escrow agent, all duly licensed, facilitated the transaction. XXXX law requires use of an escrow agent and payment by the seller of prorated property taxes at closing. This was done. The attached XXXX XXXX XXXX shows I paid {$670.00} in prorated property taxes at closing. XXXX law also requires that a XX/XX/XXXX seller 's name remain the name of record for XX/XX/XXXX property tax purposes and that the buyer notify the County Treasurer and Assessor of a change in ownership. The XXXX and XXXX halves of XX/XX/XXXX property taxes were due XX/XX/XXXX and XX/XX/XXXX, respectively. IHFA failed to pay any tax by these dates. On XXXX XXXX, 2015 I received a notice that I ( the seller ) was delinquent in the payment of the property tax. Furthermore the County Treasurer lists on its public web site that I have been delinquent, slandering my name and financial status. See attached documents. My XX/XX/XXXX HUD-1 Settlement Statement shows that the lender was Primary Residential Mortgage of XXXX XXXX XXXX, XXXX. But after many hours of speaking with the parties involved, researching, and consulting an attorney, I found the loan had changed hands around XX/XX/XXXX-XX/XX/XXXX. At this time I understand there was a XXXX-link chain of lenders. The XXXX mortgage holder is currently XXXX Housing and Finance Association. I notified IHFA that it needed to pay the property tax. It did so XX/XX/XXXX. Various losses to me remain. XXXX will be to the permanent detriment of my reputation. I accuse IHFA of abusive practices and waste. I think few XXXX would have the time and ability to have identified who was responsible for the property taxes. Many XX/XX/XXXX home sellers, under duress, might have double paid property taxes ( once at closing ; again upon the County Treasurer 's notice of delinquency ). To abuse home sellers and buyers is an easy matter, perhaps especially in the case of mortgage holders servicing loans for those of more humble means. Waste includes squandering my and others ' time ; accumulation of interest and penalties on the delinquent property taxes ; and the buyer of this home ( XXXX XXXX XXXX ) not being able to take a tax deduction XX/XX/XXXX for the payment of property taxes. I really have just about had it with everyone involved at this point. I am a good taxpayer and bill payer, single XXXX year old woman. Not some whiny XXXX. You need to use your attorneys and straighten this out for me and everyone else being harmed. I took out a mortgage with down payment assistance that was a silent lien, a lien placed on the asset. I have enclosed a copy of the recent credit report update. Now they show both by First Mortgage and the XX/XX/XXXX status as if it is in " Forbearance '', I also enclosed a definition straight from XX/XX/XXXXselling guide as to their definition of Forbearance since no one is quite sure what it means. I have tried this complaint 3 times, each time has yield a different result, previously the bureau simply removed both reportings as " closed '' Now, they put them both back on and noted they are in " Forbearance '' " A forbearance plan is a retention option in our workout hierarchy for a borrower with an eligible hardship that is temporary in nature and has not been resolved. A forbearance plan provides for a period of reduced or suspended contractual monthly mortgage payments, followed by a full reinstatement, mortgage loan payoff, or another workout option to enable the borrower to resolve the delinquency '' The Silent second was a lien, there is no balance due, there are no interest charges, there are no payments due, yet they show it in Forbearance. It is killing my Credit Score, it looks like a collection account. Recently looking at a car loan, the lender told me they would count 5 % of the outstanding balance " as if it were a collection account ''. This account is a lien, it in no way needs to be reported on a credit bureau, it affects my ratios, it causes a lower credit score ... this is simply unacceptable. I never agreed to this. The SIlent Second was disclosed to the First Mortgage provider, I was not informed that XX/XX/XXXX would be reported to any credit bureau in any fashion.. The First Mortgage, I did sign paperwork that I understood the lenders obligation and my rights under FCRA The big issue, the First mortgage with Home Loan Serv is I pay this every month and have all year, even while being unemployed when my employer closed, yet it shows in Forbearance. It is not in Forbearance, they are just trying to keep me paying the high interest rate because in reviewing XX/XX/XXXX guidelines : homeowners who missed payments and entered into a loss mitigation solution such as a repayment plan, payment deferral, or loan modification are eligible for a new refinance or purchase mortgage after three timely payments. The lenders I spoke with were very clear the current mortgage can not be noted as " in forbearance '' From what else I read, the receive a premium of some sort when I make timely payments if they code it as in Forbearance.

HomeLoanServ set up a loan modification with me. The agreement was that I was supposed to make three months of on time payments and then the modification would be completed. I had the third payment completed by XX/XX/. I was told that XXXX would be processing the paperwork for the modification. I didn't hear anything. I called in several times since then and was told that there was a rare glitch in the system or something. XXXX told me that he had told his supervisor about it and they would work on it. I called in several times after that and was told by multiple reps that they weren't sure what the hold-up was, but to keep making my payments. I then received some mail about a modification with past dates on it. I was confused, so I called in. I was told that they must have forgotten the paperwork even though I had already completed previous paperwork and the three months of payments. I sent it in as I was told. I called in several other times and was told by the reps that they couldn't see what the issue was. One rep at the beginning of XXXX told me she could fix it but didn't want to because maybe she didn't have the whole picture. She then said she would contact XXXX. I said I would email him. He responded saying that, " For some reason our system is trying to convert the workout we have with you to a different one. My supervisor is aware and she is working on correcting the issue. '' That was on XX/XX/XXXX. I emailed him again on XX/XX/XXXX saying that I had gotten a credit report notice that my mortgage was severely behind and it was knocking the score down further. I also stated that I was accruing late fees from them still I didn't receive an email. Today I called again. The first rep. said that I had to wait another 120 days. That didn't seem right, so she said she would have a supervisor contact me. I hung up and called again because no one had ever told me that I would have to wait another 100 days after completing the third payment. She was rude, so I called back. That rep. told me what all the others had, minus the first one from this morning, that my paperwork should not have been held up. I bawled. I'm trying to get myself out of a financial pit after divorce and a car accident. I can't get help with a credit score that keeps dropping because it shows that I'm almost a year behind in my mortgage. She sent XXXX an email. I called three more times today. One rep was named XXXX. She refused to let me speak with a supervisor, but she said she would send an email to one. The last person put me on hold for ten minutes and then nothing... I can't get any help. Please, help me.

