I am here to file a formal complaint against the lender Homeowner Financial group USA NMLS # XXXX representing by XXXX XXXX and XXXX XXXX. While applying for a second mortgage I had encountered many difficulties after switching from XXXX XXXX to Homeowners Financial group as suggested by my real state agent XXXX XXXX XXXX due to time frame with the builder. In the begging of XXXX while in the process of obtaining financial approval and before the closing was announced but the builder to avoid any default with the builder and lose the EMD, I requested to XXXX XXXX XXXX and XXXX. XXXX XXXX ( the lender ) to obtain a final answer either I could obtain a second mortgage or not, because the conditions for the loan were almost impossible for me to fulfill so I raised the concern, but instead the lender and Real state agent keep on pushing me to continue with the loan application and I was threat with the deposit that I had already paid. At the time I started the application I was asked for proof of employment, bank statements from USA and XXXX, and my employer verified all information and I was able to proof the sources to pay the down payment. After all was verified I qualify for the loan in matter of few days. My credit score is over XXXX at the moment and I only have two credits in USA which are my vehicle and my current mortgage for the past 12 years. Some of the initial conditions for the approval were to settle my car loan and have my mother to send the wire transfers to the title company from one of her banks outside USA, to which I declined because we could not complied, then the lender wave the car prepayment because my credit score and also the lender request the wires to be send still from my mothers account but from an USA account accordingly to XXXX XXXX and XXXX because I live abroad and it was going to facilite the process. Once the loan was approved I didnt receive an official notification, all communications were either via SMS or whats-up messages sent by my realtor on the behalf of the lender. After insisting for an official confirmation of the approval a communication was released with two conditions to get the COC, the first condition it was to have the wire transfers to the title company sent from my mothers account in USA as a gift, this again accordingly to the lender because I work abroad and it wouldve easier to use an account in USA other than my own in XXXX and other transactions that under XXXX XXXX law it was going to take long time to for the bank to understand, but that I had already also clearify to XXXX XXXX while I was with them. I did clarify my mother was giving me {$10000.00} as a gift and the rest of the money was sourced from my savings and my mothers and I are listed on our accounts us as mutual beneficiaries, The second condition it was to submit a proof of wires sent and then we could proceed to close. The agent XXXX at one time offered his fathers account to be used to wire the money to the title company but I was skeptical Because It was a large amount of money to send to a stranger, so I we continued sending the wires from my mothers bank account in USA. The wire transfers took one month to be completed due to bank limits but the lender and the builder agreed to wait. At one time after the loan was approved, the lender informed that the 5 % of down payment that I had paid back in XX/XX/XXXX and XX/XX/XXXX, could not be taking into consideration for the closing and I had to pay again but the EMD was going to be refund back to me at closing and the builder did confirm it. This situation woke up a bad feeling on me about this whole deal for which and I contacted the realtor that I used in the past for my first mortgage to serve as mediator with the lender, and even she questioned the reason of being asked to wire all the money before I had the COC but the lender and my relator were convincing enough and certain that this was just the last condition before closing. The wires were completed as requested from the lender and the realtor. Once the wire transfers were completed I received a text message from the lender congratulating me on completing all conditions and saying that we are ready to close but again I had last two conditions, now those were 1. Submit my current lease in XXXX and proof of how I pay for rent abroad and 2. Proof that I have over {$9000.00} on any of my bank accounts either in USA or XXXX XXXX for contingencies, but Mr. XXXX insisted that I should only submitting the bank statements from XXXX XXXX. I was able within two hours to comply with these two, the current lease in XXXX XXXX and prove that my employer is giving me an allowance which cover 100 % of it and I just pay for utilities all inclusive in the annual lease, I was also able to proof that I have over {$40000.00} in reserve for any contingencies and also above {$5000.00} in USA. After the lender received the lease, XXXX XXXX started arguing that I had adquiere new debt because I moved to a new apartment in XXXX XXXX increasing then my capacity compare to the previous year, which is not truth, I challenged the lender to then reproduce a copy of lease for year XXXX proving what he was arguing and the lender didnt reply because he had no ground for his argument, beside since I applied my pay stubs and verification of employment clearly showed that I am entitled to an annual house allowance of XXXX 160,000 ( {$46000.00} USD ) and from day one the lender was able to verify it and never questioned it. At the time the lender started rising this question I was still in XXXX XXXX it was XX/XX/XXXX and I had all my tickets purchased, hotel reservations and furnitures shipped to the new home because the closing was happening on XX/XX/XXXX in USA. All transfers were done by XX/XX/XXXX and I had appointments at the embassy of USA in XXXX XXXX to close there, XX/XX/XXXX, XX/XX/XXXX and XXXX but the lender keep insisting I should travel instead to USA and sign in person when at the begging for we all agreed to close at the embassy because the nature of my job ( XXXX XXXX ) doesnt give me the flexibility to travel home ( USA ) at my own time. With all these new complications and still in XXXX I was insisting hard to obtain a clear answer before I travel to USA, either the closing was happening or not, I was qualified or not because everything them seem so obscure, but XXXX XXXXXXXX and XXXX XXXX requested me to travel to USA and to be available for closing on the XXXX of XXXX, even the builder was informed and ready. I had to take a long detour to USA due to last minute flight changes, I flew via XXXX with three nights in between, two long flights and even XXXX XXXX XXXX XXXX increasing the cost of my travel even more but I did arrive on the XXXX of XXXX. Once in XXXX on XX/XX/XXXX and with no confirmation or email from the lender about the closing the agent sent me a message saying we are ready to close but later during the week and that he had to travel to XXXX and I was on the lenders hand alone. On XX/XX/XXXX, XXXX XXXX contacted me over the phone asking me questions he shouldve ask three months ago, and again I replied that I needed an answer right away because I already travel to USA following all his instructions and I shipped furnitures form XXXX with expenses over {$40000.00} for the new house and now I was seating in a hotel for two weeks waiting for his daily and non sense changes. On the XXXX of XXXX late afternoon I received a notice of action denying the loan with no much information and no credit agency reference, and since then I ever hear from the lender but still and through my realtor he argues things he cant prove. Now XX/XX/XXXX I am traveling back to XXXX for my work commitments and the builder represented by XXXX XXXXXXXX XXXX had giving me a green light to find another lender, but for the one she recommended I cant qualify because the amount of down payment required, and I was on my way to find a third option advised by the Realtor XXXX XXXX whom I can trust at this stage because I can feel XXXX XXXXXXXX is supporting the lender 100 % and not me and XXXX XXXX is helping me free of change just so I can reach this goal, but the Sales manager of XXXX XXXX on XX/XX/XXXX late night advised me not To USE ANY other lender than Homeowners, but at this stage I had already being notify of the denial and the filed is closed and I could never clearly understand all their conditions because as soon as I clear one another one arises and so so without an end. At this stage the builder if XXXX XXXXXXXX XXXX is acting on their behalf had closed all doors to me to continue with the agreement and for this I demand also the refund of the EMD as I had exhaust all my possible, feasible and legal options proving my willingness to complete this purchase. Until now in the behalf of XXXX XXXXXXXX I am receiving HARASSING messages on XX/XX/XXXX now arguing that I was denied based on my International credit report so I am requesting prove of this document because even on the notice of action there is no detail of any credit agency, but I am still waiting for the lenders reply because he is RUYING my reputation in front of the builder and others involve in this aggrement. Also the lender keeps requesting through my Realtor additional down payment, pay off of my current debts???? Why this when the relationship ended on the loan denial so I am not sure why is XXXX XXXXXXXX still relaying messages to me. I feel harassed. I demand from The lender the compensation of all financial damages, which are 1. Deposit paid to XXXX, 2. the cost of shipping furnitures from XXXX , 3. The storage of the furnitures until I buy a suitable home to keep my furniture 3. the cost of hotels while my travel from XXXX XXXX XXXX USA with all the hotels in XXXX 3. airline tickets, train fares and rental cars. From the Builder I request the reimbursement of the EMD in the amount of $ 13,000and from the title company the refund of the {$30000.00} hold on their account under my name There are over 100 emails, text messages and voice recording messages that can be provided as evidence. Here I am attaching the last email from the builder when I was referring to a new lender as it is concise, clear and resumes my entire situation Also the email sent to the lender in XX/XX/XXXX requesting a final answer to avoid default with the lender and expressing my concern of being pressure to continue with the deal with all the conditions and still my fear and threat of losing the money paid st front.

