The borrower and co-borrower claim HomeStar Financial and its Mortgage Loan Officer exhibited the following behaviors resulting in financial loss : Failure to provide a loan estimate within three days of application Failure to address a loan file in a timely manner Unethical and inconspicuous behavior Failure to maintain adequate procedures Failure to provide loan estimate in good faith ( increase in fees at closing ) Failure to provide a closing disclosure in good faith Failure to provide closing disclosure three business days prior so consummation HomeStar Financial Corp failed to provide a loan estimate within three days of the loan application for the borrower and co-borrower. On XX/XX/2018 borrower completed the loan application process with HomeStar Financial Corp through their Mortgage Loan Officer, XXXX XXXX and his online page. A loan estimate was not provided until XX/XX/2018. On XX/XX/2018 the co-borrower submitted an online loan application with XXXX XXXX of HomeStar financial Corp. A Loan estimate was not provided until XX/XX/2018. HomeStar Financial Corp and their loan officer failed to provide a loan estimate within three days of the loan application to the borrower and co-borrower. Mortgage Loan Officer, XXXX XXXX, exhibited unethical, dishonest, and misleading practices. On XX/XX/XXXX the borrower asked about locking the rate via text message ; the loan officer said he would look at them in the morning. On XX/XX/XXXX, borrower asked did he have everything he needed from us and what rate we are locking in ; the loan officer responded he was looking at rates that day. On XX/XX/XXXX the borrower asked for a good faith estimate and to lock in the rate ; the loan officer responded they are now called loan estimates and should receive it that day. The borrower did not receive it. On XX/XX/XXXX borrower asked to lock the rate again ; the loan officer responded he would try and lock the rate the next day ( XX/XX/XXXX ). On this same day, the co-borrower asked XXXX XXXX if she was the processor because they still hadnt heard anything. On XX/XX/XXXX the loan officer texted advising of not so good news. Shortly after, on XX/XX/XXXX, the co-borrower followed up with XXXX on a recorded call to see why the rate had not been locked the several times the borrower requested it. It had been almost a month since the initial request. He said, I couldnt lock it, because of issues with the secondary market. Co-borrower responded, the way it was presented to [ borrower }, you stated there was an issue with the secondary market and therefore could not lock the rate. But from what youre saying, there was an internal issue with the HomeStars internal Secondary Market Team that didnt allow you to lock the rate. If you stated that from the beginning, we would have made a different decision on lenders. But it was not presented that way. It was misleading and dishonest. I think it was done intentionally. This was the first instance of unethical and inconspicuous behavior in addition to the failure to act on a loan file in a timely manner. The incomplete / inadequate management processes of the data provided to the loan officer, information being given to the loan processor, and the data on the closing disclosure did not reflect the information send to the loan officer and presumably the underwriter. The borrowers name was consistently spelled wrong. The loan officer failed to provide updated numbers to the loan processor and closing agent. The underwriter sited a changed circumstances in the updated closing disclosure, but did not account for all the income for both the borrower and co-borrower. The income information on the closing disclosure was not correct and was not provided until less than 24 hours prior to closing. When the first disclosure was provided, it was not correct. When questioned, the man officer said it only matters once we get to the table. They will have all the numbers correct then. Towards the end of the transaction, the co-borrower explained she believed the loan officer failed to act on the loan file in a timely manner. He knowingly did not send or attempt to lock the rate. He knowingly failed to review the file to confirm the intent to proceed had been signed. The intent to proceed was sent, but seven days after it was sent it still had not been signed ; even though the borrower asked XXXX plenty of times what else was needed from them since they hadnt heard any questions from the underwriter. It was not until the appraisal was scheduled and not paid for that the loan processor revealed the intent to proceed had not been signed. The loan officer had no clue. This is a clear process failure at HomeStar ; and a negligence on the part of the loan officer. On the dates and time where the borrower checked on the rate lock and status of loan processing, the loan officer didnt even check to see if the borrower or co borrower had any outstanding items. Both had been checking the online document management system to see if there were any actions on their part. The intent to proceed was not shown in either account. The second instance of unethical behavior occurred on XX/XX/2018 three business days before scheduled closing. Without knowledge or permission from the buyers, the loan officer, who never previously responded to any of the agents inquiries, reached out to the buyers agent to see if, there was any way to increase the purchase price to XXXX and get an additional XXXX in seller assist?. The co-borrower contacted him immediately. In a recorded conversation, XXXX tried to explain that sometimes you can game these numbers. This behavior show failure to understand and address the loan file in a timely manner in addition to unethical and inconspicuous behavior. HomeStar Financial Corp, through their non-compete agreement with the loan officer, are exchanging a thing of value ( his job ) to support their unethical processes. During the recorded conversation with the co-borrower on XX/XX/2018 about rates and fees XXXX stated, I completely understand your turmoil. I have been unhappy with HomeStar the last couple months myself. If I could leave tomorrow I would. Unfortunately Im on a non-compete clause that wont allow me to. He essentially can do whatever he wants in a loan file without recourse. He cant leave and they wont dismiss him. This is quid pro quo. Please keep in mind we have recordings of the conversations conducted between the loan officer and the co-borrower in addition to text message screenshots of the loan officer requesting an increase in the sales price. We are fully prepared to pursue this matter to the fullest extent possible.

