Attentively review my formal writ composed declaration of not proven complaint misinformation that is all or in part : deficient of the adequate current status in the fullness of TRUTH, ACCURACY, COMPLETENESS, TIMELINESS, documented OWNERSHIP, certifiable RESPONSIBILITY, or otherwise irrefutable, complaint obligatory, and regulatory requisite reporting thereby mandating your immediate actions to rectify and remedy and any infractions behavior ( s ) by retaining or returning to demonstrate TRUE, CORRECT, COMPLETE, and COMPLAINT METRO 2 data field formatted reporting!!! I am a victim of identity- theft, I am writing to request that you block all accounts disputed as fraudulent on my credit reports with XXXX XXXX XXXX XXXX and XXXX. This information does not relate to any transactions I have made. I did not give anyone authorization or consent to use my personal information. I hereby exercise my legal rights enacted by Congress and The Federal Trade Commission, which explicitly states when a victim of identity-theft dispute a fraudulent account on his/her credit report it shall be honored by all credit bureaus and all fraudulent information should be blocked within 4 days and proper notification shall be given to all data furnishers pursuant to section 605b of The Federal Fair Credit Reporting Act. Failure to comply shall lead to complaints being filed with The XXXX XXXX XXXX, Consumer Financial Protection Bureau, and Attorney General stating your companys unlawful collection practices, misrepresentation of creditworthiness, defamation of character, and noncompliance to abide by laws enacted by Congress to protect victims of identity-theft who's credit been impacted by acts of fraud. Because I know my rights under THE FAIR CREDIT REPORTING ACT, CONSUMER CREDIT PROTECTION ACT ( CCPA ), and FAIR and ACCURATE CREDIT TRANSACTION ACT of 2003 ( FACTA ). I will be taking action. I also know my rights under this paragraph of Section 312 of the FACTA LAW : SEC.312. Procedures to enhance the accuracy and integrity of information furnished to consumer reporting agencies. ( b ) duty of furnishers to provide accurate information. -- Section 623 ( a ) ( 1 ) of THE FAIR CREDIT REPORTING ACT ( 15 U.S.C . 1681s-2 ( a ) ( 1 ) is amended ( 1 ) in subparagraph ( A ), by striking " knows or consciously avoids knowing the information is inaccurate '' and inserting " knows or has reasonable cause to believe that the information is inaccurate '', and ( 2 ) by adding at the end of the following : ( D ) DEFINITION -- For purposes of subparagraph ( A ), the term 'reasonable cause to believe that the information is inaccurate ' means having specific knowledge, other than solely allegations by the consumer, that would cause a reasonable person to have substantial doubts about the accuracy of information. Policy states. According to the Fair Credit Reporting Act FCRA 611 ( 15 U.S.C 1681 ), Procedure In Case of Disputed Accuracy. ( a ) Reinvestigation ( 1 ) Reinvestigation ( a ) In general. Subject to Subsection ( f ), if the completeness or accuracy of any item of information contained in a consumers file at a consumer agency is disputed by the consumer and the consumer notifies the agency directly, or indirectly through a reseller, of such dispute, free of charge, conduct a reasonable reinvestigation to determine whether the disputed information is inaccurate and record the current status of the disputed information, or delete the item from the file in accordance with paragraph ( 5 ), before the end of the 30-day period beginning on the date on which the agency receives the notice of the dispute from the consumer or reseller. Therefore, my position is being clearly stated, these accounts do not belong to me, meaning that you are reporting inaccurate account information within my credit file. The fact that these are inaccurate account information means that you, this credit-reporting agency, are reporting incorrect accounts. 1. HERTG ACCPT bal. {$0.00} I am well aware of my rights as a consumer. The Fair Credit Reporting Act requires that you, the credit-reporting agency report accurate and/or correct account information within my credit file. My credit issues are very specific, these accounts and/or items do not belong to me. This means that you are reporting incorrect account information within my credit report. It is this in mind that I request that these listed accounts and items be Blocked and Deleted. According to the Fair Credit Reporting Act FCRA, Section 1681c ( 2 ) Block of information resulting from identity theft. 1.Block. Except as otherwise provided in this section, a consumer reporting shall block the reporting of any information in the file of a consumer that the consumer identifies as information that resulted from alleged identity theft, not later than four ( 4 ) business days after the date receipt by such agency of 1. Appropriate proof of identity of the consumer ; 2. A copy of an identity theft report 3. The identification of such information by the consumer ; and 4. A statement by the consumer that the information relating to the transaction by the consumer. I have provided all of the above listed four ( 4 ) items within this package. Therefore, I expect these listed accounts to be deleted and blocked within ( 4 ) business days. This is clearly an identity theft issue. I am also entitled to receive a free copy of my credit report, so I am requesting a free credit report and that all of these accounts, public records items, and inquiries be permanently blocked and deleted. The company Heritage Acceptance is a horror movie, the staff there is horrible, bad communication and treat people like XXXX especially the lady name XXXX, they had one name XXXX and she made me cry, I purchased a XXXX XXXX XXXX, my payments were set up for me to pay {$250.00}. Every two weeks, well I was doing okay but then my rent was not being paid in full so I had to pay a little more on the next car payment but I also explained to them that I could not continue to pay every two weeks because I needed to keep a place to stay, Pay my Rent, well that did not sit well with Heritage, I asked them to put me on a monthly plan, they said FLAT OUT NO, NOT UNTIL I GET MY PAYMENTS BACK ON TRACK. On XXXX XXXX my sister received a call from XXXX a representative with Heritage acceptance. She did not Identify herself or the company she was calling from. XXXX was calling to confirm my residence through my sister. My sister advised them that I was XXXX. A week later I receive a letter stating that there was a judgement against me the amount and how much I owe. However the did not specifically state that this was an attempt to collect. This debt was from XX/XX/XXXX, and the judgement was filed XX/XX/XXXX. The statue has passed for them to report this to the credit bureau as the have threatened to do so with in the letter. Also the were advised that I am disable and do not have the ability to pay. XXXX then asked my sister who was speaking on my behalf if she was able to pay it. Which was inappropriate to solicit my sister for she did not owe. My sister asked to speak with the supervisor XXXX and she explained the same thing to the supervisor and XXXX was still insistent upon collecting on the debt as well. I am mentally and physically XXXX and have been for along time, with the documentation to provided details concerning my XXXX of which I feel I should not have to disclose. The were advised that I do n't have the ability to pay, and the debt is 18yrs old. XXXX stated that they can try to collect on a judgement up to 20yrs. Either way I do n't have the ability to pay, am currently XXXX and request that the debt be eliminated. I can afford to continually be contacted about this debt and I am on a fixed income that barely meet my daily living expenses

