To whom it may concern, I am filing this complaint regarding a tentative future home purchase, and a loan approval with option to rate lock interest at no cost for VA loans. This complaint is based on the actions of XXXX American Homes ( XXXX ), and its affiliate loan company , Home American Mortgage Corporation ( HAMC ). The XXXX had a " single point of failure '' ( non-availability of authorized personnel to conduct transactions ) which resulted in the buyer ultimately missing out on the opportunity to take advantage of the Interest Rate Lock Program ( IRLP ), and locking in base price of home. This IRLP program was unexpectedly cancelled when communication was re-established resulting in a huge interest rate increase and ultimately a tremendous spike in the monthly payment for the buyer. In addition, the buyer was exposed to 'bait and switch ' tactics to include erroneous property listing information, price fluctuations, failure to fully disclose and causing unnecessary delays, disparate practices ( Veterans vs non-Veterans ) and misleading buyers by exacerbating price spikes ( i.e., alleging if buyer attains a realtor a price increase to home would be imposed, or not acting ( now ) would result in price spikes although seller delayed responding to buyer ). The following provides a synopsis of a few events from the most recent encounter ( not limited to ) and also, attached a couple of emails to depict the dialogue with XXXX and HAMC. After entering into a purchasing agreement on XXXX XX/XX/XXXX, attaining VA loan approval on XXXX XX/XX/XXXX, and IRLP disclosure on XXXX XX/XX/XXXX- I immediately started to request for interest rate lock information starting on XXXX XX/XX/XXXX after reviewing loan approval documents. The Loan Officer provided fragments of information ( intermittently ), however, never adequate enough to make an informed decision ( regarding program specifics ). I reached out to the XXXX HAMC Loan Officer on XXXX XX/XX/XXXX, to remind her I had not received a response to my email, as my intent was to participate in the IRLP. Despite repeated attempts to attain full clarity, contact made via phone and email, I finally attained full disclosure that was understood on XXXX XX/XX/XXXX ( email from Loan Officer listed below ). It took nearly six ( 6 ) days for a response which could had been quickly resolved by returning of a phone call or picking up the phone to advise the buyer. Exactly one day following the response, on XXXX XX/XX/XXXX, I was advised the program was terminated with no advanced notice. The XXXX HAMC Loan Officer stated very specifically, I wanted to let you know we received word yesterday that the extended rate lock program is no longer being offered, effective immediately. Nevertheless, XXXX and affiliate HAMC reestablished the Interest Rate Lock Program, on XXXX XX/XX/XXXX, with extra benefits for buyers attaining non-VA loans and kept the no cost to buyers attaining VA loans. However, the sudden interruption of the Interest Rate Lock Program ( IRLP ) penalized the Veteran or buyers with VA loans because during such timeframe the interest rate increased significantly. Fortunately, now buyers with approved non-VA loans can also benefit by now having a XX/XX/XXXX split of the cost to participate in the program, by contrast the Veterans who already received a VA loan approval prior to terminating the program, are now expected to purchase points to retain the previous prevailing interest rate ( that was originally at no charge ). The action of XXXXAH and its affiliate HAMC, appeared to be very deceitful, disingenuous and discriminatory ( disparate ). I was further led to believe these tactics were very deliberate with intent to cause harm to Veterans based on assertions made by the XXXXAH Sales Representative XXXX XXXX ) on approximately XXXX XX/XX/XXXX, while visiting the XXXXAH Sales Office at XXXX to finalize discrepancies made by the assigned Sales Representative. I was informed by the Sales Agent ( XXXX ) during my visit that I would not be able to participate in the program because it would cost the builder. This assertion directly aligned to the Loan Officers email on XXXX XX/XX/XXXX ( extracted below ), however, the way it was conveyed it was in a displeasing and disapproving tone. After leaving the sales office, I conducted additional research and located the language on the XXXXAH website, which clarified the rate lock program existed and for VA loans there was not a cost associated to participate. Therefore, if the interest rate dropped the builder ( not buyer ) would pay to float down the interest rate at the prevailing rate originally offered to the Veteran. This was contradictory to what was expected for non-VA loans ( apparently there was a cost involved to participate in the program until XXXXAH/ HAMC instituted a strategic pause and reinstated with new incentives for the non-VA loan buyer ). On XXXX XX/XX/XXXX, I was offered to participate in the reinvigorated program after it was relaunched but to my surprise with higher interest ( 5.37 % ) and option to buy down points to keep the original 3.5 % rate offered ( the Veterans/ VA loans were not godfathered to retain original benefits/ incentives ). Not only does it appear XXXXAH and HAMC partnered to intentionally cancel the program to avoid having to pay out of pocket to retain the lower interest rate for VA loans, it also appeared it was adversely and unfairly targeted at Veterans. As mentioned, when the program was reestablished about a month later the same VA loans that were already approved prior to the immediate no notice termination of the IRLP continued to still be at no cost but now there are inherent cost to buy-down interest points ( to rates that were previously available to the Veteran ). Prior to terminating the IRLP, non-VA loans were subject to charges and upon reestablishment of the program it was reinstated to a XX/XX/XXXX split among XXXXAH/ HAMC and