I entered into a payment arrangement with the debt collector, with my first payment due approximately XX/XX/XXXX, in order to attempt to bring my account balance up to date and avoid further garnishment against my account. I had attempted to enter into payment arrangements previously to avoid garnishment, however the company told me every time I attempted that they would not allow me to make any payments on my account without providing all of the personal information they requested from me and I without having a job that I receive a paycheck from. I worked independently as a XXXX so I did not have payroll, I could only bring cash, so I wasnt allowed to make payments on my accounts at several points throughout the last several years. I entered into the payment arrangement and my first payment was due on XX/XX/XXXX. I was never given any copies of my agreement, as I was told that they do not provide this to people except over the phone, but the staff member told me over the phone on a recorded call that they would no longer send any garnishments against me as long as I made a good faith effort to pay. I was told that Mondays were the only day I could set my payment arrangement up to be due on ( on a weekly basis ). I explained that I was concerned about payments being due on Mondays, and that I am unable to make it to the office sometimes on Mondays. The staff member told me that there was nothing else possible, and that my only choice was to bring the payment on Mondays, but that there is a three-day grace period available just in case I couldnt make it on that day. Additionally, I have explained to them several times that the only funds available in my bank account and the times they levied my bank account were from child support, that I could prove, and that the funds they kept taking from my account were exempt funds. These funds were never returned. I began been making payments regularly, and there was a week that my payment was due on a holiday ( XXXX XXXX ) and I didnt make it into their office on that week. My mother had been admitted to the hospital, and between the holiday and her hospital stay I was unavailable to make it to their office. I made it as soon as I could to make my next payment and explained what happened to the staff member, and I expressed concern that I was late in getting my payment to them and wasnt sure if that messed up my payment arrangement or not. Because I was never sent any information about the terms of the payment arrangement, I was not able to review this information to figure out what to do at the time and I didnt have phone service available at the hospital. I explained all of this information to the staff member in the office, and I was told that there shouldnt be any issues with my payment arrangement and to continue sending payments as scheduled, which I did. On XX/XX/XXXX I realized that the funds in my account were gone after my card was declined at a merchant and I called the bank. They notified me that a bank levy had been sent, and was received by the bank on XX/XX/XXXX, which was the day after my last payment made to this company. I was actively making a good faith effort to pay my account, and the company sent a levy to my account anyways and sent my account into the negative by {$110.00}, as well as draining the {$32.00} that was in it. Those funds were child support funds, which I reported to the company today. I noticed today ( XX/XX/XXXX ) that my account was negative {$110.00}, which made it impossible for me to receive another payment for child support in my account without the funds being taken up by the negative balance. When I called the company to ask why they garnished my account after previously promising not to and telling me that my payment arrangement wasnt affected by being late when my mother was hospitalized ( I am her legal Power of Attorney ), I was told that there was no payment arrangement on file, that they had notated the account that they had previously informed me that I needed to call and set up a new one, after they had told me a different time that I wouldnt be allowed to set up any more payment arrangements, which is false. She also told me that there was no grace period allowed, and when I confronted her about what the other staff member had told me about the three day grace period, she then recanted her story and stated that there IS in fact a grace period available, but then stated it is more for when a payment is due on a weekend. She then told me if I wanted to take up any concerns about child support funds being garnished which should be exempt, that I had to do so through my bank account, and that my bank are the only ones able to tell them that the funds in my account are exempt funds. This is not true. This phone call between myself and the company are recorded, as well as the phone call I made with the bank informing me that they have nothing to do with informing the creditor that the funds in the account are exempt. To date I have been given no notice to dispute the garnishment or inform them that the funds are exempt, and this is a frequent occurrence with this creditor. Per my experience and the experiences of thousands of other consumers in our town, the creditor, who is owned and operated under the name of an attorney, does not allow many people to even make reasonable attempts to pay their account balances without meeting extensive requirements, will deny attempts to pay accounts, uses false and misleading statements regularly and illegally misrepresents the law and what people need to do in order to take care of their debts, frequently garnishes funds that they know to be exempt forcing consumers to go through extensive legal processes and fees in order to dispute the funds being garnished and claim them as exempt, will repeatedly send garnishments to accounts that they know have little to no money in them week after week, sending consumers into more and more debt with their banks as they repeatedly incur huge legal order processing fees and can not even maintain an open bank account long enough to save any money to pay the debts off in the first place, does not provide accurate documentation of payment arrangements or account activity, lies about payment arrangements, promises to not garnish accounts and then garnishes them anyways, and frequently communicates court summons to debt collection court for status hearings by post card, which is also illegal. This creditor has done this for years and should be penalized for their procedural harassment and bullying of creditors and denying people the ability to pay their debts. By law a consumer doesnt have to provide any more information than what they are comfortable with sharing, and the company uses this to deny people the ability to pay their debts. They do not cease collection efforts when notified that funds are exempt or that debts are disputed, and they frequently fail to give notice prior to legal proceedings which ensure an individual does not have time to attend the hearing to dispute the debt in the first place, resulting in default judgement. On behalf of almost everyone in XXXX, KS, please hold this creditor accountable for their malicious, negligent, and bullying debt collection practices. This is not right for anyone to have to be subjected to this kind of nonsense and I have the calls recorded finally to try to help prove it. We all believe that this company is actually embezzling through the abuse of state statutes and abusive collection practices, and that they are somehow involved with the state in the funneling of funds gained by nickel and diming people in small enough amounts that they dont have the opportunity to contest it without incurring huge financial or time losses to try to do so.