This company has been unresponsive to assist me with my loan and because of my complaint they have decided to no longer assist me. Ive repeatedly asked to speak to the CEO several times and they just keep sending me to the people that arent helping. I have shown the compliance officer proof that the individuals within their company has a huge lack of communication costing me money time and XXXX They say theyre going to call me and I dont hear anything back and I have to keep trying to contact them. There are three individuals especially that have caused this problem. XXXX XXXXloan processor and daughter of XXXX XXXX, XXXX XXXXdivision manager.and XXXX XXXXcompliance officer. They have ran my and my fianc Credit without our permission. When I made the second complaint Ive never heard anything back from XXXX. She said she would call me back last Thursday or the following dayXXXX. She said if I had any more questions or concerns to dial her number directly and until then she was going to look into the complaint and gather all the information and get my preapproval letter back and move forward. I never heard anything back from her but emails stating that she had received my complaint and would be investigating and to get back with her if needed and to also provide her with any proof of my complaint. I sent her plenty proof that I was being neglected and abandoned by the loan processor and her father. I requested that XXXX not be the one to contact me back on this complaint as he is a part of this complaint. Today, XXXX, I heard back from XXXX he was very aggressive and told me that they would not be giving me any credit. I asked him what was Credit and why is he calling me. He stated they would not be extending a loan to me And he had reviewed the complaint that I made and thats the end of the conversation. He tried to hang up on me but I insisted that that was no way to handle this being in his profession in as a human. I stated I requested specifically for you not to be the one to contact me back or handle this complaint because youre part of the issue. I asked why I have not heard back from the compliance officer XXXX and her boss XXXX and did they agree with this. He said that is my decision and were just not giving you alone and thats the end of the conversation. I said this is no way to do business and I feel some type of way and I need to hear back from the compliance officer who said that they would contact me back and he said in a very aggressive tone Im over them Im their boss and its my decision. He stated he was not going to make no more room for that conversation and that he was getting off the phone. I told him again this is ridiculous and inappropriate and this will not be the end of it since you dont want to make time for this issue and move forward Im going to file a complaint on each persons license. He had no business calling me when the complaint was filed on him and his daughter, XXXX. I never used profanity nor yelled at these people even though they have brought me and my fianc through the ringer. They have ran our credit over three times and I have been dealing with them for over a year. My fianc and I have done everything they told us to do in order to be approved for the loan and they decide because I complained that they are not going to extend us are alone in the meantime were stuck in a hotel in which they knew our situation. I am seeking discipline to all three that I listed above and that they give me someone else or give myself to someone else so that our credit does not have to be ran again. Theyve made me lose our home, money, time. I am a XXXX woman that in XXXX XXXX XXXX. You cant just drop someone after theyve been working with you for over a year and you repeatedly ran their credit and and the consumer has done everything you told them-paying off things on credit, saving certain amount of money when it their fault! I needed another pre-approval letter due to XXXX non compliance and she tried to request information thats required to complete the loan as of Ive already chosen a house because I called her out on her lack in which youll see. She had already given 3 pre-approval letters without all the info she requested. I advised I have no problem after weve found a home and offer basically accepted because whats the point especially after youve given my pre-approval already to the same realtor. Right before this we had a home ready to get and because of her lack of being informative and attentive, we had to back out at the last minute. Her or her father wouldnt answer my questions before I gave my hard earned money.. This isnt the first issue Ive had with HomeStar. My initial complaint several months ago was similar to this which is how I got in touch with XXXX Im the first place. Even my realtor was frustrated and shes the top 10 % realtor in Georgia. She shared the same feelings.