My loan was transferred to HomeloanServ after my closing. I began making my payments in XXXX, but went on maternity leave in XXXX. I called the company in XXXX noting that I wouldn't able to make the full payment as I was on maternity leave and my income was reduced. I was told that there was nothing that can be done for me until I miss two full payments, which would ruin my credit. I was sent documentation to fill out and was told to wait until the end of XXXX to submit them. Two weeks after submitting my paperwork I was given a call and asked how much can I pay. we agreed on an amount and that was that. I never received a document stating what program I was on what the stipulations were, what would happen at the end of the program nothing. I called back in XXXX and spoke with a lady who told me some information but was very vague and told me I had to speak with my assigned case worker XXXX XXXX XXXX also inquired about the new program signed by Biden to into HUD to reduce lenders PMI, she had no knowledge but did look it up with me on the phone and said she would make a note of it as well. We ended the call with her noting she would let XXXX know to call me. I never received a call and called back and left a message. On XX/XX/XXXX I received and email from XXXX with a phone number to call. We had a conversation about the lack of information I was given during this process and how I was not informed of my other options. She agreed that I was placed on the wrong program, but assured me that the program I was placed on was the best one for me. I also inquired with her on the PMI reduction program signed by Biden and she had no knowledge of it and stated she would get back to me. I did not hear back from her at all. After speaking with a lawyer I was urged to give the company a call back and find out what program I was on as well as any documentation as to what happens when this program ends. I emailed XXXX on XX/XX/27 and requested documentation and she responded with a phone number to call. I called XXXX and asked for a the document attached which only states the agreement. I asked her what were my options once the program was over in which she was extremely vague. She stated there were multiple options but a resolution would be noted when we as the end of the program comes. I asked if I was not financially able to make the full payments at the end of the program what are my options. She noted that I would have to put my house up for sale.

Mortgage company thought the home insurance that they are to pay on our home didnt get paid. So they purchased more insurance when in fact it did get paid. They then raised our mortgage from {$680.00} to {$1000.00} a month. I called and asked why they did this and was told it was due to the taxes being raised on the home. I called the assessor to see how much the taxes went up and they told me {$120.00} A YEAR! I had also before any of this happened filed a complaint through your office in regards to them saying they would not help us through Covid. They said they never said it but they did say it to us. So any how the raise in our monthly payment went up {$400.00} a month for our taxes going up {$120.00} a year. They do nothing but harass us. My Wife and I both had XXXX and they would still harass us even while sick. On the very month that our mortgage was raised they did not tell us and I made a normal payment of {$680.00} thinking it was paid in full. However, they did not even let us know about the increase in our mortgage til the next month. So they put the {$680.00} in escrow saying we are behind on our mortgage. We pay them every month! I had made arrangements with them that I needed to pay on the XXXX of each month due to how I get paid. They agreed at first but every 2 to 3 months it goes back to the XXXX its due. So once again I have to call on it. This has happened several times. The raise in our mortgage never should of been raised in the first place. I also had told them that right before the Covid hit I had a severe XXXX that put me out of work for a while, u til I could recover. However, the mortgage still got paid every month. So in my case it was a double hit on my health. I was sent to a recovery hospital where I had to learn to walk again. But like I said mortgage was always paid. May of been late some times but paid - Recently they sent us a certified letter saying Notice of pre foreclosure options. Why?! The letter didnt even state why or what it was in regards to. Just a letter of foreclosure options. As if we didnt already have enough to worry about! This company wont stop! In XXXX of XXXX my husband lost his job due to XXXX. My mortgage went into the COVID forbearance program that was offered. Once it was in forbearance, I was no longer given access to their online system to view my account and thus had to pay via check. My husband and I both started new jobs in XXXX of XXXX, where I took a large pay cut but trusted it would be okay knowing there would be two incomes again. Shortly after he started working there, I found out that he had lied about most of his past and that he had run up debt on my credit cards. We immediately XXXX and I was faced with providing for me and XXXX XXXX children on half the income I used to have. When the COVID forbearance came to an end, my mortgage company wouldn't let me modify my loan without my husband 's driver 's license number, which I didn't have because he told me he moved out of the state and refused to give me any information about his location. His name has never been on my loan and I don't know why the mortgage company was insisting they have his information. The only other option they gave me was to modify the loan with a divorce decree. Without his location, I could not serve him with divorce papers in order to provide that information to them. I got very behind in payments because of my income drop, the credit card debt and not being able to proceed with the divorce. In XXXX of XXXX, I was able to get a higher paying job in order to provide for my XXXX and I. I did send mortgage payments when I could but the mortgage company did not apply them to my loan at the time they were sent. They cashed the payments yet did not apply them to my loan until a lump sum was deposited in XXXX of XXXX. On XX/XX/XXXX, I received notice of default on the loan and they were requiring me to pay {$25000.00} within 35 days. There was no way I could pay that and have since been trying to figure out how to cure my mortgage. I have been paying the mortgage consistently in the recent months but they started sending my checks back telling me that it's " illegal '' for them to accept my payments. They also have not been forthcoming regarding the foreclosure process and timelines.

We have had our Mortgage with HomeLoanServ since 2015. We have had several instances over the years where our payments are being applied incorrectly. We make a partial payment on the XXXX, log in on the XXXX to make the rest of the payment, only to discover that the previous payment went towards interest instead of principal. We then have to call and have the situation reconciled every time this happens. When I called to file a complaint I was transferred around to 3 different people, and finally transferred to a man who just kept telling me I didn't understand how banks work. That if anyone using this institution were to make a partial payment at any time this will continue to happen, payments will continue to not be applied towards the monthly principal balance, and the consumer is expected to call them every time this happens. When I expressed that this is a shady business practice and sounds a lot like a scam, they purposefully change your payment to interest if it is not a full payment hoping you won't catch on and pay them extra money, he raised his voice at me and told me to go ahead and file this complaint, it wouldn't make a difference. The conversation lead me to believe this is a very common occurrence at the institution, where they apply consumers payments to the wrong option and expect them to call in to have it fixed, or they will continue to make double payments if they don't catch on that this is happening. I also have tried to download my statements to receive a detailed transaction history, and they are telling me that is not possible. My current XXXX statement shows I made 2 full payments and 1 partial which applied to my XXXX mortgage principal. When I called to inquire about this I was told one of those payments actually went towards my XXXX mortgage principal payment ( which one? ), but nowhere in my statement does it say that. I asked for a more detailed statement that would list exactly what month each payment was applied to and was told the company can not produce that type of statement. I was again met with condescending language, telling me I just don't understand how banks work.

