I started my home loan refinance with HMAC on XX/XX/XXXX. I started the application with XXXX XXXX. She took the loan application and negotiated the loan with me. I provided all information for the application including the information of an open HELOC but no money are owed on the HELOC. She assured me that this will not be a problem to close the refinance. After XXXX XXXX negotiated the loan with me ( couple weeks after the application ) I was introduced to a new loan officer, XXXX XXXX. I thought this was strange since I already was under the impression that XXXX XXXX was my loan officer. That was the time when I checked XXXX XXXX XXXX NMLS and she does not have a current or approved license with NMLS to negotiate loans. I have emails and text documentation. Couple weeks later, XXXX XXXX emailed me that I do not qualify for a 20 years loan anymore and I should go to a 30 years loan. She communicated the terms with me over the email and texts ( I have complete communication ) and we agreed to move forward to a 30 years loan. XXXX XXXX mentioned that I need to pay off some of my credit cards payments and had questions regarding car loans. Everything was completed and paid immediately and provided the backup. The times of the loan end up to XX/XX/XXXX. This went on and on until XX/XX/XXXX. I received an email from XXXX XXXX sending the Closing Disclosure. We received the CD, very happy! We are closing!!! but something else happened. On XX/XX/XXXX ( 4 months later after I started my application with XXXX XXXX ), XXXX XXXX mentioned that my Debt to Ratio is too High. This was supposed to be handled at the beginning of the loan but due to the loan officer negligence, nothing was completed. XXXX XXXX mentioned that in order for the refinance home loan to close ; I would need to either close the HELOC or show more income. XXXX XXXX advised me to close the HELOC in order to qualify for the refinance of the loan and after we close, to reopen a new HELOC. Wasn't this supposed to handled by my loan officer? I was very confused at this point ; XXXX XXXX is not a licensed mortgage loan officer but she negotiated my loan with me. I only spoke on the phone with XXXX XXXX once, once when XXXX XXXX connected us both and we talked for 2 minutes. All communication was from XXXX XXXX and XXXX XXXX was just copied to the email. I decided to add my wife 's income in order to lower our Debt to Ratio and close the refinance loan. On XX/XX/XXXX, I provided my wife 's income from XXXX, again to XXXX XXXX. The following day, XX/XX/XXXX, I checked with XXXX XXXX if the documents were received and I quote " We have entered the information and sent to underwriter. On XX/XX/XXXX, my wife and I receive an email from XXXX XXXXXXXX at XXXX with the Loan Disclosures. In the same evening, all documents were sent back with completed signatures. We have not heard anything until the morning of XX/XX/XXXX, when my wife called the corporate office. My wife called the office and inquired about our loan, we find out there is no loan open on our name. The Loan Processor emailed her requesting for additional documents, like ( copy of DL and SS ) in order for the loan to go at underwriting. What do you mean by send to underwriter???? XXXX XXXX mentioned on XX/XX/XXXX that all documents were received and information was sent to underwriter. Due to a very unethical professionalism and miss communication of my unlicensed mortgage loan officer XXXX XXXX, I had to pull my refinance loan application from HMAC ( after a 5 months process ). I was not able to trust my loan officer since I only communicated with XXXX XXXX and she was misleading my wife and I on the process of the loan. She was very unprofessional and hope for no other family to go through this.

I came to XXXX after being denied the week of my closing date by another mortgage company at the advice of my realtor. At first they were very helpful and insisted that they would be able to help me. My application was in XXXX when rates were higher than they are now. My other lender locked me in at 4.375 %, XXXX because I was desperate gave me the same rate early XXXX but left the rate floating. I was changing jobs so they told me the underwriter could not make a decision on my loan until I got a paystub from my current employer, I asked several time in the course of the loan was this the only outstanding item, they assured me yes. I later find out that they had issues with my credit score, and were not planning to make the loan but didnt tell me until the day of my closing. They sent a representative that doesnt work for them to tell me we would not get the loan due to a credit score drop in XXXX. Well here we are and XXXX and instead of notifying me when it happened he kept it to himself. I told him that whatever issue that was on my credit in XXXX was removed and I had documentation to prove it. Had he told me when the credit was pulled, this could have been resolved then. He then resolved the credit issue in mins, redisclosed the loan to me at the same high rate even though rates have gone down, charged a 1 % origination and 1 % points fee and the issued me a closing disclosure. Closing disclosure stated that we could close on Monday. Because I was desperate and wanted the house I obliged. That same weekend my loan officer went on vacation, never notifying me and left my loan file to be handled by someone who hasnt seen my file. Needless to say we didnt close on Monday as the closing disclosure stated, on Monday it was still being reviewed by an underwriter. The back up loan officer then tells me that their system noted a possible foreclosure on a property Ive owned for over 10 years and have never missed a payment on. It was totally bogus, with no evidence at all. So I missed the closing date again. This is now the 3rd closing Ive missed. I wrote a letter stating how ludicrous these allegations were and how unprofessional this company has acted. And no apology from them at all, they just sent an approval over of my files. I have been embarrassed, my privacy violated, and taken advantage of by giving me such a high rate and expensive terms. This whole process has been unfair and abusive lending practices.

I had worked with XXXX and XXXX XXXX trying to refinance my loan. Everything was great and they worked hard to earn my business over my current mortgage company which was trying to have me refinance with them. All was great until the loan did not close on time.. which was going to cost me an additional XXXX in interest. Premier Option Mortgage was no longer able to follow through on their promises and I backed out of the refinance as it no longer made financial sense for me. They blamed me for delaying the closing although there was ample time and I was never forewarned that the closing would not occur on time as promised. After I backed out of the loan, they got very nasty!!! They will still not give my current loan company the FHA number so they can proceed with the refinance after multiple calls to them. Other false promises that the company made include they stated that they would reimburse my appraisal fee regardless of whether they were able to proceed with the refinance or not as they were confident they would earn my business. After the deal fell through, they are stating that they never stated that and will not reimburse for the appraisal as they had previously promised. Also, before I pulled out of the deal, XXXX had promised that he would pay {$500.00} towards the first payment and later told me he never said that. Luckily that was in writing and then he pretended he did not remember. I have XXXX concerns ... they will not reimburse the appraisal as promised and more importantly, they will not provide the FHA loan number so that I may finalize my refinance. They make false promises to get people in the door. I wish I had recorded my phone conferences.

We were supposed to close on the loan attached three days ago and have heard no update or no end in sight leaving the buyer and seller homeless living out of hotels with their children.
