XXXX XXXX XXXX, OH, XXXX Affidavit of Truth Be it known to all that I, XXXX XXXX, am in fact the consumer, natural person, original creditor, lender, executor, and administrator. I am not a citizen nor person as defined in commercial statutes. I, XXXX XXXX, am created by XXXX alone and subject only to my creator. Whereas, I of age, of majority, give the here in notice to all, I make solemn oath to the one and only most high of creation only ; whoever that maybe, and I depose the following facts ; so be it, now present ; Fact, The Fair Credit Reporting Act is intended to protect consumers against the reporting inaccurate information that is harmful and irrelevant to the consumer and the alleged account reported by debt collector HMC Group is inaccurate, harmful, and irrelevant to me as a consumer. Fact, The Fair Debt Collection Practices Act is intended to secure my right to privacy and my privacy has been breached so be it. Fact, pursuant to 15 USC 1692 ( g ) no debt collector or court can validate any debt only the consumer can and HMC Group violated this when they responded to the debt validation dispute through the CFPB portal saying that the alleged debt is valid. Fact, HMC Group admits to not being present at the alleged time of the documentary evidence therefore any copies that HMC Group may present is heresy. Fact, entities can not create debt nor extend credit therefore they can not lend as said so by congress under Title 12 so APT Management can not be the original credit as claimed by HMC Group. I, XXXX XXXX am in fact the consumer, natural person, and original creditor. Fact, the term consumer reporting agency as defined by 15 USC 1681a ( f ) means any person which for monetary fees, dues, or on a cooperative nonprofit basis, regularly engage in whole or in part in the practice of assembling or evaluating consumer credit information or other information on consumer for the purpose of furnishing consumer reports to third parties. Being that HMC Group has chosen to report this alleged account to my consumer report makes them a consumer reporting agency. Fact, the term consumer report as defined by 15 USC 1681 ( a ) ( d ) does not include any report containing information solely as to transactions or experiences between the consumer and the person making the report and the reporting of the alleged account by the debt collector HMC Group contains information that contributes to the alleged experience and transaction between I, the consumer and the alleged creditor which is claimed to be APT Management. Fact, the term consumer report as defined by 15 USC 1681 ( a ) ( d ) does not include any authorization or approval of a specific extension of credit directly or indirectly by the issuer of a credit card or similar device and the reporting of the alleged account by the debt collector HMC Group violates this. Fact, any consumer reporting agency may only furnish a consumer report in accordance with the written instructions of the consumer and I, the consumer, did not give any debt collector nor consumer reporting agency any written instructions to report the alleged account to any consumer report. Fact, nowhere in federal law is it written that a debt collector or consumer reporting agency must report any information to a consumer report regarding a consumer except under the written instructions of the consumer and I, XXXX XXXX am in fact the consumer and did not give any consumer reporting agency written instructions to report any information to any consumer report. Fact, an Affidavit that is uncontested, unrebutted, and unanswered stands as truth and the unrebutted Affidavit becomes the judgement in commerce. Unless this Affidavit is contested or rebutted the alleged account reported by debt collector HMC Group must be removed from any consumer report [ United States v. Kis, 658 F.2d 526, 536 ( 7th Cir. 1981 ) ; Cert. Denied, 50 U.S. L. W. 2169 ; S. Ct. March 22, 1982 1982 ] Fact, I am sure that the removal of the alleged account by the debt collector HMC Group from their records, or any and all derivatives therefore, of, and/or with any affiliates will ensure my privacy and rights as a consumer will not be violated again, and this herein unrebutted Affidavit of Truth being serviced to you today and therefore, standing as truth in commerce.

