First Merit Bank and its employee XXXX XXXX XXXX committed fraud by lying to me on more than one occasion. On XXXX XXXX, 2015, in response to the Bank 's advertisement for free checking, I inquired in person at its XXXX XXXX, Ohio branch. The ad stated " no minimum balance '' and " no monthly maintenance fee ''. I asked about transfer of money and was told by XXXX that I could transfer the money anywhere without a fee. I and my husband, XXXX XXXX, spent considerable time asking questions, including " whether there were any hidden fees ''. XXXX repeatedly stated that the account was totally free. He also told me that I would be given a {$150.00} bonus if I set up direct deposit. Based on his extensive information and answers, I opened a checking account. The person who handled the opening, under the direction of XXXX, is identified on the receipt as " XXXX ''. I was given a receipt for the deposit, but NO schedule of fees, which I did not expect because XXXX told me that there were no fees. I then went through the timely effort of switching my direct deposit instructions with my employer. Shortly afterwards, when I tried to transfer money from this account, I learned that there would be a fee. I complained in person to XXXX. He then told me that only transfers to another account at First Merit Bank are free ( which he knew I did not have ) and that transfers to other institutions required payment of fees. I, with my husband present during this discussion, requested that my account be closed because he, XXXX, had given me wrong information at the time I opened the account. To cover his earlier lies, he said that there would be a fee if I closed the account within 90 days. I was never informed of this when I opened the account, being told that there were no fees whatsoever. He refused to give me the full balance in my account. So, based on his advice to " wait at least three months to get ALL of your money back '', I did not withdraw any money. XXXX, never told me that by waiting I would be charged an inactivity fee. Again, XXXX committed fraud by misleading me. Shortly afterwards because I could not transfer my money out to another institution without being charged a fee on the " free '' checking promised by XXXX, I went through additional effort to change my direct deposit of salary from First Merit Bank back to my previous bank. I was never credited {$150.00} for setting up direct deposit with First Merit Bank. Today, I went to the same branch to withdraw the balance of my money and close the not useful account. XXXX failed to give me the full amount I had deposited, but kept {$28.00} of my money. When I asked him why he had not given me the full amount of my deposit, he stated that there was an inactive account fee. I was never informed of this, either at the time of opening the account or when I complained about his lying about free transfers. When my husband complained to him about the lousy service and asked to have the branch manager informed, XXXX with a mean look on his face and a shouted voice, threatened to " escort ( him ) outside '', saying that he, XXXX, did not want any other customer to hear a complaint. First Merit Bank employee XXXX repeatedly misled me and lied to me. He did not once indicate that there were any fees, but repeatedly stated that there were none. XXXX should be fired for purposely deceiving a consumer and First Merit Bank should both be fined for its fraud upon the public and institute a mandatory retraining of all its employees regarding not lying to, but informing, potential and actual customers of fees. Furthermore, First Merit Bank should refund to me {$28.00} plus interest and pay me {$150.00} for setting up direct deposit based upon its fraud.

On XXXX XXXX I transferred {$1200.00} from my First Merit savings account to my First Merit checking account to cover a purchase I would make later that day. I made the transfer at a First Merit ATM during regular business hours. The purchase was made and approved less than XXXX minutes later ( the bank is a block from the retailer ). On XXXX XXXX my online statement reflected these transactions but with the statement incorrectly reflecting that the purchase had occurred prior to the transfer of funds necessary to cover the purchase. Although my online balance reflected a negative balance associated with the purchase, no overdraft charge was reflected, my overall balance was in the black, and the actual transfer was additionally reflected in a separate statement section marked " pending '' ... '' Hold ''. On XXXX XXXX my online balance reflected XXXX separate {$35.00} overdraft charges ( {$170.00} ) as a direct result of the bank 's failure to recognize that the transfer of funds preceded the purchase that, according to my statement, caused the overdraft. Per bank policy, I was required to personally visit my home branch to seek management correction of the bank 's error. I did just that on XXXX XXXX. There I was informed that, despite the fact that my records reflect that at no time was my checking account lacking sufficient funds to cover the purchase, by transacting my money transfer at the bank 's ATM ( as opposed to in-person or online ), I had inadvertently - based upon their policy and practice - in fact made the transfer ( for their accounting purposes ) on XXXX XXXX ... not XXXX XXXX as their time-stamped receipt reflects. I was further informed that, despite the transfer occurring during normal business hours, they had already " balanced out '' that particular ATM for the XXXX XXXX business day. In fact, my time-stamped XXXX XXXX XXXX receipt of the transfer does ( further down ) identify the business day as XXXX XXXX ( a fiction both in reality and practice as the bank 's branch hours on XXXX XXXX continued until XXXX ). Finally I was informed by the branch manager that a call would be made on my behalf seeking a resolution. An hour later, the branch manager left me a voicemail cheerfully informing me that the bank had decided to " waive '' XXXX of the XXXX overdraft charges levied against my checking account. I attempt to return the call but was only able to leave a message stating that their " resolution '' offer of ONLY stealing {$70.00} from me instead of {$170.00} was unacceptable. The bank has, in their XXXX XXXX online statement, reflected the refund of {$100.00}. Other than taking the necessary steps to find and establish another banking institution for my banking needs, I am requesting that the CFPB investigate First Merit 's unethical and arbitrary abuse of depositors ' funds specifically regarding the transfer and/or " business day '' posting of funds between one FM account to another FM account. In my particular case, I am requesting that First Merit be required to refund all XXXX overdraft charges ( not just XXXX ) levied on my checking account. More importantly, I am hopeful that First Merit be required to 'cease and desist ' from continuing their apparent practice of 'posting ' credits and deposits/transfers in such a manner as to artificially create non-existent overdrafts.

