This complaint, against Great Western Bank, is part of a money laundering ring that is the subject of five other currently active CFPB complaints. ( For your reference, those claim numbers are XXXX-XXXX, XXXX-XXXX, XXXX-XXXX, XXXX-XXXX, XXXX-XXXX. ) Im also in the process of submitting two additional complaints ( against XXXX XXXX XXXX and XXXX XXXX XXXX XXXX XXXX ) but dont have claim numbers yet. The money laundering scheme took place over many decades and involved operators at multiple banks using check endorsements to transfer money to numerous different accounts either to conceal the location of the money with bogus account numbers or to monetize the checks with each stamp allowing for double, triple or quadruple the value of the checks written amount. Many of these checks were forged duplicates of legitimate checks I had written and were put to use for money laundering by criminal operators at the banks where I held my checking and savings accounts. The role of Great Western Bank in the criminal conspiracy is unique and is evident in two separate circumstances : 1 ) A loan I had at XXXX XXXX XXXX was evidently sold to Great Western Bank despite the fact that this appears to be a violation of the Note & Security Agreement on the loan contract. HOWEVER, even before Great Western Bank bought my debt, Great Western Banks FEIN number not XXXX XXXX XXXX was appearing on certain transactions in my bank statements. ( One of the tactics money laundering operators at my bank was using was setting up duplicate payments and then diverting the ACH Return Entry to a different account. It was on these return entries that Great Western Banks FEIN number was appearing. ) 2 ) I was forced into bankruptcy two different times by this criminal operation and was ordered to make payments to the Federal Bankruptcy Trustee for District XXXX ( Nebraska ) XXXX XXXX. Duplicated/forged checks made out to XXXX were often moved through Great Western Bank, XXXX XXXX SD, into account # XXXX. Bankruptcy Court is required by Federal regulations to use a XXXX XXXX XXXX, and Great Western Bank is not a XXXX XXXX XXXX. So, was Trustee XXXX illegally using a non-XXXX XXXX XXXX or are these examples simply forged duplicates of the payments I made to XXXX that someone at Great Western Bank was transferring to accounts set up to receive laundered money? Evidence : Please see attached documents for the evidence referred to in the following descriptions. p. 1 : On XX/XX/XXXX I made a payment to XXXX XXXX XXXX of {$500.00}. This was a loan payment on a truck I bought. Duplicate payments were made ( by the conspirators ), and I received a return receipt ( though I have no idea where the refund actually went ). It says the return went to account # XXXX, though someone handwrote my account number on the return. But the return statement said it was being returned from FEIN # XXXX. That FEIN number does not belong to XXXX XXXX XXXX. It belongs to 7 Nebraska branches of Great Western Bank. The original truck loan was later transferred on XX/XX/XXXX to Great Western Bank, and the FEIN # stayed the same. p. 2-3 : Note and Security Agreement with XXXX XXXX XXXX XXXX XXXX for the purchase of the truck dated XX/XX/XXXX. Loan # XXXX. On the bottom of the note, the disclosure statement says that the loan is between XXXX XXXX XXXX XXXX , XXXX and XXXX XXXX XXXX XXXX XXXX and the debtor ( me ). p. 4 : First payment to Great Western Bank on XXXX shows FEIN # XXXX as note owner. p. 5 : Letter notifying of full payment of loan # XXXX and cancelled note from Great Western Bank XXXX. So, who owns this note? XXXX XXXX XXXX? Great Western Bank XXXX? All the branches of Great Western Bank tied to this routing number? If the security agreement specifically states that the loan is between XXXX XXXX XXXX XXXX, XXXX XXXX XXXX and me, why is Great Western Bank involved at all? Or, what if both banks actually own the complete amount of debt probably with a different note number? I made my standard payment of {$500.00} every month, and the money launderers created a forged check for each of those debts. Quite possibly, both payments would be used for money laundering every month, each monetized multiple times allowing $ XXXX {$45000.00} in dirty money to be cleaned each month. I know that the money laundering operation had created at least 5 sets of unauthorized checks for my accounts. They may have used checks from any or all these accounts to make payments every month toward the debt in my name. Since those payments were