On XX/XX/XXXX an unsigned Writ of Execution ( dated XX/XX/XXXX ) was received by my employer and was sent to me via email on the XXXX of XX/XX/XXXX regarding wage garnishments. I contacted the company listed on the Writ as the plaintiff XXXX Guardian Capital Management Hawaii LLC ) in which they advised they don't have the file and I have to contact the attorney listed on the Writ. I then made several attempts to contact the attorney XXXX XXXX XXXX XXXX XXXX and XXXX ) by phone on the number listed on the Writ of Execution which is XXXX, and spoke with XXXX XXXX who confirmed she received my voicemails and forwarded them to XXXX XXXX who is the attorney working on this case. However, after many attempts made to contact XXXX XXXX, I had not yet received any call back to discuss this case as of XXXX XX/XX/XXXX. I have never received a court summons for the hearing that created this judgement against me nor have I received the Validation Notice that they are required to send me prior to garnishment. The Validation Notice is to include a full accounting of debt principal, interest, original loan date, and current amount due as well as original creditor and account number. This debt has not been verified nor confirmed by me as being a legitimate debt. This debt does not reflect on any of my credit reports that I recently pulled as of XX/XX/XXXX. I had filed XXXX XXXX XXXX in Hawaii on XX/XX/XXXX so all existing debt at that time was discharged and furthermore, I paid off all open collections listed on my credit report as of XX/XX/XXXX. I then submitted a letter of dispute by dropping it off to the attorney 's office as well as mailed a certified signature receipt required copy via XXXX yesterday XX/XX/XXXX. I have been living in XXXX XXXX since XXXX and did not make any new loans. All companies involved ( whoever the original debtor is ), Guardian Capital Management Hawaii LLC and the XXXX XXXX XXXX XXXX and XXXX did not follow the CFPB regulations. Only after I left another voice message for the attorney stating that I was filing a complaint with the CFPB and Federal Trade Commission did I receive a phone call back which was at XXXX ( XXXX ) on XX/XX/XXXX. I then met with him when I dropped off my attached letter of dispute in which he stated he will contact his client to remove the Writ of Execution of wage garnishments and advised he will hopefully hear back by the end of the week.

I received a call on XX/XX/XXXX from this debt collector saying I owed money from a past due in a state I used to live in. The lady I spoke to over the phone told me she would send me a letter from their company and I never received one, so XXXX comes around and they call me again. I say I have never received it and the same lady tells me there is nothing she can do and that she can not send me another one. She offers to let me sign in their payment portal and I get disconnected. I tried to call back but this time a male answered. This was on XX/XX/2021 at XXXX XXXX MST. He then asks if I have a friend I could borrow money from to pay this debt. I hang up because I cant believe that was said. I manage to call back and get the same collector employee who was handling my case. I was able to login to the portal and see my total amount. The amount due keeps getting higher. I decided to write a letter to get this debt validated. Since then it has been more than 30 days and no one has tried to contact me to validate my debt and the amount I owe just keeps getting larger and larger.

On XX/XX/XXXX I had XXXX XXXX on my right eye. All XXXXXXXX XXXX XXXX were paid by my primary insurer XXXX XXXX XXXX & secondary insurer XXXX. On XX/XX/XXXX I had XXXX XXXXXXXX on my left eye ( by same provider ) and all XXXXXXXX XXXX XXXX were paid by my primary insurer XXXX XXXX XXXX & secondary insurer XXXX with the exception of XXXX on XX/XX/XXXX. I received 3 notices/bills in the amount of {$600.00} for the XXXX provided on XX/XX/XXXX from XXXX XXXX XXXX XXXX I contacted provider after each bill ( last contacted on XX/XX/XXXX ) advising provider to submit bill to my primary insurer XXXX XXXX XXXX & secondary insurer XXXX. Each time I was told the provider would relay info to the " back office '' and I would not be sent to collection. I received no further contact from XXXX XXXX XXXX. On XX/XX/XXXX I received a bill dated XX/XX/XXXX from Guardian Capital Management Hawaii XXXX XXXX XXXX XXXX XXXX for {$600.00} for services provided by XXXX XXXX XXXX referencing Date of Service XX/XX/XXXX. This charge is covered on my qualified XXXX beneficiary program.

