I will try to give you a brief breakdown of my situation. We closed on XX/XX/2021, but we began our talks with XXXX XXXX much earlier, around XXXX. We found their home listings on XXXX and reached out to them. Our XXXX XXXX point of contact was XXXX XXXX, who doubled as the realtor that represented XXXX XXXX. Before closing, we were asked to wire a deposit to XXXX XXXX, which we did. The wire went to a XXXX XXXX XXXX XXXX account. The total for that wire was nearly $ XXXX. The remaining deposit was given on closing day, which went into escrow. The total deposit given was almost $ XXXX. When we were about three months in and did not really hear anything from anyone, we started reaching out. It was tough to get a hold of XXXX XXXX. Most of the time, the only way to get a response from them was to drive to XXXX for an unannounced visit to their office. We have, I would say, 100s of emails to XXXX XXXX and the bank because we would hope including the bank in the thread would pressure them to respond, but nope emails would go unanswered even by the bank. One of the times I got the bank to respond, I asked about interest and if XXXX XXXX was paying these as agreed, and the bank replied that XXXX XXXX had paid interest in advance, so not to worry about that. That turns out to be a lie because the bank is now including all the interest and extension fees in the payout bill. I remember the bank ( XXXX XXXX ) saying to me over the phone that this had been a learning experience for them, and I responded that the buyers were the ones paying for all the lessons. It turns out my deposit money was used to pay closing costs even though this was the builder 's responsibility as per the contract ; I paid the realtor commissions, and other things ; in short, all my $ XXXX is gone, and if I don't want them to default and come after my credit, I need to fork over another $ XXXX. How is this even plausible the only party with no control over the build gets hit with everything? These guys ( XXXX XXXX / Hallmark ) are really out DESTROY lives. In my case, they already took all my savings, and now their menacing with destroying my credit so that even renting a home in the future will be difficult. My credit is over XXXX, and I was responsible enough to save money over time by sacrificing other things so that I could put my family in a home, and that dream is gone, and along with it, my credit and future if they have their way. It seems like the bank made it possible for XXXX XXXX to operate risk-free, and obviously, XXXX XXXX has no incentive to build anything as they won't get penalized for any of their own screwups and are getting people 's deposits to fund their operation without actually ever building anything. Buyers are here thinking that these entities are acting in good faith and their just accommodating things to XXXX us over. My bill with the bank keeps racking up as they keep adding extension fees. Yet I've never been told when an extension fee is added or the cost. All communications happen between bank and builders while buyers are totally in the dark, but, of course, we are responsible for funding their dealings. Oh nearly forgot ; the only thing they did on my lot which was fill it with dirt, got me a lien. XXXX XXXX did not pay the sub-contractor. I just can't believe scams can happen this openly. I gave a deposit, and the home won't get built at no fault of my own, but I have to give close to $ XXXX to walk away free and clear. Walk to what? A ditch? I've invested so many hours calling XXXX XXXX, emailing them, driving there, emailing the bank, the county, etc. It's all been a waste. Please forgive my rant. I've been dealing with this nightmare for nearly two years, and while I've gotten somewhat numb to it, I still get worked up when reliving the situation. Please feel free to ask me anything. Purchased a home on XX/XX/21 I closed on the FHA 30yr loan on my first home. The appraiser documented No prior sales to the subject property in the past 3yrs other than when sellers purchased it I found out after closing I was the 4th buyer of the home in 1year. This information is public record on XXXX XXXX County accessors ' office, and XXXX. *My interest rate was locked and agreement signed, the fee for points changed 3 times without communication to me that the fee for points was changing while my interest rate was locked. The most important were on my preliminary and then changed again on my final disclosures. *I was steered to believe I qualified for the Mortgage Credit for first time homebuyers and that Hallmark and my lender filed for the credit as stated and the program fee of {$800.00} was on all my of my CD 's except the final CD it was removed. *I contacted XXXX XXXX XXXX who stated that nothing has been filed for any credits in my name, she also checked under my SSN and address. Nothing was ever filed. *My lender admitted that they didn't file it and threatened to push closing out to file for the credit which takes a month alone and the lender was aware that if we pushed closing out any further the sellers would not be willing to do, so I would lose the home. *Hallmark home mortgage steered me away from government programs to help with closing cost and down payment assistance which I qualified for due to my lender stating that if we go through XXXX XXXX XXXX will dictate the interest rates, and they will be higher. XXXXmorning of closing I informed Hallmark and my Lender that the CD was not accurate, showing credit cards that I had already shown proof of payment. *I have all the documentation in writing as I have a mortgage that I have not been able to afford, I had nowhere else to take myself and XXXX children. I work full time in XXXX and I have XXXX young children. This was awful what happened to me, and I was backed into a corner where I didn't have a choice. *This was originally supposed to be a conventional mortgage, but my lender stated it was not worth his time to do my loan conventional even though I had already taken the Framework for homeownership class and did everything required to do the Home ready program under XXXX XXXX XXXX I filed a formal complaint, which they gave to an attorney, who did not address any concerns.

