I have no choice but to question the business practices of HFS Financial Services ( HFS ) and veracity of some employees with the company. On the night of Monday, XX/XX/XXXX, I discovered and read several emails from XXXX XXXX ( XXXX ) and XXXX requesting a payment of {$1900.00} for pool financing / processing agreement. The email also had an unfamiliar attached XXXX document with mine and my wife 's actual handwritten signatures, with a date of XXXX. I immediately forwarded the message to the loan processor, XXXX XXXX ( XXXX ), requesting an explanation ; however, I received an out of office reply and she never respond. On Tuesday, XX/XX/XXXX, at XXXX, XXXX ( unknown last name ) contacted me by telephone ( XXXX ) and I conveyed my concerns to him about the surprising processing fee and the fact that at the beginning I believed HFS were the lender. He maintained that he did disclose the fee to me, which I continued to dispute and informed him that if he mentioned a processed fee to me that I would not have followed through with the loan and would have sought another lender. I further explained to XXXX that I was completely caught off guard and thought the emails were SPAM mail because this was never mentioned to me at the onset of the process and I have never seen the attached XXXX document before, nor do I have a copy of it with the other papers. Finally, after failing to convince me that he did disclose the fee, XXXX told me to contact XXXX XXXX. On Tuesday, XX/XX/XXXX, at XXXX, I contacted XXXX XXXX by telephone ( XXXX ) and several times during the conversation he maintained that he has been in this business for 27 years and have never encountered a situation such as mine complaint that at the onset, I was not informed by XXXX about the processing fee and that I was led to believe that HFS was the actual lender. I further explained to him that I was completely caught off guard and thought the emails were SPAM mail because this was never mentioned to me at the onset of the process and I have never seen the attached XXXX document before, nor do I have a copy of it with the other papers. In addition, XXXX XXXX further explained that he has done hundreds of these loan processing and have never dealt with an issue such as mine. XXXX XXXX later repeated himself and changed the numbers to thousands. I later conducted my research on the company through the Better Business Bureau ( BBB ), which resulted in me discovering one complaint about its business practices. Although it is only XXXX complaint, it is remarkable how the complainant 's situation [ INFRA ] is exactly similar to my matter. The lady went as far as to mention XXXX XXXX name in her complaint, which he submitted a response to. I was and am even more positive that XXXX did not disclose to me about the processing fee or that HFS was not the lender. In addition, as I stated to XXXX XXXX during the telephone conversation, I believe that this is a scam and we did not sign the document provided in the email. Furthermore, the fact that XXXX XXXX offered to reduce the fee by {$300.00} after I mentioned filing a complaint with the BBB and the Federal Trade Commission ( FTC ) was indicative of his knowledge that there was a strong possibility that there was no informed consent concerning the processing fee between us and HFS to include the possibility that the XXXX document was forged. Further I have proof, which led me to believe that an employee with the actual lender, United States XXXX XXXX XXXX XXXX ( XXXX ) provided the signature that was affixed to the fake XXXX document. Finally it is worth mentioning that the signatures do not match our correct XXXX signatures. Please see BBB link below. XXXX : XXXX XX/XX/XXXX Problems with Product / Service Complaint I was sent an email after my loan closed demanding nearly {$1800.00} that I never was told I needed to pay. I was sent an email by an HFS employee on XX/XX/XXXX. The email stated that I owed {$1700.00} to satisfy a processing fee. The attached document showed my and my husband 's signature, and it was dated XX/XX/XXXX. I thought it was a scam at first because I had never seen the document before. I contacted XXXX with HFS to confirm that the fee being demanded was an error. I was instead informed that the fee was something I had agreed to. I was confused and upset because I knew that I had not sent any paperwork via XXXX ( the program that was used for the document HFS says I signed ) I sent all of my paperwork to HFS on or around XX/XX/XXXX. I explained this fact to XXXX and XXXX at HFS via email. However, they continue to insist that I signed the document agreeing to payment of the above mentioned " processing fee. '' I did no such thing. I read all of my paperwork thoroughly, and at no time was I sent nor did I or my husband sign a document agreeing to pay a " processing fee. '' HFS is either forging my and my husband 's signatures or they are employing some other shady tactic to get me to pay them money I never agreed to pay. I have received several calls in the days since the first email on XX/XX/XXXX demanding payment, and just today I received an email threatening that HFS would begin charging me {$50.00} daily for every day