In XXXX of XXXX, my wife and I decided to explore enrolling in a debt management plan ( DMP ) as our monthly debt payments ( combination of credit cards, personal loans, auto loans, and mortgage ) outpaced our monthly salary earnings. I found XXXX XXXX XXXX ( XXXX ). I want to preface with the following : I am beyond grateful for the assistance of XXXX and the DMP system ; this company single-handedly saved our finances and helped us get on a path to being debt free. However, while XXXX helped us immensely, I also suffered a derogatory credit reporting by Happy Money ( HM ) during the process of setting up the DMP that decreased my credit score instantaneously by XXXX. I will explain the events and why I think the reporting of a missed payment by HM is unfair given the circumstances. In XXXX XXXX, we enrolled in a DMP with XXXX. I've provided the original signed DMP agreement. This DMP was set up entirely over the phone. A very friendly XXXX representative went account-by-account asking for details such as the company owning the credit card or loan, amount due, account numbers, etc. At the time, the representative indicated that HM participated in DMP 's and included this personal loan in the original DMP as you'll see in the DMP agreement. The HM loan, at the time, had a monthly payment of {$850.00} and an outstanding balance of {$13000.00} ; XXXX reduced the monthly payment to $ XXXXmonth ( page XXXX of DMP agreement ). My understanding on this original DMP setup phone call was that XXXX would reach out to all of the creditors in the DMP on my behalf, and negotiate on the estimated terms in this original DMP agreement. In the meantime, I was instructed to turn off all auto payments directly to the creditors ( which I did ) and enroll in auto deposit to XXXX to satisfy the monthly DMP deposits ( which I did ). While this process worked for all the other creditors, I had issues with HM. In XXXX, XXXX, my wife and I made our first deposit to XXXX between he original DMP setup call and then, I had not been informed by XXXX or HM that HM would not agree to the DMP terms. From the first deposit made to XXXX in late XXXX, XXXX distributed a payment of {$630.00} to HM in early XXXX XXXX. This was flagged in the HM system, and I received an email on XX/XX/XXXX ( Subject : Missed Loan Payment ( 1st Notice ) ) since the XXXX payment was missed. At the time, I was under the impression that XXXX was managing all discussions/negotiations with the creditors on my behalf, and unfortunately, disregarded this as I was in good standing with XXXX, and XXXX never reached out to me to notify me that HM was not willing to participate in the DMP. In XXXX, XXXX, my wife and I made our second DMP deposit to XXXX, and another {$630.00} payment was sent to HM in early XXXX XXXX. In early XXXX, I began receiving debt collection calls, and acted immediately to remedy the situation. I was notified of the attempt of HM to collect past debt, and saw a report on my credit report of a missed monthly payment to HM. This single reporting reduced my credit score by over XXXX. As the record will show, I immediately paid HM directly in early XXXX XXXX to get my account back into good standing. I also sent an email to XXXX following up with them in early XXXX XXXX since I received debt collection notifications from HM but HM was still included in my XXXX DMP and I was never notified by XXXX of issues with HM and the debt management plan agreement. I was in the dark, and assumed the agreement with XXXX stood, and that my monthly deposits to XXXX satisfied all my debt payments. I came to learn, through a phone call with HM in early XXXX XXXX, that HM does not participate in DMPs, and never agreed to the plan proposed by XXXX. This was 2-3 months after initially setting up the DMP with XXXX. Unfortunately, the lack of follow-up communication from XXXX, and the unwillingness of HM to agree to the DMP, led to me unintentionally missing a payment to HM. I am seeking support as I do not believe that a missed payment reporting to my credit score is fair and accurate. I did make a payment, through my XXXX DMP deposits, under the understanding that HM was part of my DMP. I had the money to make the payment, and never intentionally withheld payment from HM. As my credit record will show, I have a pristine record across +20 creditors on payment history, never once missing a payment on a credit card, personal loan, mortgage, auto loan, or student loans. I am trying to build my finances back up from the lowest they were, and XXXX and the DMP has been instrumental in helping me, but this missed payment reporting from HM is holding my credit score back majorly. As a result, my wife and I are unable to get favorable car loan terms, and credit cards. Today, I am proud to say that my wife and I paid off our DMP with XXXX in full, years ahead of schedule, and we are on track to finish paying off the HM loan in the coming months. My record with HM and with all of my other creditors will show : I do not miss payments. Please help me remedy this misunderstanding, and inaccurate reporting to my credit report brought about from miscommunication between me, HM, and XXXX. Thank you!

I opened this account on XX/XX/XXXX, and made on-time automatically withdrawn payments every month. The monthly payment amount of {$600.00} was automatically deducted from my account every XXXX of the month with no issues. When I called the company on XX/XX/XXXX to pay off the account, my monthly payment had not been received and did not reflect on the balance of my account. The representative, XXXX XXXX who is pictured in the email from the company, informed me that my payment had not yet been received from my bank. She could not give me a payoff amount that included that XX/XX/XXXX payment as being received and applied to my account. She suggested that I stop payment on the auto draft with my bank, otherwise, it would take 4-6 weeks for me to receive a refund of my payment. The payoff amount did not reflect my XXXX payment. The payoff amount was calculated to include the full amount due prior to my XXXX payment to close my account. I set up an automatic payment with Happy Money , Inc. representative, XXXX XXXX, to be deducted from my account on XX/XX/XXXX in the amount of {$13000.00}. I received an email confirmation of this amount with the statement that this amount would pay my account in full. This account was paid in full on XX/XX/XXXX with an ACH payment taken directly from my personal checking account. In XXXX, I received a phone call from Happy Money , Inc., stating that my payment is past due. I called the company and spoke with a representative to discuss this incorrect information. I provided the representative with the email confirmation, proof of payment that my account was paid in full. Furthermore, I provided confirmation that my credit report reflected that this account was paid in full. The representative apologized and said that there were notes in my account that proved the information I was providing was accurate and that my account will be updated within 6-10 business days. In XXXX, I received another phone call from Happy Money , Inc. stating that my payment is past due. I called the company and spoke with a representative to AGAIN, discuss this incorrect information. I provided the representative with the email confirmation, again, proof of payment that my account was paid in full again, and confirmed with the representative that an error was made by the company regarding this account. The representative apologized again and confirmed there were notes on my account that proved the information I was providing was accurate and that my account will be updated within 6-10 business days. Now, in XXXX, I received another call from Happy Money , Inc. stating that my payment is past due. I called the company and spoke with the representative again, to discuss this incorrect information and provide my proof of payment in full. I was on the phone for over an hour, waiting, on hold with this representative who was getting the information updated. When the representative finally got back on the phone, she said that there was an error on my account and that my XXXX payment was never received. I discussed with her the entire conversation and explained the events that happened on XX/XX/XXXX with regard to the payoff amount. I explained that my credit report reflects that the account was paid in full; had a letter of payment in full with the amount that included all monies due prior to my XXXX payment. I explained to her that XXXX XXXX, the representative, suggested that my auto draft be canceled, otherwise my refund of my payment would take 4-6 weeks to be returned. This representative then said that the amount I paid was not including my XXXX payment and that my XXXX payment was included when the payoff amount was given. I disputed that information and she said that it was a mistake on their part. I told the representative that I paid for a stop payment fee, at the suggestion of her company, as the payoff amount did not show that I made a payment in XXXX. This representative then said that she was going to reopen my account on my credit report and change the status unless I paid the {$600.00} to her that day. This representative refused to accept my payment in full letter, the amount that was included in my final payment and has since reopened this account on my credit report and has reported my payments for the last 2 months as late, thus, my credit score has dropped over XXXX points. I have a payment in full letter from this company, proof that the account was closed on my report, and confirmation that the payoff amount was received and the account is again, paid in full. My next step, if this is not reconciled with this complaint, is to pursue legal remedies as this is affecting my ability to gain credit. Attached are copies of my credit report, reflecting the account from Happy Money , Inc. as paid in full and a copy of my email confirmation of payment in full.