redundant, they would have been returned but they were diverted to a different account, not mine. How is Great Western Bank involved in the money laundering and who is benefiting? Are they legally allowed to buy my debt anyway? When I made bankruptcy payments in XXXX, they went into an account that already listed a minimum balance of {>= $1,000,000}, according to Bankruptcy Court paperwork. I think the criminal operation had been laundering money through me into this account beginning as early as XXXX. By XXXX, when they put the bankruptcy process to use for money laundering, the account already contained XXXX XXXX less than {$10.00} XXXX. Multiple truck payments could be just one explanation for how money was ending up in this account. Or they may have used other businesses as unwitting mules like me for additional money laundering. Im not certain Great Western Bank XXXX XXXX, SD account # XXXX is the account that received this {$10.00} XXXX but its a good guess and worth investigating. Who owns this account? Where did the {>= $1,000,000} come from and where did it go? According to Great Western Bank, this account is a trust with XXXX XXXX listed as a trustee of this account, but I dont know the holder of the trust. p. 6 : My account statement at US Bankruptcy Court listing account minimum balance as {>= $1,000,000}. I dont know if this money was in GWB account # XXXX, but it is a good possibility. p. 7 : Check # XXXX PAY TO THE ORDER OF : XXXX XXXX XXXX Trustee {$2000.00}. XX/XX/XXXX Stamp endorsement PAY TO THE ORDER OF GREAT WESTERN BANK, Routing # XXXX account # XXXX. The signature is a very blatant and obvious forgery, a duplicate of a bonafide payment I had made. p. 8 : Check # XXXX PAY TO THE ORDER OF : XXXX XXXX XXXX {$2000.00} 1. Endorsed at Great Western Bank XXXX XXXX, S.D. ( Routing # XXXX ). Additional # XXXX ( not sure what it refers to ) on XX/XX/XXXX on back 2. Endorsed at Great Western Bank XXXX XXXX, S.D. ( Routing # XXXX ) Additional # XXXX ( not sure what it refers to ) on XX/XX/XXXX - on front 3. Endorsed at Great Western Bank XXXX XXXX, S.D. ( Routing # XXXX ). Additional number # XXXX ( not sure what it refers to ) on XX/XX/XXXX 2nd time on back 4. Endorsed at XXXX XXXX XXXX Mn. ( Routing # XXXX ). Additional number # XXXX ( not sure what it refers to ) on XX/XX/XXXX 5. Endorsed at XXXX XXXX XXXX, XXXX, Ga./XXXX, IL ( Routing # XXXX ). Additional # XXXX ( not sure what it refers to ) on XX/XX/XXXX on back Why was this check stamped on the front and the back, 6 times total? Was it endorsed for each stamp? How many of those transactions deposited money? Is it possible to endorse a check from XXXX, Ne. to XXXX XXXX S.D. to XXXX, Mn. to XXXX, Ga. in 2 days? Perhaps its possible with XXXX but whats the purpose of moving the money to so many different banks and different accounts? p. 9 : Check # XXXX PAY TO THE ORDER OF : XXXX XXXX XXXX Trustee {$2000.00}. XX/XX/XXXX This check is endorsed twice at Great Western Bank ( routing # XXXX ) XXXX XXXX, SD. It supposedly goes into account # XXXX. Is it just stamped twice or was it monetized twice? This is not a XXXX XXXX XXXX. US Bankruptcy Courts are required to use a XXXX XXXX XXXX. So, either XXXX is breaking Federal regulations by using a non-XXXX XXXX XXXX for US Bankruptcy Court transactions or she or an employee of Great Western Bank is using this account ( and my Bankruptcy payments ) in a way that is totally unrelated to her legal Bankruptcy Court responsibilities. p. 10 : Check # XXXX PAY TO THE ORDER OF : XXXX XXXX XXXX Trustee {$2000.00}. What legitimate purpose could there be for moving it so many times? How many of these are actual transactions? Thats 8 opportunities for corrupt bankers to hide dirty money. If each stamp does in fact represent monetization, this check alone is worth {$16000.00} in laundered money. Finally, why is XXXX XXXX, the Federal Bankruptcy Court Trustee for the state of Nebraska, doing most of her banking in the state of South Dakota? Notice there are different routing numbers supposedly going to Great Western Bank XXXX XXXX ( according to the stamps ) : XXXX and XXXX. Whats the difference? Where is the money actually going? The money XXXX XXXX Ive documented with hundreds of checks ( described in this claim and my other claims ) demonstrates collusion at a minimum between XXXX XXXX, XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, XXXX and XXXX XXXX, Ne., Great Western Bank , XXXX , Great Western Bank , XXXX XXXX , SD and US Bankruptcy Court Trustee XXXX XXXX .