Homestar was a accessory to mortgage FRAUD after the fact- On XXXX XXXX, XXXX XXXX Homestar Processor reached out to the closing attonery paralegal XXXX XXXX, to let her know she had a post-closing issue on my loan Homestar didn't have a Builders Warranty or a Certificated of Occupancy she asked XXXX XXXX, if she could reach out to the builder, XXXX XXXX XXXX to get these documents. XXXX XXXXProcessor had made serveral attemps to get these documents from XXXX XXXX XXXX XXXX before closing on my loan but he fail to send them to her ; They closed on my loan without the forms. Please review the attachment email chain of the coversation to get greater context as XXXX XXXX XXXX XXXX, was stalling because he did not have the forms. XXXX XXXX XXXX XXXX ; did not get the Builder Warranty and Certificated of Occupany until he Fraudulently paid XXXX XXXX and XXXX XXXX the City Inspector for these documents. Homestar allowed XXXX XXXX XXXX XXXX to bring the documents back to the closing attonery office with a wet signature from XXXX XXXX, a builder they had never heard of-and then HOMESTAR COMMITED FRAUD WHEN THEY XXXX XXXX SIGN MY NAME ON THE DOCUMENT!! I NEVER XXXX XXXX SIGN THE BUILDER WARRANTY. I would have never sign that document because it had a builders name on the document I had never heard of-Mr. XXXX XXXX I reported this FRAUD AND THEFT BY DECEPTION TO XXXX XXXX XXXX XXXX GA XXXX I applied for a arrest warrrant for XXXX XXXX XXXX and XXXX XXXX This case was heard before Chief Maigistrate XXXX XXXX XXXX XXXX she Denied the the arrest warrant because she felt it was a CIVIL CASE and not Criminal but that's a LIE- It is BOTH ; this is a small town and they are going to be complicit in behavior. This Pre-Arrest warrant hearing was recorded in a Court of Law- This case docket can be Suppoena and reviewed by Homestar . XXXX XXXX XXXX, the fake builder confess to building the home XXXX XXXX-Builder confess to NOT building the home All of the sub contractor confess to NOT perfoming any of the work on the home. Everyone confess that XXXX XXXX XXXX paid them under the table cash money and they did not have one receipt or one document for any of the costruction of this property-NOT ONE piece a paper! This property was XXXX and the Builder - XXXX XXXX, could not produce one document of any supplies that he purchase from any vendor. The Plumber XXXX XXXX confess to NOT doing plumbing - The person who did the plumbing is a CRACKHEAD and he could not come to court because he was in rehab. This whole entired house was built by unlicensed individuals XXXX XXXX XXXX paid XXXX XXXX to sign the Builder Warranty XXXX XXXX XXXX paid XXXX XXXX for the Certificated of Occupacy XXXX XXXX XXXX tried not to paid those guys because he wanted to keep all the money for himself but when he realized he was going to have to produce to the documents to the closing attonery to give to Homestar he went ahead and paid the money. That is why it took him six days to get the documents to the closing attonery. If you review the emails you can see XXXX XXXX XXXX XXXX is a Bold Face Liar who was just making up excuse try to waste time. HOMESTAR could have prevented this whole closing from taking place. When XXXX XXXX XXXX failed to send in the required documents we should have NEVER close on this loan.XXXX XXXX XXXX failed to closed on the last closing because he could not produce the documents. The realtor XXXX XXXX testify in court onXX/XX/XXXX, she was the agent who had a contract on the property before me. The XXXX XXXX XXXX XXXX Ga This property XXXX is Mortgage Fraud!!! The Builder and all the Sub contractor have all been reported to Secretary of State Licensing Divsion for Fraud!! Homestar can not just write back and say the complete a investigaton without subpoenaing the COURT DOCKET # XXXX from the Magistrate Court XXXX XXXX GA and revewing it. The evidence will clearly show Mortgage Fraud and Theft By Deception! The evidence will show HUD FRAUD ( 18USC 287, 1001 AND 31, USC 3729 )

As low income and moderate income consumers have a hard time breaking into the home purchasing market in this area, XXXX, buyer found a HUD repo to purchase with only {$100.00} down and seller pays 3 % closing costs. This is a sweet deal for a low income/moderate income buyer ; however, the first mortgage company, XXXX Mortgage XXXX, preapproved buyer for the property right away but failed to complete the process. This company was given 60 days to complete where the buyer soon learned that this was a rag-time company operating on lies and deception. Each time consumer would call the LO would not answer the phone -- only operated in e-mail communications. This company kept running credit reports, bringing down the credit score. Also, this company tried to make the buyer pay for Rapid Rescoring, and insisted that buyer pay for this cost thru credit card after requesting the buyer pay down these accounts to help with the DTI. The LO requested {$450.00} for an appraisal which never took place. Buyer found out after canceling with this company. This was a horrible experience. HUD offered a 60-day closing, and this company waited until the last week before alerting buyer about errors appearing on credit report. Advised buyer to not dispute these errors, but buyer did not comply and these errors were removed, immediately, after disputing. To save the great deal ( {$100.00} down/seller pays 3 % closing ), buyer obtained another mortgage company that stated it could process, underwrite, and fund within a day -- Homestar Financial. The file was discussed with the LO on or about XXXX XXXX, 2015 and given to the LO of Homestar Financial, XXXX around or about XXXX XXXX, 2015 with the disputed errors in process. The buyer received a closing extension from HUD until XXXX XXXX, 2015. The LO from Homestar Financial stated the loan would be approved with the assumption that the errors would be corrected. The credit corrections were done on or about XXXX XXXX, 2015 and forwarded to the LO at Homestar Financial. Buyer received an e-mail from LO that he was not in the office and for buyer to forward the corrections, and he would make sure Credit received them on XXXX XXXX, 2015. On XXXX XXXX, 2015 Homestar submitted a Loan Estimate with several major errors and required buyer to sign. Buyer refused to sign, and the file was submitted to underwriting, buyer assume, with these errors. This LO is not familiar with HUD/FHA closing, and has delayed up until today the closing -- offering no solution to an extension. Even when the realtor had submitted a cancellation notice to HUD this a.m., he was still e-mailing about the closing -- that it will take until the end of the month. The LO has no clue as to the policy and procedure of HUD nor FHA. Buyer lost the great deal. Homestar Financial needs to change its mission statement because it is not in the business of helping all buyers. Buyer find that this mortgage company will nickle and dime a consumer to no avail. It will make sure the buyer does not get back any funds from the earnest money even though that money is over and above what is needed to close. It will find a way to take that money. Buyer did have credit issues, but those issues were quickly fixed according to FHA guidelines. Buyer had a low middle score of XXXX, but was able to bring that up to XXXX ; however, Homestar still assessed a 4.75 % FHA interest rate. Buyer did not receive a fair shake from this company and missed a great opportunity as a low income/moderate income minority homebuyer. The LO took on an egotistical, lackadasical attitude. There are nill to none $ XXXX/down homes in this area. This was a golden opportunity for a moderate income minority homebuyer.