As of today I have 4 consecutive late payments listed on my 3 credit reports. These late payments are being reported inaccurately by Payoff and are negatively affecting my credit score at no fault of my own as I have been making monthly payments as you will see from my attachments. I have tried multiple times to have this resolved including contacting Payoff via email, phone, and disputing via a credit reporting agency. After viewing my credit report in XXXX and noticing a late payment listed, I reached out to Payoff/Happy Money via the email inquiry on the site page. The correspondence with XXXX revealed that although I had scheduled a payment in XXXX, Payoff was having " drafting issues '' and my payment was one of the few that were scheduled by not received by Payoff-no fault of my own. I was not notified by Payoff and due to my busy schedule I did not notice until later. I am in the habit of checking my credit score/report as often as I can. With the pandemic I am able to check weekly on XXXX. I have attached all payment confirmations from Payoff from XXXX until now. I was then told to by XXXX to contact Payoff 's customer service number to rectify any issues with credit reporting. Short on time during the day because of my work schedule at the hospital, I decided to submit a dispute through XXXX to see if that would help resolve the issue. It was unsuccessful. I then contacted Payoff again via the customer service line in XXXX. I explained the issue to representative about the continued late payments being reported inaccurately despite me continuing to make payments. The customer service rep spoke with a supervisor and told me he would be able to skip XXXX and XXXX 's payments and add them to the back of my loan in order to get my account " up to date. '' Below is the confirmation from that conversation. While I appreciated that, I did not have a lot of trust in Payoff by that time. I continued to make Payments in both months to avoid any inaccurate reporting by Payoff. Yet and still both these months are still listed as late on all 3 of my credit reports. Most recently I called and spoke with XXXX at Payoff in late XXXX who confidently assured me that my XXXX payment would not be reported as late because she saw my scheduled payment at that time. The payment came out on XX/XX/XXXX. She said that she saw the " XXXX and XXXX skipped agreement '' and that as long as my XXXX payment was not 30 days late it would not be reported. My XXXX payment was NOT 30 days late. My payment is due the XXXX of every month which would make my payment exactly 20 days late. Yet, I pulled my credit report on XX/XX/10 and 2/3 credit bureaus ( XXXX and XXXX ) showed that my XXXX payment is 30 days overdue. When I spoke with her about my frustration back in XXXX she told me to email " XXXX XXXX XXXX '' to get the inaccuracies resolved. She was kind and helpful, however when I look at my credit report I can't help to wonder if I'm being mislead by Payoff/Happy Money. During a time when people are struggling to make ends meet and keep up their payments to avoid negative consequences.-this is unacceptable and infuriating! I'm a registered nurse supporting families suffering from the Coronavirus pandemic. Between my kids home doing virtual school and the stress of my job- the last thing I need when I come home is added stress at no fault of my own. After emailing Payoff I received an email tonight from XXXX telling me the same story about my payments being 30 days late when they are not. He told me to dispute with the credit agencies. No resolution and it was almost as if they did not read my email in which I provided ample screenshots of my scheduled and debited payments from my account. Payoff has seemed created a domino effect with their " drafting error '' and fraudulently reported my XXXX payment 30 days late when it in fact is not. After some research I am not the only customer who has suffered from these same credit report inaccuracies.

