On XX/XX/XXXX, myself and my husband XXXX XXXX were given a prequalification letter from Homespire Mortgage specifically for a USDA Loan. At this time, Homespire Mortgage was made fully aware that I did not have 12 months of steady employment history. I had worked for XXXX from XX/XX/XXXX until XX/XX/XXXX, then I resided for 4 months for my husband to be in XXXX XXXX, and then I was rehired on XX/XX/XXXX and am still currently employed. In XXXX, that would have been 8 months of steady employment history for myself. Knowing this fact, my family was still given a prequalification letter and the green light to move forward with the home buying process for a USDA loan. We then spent over 2 months paying for due diligence and earnest money, inspections, etc. to a total of almost {$3000.00}. We also spent more than normal time gathering documents, sending emails/faxes, etc as soon as Homespire Mortgage requested it. Homespire Mortgage took their time and most definitely pushed this loan out as long as they possibly could ( and now I see why ). At one point, XXXX XXXX ( loan officer assistant with 10 years of USDA underwriting experience ) refused to respond to my emails, text messages, and phone calls as a consumer who had questions about the loan. At that point, I had to get my real estate agent XXXX XXXX involved in order to ask questions. I had to ask my agent, who then had to ask XXXX, then my agent would bring the answer back to me, since she refused to speak to me regarding my loan. On Friday, XX/XX/XXXX, it was assumed that we did not get approved for the USDA loan. At this point, Homespire Mortgage 's underwriting had approved it, and it was also approved by XXXX. Apparently when it landed in front of USDA, USDA reminded Homespire Mortgage that they have a " 12 month employment history '' guideline and always have. Therefore, on that one basis, they denied our entire loan. If this was the guideline, then back in XXXX when we started this process, we would have never met the qualifications. At this point, I begged XXXX XXXX ( our loan officer ) to start on a plan B. Our contract had to be extended, which XXXX agreed to do. Our new closing date had to be by XX/XX/XXXX. XXXX informed me of the XXXX program that same Friday, and tried to push a conventional loan through knowing we did not want or have the money to provide any sort of down payment ( this is why we wanted USDA-100 % financing ). As the days went by, we had no answer as to if these loans would go through or not. As I continued to text, email, call and so did my real estate agent, XXXX began ignoring and refusing to answer us. Finally on Tuesday XXXX, XX/XX/XXXX I informed XXXX if he did not give us an answer or an update that we were done with this process. We had already lost thousands of dollars, our home we were renting had been packed in boxes for weeks with no access to normal everyday items, we have had to give our notice and break our rental lease, lost this home we thought we were moving to, etc. On Wednesday, XX/XX/XXXX XXXX sent myself and my husband a text message saying that the down payment would be too high and it wouldn't be approved anyway. He then offered to run our credit yet again ( ARE YOU SERIOUS ), for what reason, I don't know. He again mentioned USDA would be our best bet, and good luck, to try again once my employment reached 12 months. That's where it ended. No empathy, no I'm sorry, nothing. I requested for my money to be refunded at the very least, and informed them I would be contacting an attorney. Of course, no response to that. I have contacted an attorney and have my consultation with him on Tuesday, XX/XX/XXXX. At the very minimum, we feel like we were extremely taken advantage of, we have lost all of this time, put in so much effort beyond a normal loan closing process, we were honest in truthful the entire time and had proof to show it. I am hurt and depressed that we were fooled and taken for granted, only in hopes that someone might be able to " slide this one under the rug ''. I can't believe this is allowed to happen to innocent people, when Homespire Mortgage 's job is to know the loan and it's guidelines inside and out. Someone just wanted their commission, and how they've impacted our lives forever doesn't matter.

In XX/XX/2020 I submitted an application to refinance my house located in XXXX XXXX XXXX, XXXX, XXXX to XXXX XXXX Homespire Mortgage Personal Loan Consultant | NMLS # XXXX She ask me to send all support documents including tax returns, bank statement, financial statements..etc, which I sent immediately. XXXX reach out to me, she inform me that my application is pre approved for interest rate of % 2.25 For 15 year fixed. She told me the underwriter will reach to me for a final closing day. No one reach to me, I kept reaching to XXXX in weekly basis and she kept telling me that underwriter is backed up and wont give me a closing date. In XX/XX/2020 I reach to her again and told her that I need to close before the end of XXXX before the increase of the interest rate for refinance applied in XXXX. She assured me that my rate is locked and honored and that increase wont apply on my refinance. I Kept reaching out to her in a weekly basis and she kept telling me that the underwriter almost getting to my application. On XX/XX/2020 I reach to her to check the status and that what was her response : Im sorry I couldnt answer just now Im on the other line.The underwriter just got back to us late last night but has suspended the loan due to a debt to income issue with the file. Also during the application process she tried to push me to sign application with false info and I refused to do so and kept pressuring me to sign that loan application with false info and I told her this is fraud and I wont sign this application until all this info are corrected.

My family closed on our home XX/XX/XXXX. We were not required to make a payment until XX/XX/XXXX. We were informed that our loan would be transferred to a new loan servicing company, which happens to be a company by the name of XXXX XXXX, but the dates as to when were still unclear. We were told we would receive a notice with the new loan information. It had came time to make XXXX payment and we still had not received notice from the new loan servicing company, XXXX. I contacted my original loan officer XXXX XXXX with Homespire Mortgage and was informed that any payments due before receiving notice from the new loan servicing company was to be paid to Homespire Mortgage using their online payment portal. The payment for XX/XX/XXXX was paid to Homesprire Mortgage on XX/XX/XXXX I have bank statements as well as conformation that the payment had processed. I was informed by XXXX XXXX that the payment would be transferred once the new servicing company, XXXX XXXX was in place. It is now XX/XX/XXXX and my payment for XXXX still has not been transferred to XXXX XXXX. I have made countless attempts to reach XXXX XXXX regarding this issue. I have provided her with MR.COOPER companies information as well as the loan numbers for the new servicing company so that the payment can be transferred and she has failed to do so. She has failed to respond to any emails or phone calls. I have provided XXXX XXXX with proof that the payment was made, I am continuing to get calls from XXXX XXXX requesting payment for the payment that has already been made.

In XX/XX/XXXX, I started working with Homespire Mortgage Company to qualify for a mortgage. I never received an adverse action letter but my credit was not extended to me and I followed all the instructions up until XX/XX/XXXX when I was told I needed to get rid of my car in order to qualify. My inalienable rights has a natural person was violated and my consumer rights by denying me for exercising my rights. There are no laws stating that credit reporting agencies determine credit approvals, and the credit reporting agencies are violating my privacy. In fact, XXXX does not back credit reporting agencies. Homespire had me submit an application which is the security collateral that they submitted to the federal reserve for benefits but I received nothing as a natural person. Additionally, Homespire has discriminated and discouraged me which is a violation of XXXX.

I was preapproved for a mortgage earlier this year, i was conditionally approved but right before closing ( after I made payments for inspection and deposit to XXXX realtor ) they said I was denied because I was furloughed but I was never furloughed I continued to work during the pandemic as an essential worker. My hours were cut a little bit because of the pandemic but I was still working 50 hours per week and had substantial recurring income for a successful closing. I feel as if I was discriminated against because of the effect the the pandemic had on my finances even tho I still was making well enough income for the low mortgage and I had funds to close. Their actions have resulted in emotional distress for me and my family who have been looking forward to closing.