the non-VA loan buyer. So, what was the reason and intent behind terminating the program? To hurt ( defraud ) or to help buyers who are not entitled to VA loans vs those who are entitled. If the answer was to help both demographics ; the program should had continued for those that it benefited ( Veterans ) and paused to integrate additional benefits to aide non-VA loan buyers. Essentially it caused harm to one group with no explanation and leveraged the other. IN this case it caused an adverse impact to me my mortgage is expected to go up nearly {$700.00} per month due to the termination of the program, and for failure of the XXXXAH and HAMC to disclose pertinent information in a timely manner to the consumer/ buyer to make an informed decision. In addition, the XXXXAH and HAMC ( as a corporation ) failed to notify the Veteran of the consequences which would have allowed greater participation, and been advantageous to both group of buyers ( i.e., no cost Veteran program and XX/XX/XXXX split for non-Veteran ). The aforementioned has been my experience with RAH since my encounter contradictions to original offering and lack of transparency. For example, during the purchase of the XXXX home originally listed as one price ( lower ) and after proceeding with the sales process, I suffered surprises with the sudden price spikes and provoked sales tactics ( i.e., if you dont act soon, my colleague will sale to someone waiting to buy or it will go up after they buy by $ XXXX or more ). I was advised last Friday, to this date, the same lot # XXXX has not sold ( after three months earlier receiving erroneous price information and assertions/ threats others will buy if I dont act now ). The rationale for the disparity appeared always linked to the buyer ( me in this case ), the information was wrong, the sales or design center rep is new, or there were glitches in the system. The constant the buyer me it was always to my detriment. Considering the race to buy a house across the United States, it appeared the sale tactics caused unnecessary chaos and provoked unnecessary competition and scare with assertions the price of the home will jump and after sealing a deal, the calls congratulating you because the buyers future home is allegedly already worth more based on other recent sales i.e., your home is now worth $ XXXX, $ XXXX, and $ XXXX more. However, when the XXXXAH reduced the base price, in my opinion, to lure other potential buyers no one called to say hey your future home just went down by $ XXXX ( before breaking ground, before attaining a permit to build, before attaining the site plan, etc. ) which is what I explained today to the VP of Sales based on the recent reduction of the XXXX. I sought to remedy my concerns via XXXXAH and HAMC, and requested : 1. Primary remedy : Honor the interest rate at the time of my contract and loan approval based on the Loan Officer not responding and causing me to forfeit the opportunity to participate in the rate lock program, at 3.5 %. The Senior Manager researched my complaint, and advised today everything I advised checked out and my story aligned with the HAMC Loan Officer ( who profusely apologized according to XXXX XXXX XXXX ). However, I would not receive the original interest rate offered under the rate lock program, but instead of 3.5 % RAH/ HAMC would concede and authorize 4.75 % ( floating down from the new offered interest rate of 5.37 % ). He further explained, although I have other problems in the process he stated he was shrugging his shoulders because it did not fall within his lane. I advised him the lanes became blurry because the VP of Sales indicated XXXXAH/ HAMC will not concede because several home buyers in similar situations are also complaining so basically jump in line. In addition, because HAMC is an affiliate of XXXXAH, for the buyer Sales vs Loan is integrated and unfortunately has a dual-impact to buyers. Therefore, I am not shrugging my shoulder. 2. Seeking for VP of Sales, XXXX XXXX XXXX, to fully honor reduction in price of hopefully future home based on all that occurred and attaining erroneous information. The delay tied to reconciling the error, resulted in the alternative home/ lot offered being offered at a higher rate while being denied by RAH to honor the listed price. The XXXXAH website now lists the XXXX at $ XXXX ( today ) and on Saturday at $ XXXX. I specifically asked the Sales Representative in the beginning of the process, what would happen if a significant reduction in cost prior to breaking ground, closing, etc ; and advised they would probably have to honor the sales price listed. Email sent on XXXX XX/XX/XXXX, from HAMC Loan Officer affiliate of XXXXAH : Hi, You would not receive any of the funds that the builder pays to participate in the long term lock. The upfront fee is a non-refundable fee paid to the mortgage company by the builder. So its the builder paying this cost on your behalf, not the lender. The builder will still pay the closing incentive indicated in your Purchase Agreement through the use of HMC. In effect, the builder is paying the agreed upon closing costs ( per the contract ) PLUS the upfront fee of participating in the long term lock. This is the case for VA loans only on all other loans types, the customer pays the non-refundable fee to participate in the long term lock program. My husband and I recently entered in a contract to build a home with XXXX XXXX XXXX in XXXX XXXX, AZ - Subdivision : XXXX XXXX XXXX XXXX. We signed the contracts in late XX/XX/XXXX with a projected closing date of XX/XX/XXXX. As we continued moving through the process, we agreed to use their in-house lender - Home American Mortgage Company. We are pre-qualified without a contingency to sell our previous primary residence, also in XXXX XXXX. However, we intended to sell once we were closer to the closing date. In late XX/XX/XXXX, we received a call asking us to move up our closing to