My name is XXXX XXXX. My address is XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX Phone number is XXXX XXXX XXXX XXXX, I started to build a house with XXXX XXXX. They could not do my loan because my business was just recently opened, so they referred me to XXXX XXXX XXXX XXXX, address XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX. I got XXXX XXXX as my loan officer. In XXXX XXXX XXXX, once interest rate started going up, I decided to lock my rate, I put down ~ {$5400.00} as a deposit for lock rate extension. Fast forward, last month, XXXX XXXX started to collect my documents to get ready for the closing date on XXXX. He asked for 2 months bank statements, the last rental statement ( the house was rented out in XXXX ), and profit and loss statement from my business. He also gave me options for interest rate of 5.75 % ( which I was locked for ) and 6.5 %. At the time, I was already got approved from Home Owner Financial Group. 1 week after XXXX looked at all my documents, his concern was about my last rental payment of {$1900.00} ( it was {$3300.00} before ). He was worried about the high debt ratio that would affect my approval to the loan. On the other hand, he kept pushing me to pay for the appraisal. I got so confused, I wrote an email asking if my rental will affect my approval to the loan, and if he can send me decline letter. He called my next day and telling me that he will not give me the decline letter and I am approved regardless my high debt ratio. He was so rude and unprofessional, I told him I would not want to pay for the appraisal on a situation like this ; what if I would not get approved by the under writer and loosing my appraisal money. He told me to send in a new lease agreement which I do not have since I have no tenants at the moment. All he cares about is to move forward with my loan and put me to a situation where I can not get my deposit back and loosing my appraisal. On the other hand, he never sent the loan estimate which I kept asking for 3 times ( XXXX time via email, 2 times via phone calls ) He only provided emails in which some of fees included. This is totally against the law, not to mention about giving approval without taking a look at my file after knowing my tenants broke rental contracts. This is totally a FRAUD and SCAM. Please assist with this situation. I want my deposit of lock rate extension back. They are desperate of making money but not putting heart and professionalism into their work. XXXX even yelled at me in the phone. SO UNPROFESSIONAL, RUDE, AND LACK OF KNOWLEDGE. Never recommend them to anyone.