We placed our mortgage in forebearance back in XXXX, XXXX. Upon the six month forebearance expiry date in XX/XX/XXXX, I contacted the company, HomeLoanServ a.k.a. Idaho Housing to take our loan out of forebearance in order to resume payments. They said they would send paperwork and we were to wait for a call from their traveling Notary Public. The call never came. The HomeLoanServ company sent us paperwork that we filled out and sent back which included a request for past tax returns, and two months of pay stubs, which we provided. Then they sent another letter stating we missed two weeks of pay stubs and we had 4 days only to get the documents to them, or the deal was off. Well, that was XXXX of XXXX. I called them in XXXX and they said that we weren't eligible to exit the forebearance ( which was false ), and that they had sent us paperwork for a loan modification. Well, we were already in process, they said it would be 30-45 days from the XXXX date that they would call and notify us of our options to begin repayment on our mortgage. I called them at the end of XXXX, and 5 times last week, and 2 times earlier this week. Different agents tell us different stories. My favorite one is that we must have been confused because we are eligible to resume payments by placing the forebearance debt onto the end of the loan. Ok, well, we are supposedly near the end of the loan modification process so we thought it would be wise to wait and find out what all the options are before making a decision. According to HomeLoanServ assigned agent, they only have one person authorized to sign off on loan modification applications and she has hundreds of them outstanding. Well, it's the end of XX/XX/XXXX. HomeLoanServ blew past thirty days, forty-five days and now it's more than 60 days and still no information. We are down to one vehicle for the family and we can't apply for a new auto loan to purchase another vehicle until we know what our house payment is supposed to be. We are growing tired of all the excuses and procrastination and false and misleading information coming from HomeLoanServ and desire a speedy resolution.

I am super frustrated, this is my 3rd complaint. Take action Please. I purchased a home using XXXX XXXX, they provided Down Payment Assistance tthru Texas-see attached page. In XX/XX/XXXX a trial period was agreed upon by both parties in which three installments were to be made in consecutive months to commence the loan modification process with the new 2.5 % interest rate. This was paramount for me because I had been unemployed for 19 months ( XXXX XXXX XXXX ) and needed my income to justify any modification. Over the course of six months the only delay in making the modification official was a lien handed down on my property that I wasnt notified of until XX/XX/XXXX. I acted swiftly to pay this which led to the release of the lien in XXXX of XXXX. I continued to call to pay my modified mortgage and asking for an update to my modification but only words followed ( as opposed to the action promised each time ). Its makes no sense for XXXX more months to elapse without any guidance, direction, or expectation set but this is exactly what transpired culminating in the the most gut wrenching phone conversation ever to occur in my life when a call to pay my XXXX mortgage informed me that the documents had been delivered and since more than two weeks had elapsed since distributing them a new modification would need to be enacted. Apparently they had been sent while I was away. How could a reputable business allow so much time to elapse without presenting any other explanation than we have thousands of loan modifications to deal with? To ask a hundred questions with only a few actual answers received over the course of XXXX months is completely preposterous! Well, sir, we dont work with that department isnt acceptable feedback to acknowledge before, during, or after this process. Now I have to somehow accept a 6.0 % interest rate and a {$40000.00} delinquency amount because the trial period payments were significantly lower than my previous mortgage ( pre-CoviD ) amount. Standards are quintessential in business arrangements and its clear that my HomeLoanServ coerced me to believe I was getting ahead only to end up further behind than I initially started in XXXX of XXXX.

Complaint is regarding Idaho Housing, XXXX XXXX relating to incident occurring in XX/XX/XXXX and remains ongoing with no updates to a resolution. Preliminary : XXXX XXXX XXXX was moving its business out of state and I needed to find new home owner 's insurance by XX/XX/XXXX. I found two homeowner 's insurance companies, XXXX ( XXXX XXXX XXXX ) and XXXX. I opted for XXXX insurance which was finalized through intermediary, XXXX XXXX XXXX company and it was billed to my escrow account with Idaho Housing. Billing amount with XXXX was for {$630.00} in XX/XX/XXXX. For another reason XXXX was also processed and billed to escrow for {$1000.00} in XX/XX/XXXX. Another duplicate billing for an amount of {$1000.00} was done in XX/XX/XXXX. I am assuming this is for the same homeowner 's insurance amount for XXXX. It is understandable that I should have only {$630.00} and {$1000.00} billed to escrow. The {$1000.00} was reimbursed by XXXX via check, which was deposited into my checking account. I have yet to trasfer the {$1000.00} to my escrow. However, the main inquiring of concern is regarding the other duplicate amount of {$1000.00} dated XX/XX/XXXX, which needs to be reviewed further for additional clarification. Additionally, back in XX/XX/XXXX I was terminated from my employer and I attempted to reach out to Idaho Housing for additional assistance for my mortgage. Idaho Housing representatives stated to me that due to my loan being less than one year Idaho Housing could not be of assistance. I also want to make sure that at the time of contact, Idaho Housing was following FHA Servicing Guidelines and Regulations regarding my attempt to explore workout options. I was in contact with Idaho Housing call center representatives with no timely success to my problem that has arisen with the company regarding my homeowner 's insurance. XXXX and XXXX are not the focus of attention- resolutions were made with both companies. No documentation needs to be shared with XXXX, XXXX XXXX, or XXXX.