I noticed a collection account on my credit from Heritage Acceptance Corporation for a car loan. I immediately went to the credit reporting agencies website and disputed this claim. The credit reporting agencies never received validation and in turn removed this debt from my credit. about a month later on XX/XX/2016 I received correspondence from Heritage Acceptance Corporation. I will put word for word what the letter says. This letter is to inform you of certain actions that Heritage Acceptance Corporation has or will take in relation to your account. Dispite Heritage 's efforts to collect, this account has a current balance of approximately {$7300.00}. As a result of certain I.R.S regulations and Heritage polices, Heritage is required to file a form XXXX reporting a cancellation of debt. This letter is to inform you that Heritage is filing a XXXX related to the account. Generally, the IRS considers forgiven debt as additional income. You should consult with you tax professional to determine if this will impact your tax liability After receiving this letter I got a call from Heritage acceptance at my work trying to verify employment. I also got another letter from Heritage stating they are going to request that this account be updated back on my credit. My question is why am I being bothered after a letter was sent out stating my debt was cancelled? Also, what is Heritage intentions with verifying my employment on " cancelled debt ''? I do n't want to assume but I feel as if this is a bullying tactic and harassment.

On XX/XX/2020 I sent off a debt validation letter to Heritage Acceptance Corporation. It was delivered via certified mail ( USPS ) on XX/XX/2020. Heritage did not complete the debt validation form as requested in the letter which will be included in this complaint. I have highlighted ( Exhibit B ) the areas in the form that were supposed to be completed by the corporation, but has failed to do so. Heritage Acceptance Corp has also clearly violated the FDCPA. 15 USC 1692b ( 5 ), " not use any language or symbol on any envelope or in the contents of any communication effected by the mails or telegram that indicates that the debt collector is in the debt collection business or that the communication relates to the collection of a debt '' ( I have also highlighted this violation in Exhibit A ) 15 USC 1692e ( 11 ), " The failure to disclose in the initial written communication with the consumer and, in addition, if the initial communication with the consumer is oral, in that initial oral communication, that the debt collector is attempting to collect a debt and that any information obtained will be used for that purpose, and the failure to disclose in subsequent communications that the communication is from a debt collector, except that this paragraph shall not apply to a formal pleading made in connection with a legal action. '' Heritage failed to disclose in their communication via postal mail that they were attempting to collect a debt which violated the FDCPA.

