While recently Checking my credit file I found that your Company has added a derogatory Line on my Personal Credit Report and as allowed under the Fair Debt Collection Practices Act ( FDCPA ), I am requesting that you allow me to validate the alleged debt. I am not aware that there is a debt from XXXX XXXX XXXX, and XXXX XXXX XXXX XXXX I am also unaware of the amount due and your Derogatory Remark does not include a breakdown of any fees. Additionally, I am allowed under the Health Insurance Portability and Accountability Act ( HIPAA ) to protect my privacy and medical records from third parties. I do not recall giving permission to XXXX XXXX XXXX, and XXXX XXXX and XXXX ] for them to release my medical information to a third party. I am aware that the HIPAA does allow for limited information about me but anything more is to only be revealed with the patients authorization. Therefore, my request is this : Validation of debt HIPAA authorization signed by myself. Provide breakdown of fees including any collection costs and medical charges. Provide a copy of my signature with the provider of service to release my medical information to you. Cease any credit bureau reporting until the debt has been validated by me. Your Company and the Medical Professional/Company that Contracted you are in Violation of these laws among others : Subtitle D of ARRA Sec. 13401 ( Application of Security Provisions and Penalties to Business Associates of Covered Entities ) Subtitle D of ARRA Section 13407 ( 1 ) - ( Breach of Security ). Please send this information to my address listed above and accept this letter as my formal debt validation request, which I am allowed under the FDCPA. Please note that withholding the information you received from any medical provider in an attempt to be HIPAA compliant can be a violation of the FDCPA because you will be deceiving me after my written request. I request full documentation of what you received from the provider of service in connection with this alleged debt. Dear CFPB, I have XXXX XXXX in my XXXX, so I have a XXXX doctor and XXXX office I visit to keep on top of it and in good health ( XXXX XXXX XXXX. ) After visiting the XXXX office multiple times with no issue, I get a bill for {$1700.00} dollars for a test I did not receive. The procedure is called a XXXX XXXX XXXX. I called the office to remedy the problem and woman staff member tells me that this happens from time to time, they will take care of it and not to worry. A month goes by and I receive another bill. I call the office again and remind them of the issue and they tell me once again that it will be taken care of. Another month goes by and I receive another bill. I had an appointment scheduled in 3 days, so I decided to speak with them face to face. I have my regular check up and on my way out I speak to the front desk staff and they tell me that they are very busy and that they can give her a message and remind her of the situation. I left the office and went to work. A few weeks later I get another bill. I make another phone call and now that the account is over 90 days delinquent they proceed to tell me that they will not see me again until the account is paid up. I tell them that this is a mistake again and what the other girls told me and she tells me they will look into it. At this point I don't believe her and am fed up, so I decide to seek a new XXXX. The bills stopped coming for a couple months and I think that the mistake has been fixed. Great right! Nope, that's just how long it took to be turned over to a collections agency ( Holloway Credit Solutions ) and the phone calls to start rolling in. In response to all this I decide to use XXXX XXXX to dispute the inaccuracy and have multiple times, I added a consumer statement to my credit report and now I am filing a CFPB complaint. I just don't know what else to do. The mistake happened so long ago, no one remembers me on the phone and if it is investigated, because the mistake was made by the XXXX office, it is in my file that I owe this money. I do not owe this money, I did not receive a XXXX XXXX XXXX and I am not going to pay for something I did not receive. Please help .... Respectfully, XXXX

