Having issues not with XXXX XXXX XXXX but with the third party collection agency who acquired my account by the name of XXXX XXXX XXXX. By all accounts they are not adhering to the FTC obligations and calling me, threatening to take me to court and stating they will garnish my wages. I am enclosing my correspondence with XXXX yesterday about the telephone conversation I had with the collector, who not only called my work number, but home and cell. Also, got a verbally abusive call this morning with the same individual on my cell phone. Not receptive to having a civilized conversation and very abusive on the phone. Below is their response to my email on XXXX and following that is my initial email to them with the complaint about the person at Hewitt. Thank you for contacting XXXX XXXX XXXX, your account is no longer with XXXX. Your account was sold to XXXX XXXX XXXX XXXX. Because we no longer own the account you will need to contact XXXX to discuss your account. The calls/emails you have received threatening legal action or any other correspondences were not from an XXXX XXXX XXXX representative. XXXX XXXX XXXX does not engage in or condone such practices. We have sent your email to our Buyer to review so that when you call you can discuss your complaint. Loan Number : XXXX Balance Sold : {$310.00} Should you have any questions please feel free to call XXXX XXXX XXXX @ XXXX Thank you, AMT Department XXXX XXXX XXXX The contents of this email are intended only for the recipient ( s ) listed above. If you are not the intended recipient, you are directed not to read, disclose, distribute or otherwise use this transmission. If you have received this email in error, please notify the sender immediately and delete the transmission. From : XXXX [ mailto : XXXX ] Sent : Wednesday, XX/XX/ XXXX XXXX To : cct XXXX Subject : Re : There is a problem with your payment// ref XXXX Hello, Just got a call ( at work ) from a XXXX at Hewitt Capital ( in Texas ), stating that he is representing your company to collect the outstanding debt with XXXX. He stated that he has documents that need my signature and he was sending someone over to serve the papers at my place of work which would in turn start the process of setting up payroll garnishment. He also stated that he has attempted to give me these documents at my home address in one message, the other message was that he sent them through the U.S.Postal Service and I did not sign for them. I told him that was not an accurate statement because if something would have been sent via U.S. mail, the postman would have left a notice. Not sure who this person is and how he got all of my information, but I asked him to email me correspondence related to our conversation ... this was two hours a ago and I have not received anything, not in my spam nor in any of my filters in my email ... funny thing though ... he had my email address and place of work and my residence ... skip tracer? I don't know. I logged into my portal with your company and see that I do have an outstanding balance ( for the reference number XXXX ). The amount on your website is different from the amount he told me I owed. I also told him I do not give out credit card information over the phone because someone can be impersonating a debt collector and that is not something I am willing to do. I am writing to you today to make certain that first, you are aware of the communication with this individual, ( or someone who may be representing your company ) and secondarily that I do intend to satisfy my debt but I will not engage in telephone conversations without proper channels and paperwork to support the request of payment. Thank you for your time. XXXX XXXX

A guy by the name of XXXX XXXX called my job from number XXXX early XX/XX/XXXX and advised that their client was XXXX XXXX and he was calling to collect a debt of XXXX on their behalf. He advised me if I didn't pay that day, that he papers would be served at my job and they would take me into custody. I asked him to send documentation, he advised that he sent it to my address, I never received it. I told him I only have XXXX dollars, I gave him my debt card number and withdrawed XXXX from my account XX/XX/XXXX. He advised there was a XXXX dollar processing fee. I told him I would try to pay XXXX on saturday. He said ok. He never sent a confirmation email or number for the XXXX payment. The following Monday, he called my job again. He said I didn't receive your payment on Saturday. I said I didn't have it and I have to pay my rent. He yelled at me and said " I would take your rent from your landlord hand and he said I see you paid for gas this morning, so he was looking into my account without my permisson. He said, your on a recorded line. This is a legal matter and you should be in custody. I was very intimated by his tone so I complied paid {$400.00} on XX/XX/XXXX and told him I would try to have the rest owed Saturday. Again, I never received any legal documentation or confirmation number of payment. So, I used my money I saved for rent and paid him on XX/XX/XXXX {$2500.00}. Again never received confirmation number or legal documents. At this point, I believed I was paid up. He Called that following Monday, said I owed {$1500.00} more dollars. He called my place of employment again, and I advised him. I have no more money and that he caused me to get evicted and that I never received legal documents or confirmation number for my payments. I also told him that XXXX XXXX did not hire them. He told me I was liar said he would closed my account and hung up on me. And I still have an outstanding balance with XXXX XXXX.