Hello, I am not sure who I would contact in regards to checking the legalities of my Foreclosure in Idaho. I was Foreclosed XX/XX/XXXX/XX/XX/XXXX. My loan was originally through a different lender in XX/XX/XXXX. Then somehow it was switched over to Idaho Housing and Finance in XX/XX/XXXX without my knowledge. In XX/XX/XXXX I was able to modify my loan through the E-Help program. Although it took my percentage rate up to 5 %. In XX/XX/XXXX/XX/XX/XXXX I got behind on my Mortgage due to personal reasons. XXXX for 16 weeks and the XXXX of my mother which I needed to take FMLA to care for her prior to her XXXX. I attempted to modify my loan through Idaho Housing and Finance and they would not approve me to do so. They stated that since I am a XXXX that traveled at the time, I was considered a XXXX. I never received XXXX so I do not understand this thinking. If the government does not consider me a XXXX XXXX how can the lender state that I am a XXXX XXXX? I at one point met with the counselors and had all of the money to pay except for one month. I advised the counselor I would be able to catch up the following month with the full payment. He stated he would not Modify the loan still as I was considered a XXXX XXXX as long as I was a XXXX that traveled. There are a XXXX XXXX that travel for their work and I do not understand why I was singled out and not able to modify my loan. The counselor I worked with kept telling me that he was following the FHA rules. I called an FHA counselor and he stated it made no sense and he would have refinanced me with out an issue but my loan did not show up in their system. So obviously something was not right. I reached out to Homeloanserv for the Covid Forbearance and then around XXXX of XXXX my account was reviewed and elgible for the FHA Partial Claim/Modification program XXXX Well Homeloanserv sent my paperwork after XXXX XXXX weeks to a stranger with all my personal information it and a higher amount that was incorrect. I asked them to hold off because i was approved for a grant that bought my mortgage current and then spoke with supervisor XXXX that gave me an option to modify my loan. It took over 4 months to receive the modification agreement. During this time my property taxes was paid early XX/XX/XXXX. Homeloanserv did not do an escrow analysis or anything for me. They waited until XX/XX/XXXX to process my modification and posted late on my account. A payment for XX/XX/XXXX of {$1800.00} was sent to Homeloan on XX/XX/XXXX and they have it posted on my account with the wrond date XX/XX/XXXX. I have enough money in my escrows over {$9000.00} to cover my property taxes for rest of year including property taxes over {$1600.00} that was included into XXXX & XXXX XXXX payments. They have not sent me a surplus refund or even asked if i wanted it. Homeloanserv did not pay my property taxes to XXXX XXXX. They wont even provide me with proof of their payment which i requested already. I am double paying property taxes and my loan should be updated and overall monthly payments reduced with the prepaid taxes in the escrows. They wont return my calls, they are lacking in professional principle ethics and not communicating with me or granting any type of help. Just taking me in circles with stress and frustration which would leave me with inaccurate mortgage finance numbers on my account and push me to be late or possible foreclosure. I dont understand their unprofessional behavior. I need a resolution immediately

I was under the covid forbearance program and while i also had significant issues with that process, they are refusing to comply with the terms and still reporting the forbeared amount ( {$11000.00} as delinquent ). I have resumed making my payments consistently since XX/XX/XXXX and also in some cases made more than my regular payment amount and they have not been applying the excess amount correctly. They have also reported incorrect information in my credit reporting which was reported XX/XX/XXXX. These are all the incorrect information to date : 1. Reporting forbearance from XX/XX/XXXX through XX/XX/XXXX ( 17 months ) instead of 9 months ( please note that they should not be reporting this in the first place per CARES ACT ) 2. Reporting XXXX XXXX payment late even though they received payment per transaction report I pulled from their page. This homeloanserv transaction statement showed I pay {$1400.00} monthly and they only apply {$1300.00} which is incorrect. 3. Month end balance as of XX/XX/XXXX is {$160000.00} and they are showing {$170000.00} 4. They are showing a monthly payment of {$1300.00} on credit report even though my monthly payment is {$1300.00} The number of inconsistencies is mind boggling to say the least. I called again today and spoke to XXXX who was beyond rude and asking me to email their support team even though I have done this on multiple occasions with no response to date. This loan servicing company is not complying with regulations and especially not following Section 6 of RESPA as they have refused to respond to any of my written requests. I am super frustrated. I submitted a complaint last month to CFPB and the situation has worsened. I purchase a home with a conventional loan through XXXX XXXX company who then sold the loan to Home Loan Servicing out of Idaho. Who doesn't seem to work within FCRA guidelines. I inquired about the forbearance program for my first mortgage back in XXXX but, continued to make my payments, I have requested they remove the remarks regarding it is in forbearance so I can refinance the mortgage, see attached, My major issue I need help with is I purchased the home using down payment assistance which I signed paperwork acknowledging it was to be recorded as a lien but, signed no paperwork regarding it ever be reported to the credit bureaus. See attached. Adding insult to injury is it says it is currently being reported in forbearance. This is not acceptable. I ask they be forced to comply with FCRA and the signed agreement between us. There are no payments due, ever on this loan. Look, I never agreed to just give anyone free reign to report just whatever they want on my credit. This down payment assistance needs to be FORGIVEN and me be COMPENSATED for the damage to my credit rating. I went to XXXX website and NO refinance is allowed with reference to a forbearance. For reference here is their definition used. " A forbearance plan provides for a period of reduced or suspended contractual monthly mortgage payments, followed by a full reinstatement, mortgage loan payoff, or another workout option to enable the borrower to resolve the delinquency '' There are NO contractual monthly payments on this silent second. I am at my wits end, I bought this home right after college, I know what I signed but, am powerless to enforce FCRA rules on a giant corporation.

In XX/XX/2022, I went through a huge mess with HomeLoanServ to get my mortgage current after going through XXXX forbearance and divorce. I was told that my credit would show as on time once I filled out the home retention packet, which I emailed back on XX/XX/2022. I was told that after XXXX months of on-time payments, I would receive new paperwork and my credit would show current for the mortgage.Unfortunately, things did not work out like that, and even though I continued to make payments, I was consistently told that there was a rare error in their computer system. Eventually, I filed with the CFPB and finally got someone to help me. XXXX with HomeLoanServ was great and got everything back on track. Still, after getting my annual credit report from the XXXX credit bureaus, my credit is still showing delinquency. Each credit bureau is reporting something different with different months being delinquent, even over the summer after getting paperwork squared away finally. I looked at the report HomeLoanServ gave in response to my initial CFPB report, and it is stated that their XXXX asked me to let her know which months were showing up as delinquent in my credit reports. That never happened. I never was asked, nor did I know that they would need that information. Wouldn't they share that information naturally with the credit bureaus. Why would they need to ask when they can see from their own records that I submitted the home retention packet at the end of XXXX. Shouldn't they just report that I have been current on my mortgage since XX/XX/2022? HomeLoanServ needs to follow through and make this reporting correct with the credit bureaus. XXXX XXXX, who is also listed on the loan, needs to have it corrected for him as well.