I am a closing attorney and closed on a VA loan with XXXX XXXX with Homeowners Financial. XXXX repeatedly directed me to share information with a non attorney in fact, non-borrower, and non-purchaser of this loan. XXXX was unprofessional and unethical, claiming that her company approved an unexecuted power of attorney for use. When I refused to comply with XXXX and her teams unethical and possibly fraudulent requests, she and her staff verbally threatened to " pull '' the closing from me and for the borrower to switch title companies. XXXX and her team has me email closing documents for electronic signature to an email address that did not belong to the borrower or the purchaser on the contract. The realtor charged a VA borrower a broker transaction fee and the lender allowed this charge to remain. The borrower received a refund at closing and XXXX directed me to mail the check to an address where the borrower was not located so that his spouse could endorse the check and deposit it. I do not think that XXXX XXXX and her team follows any rules or regulations. We closed on XX/XX/2023 and I am located in Florida. When the check did not arrive in North Carolina, the borrower and purchaser is currently station in California, XXXX and her team accused myself of stealing the borrower 's funds. Yesterday I personally spoke to the borrower and he apologized for XXXX 's behavior as he had no clue that this was happening " on his behalf ''. XXXX and her team works for Homeowners XXXX and her NMLS # is XXXX. I believe that XXXX 's actions during this closing is a pattern of having non attorney in facts sign closing documents and receive loan information that they should not be privy to. Thank you.

On XX/XX/2022, I applied for an extension of credit with HOMEOWNERS FINANCIAL and a few days later I received an adverse action letter stating that I was denied. I called the company on today of XX/XX/2022 asking what laws and procedures were used to come to this determination and I was told they had a the right to deny me of my credit and that it is company policy. I want to be provided with the exact subsections that was used so I can study this for myself. I am requesting to be provided what laws I have to abide by the credit score and that this private transaction needs to be reported. The account is negatively affecting my credit score on my XXXX account The CFPB states that credit reporting is optional. Company procedures do not supersede federal law and this is a direct violation of my rights as a consumer. 15 USC 1602F states that credit is my right and I can not be denied a right. 15USC 1602P makes it clear that you used my credit card without authority and I received no benefit. This is clearly discrimination as usc 1691 ( a ) ( 3 ) makes it clear that I can not be discriminated against. I am holding you all liable now as you are acting as an authorized representative. I am willing to terminate further actions if your company does the right thing and reverse this decision. Thank you.

I purchased a home from Home OwNers Financial of America in XX/XX/2022 and then refinanced it as the rates were still low and I was saving over $ XXXX monthly. Shortly after the refinance was completed, I was supposed to receive my escrow balance and overpayment of the payoff amount. It has been more than 2 months since I have received anything. They intentionally keep delaying sending our check with various excuses made. At first, they said a check will be sent out on XX/XX/2022. It never sent out. Then an email came that a check was being sent out on XX/XX/2022. It has still not arrived. This is highly unprofessional. I reached out to XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX to request a Loan Estimate on a mortgage and provided him with : Name Income, SSN, Desired Loan, and Property ( New Construction ) He ran a Hard Pull on my credit then attempted to manipulate me into locking into his company without providing a Loan Estimate. He claimed that I am required to provide him a signed contract before he can provide a Loan Estimate, which is illegal. Do not work with anyone at Homeowners Financial Group as this could impact my ability to qualify for a mortgage as a well qualified buyer and impact my score thus costing me tens of thousands of dollars ( or more ) in interest over the course of my loan.

Hi, I called a loan mortgage ONLY to check if I will be applicable to get a pre approve if I moved from XXXX to XXXX to buy a house without run my credit now because I will not move anyway now to the new state, he confirmed to me that he will not run my credit and he will only check the possibility of how much I may get as pre approve then he asked me to submit the application with all my details so he can check all my income and expenses ONLY. Our loan officer said he works for us but instead of talking with us he made decisions with the builder and then strong armed us into having to deal with it. They tried to pin us against our realtor and talked bad about them didnt stick to the information we gave when we decided to go with them in XXXX of 2023 and also were very unprofessional and did what was best for the builder. I would not let them use the VA home loan as they were not falling in the guide lines of the VA home loan terms. Very shady.