XX/XX/XXXX. They didn't even have our house framed yet. We declined and they pushed for a later date and were advised to prepare for a XX/XX/XXXX closing. We immediately began to work with our buyers to accelerate the sale of our home during the holiday. Throughout the process we received financial disclosure statements estimating our mortgage, which included property taxes, homeowners, and P & I. As signed our final disclosures the week before closing, our escrows were estimated at {$710.00}, which I contacted the lender about being high. I was told it was an estimate and we have better numbers at closing. The afternoon we got to the closing table on XX/XX/XXXX both the title company and us struggled to understand a number of changes to their documents that didn't add up. The property tax estimated had skyrocketed to almost {$10000.00} per year for escrow changing the total monthly payment by over {$500.00}. The new amount was {$1000.00}. I immediately called our loan officer while the title company worked with those preparing the papers to make corrections and we were told they estimated our taxes based on a mil levy estimate received by XXXX County Treasurer 's office and this was their high figure. When they ran their numbers again, they couldn't determine who that number was derived as XXXX Conty calculates tax at .85 % of the assessed value, which would be approx {$450.00} per month in property taxes. I was advised that everyone had already left the office for the day ( on a Friday ) and they would work to resolve it on Monday. They aslo reminded us that we had signed a document correction agreement and we would not have to return to title company for them to resolve. Monday came and we were told that given we has signed and the loan would be sold so we would have to wait to be contacted by the new servicing company at completion to resolve the issue. This didn't make sense because they were still sending me documents that were not signed or incorrect so they could fix things found in their audit of the paperwork and I entered into a contract with HomeAmerican Mortgage. In the interim, I called the XXXX Country Treasurers Office and the Assessor 's office and neither could determine how the lender came up with their {$9700.00} tax estimate. I again asked it to be reviewed and was told they were sorry for giving us incorrect information, but it would have to resolved later after the loan is sold. How is this fair to the consumer and what does another lender have to do with this when my assumption is they can correct before supplying the loan information to whomever they sell it to. I entered an agreement with Home American Mortgage. All my paperwork and contracts reference them. I have text messages and email reflecting even after a 3rd audit their was a gross miscalculation, but their leadership was unable or unwilling to help. Today, I again spoke to the Assessor 's office and they provided the following info - 1 ) our home will only pay property taxes for land this year and next year. The valuation we receive in XX/XX/XXXX will still only be for land. We are estimated to pay and approximately XXXX $ for XX/XX/XXXX and no more than 5 % more next year. In XX/XX/XXXX, we will receive that actual valuation for our property at which point they can find multiple parcels in our subdivision who have actual property tax bills. They advise property taxes are calculated on lot size and livable space and since most of the homes that have their final tax bill are of similar size in land and livable space our property taxes in XX/XX/XXXX should be between {$4500.00} and {$4800.00}. The gentleman gave me his name and phone number in case someone wanted to speak to him because regardless of the calculation used there would be no way our property taxes would ever be anywhere near {$10000.00}. More like half that amount. Comparable parcels included XXXX, XXXX, XXXX. I have about 6 more that all reflect property taxes for my neighbors all printed out for comparison. Given the fact Home American still has my loan and I recently sent back documents to correct that benefit them, I am asking for them to re-evaluate my escrows and correct my loan before it is sold. I was told to make the XX/XX/XXXX payment to them and since they are still the servicing company this gross error should be corrected and we should not have to live with the error for a year and risk financial hardship over something that was communicated at the closing table as an error. We were rushed to the closing table with 2 hours notice and we bent over backwards to work with this company. When you have a family and XXXX children and are living in a temporary house, we would have moved mountains to be able to be in our forever home and we took their word they would make this right. My current escrow payment is {$1000.00}, which includes homeowners insurance and property tax. My homeowners insurance through XXXX is {$850.00} a year, not {$1300.00} as priced by XXXX and referenced in the docs. The declaration page and info was sent to Home American on XX/XX/XXXX. Our property taxes should be closer to {$4800.00} a year if they want to make sure they are collecting on the high side even though we only owe {$1600.00} for this year, which is already in the escrow account. We estimate our escrows to be approximately {$470.00} a month ( high and based on final tax bill, which again can only go up 5 % per year ) and even with a potential uplift to over overages, that would still be a {$500.00} savings on our current monthly escrow payment and overall monthly mortgage. I am asking for assistance for someone to help us get Home American Mortgage to do the right thing and correct this issue so we don't have to wait a year once the loan is sold to have a new company complete an escrow analysis. A 40-50 % overcharge on escrows is unacceptable and I would like to resolve this jointly before I engage an attorney for assistance.

