I had a judgment placed against me by a debt collection agency who used a fictitious name ( for me ) for a debt that I supposedly incurred with a credit card company that I never applied for. I didn't know they had any judgment or charges against me since it never showed in my credit report, I was never contacted by them and there has been no collection attempts on their behalf that I recall prior to the filing of the original case in XX/XX/XXXXfor a debt that they claimed occurred in XXXX. I also never received any judgment papers from the court or any fees associated with this claim. I got a reviver of judgment paper last month for {$10.00}, XXXX up from the amount that the original amount started at in XXXX for {$7600.00}. The case is still going to be heard for the revive motion next month and still being processed under a fictitious name. This debt never occurred by me or anyone on my behalf because I have never owned a credit card ( other than prepaid ) after my ex husband filed for bankruptcy on or about XXXX and I had to be included in it against my wishes. I would never have used the name that they submitted the claim against me and I was never given any verification of the debt. When I contacted the attorney representing them, they would not let me speak with the attorney on file, the receptionist however refused to give me any verification of the debt other than who the debt was supposedly incurred with originally and the dates that it supposedly happened. These allegations of debt will not be verified, I would never use such a name and I have never used a credit card since bankruptcy. The credit bureaus also put a fraud alert on all my credit reports since this happened and removed the fictitious name from my accounts used by this debt collector.

Today in the mail I received a letter from H & S Financial Inc. located at XXXX XXXX XXXX XXXX, TX XXXX. The letter stated I owed them {$8000.00}. They are claiming they had a judgement against me for the amount of {$8000.00}. I have never occurred such a debt. In fact, I went through six years of credit reports and it 's spotless with the exception of XXXX XXXX late payments, which were accidental. At no time was I served papers for a lawsuit. I never had a chance to appear in court. I never received any official court documentation. They did a hard credit pull without my permission. If there is a rule H & S Financial Inc. broke it. I am not paying the debt as it is not mine. I am filing a complaint with the FTC as well and will be sending certified letters to both H & S Financial Inc and the FTC stating the above with a request to do not contact me regarding this fraudulent attempt to collect a debt that is not mine.

This judgment is from XX/XX/XXXX. I wasn't aware of this collection action until XX/XX/XXXX. Company garnished my wages through XXXX county and I filed for an exemption for {$20.00} a check. This was approved. They then filed another judgement for the same case number in a different county for 25 %. This is against the law. Not only is this judgement from XX/XX/XXXXand I wasn't even aware of it. I was never served or anything. But they were garnishing me for more than 25 %. Now they want me to pay them directly {$80.00} a month so the sheriffs department doesn't collect fees and they get more money. Please help.