My complaint is with First Merit Bank ( XXXX, OH ) on a vehicle loan ( XXXX ) in which I paid in full, hold the title to ( enclosed ) and according to the bank personnel I spoke to on XXXX/XXXX/XXXX in good standing ( XXXX and XXXX - supervisor ). The issue is that all XXXX of my credit reports ( XXXX, XXXX and XXXX ) show different 30, 60 and 90 and 120 days deliquent status thou I was not late with payments as each was called in person on due date of payment. XXXX shows 60 day late and XXXX shows 120 day late of which I was told by both individuals up top in XXXX/XXXX/XXXX that there records show 5 - 30 day late payments only and no 60/90 or 120 days late and if that was the fact on my report according to them on the phone, they would of repossessed my car. I believe another issue at the center here is that I was offered a " loan extension '' on the back-end of the loan as a " special offer '' to customers like myself in good standing. This was encouraged/offered to me on the phone by a First Merrit Rep back in XXXX well before loan maturity of which I took advantage of but that I would have to pay some additional interest at the end of the loan by doing this. I paid that interest and its documented. I did receive a letter of the offer but no specific details of the offer in writing or informed by anyone at First Merit Bank on a monthly basis when I called to make my payment that this would put me in a " delinquent status '' or " affect my credit report. '' nor did I receive any written notification outside my statement in good standing that my " loan was in jeapardy '' outside of the additional interest that was due from the extension of the loan. Each month I called in on the due date and make a payment and the First Merit Bank reps were pleasant and informative on any questions I asked. Last week I called First Merit ( XXXX/XXXX/XXXX ) to address the credit reporting errors after " repeated attempts '' this past year to resolve with " notorized letters '' and " attempts to remove '' the errors. I spoke with all three credit reporting agencies who said they would submit inquiries to the bank -- most of which was not done and the tone was very clear that the Bank is always right. I received today ( XXXX/XXXX/XXXX ) upon my request a " history of payments '' from First Merit and asked for both due dates and payment dates to verify the so called 5 separate months of 30-day late payment. The multiple sheet shows nothing of the such to support their claims of 30/60/90 or 120 day late. I 'm requesting all 30-day lates be taken off my credit reports as well as 60/90/120 day which are not acurate and was even told so by First Merit Bank Reps/Supervisors - XXXX and XXXX on XXXX/XXXX/XXXX. Additionally, the " loan extension '' offer was both misleading and not explained in a way that clearly benefited the consumer vs the lender. Additionally, the contact information on all XXXX credit reports for First Merit Bank goes to a non working number. I asked the Credit Bureus for a working number and they indicated they did not have the responsibility to provide or supply beyond what First Merit provides to them - very non helpful. The real numbers are Consumer Loan Services number is XXXX or XXXX. Another number is XXXX for Financial Services.

I suffered a severe hardship, I have been XXXX since XX/XX/XXXX. I finally had a hearing for my social security XXXX benefits on XX/XX/XXXX, which the judge approved my case. I contacted my mortgage company the same week and spoke to XXXX and informed him that I had been approved however, I would not receive my approval letter for up to XXXX days per Social Security Administration. XXXX informed me that as long as I keep the lines of communication open I should be ok. I have told the mortgage company almost every month that I have been waiting on Social Security. I fell behind and did not pay XXXX or XXXX payment. I received a letter from First Merit Bank dated XX/XX/XXXX stating that I was in breach of contract and that I need to pay XXXX, XXXX, XXXX and XXXX in order to not face foreclosure. I paid {$800.00} last week and {$1800.00} today XX/XX/XXXX. That is the total due minus XXXX payment. I have been informed of my contract that I signed by many collections agents but when I informed them that I am not yet obligated to pay XXXX payment they keep threatening me because I have not yet paid for XXXX. At this time I feel they are doing something illegal due to the fact that my contract states that my payment is due on the XXXX of each month and not a day before, however, they are trying to squeeze another payment in advance from me and have stated that they will not apply any of the money I have paid to my mortgage, setting me up to be foreclosed on. I have shown good faith by making the past due payment and I just want the threats and harassment to stop. I have health issues and certainly not trying to avoid making a payment. I do have children and XXXX at First Merit uses many threats as I have spoken to her a couple of times. I have asked to speak to XXXX and the team lead refused. I asked XXXX at the bank to give me the total due today minus the XXXX payment and he refused and I called back to speak to XXXX who gave me the amount and yet again he advised me that I am still in breach despite me paying XXXX, XXXX, XXXX mortgage payments and all fees except the XXXX payment. I have applied for modification on XXXX occasions this year and was denied both times due to the amount of income. I have been proactive in contacting the mortgage company however have been received with snide comments and sarcasm. I understand they are in collections but I am reaching out to them and they are rude and callous. The team lead, was the very worst and he was the most rude. First Merit Bank have very limited number of branches in XXXX XXXX, they do not have an online payment system, they are only open Monday-Friday until XXXX thus making it very difficult to make convenient payments or have any questions answered. I have tried to reason with the bank to no avail. I am more than willing to make all payments that I am obligated to make, but I am looking for some reprieve because I am doing the very best that I can and will continue to make the payments and get completely caught up once I start receiving regular payments from the Social Security Administration.