In XX/XX/XXXX I took out a personal loan with Happy Money and entered into a contract to repay {$330.00} monthly with the payments to be made on he XXXX of each month by automatic withdrawal from my checking account. I didn't have any problems fulfilling the terms of the agreement until in XXXX my employer discovered an employee embezzled money from the practice which affected all employees salaries also I had to make car repairs which also caused financial strain and setback. So on XX/XX/XXXX I visited Happy Money website and noticed that they offer financial hardship programs which allow you to skip payments and the amount is added on to the end of the loan. So I applied and signed documents that agreed to have XXXX payment of {$330.00}. XXXX added on to the end of the loan. I received confirmation that the request was approved. On XX/XX/XXXX this company deducted the full amount from my checking account on XX/XX/XXXX I called and spoke with XXXX XXXX and asked why was the money deducted from my checking account after I have documents signed to skip this payment. He stated there was a system error and I asked why wasn't I notified. He responded because I wasn't on the phone when this happened so the agent didn't know to call me. I then asked him to provide me with something proving that this amount was not added to the end of the loan and that the contract I signed was voided, he stated that he couldn't he then provided me a email that states they apologize but the skip payment process requested on XX/XX/XXXX did not process due to system error. I explained that this has really put me in even a more difficult situation, he apologized and stated the company is aware of the problem with their system and were repairing it so this will not happen in the future. He stated that I could apply for another financial hardship and skip XXXX payment which will help me out. I told him I will think about it and if I needed to I will apply again. On XX/XX/XXXX I applied again and signed documents which skipped XXXX and XXXX payments. Earlier today XX/XX/XXXX I received an email which says my XXXX payment is due in a few days. I called and spoke with agent XXXX and asked him to explain to me what is going on with this company. He too told me their was a system error but once again I have documents signed by me and their agent saying that the request was approved. I told him that what they are doing to consumers is fraudulent. They are preying on consumers during a time when they are most vulnerable by deceiving consumers into thinking they can skip payments but actually they are having us sign additional loan documents which will only benefits their company Once you've signed agreeing to have the payments tacked on to the end of your loan they still deduct the full amount from your account for the months you were approved to skip. Therefore causing the consumer to make additional payments and pay more interest to this company. I also asked that he provide me with a payoff amount he said I can give you two dates, Next XXXX or Next XXXX I told him just give me the amount he then responded being facetious, " do you want the dollar amount ''? I know that this company is fraudulent and I am being taken advantage of because I have three loan documents I have signed agreeing to skip payments but the money is still being deducted from my checking account and they will not provide proof these contracts are voided. I can't believe I put my trust in this company. Its sad people don't care how they treat another human being and the worst part they go home and sleep at night.

According to the Fair Credit Reporting Act 15 USC 1681 section 602 that states : " There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. '' XXXX, XXXX, and XXXX are consumer reporting agencies, I am the consumer and I have the right to make sure my private information isn't shared which is backed by 15 USC 6801 that states : " It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. '' XXXX XXXX, XXXX and Happy Money Inc is a financial institution by definition under that title. 15 USC 1681 in section 604 a section 2 states that " In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. '' Happy Money Inc, XXXXXXXX XXXX and XXXX and the Consumer reporting agencies XXXX, XXXX, and XXXX did not have my consent to furnish this information and they surely do not have my written consent. Any and all consent to XXXX, XXXX, and XXXX whether it be verbal, non-verbal, written, implied or otherwise is revoked. 15 USC 6802 ( b ) ( c ) clearly states " A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless the consumer is given an explanation of how the consumer can exercise that nondisclosure option. '' XXXX XXXX, XXXX and Happy Money Inc never informed me of my right to exercise my nondisclosure option. Also 15 USC 1681C ( a ) ( 5 ) states " Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. '' This account is an adverse item they are reporting again without my permission which is against the law. 15 U.S. Code 1681s2 ( A ) ( 1 ) A also states " A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. And 15 U.S. Code 1681e states " Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title. XXXX, XXXX, and XXXX are not maintaining reasonable procedures. 12 CFR 1016.7 states that " A consumer may exercise the right to opt out at any time. '' I am opting out of your reporting services. XXXX XXXX XXXX has failed to assist my son with his account from the first payment due back in XX/XX/2022. XXXX XXXX XXXX gave verbal authorization to allow XXXX XXXX to be on the account due to being the legal gaurdian due to XXXX 's traumatic situation. The company continued to e-mail him and call his phone when he did not know who it was and plus he works at night at XXXX and tries to sleep during the day as a result of how hard the job works him. I have e-mails and phone logs where the company responded to me barely a handful of times. I even attempted to make payments over the telephone from the beginning of the first payment due until XXXX Bank stole two rental car holds for {$500.00} each and never gave the money back so I had to pull all of my family accounts out of the XXXX bank which was four accounts. I contacted XXXX XXXX personally, explained the banking situation through telephone and tried to make the first payment with debit card but they would not except it. On a recorded call, I personnally stated that I did not want my son going into the credit bureau which the represented who was a male assured me he would not but the company placed XXXX into the credit bureau behind his back. At no time would they accept the debit card payment. In addition, the website blocked us from making the bank changes online. It kept stating the first payment had to be completed under XXXX before it could be changed which XXXX was closed. The company never offered any payments to be sent in by mail nor a representative to accept the money by telephone which was just now told to me a week and a half ago over the telephone. I informed the representative, no one ever offered, all the information ever disclosed was that the first payment had to be paid through the portal which the company knew we were having issues with. and I consistently reported, reached out for help and no resolution. Happy Money was going behind my e-mails and calls contacting my son and would not reach out to me. There was a 5 questionnaire completed which XXXX and I did and sent it back from my e-mail and per their request, screenshots for closed XXXX Banks were sent. Unfortuantely, it was past 45 days until the company supposedly unlocked the account where I did go in an input the new banking information. Yesterday and last night we attempted to make another payment and the company blocked us again. This time pictures were taken to prove it. This is bad business and the company is not to be trusted. The error is on behalf of the company and they need to work with my son and I and pull him out of all XXXX credit bureaus because they are using deframation of his character and destroying his good credit. His credit was at XXXX and now it is in the XXXX 's as a result of XXXX XXXX 's negligence and unfaithful practices as a loan company.