Subject : XXXX XXXX of XXXX XXXX by XXXX XXXX XXXX XXXX XXXX , XXXX. in the city of XXXX, California We are seeking your help for the refund of an aggregate earnest deposits of {$13000.00} ( {$13000.00} for the lot and {$350.00} for design center ) we made to purchase a one-story SFR ( XXXX XXXX of XXXX XXXXXXXX by XXXX XXXX XXXX XXXX XXXX , XXXX., in the city of XXXX, California ). We entered into a purchased agreement on XX/XX/XXXX for a house intended for our future retirement in 4 years, and we had revisited the sales office and the construction site, ( currently in dirt ) several times, and found out that my husband had unusual coughing symptoms after every revisits ( FACTS : my husband had XXXX XXXX and was treated and recovered since XXXX. Furthermore, he had XXXX in XX/XX/XXXX. My husband is currently under long term care since XXXX, with medical XXXX, who advised my husband to undergo a XXXX XXXX and must rush to the emergency room when XXXX out XXXX at any time. In lieu of the potential risk of health of my husband mentioned above, we decided not to pursue with the subject property because of the possible XXXX, i.e., smell of dairy manure or unknown allergic sources from the environment in a close vicinity to existing dairy ranches. We did our best to notify the Sales Office as soon as we reached to the decision of cancellation. On XX/XX/XXXX, we went to the Sales Office ( they or them ) and explained to them of our health concerns and decision. We were told that they would try to work on refunding our earnest deposits back to us, before we left the office. Shortly after we left the Sales Office, they phoned us to return to the Sales Office to proceed immediately with the cancellation process, and had promised to work towards the refund of our earnest deposits, so they can release the subject home site in the market for sale. We proceeded without delay with the cancellation process at their request based on the reason of Life Event, with the intention that would help them to release the subject home site in the market for sale. However, we did not receive response from the Sales Office within a reasonable time, but a forwarded email message from the Director of Sales that Their deposit is not being refunded as the builder will retain it after our follow-up emails on XX/XX/XXXX ( attached with health test facts ) and XX/XX/XXXX. We are now filing a complaint of : 1 ) Predatory Practice. We had sent a health explanation email on XX/XX/XXXX ( attached with health test facts ), and my husband had scheduled a medical appointment on XX/XX/XXXX, XXXX.with the XXXX in order to request the health letter. The builder should not retain our earnest deposits, due to the following facts : a ) Loan approval process was just started, our loan requirement documents were sent to the lender on XX/XX/XXXX, b ) Without disclosing that they would forfeit our deposits and our rights to purchase the subject property, while at the same time releasing the subject home site back to the market for sale, c ) The subject property was still in a dirt lot and has not been started to build by the time of the cancellation. Besides, we have not gone to the design center to choose any options, so no upgrades nor any options were ever made. 2 ) Malpractice. During the course of the cancellation process, the Sales Office, on XX/XX/XXXX had advised us to write an email to their management but we were told not to mention the heavy smell of manure in the letter. 3 ) Discrimination. In response to our email dated XX/XX/XXXX, the Sales Office replied that their boss asked why we purchase the house if we have that kind of health issue. As consumer, we are offended by such unprofessional, unresponsive and discriminatory comments. 4 ) Nuisance. Since the cancellation process on XX/XX/XXXX, we continued to receive emails from : a ) the Lenders on XX/XX/XXXX and XXXX, XXXX, b ) XXXX XXXX XXXX on XX/XX/XXXX. We hereby urge them to cease any communication emails after a formal cancellation process. Your assistance to our request for the refund of an aggregate earnest deposits of {$13000.00} is deeply appreciated. I started a home building process with XXXX XXXX XXXX, who in turn, makes buyers use their lender in order to get closing cost incentives. Their lender, Home American Mortgage is owned by XXXX as well as insurance, title etc. The offered a $ XXXX incentive to use their lender so naturally why wouldn't we? We received their approval up-front and then were required to put more money down due to the upgrades we chose. Once the initial process was over, we never heard from the loan officer until closer to the end. We updated documentation, were told all was good with our loan and started packing up our apartment and getting ready for the move to happen in the next week. Our walk-thru was completed, the closing was scheduled, all was good. Until the next day! I received a phone call from Home American Mortgage saying the underwriter would NOT approve our loan!! Mind you, our home was under construction for about 10 months and the loan approval was done up-front then we hear this a few days before our closing was supposed to happen!! They obviously didn't look at our loan up-front or this determination would have been made at that time!! We were referred to their " local preferred lender '' who could most likely get the loan done. So we started over from scratch waiting