My mortgage was sold to Homeloanserv. They have been a nightmare from the start. My wife and I originally set our mortgage to be due between the XXXX of each month. This is the time frame we have the money to make our Mortgage payment. HomeLoanServ has a policy of all payments being due on the XXXX no matter what. We weren't aware of this until it was too late. We received a letter in the mail stating they were taking it over and that was it. I have talked to them nearly every month since. They refuse to change the payment due date. They refuse to allow split payments. This is causing a serious issue for my family. We are charged {$110.00} a month extra on top of our already {$3600.00} mortgage. This is incredibly hard on us. We have paid a total of {$1400.00} in late fees since they bought our loan in XX/XX/2022. I've asked them multiple times to work with me. I tried making a split payment to avoid the fee and the very next month I received an email saying " Split payments will no longer be allowed. Due amount must be paid in full in 1 payment each month ''. They call me every month between the XXXX to tell me that my payment is late. Asking when I'll be making the payment. Every time I have talked to them, or asked if there Is anything we can do. The only thing they tell me is. " You don't have to pay your late fee now. You can pay the mortgage and pay the late fee later '' this does not help at all. We're still being charged quite a bit extra. They refuse to work with us in any way. Loan modification application XX/XX/XXXX. Phone call from mortgage counselor at loan company, XX/XX/XXXX, stating approval for $ XXXX from modification. Since XX/XX/XXXX, XXXX by month Im told a different payment amount. {$1200.00} and {$1700.00} ( my original loan prior to modification was {$1700.00} ) Finally by phone call, of this year, ( XX/XX/XXXX ) the mortgage company admitted to an error, by not including town tax for the monthly payment. All I stated, was wanting something in writing of the error and breakdown of the loan payment with the modification approval and that my new payment is. ( {$1700.00} ). Never received anything. Again, month by month Im still told different amounts of {$1200.00} and {$1700.00}. I made payments with different amounts depending on what the loan counselor said was approved on their end at that time. Still with every phone call inquiring on finalized documentation. This wasnt rectified during the modification trial until XX/XX/XXXX, stating false information, that I canceled my modification. Followed by a certified letter on XX/XX/XXXX of default and needing to pay XXXX or face foreclosure. The mortgage companies justified this by stating I didnt pay the correct amounts of $ XXXX. Again, over the past year Ive made numerous calls ( from their recorded line ) for anything in writing stating what my mortgage payment is. Nothing was ever provided. I have had multiple incidents over the last year to where I was consistently given inaccurate information concerning the status of my account which has contributed to my account falling behind. I was approved for XXXX XXXX for a lump sum payment back on XX/XX/XXXX and also approved for an additional XXXX XXXX starting XX/XX/XXXX. I was told that XXXX was covered and partially of XXXX and the rest was put into a repayment plan which brought my current mortgage of XXXX to XXXX. I called in a few days ago and was told that since XXXX XXXX sent in XXXX that I only owed XXXX. I just received an abrasive call today from XXXX XXXX as well as the XXXX XXXX who was also abrasive ) saying that the repayment plan started in XXXX and a repayment plan letter was sent out, in which it wasnt. Instead I got a threatening letter saying that I owed roughly {$5000.00} which is inaccurate. I called concerning the letter and she said that I shouldnt have gotten that letter and that I would continue to receive only the letters stating that a late fee was assessed since I was on a repayment plan. There was no mention of a repayment letter being sent out until today. XXXX also mentioned in a threatening way that this repayment plan had failed and although she could restructure the plan that if I failed again then I wouldnt be eligible for a repayment plan again. In my experience since Covid, this company is purposefully giving out inconsistent and inaccurate information to purposely make me default. I plan on filing a lawsuit and any assistance would be appreciated.

I received a mortgage from XXXX and closed on the property at XXXX XXXX XXXX, XXXX XXXX on XX/XX/2022. Approved for a second mortgage XXXX loan ( Down payment assistant loan ) with Homeloanserv. XX/XX/2022 made my first payment on the first mortgage to XXXX. Attempted to make the first payment on the 2nd mortgage to Homeloanserv, When I could not make the first payment on the second loan online I called the company. I was informed that the company was behind in the processing on the second loan and to wait a week to pay the first payment. After about a week i was able to make the first payment. Shortly after this it was shown online that I was late making the payment. I received a correspondence XXXX stating that the first mortgage was sold to Homeloanserv. XX/XX/2022 I contacted XXXX and inquiried about the first mortgage being sold to which I was told that it was not and made my XXXX mortgage payment to XXXX. On XX/XX/2022 I find out that the loan was sold to Homeloanserv and not wanting to be late on the payment made a oayment on XXXX to Homeloanserv to the first mortgage. The XXXX payment to XXXXwas forwarded to Homeloansev which they placed into escrow and will not give it back to me. Even though I have made duplicate timely payments to Homeloanserv I see late payment on the online account, which I want corrected and I want my duplicate payment returned to me which my attempts to get this has been unsuccessful, with Homeloanserv saying that that payment sent to them from XXXX was for escrow, even though XXXX has stated that it was not.

On XX/XX/2021, my mortgage payment of {$1000.00} cleared. On XX/XX/2021, a duplicate mortgage payment of the same amount cleared, which I was not expecting. On XX/XX/2021, I noticed the anomaly and immediately contacted my loan servicer, Homeloanserv, to correct the issue. The customer service agent was friendly, but they simply directed me to a support email address with instructions to submit a screenshot of my bank statement as proof and ask them for a refund. I did this right away, to which I received an automated response asking me to wait 5 days before expecting a response ( due to COVID-19 ). On XX/XX/XXXX, a new transaction appeared on the website for a refund, but it was left as In-Progress. By the end of the day, the transaction was updated to say that the transaction was completed, but I have yet to receive a refund. On XX/XX/XXXX, I contacted the company again via phone, and I was informed that they are only allowed to send refunds by a physical check in the mail. I received the tracking number from XXXX, and it looks like the check is supposed to arrive today by XXXX. Finally, on XX/XX/XXXX at about XXXX, the check arrived. I was able to deposit it and have {$500.00} in my account today while the remaining {$550.00} is on hold until the check clears. Also, it's important to note that the duplicate mortgage payment was a complete duplicate, as in I paid interest and escrow in the duplicate, not just principal as would be expected for any additional payments in a single month.