Enrolled in forbearance program in XX/XX/XXXX, which was extended until XX/XX/XXXX. Since that time I have made payments early, and have been working with the company ( Homestar ) to submit a partial claim, which they offered as an option. This is supposed to move the past-due payments to the end of the loan. I was provided documents, which I signed on XX/XX/XXXX. The documents were also reviewed and signed by a VP at Homestar on XX/XX/XXXX. After those were submitted, nothing happened. My account still shows a past-due balance for the payments during the forbearance period. I can not make payments online and it shows that I am 5 months behind on my mortgage. The company told me in late XXXX that there were other documents I needed to sign ; they never sent those documents. Since that time, I have spoken to over 20 people. Dates of the calls are listed below ( I started keeping track after calling 2-3x a week for several weeks ). Each time I would speak to a different representative, who kept telling me the same thing - " the documents will be sent out, you should receive them via email in 2-3 business days. '' I receive emails from the company regularly regarding my mortgage payment and I monitored my spam folder, never receiving the email. Finally, on XX/XX/XXXX, they sent the documents that " we are waiting on to execute the partial claim. '' The documents they emailed were the SAME documents that I had signed on XX/XX/XXXX, complete with my signature, my father ( co-signer ), and the VP of Homestar. I have spent countless hours on the phone with them, speaking to multiple people, being told the same story. I am just trying to get them to do their job. It was a forbearance option they offered, and I have done my part. I am still waiting on the claim to be processed and my account be brought up to date. I call each month and make a mortgage payment via phone, as I can not manage my account online due to the pending claim. Calls I've recorded include : XXXX - talked to XXXX, said a manager would call to discuss my issue and that she had " personally '' sent the manager an email - call was never returned XX/XX/XXXX - spoke with XXXX, said the docs would be coming XX/XX/XXXX - tried to call and inform her that I had not received the documents, the extension she provided went to a call center. Had them forward me to her voicemail, left a voicemail, she never returned my call XX/XX/XXXX - spoke with XXXX, said docs would be sent out, never received XXXX - XXXX on customer ally team said email was being drafted and would be sent out in 24-48 hours XXXX - Received a copy of the same documents I had signed on XX/XX/XXXX via email, saying that I needed to sign and return ... signatures already present on those documents, from me, father, and Homestar VP XXXX - Spoke to XXXX, he was perplexed as to why the claim had not been executed yet. He initiated a " task '' and said that it would be brought up to date in the next few days XX/XX/XXXX - Received call from Homestar to tell me that they were again " reviewing documents ''

Homestar drop the ball on my loan from day1. Lack of communication. I was pre approved for {$120000.00}. I made an offer to a HUD {$100.00} down house. Hud accepted my offer of {$92000.00}. I supplied ALL documents to my loan officer via email and fax in less than a week. After a month of waiting, they finally ordered appraisal. What originally cost {$450.00}, but they charged me {$550.00}. Because they had to put a rush on it. The property management made me turn on all the utilities on in 2 days!! I got total of XXXX disclosures, all because they had mistakes with the loan amount and down payment. I called my loan officer multiple of times, no answer. In one occasion, he text me back at XXXX, stating that he will call me back during business hours. But turn around and respond to my email at XXXX!! After 6 weeks of waiting, he emailed me stating the underwriter approved my loan! A week later, I got email from the loan processor for additional documents. I sent all requested documents the same day. Then they started to ask for same documents over and over again. I emailed and faxed the documents. I was so tired of them not receiving my documents. I got off from work early, and hand deliveried all the documents to the branch office. My realtor had to get 15 day extension on the contract, because the underwiter still working on my loan. After a week later, they finally sent me the closing disclosure with the closing date of XXXX/XXXX/16. I signed it and emailed my loan officer asking them what time is closing that same day. No response. When the closing day came, I still took the day off from work. Praying someone will call me. No phone call. The next day, my realtor called me and told me the underwriter wo n't close on my loan, because the appraisal report has pictures of missing outlets. So they want hud to fix it, but Hud is refusing to make the repairs. I was so upset. She then said to get a invoice from a repairman for the cost to fix it, then we can close the next day. I called my friend whom does home repairs, showed him the appraisal report ( which by the way, I finally got from the loan processor that day via email ) all this time I never got the appraisal report that I paid for a month ago. I emailed the underwriter the repair invoice, agreeing to make the repairs once we close. No response. Now my extension on the contract expiring in 4days! XXXX/XXXX/16. No calls. No emails. Nothing from homestar. How can homestar send me the closing discloser with closing date, but now have a problem with outlets in the house???? They made what suppose to be one of the greatest moment of my life, XXXX. I 'm about to lose my dream home, because I choose to apply with homestar.

