( a ) Written notice by obligor to creditor ; time for and contents of notice ; procedure upon receipt of notice by creditor If a creditor, within sixty days after having transmitted to an obligor a statement of the obligors account in connection with an extension of consumer credit, receives at the address disclosed under section 1637 ( b ) ( 10 ) of this title a written notice ( other than notice on a payment stub or other payment medium supplied by the creditor if the creditor so stipulates with the disclosure required under section 1637 ( a ) ( 7 ) of this title ) from the obligor in which the obligor ( 1 ) sets forth or otherwise enables the creditor to identify the name and account number ( if any ) of the obligor, ( 2 ) indicates the obligors belief that the statement contains a billing error and the amount of such billing error, and ( 3 ) sets forth the reasons for the obligors belief ( to the extent applicable ) that the statement contains a billing error, the creditor shall, unless the obligor has, after giving such written notice and before the expiration of the time limits herein specified, agreed that the statement was correct ( A ) not later than thirty days after the receipt of the notice, send a written acknowledgment thereof to the obligor, unless the action required in subparagraph ( B ) is taken within such thirty-day period, and ( B ) not later than two complete billing cycles of the creditor ( in no event later than ninety days ) after the receipt of the notice and prior to taking any action to collect the amount, or any part thereof, indicated by the obligor under paragraph ( 2 ) either ( i ) make appropriate corrections in the account of the obligor, including the crediting of any finance charges on amounts erroneously billed, and transmit to the obligor a notification of such corrections and the creditors explanation of any change in the amount indicated by the obligor under paragraph ( 2 ) and, if any such change is made and the obligor so requests, copies of documentary evidence of the obligors indebtedness ; or ( ii ) send a written explanation or clarification to the obligor, after having conducted an investigation, setting forth to the extent applicable the reasons why the creditor believes the account of the obligor was correctly shown in the statement and, upon request of the obligor, provide copies of documentary evidence of the obligors indebtedness. In the case of a billing error where the obligor alleges that the creditors billing statement reflects goods not delivered to the obligor or his designee in accordance with the agreement made at the time of the transaction, a creditor may not construe such amount to be correctly shown unless he determines that such goods were actually delivered, mailed, or otherwise sent to the obligor and provides the obligor with a statement of such determination. After complying with the provisions of this subsection with respect to an alleged billing error, a creditor has no further responsibility under this section if the obligor continues to make substantially the same allegation with respect to such error. ( b ) Billing error For the purpose of this section, a billing error consists of any of the following : ( 1 ) A reflection on a statement of an extension of credit which was not made to the obligor or, if made, was not in the amount reflected on such statement. ( 2 ) A reflection on a statement of an extension of credit for which the obligor requests additional clarification including documentary evidence thereof. ( 3 ) A reflection on a statement of goods or services not accepted by the obligor or his designee or not delivered to the obligor or his designee in accordance with the agreement made at the time of a transaction. ( 4 ) The creditors failure to reflect properly on a statement a payment made by the obligor or a credit issued to the obligor. ( 5 ) A computation error or similar error of an accounting nature of the creditor on a statement. ( 6 ) Failure to transmit the statement required under section 1637 ( b ) of this title to the last address of the obligor which has been disclosed to the creditor, unless that address was furnished less than twenty days before the end of the billing cycle for which the statement is required. ( 7 ) Any other error described in regulations of the Bureau. ( c ) Action by creditor to collect amount or any part thereof regarded by obligor to be a billing error For the purposes of this section, action to collect the amount, or any part thereof, indicated by an obligor under paragraph ( 2 ) does not include the sending of statements of account, which may include finance charges on amounts in dispute, to the obligor following written notice from the obligor as specified under subsection ( a ), if ( 1 ) the obligors account is not restricted or closed because of the failure of the obligor to pay the amount indicated under paragraph ( 2 ) of subsection ( a ), and ( 2 ) the creditor indicates the payment of such amount is not required pending the creditors compliance with this section. Nothing in this section shall be construed to prohibit any action by a creditor to collect any amount which has not been indicated by the obligor to contain a billing error. ( d ) Restricting or closing by creditor of account regarded by obligor to contain a billing error Pursuant to regulations of the Bureau, a creditor operating an open end consumer credit plan may not, prior to the sending of the written explanation or clarification required under paragraph ( B ) ( ii ), restrict or close an account with respect to which the obligor has indicated pursuant to subsection ( a ) that he believes such account to contain a billing error solely because of the obligors failure to pay the amount indicated to be in error. Nothing in this subsection shall be deemed to prohibit a creditor from applying against the credit limit on the obligors account the amount indicated to be in error. ( e ) Effect of noncompliance with requirements by creditor Any creditor who fails to comply with the requirements of this section or section 1666a of this title forfeits any right to collect from the obligor the amount indicated by the obligor under paragraph ( 2 ) of subsection ( a ) of this section, and any finance charges thereon, except that the amount required to be forfeited under this subsection may not exceed {$50.00}.