A medical bill that I could not afford was sent to SOS XXXX XXXX in XXXX, OH. On XX/XX/XXXX I was at work and the receptionist told me someone named XXXX urgently needed to speak to me. She was a debt collector for the SOS Group. I could not continue to tie up our businesses only line so I offered to call her back from my personal cell phone. When I retrieved my cell phone I noticed I did have a missed call from the number less than one minute before they called my workplace. I immediately called Miss XXXX XXXX back and she explained this was an effort to collect debt for a medical procedure. I could not afford the entire bill, around {$2100.00} ( this was one bill of many from a medical event that in total was so high I surpassed my out of pocket insurance limits for the year and still owed ) and offered to arrange a payment plan. I explicitly asked Miss XXXX if this would keep the collections debt from being reported to the credit bureaus ( as I have been asking each collector for this event ) and she assured me it would. We went ahead and set up automatic payments to my card to be deducted each month. In mid XXXX my debit card has suspicious activity and my bank froze all of my accounts to investigate until I received my new cards in the mail. The card on file was affected but when they called me, on the Due Date of XX/XX/XXXX, I explained the situation and provided my new card which I had just received and activated the day before. On XX/XX/XXXXaround XXXX XXXX. I received an email from XXXX stating there was a new account on my credit report. I investigated and was shocked to see it was a collections account with HMC GROUP which I have never heard of. I called the phone number provided multiple times on XX/XX/XXXX until they opened and explained I didnt know what this debt was. Imagine my surprise to find out the HMC Group was also the SOS Group and I had been reported for a debt I was in a payment arrangement with. I do not remember the name of the representative I spoke with at this time. She was very rude, accused me of lying about being told this would avoid the debt being reported to credit bureaus and was raising her voice. She said she would forward my complaint to a supervisor but I could not speak to them now. I decided to call the number again as I was not satisfied with this answer. This time I was connected to Miss XXXX XXXX, who I had originally spoken to in XXXX. I again explained how she assured me this wouldnt be reported. As someone who temporarily lost their job in the pandemic and then had an additional almost month out of work unpaid due to the medical event in question, my finances took a huge hit and it was a stretch for me to afford the monthly payment I agreed to and only did so to save my credit. I asked to cancel my Payment plan if our agreement wouldnt be honored and Miss XXXX made threats including being sued, denying she ever agreed to these terms ( a few co workers were in the break room with me during the initial conversation on XX/XX/XXXX and have said they remember me explicitly asking this ) and raising her voice. As I was asking to speak to a supervisor she actually said things like just pay you bills next time and Im not arguing over this with you and hung up. This is absolutely unacceptable behavior. I have worked in customer service myself and that would never be tolerated under any circumstances. I was crying and emotional due to her lies but I didnt swear at her or call her derogatory names. I of course called again and this time was connected to a nice representative named XXXX. This complainant is not at all about her but about the company as a whole and the previous representatives. She apologized profusely and stated multiple times the manner in which I was just treated was unacceptable. Without asking, she offered me the direct line for her Supervisor and advised me to report the behavior. Because she was so kind I agreed to reinstate the payment plan until this dispute is settled. I have no issue paying what I can but I do have an issue with being lied to about this not being reported to credit bureaus to get me to enter this arrangement. I have now left 2 messages for the supervisor on his direct line ( I was told his name is XXXX XXXX ) with my name, phone number and the situation. I have not been contacted.

Be advised that this is not a refusal to pay, but a notice sent pursuant to the Fair Debt Collection Practices Act, 15 USC 1692g Sec. 809 ( b ) that your claim is disputed and validation is requested. This is NOT a request for verification or proof of my mailing address, but a request for VALIDATION made pursuant to the above named Title and Section. I respectfully request that your offices provide me with competent evidence that I have any legal obligation to pay you. Back in XXXX i was involved in a motorcycle accident. I did have insurance which paid my medical, however several items were not paid due to incorrect coding. As a result they went into collection. They were all for XXXX XXXX XXXX in XXXX Ohio. When they were sent for collection they went to an attorney, They were marked individual but when they were paid it was one lump sum. which we paid to the attorney. I should add that it had gone to court. Because we had moved we never got a notice so there was a judgement, which was paid in full..I have a notice from the court and the attorney that shows