A debt from Guardian Capital Management for an account placed by XXXX XXXX XXXX is demanding the amount of {$4100.00} dollars. The XXXX XXXX XXXX XXXX a housing capacity for student in the state of XXXX I was a student and I held a room there at the XXXX XXXX XXXX but one night an altercation with the room mates led to them calling the police. When the police arrived I was forced to leave. I returned the next afternoon only to be allowed to remove my belonging from the room and told that if I returned I will be considered trespassing and they would call the law to arrest. I never returned but signed out my lease because I had to return the keys. There was a one month security deposit they held and now they want me to pay for the months I did not stay in the lease. This is three or 4 months of rent they are trying to collect but I did not stay with the lease. A police report was filed on the day of the altercation. Please advise. XXXX

When I was XXXX in Hawaii I bought a truck for XXXX upon contract completion I got out on military orders to leave. The lender would not allow me to ship the vehicle with me so I was forced to do a voluntary repo. After a year of discussing back and fourth with the lender I was made aware that all debt was cleared and the account was closed. Now ( XXXX later ) I happen to check my credit report and I have a collections for XXXX with the lenders name as the original lender. Im not sure what it is for, and was never sent a letter or notified of the collections before they reported it to my credit. I have taken a major loss in credit due to this. I feel it is extremely damaging to come after my credit without ever giving me a chance to dispute or resolve the debt. Thank you.

On XX/XX/2020, GUARDIAN CAPITAL MAN add a derogatory mark on my credit reports. GUARDIAN CAPITAL MAN did NOT provide me a HIPAA release that releases my medical information to them, therefore by providing such information they are in VIOLATION of my HIPAA rights. I am proceeding with legal action as prescribed by law against the above named original creditor/collection agency should this item not be deleted within the required time allowed by law. I will seek every legal remedy available to me and file suit against the credit bureau responsible for reporting this violation. I urge you to take this extremely seriously as I have documented my case without error. I encourage a response from you expeditiously.

I have asked Guardian Capital Management to validate a collection they are reporting on my credit reports on XXXX/XXXX/16 and they have failed to provide anything that would support the fact that they are attempting to collect on a debt without an agreement or contract. Nor have they supplied anything other than a statement on one of the collections. I told them that I would be reporting them to you but they obviously do n't fear you because they failed to delete themselves or answer questions about the debt ( s ) that they are using to damage me financially. Its damaging my credit and it is important to me.

There was a wrongful use of my checking account from XXXX XXXXXXXX XXXX I asked help from the Bank that it was not me who purchased it. Staff from the bank said they will do a dispute and I dont have to do anything. Dispute came back and said I authorized the transaction. They closed my checking account. Few months came I received a notice about a debt in collection from XXXX XXXX XXXX that I owe {$590.00}. The original transaction from XXXX XXXX XXXX was {$530.00}. I did not receive a notice from XXXX that about the {$530.00} and this was sent directly to collection.

My rights as a citizen and a XXXX vet have been violated under FCRA/FDCPA by Guardian Capital Management. They have reinserted a previously reported debt. I have been advised by my attorney that I am entitled to {$1000.00} per violation in statutory damages and attorney fees. I do not wish to go down that route, but am prepared to do so. I am requesting that the CFPB please investigate this matter / Guardian Capital Business Practices. Guardian Capital Management LLC, the collections agency in charge of the account in question, hired a process server to serve me court papers. The process server went to my building and asked if I was home, upon being told I was not there, he served the court papers to the third party, my neighbor. This is an embarrassment and violates the Fair Debt Collections Practices Act. This breaches all privacy laws put in place to protect borrowers from their personal information being distributed to anything other than the borrow or their attorney.

They called to my cell, and I explain to them that I already paid it. I have all evidence but they keep calling to me. I ask to stop call me, but they call to my work after I ask not to call. They never sent me written notice but keep calling to me.