In XX/XX/XXXX my bank account was garnished by the office of H. Kent Hollins. I had no idea what it was in regards to, but after over an hour on the phone with my bank I was advised that my best option was to authorize my bank to release the funds in the account to the garnisher, in order to have my accounts unfrozen as soon as possible. I was at the doctor with my daughter and was unable to pay her copay because of this freeze on my accounts ; in an emotional and confused state I agreed to allow my bank to release the funds. In XXXX of XXXX I received a letter from the law office of H. Kent Hollins, stating that I owed {$1100.00} to XXXX XXXX Bank. I had a checking account with XXXX XXXX XXXX in XXXX, KS. In XX/XX/XXXX, I believe, I overdrafted the account in the amount of approximately {$500.00} and was unable to bring it current, so it was eventually sent to collections. I moved to Texas in XX/XX/XXXX and forgot about the debt. When I finally pulled my credit report years later, the account was not even shown as one in collections, so I had no reminder of the debt owed. Fast forward to XX/XX/XXXX/XX/XX/XXXX, and I learned that the office of H. Kent Hollins had sued me and was awarded a default judgement against me, which enabled them to garnish my bank account. At the time I was sued, the original debt was already near or over 10 years old, no payments had been made within that time period, and thus it was a time-barred debt. However, I received no communication to let me know that I was being sued for this debt, so had no opportunity to show up in court to defend myself based on the statute of limitations for debt collections. The default judgement was awarded only because I was never notified that I was being sued. Moving on, on XX/XX/XXXX I called the office of H. Kent Hollins and explained that I couldn't afford to pay anything. I was told that in order to avoid more garnishments in the future, I had to pay in full or set up a payment plan. At the time, I was going through a terrible separation/divorce, and my daughter was very sick. I wasn't in the state of mind to think to look up these laws and argue that this debt was too old to be collected on. Knowing that any future garnishments would literally leave myself and my children with no home, food, or vital medications, I agreed to a payment plan of {$25.00} per month. At the time the agreement was made, on XX/XX/XXXX, the balance owed was {$1100.00}. I have made a total of {$320.00} in payments so far, yet my current balance owed is {$1000.00}. The total balance has only decreased by {$170.00}, meaning this is accruing interest at a rate that would prevent me from ever being able to pay this off, at this point. I am aware that the time period for the statute of limitations can be reset if a payment is made on an old debt, but given that I was practically forced into making payments to unfreeze my bank account and then to avoid future garnishments, I think it would be absolutely unethical for the time frame to be reset in this case. I agreed only out of fear for the financial well-being of myself and my children, based on the threat of future garnishments.

I was XX/XX/XXXX in XXXX KS XXXX and while there myXX/XX/XXXX account was garnished by a debt collection agency and they took all my funds from my XX/XX/XXXX account, stating it was was for a default judgement from XXXX. The original creditor was listed as XXXX XXXX XXXX but I was denied permission to contact the debt collection agency to dispute the validity of the default judgement by the my inmate case manager, Ms. XXXX. Recently I was given a new notice of unpaid judgement by the same debt collection agency, dated XX/XX/XXXX with a balance due of {$490.00}. Recalling the extreme XX/XX/XXXXI suffered inXX/XX/XXXXas a result of this judgement, I searched the court records to see the procedural due process leading to the XXXX default judgement. What I found was that in XXXX I was accused ofXX/XX/XXXXandXX/XX/XXXX were filed XXXX XXXX XXXX XXXX XXXX. Apparently there was no judge assigned to the case but somehow I was fined {$170.00} which was allegedly due to be paid by XX/XX/XXXX. On XX/XX/XXXX a petition was filed against me in XXXX XXXX XXXX heard in Limited Actions naming the Plaintiff as XXXX XXXX XXXX. The statute of limitations in Kansas for civil actions is five years. The City of XXXX Municipal Court filed a petition on a ten year old traffic fine, the Plaintiff was represented in Limited Actions court by their Attorney of Record, XXXX. XXXX XXXX in XXXX which is also the debt collection agency which garnished my XX/XX/XXXX account in XXXX. I'm going to send an inquiry to validate the debt. I am also expecting the evidence of jurisdiction for the Limited Actions court to hear a claim for XXXX year municipal court fine of less than XXXX $ since the statute of limitations to file a civil cause of action in KS is one year from the discovery of the alleged delinquent account. and since I've never paid on this account. Deceptive acts and practices, false claims, unfair debt collection practices, prosecutorial misconduct and abuse of process. Fraudulent activity and judicial misconduct.