I XXXX XXXX, formerly XXXX XXXX have been contacted by Hewitt Capital LLC a company that claims to have bought my Debt from XXXX XXXX XXXX, who bought the debt from XXXX XXXX XXXX. I did take out this loan from XXXX XXXX and fell on hard times and could not pay the debt on time. I have made efforts to make as many payments as I could with XXXX before they sold the debt. Hewitt Capital in their communications which I have recorded is claiming to be XXXX XXXX XXXX XXXX but the company name is Hewitt Capital LLC as registered with the XXXX XXXX XXXX. I have attempted to get verification of the debt and was given an email attachemnt with a letter to a previous address that I had stating only the original account number the original creditors name and the amount due. I sent an email return asking for more info in the form of the loan documents to verify. The XXXX has an alert on the company stating they could not provide all the Bonding and exemptions for states they claim to collect in. I also did more research and found numerous consumer complaints of this company and this was why I asked for more verification from them. They still have yet to provide in my opinion adequete proof they are who they say they are. In addition the company has threatened to file suit on me if I do not contact them by the end of the business day which according to them is XXXX XXXX XXXX time. According to the XXXX the company is based in XXXX XXXX but calls to my phone have been from a XXXX number. To this time the company has been bullying and used extreme tactics even though they have only had this debt for a few months. In addition the company has kept extending their dead lines on when they intend to file suit twice so far. If you could please possibly get back to me my number is XXXX with advice or if this company is legitimate. I am very concerned and have only been attempting to protect my self from fraud. lastly I did make an offer to pay the company a minimum of XXXX $ per month in addition to their XXXX $ processing fee and was told they could not accept that amount. They did make the claim they would put in for hardship and make a good reccomendation to the Judge for me. With all the infromation I have so far I do not feel comfortable handing out my information to these people fearing a scam or fraud. Any help in this matter would be greatly appreciated. Thank You and have a wonderful day

I received a call telling me that XXXX XXXX '' needed to confirm that I was going to home on Tuesday with ID to sign for a package. I asked who it was from he said HC XXXX. I explained that I did not want the package because I am not familiar with the sender. He then told me that he would forward through dispatch to the client who is sending it so that I can verify. I then was put on the phone with a gentleman telling me that a company was filing against me in XXXX County and he needed to send the me the documents. I advised him that I could not commit to be home during any 4 hour window on any day as I keep a busy schedule. HE then told me that he would advise XXXX County that I am a skip and they can deal with finding me. I said no problem sir, but for the record, your false legal jargon needs some updating because when a person is being sued, they are notified by the court so they do n't need your documents. Good Day! I called the XXXX County Courthouse and they advised me that they had no lawsuit pending AND that if a suit is filed and a court date issued they will provide me with the paperwork via certified mail or deputy service. Anyone who gets a call from these people, write it down because this process they are using will hurt them in court! I tried to call the number back to the so called courier service and no one would answer. Then I tried from my home phone an still no answer. Low and behold they called back and the name on the caller ID said " Hewitt Capital ''. I am assuming that this is what the HC in HC XXXX stands for. I guess they either own XXXX XXXX or they were ( and I am sure this is it because according to the real company XXXX XXXX whose number I found online, they are not affiliated ) misrepresenting themselves in order to try and collect a debt. I felt threatened, the conversation made no sense because I initially though he was telling my that I was being sued by the county that I live in. I called my country courthouse and they stated that there was no pending action against me for this company and that they would have served any papers to me. This man made me think I was suppose to be in court next week!! Gave a XXXX XXXX in the middle of lunch with my toddler, thought I was going to have to go to the hospital!

Received a call for the first time on XX/XX/17 from XXXX. The collector left a voice-mail. I returned the phone call immediately and paid {$150.00} over the phone. I have asked many times for written documentation and they have provided the attached on company letterhead via email. Each time I have spoken to the collector " XXXX '' the amount changes and she has told me the amount on the letter is incorrect due to a glitch in their system. Today, she stated that they did not send the attached emails to me because she could not find them. At no time did the collection agency send a written notice clearly stating my right to dispute. I am filing this complaint as the company uses : Deceptive practices to collect. Misrepresentation of the amount owed. 809. Validation of debts ( a ) Notice of debt ; contents Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing -- ( 1 ) the amount of the debt ; ( 2 ) the name of the creditor to whom the debt is owed ; ( 3 ) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector ; ( 4 ) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector ; and ( 5 ) a statement that, upon the consumer 's written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor.