it was paid. This was back in XXXX of XXXX. All of a sudden in XXXX of XXXX one of the amounts owing shows up on my credit report {$560.00}. I called HMC which ids the collection agency that now has it and explained to them that it was paid. They disagreed so I filed a dispute with experian.I informed them that I had even contacted alliance hospital which she had trouble locating the debt since the XXXX had turned it over 4 years ago. But she showed no such amount owing. I contacted the attroney 's office who handled this. When this debt was paid the credit bureau was not notified. Since the amount paid did not match any invoice ( as I said, there were 5 different invoices that equaled XXXX which I am sure includes interest ) The hospital said the account was closed. Somehow XXXX of the invoices from this group that amounted to XXXX which is listed on the invoices that were paid. It somehow was shuffled off ( I get the feeling that the hospital was not notified in a timely manner, therefore may have been passed on to someone else for collection. Which I found out had indeed been passed on. Several times over the years. This HMC however decided that after 4 years they would list the debt as owing and all but destroyed my credit. I have asked them to show proof as I did with with XXXX. I faxed XXXX the court document and letter from the attorney that it was paid. All they did was send dispute results back stating that it will remain on my report. Nothing from the hospital, nothing to back up their decision other than what they said. This is horrible, how do these people get away with this. The hospital didn't even know who HMC was as when the original debt was placed in collection, it was through an attorney. Don't they have anything better do do than to ruin the lives of honest hardworking people who are trying to get by. It's a wonder that so many people do things under the wire..trying to do them right is quite obvious to no avail. I have the receipts and court documents showing this was paid. It is actually a few dollars more with the added interest. I have absolutely no confidence or trust in our credit reporting agencies. The seem to have carte blanc in what and how they do things. All I want is for this XXXX that they claim is owing taken off my report. An apology from experian I'm sure is a pipe dream but worth mentioning. I do hope that the CFPB can help get this resolved. I received an alert from XXXX that a collection account had been added onto my file. Upon reviewing the account, I saw that there was an account from a company that I did not recognize ( HMC Group ). I sent a debt validation letter certified mail/ return receipt to HMC Group on XX/XX/2020. I also disputed the account via phone with XXXX. On XX/XX/2020 I received a letter in the mail address to me from HMC Group. In the letter was a single sheet of paper that included my personal health information/medical record. I never gave HMC Group written nor verbal permission to access nor share my medical records. I do believe that HMC Group actions violates my HIPPA Rights. I never signed a HIPPA release form that would allow HMC Group nor XXXX to access and obtain my medical records. In the letter I sent to HMC Group, I requested ; The name and address of the original creditor, the account number, and the amount owed. A copy of the original contract that I signed for services, verification that there is a valid basis for claiming I am required to pay the current amount owed. Details about the age and amount of the debt including a copy of the last billing statement from the original creditor ; a detailed explanation of any interest added or payments made since the last billing statement and the legal authorization for this interest ; the date the original creditor claims this debt became delinquent. Line by line accounting of the original account which should include ; transaction history and full breakdown of this account. Proof that this account is within the statue of limitations. Proof of their authority to collect this debt : whether you are licensed in my state and if so provide the date of the license, name on the license, license number, and the license number, and the name, address and telephone number of the state agency issuing the license. Since they are located in Ohio, I also requested that they provide the licensing information from Ohio state as well. HMC Group did not provide me any of this information. Instead, they obtained my medical record and sent that to me. I would also like to note that the HMC Group account was returned to XXXX as a debt that was validated and verified. I have no access to view what information was sent to validate this date, but from what I was sent. I want to make it clear that I did not give any permission for HMC Group noXXXX XXXX to access and obtain my personal medical information. I do hope that this matter is investigated and address. If I am needed to testify to what I am stating has occurred, I am willing to do so. The account information still has not been address due to my HIPPA rights being violated by HMC Group. I have attached a copy of the United States Postal Service certified mail receipt, a copy of the medical record HMC Group sent to me, a copy of the envelope that the letter was sent to me in, and a screenshot of how HMC Group has updated and is reporting this account on my credit file.