ood afternoon! I must say I am very frustrated with THESE COMPANIES. I have been trying to get a loan with THEM for years. Even when I had a XXXX to XXXX XXXX XXXX, I could never get loans with you. I have been wondering for many years that maybe it's just me and maybe it's my credit. I have been going years and years with disputing things off my credit and getting my credit as high as ever. I have done everything to try to make my credit manageable, and I have still BEEN turned down for a loan every time. So now we are gon na do things my way! Let me inform your company of some Laws protecting consumers. XXXX cfr part XXXX talks about the Equal Credit Opportunity Act. Consumers by law can not be denied credit. By law you all can not deny me credit transactions for any applications. Please see the screenshots below I am a CREDIT WORTHY APPLICANT. Individual accounts can not by law deny me credit. This is DISCRIMINATION. I have many adverse action letters even from when my credit was even in the mid XXXX and I was still getting denied. So it makes me think who is responsible for this, the credit bureaus or your company.. Please refer to the other screenshot below. Adverse actions are illegal amongst consumers. Adverse action : ( ii ) does not include ( I ) information solely as to " transactions '' or experiences between the consumer and the person furnishing the information; or ( II ) information in a consumer report. These are transactions that I have applied for for years and I was turned down everytime. This is {$1000.00} per violation if I pursued this towards court. This is 15 u.s. 1681m. Please view that as your company has broken this law and has resulted in me being denied for credit over and over. My SSN is my credit card which has been unauthorized by your company, bureaus etc. So you all can make money off my ssn but I can't benefit from credit transactions which are illegal!! Loans, Mortgage, car notes etc are extensions of credit transactions! There is civil liability for violation of these laws! Please see 15 usc XXXX. I posted the screenshot below I have been denied credit from you for years and I refuse to be denied again. Please forward this to your manager or corporate and have them contact me immediately! I want a loan of {$50000.00} or higher. I deserve that amount for all the years of frustration your company has caused me!!! I also want to get some credit cards to improve my credit asap! Please don't make me go to higher authorities and take you to court like I may soon do with the credit bureaus. If I take you to court, I have consumer rights attorneys waiting for a case like this. I finished paying on XX/XX/XXXX after a charge-off of {$1400.00} that occurred in XX/XX/XXXX. The servicer XXXX XXXX reported the receipts to me as I paid it down. I rejected the offers to settle for less than the full amount, instead opting to pay my debt down to {$0.00}. After the data was not refreshing on my credit I contacted XXXX XXXX, who redirected me to XXXX XXXX ( previously XXXX ) whom was the debt recipient and reported the it incorrectly to the credit agencies. The front desk option never answers, so I disputed the results. XXXX dropped my credit 80 points once the dispute returned, indicating 1 ) Comments : " paid in full for less than full balance '' 2 ) Status : " Paid in settlement. {$1400.00} written off. '' 3 ) On Report : " Charge Off as of XX/XX/XXXX '' ( when the charge off occured on XX/XX/XXXX ) and the payment in full occurred XX/XX/XXXX. XXXX also dropped my score 80 points. I contacted XXXX XXXX over a dozen times. I was told that the dispute was corrected on XX/XX/XXXX, and it is now XX/XX/XXXX. XXXX XXXX insists, that it is always considered a settlement, even if paid completely, after charge off. I have called XXXX several times, uploaded multiple documents and evidence from XXXX XXXX claiming that I did in fact pay it down to XXXX. XXXX says I should dispute again and start all over from scratch and give them another 30 days. I am in serious need to fund medical issues, to avoid cutting off my relative from XXXX XXXX. People I have spoken to both at XXXX XXXX and XXXX are aware of this issue, yet they both refer me to speak to the other party, which I do speak to both repeatedly. XXXX says that based on the information XXXX XXXX sends them, that it shows that I settled for LESS THAN the full amount, and that text apears on my credit report. The dispute was XX/XX/XXXX sent electronically, the dispute has exceeded 30 days from the date that XXXX XXXX sent the response to XXXX, and they insist that this is the correct way to mark it as settled, and the comment that says " paid in full for less than full balance '', they believe that it is now fine what they sent and corrected even after re-investigation. I ask that they delete this, having exceeded 30 days to fix the issue and severely impacting my ability to borrow, and I have had to get one very small loan was the best I could get was at 59 % APR interest, so this reporting matters both in financial impact to me, as well as medical impact of continuting life support for my relative. Please help fix it.

Happy Money , Inc. reported to XXXX on XX/XX/2023, that my accounts outstanding balance was {$18000.00}. Happy Money Inc.s records, according to their online portal, reflected my accounts outstanding balance to be {$16000.00} as of XX/XX/2023. My monthly minimum payment is {$1200.00}. The difference between {$18000.00} and {$16000.00} is {$2400.00}. Happy Money , Inc.s reporting of my accounts outstanding balance is 2 months in arrears and ultimately, inaccurate. However, Happy Money Inc.s credit bureau reporting of my accounts outstanding balance, as of XX/XX/2023, 2 months in arrears and ultimately, inaccurate. I filed a dispute through XXXX online portal on XX/XX/2023, trusting that Happy Money , Inc. would accurately report my accounts outstanding balance to XXXX, and the other credit bureau reporting agencies. XXXX provided me with results of my dispute on XX/XX/2023. XXXX stated, The company that reported the information has certified to XXXX that the information is accurate. This item was not changed as a result of our processing of your dispute. Please review your report for the details. Inaccurate credit reporting can materially and adversely impact consumers ability to access credit markets, obtain the best interest rates, increase insurance premiums, and impair ones ability to maintain or obtain employment. Happy Money , Inc. has a legal responsibility as a credit data furnisher, to accurately report consumer information to the credit reporting agencies. I applied for and received a Payoff loan in XX/XX/XXXX in the amount of {$34000.00} ( after financing fee ). I made regular monthly payments of {$1100.00} until XX/XX/XXXX when the global pandemic happened, at which time I suffered a financial hardship and was unable to make payments. My principal balance at this time was {$19000.00}. I contacted Payoff and was granted a skip payment so I would not be responsible for paying the loan nor getting further under water with accruing interest. After a few months of skip payments, I pursued a loan modification that reduced my payment to {$25.00} for three months ( XXXX - XX/XX/XXXX ). When I made that payment in XX/XX/XXXX, my new principal balance was {$19000.00}, {$25.00} less than what it was nine months earlier. I still was not in a position to resume payments of more than {$1100.00} per month so I then went through a several month process of modifying the loan to reduce the payment to {$820.00} by extending the maturity date. This occurred in XX/XX/XXXX. I then resumed monthly payments of {$820.00} in XXXX and eventually noticed that my XXXX, XXXX, and XXXX payments totaling {$2400.00} weren't lowering my principal so I reached out to Payoff and they told me that my payments were going solely to " accrued interest. '' This is the core issue. Never was it disclosed to me that interest would be accruing when I began the skip payments and loan modifications. Never was it disclosed to me how much interest was accruing and that my resumed payments would go solely to said interest. I still have seen no accounting nor statements detailing such accrued interest and I find it odd that the amount of accrued interest is conveniently the total of 3 of my monthly payments. This feels like robbery to me. My Truth in Lending document states that the cost of my credit for this loan was to be {$6100.00} and I've already paid them more than {$6700.00} in interest to date. I believe they incorrectly and illegally charged me interest when they said I would not be subject to interest, they never disclosed any information to me via statements or through my customer portal, and despite my attempts to resolve the issue directly, they will not take any action.