I've been on a COVID-19 forbearance since XXXX. In XX/XX/XXXX I reached out to Homestar financial to let them know I'm now working but not making the same amount, I'm ready to end the FB. They sent me a no document modification which is what XXXX XXXX is offering. I didn't receive the documents until after XX/XX/XXXX and the first trial payment was due on XX/XX/XXXX and I had to accept it by XX/XX/XXXX but I didn't receive it on time. That modification was a Flex no doc mod with and interest rate of 2.875 % with payments of {$XXXX}. Those payments were perfect and affordable as my income decrease drastically. I contacted Homestar when I received the documents and the time had expired. They advised they would send new documents with updated date and nothing else would change. I waited to received the new documents but these documents were not the same. The new received has the same Flex modification but the interest rate is now 5 % and they only stretched the loan out, the payment would now be {XXXX} which I can not afford. I spoke with the account rep several times in XXXX and XXXX to get this rectified. The rep XXXX keeps calling but confusing the account with someone else forgetting what he told me he had to reach back out to the loss mitigation department to get the documents corrected or have a partial claim and modification combo. I spoke with XXXX today, XX/XX/XXXX, he again forgot what he was suppose to be doing for my loan. I reminded him, the he stated, oh I was suppose to send you a loss mitigation packet because Covid is over. I advised him XXXX is still offer the same resolve options as before since my loan was affected because of me losing my job due to COVID. He was very insensitive to the situation. He asked to speak with his manager and he refused to let me speak to anyone else. I asked him to schedule a manager or supervisor call me back and he again advised he's the only one I could speak with, I advised him he has a superior. He refused me to speak to anyone and I hung up on him and cried. I cant believe I'm being treated this way because I was affected by something out of my control. It's not my fault I didn't receive the first set of documents on time but I called as soon as I received them. I'm trying to get this fixed so I can start making afford mortgage payments. XXXX put these programs in place for a reason and I'm being denied what they're offering for there loans being serviced by your company.

Hello- i purchased a home in XXXX 2014. This day was suppose to be the happiest day of my life and instead i was feeling like i should have not made the purchase but was n't able to get out of it because of i would loss the down payment money and other things. the lender company did n't do a great job of explaining things correctly to me and i often received conflicting information or finding out that the amount approval was given was incorrect fha vs 100 % financing. ok, i found out that the lending company use and insurance company that i had no knowledge of and the amount of coverage was not correct. the house had coverage for someone not going to be in the home for about six months. i found that out due to searching for a lower monthly payment, on now i found out that the taxes on my home is 1500.00 hunder dollars more than what they said at first before closing. so with my monthly payment of XXXX is now going to go up over 800.00. When i went into the office to apply or see if i can qualify for a home, i told them I do n't a monthly payment of 700.00. they said i would have to fight the payment of XXXX until i file homestead exemption and i will drop about 300.00 a year and the would put me closer to my request. I said ok, now come to find out THAT is not going to happen since i am in the whole from the amount of propery tax and the correct insurance has gone up on my home. I am so afraid I will not be a home owner for long because of the STRETCH payment i am having to come up with from month to month now. This is stressing me OUT so bad, it will mess up my credit, and my living status with my family of having to find them a nother place to live. I spoke with manager of homestar and i do n't feel as thou he understand how this has effected my finances of struggling to pay this every month. Having to come up with extra monthly with children and other responsiblity is difficult, and that is Y i try to plan and keep it to an minimual ... .. this is CRAZY ... .... i am trying not to cry but it is hard to tell your family we may have to move because we can afford where we are because of some XXXX else neglection.

My name is XXXX XXXX, me and My wife XXXX XXXX went to see the XXXX property located in XXXX, by XXXX XXXX XXXX, we met their agent XXXX XXXX on XX/XX/2021, we decided to apply for a House the only thing needed at that time was the pre-approval letter from a lender ( XXXX mortgage ) also we went with Homestar and got preapproved, We submitted the information, XXXX XXXX was already set with the information but insisted that we used their preferred lender, We waited for the property to reach out to us about the house and decided to apply with her preferred lender because she was stating that based on their relationship with the lender ( Homestar XXXX XXXX ) would give us preference which we already had an approval by the same office but a different branch, their prefer lender increase our rate twice We were waiting until XXXX the price and the building of the house were changed on XX/XX/XXXX they asked us to come to see the offer and sing the contract on such contract was requested the good faith deposit, now when we sat down with the XXXX XXXX XXXX, XXXX XXXX, she stated that because it was am FHA loan, if we decided to not close on the house we would not loose our XXXX money She asked me to do again the application with the Homestar and their mortgage went up to XXXX a month, I contacted XXXX XXXX about the situation and explained to her that we could not afford that rate, she said that it was fine but that we were Giving up on the Good faith deposit, she guaranteed us that the lot would be release she was making promises that we would get a house in that process their prefer lender increase the rate 3 times, decreased the amount I called the loan office to cancel the loan because of the payments, XXXX XXXX said that he would call them to notify about our decision, and to get our Good faith deposit, XXXX XXXX still pushing me to try with other lenders, or be ok with loosing the money, we could have locked the rate but we weren't sure of nothing with them now we are facing a situation of getting a unaffordable house or loose the deposit because this has been a nightmare for me and my family