I have been laid off at the moment due to the covid 19 I have sent the screen shots from my work that has shown them that I have been off and havnt returned to work. I have already menchend to them that I am waiting for my unemployment or my stimulus check and that I will be able to arrange a payment plan and make payments on the car and they continue to harass me and mention that my car is the list to be repoed in XXXX. They have continue to send me letters in the mail. On Monday XX/XX/XXXX at XXXX they sent a gentle men named XXXX to my residence from XXXX XXXX XXXXXXXX XXXX to make sure that the car is still here and to tell me that heritage is trying to get ahold of me which I have already known but their is no reason for this to continue to happen after I have already spoke to them about the situation and how i will be able to resolve it after i receive money. It worries me that they will take the only need of transportation that I have to get my child to his XXXX appointments and to get his formula and wic and his diapers and wipes. It just puts so much stress on me trying make sure that I can have a vehicle to make it to work and back after the covid 19 is over to make it to work to provide for my family. Management trains employees to hide documents that would otherwise print off during a legal court proceeding. Management requests employees email when they need account notes deleted. Examples would be. Notes documented during a call with a customer. But management doesnt want those notes seen for possible legal action. Management trains employees to cut off the date listed on any authorization sheet the customer gave Heritage a signature on. Prior to sending for proof of verification. Examples : To verify information such as Employment, rental information. Mortgage information. Utility verification. On any customer. Management is vindictive. She picks and chooses what customers can pay to avoid garnished. And what customers get garnished even if they are paying. If management is having a bad day. That. Bad day is then taken out on the customers. And there account. Some customers get promo offers. And others are denied promo offers. On any same given day. No consistency, or fairness taken place behind Heritages doors. This company needs looked into. This company has proven to be unlawful unhealthy Undo stress to me and Many others others unwelcome in the work place behavior They have many dark scandalous Skeletons in the company closet!

I was financing a car with Heritage Acceptance Corp in XXXX XXXX .The company was taking money directly out of my checking accounts every two weeks. I paid on time and never missed a payment. The beginning of XXXX XXXX one of their Acc ounts reps had called and said to me you do n't have that much longer to pay off your loan would you like to pay it off in full? I made arrangements of two payments to be taken out in XXXX that would calculate to {$850.00}. Now I did n't know me paying off the account in full would leave a derogatory remark on my credit report. I started looking at my credit report in XXXX XXXX XXXX and I had called and talked to the acco unt manager a nd explained to her that I have a remark of " Derogatory Less than settled amount '' she stated its nothing that she could do. So I decided to take action and have them to dispute this remark and they did n't within th e 30 period. Now they are in violation of the FCRA 623 ( a ) 3 and FDCPA Section ( 225 ILCS425/9.3 ) Attached is all the necessary paperwork you need to review this case. I had been calling them about this problem since XXXX XXXX and nothing has been done until now. On XXXX XXXX I signed to a 42 month loan with Heritage acceptance corporation out of XXXX Indiana. I signed to 21.70 % apr, a 42 month loan, after 2 years and 6 months of payments I've added my monthly payment of $ XXXX. Why has heritage added another 8 months of payments to my loan without my Permission and without my knowing? I've asked them since XX/XX/2017 to send an itemized statement, I've asked XXXX, XXXX, and XXXX. I've still not received a statement of any kind I just get told if I don't pay the monthly amount they'll repo the vehicle. Now with them adding almost another {$2000.00} on my loan at this rate they could have anyone pay {$500000.00} for an XXXX XXXX with XXXX miles! Total violation of my rights and truly a breach of contract! But what can I do, they've got the title so i guess they can add whatever to your loan and you better pay it on top of the high interest rate or you'll just be out {$8700.00}!!!! Since the beginning of the loan i was placed on biweekly payments when I showed them I receive social security supplemental income payable the first of every month so they've had me paying biweekly and keep saying I'm behind although I never have received a statement in 30 months of a XXXX month loan! Finance company -heritage .My health gotten worse, I applied for XXXX While waiting for help I had to stop working, which, fell to slow car payment, which heritage, took car, I got my XXXX Then I tried to get car back, heritage said, they sold car, XXXX I received summons. Went to court, met with attorney in court room hallway, have him paperwork from social security, about me being XXXX, how long I been on XXXX, he took papers said he was moving to dismiss, he said I did not need to meet with judge And he can tell judge, so I left courthouse Amount? You tell me, it differs, even on the summons did not have amount. They had no date when this happened, which was XXXX. One month later, started phone calls from heritage, collections, she claims heritage can sue, as many times or years to come, as for our court date, they said did not mean a thing, on that court day, 29 years of harrassment. They informed me they got a judgement against me XXXX, without me being present? And as for notice I didn't get any. They claimed they have right to keep embarrassing me Harrassing, me. I asked to not contact me, they call and hangup, I said let 's go back to court, so I can talk to judge, they said no, I am still on XXXX.