I originated my account with Great Western Bank in XXXX XXXX SD in XXXX. The same year I moved to XXXX and continued to bank with Great Western Bank. During my time in XXXX I needed to have my bank visa debit card replaced on three occasions. The first time XXXX XXXX from XXXX XXXX XXXX XXXX XXXX Branch agreed to send me my bank card by currier in advance and then collect payment from my account on or after the XXXX of the following month. Unknown to myself When XXXX went to take payment for the currier expense the money was not there as I had paid bills in XXXX. Instead of informing me of this XXXX met with her manager XXXX XXXX and both ladies agreed to waive the cost and agreed to not allow me to receive my card in advance in the future. While I remain grateful this was done both women failed to inform me of this change which meant that when I needed a replacement card the third time. I was told that I had to wait until the XXXX of the following month for my replacement card. I was upset by this because as a consumer I have the right to be informed of changes in procedures or policies. I was never informed neither was I given an invoice for the cost or the chance to remedy for the lack of funds such as arranging to collect the following month. So that when I needed my third replacement card I was told that I had to wait until the third of the following month. The most recent replacement card request was made on or around XX/XX/XXXX or XXXX XXXX. My complaint is this : I have the right to be informed of changes in policy or procedures. I did file a complaint with the bank and instead of apologizing I got railroaded. Notes were added to my account so that when I call the number on the back of my bank visa card employees are told to route my calls to either XXXX XXXX in XXXX XXXX SD or XXXX XXXX in XXXX XXXX, SD. Because of these restrictions I am denied the right to request small changes that customers can normally request by calling the number on the back of my bank visa card. I got help from a friend who deposited a modest sum of money into my bank account to cover the cost of currier so that I could get my third replacement bank visa card on time. Had I been informed of the change in procedure I would have known to be more prepared to ensure the money was there for payment to avoid waiting. Had I waited until the third my card would not have arrived until a week later which would have affected my bill pays. I have the right to be informed of changes made on how my account is handled and I have the right to be able to call the toll free number on the back of my bank visa card and get the help I need without being limited to or restricted to speaking to two personal bankers. As a consumer I feel that I am being railroaded by this bank and punished for lodging a valid complaint. Prior to my complaint I was able to call the number on the back of my bank card and get the help I needed. The only time I was required to deal with XXXX XXXX directly was to request currier delivery of my bank card. Again I remain grateful to XXXX for waiving the cost of the currier expense in the past. My complaint is I have the right to be informed of changes made and to be fair I have the right to be given the opportunity to remedy for the lack of funds by being presented with an invoice for cost of currier and then the funds taken the following month as needed. I never asked for this cost to be waived this was done without informing me. I was not aware of this. Neither was I given the opportunity to remedy this. I was also not told of the changes in procedures. My right to be informed of changes in their procedures in relation to handling my replacement card was breached and my right to receive reasonable help by calling the number on the back of my visa card is now breached as there are notes on my account to route all my calls to either one of the aforementioned personal bankers. I was not informed these notes were put on my account until I called the number on the back of my visa card. Then the employees informed me of these notes to route my calls to one of two personal bankers. Also I lodged a dispute with a company I did business with and whom I am not satisfied with their services. I lodged this dispute through Great Western bank who told me they do not allow customers to speak to their disputes team. This obliges me to relay my details to a banker who forwards my details to the dispute team. As a consumer I have the right to speak to the dispute team. I am denied this right and obliged to relay my details through various bankers depending on who answers the phone when I call. Also I was told that XXXX XXXX and XXXX XXXX do not handle disputes which then sets me up to fail when I call and am informed that my calls must be routed to either XXXX XXXX or XXXX XXXX. I started asking in XX/XX/XXXX for someone to call me about my HILOC coming due. I asked in XX/XX/XXXX and again in XX/XX/XXXX when I visited the branch office. Finally in beginning of