Here 's a copy of what was sent to Homestar Financial : To whom it may concern. I am deeply troubled by the lack of communication and unacceptable service received since refinancing my home. For some unknown reason, Homestar did not process the approved payment for the XXXX premium. Subsequently, I received an unfortunate letter re Foreclosures and the need to make immediate payment for two months premiums. I obtained a mortgage from Homestar Financial Corp. for {$60000.00} at 3.5 % interest rate. The loan number was XXXX. I made my first payment of {$31000.00} to pay off part of the mortgage on XXXX/XXXX/2016 to Homestar. They cashed the check on XXXX/XXXX/2016 and applied only {$660.00} toward the mortgage and then sold the mortgage to XXXX ( account number XXXX ). The balance transferred to XXXX was {$59000.00}. This balance clearly failed to reduce the amount by the additional {$30000.00} they had cashed on XXXX/XXXX/2016. After I received the XXXX statement in XXXX and saw that clearly that the bulk of the XXXX payment had not been applied to the mortgage balance transferred to XXXX. I called Homestar and they always transferred me to " XXXX ''. XXXX never answered her phone and XXXX or XXXX messages went unanswered. Finally, I told the operator at Homestar that I needed to speak with someone other than XXXX. I spoke with XXXX XXXX and she was helpful in getting us answers even though it was not her Dept. Shortly afterwards we received a called from XXXX at Homestar who did n't know what happened. She finally tracked it down and and called back and told us that she had not known " what to do with the rest of the XXXX after subtracting the XXXX XXXX payment ''. This was now XXXX. She said she would mail it over to XXXX. The additional {$30000.00} ( the remainder from the {$31000.00} we sent on XXXX XXXX ) finally did arrive at XXXX and posted on XXXX XXXX. The issue is this. XXXX feels like Homestar did nothing wrong. I pointed out to her that from XXXX XXXX to XXXX XXXX I had to pay 3.5 % interest on the XXXX that I should n't have had to and asked to be compensated. XXXX insisted Homestar did nothing wrong. I then called XXXX XXXX at Homestar and asked that someone from Homestar besides XXXX contact me to discuss this issue. That was on XXXX. As of today, XXXX XXXX, no one from Homestar has contacted me to address this issue. Their lack of reasonable response has forced me file a complaint.

My mortgage was bought back from HomeStar in XX/XX/2020. First payment was made XX/XX/2020 under the original loan number I had with XXXX. HomeStar changed my loan number after that payment was made but before I had a chance to update it - honestly I don't recall receiving a new loan number. So on XX/XX/XXXX my payment left XXXX XXXX and Proof of Payment shows Homestar accepted and processed the payment under the original loan number on XX/XX/2020. On XX/XX/2020 or shortly thereafter, I started receiving debt collection calls from HomeStar, but because the loan was transferred I was still under protection of late fees. At that time I called back and let them know I paid - a ticket was opened but the gentlemen refused to take my proof of payment from XXXX. I called 2 days later because that first gentleman was rude. 2nd guy reopened my ticket - it was closed because there was no proof of payment ( which I asked if I should send ). It was closed without my knowledge. I got another phone call but this time sent the proof of payment on XX/XX/2020 - never head back. Called again - they had to reopen the ticket again - resent proof of payment on XX/XX/2020. Finally contact my mortgage provider who got me in touch with corporate. XX/XX/2020 received a message from corporate asking me to confirm the address - even though it is on the proof of payment. I called same day and left a message. Got a call back XXXX - she was on vacation and sorry she didn't get back to me sooner. XXXX asking for more information - I already send proof of payment and that's all they need. message back on XXXX - we are working on this! XXXX - harrassing messages have picked back up. I was told the messages would stop, but they didnt. It has now been 30 days since HomeStar took {$1700.00} from me and refuse to post my payment despite sending proof of payment to 2 people in Customer " Care '', 1 mortgage lender, and 3 people in corporate.

I was preapproved for a USDA loan XXXX 2021. Went under contract for a home XX/XX/2021. Was made to switch agents bc the builder required you use his agent of choice. So switched to XXXX XXXX with Homestar financial. We spoke and he said USDA was a go. I spent over XXXX dollars on upgrades for the home thinking i would be okay with closing costs, etc based on USDA loan. Three days prior to closing i was told i would not qualify for usda and that i would have to go FHA requiring an additional XXXX dollars at closing which was now pushed back to XX/XX/XXXX. I tried to explain to them that my income varies and that they were not calculating it correctly but they would not listem. The change also increased my mortgage payment making it higher than i wanted. I had already invested in upgrades that were non refundable so could not walk away. On XX/XX/XXXX about 30 minutes prior to closing was told i had to have an additional XXXX dollars in order to close. I essentially emptied my savings leaving me nothing left. DUe to the fact i had to use him i could not utilize several XXXX or first XXXX XXXX available to save money. Not to mention the last minute changes left me no time to even be able to try and figure out other options. When i got to closing on XXXX they crossed out some areas and hand wrote on the disclosure which was very confusing. Instead of first payment being due XXXX like it shouldve been it was pushed up to XXXX leaving me 3 weeks before my first payment was due ( which is late ). They also required a years worth of escrow in my escrow account which i have been told is not the standard amt. I am broke, and risk losing this home bc im late with my payments. The whole process was a nightmare and now i am in a position where i dont know what to do. It is not right.