My wife had an accident with a deer on XXXX XXXX with our 2012 XXXX XXXX and it was totalled. XXXX XXXX told me they paid FirstMerit {$10000.00} on XXXX XXXX. ( Loan Number XXXX XXXX ). We also had XXXX XXXX through XXXX XXXX on the car and the rest of what was owed to FirstMerit was roughly {$2600.00}. Finally this morning XXXX XXXX, after many calls and conversations with XXXX XXXX they finally had all the information they needed to pay the rest of the car off ( Their reference numbers for our case was XXXX and XXXX. FirstMerit called yesterday XXXX XXXX and wanted a car payment of {$290.00}. I believe I talked to a XXXX. I said we would not make that payment because the XXXX XXXX from XXXX XXXX was covering the rest of the car loan. She knew that was the case but still wanted our payment else would be delinquent on our payment. I contacted XXXX XXXX this morning and all the items they needed to pay off the rest of the loan were in order and the money would be allocated within 5 to 7 Business days. I figured I would call FirstMerit back and I got hold of a Man by the name of XXXX XXXX. I told him about XXXX XXXX making the rest of the loan payment within 5 to 7 business days and he said he would make a note of that. Then he proceeded to tell me we would be reported for 30 days over due because in 5 Days our payment would be overdue and we should make that payment of {$290.00} to stay current. I then proceeded to tell him everything I had told him before about XXXX XXXX making the payment within 5 to 7 business days and he came back with the same statement about we would be reported for a late payment if we did not make the {$270.00} late payment. I again told him the money would be there from XXXX XXXX and he said we would be considered 30 days late in 5 days. I asked him his name and he told me and I told him he should consider the circumstances and not consider us late. He then repeated the same 30 day information he had told me 2 times before. I told him to mark this down on his computer that we should not be late because the money was coming from XXXX XXXX. He said he could n't do that and started his 30 day speech again I was getting rather disgruntled with him so I said I was going to report him to a XXXX. I then hung up and got this information to make a complaint. Desired resolution is that we should not be turned into anyplace for a late payment. If it has been put in some record it should come off from our record immediately because of the timing of this whole issue. By this time FirstMerit would have received all their money and the late fees of {$20.00} should not apply also. I believe that XXXX was quite unprofessional and did not care to hear anything I was telling him.

FirstMerit recommended that I turn on overdraft allowances to my account so that I can overdraw and they will let me but charge a fee. I did opt in for this. In their Online Banking, it talks about what a great program this is for you and why you should use it. They are just scamming people into entering a program to steal our money basically. I made a few transactions with my debit card and there were plenty of funds in my account to cover them. I then waited a few days and then withdrew {$140.00} at an ATM, knowing that I was going to use the program and overdraw my account and be charged a {$35.00} fee. In my Online Banking then, everything posted just fine. Every transaction that had been done days before the ATM withdrawal were listed and a positive balance listed after. Finally, another day later the ATM transaction showed posted to a negative balance. The following day I was charged XXXX {$35.00} overdraft fees totaling {$240.00} in a negative balance on my account. This is absolute robbery and they refuse to refund my funds for no real reason at all other than having had XXXX fees waived in the beginning of the year already. Those fees were done in branch error and were refunded because it was their fault. So no courtesy waiver was ever given to me, which this is n't even a courtesy waiver! They can not charge XXXX overdraft fees for XXXX overdrawn transaction that was done days after any other transaction and after their cut-off processing times anyway. It 's ridiculous to think that banking regulations would allow such a robbery from the public. But even so, the ATM withdrawal was days after anything else so it should have caused the only {$35.00} overdraft fee. I 'm more than happy to pay this fee, as I did withdrawal these funds in excess of my account balance. But I did this because the bank told me what a great opportunity this program was to be able to do that now and then. I never would have signed up if I knew they were using such deceptive processes, as to turn a {$130.00} overdraft done by XXXX transaction days after anything else into a negative balance of {$380.00}. I followed their recommendation and now it 's going to take my entire paycheck nearly and I do n't know what I 'll do when it should 've been XXXX simple fee since it was done so long after anything else and only XXXX transaction overdrew.