I took out a construction loan from Hallmark Home Mortgage LLC that closed on XX/XX/XXXX. We started building a home soon thereafter. When we went to close on the permanent financing for our home loan with a closing date of XX/XX/XXXX, we were shocked to find out that Hallmark Mortgage LLC charged us {$750.00} per month to extend our construction loan. We paid monthly interest to Hallmark and received a statement each month and paid the amount owed. Never was a {$750.00} per month charge disclosed to us at our closing. I approached Hallmark Home Mortgage LLC and the representative we dealt with, XXXX XXXX, and he said that those fees would have been waived had we chosen them for our permanent financing but since we were financing our loan elsewhere, we had to pay them. Hallmark Home Mortgage LLC waived one month of fees but we were forced to pay the remaining {$4500.00} in fees in order to have the construction loan paid off and our permanent financing put in place. I asked XXXX XXXX to refund these dollars since they were never disclosed to us at the closing of our loan nor did we sign any document stating that these fees existed. We did not hear back from him after his initial email that he would ask his Manager. I have a copy of all of our closing documents and monthly statements and there is no mention of this fee anywhere in these documents. I am attaching a copy of a monthly interest statement received from Hallmark Home Mortgage LLC as an example.

I purchased my home in XXXX XXXX and XXXX went into my escrow to pay property taxes for XXXX. {$3100.00} was paid out which threw my escrow into a negative of XXXX which I am being held accountable for. The correct amount of property taxes was not factored into my loan accordingly. The house was vacant for several years upon my purchase in XXXX. There was also a late fee charge accessed since taxes were not paid on time from XXXX. Exemptions were not filed for XXXX by previous owner. This raised my mortgage from {$690.00} month to {$1100.00} month. I am being held accountable for taxes from 2 years prior to me purchasing the home. I relied on and paid Hallmark Home Mortgage to correctly figure the right amount of property taxes into my loan. They do specialize in HUD homes and should have known to look and see if exemptions had been filed considering this had been a vacant home for quite some time. The error was on Hallmark Home Mortgage and feel they should be held accountable for the refund back into my escrow account. It was negligence on their part to not factor in property taxes as they should have. According to the XXXX XXXX XXXX, XXXX and Hallmark Home Mortgage, there definitely was an error made, but Hallmark Home Mortgage was not willing to correct their error when I went to personally speak to them in XXXX XXXX.

A formal contract was signed with a client to build a home, the client received pre approval for mortgage XX/XX/18. Builder began to work with client and loan orginator, providing details on home, completing the builder package and providing financial information. All submitted and confirmed receipt XX/XX/2018. Email from Banker confirmed package sent to Builder approval department XX/XX/18. At this point client and Builder began construction with periodic check points with orginator, conversations indicated, First draw would be available as of XX/XX/XXXX. Builder contacted Banker/Mortage Broker to get update and proceed with first construction draw and was told by banker no construction loan has been submitted or funds available. Building was started XX/XX/18 to comply with contract to complete home end of XXXX. Outstanding balance exceeds XXXX client nor Builder have funds to continue construction.Banker advised client to have Builder complete the home since it would close in 45 days and can then execute the mortgage.

Hi CFPB! My names is XXXX XXXX. I have a problem about Esrow Funds with Hallmark Home Mortgage, LLC XXXX XXXX XXXX, XXXX XXXX IN XXXX. They are keep the amount is {$1100.00} and tell me they will refund when the yard at house done ... but since it done they just sent me back {$1000.00} because of the inspection cost {$130.00}. Nobody tell me i need to pay for the inspection. When i call XXXX XXXX ( work for Hallmark home mortgage ) said i was signed on the escrow agreement at closing date on XX/XX/2018. The reason I complaint is because i have no time to read the escrow agreement on closing day. I would like to have the escrow agreement some days before i need to sign so i will understand it. I would like to have {$130.00} back because I didnt know ... I would love CFPB help for that issue ... thanks so much ... please contact me at XXXX!!!

I recently closed on an fha loan for a home I just bought on XXXX2020. The house had termites and bedbugs and very many other issues that were not taken care of which was a breech of contract and should of never have passed fha guidelines, or been approved for the loan. I would like this looked into and resolved. The invoices I received after the closing from the seller was missing and never was address in the agreement from the inspection. I was taken advantage of by my realtor, lender, and the other realtor also XXXX XXXX XXXX because they obviously didn't go over the paperwork that clearly states termites were visible in the inspection and never addressed or disclosed to me.also during signing I felt rushed and was just told to sign and next page, not givin a proper explanation of anything I was signing or informed of new discoveries.

serval accounts has been applied in my name fraudulent from different leading and credit card company, for mortgages in the last 2 years, I have reached out to all companies that were applied in my name fraudulent. all companies agreed to remove remark from all 3 credit bureau. I also contacted credit XXXX XXXX, XXXX and XXXX to investigate this matter, never received any answer from none of the credit bureau. attached to file

Hallmark Morgage sent the final disclose 8 hours before closing which the buyer never got or singed. Also the buyer did most of the work for the sale