for an up-front approval after letting her know why our loan was being denied by Home American. Panic set in as we were going to be homeless in just a few short days. We had a moving van parked in the driveway ready to be loaded, our landlord had already re-rented and the new renters could not delay their move-in so we had to be out. Luckily we had family we moved in with for what turned out to be 3 weeks before the new mortgage company could get the loan closed. Not only were we inconvenienced by this whole ordeal, the expenses from moving, rental truck, a new storage unit, paying movers to move twice were all adding up. A day or so later our own realtor called and said XXXX was NOT going to honor the $ XXXX closing cost since our loan was not closed with Home American Mortgage. Panic sets in again as we didn't know where we were going to come up with $ XXXX to cover the closing costs. I do have to say we did sign the contract that said the incentive would only be offered with Home American Mortgage. However, that's a VERY gray area in my opinion. They are protected by one sentence but they aren't held accountable for not doing their job in 10 MONTHS??!! Contractually yes we signed it. Ethically should they have honored it?? ABSOLUTELY!!! They didn't have a competent loan XXXX or company with a work flow that should have checks and balances in place to make sure this doesn't happen 4 DAYS BEFORE CLOSING?? The stress this put on our family, our finances, ( had to sell a vehicle to get the extra $ XXXX ) and with small children one car just isn't enough!!! We weren't able to get a loan on the car due to debt ratios so that was our only option. I would NEVER recommend anyone buy a home from XXXX, they were dishonest with upgrade issues that our realtor ended up covering out of her commission, they pulled our incentive when they couldn't do the loan and someone else could. The model home agent made a comment like : " Would you like your deposits back? This home has gone up almost $ XXXX in value since you started so we could re-sell it fast ''. REALLY??!!! This remark obviously comes from the top. They DO NOT CARE if they deny anyone at the last minute because they will turn around and sell it for more!! I hope Home American Mortgage and XXXX doesn't prey on any other families like they have on ours. They are a disgrace and give home builders a bad reputation!

We are refusing to accept this shady Loan approval practices : We all know that loan approval is based on, among other things, debt to income ratio. I truly appreciate the fact that " Homeamerica Mortgage Company '' made it super easy for us to qualify for the mortgage loan that we actually believed that were not going to qualify for the new loan with the current unusual interest rate hike in short time. We believed so because the interest rate had doubled in an unusual way which pushed us out of the market to buy this unit. Here are some numbers for comparison purposes. The numbers are taken from the first loan estimate and the final loan estimate : First loan estimate ( principal plus intrest= {$2500.00} ) before interest rate hike Final loan estimate ( Principal plus intrest= {$3600.00} ) after rate hike In another words my annual mortgage payment in the first loan estimate amounted to be about {$40000.00} where as in the case of the final loan estimate the annual payment skyrocketed to an amount close to {$54000.00} Coming back to the debt/income ratio ( 26-38 ) %, a person with annual mortgage payment close to {$54000.00} needs to have a corresponding income of ( {$200000.00} - {$150000.00} ) Based on my most recent tax documents ( XXXX ), my wife 's income shows {$50000.00} and mine shows {$59000.00}. One can see these numbers from the attached XXXX tax return document. Prior years tax documents show a much lower income than XXXX. My question here is what are the basis for the approval of this extremely risky loan when the clients are willing to exit the contract because of their strong conviction that they will not afford to pay the loan in the long term? Some one may ask, why did I lock up the interest rate at 5.5 %? We locked it up because we believed that it was part of the mortgage process. We assumed that the system would recognize and automatically reject our application. That would have resulted for the clients to receive at least their earnest money without being penalized. However, because the builder and the lender are working in harmony, they did not care much about the risky qualification steps ; instead they kept pushing forward for the final approval and closing the loan on XX/XX/XXXX. Another point to look at this case is, the builder believes the newly built home worth much higher ( {$780000.00} ) than what we signed for ( {$710000.00} ). If that is the case then why do they need to keep the earnest money of a client who got pushed out of the market without their own fault? We are not interested to accept this loan offer for the following two reasons : 1. The inflated home price in addition to the unexpected mortgage rate hike has priced out clients like us and this is not our fault. 