I am requesting this complaint to be reopened due to the unfairness of the individual at the Consumer Finanancial Protection Bureau who closed the case when we reached out to request the company to pull the account back into their office and work with us in getting the account caught up due to Happy Money not assisting us in getting the payments made when calling in and emailing. The company failed to offer any other method of payment which was reasoning for the account going into default. Consumer Financial Protection Bureau failed to request the copy of the document signed by XXXX XXXX providing me XXXX XXXX permission to speak on his behalf on his account. Happy Money is negligent in how the company mishandled in how the account was blocked from making payments. In this dispute, the company came with a legal guardian reasoning in not to work with us in getting the account caught up. The concern is, by selling this account off, is the company making their money in why Happy Money has been so resistant in helping us to get into the account. Even when we went into the account on the XXXX of XXXX to try and make a payment after my banking information was updated, the company quick responded they closed it on the day before which does not make sense. There has been an oversight by Consumer Finanancial Protection, Bureau because when I responded to the company in not majoring on utiliziing the Power of Attorney as an escuse to help us in getting the account caught up, the company never responded with an alternative in doing everything to assist us with the account. I do no see how the Consumer Finanancial Protection Bureau did not address this but just closed out the complaint. This is exactly what we were dealing with in the company neglecting to work with us in getting into the account prior to it getting so far behind all the way up until it did get XXXX or more months in the hole. I am requesting the case to be reopen and Happy Money to send the document XXXX XXXX XXXX signed online to have me addressed his account due to his XXXX. And the company stop resisting to help us catch up on the payments by so quickly selling the account off.

The company had switched my payments from monthly to bi monthly to accommodate my job loss over one year ago. The past two weeks I have been getting late payment emails and received a credit alert on XX/XX/XXXX indicating there was a credit hit from payoff. I called payoff and after further investigation, the rep informed me that back in XXXX, when they switched payment plans, it looks like a portion of the minimum due was overlooked. This was news to me because for the past year, I have called in my payments monthly to a representative and no one has told me that. The representative apologized and said that I need to dispute the credit hit but as a courtesy, she will waive the XXXX payment that is due in the amount of {$490.00} if I can pay the assumed overdue of {$490.00} from XXXX, putting me back on track. I agreed and authorized {$490.00} to be paid on XX/XX/XXXX according to their pay schedule as payment has to be received before the XXXX of each month. Then on XX/XX/XXXX, I received an email confirmation of my pending payment of {$490.00} to be withdrawn on XX/XX/XXXX ; however, the amount they logged in was {$4900.00}. I immediately called them and was extremely upset because I dont have that in my bank acct and furthermore, thats not what was agreed on. I spoke to a manager named XXXX XXXX who said he could do nothing on his end and to call my bank. I called my bank and spoke to a supervisor who escalated the issue and stopped payment of the {$4900.00}. Then I received another email that evening from payoff indicating that they made a mistake and payment was really {$490.00}. I answered back that the {$490.00} cleared my bank as of XX/XX/XXXX and XXXX payment was skipped per my conversations with them on XX/XX/XXXX. I am writing to file a complaint against XXXX XXXX XXXX ( " HM '' ) for violation of the Fair Debt Collection Practices Act ( FDCPA ), specifically 15 USC 1692c ( c ) and 12 CFR 1006.14 ( h ) ( 1 ). HM is a credit services organization and as per their own admission, they act as an intermediary between a XXXX XXXX and the consumer, and do not extend credit directly or indirectly. This role, coupled with their admission of being a debt collector, brings them under the ambit of the FDCPA. On XX/XX/2022, I sent a certified cease and desist letter to XXXX ( Certified Mail Tracking # : XXXX ), asserting my rights under 15 USC 1692c ( c ) and requesting that HM communicate with me solely through written mail and only when the communication pertains to my remedy. Despite my explicit request, HM has continued to breach the guidelines set by the FDCPA. They have recently sent me 3 emails concerning the alleged debt, which is a clear violation of 12 CFR 1006.14 ( h ) ( 1 ). Additionally, they continue to report to my credit report, which according to the definition of " communication '' under 15 USC 1692a ( 2 ), constitutes an indirect conveyance of information about the debt. 15 USC 1692a ( 2 ) as it states " The term communication means the conveying of information regarding a debt directly or indirectly to any person through any medium. '' I believe these actions by HM are a clear violation of my rights under the FDCPA. According to 15 USC 1692c ( c ), a debt collector must cease communication upon the consumer 's request, except for specific circumstances which XXXX has not adhered to. In addition, per 12 CFR 1006.14 ( h ) ( 1 ), a debt collector must not communicate or attempt to communicate through a medium the person has requested not to be used. I respectfully ask the CFPB to investigate these practices and take appropriate action to protect my rights as a consumer. On XX/XX/XXXX, I applied for a debt consolidation loan through payoff.com. The loan was approved for {$22000.00} over 36 months. The loan came with a rate of 6.99 % and an origination fee of {$110.00}. A monthly payment of {$670.00} was set up for automatic deduction. I was told that manual payments were not an option. The first payment was due XX/XX/XXXX and then the due date was changed to the XXXX of each month starting in XX/XX/XXXX. Payments were deducted automatically on XX/XX/XXXX and XX/XX/XXXX. The problems began when on XX/XX/XXXX they deducted an additional payment of {$670.00} without my authorization or approval after having already deducted the scheduled payment for the month. This deduction had an impact on my bank account as it was not a scheduled or planned for expense. They were contacted and said that it was an error on their part and that they would refund the amount, which was refunded into my account on XX/XX/XXXX. Their website continued to say that my next payment date would be on XX/XX/XXXX after the date had passed and the payment had been made. I had concerns regarding their business practices and called to followup.I called on XX/XX/XXXX at XXXX and XXXX, and then received a call back at XXXX. During these calls there was discussion on the fact that I was mischarged again and that I was concerned regarding my upcoming payment as it still said the XX/XX/XXXX was my next due date. They assured me that it was an error and they were working on it and that my account was in good standing. On XX/XX/XXXX I received a text message saying that my payment was now past due despite all these conversations and my concerns that were shared. I called them on XX/XX/XXXX to discuss that I had received this alert and could not get an answer and was told I will get a call back and never hear back. This complaint concerns Payoff ( https : //www.payoff.com/about/contact/ ) For the past several months, I have been receiving invitations from Payoff, via email and postal mail, to apply for a loan to pay off some or all of my credit card debt. These invitations have been accompanied by a unique invitation code, which I am asked to enter on their website to begin the process of applying for such a loan. Repeatedly over the past several months, every time I have entered my invitation code, my application is blocked with an unspecified error, and I am directed to contact Payoff via its live customer support chat. Each time I am told the exact same thing : that there is a " technical problem '' with my account, and that their " engineering team '' will look at it and that I will hear back from Payoff within a few days. Each time, this has NOT happened. Nobody ever follows up with me, either by phone or by email, or via any other means. The same issue has continued when I have attempted to email Payoff ( repeatedly since XXXX ) : I am told there is a " technical problem, '' the " engineering team '' will look into it, and that I will hear back from them ( yet I never do ). The same has also happened when I contacted their phone support. I spoke to them twice by phone, only to be told in the end that it is a " technical problem '' that their " engineering team '' needs to look into and that they will contact me. Again, they never have. Perhaps I shouldn't, as this poor level of customer service is a red flag, but I would like the opportunity to at least apply for a Payoff loan, but have found absolutely no recourse so far in attempting to do so.