This is an addendum to my initial complaint against FirstMerit Bank, ( they are in the process of becoming XXXX Bank ) XXXX. : XXXX : I just want to inform you that a month ago, I was informed that FirstMerit Bank in XXXX XXXX, IL actually had a security breach in the last quarter of 2015 XXXX XXXX through XXXX, 2015 XXXX and did not inform its customers until a month ago. I recently was informed when I tried to use my debit card and it was denied. I called the bank and was told that was due to a Security Breach back in XXXX and XXXX. This was the same timeframe in which my checking was being debited for numerous overdraft fees, which were erroneous. I knew that there had to be something erroneous happening. more than " our system is down '' right now, which is what they said when funds began disappearing from my checking account. They said that the system would be back up but they did n't know exactly. That " this happens ''. FirstMerit Bank replaced my old debit card with a new XXXX. This new debit card does not recognize " credit card '' purchases ; i.e., as a debit card holder, I can choose to have purchases processed as a " credit card ; '' and not as a debit card which would require my using a " pin '' number. Anyway, now when I use my " new '' card as a debit, it declines it and I have to call the bank ; I never get an text or email from FirstMerit as their Customer Service reps. say I should. They tell me that I will need to call them every time my debit card purchases are turned down to get the bank to approve the purchase, nor to me. My main point is that it appears that FirstMerit Bank did not disclose to you, on my initial complaint, that there was as Security Breach going on at the same time when their systems " went down. '' I just recently got informed of the Security Breach in XXXX and XXXX, 2015, about a month ago. Please reconsider my case. Thank you. I have already filed a comlaint about this but have a new issure with this company. I had a mortgage with First Merit bank. They had a law form send me the only notice i ever recieved dated XX/XX/2015 that i recieved on XX/XX/2015. This notice wa as i stated the only notice i ever got from then. It stated that they were plannnig to hold a forclosure sution on XX/XX/2015 for my house. Even this law firm admits they have no prof thatbo recieved prior notice of this. Well i sold this house for cash before they did anything. This loan was paid in full an closed on XX/XX/2015. The title company as well as the broker that did the closing said they never heard of a bank being able to charge for a fee called uncollected attorney costs when this was sold sn paid before it was forclosed. There is also nothing listed as to where an how much was applyied to this account that was being held untill it was paid. Then the final complaint i have is that on tuesday XX/XX/2015 sbout 15 minutes after i was relashed from a hospital where i under went a XXXX that i was unable to complete. I recieved a phone call from collections at First merrt bank. The guy asked me if i can pay the past due smount an if i plan to keep this home. Thats when i let him have it for reuining my day further after not being able to complate my XXXX. They do not have employees that can do there job an dont know to check things before they call an harrash people. I do feel they over charged me for this uncollected attorney costs that should be there exprense then to have to deal with somebody that does not have intellagence to know that this was paid 8 days before they harrash me. I now deel that First merit bank owes me a public appalogy as well as a refund for these fees assl as interest. They do not care about service they only want money. I have been in contact with a consumer protection attorney an looking into suing them for harrashment as well as XXXX medical bils from the strss they have now caused. Thank very much

This complaint is in regards to First Merit Bank, which is currently merging with XXXX. I 've had an ongoing issue with the bank, which continues to charge excessive overdraft fees and rearranges the withdrawals on my account to incur larger penalties. I 've asked to opt out of the overdraft program, but I was told I could not opt out of the overdraft program when direct debates are made on the account. An example of the questionable tactics First Merit uses can be seen in the latest dispute I had with the bank concerning transactions that took place on XXXX/XXXX/2016. At the time I had {$35.00} in my account, and XXXX transactions occurred that day. The transactions were as follows, {$2.00}, {$4.00}, {$9.00}, and {$50.00}. Regardless of the transaction times, First Merit applied the highest charge first, which immediately overdrafted the account creating a {$35.00} fee. Then they subsequently charged me an additional {$35.00} overdraft fee for each additional transaction that occurred, for a total of {$140.00} in fees on {$67.00} in total transactions. While I admit the error that occurred in scheduling the {$50.00} deduction from my account that lead to the overdraft, the fact that First Merit stacks their transactions in a way that advantageously creates the scenario where they are more likely to incur higher fees from customers is troubling. In the last year, due to a serious of unfortunate events that have left me on a tight operating budget, my situation has been further escalated by First Merit who has taken hundreds of dollars out of my account through these practices. While at first they admitted the unfairness of their system and refunded {$70.00} in charges, any subsequent inquires on my behalf have been met with the notion that, 'because I know their system is unfair, any request for recompense on my part is negligible. ' Please look into these unfair practice, as no doubt they are fleecing more of their customers than just me.