I have had my mortgage with Idaho Housing and Finance for 14 years. Six years ago I went thru XXXX XXXX and lost my job. At that time I filed Chapter XXXX Bankruptcy. A year later I stopped the bankruptcy and I paid back ALL of my creditors. With IHaF I applied for the program to save my home and since that date I have not been late ONE TIME with my mortgage. However IHaF has continued to report my loan as closed and refuses to change that status. On XXXX and XXXX they would report it as closed XXXX balance due and included in a chapter XXXX. I have disputed this dozens of times and they refuse to fix the record. They continue to take my payment, but wont report it correctly. As of today they are now reporting on XXXX that I have filed chapter XXXX bankruptcy WHICH I NEVER DID. This has damaged me extensively. The emotional damage is huge because of the sheer HUNDREDS of hours i have spent trying to get them to fix their error. I have spend hundreds of dollars on paper, postage, toner, and phone calls trying to get this fixed over and over. I believe this latest report is in retaliation for me making the company pay overdraft fees back to me when they drafted my bank account in error causing my bank to overdraft. I have a letter proving that they did this. And now to get back at me they are trying to destroy my credit even more. I just want them to stop trying to destroy me. i cant buy a vehicle because of their malicious behaviors. It has me severely XXXX and angry.

The moneys were to be released in draws, as work ws completed and verified. The moneys were to be released in XXXX party checks, to ( myself, the homeowner ), and the contractor, XXXX XXXX XXXX, of XXXX Id. In XXXX of this year, the final release if funds was done, completely without my knowledge, or any endorsement of any kind by myself, who is a lifelong singleman, with no heirs or assignees. Upon independant inspection, it has been determined that the work that has been done os both shoddy and substandard. The inspector certifies that work was done after inspection, without sanction. It seems much of the work must be re-done to comply. It was also stated by HomeLoanServ., that the cotractor was within two weeks of completion, and the funds drawn were used to that purpose. On XX/XX/2019 I contacted Home Loan Serv Idaho as i received the Escrow analysis from them and they said i was Short {$1600.00}. I have called several times. the 1st time they explained that it was my home insurance with XXXX XXXX that it was the Windstorm. Once i contacted XXXX XXXX i was told that windstorm was excluded form my policy. Then I was told it was my separate windstorm policy. When i called them they told me it was paid at closing and i received a receipt from my agent. The 3rd time i called i wanted an itemized explanation of why i had such a high shortage. The lady that was on the phone was very upset because i had answers for everything no two people have said the same thing. And they keep saying it was explained the time i called before and it has not. They told me they were going to sent me the escrow payment history from the beginning and they have not. i emailed them a formal complaint asking for many things and there response was i had already been talked to over the phone. They can not clearly tell me what the shortage is and my taxes have gone down {$500.00} dollars. They are trying to up my mortgage almost {$200.00} for 12 months and they will not tell me why. Applied for COVID 19 forbearance on mortgage. Signed the promissory note on XX/XX/2021. FHA Partial Claim is dated for XX/XX/2021. Claim request from loan servicer ( Idaho Housing And Finance ) was submitted to XXXX XXXX XXXX on XXXX XXXX. Called loan servicer, claimed they can not give payoff due to funds from HUD/FHA have not been received for COVID 19 forbearance. State they have submitted claim to XXXX on XX/XX/2021. Called XXXX back, state they dont have record, so they can not give payoff for COVID-19 forbearance. Called servicer, they state the title company has not recorded the signed documents, so they can not process a payoff. I stated we can pay out of pocket for the loan amount but they will not allow it because the paperwork has not been processed. Homeloanserv stated they would fully process my Covid Combination Partial Claim/Loan Modification within 60 days by XXXX XXXX, Homeloanserv is not fully cooperating with me and I believe they are intentionally delaying the process to force me into foreclosure. Homeloanserv is treating me unfairly and violating federal servicer laws that protect homeowners. My application is not being processed in a timely manner. I would also like an update on a correct escrow analysis. The balance on my escrow is incorrect which could affect my loan modification amount. The estimated taxes that was included in my custom partial claim/loan modification was misinformed. Homeloanserv has not provided to me an updated escrow analysis with the correct balance for my property taxes/insurance. My custom loan modification should be a lower amount than {$1800.00}. I am feeling overwhelmed with stress due to the poor communication and hurtful words i have heard when I called in to Homeloanserv to speak about the Covid FHA loan modification/Partial claim options and follow up.

Loan Servicing Company is HOMELOANSERV We mailed our mortgage payment in the form of a cashiers check form our bank on XX/XX/XXXX. On the XX/XX/XXXX we received a letter from HOMELOANSERV stating that our XXXX payment was not received and now late. I contacted the company and they requested for me to send them a copy of the check front and back to their support email. I did this on XX/XX/XXXX. I checked my online account at HOMELOANSERV 10 days later to see that the payment issue had not been resolved. On Monday, XX/XX/XXXX I called the company again and resent the email of the proof they requested. The person I spoke with told me that it was taking longer than usual but support should have the issue resolved within a few days. Today we received another letter stating that they where reporting us negatively to the credit bureaus so when my husband spoke with them over the phone, they said we needed to send another payment for XXXX until they resolved the issue. I faxed the proof they requested today along with a letter that included the issue, our loan number, our address and phone numbers. I feel like this company is trying to rip us off almost {$1300.00} and are taking advantage of us, or trying really hard to. But we have proof they took our check and cashed it before it was late and are refusing to credit our account for it.

I filed XXXX XXXX in XXXX to save my home. During that time I also applied for a Loan Modification in which I was approved as of XX/XX/XXXX. The letter said that the modification should be final within three months. I have made the three trial payments under the contract. During this process I converted my bankruptcy to a XXXX XXXX ( the house is no longer included XXXX. I have called HomeloanServ each month asking when they will finalize this modification and no one ever has any answers for me. They are always I don't know what to tell you. I reached out to the Company via this Platform and received a response that is not any where near what I was told by the representatives that I have dealt with. They claim that a letter was sent that in conjunction with what was done. I was told By their XXXX XXXX that seeing as we were trying to get our loan refinanced as not only have housing prices risen but that rates had dropped and we wanted to lock in the better rate that we had been given. What prompted this was the fact that our house price had gone up without explanation and when reaching out could not get anything from them until they called trying to collect the amount that was left off. That is one reason why we wanted to refinance as the communication is beyond poor. In the previous complaint they addressed this portion and that is it. What was failed to address was the rep said he was getting with credit to keep any late notices off so that we could get the refinance completed and that it would hold off for 60 days so that this could happen due to their noncommunication. It was not a week later that this hit according to the lender that we are trying to use that this hit after talking to him. This is a case in point as to why we want to go else where no one here sticks to what they say.

