TimeLine. In XXXX of XXXX, XXXX decided to finally get a will based on the hospital request and personal choices because of his XXXX including being legally XXXX. The will was certified with two bankers that questioned XXXX about the understandings of the will, and what his wishes where. It was XXXX desire to leave me the home because of all I've done for him and his mom. So his sister knew months before he passed that the house was to be given to me. I also have proof of this via text messages, emails, and video messages. XX/XX/XXXX. XXXX XXXX XXXX of XXXX XXXX XXXX XXXX XXXX away from struggles with XXXX. I was his power of attorney and executor listed on his will with co-executor his half-sister XXXX XXXX. We weren't related by blood, however, I considered him my dad/ uncle and the day I got married he walked me down the aisle. XX/XX/XXXX I stopped by Habitat for Humanity XXXX XXXX speaking with XXXX XXXX providing a copy of the death certificate for XXXX XXXX and co-owner XXXX XXXX his mother that passed away in XX/XX/XXXX and the Will. At that time XXXX said he would be needing to meet with the board for habitat because this had never happened before where both owners were passed and because they were a nonprofit and the lien holder. At that time his recommendation would be a transfer of the original mortgage to me with the assumption of the mortgage. XX/XX/XXXX I provide a copy of my bank statements, a copy of my credit report, and drivers license to XXXX. He shook my hand and thanked me stating " the debt is yours now ''. At the moment the balance of the mortgage was {$16000.00}. I was represented by XXXX XXXX of XXXX, XXXX, and XXXX and told her about the steps I would be taking to resolve this matter directly with Habitat. Please note I have a copy of all emails exchanges. However, once the board reviewed my income, they request I get a personal mortgage to take care of the balance. I agreed and went through XXXX located in XXXX working with XXXX XXXX. XX/XX/XXXX The mortgage was approved pending Habitat agreed to transfer the mortgage in my name which they originally agreed to Per emails dated XXXX XXXX Then Habitat came back stating they wouldn't and the deed would need to come from the estate, at this time the co-executor started making problems. and refusing to work with me to close the estate out. I then contact Habitat about simply paying off the balance in cash and they once again said they would do it. but didn't follow through. XX/XX/XXXX, I emailed XXXX again trying to take care of this mortgage and asking them to finally follow through on the settlement agreements. Which again he gave me the runaround XX/XX/XXXX we began the process to remove XXXX from co-executor do to her intentionally .delaying the closing process. My attorney submitted all paperwork and forward to Habitat. XX/XX/XXXX received notice of foreclosure and requested a meeting with Habitat for Humanity and XXXX XXXX their representing firm. They refused to meet about settling the estate. Noc XXXX Finally had XXXX remove as co-executor on the Estate but had to wait too receive my official seals of the estate. XX/XX/XXXX I finally received my seals from the courthouse which had been delayed due to human error. Once again we reached out to try to settle the estate. Yet they pushed for a court hearing seeking a judgment against the estate for the balance owed. XX/XX/XXXX I requested a pay off balance, requested which I expected would be a balance of the mortgage taxes and fair legal fees associated with the estate. Thus the last emailed received before the balance requested for their legal fees were {$2300.00} however upon balance request for payoff they where claiming legal fees of almost {$10000.00} which is fabricated and abusing of powers. Between XXXX my mom did not receive any mortgage statements on her account and was unable to verify how her mortgage payments and account was being handled. In XXXX a Mortgage Cancellation and Release was filled with the state of Alabama. It stated that XXXX mortgage was paid in full and fully released, satisfied, discharged, and cancelled. Please explain!!! I spoke with XXXX XXXX ( executive Director ) on multi occasions about this matter and each time she refused to discuss the issues with me. She said that her lawyer advised her not to discuss anything with me about the mortgage. Since the mortgage is still in my mom, XXXX XXXX name. XXXX XXXX just ask for a copy of my Quit Claim Deed. I gave her a copy of the quit claim deed and yet she still did not give me any information about what I need to do or anything about the mortgage. To my knowledge the Silent 2nd mortgage is to keep homeowners from selling their homes quickly for a profit. Habitat for XXXX has solely given the audit for XX/XX/XXXX. I did not and have not received the audit from XX/XX/XXXX and request confirmation of mailing from the office. as I can provide every mailing through priority mail tracking. This company is