On XX/XX/2016 at approximately XXXX est I received a phone call from First Merit collections dept on a private number on my cell phone. I was unable to catch the woman 's name, but she proceeded to tell me that I have only been making partial payments for the past several months for our auto loan. When I informed her that information was untrue and offered to give her receipt numbers for the payments, then asked her where these extra charges are coming from she told me to hold for a moment while she listened to recorded conversations that I had had with XXXX other First Merit representatives who told me that if I paid {$340.00} by XX/XX/2016 that I would be current on the account that took place on XX/XX/2016 and also on either XX/XX/2016 or XX/XX/2016. After she allegedly listened to the recordings, she told me that the information that both representatives told me was wrong and that I owe them more money. When I asked what I owe them more money for she was not able to answer me aside from to tell me again that I was making partial payments. I explained again that I was only operating on the information that XXXX first merit representatives had given me, and that I plan to speak with the first merit office to correct the information. She told me they would not help me and only send me back to her and that one of the representatives had tried to call me back at the time when we initially spoke but I had no missed calls at that time and no messages left by anyone so I do n't believe that she was telling the truth. Then the collections representative would n't let me get off of the phone to go back to work until I had told her several times that I needed to go back to work and would have to deal with this at a later time. The caller also threatened to ding the account holder 's credit every day until I pay the amount they claim that I owe them. I have receipts to prove my payment dates and times for every payment since we got the loan.

XXXX and myself owned a business we had a BANKER ( XXXX XXXX from XXXX ) come to us and see if he could do some finances for our business with us, we told him we would like to take out a small business loan and use it to pay off our home mortgage and our business mortgages using our XXXX commercial properties he agreed that would be something his bank could handle. It ended up by us loosing our business ALL of our properties to include our home and with paper work that has been used wrongly. It is very hard to explain however what the paper I have does not match what is in Register of needs. We hired Attorney on our home and they did NOT present any evidence on our behalf and I Had given them more then any one could believe, there excuse was it would only confuse the Judge! Well it also confuses anyone who looks at it. So now I am turning to anyone who can help us clean up this mess and get our money back that was wrongfully taken from us. This involves XXXX that is why it is so confusing and the BANKS would not do anything to help I might add the original Bank was bought out XXXX since this all started and I got the run around from all of them. All of the Evidence the banks Attorneys brought forward is in question because we did not knowingly sign any mortgage on our home and we never sign in front of a notary even if they say we did and I can also prove that is a lie. So as you can see this is a confusing mess, but some one has to care enough to get to the bottom of all of this we are now out of money do to all the attorney fees so far and we still have no answers because it never went to court with our evince the Judge did a summary judgment which was never asked for. So if there is any thing you can do for us to find out where the XXXX loan money went if it did not pay off our home. Please help us! We wrote Senator XXXX and he his the one who told us to get ahold of you for help.

On XXXX XXXX, 2016, I received a call from the Fraud Department for XXXX Bank XXXX notifying me of a fraudulent attempt to open a bank account in my name with my stolen personal information. After speaking with them, I immediately called XXXX Credit Reporting and froze my credit report accounts. On XXXX XXXX, 2016, I received written notification from XXXX, an on-line bill pay service provider in XXXX, OH, for XXXX Bank, that an on-line bill pay service account in my name had been frozen due to the fact that XXXX could not withdraw funds from " my '' XXXX Bank account in order to make payment to another financial institution. They said my on-line account had been frozen and gave me transaction details involving Firstmerit Bank in XXXX, OH. I have never done business with XXXX Bank, XXXX or Firstmerit Bank. I called XXXX and notified them of the fraudulent activity and they, in turn, told me to call Firstmerit Bank, which I did on XXXX XXXX, 2016. When I attempted to call Firstmerit Bank, they proved to be extremely uncooperative and explained that since my name was not associated with the account number provided, they could not discuss anything with me. I told the Customer Service Representative that I did not want account information but only to notify their Fraud Department of fraudulent activity associated with this account. I asked to speak to someone in their Fraud Department and the Customer Service Representative said they did not have a fraud department, which is incorrect. I asked to speak to a supervisor and when I asked that, she forwarded me to their fraud department, where I was only able to leave a voice message. They have not returned my call. I have filed a criminal report with the XXXX XXXX XXXX Department and the situation is currently being investigated. I wish to file a complaint against Firstmerit Bank for refusing to help resolve this situation.

My son, was staying with me temporarily after his XXXX. He was also in a XXXX doing very well, ( I thought ). A couple of times I let him use my debit card, I was ill, but I always changed the pin # afterwards. I have had XXXX accounts at first merit bank for over 20 years. 10 years ago I started selling items for individuals and occasionally have small estate sales. My accounts have always been individual rather than business accounts. In XXXX the bank manager said the bank flagged my account for having too many checks deposited. She informed me they wanted me to change to a business account or to supply 2 years of tax returns to prove I was claiming income from the liquidation of personal property. I complied and gave XXXX ( the other manager ) 2 years of my tax returns which were supplied by my accountant. I had assumed since I had shown that, in fact, I had claimed all income the issue with the accounts was resolved. A few weeks later I received XXXX certified letters stating that all of my accounts were being closed. Quite stunned, I called first merit and spoke with XXXX ( downtown ) and she said they were closing my accounts. I asked why. She said they did not need to explain why because they could terminate a relationship with any of their clients at any time. I had explained that I supplied what they had requested from me, and still wanted to retain my accounts. She said she would submit a request to keep the accounts open & would check to see where my 2 years of tax records showed up. I called her back 3 days later and she said since I did not give them the tax records ( which in fact I did ) as XXXX another teller at the branch confirmed that I did, they were still closing the accounts. I was never given an honest or appropriate reason that the accounts were being closed. I had done what they asked me to do. I believe this is CLEARLY a case of DISCRIMINATION and would like to allow the First Merit bank to explain their actions before I escalate further action against their institution.