Early XXXX I drove from XXXX, Alabama and visited the office of XXXX XXXX XXXX in XXXX Alabama. During the visit I requested a series of lab panels. I received the results of the panels but there were no results provided for a cholesterol panel that I had requested. I spoke with Dr. XXXX XXXX regarding the missing cholesterol panel and he responded that no cholesterol panel had been performed. Approximately two months after the visit I received a bill from XXXX XXXX XXXX for the cholesterol panel. I called the doctor 's office to discuss the matter and was told that the person who had been doing the billing was no longer performing the services. I was also told that an error had occurred and that the cholesterol panel had been done. I told the doctor that I had never received the results of the cholesterol panel and that I had found a new family care doctor to provide the needed lab work. Dr. XXXX became angry and demanded that I come to XXXX for the results. I spoke to the doctor office 's new billing manager to try to get the matter resolved on several occasions. She explained to me that the billing manager had been fired due to administrative problems specific to billing and they were having to write off a lot of accounts I also learned that there was a connection between the entity performing the billing and the collections agency, Holloway Credit Solutions at XXXX XXXX XXXX XXXX Alabama XXXX ( XXXX ) XXXX. In XX/XX/XXXX Holloway Credit Solutions submitted account number XXXX to the three credit reporting bureaus as an unpaid balance of {$40.00} related to the cholesterol panel that I never received. I filed disputes with each credit reporting agency. This item has been removed by all agencies except XXXX. I have contacted Holloway Credit Solutions and XXXX to have this item removed because the services were never provided and are believed to be part of a scam. Also, I never received the services. Due to the numerous complaints filed regarding the billing the doctor cancelled his membership with the better business bureau.

I went in XXXX of 2015, to XXXX XXXX located at XXXX XXXX XXXX. XXXX, AL. XXXX due to some XXXX. XXXX XXXX XXXX suggested that I needed a procedure, so that they could determine what was going on. It was a non-invasive procedure. My mother and I met with the person who handles insurance at XXXX XXXX and she reassured us that XXXX XXXX XXXX XXXX would cover the charges for this procedure. She actually called the insurance company just to be one hundred percent certain. The only thing that we would have to pay would be the co-pay. The procedure was done at XXXX XXXX XXXX XXXX XXXX. by XXXX XXXX. However, soon after the procedure ; I received bill for approximately {$600.00}. I called XXXX XXXX XXXX XXXX and they said that the procedure was not covered under my insurance XXXX XXXX XXXX. It is now reporting with the debt collections agency Holloway Credit Solutions, XXXX. XXXX XXXX XXXX. # XXXX XXXX, AL. XXXX. I recently called XXXX XXXX XXXX XXXX and they stated that due to XXXX XXXX reporting me as ( XXXX ) which in medical terms mean that the patient has a lot of medical issues. I was XXXX XXXX XXXX at the time of the procedure, and had never had any other medical problems. He used the most expensive XXXX that 's only used for high risk patients based on the information given by XXXX XXXX XXXX XXXX. XXXX XXXX XXXX XXXX also stated that they would have covered the charges if doctor XXXX would have not put me as a high risk patient. They also said that he either did it as a way to get more money, or the fact that I 'm XXXX XXXX which is ( racial bias ). They said that he he did n't have to put me fully under for this procedure due to me not having any previous medical conditions. That is the reason why I was left with a balance.

I have 2 negative accounts from XXXX XXXX that have been sold or given to a collection agency. Holloway XXXX XXXX. One of the 2 is where we broke our lease when my husband was relocated to XXXX from XXXX. This one I knew I would owe but the other one is a the home we lived in prior to that one and we did not break the lease or damage anything. They stated they are charging us for clean up but they also kept our deposit and it should not take {$800.00} for clean up. We also upgraded light fixtures and put in ceiling fans and did not request payment for those. The lease we broke, I was charged for marks on the walls even though I did repair them. I repainted in the paint left by them but they still said it was not clean enough even though I had a professional cleaner come in. I was never notified of these bills or allowed to dispute the amounts. They suddenly appeared on my credit when I went to apply for a mortgage. I did call and ask for a settlement amount to just take care of it but they will not return my call. The collection agency said that XXXX has to approve it. XXXX XXXX knows nothing when I call them. They are not giving me any means to get this corrected or working with me on this. I called them on XXXX the XXXX and they said that XXXX had 15 days to get back to them. The 15 days would have been XX/XX/XXXX. I ask if it was just business days and they said no, just calendar days. My husband started calling back in XXXX and they gave him an amount to pay that was 50 % of the bill but when I called they said it wasn't approved and no one would have told him that. I just need a means to correct this since no one seems to be responsible for it but yet they were quick to put it on my credit negatively!