extending dates for audits and not appropriately crediting the audit years paid. This is causing inaccurate payment dates and amounts paid. This is causing a deficit and miscalculation of ACTUAL PAID AMOUNTS. I believe that I am entitled to a return of paid and misallocated funds in my escrow account and principal account.My escrow account is deficit over {$2000.00}. I bought my home with Habitat for Humanity in XXXX with a no interest loan. Due to a lack of income I many times have made partial payments, to avoid foreclosure, and which has been a normal way of doing business through communication. The issue I have with my local XXXX County Habitat for Humanity chapter is the poor accounting, poor handling and lack of access of my account, not to mention a lack of protocol and unprofessionalism and trickery I have recently experienced. Having XXXX children, being on a fixed income since XXXX, I ended up struggling to pay my note and then in XXXX things got worse when I lost my child support so, I begin making partial payments in XXXX XXXX, in order to avoid foreclosure. I was in constant communication with the staff. On or around XXXX XXXX, I made a visit to Habitat to request a print out of my pay history as it appeared payments were missing and the amount owed was higher than expected. XXXX, was very critical to discuss my account, while sitting in front of her computer but never clicked print to grant my request. At that point, it was determined that {$200.00} asap to remain within the 60 day past due time from before the next month payment was due but {$200.00} was paid an accepted on XXXX XXXX instead. Then after receiving a letter on XXXX XXXX from Habitat dated XXXX XXXX I went again to the office on XXXX XXXX to pay and recieved receipt for {$1200.00} and I left a promise to pay XXXX 's mortgage before the end of the month, in which I did. So, on XXXX XXXX I made the regular mortgage payment of XXXX which included a {$40.00} late fee. On the XXXX XXXX, I received a letter in the mail dated XXXX XXXX, stating acceleration and additional fees. I assumed it was an error because my account was current and payments accepted with no further issues. However, I was unable to pay again XXXX, XXXX I was told was waived due to XXXX but now I 'm being told only the late fee was waived. So, out of relief I did n't pay in XXXX, I paid {$430.00} in XXXX, and I made 2 payments in XXXX of {$860.00} to include a payment for XXXX. At this point, I am still receiving acceleration notices while I am in dispute of what is stated in the letters that I owe. I went in office again on XXXX XXXX and submitted a hand written request to Habitat and explanation of my account and record history and was put on the phone with Attorney XXXX to request it. I was also advised for the first time that my money orders had never been deposited and I was offered to accept them back. I did not accept them because circumstance were not communicated to me properly and it did not make sense. So, on XXXX XXXX, XXXX, I mailed a certified letter to president of my Habitat office, XXXX XXXX, again requesting my payment records and expressing my discrepancies with the handling of my account, in an attempt to resolve. He received the letter on XXXX XXXX but I never received a response. When I called on XXXX XXXX to follow up with him and was advised by office personnel he could not accept my phone call and to refer to the attorney. I never received any communication from their attorney since XXXX once I had caught up on my payments so I was not aware that my file was still in her office. I finally received a record of my account per the attorney 's office on XXXX XXXX as I had called XXXX XXXX to request a copy be mailed. The letter was dated XXXX XXXX which I had not originally received. It should have been sent certified like anything else important. At this point I am still in disagreement with the way my account has been handled, not properly. Not only have I been jeopardized by being refused to receive documents in a timely manner that I lawfully have a right to, but all communications attempts I made were in vain. This is no way to run a business with a homeowner seeking resolution to unresolved matters and possibly even mistakes or misunderstandings. Their letter states " THEY DO NOT DESIRE TO TAKE POSSESSION OF YOUR PROPERTY '' yet they have made every very close attempt to do so, despite my efforts to bring the account current. There have been many accounting issues in the past. I noticed according to the payment history record I finally received that were never credits applied to my principal for overpayments as had I requested so that I can pay my home off sooner. Instead it seems it was applied to the escrow instead and then refunded to escrow. And the accounting records never show the current balances nor any positive credits so its hard for homeowners to read. According to the policy you there is not suppose to charge a late fee if paid