I was placed on covid forbearance since XX/XX/2021 which really helped during difficult times. When the forbearance ended, I contacted my mortgage company XXXX Idaho Housing and Finance Association ) to see what my options were. They informed me that I could do loan modification or just resume payments. If I was to resume payments that all the months that I did not make payment due to the covid forbearance will be reported as unpaid and will greatly impact my credit. I spoke with a couple of representatives that informed me of the same thing. I was very upset to find that the help I thought I was receiving during this trying time will very much hurt me financially. I assumed that this was a great program to help all Americans struggling but was dreadfully very much wrong. Feeling that I had no other choice but to do a loan modification. I thought that federal government enacted measures to help. Renters received billions in ad and did not have to pay anything, but homeowners ultimately did not receive any help. Homeowners must pay either by refinancing payments or putting at the end of loan. Moreover, having credit being negatively impacted. I spoke with other homeowners under different mortgage companies, and this was not the same case.

On XX/XX/XXXX I made my payment to my servicing company, HomeLoanServ, also known as Idaho Housing and Finance. On the XXXX of XXXX I reached out to just double check that my payment had been added to my account. It had not. I reached out to them via a phone call and email. I got a response back saying the issue would be resolved if I could provide proof I had in fact made my payment. I provided multiple screenshots as well as get the appropriate documentation from my bank. I received no response for a week. I reached back out on the XXXX and was told that this was an issue on their ( HomeLoanServ ) side and that my account would be fixed, I would not be charged a late fee and my credit would not be damaged with a mortgage late. However, they also stated they have no idea where my mortgage funds are, they also said this is happened to hundreds of people in Idaho, they also stated that this is due to the fault of an insecure payment portal tool that they use. They have yet to notify the public of the breach of security, missing funds or make anything correct with the consumers. Where is our money? Why was it not applied to our accounts? Why were we not notified? How many people are being charged late fees for their negligence?

This is a follow up to Complaint XXXX which was submitted on XX/XX/XXXX. After our Mortgage servicer voluntarily dismissed their foreclosure action they have refused to take payment on our mortgage citing the fact that they had started a foreclosure action and because of that their system won't allow payment to be made. That conversation happened around XXXX CST on either XX/XX/XXXX or XX/XX/XXXX of 2021. The representative of Idaho Housing and Finance Association said that the call had be escalated to a supervisor and I would be getting a call back within a few days. It is now a month later and there has been no communication from Idaho Housing and Finance Association. On top of that when we checked my wife 's credit score my wife 's credit score had been negatively impacted by Idaho Housing and Finance Association and had not been fixed. It should be noted that the companies lawyers broke the rules of Iowa Civil Procedure at least once during litigation by submitting a document saying that they had held a Trial Setting and Discovery Conference with us. This should have amounted to lying to the court as this would have been a step that is required for any case that is heading to trial

Step 1 : What is this complaint about? My mortgage company refuses to accurately report my mortgage on two of my three credit reports. Step 2 : What type of problem are you having? My loan got sold to homeloanserv. I work in XXXX so I know it can take a while when that happens for them to report the mortgage to the credit bureau. However I have been making payments since XXXX ( XXXX ) and it is now almost XX/XX/XXXX. My mortgage has not reported to my credit. I have called and emailed and homeloanserv intially did not respond to me. I finally started working with one of their employees who said it would report by XXXX ( XXXX ) at the latest. Keep in mind that is 6 monthly mortgage payments later. XXXX has passed and it is still not reporting. Emailed the representitive again and she said it could take the credit buears two to three months to report. So basically they are telling me my mortgage may not report to my credit until XXXX. That is 10 months worht of payments and no reporting. In my five years of XXXX I have never seen any other company take that long to report. They will not address or fix the issue even though I have contacted them multiple times to do so. It's frustrating where i'm actually making my payments and trying to further build my credit score but I am unable to do so due to the companies lack of reporting standards.