On or about XX/XX/2021 I applied for a debt consolidation loan with Payoff.com. They initially offered me a rate of 6.65 % for 36 months on a {$40000.00} loan which is their lowest rate for this term and amount. This loan was meant to pay off some existing obligations - thus the debt consolidation. I have an 800+ credit score, and an income in the top 5 % nationally ; furthermore, I have an impeccable record of paying my obligations on time. Per their requests, I submitted W2, Paystubs, and other related documents ; however, they declined my loan request, on the basis that I had a hard inquiry on my credit report. This inquiry was associated with me shopping around with my current lender to see how they compared to Payoff.com 's offer. I believe that they are redlining me and effectively denying me credit that would otherwise be available, because I chose to exercise my right to shop around with their competitors. I believe that their actions are in violation of Fair Credit Reporting Act, and beyond the scope of Truth In Lending Act, by not disclosing that such inquiry could have adverse impact. Their actions are anti-competitive and hypocritical to their stated mission. I contact them via email and phone on XX/XX/2021 with regards to this situation and their supervisors and team leads only read me jargonesque filled responses and did not try to help nor did they provide a positive adjudication even though the facts would warrant otherwise. Happy Money ( PAYOFF loans ) issued me a loan which they make it difficult to make final payments and caused my account to incur additional interest. They will not issue a 30 day payoff which does not appear to cause additional interest except for the fact that their website does not allow me to make the last smaller payment to close out my account. My account shows past due even though I made a large payment in excess of the actual amount due a week before the due date. When I attempted to make my last payment, Happy Money does not allow to make a small payment and only allows for the regular monthly payment. My options from the website are to over pay hundreds of dollars or contact them to setup the payment. This again causes increased interest to my account. The first time I reached out to the company I received a response that they are closed for 2 days due to a company outing. More interest. When they got back to me the payment could not be scheduled for a few more days. More interest. All of this extra interest might be a small amount but they are doing this to multiple customers. I found this out by looking at social media and found others complaining of my same situation. This makes me feel that it's done on purpose to increase profits. I have included 2 screenshots. One shows that I made a large payment but yet the website still says I'm past due. The second shows that I'm unable to pay the {$81.00} balance. The {$81.00} has additional interest because I was unable to pay using the website but they do not provide a statement that shows this.

On XX/XX/2019 I authorized an online payment from my checking account. I noticed it had not come out. I called them. forwarded them the confirmation email that I received. they then took 2 weeks to figure it out while calling me saying I was late. They finally took it out on XX/XX/XXXX and did not effective date it for XX/XX/19 when I originally made the payment and provided such proof for. For XX/XX/2019, I called and advised them I needed to make a payment from a different checking account due to a XXXX XXXX issue and a protective order. they took the month from the account I specifically asked them not to touch ever again. I called back and had to wait for my ex to be refunded and then be able to make a payment from my account. This is a huge hassle because we are unable to speak to each other. I called last week and advised them he was threatening to have me arrested for something that is none of my fault. Via a mediator I was able to calm him down and reassure his money will be refunded. Payoff stated it was a back office issue. Low and behold, they call me yesterday and set up a payment for today and I ask several times if it is coming from the XXXX to avoid another issue. Well, its pending today from my ex 's account. And the police are on their way here. This is ridiculous. This is a follow-up of claim with the reference # XXXX, Happy Money is negligent where the company entrapped my son by disregarding the account was falling behind from day one and the automated emails I did receive, they would inform me someone would be getting in touch, but no one never contacted me to resolve the issue. The reason for the word entrapped, is the companys failure to assist us correctly but recently claiming the account was charged off around the XXXX a day before my payment attempt. Their excuses are they called and e-mailed XXXX XXXX XXXX but what is their excuse for not unprofessional conduct disregarding my son 's request to allow his mother who is his authority to handle the account? My other reason is, it was not until I spoke to a representative at the end or beginning of XX/XX/2022 when he finally comes out and states that they could have taken a payment over the telephone as an exception and why did I not mail the payment in. I informed him I was never provided the options. All I was told and redirected to do was to go into the portal to make payments when I constantly informed the company, I could not make payments online under the old account under XXXX XXXXXXXX XXXX. I am receiving constant notification via XXXX XXXX that this company is reporting my payment history as having past due payments on an account that was paid in full and closed in XXXX of 2021. I have disputed this information every month since XXXX with XXXX XXXX. XXXX XXXX would clear the incorrect information only to have Happy Money report it again within 30 days. This month they are now reporting incorrect payment history to XXXX. When I was a Happy Money customer, I paid them every two weeks and I was never more than 30 days past due. I have enclosed a sample of my bank statement for your review. I was told by the company that my payments were misapplied and this was causing the issue. It was a hassle to get them to fix it and finally they agreed and corrected the report BEFORE i paid them off. Their carelessness caused me to rescind doing business with them and pay the account off to prevent future mix-ups. I do not understand, why this situation has not been rectified by now and it seems to be getting worst. They reported me at 100 % payment history the life of the loan, then 96 % payment history and this month is now being reported at 91 % payment history after the loan was closed which is unacceptable. I have been trying to make my loan payment for weeks now. I have lost track of how many people I have talked to trying to resolve this issue. Their website was having problems so I scheduled a payment through them that they never took out. I attempted making the payment multiple times before this. They asked that I change my bank account on file so I added another. They said that it didn't work and to add a third bank account which I do not have. I had to change the bank account again and now they are saying it will take 5 days to change it. They have been spamming me with calls texts and emails about the overdue payment even though they know I have been trying to make the payment and the issue is on their end. In XXXX of 2021 I reached out to make a payment towards the principal of my loan. I paid {$10000.00} and there was still a high amount of interest taken from the payment. Today XX/XX/2021 I logged in to my account to make a payment towards the principal and I