I disputed an invalid collections placed on my credit report with XXXX, XXXX and XXXX online. XXXX and XXXX removed the collections account from my credit report within days. It took XXXX approximately 30 days to return a decision that the collections account was verified to be mine. I reached out to the collections agency through the phone number listed on my XXXX account. I told them that I needed proof of account ( original agreement ) for a collections that they placed on my credit report. They asked me my name which I provided. They then asked me if my dob was XXXX, which it is not even within 10 years of my dob. They then asked me for my address. They told me that they did not have an account associated to me. I created a new dispute with XXXX for the same collections account. This time I also called to speak to a representative. I let them know that I had not done any business with XXXX XXXX XXXX XXXX ( the original creditor ) and that the collections account was not mine. First I was told I would have to wait for the 30 days again. I told the young man that it was not good enough and told him how I had contacted the collections agency. He then told me that I needed to prove that the account was not mine. I told him that it is impossible to prove a negative and that the creditor is responsible to prove that the debt is mine and that they are supposed to validate that information. I asked for a supervisor ( operator id XXXX ) and told him the same story as before. He too refused to help me so I asked for his manager. I was transferred to XXXX ( XXXX ) in the Consumer Affairs department who refused to assist as well. I asked again for a manager. I asked for verification of the debt that they had been provided in the validation of the original dispute. I was told they do not provide to the consumer. He told me to contact the creditor. I told him how I had already done so and they could not locate a debt that matched me. The XXXX operator then told me to get the creditor to provide a letter saying that I dont owe them anything. I told him it is the creditors responsibility to prove I do owe and not for me to prove that I dont. I then asked for information on how to contact the Consumer Financial Protection Bureau. He told me I would have to XXXX it. I also asked if the call had been recorded and was told it was. I asked for a copy or transcript and was refused.

Between XXXX and XXXX of 2018, I received a call from another XXXX XXXX located in Utah stating he was getting collection calls and mail for me regarding a medical debt. Somehow, this person was given my work direct line which was likely provided by the collection agent, and called me directly at work to notify me of the collection. I hadn't received ANY mail from this entity, so this was the first I'd heard of HMC group. I contracted HMC group directly and advised them that we'd actually spoken to the hospital and our insurance provider directly, and our insurance told us this should've been covered and no balance remaining, so we put our insurance into contact with the hospital in Ohio. We didn't think anything of it as we thought it was handled. I explained all this to the collection representative. At which point, a manager ( male ) took over the call, and asked how I wanted to resolve it. I explained the situation again to him and advised him I've received NO mail from them and asked them for validation of debt as I believed this was handled by our insurance provider. He ignored my request and continued to forcefully ask how I wanted to resolve. I told him I'm not doing anything until I receive mail from them and asked them why they were intentionally contacting the WRONG person when they likely already had my contact information. He got defensive and said if I'm not paying it will continue to damage my credit. Note I track my credit on XXXX XXXX and hadn't seen any medical debt notices, so I advised him it's not on my credit ( turns out XXXX doesn't report to XXXX XXXX, which is why I didn't see it ). He said he was going to personally 'make sure ' it's reported to my credit bureau then and then he hung up on me. So, in short, they're guilty of the following : - intentionally calling the wrong XXXX XXXX on the west coast in Utah and mailing my personal information to this other person, and providing my work direct line for this other XXXX to call me at work. - threatening and following through on actually reporting the debt to be CBR without providing any mail to me, or validation of debt which I requested.