that I do not pay the money. I feel horribly harassed, and I do not understand why HFS is allowed to conduct business this way. My husband and I were never told that we would need to pay a processing fee to obtain our loan. We did not even know that HFS was not our lender! They made it seem that they were our lender the entire time! I had no idea they were a broker, and there were no reviews anywhere that allowed me to get an idea about who they were as a company. I even inquired about the lack of reviews. I felt it was a bit strange that no one had left a review. Ever. The lady said she would get back to me about it, but of course that never happened. I want answers as to why I am being harassed for money. I want to know how they have my and my husband 's signatures on a document that was signed a full two weeks before I ever sent them any documents, and finally, I want them to stop harassing and threatening me with further penalties if I do not pay them money that I and my husband never knew about or agreed to pay in the first place. ( Show Less of Complaint ) Desired Settlement I want HFS to rescind their demand for {$1700.00}. I never agreed to it. The fee was never disclosed to my husband and me. The document they forwarded has got to be forged or doctored in some way as I had not yet sent any documents to HFS on XX/XX/XXXX. It was not until XX/XX/XXXX that I ever sent any documents to HFS regarding my loan, and when I sent those documents it was via fax and email. The only documents that I signed via XXXX were towards the end of XXXX into XXXX, and none of those documents went to XXXX XXXX, or XXXX ( the loan processor ). ( Show Less of Desired Settlement ) Consumer Business Dialog Business Response Please be advised that this consumer applied to HFS Financial Services on XX/XX/XXXX. We then electronically sent the consumer a XXXX agreement which is our letter of engagement for HFS Financial Services to begin the process to find the consumer the best financing options that exist in the country. The XXXX was signed electronically by a mobile phone ( we have included the XXXX record of tracking ) Once we received this back from the consumer, we started our process to obtain them the financing though a national federal credit union. We have included all of the documents that show that this consumer was introduced to this credit union by HFS Financial Services. All of the attached documents from the membership application to the loan application, borrower certification and authorization clearly shows that this consumer signed all of the required documents to have the loan process completed. The consumer has received their monies and are installing their project. We would ask that you dismiss this complaint. Thank you XXXX XXXX XXXX Financial Services Consumer Response ( The consumer indicated he/she DID NOT accept the response from the business. ) HFS is outright lying. I actually received an email on XX/XX/XXXX from XXXX ( the loan processor ) thanking me for paying their processing fee. I did not pay them one red cent because I did not owe them anything. However, if HFS wants to attempt to keep whatever reputation they may have by pretending that I paid them, it is fine by me. So long as they stop harassing me and my husband for payment of their fraudulent " processing fee, '' and they do not ever in the future claim that we owe them again, I am fine with closing this case. XX/XX/XXXX To Whom It May Concern : I was directed to HFS Financial by a XXXX. I just purchased a new home XX/XX/XXXX and had a small window to schedule and complete a fair amount of work. I was repainting the entire home, installing XXXX square feet worth of new flooring, landscaping the yard ( including some demo, install of pavers and patio cover, shrubs, and new grass and irrigation system ), a new XXXX XXXX XXXX and new appliances for the home Washer/Dryer, Refrigerator, Stove, Microwave and Dishwasher. I originally contacted HFS financial on XX/XX/XXXX and spoke with XXXX XXXX ( Senior Loan Consultant ), following my application I was shifted to XXXX XXXX ( Processor ). They mentioned that I was conditionally approved for an {$80000.00} loan, and it would take two weeks to get through the paperwork. I said that I needed to pay for items to secure their scheduling. For example, my flooring was installed by XXXX XXXX and they will not schedule until you have paid the job in full. I advised both XXXX and XXXX of this. They told me its ok, because the deposit would come to me and I could use the funds however I wanted after I received them. Being already pre-approved, they had already received all of my receipts ( and spoken to the contractors by phone ), and they pulled my credit, I figured we would be closing in a couple of days. Over the next couple of weeks the items that I advanced paid for with my credit cards have posted to my credit report. On XX/XX/XXXX I received an email from XXXX XXXX that the bank has now said they will only approve {$35000.00} ( rather than {$80000.00} ) because of the debt that has posted to my credit report. This was upsetting, because they fully understood that the new 20 year loan would pay off the other debt. Then, XXXX than a