don't have the option to do that. The web portal only allows me to make a payment in full. I started a chat with a rep who stated I could make my payment and then make another payment in the exact amount ( in full ) and she thought that would go to principal. I told her I was not wanting to make another payment in full but just an additional amount of {$500.00} to go towards the principal of my loan. She said their web site does not provide that option to those clients who make payments manually but that their ( auto pay ) clients have the option to pay extra like that online. That I would have to mail a check that would need to be received within a certain timeframe for it to work for me. I told them I should have the same option to make extra payments to the principal of my loan regardless of how I was set up to make my payments. I was approved for a personal loan for XXXX $ at 6.99 % APR, following a direct access to my checking account for income and identity verification by PLAID and hard enquiry on my credit report. To finish processing my application they asked me upload my valid drivers license, which I did, after 2 days they send me an email to call them at a given number, during the call based on my name the agent asked about my immigration status, which I replied I have a valid immigrant visa, he then asked me to upload a utility bill, I went on to their portal and uploaded, and then when I went on to check the status it asked me for SSN card to upload and I did, then every time I go on the portal to check status it kept adding documents to upload, my passport, visa, immigration approval document. I uploaded all of them valid documents a total of 7 and denied because the validity is not enough for the loan term 3 years +. I met their advertised criteria and a good credit score of XXXX, they discriminated against me and denied me just because I am an immigrant with reason given - no reasonable assurance to pay back, no where on their website or terms and conditions it mentioned one need to be a citizen or have a validity up to the loan term, I was mislead, played around, discriminated, and humiliated, they asked of unreasonable assurance that exceeds anyones ability.

A substantial payment was made on my Payoff account in the month of XXXX leaving a balance of less than XXXX on the account. Subsequently, I made a phone payment in XXXX meant to pay the account in full. This payment was to have been processed as if XXXX. Although the funds were deducted from my account, Payoff failed to post the funds to my loan. I called payoff regularly to follow up in this issue and have them correct their mistake. Although people I talked to acknowledged that there was an issue on the account, nobody was able to provide a hard time line for a resolution. Throughout this process, I was assured that my account was in good standing and that they would not be reporting my account as past due. Ultimately, it took payoff more than 39 days to fix their mistake. On XX/XX/21 I received notification through my credit monitoring subscriptions that I was reported 30 days late resulting in significant drops of my credit score. This is in the midst of looking to refinance existing debt to reduce my monthly expenses. Payoff failed to post funds timely, failed to correct their issue timely, and failed to protect me from negative impact they caused. I need to have this corrected immediately and to receive a confirmation of the correction both via email and in writing.

Payoff.com has adversely impacted my personal credit through predatory credit lending practices. I applied for a credit card consolidation loan and was given a rate of 9.99 % APR. A few days later, I was told that my application was completed and that I just needed to accept the loan. There was no mention of my rate increasing in their communications with me however when I looked at the fine print, my APR had increased to 11.99 %. When I brought this to the attention of their customer support, I was told that is a normal occurrence and credit rates are complex calculations. I did not accept the loan for a week to reevaluate my options given the change in rate. When I went back to their website, my APR had increased another 2 % to 13.99 %. Both of these increases had occurred in less than 2 weeks. I asked customer support why my rate increased and was told a very similar answer. I authorized Payoff.com to perform a hard inquiry because of false information that they provided me with. This has lowered my credit score and made it more expensive to attain the loan I am seeking. They claim to help people get out of debt but I am now in a worse situation because of false information that they provided.

I applied to skip my payment due XX/XX/2022. After I didnt hear back I sent the request again. After not hearing back for over a week I contacted the company by chat. The representative told me there was a problem on their end and they lost the documents. He manually processed them for me. I received a loan modification agreement that said XXXX was due for XX/XX/XXXX XXXX XXXX and that payments would resume XX/XX/2022. I signed it and shortly after received a signed copy from the company. I kept getting late payment notices. So I emailed the company, they responded saying my request was denied. I had spoken with the company in XXXX and we had a verbal agreement in which I was told I would be eligible for covid relief for XXXX, XXXX, and XXXX with payments restarting in XXXX. I was also told multiple times I would be sent documents to sign but never received them over the course of the covid relief period. Happy Money , Inc. is violating FCRA regulations by reporting fraudulent information on my credit. As per their request, I have sent them police reports, court documents & FTC affidavits documenting bona-fide ID Theft/ Fraud however they have failed to remove my account as other creditors involved have already done which has lowered my credit score by over 200 points. Happy Money, Inc. can not provide proper validation that is required by federal and Texas state law in order to credit report. They can not provide me with any original credit application or signed loan contract with my original signature displaying that I borrowed money or applied to borrow from them which is a strict violation of FCRA. All they can provide is online documentation with a computer generated signature -- nothing that connects the debt to me legally by original signature as strictly required by Texas Finance code. I have a personal loan with Happy Money, and I set up a payment for XXXX XXXX, XXXX. It was not taken from my bank account nor was it reflected on my account. I received a text on XXXX XXXX, XXXX stating that payment was late. Thought it was no fault of my own, and an issue with their system, I went ahead and scheduled a payment for the same day. Being a Saturday, it would clear before Monday. On Monday, I received 4 emails, 2 texts and 1 phone call. I reached out to them because of the excessive nature after 4 emails. They agreed that it was a bit much, and their system is set up for single touchpoints daily and something was going on with my account. After receiving multiple invitations for a personal loan with this company I finally decided to see the terms on XX/XX/2021. The application process collected TONS of personal information, even my bank account details. This made me uncomfortable but I was under the impression this was the only way to see my odds of approval. In the end my application was denied and after chatting with representatives, was assured I would be removed from marketing communications. I also had to wait 36 days ( XX/XX/2021 ) for confirmation that any personally identifiable