She told me that if I set up a savings account that it would cover my checking in case my account was overdrawn. We refinanced our XXXX mortgage in XXXX. The remainder of our 20 % loan went to XXXX bank, then was sold to First Merit sometime in XXXX. We recieved monthly statements showing our payment amount, including an amount going to principal and interest. We continued on time payments until XXXX XXXX, at which time we sold our house. At that time, there was an issue at closing, when First Merit said we had an outstanding interest balance due of over {$7700.00}. Some time between XXXX and today, they stare applying only a small portion of our monthly payment to interest and the rest to principal, and then we 're tallying up the remaining interest as something we owed behind the scenes. This was never disclosed to us on any bills, and since we knew that some amount was going to interest every month and that we were paying the mortgage down faster than expected, we did n't question whether the amount the bill showed as our interest due was accurate. The result was that instead of getting back {$2500.00} that we expected at closing, they said we owed {$4500.00}. We moved out of state and we 're prepared to take some degree of a loss on our house in order to sell quickly ; however, we would have made some very different decisions had we any indication they were not honest in allocating the money we sent. We would like to know if we have any recourse. We do not feel we should be accountable to pay this amount. It was supposed to be a 30 year loan, and for at least the first year, the money was being applied to interest. What would have happened if we 'd reached the end of the loan term? On XXXX XXXX, 2014, I was unable to leave the property of First Merit Bank, XXXX XXXX, XXXX XXXX, Ohio because of a bank XXXX. I complained to the bank employees who did nothing. I was trapped at the bank. I filed a written complaint with the bank the very next day, including the following : " Because of this terrible situation I experienced at FMB, I tried to contact the offices of its XXXX, XXXX XXXX, to inform headquarters. I called the XXXX customer number. To my disappointment, XXXX would or could not give me contact information for the Bank 's corporate offices in XXXX. I then called the XXXX XXXX branch. To my continued amazement, teller XXXX had never heard of XXXX. ( Does n't the Bank educate its employees about such a simple piece of information? ) Nor could she tell me how to contact the Bank 's corporate offices. All she would say is call customer service. I informed her that I already had. XXXX had nothing more to add. '' No one from the bank ever responded. I resubmitted the complaint on XXXX XXXX, 2014. Still, to date no one from the bank has contacted me about being prevented from leaving the bank 's property, It is now more than half a year without the bank acknowledging the customer service problem, let alone apologizing or taking action to correct its mismanagement. It is against public policy and the public interest to be held 'captive ' by a bank and its contractors. And, just as bad is the inability or the intention of the bank 's customer service department to provide access by a current customer to the bank 's corporate staff. How can the public complain to headquarters when the lower ranks are a hindrance.

My HELOC w ith First Merit B ank termed out XXXX of 2016 an d at end of term First Merit sent a statement showing the total balance due. Seeing that I did not have over {$300000.00} on hand I called First Merit Bank for guidance. I was told by a representative to continue m aking monthly payments of {$1000.00} to at least cover the interest while they sort things out. I then received an alert on my credit report that I was being reported as late, even though I made {$1000.00} payments from XXXX 2016 - XXXX 2016. I then called the First Merit customer service line. The First Merit Bank representative told me several times the credit reporting would be reversed, yet each month things got worse not reversed. I talked to my branch contact XXXX XXXX who called customer service on my behalf many times. The n Huntington Bank took o v er First Merit Bank and now many of the personnel familiar with my situation are no longer employe d by Huntington Bank. Luckily my XXXX XXXX branch contact XXXX XXXX is still wit h Huntington B ank. XXXX has made and continues to make several phone calls and has also been told mulitple times that the reporting is being corrected. Huntington Bank has since given me a two year extension on my HELOC, yet at a higher interest. If I were 120 days past due why on earth would anyone extend credit to me? On XXXX XXXX, 2015 I visited the drive through at First Merit bank in. XXXX. Michigan. XXXX XXXX XXXX XXXX , Michigan XXXX. I deposited XXXX checks totaling {$3500.00}. The math is obviously wrong. The deposit was to be {$3300.00}. There is a {$100.00} discrepancy. The math error was my fault. The teller gave me {$200.00} in cash and I was given a total deposit of {$3200.00}. Nothing was said and nothing was corrected on my deposit slip. I counted the {$200.00} given in XXXX twenty dollar bills and drove away. I later examined my deposit slip online and noticed the error. I brought it to XXXX 's attention at First Merit bank. She told me that I was given {$300.00} in cash that day to correct the error. I was not. I was given {$200.00} in cash. I asked her for the bank video and she said that there would be none. She refused to give me my money back. The deposit slip says it all. The math is wrong and there are no corrections on it. I was only given {$200.00}. I certainly would notice if I was given an extra {$100.00}. I know {$100.00} is not a large sum of money and maybe not worth this hassle but I feel cheated to and lied to. This is not fair. This is concerning my checking account with FirstMerit Bank. I deposited my payroll check for {$990.00} on Saturday, XXXX XXXX, XXXX. Today, Monday XXXX XXXX, XXXX, my funds are still not available for withdrawal. I called the bank and asked why this is the case, and XXXX the branch manager at the XXXX XXXX location in XXXX, Ohio told me that this is their policy and that it will be available tomorrow. If Saturday is a business day on which a check can be deposited into a bank, directly to a teller via their drive through ( not an ATM ), then it counts as the business day on which the check was deposited. Today would qualify as the business date after the date on which the check was deposited, and according to the Expedited Funds Availability Act of XX/XX/XXXX and Reg. CC, I should have AT LEAST {$200.00} available to me out of that check. Currently, my previous balance, not including my pay check, of {$57.00} is all that is available to me. FirstMerit Bank is violating federal law by withholding my money from me and I want them to stop doing this. None of the stated exceptions apply to my transaction - the check is not fraudulent, I have not overdrafted my account, the check is not being re-presented for cashing after not clearing, none of it. I do not have direct deposit available to me through my employer and I should not have to go to check cashing places and pay a fee when I have a perfectly good checking account.