This judgment was filed XX/XX/XXXX in XXXX County. I found out that the federal prohibits someone from collecting debt after ten years in the state of XXXX. The business alleged debt refers to XXXX XXXX XXXX, Doing business as LLC. They are out of business and also in the state of XXXX, which is out of the jurisdiction for them to collect from me without filing in the state of XXXX, where the debt originated and since the debt was not sold they are committing fraud. The collection agency that continues to try to collect the debt is a collection agency, which is in the state of XXXX and is the Attorney at Law P.A. Kent Hollins. They use a bogus account number that claims they have a XXXX County case Number registered through the court. I have contact the court about this issue and they have no Judgment listed under the number that the collection agency is using to collect the debt. They are attempting to continue to collect by a the letter sent by them, to persuade me to sign a form that they continuously keep sending, which states if I have a dispute to sign and request a court hearing. My Bank account has been garnished for the second time now and the first time they release the judgment because they found out through investigation that it was bogus and released funds back into my account. The collection agency came back again raising the amount from {$620.00} to {$740.00} on XX/XX/XXXX and then raised the amount XX/XX/XXXX to {$830.00}. I contacted them after speaking with the bank representative to resolve the issue by asking if I can settle out with them by giving them {$50.00} and they refused that offer and requested for more information and after that conversation I told them I would get an attorney and they told me to do this. Since the bank I bank with is a third party to parties that are trying to collect the debt, they are waiting on me to send them a letter and proof of this debt being fraudulent. I am sending my evidence to resolve this issue.

I didn't know anything happened until I got my direct deposit and noticed I was missing a huge amount of money. A couple of days later I got a letter in the mail from my human resources office of a copy of a court ordered garnishment. The paper showed my maiden name ( XXXX XXXX ) and an address in XXXX, Florida ( XXXX XXXX XXXX XXXX XXXX XXXX XXXX, FLORIDA XXXX ) in which I've never lived or have ever been. I also noticed that my own human resource office gave these people my current address without my consent or informing me of this. I never got a chance to exercise my rights of this claim/judgement/court order as I didn't know anything about it. I also noticed that the original creditor is XXXX. The only XXXX I know is a gas station, and if I ever owed them anything that wouldve been over 20 years ago, which is well past the statue of limitations. I was paid by my employer on XX/XX/XXXX, on XX/XX/XXXX my bank account was drained by a Garnishment for a Civil Judgement I had no idea even exsisted. They sued me for a account that was supposadly opened in my name in XX/XX/XXXX. I was XXXX at that time, I didnt have anything in my name. They filed this suit in XX/XX/XXXX. I have NEVER received a summons for court, I have NEVER received a notice stating there was a garnishment or my right to appeal the garnishment. I have never been served. I was completely unaware of this debt until my bank told me today. about a month ago I started getting calls threatenting me about a Law Suit, they were even calling my parents, grandparents, and minor child threatening that I need to get an attorney and call them to prevent jail time. When I called they could never give me any information and stated they were unable to find record of a debt. So I reported it to the Consumer protection website because they couldnt give me any information so I figured it was a scam. I dont know if that was in relation to this or not. But this court case began 11 years ago, from a debt that was wayy older and that I dont even know about because I was a minor. Now I have no money, I have XXXX kids, I care for my father who is batteling XXXX XXXX XXXX XXXX, and I was just diagnosed 2 months ago with a XXXX XXXX XXXX ( XXXX XXXX ), I couldnt even pay my rent, or get gas in my car or food for my kids or get my prescriptions which my life depends on!! If i would have know about this judgement I would have taken care of this a long time ago, I would not avoid a court order. I didnt even know you were able to access court records online until today! Is there anything I can do to fight this? or to get my money back? I am DESPERATE.