I received information from you attempting to collect the above-listed alleged debt. Your initial communication to me of the alleged-debt was within 30 days ago. Please be further advised, I dispute the validity of the alleged debt in its entirety. Further I request verification of the alleged debt, including, the name and address of the original creditor, along with a copy of a signed contract with the creditor. Where is my signed HIPPA form? I am aware that you have directly violated the regulations of the HIPAA Act of 1996. I never signed a HIPAA form to authorize your company to have access to my medical records or procedures that I went through. Additionally any attempts to harm my credit history and rating by updating or changing dates after you have been informed that the debt is expired, is a direct violation of the FDCPA. Any abuse to my credit rating on your part will be met with all recourse available to me by the law. You are illegally attempting to collect an alleged debt and money that I do not owe. As per the law, cease and desist all collection activity, including credit reporting. I have disputed this debt with the credit bureaus and it came back verified i have since then contacted the company and haven't received a response. Where are the documents that your company used to verify that you are reporting these accounts accurately? What is the name of the person in your company who verified the accuracy of this account? What documents did they use to verify them? Please provide me with the name of that individual, their company title, and telephone number as well as copies of the documents that they used to verify that this disputed item are being reported accurately.

On XX/XX/2019 I contacted XXXX XXXX XXXX where I had previously received an XXXX XXXX and purchase eyeglasses. My eyeglasses were stolen and I called the day before to set an appointment. I told the Receptionist that I got slapped by another XXXX XXXX and his fingernail scratch me in the XXXX. She suggested I see a Doctor upstairs instead of going through the doctor on the 1st floor that exam my XXXX back then. She asked me did I have Insurance and I told her yes with XXXX XXXX XXXX XXXX. When I arrived the following morning they told me that the Doctor did not accept XXXX XXXX XXXX XXXX and I needed to go to their Emergency room. I went and 2 Doctors exam my XXXX and said everything was fine, the receptionist took 2 insurance cards from me, one Was XXXX and the other was XXXX XXXX XXXX XXXX. I never committed to self-pay for an exam that I normally get free at XXXX XXXX XXXX where I now have my eyeglasses. XXXX XXXX XXXX committed Fraud by charging me {$770.00} for an XXXX XXXX and placing it on all 3 of my Credit Reports. I contacted the Debt Collector Holloway Credit Solutions for the Dispute process and they still put it on my Credit Report. They both are in Violation of The Fair Credit Reporting Act and are liable up to {$1000.00} each on all reports in State and Federal Court. I am also a XXXX XXXX, a XXXX XXXX XXXX for The State of Alabama. Due to the collection on my Credit it is prohibiting me from borrowing money from my 2 Credit Unions for funding for my XXXX XXXX XXXX to purchase XXXX. Received a phone call from Holloway Credit Solutions on XX/XX/2020. Returned their call to inquire why they were contacting me. First representative requested personal information to identify me and then told me I would receive a letter in the mail, she would not provide me with any information about the account that was sent to them to collect. She then hung up on me. I attempted to call 2 more times and was hung up on those times as well. My third attempt, I did speak with a representative that advised me of company that sent my account to them for collection. This account is for a medical facility ( XXXX XXXX XXXX ) that I am paying consistent monthly payments to and should have never been sent to a collection agency. I informed the representative of this and he said I need to make a payment over the phone with him immediately. He stated that they were reporting this collection to the credit reporting agencies and it would affect my credit. He also stated that the company ( XXXX ) was a member of the XXXX XXXX XXXX ( they are not ). One of the representatives wanted to know who I was employed with and other information that was not relevant either. I did tell them not to contact my place of employment. This account should have never been sent to them by the health care provider. Business practices from XXXX are unacceptable, unfounded, unethical, misleading and they should not be allowed to harass consumers.