on or before the XXXX and this also applies to mail being postmarked by the XXXX. I see tons of late charges where I know I was n't a day or two late. I 'm either on time late after XXXX. Maybe, someone checks the mail late and decides to notate the account based on the date the pmt is entered. Not to mention, there is a high turnover rate in the accounting department and someone new is always working on my account. I 've dealt with at least 3 different people in XXXX. One year I did n't even receive a refund from escrow. Several home owners have lost their homes in XXXX XXXX for various income reasons but for one reason I know for sure was a leading cause of homeowners stress and issues like this and the reprobate that does not sincerely want homeowners to lose their homes. Based on how this issue was handled Habitat owes me the right to be treated fairly as a homeowner, providing me with information vital to my mortgage agreement without delay or causing a burden for me to assume additional attorney fees that they have intentionally incurred. Per the attorneys response that Habitat claims they tried to contact me after my XXXX XXXX payment concerning my account by phone and also by email which is a flat out untruth. Habitat has never not been able to reach me especially if they left a voice message. Besides, I was always in and out of its office. No emails received in XXXX ... If so, I would be glad to see the proof. Either way, I believe it was wrong while I was in close communication with them and was never told anything otherwise that after my payments there would still remain an issue. These are the overall issues I have with Habitat NW : # 1 accepted my payments and not deposit them, # 2 accept my payments and still accelerated, # 3 suspended my account without my knowledge, # 4 forwarded the account to their attorney after I had made a reasonable effort to bring the account current, # 5 excluded me from any consideration given to other homeowners during XXXX, # 6 did not provide me with any account information when I requested it on three different occasions. ( This also prevented me from providing documentation needed to receive mortgage assistance help ). # 7 Mislead me # 8 Attempting to further hinder me # 9 Charge me late fees on top of payments with late fee, in which Ive paid. # 10 Account information letters never sent within a reasonable time for me to act. Otherwise, it seems like an attempt to further hinder me from bringing my account current, doing the exact opposite of what the delinquent letters state.

I applied for HFH mortgage loan. My representative and understanding was with a lady by XXXX XXXX. XXXX XXXX had a concern with my child-support. Apparently credit bureaus had been reporting my child-support was in collectiin status! This in turnwiuld have prevented me from obtaining a successful application. So I paid {$920.00} on my child-support because I was told that was the only portion in collection. This did not make sense ; since all my support was in *rears. But none the less I paid it. I was contacted on phone by XXXX XXXX. Apparently she had read an email sent specifically to XXXX XXXX. I found this nerve-wracking and an unstable manner for her to be approaching me about a email sent directly to XXXX XXXX XXXX XXXX None the less XXXX verified that the payment was not the issue but the fact all my child-support was reported as collects and not just the delinquent portion. She verbally told me to try and reach XXXX and see if this mistake could be taken care of ; she had experienced the same issue with another client. So, I contacted XXXX XXXX ; head of child-support collections. He review my grievance and sent an email and letter to the effect of my rears not being in collection and just a debt to be paid. Well, shortly after forwarding this email to XXXX XXXX I received an email to the blessfull reaction to my effort of resolving the child-support issue. But just as happily as I had become over such a positive accomplishment- i was shocked to be horrified by a follow-up email fromXXXX XXXX! This email read of a major issue with my student loans. Now here in this email XXXX XXXX claimed falsely that I would owe a monthly payment of {$430.00} towards my student loans!..? I had no foundation or knowledge to where XXXX XXXX gathered her information. At this point I was clearly baffled and left the feel ignorant. In the previous month I had sent XXXX XXXX XXXX and email attachment stating my application was approved for Total XXXX Discharge ( of my student loans. During this time I only knew there would be a review of my medical condition for determination of loan-offset. So to receive my application packet in the mail denying my claim due to a payment of {$430.00} was incorrect! This was seriously unethical. I wanted to know where XXXX XXXX got her information. I called XXXX XXXX. Once on the phone with XXXX XXXX spoke of my issue with the student loans before I had a chance to