I one day noticed my paychecks were smaller and called HR. Then found out that there was a garnishment for {$4000.00}. I NEVER received notification. I called the lawyer who was doing it and they said it was for a debt from a bank in which I closed my account back around XX/XX/XXXX-XX/XX/XXXX and withdrew all my savings of {$8000.00} and asked the teller if we were good and she said yes. The bank had went out of business not long after. I asked what the debt was for they said an old account of a little over {$1000.00} with the bank. I told the woman I closed my accounts when I was moving and remarrying so did not see how and they never notified me of the debt to try to set up a plan or prove it or even of a garnishment. They have taken well over $XXXX XXXX already and still harass me. They also told me when I called them that they have another debt from a XXXX bank with an old boyfriend. I told them I never had a XXXX XXXX account. And not with him either. I called XXXX and they said they NEVER showed me having an account either or debt. I asked them for proof and they refused and are threatening to garnish it too. This law firm is taking {$4000.00} from me and never notified me or provided proof on a debt with no evidence or even tried to work with me and I am a single parent dealing with XXXX and XXXX and they are rude and always threatening. Plus we are talking over 13 years old and a bank that is long out of business. Please help

I did file another complaint with your agency before and I though this matter was taken care of and the bank was able to remove the restriction and restore my account. H. The bank is informing me that even though this is fraudulent, they are under the order of the collection agency, until this matter is resolved. On XX/XX/XXXX, we received a letter related to a notice of unpaid judgement with Account # XXXX. This was the first letter we have received, with little to no information about the reason for the debt. After multiple calls and emails with the debt collection agency, we found out this was related to a bad check written in XXXX, in the amount of {$14.00}. We were not aware there was insufficient funds in the account, and the first time we hear of this debt. We called the agency several times to negotiate paying for anything we owed regarding the principal, we offered to pay a settlement of {$200.00}, they wont respond to our calls or emails. We have escalated several times, and they do not return our calls. They are trying to collect over {$810.00} for a check in the amount of {$14.00}. We can not even get information related the first correspondence or the statute of limitations. They demand we provide them a SSN and other personal information to discuss the case with us. They also claim we sent them a money order for {$44.00}, which we do not recall ever sending.

The debt collector H Kent Hollins filed for garnishment 4 times including emptying my bank account. They have repeatedly harassed me with phone calls at all times day and night. They filed a lawsuit against me for XXXX $ owed. Which was due to me moving out of state and have sent communications to my employers regarding my debt. Since they bought the debt ( to which I tried settling with the original debt or as well as trying to settle with the collector and the collector refused to settle ). They have levied multiple unexplainable fees, 300 % over the original amount and will also charge additional fees to pay over the phone etc. They are not out to settle a debt, they bought a debt and have levied fees against it in order to balloon the balance. I have reported them to the XXXX, the KS Attorney General as well as you guys in order to stop their aggressive collection practices, their defamation via garnishment and their addition of misleading fees against a debt that has been paid for all intents and purposes.

I have repeatedly tried contacting this creditor after he continued to call and harrass me even when I had set up a payment arrangement online to get this debt settled once and for all. This debt is more than 10 years old and he continues to try and sue me for it. The last time I had a dealing with them they would call me and I would call them back and try to negotiate with them and they would tell me I am in garnishment status so there is no negotiating with them. This was after I had already paid over {$370.00} to them to get them off my back. They continued to try and get my employment information and bank information and when I wouldn't give it to them they would hang up on me. They refused to take any reasonable payment plan I had to offer them so even when I agreed to the amount online it wasn't good enough and they kept telling me I was in default and in garnishment status and they wouldn't let me negotiate any reasonable solution. They just continued to hang up on me.

It is for an old bank account and the debt is {$440.00}. I have been told to appear at a show cause hearing. I have told the company I cant make it to the court hearing due to health reasons and as well as Im on XXXX and limited on funds. I have set up a payment arrangement with the company however they still want me to appear in court. I have only been sent the letter for court in the mail and not properly served by a sheriffs office. The court date is in another county and I live 3 hours away from that court. Kent Hollins of Law Office of H Kent Hollins filled a Wage Garnishment for the same account knowing that the amount was paid in full. Attempts to contact them have resulted in a road block. A company called and stated we owed a debt. We asked for proof and never received any. Years later they called again. We still were not given answers. They claim the debt is from 2007 b ut fail to provide proof. Now they keep sending letters that show debt and a 12 % interest rate monthly. They garnished my husband wages until we moved and he changed jobs. Now, they 're sending letters again demanding money.

Over the course of 5 years, i received a call from the debt collector no less than 5 calls a week and often 2-3 times a day.