information not be sold to third party companies as is my right according to the California Privacy Law ( CCPA ), which I never received. Payoff.com, misrepresented how much I owed them in XX/XX/2019. When I refinanced my home, I sent them a check for the balance they quoted me also in XX/XX/2019. Turns out, they wanted {$66.00} more dollars. I tried to explain I paid the amount they said and they said well the quoted amount did not include interest. To be honest. This has been a complete horrible experience. Never jumped through so many hoops in my life, and then had someone from a company cause so many issues bc they canceled my application, without my permission, which should be no issue of getting my application done and approved, and now, being told they can not approve me, but yet I was approved! I was told it would be no issue to get the backend to reinstate my application. I see others online with the same thing that this company has done to them. I took at loan with XXXX XXXX and part of the process was to payoff existing credit cards with the proceeds. I has 6 credit cards and 5 of them were paid off with the proceeds and the balance of the proceeds were sent to me as agreed. There was one card that was not paid, XXXX XXXX. I call the company several time to ask when will the payment be made, I was told to wait 7-10 days. The after those 7-10 days I called and inquired again. I was told as soon as they receive confirmation that payment was rejected by the creditor, the funds would be deposited into my account so that I could make the payment. That time has elapsed and still no payment or deposit into my account, I was event told that they received confirmation that the payment was rejected in the system and I should be receiving the payment. Happy Money/Loan # XXXX was paid in FULL on XX/XX/2022. I requested that said loan reflect as paid in full to XXXX. Happy Money responded to XXXX that there is still a balance. On XX/XX/2021, I applied for a {$40000.00} to consolidate credit card debt that was mostly incurred due to a job loss from a 23 year employer. I used XXXX XXXX and the approval rating was 90 % that the loan would be approved. I provided all information they requested and was turned down for credit card debt. First, I was paying off the credit card debt and secondly, this debt was available to them when I initially went through the prequalifying process. I opened a personal loan with payoff a few years ago during some financial hardships. I have regularly made payments and then realized I was being charged extra interest and had fallen victim to a predatory loan company. I started struggling to make payments during 2020 as I lost my job during the covid pandemic. I am currently working again and need to catch up on payments. Now I am being harassed by the company and have received over 300 emails for debt collection. They are sending an email every 10 minutes for weeks. After seeing an ad for payoff.com loans to help lower credit card debt, I went to their website and applied for a loan. I was preliminarily offered a loan for {$25000.00}. I accepted the offer and submitted by bank account information for them to review for the loan. When payoff.com started reviewing my financial information they said only my income could be counted in offering the loan. I asked why my spouses salary did not count towards my household income and they said I could only count mine. And they couldnt confirm that they did not count shared household debt. Hello, I applied for this loan and faced some financial difficulties because my student loans became due. This company helped me by deferring my payments. However, this caused my payments to balloon. I was not fully aware of what was occurring when my payments increased. Now they are sending me emails saying I have options to pay off my loan. My complaint is that Payoff Inc by Happy Loans should not have closed my online access for my personal loan. On XXXX my bank cleared {$3900.00} as the payoff amount. The following days I could not access my account to confirm if my balance updated to XXXX. I took out a personal loan from this site, and on XX/XX/31 I paid off the remaining amount, which per their site was, XXXX. Three days later, it was still showing as pending, and I had to call customer service twice to try to push the payment through. They took a verbal confirmation and said it would go through today, XXXX. It didnt go through. When I called they attempted to charge me XXXX. I told them that I would not pay additional interest due to their system errors and after a lengthy back and forth with a supervisor, they agreed to charge the original amount. Happy Money took a second payment out of my bank account for the month of XXXX without my permission. The lender named Payoff Inc. under Happy Money has erroneously and falsely reported a negative month into my credit file with XXXX, and XXXX. They have told me that they only report when an account is 30 days delinquent. My monthly and semi-monthly payments towards my account with them have never been beyond 30 days late. I opened a loan with Payoff loans. I paid the loan bi-monthly. Payoff misapplied loans and caused the account to look as if payment was 30-59 days late. This caused my credit score to drop 89 points. The original amount of my loan was {$35000.00}, but with only a few months to go, Payoff began reporting that it was only {$3500.00}, NOT {$35000.00}. I submitted a final loan payoff on XXXX A week later, my account showed a {$0.00} balance and then a few days later I was no longer able to see the account anymore. I noticed that my credit report was not being updated to reflect the payoff and my report still shows a large balance. I asked the company to send me a letter to prove I have paid it off. They ended up rejecting my application because my XXXX XXXX expires in 14 months and loan was for 3 years. I have tried several times in the past 90 days to apply online at Payoff.com for an installment loan. Their system has experienced glitches not allowing me to fairly apply for a loan. Most recently the system has declined me stating that I was denied based upon a credit report from XX/XX/2018, which my credit has significantly improved since XX/XX/2018. I've attempted to reach out to Payoff to correct this and have received no responses most recently in XX/XX/2018. This glitch does not allow customers to properly apply as they legally are allowed to. The company has failed to address the issues and put measures in place to insure their process is fair and complaint.

Payoff indicated that my online application was approved for an offer and requested that I submitted the required documentation to complete the process, which I did. I didn't have any followsup from Payoff regarding the status of my applications. I sent a payment of {$16000.00} to the lender to be applied to my account through my online bill pay at XXXX XXXX XXXX Bank. The payment was scheduled to arrive on XX/XX/2021. The check was finally deposited and cleared my bank on XX/XX/2021. Recently I was pre approved for a XXXX Payoff Loan I advised them I received my money through XXXX and they advised me that I had 30 days total to upload the XXXX Award Letter. I am currently still waiting on it as it should be delivered to my home any day. This was the only document that they needed. Before I took out the loan I was lied to about the interest. I was told the interest would be added on monthly and that if I wanted to pay off the loan early I would only be charged the interest currently accumulated. Instead, they front load it all of the interest, and when I click on my payoff amount, it had all of the interest through the entire term of the loan added to it.