week later on XXXX, XXXX XXXX emailed me again and said they determinized that my debt to income was too high and they couldnt approve me for any loan. My complaint is that I was deceived. Both XXXX and XXXX had no problem with me advance funding the work that I wanted to complete and using the loan proceeds to pay these off. They emphasized that the proceeds would come to me, and I could use them to do anything. I went back to both of them after the loan was decreased to only {$35000.00} and said did you explain that the debt on my credit report is from the home improvement? I also said cant we pay off these accounts at closing. They said no. You will be pleased to know that I contacted XXXX today XX/XX/XXXX and wanted to find out if there was any misunderstanding. He said no and said the only reason the loan was denied was because of the increased debt on your credit report. I proceeded to tell him that I was honest with HFS and told them everything, even uploaded receipts for the purchases. I followed their guidance to pay for the items in advance and use the loan proceeds to pay them off. If I was warned once that if these show on the credit report the loan will not go through, I would have waited a couple of weeks. However, that was not the case at all. Actually, XXXX said he can not payoff dept or tell the banks that this will be used for debt because he is selling home improvement loans and not debt consolidation loans. That being said, they sold me something that they are not licensed or have the ability to sell. The entire outline of my loan and HFS advising me to advance pay for items and upload receipts, then pay off my debts with the loan proceeds is indeed dept consolidation. Yet, they tell me they are not able to sell these. So they were marketing and advising me on a product they can not offer. Additionally, my receipts and situation was never shared to with the bank. They defrauded the banks they work with to complete a loan. They wanted it to appear as no work had been paid for and nothing had started. Because they are only authorized to complete home improvement loans. I think the above is a result of deception, lack of experience, lack of professionalism, and more. The only reason my loan was not approved is because of the debt that the bank was 100 % aware of and they approved. I want others to be aware of their practices, so they do not make the same mistakes that I did. My monthly payments are now higher on credit cards, and with higher interest rates as a result. I think this needs to be further investigated and I would be happy to supply any and all correspondence I have had with HFS on the aforementioned topic.

On XX/XX/2022, i applied for a loan with HFS financial in the amount of XXXX provided the requested documents. ( i had already obtained a loan with them previously, and it was virtually seamless ) .on XX/XX/2022 i received an email stating i was conditionally approved and that the process was starting.XXXX XXXX XXXX i received an email to retake my drivers lic. pic over and submit, i did.XXXX XXXX XXXX i resubmitted a voided check to the account for the direct deposit of the loan.on XX/XX/2022 i got a call from XXXX XXXX XXXX XXXX XXXX XXXX, stating the loan was approved for XXXX and they needed to ask me security questions.after the interview she stated everything was good and that i would get the documents to sign.when the email came i could not open the document to sign.i called the credit union and HFS they stated that it would be fixed.they attempted to send the documents three times that day i could not open to sign.XXXX XXXX XXXX i got an email stating the loan was approved and to look for the documents to sign again.the documents then arrived to sign again i could not open it.i called HFS, the credit union and the docusign support.after going back and forth all day i was then told that the loan consultant at HFS changed the loan to two loans in the amount of XXXX each.i did not request this and this action caused a glitch in the system to look like i applied for three seperate loans.i then got and email at the end of business day that the loan was now denied.no explanation from anyone.on XXXX XXXX, i heard from no one and called the credit union who stated that it was on HFS end due to the multiple loan attemts and that the loan was still approved on their end.when i called HFS i was told to speak to the vice president, who told me to call the credit union and he could not help me.i spoke to a manager at the credit union who stated once again that the loan was approved with them and that the documents to sign had to come from HFS. when i logged on to HFS it stated the loan was denied and i can not apply again for another 45days. i have hired contractors that are set to start in two weeks, i now have a hard inquiry on my credit report and nothing to show for it.this is totally unacceptable for no one to even follow up or get back to me.the loan processor XXXX was definitely trying to help me but it was above her.but she was the only one to answer the phone and try.the loan was already approved and cleared until HFS decided to change the terms and amounts of the loan.i applied for one loan for XXXX.