bring up the subject matter! I found this odd, once again ; because I had only corresponded with XXXX XXXX. At this moment XXXX XXXX started to speak of XXXX XXXX gathering information and reaCH-out to me about my student loans. I replied letting her know that XXXX XXXX had already injected herself into my business and spoke of matters that which should not have been to any of her knowledge!? XXXX XXXX made a very derogatory statement toward me ; " I've already been told you are being combatible about this issue with XXXX XXXX '' ( *Combatible is not even a real word ). I was shocked!!! I quickly snapped back at her with full intent to clerify three key points : ( 1 ) My student loans are under a forbearance until 2023. Yet even so, since the pandemic any payment towards student loans are not subject to any interest. All payments will go towards the principle of the loans! ( 2 ) Which entails my student loan payments not be subject to interest rates/fees which makes any future or current loan totals considerably less than any numbers crunched by XXXX XXXX! ( 3 ) How can you figure any payment ( s ) if you do not possess the knowledge or criteria of how the loans are being handled? ; as XXXX XXXX did wrong in her attempt to calculate any monthly debt amount! Since it was a pandemic there were no interest being charged ; meaning if I did have to pay on my student loans it would not be according to XXXX XXXX 's presumptuous mathematics! As soon I ended the phone call with XXXX XXXX, I immediately scanned and sent a follow-up letter reporting that my Total XXXX Discharge determination will be processed within the next 30 days! My PCP had to verify my medical condition which reflected my issues would exist way past the 3yrs needed to grant a discharge of student loans. But today I signed for a heart-wrenching letter address to me from XXXX XXXX ( President & CEO ) detailing my application is now denied { and I quote } : 2. Willingness to partner : The tone of your recent email exchanges and phone calls without staff has been unacceptable. We will not be able to consider a future application. We wish you the best going forward. I'm pretty sure it's a stamped signature on Habitat for Humanity behalf I fill very hurt & threatened by the abuse of power just because I told the truth and wish that XXXX XXXX was faced with the same grief of financial burden that their unethical behavior has cost me. She cost my family even more of a hardship and now sabotage our future of having a stable home! I've been a single parent to my two youngest daughters for the past 13+ years at the address where I currently live! If Habitat for Humanity isn't for a person like me ; then who is it for? These two employees at the XXXX location have show total disrespect, denial and disregard to humanities & suffering! Habitat has always had a problem with resident mortgages. When entering the program they indicated we had to fix our credit. Of which I completed prior to being chosen for my home to be a built. Once my home was built Habitat employee 's asked for more money and proceeded to take payment. I then found out they do not report my payments to the credit bureau and have now forbidden us to receive monthly statements. I recieved a letter drawn up by XXXX XXXX hand delivered on a Friday evening at my resident. XXXX, took over XXXX XXXX position after they neglected to notify resident that she passed away in XX/XX/XXXX. Per XXXX I owe {$2000.00}. I immediately contacted XXXX when I opened and read the amount. XXXX answered, I tried to explain my concerns and she kept rudely cutting me off and over talking me instead of allowing me explain my question. She became upset, I became frustrated and then she hung up on me. I called back and she would not answer. Then I drove up to the location to speak with her regarding this amount and no one would speak to me. I seen XXXX through the glass locked door, and she would not come to the door. A Habitat employee was outside and took me inside the lobby of the main branch, she then went inside to get someone but came back to tell me XXXX XXXX would not be in until next week sometime. I said ok and left. I do not owe {$2000.00}. Yes, I am late, but I pay my late fee everytime of which they never log either. I am tired of fight with them about ALL the lies, they have not upheld their end since the beginning regarding these homes. I am not the only homeowner with these issue. Some have giving Habitat the option to buy back, to walk away because of accounting issues and more money. Habitat has not fulfilled any of the contractual promises and have told us, the homeowners, that it does not pertain to them because they were not employed with Habitat prior to the date they started. My mortgage per the annual report XXXX XXXX sent out in XX/XX/XXXX is XXXX. If I pay after the XXXX there is a XXXX late fee. Our mortgage is broken down as such : mortgage principal {$230.00} + taxes, insurance {$230.00} ( estimate ). At the point of the letter I was past due {$4700.00} ( XX/XX/XXXX & XX/XX/XXXX ) +XXXX ( late fee ) = {$980.00}. I mailed in a certified receipt of Request for Information Pursuant to Section 1024.36 of Regulation X on XX/XX/XXXX to Habitat for Humanity PBC. I recieved the receipt they had 5 business days to acknowledge which they did via email by XXXX XXXX on XX/XX/XXXX. Within 10 business days they were suppose to provide the identity of and address the owner or assignee of my mortgage loan. Did not receive, and within 30 days to comply with and respond to the remainder of the request. I have yet to receive the information regarding my mortgage with Habitat for Humanity PBC. Due to Habitat of Humanity actions they have been deemed untrustworthy to many homeowners including myself. Being they allocate everything in office via XXXX spread sheet it doesn't take much to offset their books and form errors. XX/XX/XXXX Habitat had a Ransomware attack which happen during the hurricane. They never reported it to authorities. Habitat does not report to a credit bureau so we have no one to watch for these errors. Employers turnover all the time. Habitat has used my name to open accounts with XXXX XXXX XXXX and I received a XXXX in XX/XX/XXXX. Without notification to the homeowner. Habitat is a Non-interest mortgage. I went to XXXX XXXX to gain knowledge of how and why, but was sent to the woman that handled established the accounts named XXXX XXXX and she would never contact me back. Until I had to reach out to her manager this year and she asked me what am I looking for. All I want is what was promised, report to the credit bureau from day 1, a statement each month, and my XXXX XXXX forgiven on my 2nd mortgage. This is what I put in my sweat equity hours for. I paid my closing cost 11years ago and my mortgage with the late fee. I have been in my home for 11 yrs and they continue to butcher up our mortgages and do not give us solid responses. PLEASE HELP US. Being that the programs is XXXX based people overlook the underhanded activities they have done. Out of all the homes they have built, not that many own their home. Has anyone ever asked why? I have all my paperwork to back up everything I am saying. Even from the beginning of me starting the program. I have also been keeping a log alongside every check I have paid to them.

I am sending this email out to you to see if you are able to assist the homeowners involved with this Habitat for Humanity transfer? Habitat For Humanity receives millions of dollars from organizations like HUD and the City of XXXX. I received a call from a few devastated homeowners. The homeowners feel they are being forced to sell their homes to the lender that acquired the mortgage and become tenants in their home. Scenario : XXXX XXXX a homeowner that was a part of the Habitat Homes from XXXX. Habitat apparently sold 12 mortgage on XX/XX/XXXX. The attached assignment is the 12 home owners impacted by this acquisition. The issue : XXXX XXXX receives a certified letter from Habitat XX/XX/XXXX, the mortgage was being transferred to XXXX ( XXXX XXXX XXXX XXXX XXXX ). The servicing of this loan will not change the terms. Ms. XXXX, contacted XXXX and spoke with XXXX XXXX and was told that they are the new owners of the property. Ms. XXXX was offered to pay XXXX rent for 3 months and begin paying {$800.00} beginning XX/XX/XXXX in addition to paying her {$5000.00} to sell her property. The homeowner is confused because she is the owner of the home. XXXX XXXX walked the home and offered her a deed in lieu and also foreclosure as an alternative. Unfortunately, Habitat for Humanity did not mail any of the homeowners a monthly statement. The homeowner is not aware of any delinquency. The clerk of the circuit court has no records of a lis pendens or foreclosure. I am truly concerned for all of the homeowner 's Habitat has not handled the loan servicing correctly or the transfer of the mortgage. # 2 OF 12 Ms. XXXX XXXX owns one of the subject properties. The homeowner contacted Habitat today and was verbally told her home was transferred, the homeowner never received a certified letter ( per the mortgage the client should receive ) a notice. XXXX XXXX at Habitat for Humanity notified the homeowner today her loan was sold and she needs to call them regarding her mortgage. Habitat was in the midst of repairing her defective roof and also kitchen cabinets.The homeowner had forced place insurance because her home is not insurable. The homeowner owes XXXX and is current to her knowledge on her payments, none of the homeowners receives monthly statements. # 3 XXXX XXXX Has had some past-due payments. Habitat sold their loan to ( XXXX ). The homeowner would like to have the assistance of an attorney to navigate through this process.The homeowner does not trust a non servicing company. # 4 XXXX XXXX Was at one time delinquent made the loan current XX/XX/XXXX. The lender sold the loan days later. This client would like to assistance of an attorney to navigate through the process. # 5 XXXX XXXX This homeowner is in default. We believe the payment is not reflected on the credit report. The client would like to refinance and obtain the assistance of an attorney to navigate the process. # 6 XXXX XXXX XXXX will need foreclosure defense assistance. She was laid off and now gainfully employed. The homeowner has the equity to refinance and the mortgage to get away from this lender as it doesnt report on the credit report. 