I have a loan through First Merit Bank. It is a 15 year loan and I am currently XXXX years ahead of schedule as far as paying this loan off. I made double paymentsfor about the first XXXX years of the loan. Well I ran into some financial issues as wellas some health issues and to say the least money has been tight. Well I made fewpayments late and First Merit Bank reported me to the Credit Bureau, which I know, all banks do this, but I believe this is wrong on so many levels. First off, I am wayahead of schedule, so I do n't know how you can say it is late? Has First merit notused my money that I have already paid back on other investments to further theirbusiness interests? Had I not paid ahead, they would n't have nearly half the moneyfrom me that they do now, but somehow, they are warning other creditors that Imay be a credit risk? Firstmerit bank is moving items around in the bank account that is causing an over draft fee to be charged after the amount was put in to cover. On XXXX/XXXX/2016 I checked my bank account and showed I had {$17.00} and some change in the bank and all the pending charges had come out of the bank. When checking my account on XXXX/XXXX/2016 it showed that a check had come through after XXXX and caused the account to over draft, I went in that same day and put the money in to cover the amount and when checking my account it showed I was in the positive {$2.00} and some change. Well when checking my account this morning XXXX/XXXX/2016 all the items had been moved around causing the account to overdraft again last night costing me {$35.00} over draft fee. When I checked the account before bedtime last night I was still in the positive and after not using my card at all yesterday the charges that had come through XXXX/XXXX/2016 had been moved to XXXX/XXXX/2016. The way that they are showing in the account is that I had been using my card after the account was bounced but I even opted in to have it that I am not able to use my debit card if the amount that I am trying to buy is more than the amount in the bank. I contacted customer service and they had been no help, the representative was very short with me and did not want to help.

My primary bank is FirstMerit. My branch is located in XXXX, Michigan. FirstMerit recently added an online service with which one can transfer money into one 's account from another bank without a fee. Here is the problem. FirstMerit is making egregious use, in my opinion, of the float. This week I initiated a transfer from my account at XXXX Bank in XXXX, Mississippi. I initiated the transfer, through my FirstMerit website account, on XXXX XXXX. The money was debited from XXXX on XXXX XXXX. But, FirstMerit wo n't make it available to me until XXXX XXXX. In other words, they are getting the benefit of a four day float. I do most of my financial stuff on line, and I know that FirstMerit had my money on the XXXX ( everyone else, banks, credit cards, creditors, etc. manages to do same day transactions ). so, my complaint is that FirstMerit Bank is harming me by hanging on to my money for four days without justification. I can of course provide bank statements and documents to support these assertions. And, I have now observed this pattern repeatedly, as i have been making transfers for several months now and every one follows the same pattern.