I sent letters off on XXXX, to SOS GROUP for the alleged debts of {>= $1,000,000}, and XXXX that I do not owe and I have not heard from them nor received the requested information that I asked for. I never had any dealing with them nor owe them any money concerning any debt. Dear SOS GROUP DBA HEAD MERCANTILE CO INC : I recently received communication from you attempting to collect the above-listed alleged debt. Your initial communication to me in attempt to collect the alleged debt was within 30 days ago. Please be advised that I hereby dispute the validity of the alleged debt listed above in its entirety. I request verification of the alleged debt. Specifically, I request the following items for verification : ( XXXX ) a copy of a contract or agreement signed by me and the alleged original creditor that expressly authorized my legal obligation to pay the amount that you are now attempting to collect from me ; ( XXXX ) proof that you are authorized to collect the debt on behalf of the original creditor or as owner, which may include a debt collection contract, if a debt collector, or bill of sale, if a debt buyer ; and ( XXXX ) ( Audit Trail ) evidence and itemization of the amount due on the alleged debt, which may include proof of payment and receipt by me of any funds loaned or proof of charges for funds advanced for me. You are illegally attempting to collect the subject alleged debt because I do not owe that amount. Cease and desist all collection activity, including all reporting to consumer reporting agencies. Promptly request deletion of any and all prior reporting made to any consumer reporting agencies. If you comply with my deletion request within 14 days, then you are excused from verification. Send me a letter confirming your requests to CRAs to delete your reporting of the alleged debt. This letter and evidence may be provided to the Consumer Financial Protection Bureau ( CFPB ). The CFPB is authorized to investigate this fully matter and receive any related information herein. When I was a minor ( about XXXX years old ), I received care from a local XXXX in the XXXX Ohio region by the name of XXXX XXXX. Under the arrangement, I would go to XXXX appointments and they would bill my parents for the appointment. About a year and a half ago ( at which point I am XXXX years old, which is a few years after I stopped going to the XXXX ) I noticed on my credit report a debt in collections. I called the collection agency and found out the debt was sold to them by XXXX XXXX. I knew this could not be legally my debt as I had never signed any agreement with XXXX XXXX to bill services in my name ( which is essentially opening an open-end credit account ), I never received statements from XXXX XXXX notifying me of the debt and its balance, and I was not of legal capacity to contract as a minor. After I found this out, I immediately sent a letter to both XXXX XXXX and the collection agency requesting debt verification. While the collection agency did confirm that they could not verify the debt and ultimately deleted the account, I never received any response from XXXX XXXX. About 6 months later or so, my brother calls me asking how to handle a debt in collections, and I find out that XXXX XXXX sold the exact same debt amount to the exact same collections agency and put it under my brother 's name instead ( and I don't even think he went there ). Regardless, XXXX XXXX is flagrantly violating TILA, FCRA, and other credit regulations related to the transparency, disclosure, and authorization of debt. When confronted by consumers about their violation of the law, they choose not to respond to the consumer, and instead try to pass off their faulty debt to a different party altogether. I believe it is in the best interest of all current and future consumers in a financial relationship with XXXX XXXX that their credit, billing, disclosure, and authorization practices are audited to ensure compliance with all applicable federal regulations.

I filed a previous complaint ( XXXX ) on XX/XX/2021 about deceitful tactics and abusive language by the representatives at The SOS Group. On XX/XX/2021 my complaint was marked closed and the response was that I would be contacted by the company. Later that day I did receive ( missed the initial call due to work, but played phone tag a bit ) a call from XXXX. He was kind enough but denied everything in my complaint. However the resolution offered was for me to update my initial complaint saying they resolved it and in turn, he would have the debt removed from my collections report ( which was a huge part of my initial complaint and he denied was ever promised ). I agreed simply because this absolutely destroyed my perfect credit which is another devastating blow after crippling medical debt. I updated my complaint praising XXXX in hopes he would stay true to his word. I received a call in XXXX that my automatic payment was declined for some reason and I needed to pay. I immediately did and called my bank after I got off the phone. They have no record of an attempted charge nor a declined payment. I cant think that this was an effort to prove I didnt follow through with my end of the agreement. It is now XX/XX/2021 and no effort has been made on the part of The SOS Group to follow through with their end of the agreement, the collections is still listed on my credit-the balance has decreased but it is still there. I am confident The SOS Group will again fail to admit their wrong doings and accuse me of lying. I am sure they will deny ever agreeing to this. I certainly would never have agreed to amend my review if this wasnt offered. Be aware when entering agreements with this group, they will absolutely lie and fail to live up to their word.