2. The home appraisal and mortgage approval process does not reflect the reality on ground and needs to be scrutinized as to why the bank is allowing more risky loans even when the client says no to it./? I am writing this letter to express my total frustration with the dishonest and unethical behavior by HomeAmerican Mortgage Corporation ( HMC ). I have bought 5 homes over thirty years ( this is the second in Colorado ) and have never experienced anything close to my recent purchase. We initiated the purchase of our property in XX/XX/XXXX and provided a number of items at that time to the HMC. We also communicated that I would be retiring in XX/XX/XXXX and that my Daughter and Son in Law would live in the house for the duration. In XX/XX/XXXX, our current house would be sold ( it is 100 % paid off ) and the proceeds would pay off the remaining loan. In XXXX we were asked to sign an Occupancy and Financial Statement ( OFS ). We marked second home. HMC insisted we sign this as an investment property. The OFS states that the owner intends to never use the home as a residence under this option. The OFS also has a section about fraud, misleading or inaccurate statements. We told HMC we would not sign this document as an investment property since that would be committing fraud. On XX/XX/XXXX, we were given the dates for our guided tour of the new home ( XX/XX/XXXX ), final home inspection ( XX/XX/XXXX at XXXX XXXX ) and closing ( XX/XX/XXXX at XXXX XXXX. ) Then the nightmare started. With less than one week to go, we started receiving a barrage of information requests from HMC. Most of the items could have been provided months ago. With 2 days to go, XX/XX/XXXX ( XXXX XXXX ), HMC insisted that we sign another Occupancy and Financial Statement as an investment property. I told them we would cancel the house purchase before I committed fraud. Quite frankly, the underwriter should be fired for their unethical insistence on how this was to be signed. As this point, we believed the process to be over. We attended the final home inspection on XX/XX/XXXX and found out HMC was wanting more information and that the closing would be delayed. I was still sending information at XXXX XXXX that night, over 5 hours past the closing time. This put us in a major bind. In all of my previous home purchases, once a closing time as set, the process was over. We had a number of items being delivered on XX/XX/XXXX. We decided to take the risk and did not cancel any deliveries. We should have never been put in this situation. On XX/XX/XXXX, we were told that we would close at XXXX XXXX, but that HMC was still wanting more information. All items that were submitted were from XX/XX/XXXX or earlier. Items that could have been provided months ago. It wasnt until we were driving into the parking lot of the XXXX XXXX at XXXX XXXX that we received word that HMC had clearing us for closing. During this last week, we went online and found a number of other individuals that have also have negative experiences with HMC. It is my hope that actions are taken so that nobody has to experience what we went through.

I am writing regarding the closed claim # XXXX with respect to a VA mortgage loan applied through Home American Mortgage Company . A response was provided and received, and I missed the 60 days window to respond. Therefore, request to provide a close-out response and to reopen my claim or start a new claim. I concur with majority of the statements made by the lender. However, I want provide clarification tied to the following : 1 ). I did contact the Loan Officer, however, according to my cell phone records it was on XXXX XX/XX/2022, at XXXX. I may have also contacted the loan officer prior to this date but on my work cell phone. 2 ). It was not known to me the " Veteran '' would not be responsible for the cost associated with the interest rate lock program. The loan officer emailed me a congratulatory letter on XXXX XX/XX/2022, and spoke of the " Extended Rate Lock Program '' but did not disclose it was at no cost to " Veterans '' who planned to use a VA loan. If it was clear to me the builder was responsible for the cost ; It is reasonable to believe I would had accepted the terms of the program based on the volatile market. Hence, it was at not cost to the veteran. 3 ). On XXXX XX/XX/2022, I sought clarity, tied to the " upfront fees '' paid by the builder associated with the program. It was not clear to me if the " Veteran '' would be responsible for the " upfront fees '' at closing. The loan officer did not respond until XXXX XX/XX/2022, one day ( allegedly ) prior to HAMC making a decision to terminate the " Extended Rate Lock Program '' on XXXX XX/XX/2022 ; and not disclosing to HAMC staff until XXXX XX/XX/2022. The Loan Officer did not disclose to me until XXXX XX/XX/2022, the program was canceled. Based on the aforementioned, I request for the lender to honor the interest rate under the terms provided to " Veterans '' at the time HAMC provided me my congratulatory letter on XXXX XX/XX/2022. It was not clear to a reasonable person the terms and provisions of the " Extended Rate Lock Program '' was at no cost to a " Veteran '' who was using a VA Loan. It required follow-up clarity to fully understand the benefit. However, because we solely relied on emails and also due to the delayed response from the Loan Officer, I was inherently forfeited a benefit through no fault of my own. There is no reason to believe that I would had forfeited a benefit that ultimately would provide a lower interest rate than the prevailing interest rates. I was not clear if the " upfront fees '' would be my responsibility on the back in during closing.