My husband and I have been trying to get a payoff on a RV loan faxed to XXXX in XXXX, Ohio from First Merit Bank in XXXX, Ohio for the past 10 days. We are senior citizens and have decided we are getting too old to be hauling an RV everywhere. We have an interested young man who wants to buy it. His loan has been approved through the bank in XXXX. The bank requested the payoff in writing be faxed to them from First Merit. After numerous phone calls requesting the fax be sent, they are now telling us only XXXX handles that and she is out of the office. They wo n't give us XXXX supervisors name. In the meantime we have had to turn down XXXX prospective buyers because we think it is sold. Our buyer is getting impatient because he needs the RV for his business travels. I 've made multiple attempts to contact First Merit Bank to close out two CD 's that were opened by my late mother on which I 'm the named beneficiary. I 've spoken to XXXX and XXXX who have both asked for various identifying information and have made assurances that the CDs will be closed and a cashiers check will be forwarded to me. Yet every time I call to follow up with them concerning when I can expect the check to be sent they have an excuse about something they need before they can proceed. It 's been over a month since I initially contacted them and now they are informing me that they ca n't close out the accounts until the they have " court documents. '' Unfortunately they ca n't tell me what they actually need besides " court documents '' which is not helpful. On XX/XX/2016 I went in to pay auto loan payment. I pay {$470.00} each month I pay XXXX because I wanted to catch up on 1 late payment and pay a payment coming due on XX/XX/2016. I opened a checking account with First Merit Bank because there was a flyer that was sent to my home stating that I could receive {$150.00} worth of credits to my account if I followed certain procedures for opening an account. The procedures are in {$25.00} increments. I have ( 1 ) opened a checking account with Mobile Banking ( 2 ) enrolled int he merit rewards program and ( 3 ) I do participate in the direct deposit program to the account. Since I have opened this account I have been receiving fees of {$35.00} stating that I have had many overdrafts. I have discussed with the bank that I have a tight budget and call and go on-line constantly but they always seem to place the blame on the merchant and hold money for 2 to 3 days knowing that the purchase was made when I had the money in my account. I have been charged almost {$300.00} in overdraft fees in 3 months since I opened the checking account. I had a home equity line of credit with First Merit Bank now part of XXXX and recently closed it due to the sale of my condo. I was assessed an account closure fee of {$350.00} even though the schedule of fees did not include this fee. Buried in the language of the loan documents it said that they MAY charge an account closure fee. It did not state that they would charge a fee. I spoke to an individual that stated even though the language says they may charge a fee it is their practice to charge a fee. This language is extremely ambiguous as the institution can pick and choose who they want to discriminate against and charge this fee. Being a XXXX customer, I feel that I was unfairly discriminated against due to my XXXX background. Further I believe this to be a UDAAP violation as they are engaged in a deceptive practice indicating that they MAY charge a fee when they do charge it. A formal investigation should be opened against this institution and there should be a regulatory enforcement action against them.

First merit only allows method of payment limited to those that do not have a checking account with them. In the beginning of the loan i opened a checking account which was closed due to i did not always use the account. I opened just so i had a way to make payments online. They offered a {$25.00} bonus check for opening a new account which i was not allowed to receive seeing that my account closed. Now i have to submit my payment by cash only i went in on XXXX to make a payment with {$440.00} for my payment of {$430.00}. I told First Merit Bank employees on XXXX XXXX that my wife and I would file complaints against it with the CFPB. Simultaneously, I presented a corporate dividend check for {$3.00}, cashed it, and then deposited the money into my checking account, as has been the pattern I have utilized cashing and depositing for the past five years. XXXX sold off branches as part of the deal and any customer that supposedly had an account at a branch that was sold was being transferred to the acquiring bank which is XXXX XXXX. The XXXX XXXX branch was sold and my mothers accounts were included in the sale. Problem is she never opened an account at XXXX XXXX which is XXXX plus miles from her home. She was slammed into a branch that she never used I think to bolster a weak branch up for the sale and transfer to XXXX XXXX. My mother is not mobile and this puts an undue burden on her to do her banking. I and she wishes to keep her accounts at XXXX. I feel this was a sneaky and unfair, deceptive, and abusive action to benefit FirstMerit at the expense of an elderly and defenseless woman.

I chose to close a bank account with FirstMerit Bank located in XXXX XXXX, WI. When they gave me the document to sign it showed that only XXXX remained in the account. I asked how that could be and was told of a inactivity fee of XXXX per month. I was totally unaware of this fee. I was told by a customer service person that they send out a notice each month when the account is ready for viewing. I told them I have never received any such email. I did check the account a couple of years ago and the amount shown matched my checkbook balance. I usually come up to Wisconsin for a couple of weeks each year. Payments were sent to FIRSTMERIT BANK on or around the dates of XXXX & XXXX in the full amount of {$70000.00}. First Merit Bank is harassing me now because I previously filed a complaint against it with the CFPB. Earlier this year I closed my account with First Merit Bank. I also filed a complaint with the CFPB because the Bank erroneously and fraudulently kept part of my balance. Because of my complaint, the Bank gave me the monies due me. My bank is small and only in Michigan. I was out of town for 3 weeks and needed to make a deposit via an app in order to avoid an overdraft fee. First Merit Bank does not allow overdrawn accounts to use any online/app features. So I was unable to make the deposit necessary to avoid the overdraft fees. They also would not close or suspend my account ( because it was overdrawn ) to avoid the overdraft fees. First Merit Bank has charged hundreds of dollars in inactivity fees. Upon realizing this, I decided to make a payment of {$100.00} from the account, which would take the balance down to a minimal amount ( and, presumably, avoid the inactivity fees ). I opened a second checking account with First Merit bank to keep money separate from my main account for personal reasons. I was charged an " Inactive Fee '' because I was not using this specific account enough. This fee was half the money in the account.