*** THIS IS NOT A DUPLICATE CLAIM*** hfs financial is a company that shops home improvement/pool loans for you with banks and credit unions.I have two previous loans through them which are almost paid off with no late payments. i applied for a loan at the end of the year and got approved with XXXX XXXX XXXX XXXX XXXX XXXX. the loan was approved and then denied due to hfs stating they could not properly identify me. i was told to wait 45 days and reapply. six months later they are refusing to let me re-apply. i later found out the reason they couldn't identify me was because i had a security freeze on my credit file and it was blocking new credit attempts. i have since cleared that up and notified hfs that my file was open. They are still refusing to shop a loan for me with no explanation 's feel i am being discriminated against. i was also told that they do not deal with customers who have filed a complaint against them, because i filed a complaint when they stated they could not identify me. the same thing happened to someone that i referred to them and when they could not identify him the first time they allowed him to reapply ( XXXX XXXX of new york ), i have also referred multiple people to them through my business for loans and they have worked with everyone and been very lenient. they have been rude and nasty to me and all im trying to do is get help obtaining another home improvement loan. they offer the lowest rates and i can not understand why they are refusing to work with me. i have lifted the security freeze and should be treated like everyone else that i have referred to them. is it because i am a person of XXXX? im not sure because everyone else that i have referred was not a person of XXXX so im very confused and feel disrespected. i was told to reapply in 45 days and now they are saying i was never told that. i was told that by a supervisor and the website.i was also told that i would be reset in the system.

I contacted HFS Financial after a Internet Search, '' XXXX XXXXXXXX XXXX XXXX XXXX XXXX .I completed the On-Line Application.And I spoke to a XXXX XXXX XXXX.After checking XXXX XXXX XXXX, XXXX XXXX informed by XXXX that I was Pre-approved for $ XXXX was told to upload a list of documents to the Portal.The Portal never allowed the documents to be uploaded.I made several calls to XXXX XXXX XXXX XXXX XXXXoan Processor ) XXXX XXXX stated that She would have XXXX look into the problem.I was informed by XXXX that they have never encountered the problem.And therefore they did not know how to fix the problem.She then suggested that I forward all requested information to her by XXXX was re-assured that all information was secured since HFS was a Financial Institution.I later XXXX a email stating that my Birthdate and Address were listed differently on my XXXX Credit Report.I contacted Equifax.And both were corrected.I contacted HFS Financial and spoke to XXXX XXXX XXXX XXXX stated that he would XXXX XXXX a link to re-apply.The link that was forward would not allow me to re-apply.Multiple calls were made to XXXX.He did not respond.It appeared that my Cell Phone was blocked.When I finally reached him on a landline.XXXX stated that I should look for alternative financing for my XXXX XXXX XXXXSince submitting my information to HFS Financial, I have been notified by the Credit Bureau of numerous attempts by unauthorized individuals to apply for XXXX using my information.

This company stated they offer loans and start at no credit check for pre approval. They never disclosed that they are a Brokerage and don't offer the loan directly. They also never advised there was a 3 % finders fee. I was not allowed to pick my own terms and was just sent over a contract to sign after they ran my credit. When I called to complain, the supervisor did nothing but say he's sorry it wasn't what I expected but they send out the disclosures. When I asked him to show me where I signed the discourse and how I can review them, he said they're a one time click button and he doesn't have anything in writing. He also advised there is no harm because they won't charge me anything to cancel my application. I advised him if I would have known they were a broker and charged a 3 % fee I would have never wasted my time, submitted an application, nor sent personal information to them. After that he sent me a disclosure form with my name on it and predated it to XX/XX/28 with no signatures.

On XX/XX/2020 I applied for a Pool Installment Loan on the HFS Financial Website located at '' https : //www.hfsfinancial.net/ On the same time shortly after, I received a " conditional approval '' email letter stating that I was approved. I spoke with " Senior Loan Consultant '' XXXX XXXX on XX/XX/2020. XXXX 's tone was very rude and condescending. Apparently my credit score had decreased since the last time I had applied in XX/XX/2020. I was attempting to explain my situation to XXXX. He abruptly cut me off and the call ended. I attempted to look up HFS Financial NMLS # 's and I was able to find one regarding : '' Credit Services Business License '' but Installment Loans license is not active. This company is essentially a broker finding banks/credit unions to write installment loans and they are receiving a commission for doing so. XXXX also has no license that I could find in NMLS national registry. How can he be working doing loans and pre-screening without a proper license?

Applied in XXXX, conditionally approved then advised to call 3 credit bureaus because there a freeze on husbands credit, spent multiple hours on phone with credit bureaus - all stating no freeze. Loan declined. Told to resubmit everything to try again. They already had everything but said they could not use it. Requested declination letter, was told it would have to come from lender that declined loan but they would not provide name of lender and I still havent received it. Resubmitted for 2nd try- was told approved and to watch email for loan docs- lots of incompetence but bottom line was they did not approve loan because I refused to take my house out of trust ( this loan was unsecured ) I advised on XX/XX/27 that I did not wish to move forward with loan- got confirmation this morning that loan was denied it wasnt, it was withdrawn