To whom it may concern : On XX/XX/2022 A loan officer name XXXX XXXX working under the company Home American Mortgage company emailed me with a subject on all Capital letter and bold letters to lock my loan. He didn't even send me a breakdown of numbers how much my monthly mortgage, and other expenses involved. We are buying a new home through XXXX XXXX XXXX in XXXX, Colorado. When looking at the home, we were told that they had an incentive plan in place that if we used their affiliate Home American Mortgage Corporation for our mortgage, they would finish our basement free of charge. On the contract, they valued this incentive at {$37000.00}. At the time, I told the sales associate that I was uncomfortable with using them without knowing them because I feared for what they could do with our interest rate or points if they wanted to make up for the incentive. We were told that their prices and rates were very " competitive '' by the loan officer we were appointed at that time. We signed the papers, and are now coming up on our closing date. On XX/XX/XXXX, we were emailed by our new loan officer ( our old one who told us their rates were very competitive had retired ) stating that the government shutdown could effect our rates in a positive way. On the XX/XX/XXXX, we were emailed again by our loan officer that the shutdown did not effect our rates in the way that they'd hoped, and to let him know when we have a closing date so we could lock in the loan. On the XX/XX/XXXX, our builder XXXX XXXX XXXX sent an email with us and our loan officers copied stating that we had a closing date of XX/XX/XXXX. We believed that since our loan officer was on the email and told us as soon as he knew the closing date he would lock in the loan that it would be locked in at that point. However, I had to send a follow-up email asking what the rate would be on XX/XX/XXXX. Home American Mortgage Corporation is now stating that the rate on XX/XX/XXXX when the loan was locked was XXXX, which is XXXX higher than what the average rate is today and the rates have done nothing but climb since XX/XX/XXXX. When I asked them for the history sheet of their rates, and compared their rates to the 10 year treasury, they said their history is for internal use only, and that we were not allowed to see that information. Are they really allowed to pick and choose whatever rate they want, even when we have email documentation that the rate should have been locked in on the XX/XX/XXXX and that the rate according to the 10 year treasury on that day was XXXX? We are just looking for information that can help us out in any way since I believe they are trying to make up for the incentive by giving us an astronomically high interest rate.

In process of purchasing a new home form XXXX XXXX XXXX we were required to use it 's affiliated mortgage company Home American Mortgage. The process started in lateXX/XX/XXXX, at first initiation we stated we wanted a conventional loan, 20 % down payment. Home American Mortgage pre- qualified us an FHA Loan , a required us to payoff all debt in order to qualify for the conventional Loan we wanted. We inquired on what we should be doing to raise our credit scores to help obtain or conventional loan, we got no response, from the loan person. This was already the 2nd loan person we had been moved to, due to the first being very rude and callus with my wife. After a couple of attempts we were not satisfied with responses or response time from XXXX XXXX. We were then moved XXXX our third loan person in lateXX/XX/XXXX. XXXX was again prompted that we sought conventional loan we needed guidance as to what we could be doing to raise scores and be sure we were in good standing with credit scores. Our real estate agent was also in contact with XXXX, questioning why he had not spoke to us, gave any repose to questions or even pulled credit to see what our scores were. XX/XX/XXXXstill heard nothing from XXXX, our agent again reached out to him voicing concerns. Finally received word from XXXX XX/XX/XXXX with useful info, he had not pulled credit, the loan was still in FHA status with credit scores from XX/XX/XXXX XX/XX/XXXX XXXX ( branch manager ) reached out to me saying that she would handle all concerns now, after a brief discussion I voiced my concerns and requested guidance again! My call was not answered until a week later by XXXX, all these months wasted were I could have done credit repair/improvement gone. Which leaves me at FHA with PMI, and a mortgage payment that was $ 600- {$1000.00} higher then it could or should have been, pricing me out of the home purchase. All due to no guidance and complete negligence on behalf of of XXXX Affiliate Home American Mortgage. XXXX now is retaining our earnest money of {$9700.00}. Stating " Buyers Remorse ''. I applied for my first mortgage loan for a new build with HomeAmerican Mortgage Corporation through XXXX XXXX after they assured me my excellent credit would be enough to qualify me for a $ XXXX home in XX/XX/XXXX. They did not check bank statements after being approved for the loan. They gave me an estimated monthly mortgage payment of {$2100.00} and did not ask how much I am putting down on the house. They required I pay the earnest deposit of {$3900.00} to secure the home because property was selling fast. I did so and received estimated costs of mortgage to be {$3300.00} nearly 6 months later, when the home was closer to being built. Unfortunately, I bring home {$4300.00} a month and can not afford this {$3300.00} payment. HomeAmerican Mortgage knew the amount I was bringing home because they checked my XXXX and pay stubs. When the home was near completion in XX/XX/XXXX I was asked to join the closing meeting, to which I informed my loan officer and sales representative at XXXX XXXX that I am unable to pay this mortgage. They have since stopped communication with