Holloway Credit is reporting an account on my credit report. I had not previously received anything from them. I mailed a letter requesting verification and validation of the account. The company then mailed me a bill with a statement stating that I have 30 days from the date of the letter, which is dated XX/XX/2021 to dispute the validity of the debt. However, the account was reported on my credit report before this notice was sent to me. The most recent reported date on my credit report was XX/XX/2021. I sent the letter requesting validation to the company on XX/XX/2021. Only at this time did the company send me the notice that was supposed to be sent to me before they reported this account on my credit report. I have attached the bill with the statement from the company with the date XX/XX/2021 circled. I also attached a document showing where this account was last reported on my XXXX credit report on XX/XX/2021. I know that this is a violation as the company is required by law to send this notice of the right to dispute and ask for validation before reporting anything on my credit report. Also, as I was submitting this dispute, I saw an option that states the company 's letter did not state that this is an attempt to collect a debt. The letter from the company does not have this statement on it either. So, this is another violation. I could only select one option on this complaint.

In early XX/XX/XXXX I received a letter from Holloway Credit stating they were about to report a debt of {$3300.00} on my credit for an outstanding medical bill that I had for XXXX ( a medical facility ) from XX/XX/XXXX. This amount included an illegal collection fee for {$820.00}. As I remember it, I became afraid because they said I had 10 days to pay the full amount. So, I submitted a payment for {$3300.00} via my XXXX. Days later I discovered that I had not signed any contracts with the original merchant stating that I would pay a collection fee. As a result, I contacted Holloway Credit Solutions and informed them of this illegal collection activity, and on XX/XX/XXXX, Holloway Credit Solutions credited {$820.00} back to my account. Upon recent further review of my account transactions, my attorney determined that there was NO CONTRACT WITH HOLLOWAY CREDIT SOLUTION OR ANY OTHER THIRD PARTY to pay this debt, so therefore, I am due a refund for the remainder {$2400.00} that I paid to Holloway Credit Solutions for the money they illegally collected with no contract, and while I was under duress of the threat of having this reported on my credit back in XX/XX/XXXX.

I contacted Holloway Credit Solutions in XX/XX/2021 requesting a verification of debt regarding an alleged debt in the amount of {$5500.00} they have reported to my credit report. I received correspondence by mail from Holloway Credit Solutions dated XX/XX/2021 in response to my request of verification. I do realize that some financial information must be shared with companies regarding debt, however debt collection agencies are not allowed to send me copies of my personal health information, the health entity can only do this. Due to this being a medical bill, Holloway Credit 's proper protocol was to have the medical entity send me my personal health information for verification purposes. Holloway Credit, as a debt collection agency is not allowed to DIRECTLY send me any transactions regarding the type of XXXX XXXX I may have had performed. This information would have to come directly from the facility or physician that provided the service ( s ). Holloway Credit sent me a copy of my personal medical information and this is a violation of HIPAA laws. This means that my information has been viewed by people that I do not want to see my health information.

I visited the emergency room at XXXXXXXX XXXX XXXX XXXX on XX/XX/XXXX. My primary insurance was billed. They paid and left a {$170.00} patient responsibility. My secondary insurance was billed for this amount. They initially paid but later revoked payment due to the hospital not submitting the EOB from primary insurance. I spent the next 1.5 years trying to get this issue resolved. Despite countless attempts by both myself and XXXX to resolve the problem, the hospital never submitted the needed document. They instead sent me to collections. I submitted the needed document to XXXX several times, however there were issues with processing it as it should have come from the hospital rather than me. XXXX finally processed and approved the claim on XX/XX/XXXX. They stated payment of {$170.00} would be sent to the provider within 7-10 business days. However, the hospital continues to claim they have not received payment. They refuse to investigate the problem with receiving the payment from XXXX. They continue to pursue payment through a collections agency even though I have provided a copy of the EOB stating patient responsibility is {$0.00}.