I submitted my loss mitigation package via email on XX/XX/22 and on XX/XX/22 I received a letter dated XX/XX/22 stating that my application was incomplete and that I had to fill out a printed copy of the application and mail it in. I already spoke to an agent about the costs of gas and printing and how I could not afford to mail a hard copy and the agent reassured me that I could fill out the pdf version of the loss mitigation packet and email it. Now the lender is not honoring the packet. I called my lender on XX/XX/22 to verify the status of my loss mitigation application and the agent could not verify the status ( if they received it or not ), but kept asking me if I wanted to pay over the phone with him. I kept telling him I did not have the funds to make a payment and to please stop asking me, but the agent kept asking me if I wanted to make a payment. The agent even asked me if I was refusing to make a payment, which made me ask for his manager. The agent never got his manager and refused to assist me. I believe this lender is purposely pushing people into loss mitigation by lying about the process of paying back the deferred amount. The lender made it seem like all I had to do was call back and be placed on a forbearance plan, but now that the entire balance is due, nobody in their company knows how to help me. I have already submitted my application and called to verify they received it and have gotten no assistance, so I am reaching out to you..

XXXX contacted the seller of the home I was buying and started dealing with him instead of me. He gave the seller a copy of the appraisal that I bought, he also told him that even if he signed extension agreement for repairs, he did not have to make those repairs if FHA did n't require it ( which the appraisal company he hired did not list one repair on the appraisal ). When I contacted XXXX about communicating with the seller, he got very upset and also lied. My agent and I signed another extension agreement to extend the closing date on XXXX. XXXX called the seller and told him that he could close it on XX/XX/XXXX and the automatic 7-day extension was n't necessary. That caused a lot of unnecessary back and forth between me and the seller when it came to agreeing on a date. And we did n't close on XX/XX/XXXX, we ended up closing on XX/XX/XXXX anyway. XXXX told me and my agent I was pre-approved, but towards the end of the process underwriting needed a copy of my tax return transcript. How was I pre-approved without that? My down payment ended up being more than the required 3.5 %, because he got my loan approved at 95.9 % and never told me. I found out in my closing disclosure. XXXX was supposed to be representing me but instead he decided to communicate with the seller and keep him updated on the process while I had to find out later from my agent or the loan processor.

The previous servicer ( Homestar XXXX XXXX XXXX XXXX XXXX XXXX received a wire for {$49000.00} on XX/XX/XXXX. My loan was transferred to another company on XX/XX/XXXX, the funds did not transfer with the loan. I have bee trying to get Homestar to send the funds to the new company for almost 2 months now. I called the Homestar today, XX/XX/XXXX, now they are telling me they still have not wired the funds when multiple managers assure the funds had already been sent to new company. ( stated they wired your company the {$49000.00} that was received by them. Below is the bogus wire info from there rep. XXXX XXXX XXXX XXXX XXXX XXXXXXXX I need these funds posted to my loan. None of my funds need to be applied the inspection and FC fees, its not valid and you all and the previous company are investigating. The funds will bring my loan current plus payment for XXXX future months, use funds to cover my escrow shortage, then place remaining funds in unapplied. In additional, Homestar has legal fees and inspection fees when I was on the XXXX, then tried to get mod sent with updated dates. I was protected by the Cares Act, there is no reason my loan should have gone into foreclosure, I kept constant contact. You all need to do your job and reach out to Homestar. You both have me playing the middle guy when yall need to communicate. WHERE IS THE {$49000.00}?!?

I have been on a COVID forbearance since XX/XX/XXXX due to me no longer working due to COVID. I received a letter from Homestar/The money source advising my escrow was short and demanded {$3000.00} because they paid out for homeowners insurance 3 times. I borrowed the funds and mailed the escrow payment in XXXX. The payment came in 2 checks with escrow deposit written all over it with the escrow coupon. Homestar/the money source held the checks for over 1 week before actually showing on the account. I called daily to find out what was going on because the money had already come out my account but they didn't post it until XX/XX/XXXX and did not it towards escrow as they should have. The posted the month as 2 payments because its behind which doesnt matter if Im requesting funds be placed back in my escrow that was paid out three time by you people. MY MONEY SHOULD BE PUT TOWARDS THE ESCROW AS REQUESTED. YOU DO NOT DETERMINED HOW FUNDS ARE APPLIED. MY LOAN IS OWED BY XXXX XXXX AND NOTHING TATES I CANT PUT FUNDS TOWARDS ESCROW. THEY DEMANDED THESE FUNDS AND THEN TOOK IT AND APPLIED AS THEY WANTED TO. I AM IN A FORBEARANCE. We applied for mortgage to pay off a construction loan with a local Bank. The mortgage company sent us the closing disclosures showing we were approved for {$130000.00}. This was on XX/XX/2022. The closing date was set for XX/XX/2022. On XX/XX/2022 they were still approved for {$130000.00}. When they got to closing they were only given {$100000.00} which was the payoff on the construction loan. But when we found out we called the mortgage originator that we were approved for the {$130000.00} and that part of that was to pay our closing cost. We asked why the change from XX/XX/XXXX to XX/XX/XXXX. We were told a new underwriter decided this. We requested that we speak with the underwriter but were told they were not available. We told them we had no funds for the closing cost so then the agreed to increase the loan to {$110000.00} to cover those cost but not the {$130000.00} we were told we were approved for. We asked how this could be fixed and they told us that we would have to start all over again and wait another 6 months before we could close again. Since the interest rates were rising we chose to close although it was not for the amount we requested and were told we were approved for. We are asking assistance for this if possible. We feel that we were not treated correctly. Please advise.