me and I have asked for the earnest money of {$3900.00} back and the Senior Division President at XXXX insisted that my deposit was only transferrable to purchase another XXXX XXXX. Since then, they have marked my application for the home as " Buyer 's remorse. '' After this incident, I have researched that I should only qualify for up to {$340000.00} based on my check stubs. Without having done their due diligence of checking bank statements, savings, assets, etc., I believe I am a victim of predatory lending. As we were working out a mortgage with Mr. XXXX we opted to do an extended rate lock with a one time chance to opt into the open market rates within 60 days of closing. When the time came to lock in the rate, mr. XXXX did not present us with the open market rate ( which we found out after the fact was 3 % ) and opted instead to strongly push us towards the floated rate lock. The Floated rate lock was 3.5 % and we opted to purchase points to lower to 3.375. The problem is that he did not communicate in any form or fashion the open market rates and when I confronted him about it his response was that those are their interest rates which was not true. Once we had exercised the float he became much more transparent after I called him and his manager, XXXX. I tried to resolve this dispute with both of them and was eventually told that the Company committed no wrongdoing and the rates will be left as is. This should not have happened. XXXX first and foremost duty is to keep us informed. A complete picture needed to be painted prior to us being hurried into a decision. No one should treat their clients like this. If they are right and there truly is no wrongdoing then that means every single person in the United States needs to be an expert in mortgages or else they will be abused in this manner. We were mislead from the start which is not how an honorable business should be run. I lost XXXX USD and got a much higher rate than the open market.

I applied for a mortgage with Home American Mortgage, a subsidiary or XXXX XXXX XXXX in which I felt pressured to obtain their mortgage due to the extraordinary incentives that the builder would provide. If we obtained a mortgage with Home American Mortgage for our new home we would get {$25000.00} off of the price of the house. I applied for the Mortgage on XX/XX/2022 and did not receive the required disclosures, including the Loan Estimate until XX/XX/2022 violating the three day initial disclosure requirement. I further was charged for costs I now understand I did not have to pay due to their failure to make proper disclosures to us. I feel this the practice by XXXX XXXX XXXX and Home American Mortgage to limit our choice of mortgage providers, with their extrodinary incentive of {$25000.00} to be a highly deceptive practice when they can not meet the disclosure requirements established for consumers to evaluate our right to choose an appropriate lender. We ultimately had to close on our mortgage with Home American Mortgage under discussions of them unlocking our rate if we did not close on the home. We were forced to purchase a home in sub par condition, at the threat of loosing our rate in an increasing rate environment where we would have suffered a long term financial hardship should we delayed the closing for the builder to correct the work.

In XXXX I applied for a mortgage to buy a new construction home in XXXX California. Months have gone with little contact. I inquired about the status of my loan and has been given the run around. The loan is supposed to close on XX/XX/2021 but I still dont have an approval or denial its XXXX XXXX. We were pre-approved on XX/XX/XXXX for the purchase amount of our home being constructed by XXXX XXXX XXXX. On XX/XX/2020, I initiated a loan application with HomeAmerican Mortgage Corp. which progressed to conditional approval with closing scheduled on XX/XX/2020. I've now missed two closing dates XX/XX/XXXX and XX/XX/XXXX due to no negligence on my part. The underwriter is refusing to approve my loan in spite of being qualified. Each time the closing date is near, the underwriter adds items to be provided. I've had to supply unreasonable documents that have nothing to do with being able to afford the home. I'm a XXXX woman, on the loan alone and I believe a XXXX woman making my income, close to XXXX, would not be discriminated against the way I am. I've constantly been told " this is the last item needed '', yet right before closing, more things are added. Making it impossible to make closing deadline. They can't lawfully deny me because I qualify, so I'm being discriminated against in hopes I don't comply, so the loan can then be denied. Earlier in 2020, I was in a contract to purchase a new construction home in Nevada through XXXX XXXX XXXX using a VA loan. Due to the COVID-19 shutdown, I had to leave my place of employment and thus had to back out of the contract for the home. We had applied for a XXXX loan everything was going great came to the final week where they got a presentation for a house and ready to set the closing date. Then the mortgage company had the XXXX assessor come by in the assessor did not include the pool on the work order that was going in. So the assessment came in at XXXX and the loan amount was for XXXX. Now the mortgage company is saying the XXXX is not responding to the request for an addendum and it is now XXXX weeks past the date were supposed to close and we are still in limbo. The company withheld funds for year end property tax payment. They assumed my property tax would be higher than it actually was and failed to return a fair portion of my escrow account overpayment for property tax. I called the escrow manager and as requested sent the actual and verified county assessment for property tax. She said they can't make an adjustment once the credit for overpayment is sent to me.
