Thank you for taking the time to investigate this case. I seek your assistance in stopping the illegal practice of " phantom '' payday loan collections by XXXX XXXX and Hylan Asset Management. In regards to my case, I have secured a release from Hylan Asset Management and do not require individual assistance. However, I strongly encourage a full investigation of these companies due to their violations of the Federal Trade Commission Act, wire and mail fraud statutes, and the Fair Debt Collections Practices Act.
I am certain that XXXX and Hylan are knowingly running a " phantom '' payday loan scam by attempting to collect payday loans that did not originate and are not valid. I am certain that I am a victim of this scam. If you desire, I can provide a full financial disclosure demonstrating beyond a preponderance of the evidence that I did not received these funds, nor solicit such loan. Throughout this ordeal Hylan and XXXX have been unable to provide any proof of a promissory note, loan origination, or collection attempts. Further, according to XXXX the original creditor was " XXXX XXXX. XXXX '', however written communication also shows a disputed payday loan from " XXXX XXXX, XXXX '' or " XXXX ''. XXXX and Hylan have been unable to accurately describe the disputed debt in their communication. This is further evidence of a " phantom '' payday loan scam.
Enclosed is all written communication between the parties. Research indicates that XXXX and Hylan have a very high percentage of clients claiming that these loans are " phantom ''. As both of these companies are within your jurisdiction, I can not emphasize enough the importance of stopping this unfair, deceptive, and abusive conduct. Their conduct is illegal and prays on vulnerable populations.