XXXX XXXX from Hewitt Capital contacted my place of employment on XX/XX/XXXX attempting to collect a debt from their supposedly client XXXX XXXX, I that owed a debt of the amount of {$3100.00}. I told him that I didn't have any money to give, he then proceeded to say that if I didn't pay I would be placed in custody and sent to jail or my wages would be garnished. I ask if he could provide legal documentation, he said he sent a letter to my address. I never received a letter. I told him I would pay {$100.00} dollars for today. He said it was a XXXX processing fee. I gave him prepaid debit card information. He took XXXX out of my account. I told him that I would attempt to pay XXXX by Saturday. He said ok. I didn't have the money on Saturday. He called my employment that following Monday. He ask why hadn't I paid. I said that I didn't have it and I needed to pay my rent. He then yelled at me and said. He would snatch the check out of landlord 's hand and that I was on recorded line and I should be in custody right now. I was very intimated. So I told him I would pay him XXXX today plus the processing of fee of XXXX and try to pay XXXX in two weeks to close the account. This was on XX/XX/XXXX. So I used what I saved up for rent and paid him XXXX on XX/XX/XXXX. He advised then that I owed a another {$1500.00}. I knew something wasn't right. I stopped answering his calls. Tried to dispute the transactions with my bank. They declined the credit. He then proceeded to take out {$150.00} on XX/XX/XXXX and another XXXX on XX/XX/XXXX. I never received confirmation number or any legal documents and now facing eviction. Also, XXXX XXXX has advised they did hire them to collect debt.

A XXXX XXXX from Hewitt Capital LLC improperly called a relative of mine, and told her personal information about why he was calling. He then became a complete jerk when she tried getting his contact information because she refused to give out my information, he yelled at her and hung up on her. She called him back and left a message for him, then immediately called him back again. He answered this time and told her to stop contacting him, she proceeded to tell him that she is trying to get the information from him to give to me, then she asked me if I wanted to talk to him. I took the phone, and he proceeded to claim he was a lawyer, he threatened to sue me, he tried to bargain with me and get me to give him money, he made false statements saying I committed fraudulent acts, and claimed I never paid any money on the loan ( which I did, then got into a bind and stopped because my kids needed food in their mouths ). After he got done speaking I told him to send me something in the mail. I am utterly XXXX XXXX. Contacting my relatives is illegal, giving them personal information, including my residence address is illegal, telling them the specifics of why he was calling was illegal. He is lucky that the relative he called I am talking to because if he had called some of the others and they found out my personal information I would be suing him. Ive been told I can sue him for what he did. These things and tactics are why people dont pay things back when they get back into a good place. Illegal all the way around!

This was a call from a debt collector agency, left a vmail on my office phone. They pretend to be calling from XXXX XXXX XXXX with a delivery and they need to verify the address. HOWEVER they are Hewitt Capital. This company Hewitt Capital LLC, has been calling office threatening me. A representative of the company calling himself XXXX at a XXXX phone said he tried to deliver me a summons to my home but was unable to deliver. He would not provide any information other than the sender of this mystery package is H.C & Associates ; another acronym for Hewitt Capital. He was extremely rude and pretended to transfer the call to another department, however he actually hung up. I tried to call back several times, to which there was no answer. He refused to provide me any documentation or information on the summons they are delivering to me. I informed XXXX, I am not permitted to take personal calls at work and to stop harassing me I was not going to deal with them and hung up. They have continued to call my office and leaving voice mails on multiple mail boxes that they are going to issue me papers for summons, none of the voice mail boxes are private so they are sharing private information with staff at my work. Desired Settlement : Stop the harassment and provide me with all documentation for me to research if I truly have this debt they claim as the company they claim I owed is not licensed to issue loans in Virginia and Hewitt is not licensed as a bill collector in Virginia.

XXXX XXXX began talking over me the remainder of call including giving out another person 's social security number. I received several missed calls in the last week that led to voicemails telling me I needed to contact a XXXX XXXX back the he was a from a law firm dealing with a pre-legal matter before they file a lawsuit against me. I called him back and spoke with him, he told me he was attempting to collect the money I owed XXXX. That I committed fraud against them and they'd be filing a lawsuit if I didn't make arrangements with him. I told him I wasn't sure what, if anything I could do and wouldn't know at the moment due to a court case with my ex I was in. He said he'd call back next week and see how low he can get it. The next week came and I again wasn't able to pick up my phone ( I already explained to him it's our busy season at work and I can't be on my phone ). He left a message again and continued to call 3 more times. He then proceeded to call my Aunt and Uncle and left a Voice mail on their landline saying I was in a lot of trouble and he was trying to locate me. Then said I owed a lot of money to them and I was on the run. Mr. XXXX not only false identified himself as a lawyer, he threatened legal action, called multiple times including my place of employment and family members, and he actually left messages to my family members stating untrue facts.