I have checked my credit report and noticed inaccurate information from your company. I have not received a dunning letter from your company and you have taken away my rights to validate the debt. I am not responsible for this debt with your company. I have never done business with your company and I do not owe your company. Please be aware that any negative mark found on my credit reports ( including XXXX, XXXX, and XXXX ) from your company or any company that you represent, for a debt that I dont owe, is a violation of the FCRA & FDCPA : therefore if you can not validate the debt, you must represent that all credit reporting agencies delete the entry. On XXXX/XXXX/15, we received a phone call from a company claiming to be representing XXXX XXXX regarding a past due bill for a doctor 's appointment that took place in XXXX 2015. Knowing that this was most likely a scam, we asked the person calling for a return phone number, at which time she hung up. From our caller ID log, we obtained the phone number and called them back. A live person did answer the phone with the name of a supposed collection agency - however, when pressed for more information, the person hung up. I tried emailing Holloway Credit Solutions on XX/XX/XXXX to resolve this complaint. They do not except email. I am not contacting them on the phone due to how rude the employees are. In XXXX I received a letter from Holloway Credit Solutions saying I had till XX/XX/XXXX to submit a financial aid application to XXXX XXXX XXXX or pay this debt for {$3300.00}. XX/XX/XXXX i mailed a financial aid application to XXXX XXXX XXXX. Holloway Credit solutions hired by XXXX XXXX XXXX hospital is reporting an inaccurate collections account and amount. The hospital had a billing error and when researched by my insurance carrier the issue was resolved as an error on the part of the hospital. I never owed the amount they sent to collections. The representative from XXXX XXXX XXXX XXXX clarified with both Holloway and the hospital that this amount was not my responsibility and the situation was resolved as the hospitals billing error. There should never have been any collections efforts made on this account and it should not be reporting on my credit report as the error was not mine. Ive filed complaints with XXXX and XXXX to help resolve the incorrect reporting. However, this has been a hassle for over 6 months now. I received a letter for a debt of {$46.00}, and this is unfair. I paid the original creditor in XXXX. I never received any notice or was told verbally when office visits were made, that, a debt was owed. I always paid copayments. On XX/XX/18 I paid the debt of {$87.00}, although I have no written request to pay the debt from the collection company or original collector. My only knowledge of this debt is because of the derogatory mark it has left on my credit report. I called the collection company both before paying the debt and afterwards requesting that they delete the account from the credit report and rudely and relatively I was told that no such arrangement was available. This is an aggressive company in their policy that they will not delete the account completely after my request to see a written document expressing the debt as mine, and furthermore would not agree to delete the account from my credit report after I paid the debt to simply get it off of my records.

I owed about {$1400.00} to a Urologist for a time when my insurance had lapsed for a period of a few weeks. At the time I had been paying XXXX but was about to have employer based insurance. The debt collectors have called me multiple times over several months attempting to collect a debt that is not mine. My phone number is incorrectly associated with the person who owes the debt. When I call, some of the collectors will tell me the name of the person who they are trying to reach and some will lie and say they can not tell me due to the privacy act and that I have to tell them who I am first. These harassing calls continue every time the debt is sold, just because my phone number is erroneously associated with this persons debt. Most recently, a collector denied me the ability to speak with a supervisor about the issue after calling me while I was at work.

I check my credit at least twice a week I pay off all of my debts. I recently checked my credit and found multiple medical bills that I didn't recognize. I have not previously received written notification or any other notification about the debt. On XX/XX/2021, I sent a certified letter to the creditor in which this complaint is about ; asking for a debt to be validated. I have sent information to both the creditor & credit bureau regarding this violation. Holloway Credit Solutions has violated my HIPAA rights. I have never consented with the above collector on any terms to access my personal medical records. I have notified the reporting bureau on several occasions about this situation.