XX/XX/XXXX, I called an asked the persons name and location to have a face to face conversation. She gave me a short list of things to get and said they can do a 90 day extension. I brought the items to her. I received a regular bill for XX/XX/XXXX and paid it. Two weeks later I was told I needed 2 years tax returns, which I did not have. ( I have an email from customer service that said my loan was extended in XX/XX/XXXX ) Because I did not have my previous tax return, I was advised I could not do another HILOC, I had to do a morgage instead. She sent my info to XXXX to do a morgage. He contacts me several days later asking for the same info and he told me she could not have done a HILOC in XX/XX/XXXX due to the account was past due, this is now mid XX/XX/XXXX. I advised I did not have the tax returns, they were with XXXX, and due to their policy change I had to wait to file to get access to previous returns. I startged getting late notices for XX/XX/XXXX and my credit was being ruined, there was no extension, or it was reversed. I got the irs to send me my tax return so i could get the loan done, I had been approved just needed the copy he said. I did not hear from XXXX for several weeks and I started calling again. He finally sent me the loan docs, 6 days before closing. Then these doc 's had to be changed, and I could not view them till I got into the office to sign. No discussion was held with me what I wanted, the bank decided to lock me into a 10 yr morgage with payments nearly half my income and made me escrow my taxes and ins, which I did not want. I am borrowing about 60 % of value of home. I asked if I had to have auto pay, he said no, I can pay when ever I wanted which was good, i wanted to pay earlier to cut down on interest. He called 2 weeks after loan is signed asking for my drivers license info. Now I am now being told I have to go on auto pay and they can only pull my regular payment 1 month after the loan is signed. I feel I have been lied to and misslead the entire time with what I wanted to hear just to keep the loan with them. I feel they had me in a corner and i could not get out of, this is now 60 days and was another mark against my credit. To go anywhere else, would have taken more time and a possible forclosure, yes they sent a forclosure threat even though they were refinancing me. To go somewhere else now will cost me anotehr XXXX in closing costs. I want someone to look into their deceptive practices.

My loan was originated by XXXX XXXX XXXX ( GWB ) XXXX XXXX XXXX SD on XX/XX/XXXX, and on XX/XX/XXXX, the loan was sold to XXXX XXXX XXXX ( XXXX ) and was done so without a Deed of Trust ( DOT ) being delivered or recorded to the XXXX County Registry of Deeds. As this did not stop GWB from owning the debt or XXXX from owning the debt, it made the loan an unsecured debt. The Note was signed by GWB XXXX XXXX XXXX XXXX for the sale onXX/XX/XXXX, and XXXX on XX/XX/XXXX submitted and got accepted my loan for XXXX XXXX XXXX XXXX created XXXX which XXXX XXXX XXXX XXXX XXXX endorsed in blank the Note ( XXXX ) on or about XX/XX/XXXX, as with all loan placed into the XXXX XXXX. On XX/XX/XXXX it was discovered that there was no recorded Deed of Trust at the XXXX County Register of Deeds Office so on XX/XX/XXXX, GWB who had no remaining financial interest in the loan, illegally had recorded the DOT XXXX recorded on XX/XX/XXXX, @ XXXX XXXX. GWB knows they sold the loan 21 days before the recording as did XXXX who never applied for an Assignment of Deed of Trust because the act as with the initial recording is against the law. XXXX on XX/XX/XXXX, had XXXX XXXX XXXX ( XXXX ) start mortgage servicing all XXXX XXXX Fed Gov loans ( FHA & VA ) without purchasing as with the program XXXX XXXX has possession of the blank Notes to prevent any sale ever of the loans. Wells purchase the building the loans were housed in XXXX WI, and hired the XXXX employees, as a physical possession was taken loan files with Wells as custodian of records as well as servicer, making it impossible for the loans to every be returned to XXXX. On XX/XX/XXXX, the XXXX seized XXXX and the FDIC declared it a " failed bank '', and the bank was defunct on that day. The debt stop existing as the bank stop existing and XXXX had no way to approach the court being a non-existing entity. XX/XX/XXXX, the law firm that hired in XXXX XXXX XXXX XXXX out of XXXX XXXX, who had their attorney that was the head of the foreclosure Dept XXXX XXXX as neither XXXX of XXXX was license to do business in Nebraska as they were not registered at the State Attorney Office, as XXXX has never been authorized to do business in NE. XXXXXXXX XXXX as an Assistant Secretary for XXXX forged Assignment of Deed of Trust XXXX to make it appear that GWB sold the loan to XXXX when in fact GWB had no financial interest in the loans. My home was illegally foreclosed on XX/XX/XXXX address XXXX XXXX XXXX XXXX ( XXXX ) NE. {$250.00} property without that debt, that was my property free of XXXX debt!