In XX/XX/XXXX I reached out to Grow Credit and let them know that I was unable to set up auto pay, they offered no resolution as to why their system was not allowing me to do so. All of their " support '' is done via email, so there is nobody who will call you to assist in troubleshooting issues. They provided a link to make a one time payment. I did that for several months as I was never able to get back into autopay. On XXXX XX/XX/XXXX, I moved from the United States to XXXX. On XXXX XXXX, XXXX I had noticed that " XXXX XXXX XXXX Grow Credit '' was reporting 30+ late on my credit report. This was stemming from a XXXX charge on the account that I was not aware of. Prior to moving to XXXX, I had contacted XXXX via phone and closed my account and was assured it was closed after the current billing cycle ( This was sometime in early XX/XX/XXXX ). Lots of companies geo-block you ability to access their websites and apps from overseas, even with the use of a good XXXX. Grow Credit is one of those companies as well as XXXX, which is why I called them after I moved to make sure the account was closed. I have access to my XXXX line whilst living here in XXXX. I reached out to Grow Credit via email support on XXXX XX/XX/XXXX and advised them that I had moved overseas, wasn't able to get into their site and noticed the 30+ days late on my credit report. As I was not able to access the app or website for Grow, I had NO correspondence from them that I owed them money. No emails, no texts, no phone calls. Due to this, I was unable to pay. As soon as I saw the balance owed on my credit report, I contacted family back home and had them login and make the payment with my debit card. This brought my account balance down to {$0.00}. I initially wanted to close my account with Grow, but " XXXX '' convinced me to keep the account open as it was a reporting tradeline. He stated they could remove the late report as a good faith removal and make it so my Grow account couldn't be utilized for payments. Basically it would report as an open tradeline, but as long as I was overseas, they'd prevent anyone from being able to charge it. He stated if I went forward with a closure, they wouldn't be able to honour the good faith removal. I agreed to the terms of keeping the account open and allowing me to not access the funds so no further issues arose. On XXXX XXXX, I reached out to Grow again under the same email thread advising that my credit was still reflecting a late payment. A " XXXX '' got back to me saying that when I requested to cancel, they canceled the internal request to update my report. Nobody adivsed me that I was to re-ask for them to do that. A reasonably prudent person would presume that if they are offering to keep the tradeline open so I could get the removal, they would do that. On XXXX XXXX, Grow emailed back stating from " XXXX '' that they " decided to grant the goodwill late payment forgiveness. Please allow 60 to 90 days for the credit reporting agencies to update your credit report. '' On XXXX XXXX I had put in a dispute with the credit bureaus, namely, XXXX, in regard to inaccurate information that was showing on other parts of my report. I decided to include Grow Credit in this dispute as I knew they would reach out to Grow to confirm accuracy. I got the results of my report today, XXXX XX/XX/XXXX and not only has Grow credit kept the 30+ day late reporting on my report, they added another one and made all of my other history " unknown '' instead of current. They also reflected that I have a current balance of {$20.00} on my account, which is not true. Additionally, they stated my last payment was XX/XX/XXXX, which is also not true. The report went from having a single XXXX late to being all sorts of wrong. This is my last ditch effort to amicably resolve this issue with Grow and the credit bureaus before I move onto legal action with an attorney that deals with consumer issues.