8.XXXX XXXX I spoke with she is totally unaware her mortgage is sold and would like assistance as well. The new payment for XX/XX/XXXX has some confusion the homeowners needs the help of attorneys to figure out this matter. I am working diligently with the homeowners to avoid this tragedy. The XXXX XXXX is owned by XXXX XXXX a real-estate broker and managed by XXXX XXXX a realtor in XXXX. They recently, re-organized to the name XXXX from XXXX XXXX. I am only sharing this information because of the involvement of senior citizens, single parent mothers whom are being intimidated by a non official mortgage servicer.

I 'm writing to express concern about the lending practices of the non-profit housing organization Habitat for Humanity ( HFH. ) As a person who received a home from XXXX Minnesota Habitat for Humanity, I 've a unique perspective on the experience. I see a non-profit housing organization so focused on its mission to keep HFH in operation that they do n't see or turn a blind eye to the negative consequences it bestows upon families it works with. Quite simply, HFH is giving families keys to homes with underwater mortgages. HFH acts as it 's own realtor, appraiser, underwriter and lender. These homes are no more affordable than a traditional mortgage. They claim to offer no interest loans but it 's not the reality. HFH inflates the purchase price of a home in an attempt to capture interest. In my case they sold me a townhome for approximately $ XXXX more than it was worth. This leads me to a lot of questions ... Where is the benefit of families required 200hrs of sweat equity? What Is the actual cost to rehab or build each home? Why are families charged so much for homes when often a portion of the labor, materials, land and occasionally an existing home are actually donated to HFH? The math does n't add up for me. This practice sets families up with disadvantage disguised as a blessing. They pay higher monthly mortgage payments than they should because it 's calculated with inflated numbers. They are taking on debt far in excess of the purchase price ( or even the value ) of the home. This makes it nearly impossible to build up any real equity for years or even decades. They are essentially trapped in their situations. Partly because they are in over their head but also because HFH will not work with you if you have any difficulty paying your mortgage. These are the same sort of lending practices that big banks were reprimanded for during the recent Great Recession. I recently needed to sell my HFH home. I was lucky to afford a lawyer after first hiring a realtor and discovering the ugly truth about my mortgage. As you know, many low income families will be unable to afford a lawyer or may find the idea daunting. Also worrisome is HFH 's practice of failing to disclose figures until just before closing. A family has no idea about the price of the home, or payment amounts until days before moving in. I 'm also not fooled by HFH explanation of home repair emergency saving accounts as a reason for the higher mortgage payments. It appears just another way to squeeze money out of already low income and desperate families. Please do n't misunderstand me, I 'm not accusing HFH of doing anything illegal. In fact, the most disturbing part is that HFH practices are likely perfectly legal. They 're clearly looking out for the best interest of the non-profit, but what I 'd like them to consider is, although their practice ensures HFH continued success, it is ultimately doing a disservice for families. This has a slight odor of predatory lending. Not only for selling homes for more than their value but also for not properly disclosing to families that they 'll be paying more than the home is worth and thus be unable to sell for many years. The families that come to HFH are desperately looking for help. Most are low income without access to traditional mortgages. Many are immigrants or uneducated about the intricacies of home buying. I 'd like to ask that you please consider investigate HFH. Are they serving their charitable purpose or are they simply lining their pockets and acting as a mortgage lender disguised as a XXXX non-profit housing organization? Are they meeting their fiduciary duties such as acting in good faith and honesty? Please help ensure low-income families are put into safe and stable homes that are actually affordable instead of trapping them into mortgages they can barely afford.