My mortgage in serviced by HomeLoanServ Inc. I am having problems with my escrow account. My mortgage payments go up every year, but the customer service reps tell me something different every time I call. There is not case notes in the account that I have called several times to get the issue resolved. I am explaining the problem I am having over and over again, because there are not notes to go back to. My total mortgage amount stated out at {$680.00} now, it is now {$750.00} in three years. Last year, they said my escrow had a short fall of {$300.00}, I paid it and they guaranteed it went towards the escrow. They said I needed to pay an extra {$25.00} to cover the shortfall that I had already paid in full, ( I thought ). I paid the {$25.00} extra for 12 months. This year I have another shortfall and will pay another {$20.00} per month. I have never missed a payment or had a late payment. The accounting is off somewhere and I need to know what is happening to my account. I am struggling to pay my mortgage. I have enlisted the help of a realtor to sell my property via short sale. They have sent the offer and all required financial documentation to HomeLoanServ multiple times, to multiple fax numbers and email addresses, since XX/XX/XXXX. Still, HomeLoanServ has yet to acknowledge receipt of the documents and begin the short sale review. Each time they are called, they give a different fax number or email address. On XXXX the complete package was emailed to XXXX and XXXX. I have spoken to this company several times on both XX/XX/ and XXXX to try and resolve incorrect information on their part reflected on credit reporting. On XXXX I was transferred several times to several different people that fumbled over answers and put me on hold only to be told to log in to the portal online and read the information stated there. When I told the representative that I was reading what was online and that it did. not reflect a repayment plan previously made, I was informed again that I just needed to read what was online ( which was unhelpful, to say the least. ) On XX/XX/ I called this company yet again to revive PDF documents of these agreements so that I could handle the issue myself. I spoke to several different people over the day who said that they sent the documents. After giving two different emails and speaking to/being transferred to several different people over the course of a morning I FINALLY received one document. The mortgage company blocked me from being allowed to make loan payments via check online. I tried to call to explain that what happened is I switched banks. Before what I did was input my banking information the previous day and the money would come out the next business day because it was guaranteed funds in the account the next day. I didn't have an issue until I switched to XXXX. It took me two times to figure out that i would have to make the payment the day the funds were in the account because it pulls with them overnight. On the second time is when i was blocked from making check payments online however i explained what happened and that if they looked in their records they would see that i made the same payment amount when this was noticed so i shouldn't have been blocked. They want to argue that this isn't the first time this happened but it was a habitual or done maliciously. Closed on this loan XX/XX/2023. {$6000.00} escrow hold back from cash out proceeds to be used for replacing flooring { LVP and new carpet } to be finished within 90 days of closing. {$1900.00} paid to flooring company, from hold back funds for materials, balance to be paid upon completion of work. Work completed XX/XX/2023. IHFA refused to pay balance to flooring company on XX/XX/XXXX. Any funds remaining were to be released to me by check. I contacted IHFA and was told I needed to pay {$150.00} out of hold back to them for appraiser to verify work is complete. I asked them to show me documentation from closing regarding this since I was unable to find it in my copies of the closing. I had spoken with this company due to an issue that they still have an issue with communication. XXXX of their managers was having the stop to report to credit done this man 's name was XXXX he stated that he had them stop from reporting and that he would have this done for XXXX days. Literally days later as we are trying to refinance this away from this place late hits keeping us from being able to get this lower rate locked in. I reached out to the company and no response and have used the CFPB XXXX other times with this same complaint. I requested the mortgage forebearance protection afforded me under the CARES act from my servicer : homeloanserv XXXX XXXX XXXX XXXX XXXX ID XXXX. I was told by both XXXX and XXXX that under FHA guidelines I am only entitled to 90 days of forebearance and that I will have to call them every 30 days to maintain the program. They have both also told me I am not eligible for modification and will have to make a lump payment after the 90 days. Both of them insisted this was government guidance but offered no official documentation. XXXX claimed the cares act has been changed and we are now only entitled to 90 days. Their supervisor, XXXX, has yet to return my calls. The stated employees also asked me if I was sick. I'm not sure why I would have to disclose my protected information just for some relief. Two part issue, back when covid happened I missed one payment. I and XXXX tried to resolve the problem through their company they would not speak to anyone. I tried again to get it resolved and they lied and told Texas Payment assistance I was not delinquent, so I decided to sell my home. I received my yearly mortgage payment booklet on the mail on XXXX XXXX from home loan XXXX. The payment book showed that my home mortgage payment went from XXXX a month to XXXX a month. I am a single parent of XXXX young children and fell behind due to XXXX. I received an RMA ( request for mortgage assistance form ) and sent it in more than 30 days out from my foreclosure sale date, but the lender kept saying they did not receive my forms. A tornado hit my house, and caused damage. I dealt with the claim through the insurance, and after a number of weeks, had resolved the amount and was going to hire my contractor to repair the work. The mortgage company caught wind, and refused to allow payment from the insurance until I satisfied their documentation demands, which I did. I called to ask why they needed all of the information they were requesting, and they rudely told me it was their money and I had to do whatever they said. I sent the insurance check to them via USPS tracking to be endorsed. They apparently sent the fully endorsed check through standard mail with absolutely no interest in verification or tracking and told me via email that if I wanted security I should have paid for it myself ahead of time, and that it was not their problem if the check was lost or stolen, that I could just deal with the insurance company if that happened.

Any time that I need to contact Home Loan Serv regarding my mortgage loan, I am never able to contact anyone. I am placed on hold for a timeframe around 5-8 minutes when I am forced to disconnect or leave a voicemail. I have never, not once, received a call back when a message is left. I made a mortgage payment of {$1400.00} on XX/XX/2022 and another payment of {$1400.00} on XX/XX/2022 and received my regular confirmation and receipt via email from Home Loan Serv company. Home loan Serv is still alleging that i did not make my payments even after i have sent them multiple letters and proof ( via certified mail # XXXX, # XXXX and # XXXX ) - stating otherwise and now they are charging me extra fees and have blocked my account so i can not continue to make my payments, causing me stress and they continue to report negative things to credit reporting agencies. I have told them to stop reporting all my information to all third parties but they continue to do so and refuse to rectify this billing error.

I called HomeLoan to check on my mortgage. It says I owe for XXXX however I thought I made XXXX payment. I asked if they could send me something showing how these payments were done. Instead the rep says I could download it. Its still unclear. Instead you get snide remarks instead of assistance. I was told that if the payments werent made theyll start the foreclosure process. All I asked was if they can look into the payments because I do see reversals and I know weve made a few payments in XXXX. One was reversed due to a bank error which we made them aware of. I want to be sure the payments were applied correctly so that I can make the proper steps. Thats my whole purpose of calling.

I have struggled and not made payments do to loss of work and cut hours, I am a XXXX and we were even closed for months and I fell very behind. After being behind I felt like l was forced to enter a new contract with stricter penalties that makes me pay way more for my mortgage. We are experiencing issues with our escrow on our mortgage with HomeLoanServ, the company is claiming on XX/XX/23 that we have a shortage of {$2100.00} with our escrow which would cause our mortgage to go up to {$2800.00}. We ended up paying the shortage amount on XX/XX/23 thinking that would keep our mortgage payments at {$2400.00} but they said they still had to raise our monthly mortgage to {$2600.00} because we haven't been paying enough towards escrow. If we had know that paying extra wasn't going to make a difference we would have not paid the shortage because now we have given them {$4700.00} in one month.

I registered with my lender Homeloanserv with the special forbearance program in XX/XX/2021. In XX/XX/2021 the company reported my loan delinquent which I then contacted them and they reported to me by email that they would correct with the credit reporting agencies. I am required by them to do a monthly check-in which I do. They sent me another letter dated XX/XX/2021 stating they have been trying to contact me even though I called and spoke to one of their representatives on XX/XX/XXXX reported I still needed to continue my forbearance but they again reported my loan delinquent on XX/XX/XXXX.

Idaho Housing ( mortgage lender ) continues to show payment history for 1st and 2nd mortgages made after Chapter XXXX bankruptcy on XXXX credit report. Additionally, lender has failed to report that the 1st and 2nd mortgage were included in the bankruptcy on my XXXX credit report. Also, the 1st mortgage shows up as being closed and the 2nd mortgage as being open. Due to the bankruptcy laws, the mortgage company is not permitted to report anything on the account, including payments, balance or missed payments AFTER the bankruptcy has been discharged ( XX/XX/2016 ).

I have two different forms of proof showing my payment was received on XX/XX/2019. I received online confirmation and an emailed confirmation. I am currently on a Cares Act Forbearance with my mortgage company, Idaho Housing and Financial Association dba HomeLoanServ. This company is reporting my mortgage late each and every month to all three credit bureaus. Under the Cares Act, it states they are supposed to report as paid on time or in forbearance.