I received a call this morning from a group that identified themselves as a courier service that wanted to make sure that someone would be available at my home to receive legal documents. When I asked what legal documents the person was referring to they let me know that they would have to transfer me to Hewitt Capital who had more information on the situation. XXXX, the representative for Hewitt Capital let me know that XXXX XXXX XXXX was seeking a civil suit against me for a remainder owed on a payday loan from XXXX of 2015. When I just spoke with XXXX she let me know that her company was not a debt collection company and that was why she failed to let me know that her call was an attempt to collect a debt. It was my understanding from our conversation that she was representing Hewitt Capital in a civil suit being levied against my by XXXX XXXX XXXX. However, Instead of providing me with just that detail XXXX told me that I could resolve the Civil Suit by taking care of the remaining balance due with a credit or debit card over the phone with her. I gave my information to avoid any further possibility of a civil issue and XXXX told me that the suit would be cleared immediately.

I received a call at work today from XXXX who said he was with XXXX. Refused to provide any information other than he had been trying to deliver documents to my address from HC. When pressed for information I was transferred to someone else who refused to provide the name of the company he worked for or contact information and told me if I did n't set up a payment plan with him then " good luck to me ''. I requested verification of any debt owed and was told it had been sent previously and would not be sent again. I never received anything from this company for any supposed debt owed. Since that time this morning, they have contacted XXXX co-workers, my son, my sister-in-law and nephew ( both of which live XXXX miles away ) and who I have never given any information on to anyone. I was told these are legal documents to be delivered and if I was n't home today to receive them they would be showing up at my place of employment. Again, they refused to provide any information or verification of any debt they claim I owe.

I reached out the XXXX of Hewitt Capital on XX/XX/2019 at XXXX and notified him that he could not call my place of employment, because my job forbids these types of personal calls. I received another notification from my employer that XXXX contacted my job at XXXX XXXX after I told him that my job forbids it. I charged my phone and returned XXXX 's call and I stated to him again that he could not call my place of employment again. I received a phone call this morning and spoke with the lady on the phone and then I spoke with a gentleman named XXXX. I was informed by the lady that I was going to be served by XXXX County Police Department and if I did n't pay it then legal action would be taken and the paperwork was to be served for to appear in court. I was also told that she would see my accounts that were attached to this loan. And I was also told that it would go after anyone who was a reference on my account and also that they would serve me either at my place at home or my place of business. To not give me information on what the paperwork was for until I spoke with XXXX it was just to let me know that they we 're just giving me information about what they were trying to do. She did not inform me at first of the conversation either that this was an attempt to collect a debt.

Hewitt Capital has been contacting my children and my mother about debt they say I owe ( and other messages to get me to call ). Of course I called them as soon as I received the number, and they said I owed money for a XXXX XXXX Loan with XXXX XXXX ending in # XXXX. I have no idea what this is about, and I did not take out a loan. When I asked them for more information, they hung up on me -- twice. I asked them to stop calling my family members, and I hope they haven't called my work. I am a XXXX XXXX ( 25 years ) with a credit score of 800+, and I don't want this fabricated loan to mess up my credit or make my family worry that I've suddenly become irresponsible after a lifetime of being completely responsible and dependable. How do I make this stop? And how do I protect my identity? They see to have my social security number.

I recently received a call from Hewitt Capital LLC regarding an amount of {$76.00} owed to XXXX XXXX XXXX for a payday loan. I paid this loan off about 3 months ago so it confused me as to why this company was calling me saying I was being charged for a Breach of Contract. They asked me if I wanted to it the voluntary way and I agreed. The person who called threatened me with the XXXX as I am an XXXX XXXX XXXX personnel. I researched Hewitt Capital LLC only to discover that it is a scamming company that bottom feeds from anything they can get their hands on. They are about to charge me {$76.00} that I DO NOT OWE on XXXX. I have attached a picture of the letter they sent me over email, threatening to add {$30.00} if I was unable to pay the amount I owed. The address on letter is from where I was previously stationed.

On XX/XX/2019, XXXX XXXX from Hewitt Capital contacted my son and gave him details of an outstanding debt. My son called me stating that the person was threatening to send letters to my place of employment. I also received a message from XXXX XXXX that states that Hewitt Capital has been trying to reach me and if I don't call back, the company will send legal paperwork to my place of employment. I called her back and asked her to no longer contact my son and further action will be taken if my employer receives personal paperwork. The original debt will not be paid because I have disputed the amount they claim I owe.

Hewitt Capital is repeatedly calling my work despite being told I can not take personal phone calls and is a detriment to my job. This is the second time they have called me despite being told this. Just days ago I filed a complaint because this company is sharing my private and legal information with my fellow employees AFTER being told I can not take these calls at work. These shady business practices are not only unethical but illegal and I will not put my job in jeopardy just to talk with them at work.