My loan was transferred from Habitat For Humanity to XXXX XXXX XXXX, XXXX. My mortgage was transferred ( per a certified letter sent from Habitat ) on XX/XX/2018. I received notice of this transfer on XX/XX/2108. I reached out to the representative who was listed as the point of contact " XXXX XXXX '' via phone on XX/XX/XXXX. Mr. XXXX informed me that he was out of town and followed up saying he would be back in the office on the upcoming Monday. I followed up with Mr. XXXX on Monday XXXX XXXX via phone. Mr. XXXX stated that he was just returning from vacation and needed time to " sort '' things out. Mr. XXXX stated that he would follow up with my by the close of business on Monday. On Tuesday, XX/XX/XXXX, at XXXX XXXX Mr. XXXX sent me an email stating/saying " I'm working with attorney to get accurate account info.today. Will touch base later today '' I waited until XXXX and I had not heard back from Mr. XXXX. I arrived in person and brought Mr. XXXX 's company two money orders for XXXX and XXXX mortgage. Mr. XXXX stated that he would accept the payment but he didn't have to process the payment because I was behind on my mortgage. I asked Mr. XXXX how much am I behind, Mr. XXXX stated that he could not tell me an exact amount because his attorney is still working on the numbers. I received a statement in the mail on XX/XX/18 from XXXX XXXX XXXX XXXX, XXXX stating that I owed a past due balance of {$3200.00} stating that the transaction activity was XXXX XX/XX/18. I emailed Mr. XXXX for further clarification of this balance on XX/XX/18 inquiring about a balance of {$970.00} in my escrow account ( I was told by my previous Servicer Habitat For Humanity that this balance existed ). Mr. XXXX emailed me back explaining the balance. I returned the email asking Mr. XXXX if he could provide me with an escrow analysis and a complete pay history. I also asked him about what happens to my escrow balance of XXXX whats the account is updated and I asked him about my property taxes moving forward. Mr. XXXX never replied to my email. I arrived to XXXX XXXX XXXX on XX/XX/18 with a certified check for the balance due of {$3200.00}. My payment was taken and I was given a receipt for the transaction. While in the office I asked to speak to Mr. XXXX so that we could review my balance with the updated payment. I was told that he wasn't available and that he had just stepped out the office. I left a message with XXXX- the front desk worker to have Mr. XXXX to return my call. Mr. XXXX never returned the call. My experience with this company has been terrible and misleading. I have a mortgage with this company and I can't reach anyone to discuss my mortgage. When I call XXXX XXXX XXXX, they state that XXXX is out of town or unavailable. XXXX is the only point of contact. I have not been able to get an update amount nor a payoff or an escrow analysis. I can't call and communicate with anyone ( because they are never available ) to ask if my XXXX payment was included in the XXXX balance. My loan/mortgage has not been serviced properly and I was not given a proper notice that's required by law by my previous lender Habitat For Humanity before transferring my mortgage. I am stressed out over the exchange with XXXX XXXX XXXX company thus far. Finding information out about my mortgage should not be intimidating and stressful. I have called Habitat For Humanity and left voicemails to get more information about this transaction but I am not being replied to. Habitat For Humanity has also sold 11 other mortgages to XXXX XXXX XXXX ( also known as XXXX ).