On XX/XX/XXXX I became aware that Grow Credit had reported to the credit bureaus that I was late making my payments for the month of XXXX and XXXX, XXXX. Their app connects automatically to the customers bank account and can access balances and take payments automatically. They told me that my balance was insufficient at the time they tried to take the payment, so they did not process it. The balance has been too low that morning, but I had transferred funds since they had checked the balance, and the funds were available at the time the payment would have processed, had they actually gone through with charging my account. They informed me via chat on their application that once that happens, they can not accept a payment that day, regardless of whether I provide them different account information, a debit card to charge, or even if I inform them that the balance is sufficient and they can take the payment. They only check once a day according to their representative, and if the balance is insufficient at the time they check, the customer can not pay on-time another way that day, no matter what. Unfortunately that day also happened to be the day it was due. I tried to make the payments on their application and the website but they blocked me from doing so on the payment due date, which was also the date that the statement was generating for the following month. They said that is just how the payment processing works and that I could pay using only XXXX that day, which is not realistic since not everyone has or can even get a XXXX account, and that I would have to wait until the next day to pay, regardless of the impact it could have on my credit. I contacted them via the chat feature on the application to discuss this, and was told if I just waited until the statement was processed the next day, that I could make a payment via another account or card, but not until the following day, which was too late to be on-time. I waited, since I had no choice not to, and paid the payment the next day. The funds were available at the time they would have processed the payment, but they never even processed it because their check of my balance earlier that day showed it was not sufficient. It was however sufficient later that same day, but they refused to process it or accept any payment that day ( the due date ). When I checked my credit report in XX/XX/XXXX, I saw that they had reported the payments in question as being late. I feel that I am not at-fault for them being late since they didnt allow me to pay them before they became late as the option wasnt available, and even reused to take my auto-payment because of their own systems inadequacies and failure to check for balance when attempting payment, not hours before. I do have screenshots of the chat in question from XX/XX/XXXX when I contacted them to discuss this. They told me the same thing again, and that it was my fault for not paying by the end of the due date, but that they would accept my payment ( from whichever card or account I chose ) the next day. I am requesting your assistance in resolving this matter, as I have tried myself and have been unsuccessful. I even attempted to dispute it with all 3 credit bureaus, but they did not agree that Grow Credit was liable, therefore they still show on my credit as being late. I spoke with a Grow Credit representative and was given the information above, and told they would not change the late payment reporting, even though it was due to no fault of my own. I look forward to a resolution in this matter and please feel free to contact me with further questions. I apologize if my message is hard to understand, I have never done this before. Provide copies of all correspondence and any conclusive documentation to prove that you have conducted a reasonable investigation of the account in question. Provide the date of the commencement of delinquency. Please provide the specific date on which the items will cease to be reported. I kindly asked for a notarized affidavit to validate the accuracy and truthfulness of the provided information, in accordance with my civil rights protected by various federal laws. It is important to emphasize that a generic response letter will not suffice. If you are unable to promptly provide all the required details as outlined in multiple laws, including but not limited to the Fair Credit Reporting Act, I hereby insist on the immediate and permanent removal of this entry from my credit report. Hi on XX/XX/XXXX I noticed an email from this company stating they reported on time payments with them. I emailed and asked what is the service because I do not recognize the company nor do I recall signing up a virtual subscription credit limit of {$17.00}. I asked for the account to be deleted and cancelled. As of now they havent done so and instead of rectifying the problem over XXXX representatives have emailed me about not closing the account and telling me that I had to have sign up for the account. Again I do not recall it and neither have seen this on my credit report. Now I asked for a PASSWORD RESET. It said the reset code will go to a phone number. I DO NOT HAVE ACCESS TO THE PHONE NUMBER ASSOCIATED WITH THE ACCOUNT and I told them that XXXX. So how can I close an account if i dont have the phone number nor do I know the phone number and no im not updating the account nor information to do so. Therefore I asked them to cancel the contract and close the account since they are the ones who can see what Im not able to see. They are the ones sending out emails talking about congrats on an on time payment when Ive NEVER used this at all. They claim it was opened in XXXX and again. I do not recall such thing happening nor me doing it. What is so difficult about closing an account? I also gave the dob and zip code and this support person says they will get back to me when they are able too. Like look XXXX nobody has all day for the XXXX Delete and get this over with.

I opened an account with grow credit. make a monthly payment to them plus a small processing fee, then I can use their virtual visa to pay for certain services. I linked my bank account and paid from said bank account without fail for close to a year or more. Every so often they would report to me that my bank account didn't have enough funds to cover the charges ; this was never the case. Even when I manually tried to initiate the payment their systems would refuse to accept the payment. I reached out to them numerous times, they're telling me that their system reports I have insufficient funds in my bank account. None of this is true, they refuse to process the payment and now they reported a XXXX days late charge on my credit report. This is for XXXX dollars! Not only that, I had to migrate my XXXX payment the the same bank account Grow Credit tries to tell me doesn't have XXXX dollars. I've also attached a screenshot from Credit strong where I make 10x the payment to them each month that grow credit says I don't have in my bank account. I clearly have the funds in my account and was successful making payments for many months without issue and I still continue to make payments to others from the same bank account. I am not sure what grow credit is trying to accomplish by lying about my bank account when I can also provide bank statements as well showing payments successfully being withdrawn every month.

I opened a Grow Credit account in 2022 after seeing an advertisement on the internet saying how this app could boost your credit. In rebuilding my credit from filing bankruptcy I always like to try little things that will continue to give me a boost. This service has absolutelty been the worst thing in my life. After reviewing my credit report in preperation for trying to buy a home I noticed I now have 3 negative reports on my credit and the account is still open after asking for it to be closed and for my reporting to be corrected. This app uses the XXXX system to connect your bank acccount and it consistently disconnects. I recall having to reconnect my bank account roughly every month although it was on autopay. I also was told that if your balance is low they will notifiy you a couple days before the payment is to come out. First of all I am specific of the account I connect to apps and I move money around all the time. There was more than enough to cover the payment for this account and if it wasn't it would pull from the account connected for overdraft. As a banking professional thats why they invented OVERDRAFT PROTECTION! These late payments are effecting me in a major way and I am requesting they be removed from each credit bureau using the XXXX system for accuracte reporting which will push out to all the credit bureaus and by pass the normal 30 day waiting periodt if done in another manner outside of this.

I contacted Grow Credit as a result of an entry on my credit report that I have no knowledge of. I have disputed the account in the past and they continue to hold me accountable for it. I finally made contact with someone via chat on XX/XX/2022 who acknowledged that it appears I was the victim of identity theft. She then told me that I needed to file an identity theft claim and they would remove the account from my credit file. I did that instantly and provided the number. Then she said I needed to complete an affidavit and they would have to research further. This company is giving me the run around over {$6.00}! The account shows that the available credit was {$180.00} but the due amount is {$6.00} that has been reporting for over a year negatively on my credit. This is insane. They are making me jump through hoops and each time I do what they ask, they make a new set of rules to prolong the process.