My son was taken to the hospital by his mother XX/XX/XXXX of XXXX. At that time my son was also covered under his mothers health insurance. I reached out to XXXX medical center of XXXX Ohio and said they would transfer the bill into my sons mother name but can not do so now that the bill was sent to collection. So now here I am almost a 800 credit score never missed a payment in my life and fighting to a bill that was not mine, if it was I would have taken care of it. XXXX Billing department told me that whoever brings in the child is billed, they told me my sons mothers name was on file who brought him in and should have been billed on. I came shortly later and payed the emergency room bill to help provide for my son. So my credit score takes a 100 point deduct and Im left to bare of that why? Im a victim of balance billing my XXXX. My initial complaint was filed in XX/XX/2021 regarding misleading, unprofessional and abusive language with the SOS group. My case was marked closed and I received a call from a supervisor stating that I was lying but if I modified the complaint they would remove the report from my credit. I agreed, only to save my once perfect credit. I asked if updating the complaint so show I was satisfied and they handled it properly would be enough. They said yes. I did so immediately upon hanging up. Two months later in XX/XX/2021 I filed a new complaint because they had yet to follow through with their end of the deal. Today, Monday XX/XX/XXXX I get notice the complaint was closed yet again with no resolution. The SOS group stated again that I was untruthful about my original complaint and that they got no noticed I rescinded the original complaint so at this point they will not be removing it. I have proof my original complaint was amended-exactly how I asked if it could be-and they are again not following through their end of the deal. So I called from my credit report and tried to talk to them since this was a workmans comp bill but the man was rude, verbally threatening. He called me a liar about it being workmans comp. When I got a copy of my credit report earlier this year I noticed several collection items from a company called XXXX XXXX. They claim that it was a debt from XXXX XXXX in XXXX, OH. I had no knowledge of this debt collection company until I pulled my credit report. I did my due diligence and researched FCRA and FDCPA laws. My findings conclude that by law I have the right to dispute anything on my credit report with anyone that furnishes information to the credit bureaus. The company that furnishes information are required to respond to the consumer. I have sent several letters to the XXXX XXXX and they have failed to respond to my disputes. I sent my first letter in XXXX of this year with no response from the XXXX XXXX Consequently they have failed to report to the credit bureaus my disputes when they updated my credit file twice in XXXX. On XX/XX/2020 I had the SOS Group ( Original Debtor is XXXX XXXX XXXX ) put a number of delinquent accounts under collection on my SSN. I moved in XX/XX/2020 and even after filing a change of address, I did not receive the collection letters. As soon as I did receive them, I paid off the collection immediately. I worked for a company named XXXX XXXX. I had insurance through them and the company was sold in 2020. The insurance switched over to the new company, XXXX. The insurance company changed from XXXX to XXXX XXXX XXXX XXXX. XXXX has been sold as well to XXXX. I have tried contacting someone on this and they tell me to contact the debtor. SOS Group tells me to contact XXXX XXXX. XXXX told me the account shows paid but when I apply for credit, I am being denied due to collections. I pay all my bills on time and pay my credit cards off monthly. I do not work with that company anymore. Since the buyouts, I think I may have fallen through the cracks with my complaints. This collection company has violated a lot of serious laws. They have admitted that they did not have my correct address in the previous complaint which was an inaccuracy and per FCRA section 609 any inaccurate information must be deleted. They continued to violated FCRA, they have sent me my medical bills without showing VALIDATION instead they sent verification. They also sent my medical information through email unsecured and sending my health information which is a HIPAA violation. I have contacted my state attorney and they have advised me to work this out with the company before they step into legal action. I will give them another chance to delete their negative reporting and send it back to the original creditor because I have never gotten a notice to validate before they put this negative reporting on my credit and it is affecting me in getting credit. I've had Two accounts that have not been properly verified from HMC Group, the first one is for {$3000.00} and the second one is for {$400.00} which was placed on my credit report on or around XX/XX/XXXX. I have disputed both items numerous times only to get a Verified response without written proof or my original contract signature with this company. I am unaware of the amount due and your bill does not include a detailed breakdown of any fees. The medical problem for which I scheduled a Dr 's appointment was from a work injury ; hence workman 's comp should have covered this bill. Also, I was never given a chance to dispute this charge within 30 days. I treated very poorly at this hospital, and ended up having my coworker wheel me out in a wheelchair. I have not received any documentation nor any phone calls. I had no notice of who they were or how I owed them. ON XX/XX/2020 I wrote HMC GROUP 2 different letters about some alleged debts that they are reporting on my credit that are not mine.I have neither receive any information nor has it been reported as disputed within the 30 days time frame by law.I would like for these inaccurate items to be remove from my credit report before i seek a attorney to represent me.I have attached a copy of the letters below.