XX/XX/2018 XXXX from XXXX XXXX called a residence and either spoke to, or left information with someone that had no knowledge of this matter and has absolutely NOTHING to do with this matter. Now I do receive some mail at this address. But to actually call someone else 's home is a bit much. Besides mail I have no ties to this residence. Heritage practices these harassing tactics. I pay Heritage. They want to me to authorize an automatic withdrawal from my account. And that will never happen. I pay {$100.00} a month like I AGREED TO. They want me to pay it twice a month for a vehicle that was totaled and doesn't exist anymore. The insurance paid what the vehicle was worth to them, and there was a remaining balance. I think I OWE alittle over XXXX. Hertiage takes advantage of people that need vehicles during desperate times. I had filed for bankruptcy and had little knowledge of a company such as this. Company claims that a debt of {$11000.00} is owed and has been charged off. i have written this company and requested for documentation to be provided to me of original contract and proof of my identity agreeing to such debt. I have been dealing with Heritage Acceptance Corporation for over a year in paying a debt owed. XXXX contacts me by text as well as calling my employer numerous times on the same day. For instance I have received 2 phone calls today XX/XX/2018. On XX/XX/2018, she called me 3 times with respect to a debt. The company has my cell number and can contact me by that phone and/or texting, but continue to call my work which is harassment. XXXX tries to get forceful on the phone indicating that my wages will be garnished if I don't make payments. I had to correct her and state that can only be done if a lawsuit is filed. With regards to payments, I have consistently made payments for the last 3 months for at least $ XXXX month and that is showing good faith payments, therefore they can't pursue litigation.

I received a court order around XX/XX/XXXX. The name of the original company was Heritage Acceptance Corporation. The collection agency, Attorney XXXX XXXX XXXX, XXXX, was now suing me for {$5700.00}. I called Heritage Acceptance Corporation immediately. They told me the debt is dated back to XXXX. I told them that I dispute it. I then called my state 's attorney general 's office and they said they had never heard of anyone going back that far to sue someone for a debt. Then, on my court date, XX/XX/XXXX, I disputed it again. They totally ignored my response and a garnishment of my wages was granted on XX/XX/XXXX. The statute of limitations to collect on auto loan debt in the state of Indiana is 4 years, however, a judge granted it.

I purchased a vehicle from Heritage Acceptance Corporation for XXXX. I was having a lot of problems with it so it gave it back to them and decided not to keep it. Heritage Accept. reported that I did give it right back to them, However, they immediately sold the vehicle for more than what I owe. Now they are reporting on my credit that I owe them XXXX. According to my XXXX credit report an hard inquiry was made on XX/XX/2018 from someone within this company. I sent them a letter that I've attached below that stated that I would like for them to provide me with proof of the given authorization that gave them the right to pull my credit on that specific day. XXXX XXXX XXXX I got a automobile loan from heritage acceptance. The loan was {$12000.00} for a {$6000.00} car. I would have ended up paying {$18000.00} for a {$6000.00} car. I was young and did n't know amy better. I traded in the car for a better interest rate. The trade in was n't enough to pay off the old loan so now I have a {$540.00} dollar car payment. Struggling to get by. They also charged me {$2.00} everytime I made a payment.

I have tried to resolve my issues with Heritage Acceptance Corporation # XXXX concerning my non public personal information being reported to consumer reporting agencies. I am not liable for this debt. They have violated my federally protected consumer rights 15 USC 6802 ( b ). They did not allow me the option to opt out from reporting transactions and experiences. We know that we have fallen behind on some payments but the company has told us if we show proof to why we are behind they can do a two for one payment or pay such amount that it will catch us up. Heritage Acceptance Corporation contacted my job after they closed the account and charged-off the debt years ago. They did not involuntarily reprocess the vehicle.