I had a home built and financed ( mortgage and escrow accounts ) through the XXXX Area Habitat for Humanity ( HFH ) located in XXXX XXXX, Mo. In XX/XX/XXXX, I noticed that the real estate property taxes were not paid on time. I had contacted HFH several times about this matter with no resolution. I then received an " Urgent Notice '' dated XX/XX/XXXX stating that our mortgage and escrow accounts were " ... still seriously delinquent ... '' and further stated that " As a result of your mortgage delinquent there was not sufficient funds in your escrow to pay your XXXX property taxes and that we are responsible for paying the property tax and all penalties for late payment. '' The letter was unsigned and did not state the total amount in arrears. The acting director, stated over the phone that he had personally reviewed our records and found us to be in delinquency. This was impossible since I have paid extra every month since the inception of the contract. To this date, the property taxes and resultant penalties are unpaid. I have also requested all of the loan information to include the current balance to no avail. Habitat for Humanity has repeatedly refused and ignored my requests and I was forced to hire an attorney in order to attempt to resolve this issue. It has been determined through my personal payment records that I should be credited in excess of {$4100.00} towards our mortgage. To this date they have not cooperated with myself or my attorney. Habitat for Humanity could only provide an incomplete payment history with the first two years of information missing. Also, from XX/XX/XXXX through XX/XX/XXXX, the monthly payment records were incorrect or completely missing ; especially, the most current form XX/XX/XXXX to current. I believe I have evidence that they are in breach of contract and through the " Urgent Notice '' had intent to defraud. Since this has happened several times in the past, I also believe that this appears to be corporate policy. My concerns are that this chapter is operating under the guise of a non profit organization to help people but instead are exploiting them instead. Embezzlement is also a very real possibility. I have reported all this to the National Headquarters through their website but the case was suddenly closed without any contact with me. We were told during a previous complaint, that the corporate headquarters does not have the authority to govern the actions of their local chapters. On XX/XX/XXXX we filed a complaint with the Missouri Attorney Generals Office. As a result, the property taxes have just recently been paid but we have not received a response as to our mortgage balance or the {$4100.00} plus that we have paid. HFH made a statement through their attorney that due to the significant managerial turnover along with accountant turnover so HFH is reviewing the documentation and that they will get this issue resolved immediately but still no answer. The investigation may be ongoing but I have heard nothing from the AG within the last 30 days. Habitat for Humanity is in violation of several statutes of the Real Estate Settlement Procedures Act : 1. Refusing to provide mortgager/escrow account information within 20 days of request. 2. Not providing escrow or mortgage loan disclosures on a yearly basis or otherwise. 3. Not refunding excess escrow funds annually. 4. Embezzlement is a possibility.

Well I never received another loan servicer and ever since then I have been paying habitat for humanity. About 3 months ago I sent certified letter to XXXX XXXX for her to produce a ledger of what I've been paying and a copy of my mortgage documents. She sent the ledger but can't produce my mortgage documents. She gave me as my mortgage documents 2 deeds onXXXX saying I own the house and another deed. A promissory note and little more things but definitely not the documents I signed at closing. When we closed on our house we didn't get a chance to read anything they basically had pages marked for us to sign and told us what we were signing cause I definitely would've asked why the deed showed I already own the house. Now presently my loan is no longer on my credit and shows paid off with XXXX XXXX XXXX not written off. Everyone knows Trump and Biden put in place programs to stop the foreclosure on people 's home. I was out of work in XXXX and needed the assistance. Well in order to get the assistance you have to have a loan servicer. So habitat wanted me to falsify documents about them being my loan servicer in order to get the assistance and I'm not willing to do that. XXXX XXXX asked me if I had problems filling out the XXXX Mortgage Assistance application I told her yes the loan servicer part. Another lady who works with the habitat told me to call her and she would tell me what to put in. I told her if they were really my loan servicer I would know what to put in and no one would have to tell me. XXXX XXXX said she would have to give board over the habitat something that shows I applied if not she would start foreclosure procedures. I told her start them because I was not going to falsify documents. Btw the letter I received from the attorney has I have been in default since XX/XX/XXXX till XXXX XXXX when actually I've on been in default is XXXX and have the receipts to prove it. I asked for forbearance in XXXX? 2018 because my household income was reduced and instead of getting forbearance I came out of this meeting paying double the payment. This caused even more of a problem because I couldn't keep up with my payments. Then Covid-19 pandemic caused my income to be reduced temporally and I again requested forbearance and was told that my mortgage was not covered by Cares act forbearance and that I wouldn't be able to get any assistance. I applied for a first time home buyer program call Habitat for Humanity because the family owned home is falling down and family is unable to repair it. I pay my mortgage every month on time. The Mortgage Company changed addresses and never notified me.