I have made many phone calls, a registered letter and had an attorney write a letter but to date there has been no communication from Homestar Financial Corporation to me. This company has a really bad habit of treating the clients like XXXX if they dont approve for more than XXXX. I approve for XXXX. when I went Binding on my contract on XXXX XXXX, I was told to reach out to another lender because XXXX XXXX was on vacation. They reached out to me two weeks later then they started the appraisal with FHA to tie up my contract. we had to submit a document requesting for his company to release my case number with FHA. They back dated documents and entered The documents to the FHA website under false pretenses that they were my lender when they know they were not responding to any messages of mine until two weeks later by then I already went with a different lender. I did a VA construction loan. The mortgage company allowed the contractor to overdraw the loan. The bank allowed the contractor to exceed the contract time line to complete the home without my permission. The Bank sent me all draw request the last XXXX the contractor did not complete the work and I did not sign the mortgage company still dispersed funds. The contractor abandoned the job. The mortgage company allowed for my to apply for the refinance to complete the home with a new contractor. The mortgage company agreed to finance the completion of the home. When the home was completed they refused to pay the contractor the agreed amount and said they would only agree to a 90 day loan. I was force to return to the original loan and pay the contractor the remaining funds which depleted my saving and maxed out my credit cards. Then the mortgage company stated that the i would need an additional XXXX for taxes even though the taxes were escrowed at closing.

On XX/XX/2021 my lender, Homestar, paid three parcels from my escrow to XXXX county Taxes. I'm only supposed to pay for parcel number # XXXX XXXX and # XXXX XXXX. However, they also paid XXXX XXXX. Also, my property taxes weren't due until XX/XX/2021 but they said they paid in bulk to my county. However, my county never received payments for my property taxes as of XX/XX/2021 and could not cancel the taxes my lender paid from my escrow causing it to be short. I asked them if they could wait to do the escrow analysis until the payment was rejected by XXXX county tax office and they said they could not guarantee that and it was up to me to get the payment cancelled. How can I cancel a payment that was never sent? They also stated that because I was on forbearance I could not pay my escrow shortage until I was caught up on my payments even if I went on payment plans. This was not explained to me when I signed up for the forbearance program.

My wife and I filed a joint application with Homestar Financial Corporation for a USDA Single Family Home Rural Development mortgage/loan. We have been ignored/mislead/lied to regarding the acceptance or denial of the loan by the USDA underwriters, among many, many other faults. Our loan officer told us that the USDA denied the loan, but after contacting the USDA directly, they informed us that they had in fact not denied the loan. They told us we need to contact Homestar directly. We have contacted the local Branch Manager, the Division Manager, and the corporate office 's Compliance Division. Corporate has told us repeatedly that the Division Manager will be contacting us, but he will not return phone calls or emails. A week after the loan officer lied about what the USDA said, we still have no answer as to what the true status of our home loan is. I have a word document that details the entire experience and our attempts to find answers.

I 'm a XXXX in the XXXX, XXXX, Georgia market. I interact with a large number of real estate agents and their companies. I 'm facing unscrupulous and illegal competition in this market by Home Star Mortgage Corporation. Home Star 's entire marketing strategy is based on illegal referrals thru their contracts with realtors on XXXX and in paying rents to brokers which are n't based on market rents and are inflated to illegally benefit the broker. In particular, their rental arrangement with XXXX in XXXX Ga. and in XXXX Ga. should be looked into. Homestar 's system of reimbursing the realtors or in paying XXXX bills directly for the realtor in exchange for referrals is an illegal kick back and pay to play system that has greatly affected our market, and allowed HomeStar to manipulate the market to their advantage, while reputable lenders such as myself who will not violate the rules are left to compete against an unfair business practice.

Back in XXXX of 2020 i spoke to my mortgage company about what i could do to decreased my payments because due to miscalculations on the escrow my payments went up by around XXXX $ I was given the option for a modification. I was told by several different people from the Homestar company that this would not affect my credit and yet it has been being reported that i have not made any payments My credit score has dropped from a XXXX to a XXXX. I was placed on the COVID-19 forbearance program for 12 months on XX/XX/XXXX. When I called in today on XX/XX/XXXX to extend it until XX/XX/XXXX I was told I could not extend it. Thy verified that the program was 12 months and repeatedly confirmed the start date but said that they could only keep me on the program until XX/XX/XXXX. I am currently in the process of acquiring a second job and would have been able to pay the balance by XXXX of XXXX, but now that they will not extend it and I only have 2 weeks to apply and get on another forbearance, the mortgage company has caused me undue hardships that will affect my credit score. Homestar Financial Services reported my mortgage as 120 days late even though I was working on a mortgage modification with them and they transferred my mortgage before the modification was complete. The company negligently transferred my mortgage to another lender without finishing the mortgage modification process, violated the law by reporting my mortgage as late AFTER transferring my mortgage less than 60 days ago, and refuses to fix the situation because 'they don't have my mortgage anymore '.
