XXXX obviously someone stole my identity. XXXXI knew nothing about this debt until I noticed {$180.00} withdrawn from my checking account.them I contacted XXXX XXXX Henley lotterhaus & Henley. I tried explain this wasn't my debt.they eventually reversed the garnishment. Never heard another word from them. I was never served.never received any mail nothing. I abosulety thought that was the end of it. XXXX they say they served me when in fact I never heard another thing from these sketchy guys until XXXX where I received a letter stating we had hashed it out over phone and that i needed to fill out Id theft affidavit and return.XXXX I filled out forms had it notorized and mailed in back They claim they never received it. I have the actual letter with the forms missing from back.so that confirms for me that I did what they asked. My paperwork is purged every XXXX yrs so why I have this letter I don't know Never heard a word from them nothing. XXXX mother is XXXX in hospital and I receive my paycheck and there is a garnishment from guess who. I was taking care of my mom and I went to my corporate office where they took care if it and had the garnishment reversed again I can hardly remember the details I just know I thought again revers the garnishment they took care of it it was not my debt it was due to id fraud. XX/XX/XXXX they say they served me and this is not true I have been home with a injured leg since XX/XX/XXXX I barely even leave the house Now it is JXXXX XXXX XXXX yrs they have been strong arming me and refiling the judgement against me It's not my debt over 8 years for the first I'd theft affidavit I tried to file and in XXXX I filed another one. I was told that it's my fault they did not get first one and I should have checked with courts to obtain my paperwork on judgement.How in the XXXX would I know to do that if I knew nothing about it or I thought they did what I thought was there job and rectified the situation NOPE I didn't realize that these are sketchy vultures who buy junk debt and try to strong arm u into paying my credit report is clear I pay my bills .after 22 yes if it were in fact my debt I would have made some sort of attempt.they can't prove to me that it is in fact mine nor can they prove they own the debt and they XXXX sure can't show me any paperwork I don't even know who the original creditor was. I need help this think is keeping me from taking care of my family even though it's not on my credit report somebody checked the judgement in the county and there it is.i also have a doctor bill that should have been charged off that showed up here.but they are working to clear that up This is obsurd.ibcant afford lawyers to fight for me so I guess I can go defend myself or lose everything that I have over this 22 yrs old debt. Please help me

I did not know that I was being sued by XXXX XXXX back in XXXX, until XXXX of XXXX. They claimed they served me with papers, but had the wrong address on file. I learned of it when my previous employer XXXX received a writ of garnishment of {$11000.00}. My wages were garnished starting on XXXX/XXXX/XXXX and I received my last pay check with them on XXXX/XXXX/XXXX. At that time, {$9900.00} had been deducted and sent to the law firm of Henley, Lotterhos & Henley. According to my previous employer, learned yesterday, that I had a balance of {$1400.00} to be garnished when I left the company. I did not work for a while, went back to work a year and a half ago. Yesterday I received notification from my current employer XXXX XXXX XXXX, that they received a writ of garnishment from Henley, Lotterhos & Henley stating my wages are to be garnished in the amount of {$13000.00}. I have a copy of what they submitted to the XXXX XXXX XXXX XXXX in XXXX asking for the same amount. I finally got in touch with the law firm, they put me through to XXXX XXXX XXXX. He stated the original garnishment was over $ 19XXXX and that I owe the {$13000.00}, that my previous employer must be mistaken. I was very honest with him, told him I could not lose my job over this, that I wanted to work something out with him. He asked me how much I made, I told the truth, after that, he does n't work with me on settling unless I give him a lump sum of XXXX and will not agree to take less than 25 % until he sees what my garnishment would actually be. He was not nice and would not agree with anything with me once he found out what I made. I have a daughter in college, paying for everything, including student loans, her father does nothing for her. With all of my bills and living expenses, I can not afford 25 % of my income to be taken away. He is so money hungry that he will not discuss anything else with me until he sees how much they will received from my garnishment. He actually hung up on me stating to call back after they receive my first garnishment. I have had some very hard times, and have worked so hard to get back on my feet. This company only wants to bring people down. I am not trying to get out of my responsibility, I am trying to settle a reasonable amount and not have my wages garnished. I can not lose my job over this, and it could very well happen, I do work in an at will state. This law firm needs to be investigated, they refuse to help people, they want to take more money from them so they can not survive.

I was contacted by XXXX XXXX regarding an alleged debt owed. This is hearsay as XXXX XXXX has no firsthand knowledge or bore witness to any of my Consumer Credit Transactions. Be it known, that I hereby dispute the validity of said debt in question. In addition, Henley, Lotterhos, & Henley, PLLC are hereby requested to inform and / or remove from any reporting agencies this alleged debt that is currently in dispute. I have reached out to this company several times to get them to stop garnishing my paycheck I am barely making ends meet. I need the garnishment to stop because it has reached the statute of limitations in the state of Mississippi. Limitations of Actions and Prevention of Frauds 15-1-43. All actions founded on any judgment or decree rendered by any court of record in this state, shall be brought within XXXX ( XXXX ) years next after the rendition of such judgment or decree, or last renewal of judgment or decree, whichever is later.

Collection agencies can not report old debt as new. If a debt is sold or put into collections, that is legally considered a continuation of the original date. It may show up multiple times on your credit report with different open dates, but they must all retain the same delinquency date. I notice that in my state after XXXX years a person can not be harassed by debt collectors for old debt and also garnishing someone pay for old debt XXXX years old debt but reporting it as it is new debt.

XXXX account collection by attorney was NOT mine. I provided my XXXX credit card not the same as the attorney had shown on the record but I was still given DEFAULT JUDGEMENT by court. I was NEVER summoned to date of court. Happen under a year ago in XXXX XXXX XXXX MISSISSIPPI. Approximately + {$1500.00} was XXXX out of my DAD 's account to make matters worst.