I divorced in XXXX at which time all mortgage liabilities were transferred to my ex wife.The mortgage in question was a second mortgage on her primary residence with Great Western Bank. This mortgage went into foreclosure after our divorce at which time Great Western Bank sent a letter of reinstatement to my ex wife, in her name only, with an offer to reinstate the mortgage and accept a {$20000.00} grant from Ohio Save a Dream. The reinstatement offer letter demanded that I also sign the " CIT '' " Change in Terms '' documents which were sent to the closing with the Save a dream grant. This closing took place in XX/XX/XXXX My ex wife informed both Ohio Save A Dream and Great Western Bank ( and their legal firm/XXXX XXXX ) that I REFUSED to sign a " CIT-Change in Terms '' I also did not attend this loan closing for the grant or reinstatement. Although I refused to comply with the " CIT-Change in Terms '' reinstatement requirements or accept the grant funds for the {$28000.00} in legal fees charged in connection with this reinstatement, Great Western Bank continues to hold me as the SOLE signer obligated to this mortgage and has filed collections against my credit which has negatively impacted my credit score and causing me irreparable financial damages.

My ex wife and myself have contacted Great Western Bank, ( XXXX XXXX ) and XXXX XXXX XXXX ; all parties involved in this transaction to no avail. Great Western Bank allowed this reinstatement without my signature or consent although it was demanded as a prerequisite for this mortgage reinstatement.

I am requesting a full investigation into this matter and the removal of this illegal charge against my credit report. I am in no way obligated to pay for this mortgage per my divorce decree which was given to Great Western Bank/XXXX XXXX XXXX and per my refusal to sign the " Change In Terms '' agreement as demanded in the attached letter from Great Western Bank/XXXX XXXX XXXX This company continues to harrass me and refuses to correct my credit immediately although they have clearly violated my consumer rights and protection under the CFPB policies.

Copies of the signed Change in Terms and reinstatement closing documents have been requested from all parties however Great Western Bank/XXXX XXXX XXXX and XXXX XXXX have refused to provide these documents. I also request the CFPB investigate all parties to this claim. Each has violated my rights and impacted my credit rating irreparably due to this negligence.

The dates are not exactly clear because we've had different responses from Great Western Bank. They've refused to work with us. They also sent us a letter saying to stop contact with them, and accused us of harassment. In mid XXXX of XXXX our bank account was levied for a unpaid credit card. I had deposited my check on a Friday and Monday morning my card was declined. The XXXX county sherrif department issued the XXXX. Great Western Bank honored the XXXX putting account at XXXX balance. Then they charged us {$90.00} for a XXXX fee causing account to go negative. There were bills pending prior to XXXX XXXX XXXX XXXX XXXX XXXX, causing account to go further in debt we were unable to do anything at that point. On XX/XX/XXXX the account was charged off, and by the end of XXXX was sent to collections. My wife 's grandmother had passed away in the beginning of XXXX. We believe there were possible funds that were to be deposited into that account. The manager of Great Western Bank in XXXX XXXX Iowa knows all of us personally. There is a great conflict of interest concerning this matter. My wife was a signer with her grandmother who also had a account at great Western Bank. They refuse to give us any information. The XXXX county sherrif deptmart XXXX was supposed to last 4 months. We had no chance of recovering the account, and the XXXX left us financially ruined. Also we found out there was a great Western bank account set up in XXXX with my wife and her mother in there maiden names. They both did not have there maiden name in XXXX. We inquired with the bank about this account and they told my wife she wasn't entitled to any information about the alledged account. My wife had that account since she XXXX years old her grandmother set it up for her. She later added me to account and the XXXX was my responsibility. There were pending child support payments as well.

On XX/XX/XXXX and XX/XX/XXXX, I had numerous unauthorized charges hit my Great Western Bank checking account from XXXX. I didn't see them until XX/XX/XXXX and at that point, my account was overdrawn by almost {$500.00}. I saw that on XX/XX/XXXX, the bank had already charged me a {$170.00} overdraft fee. I called XXXX and disputed the numerous charges and they agreed to refund all of them but stated it could take 3 to 5 days to complete the refunds.There were also several pending charges that they cancelled for me. I notified my bank of the situation and that the charges were being refunded. I asked at that time if they would be able to refund me the overdraft fee once the account was refunded. The teller I spoke to said that she would pass on the request to her branch manager. The next day, I checked my account. About half of the unauthorized charges had been refunded, but I saw there was a second overdraft fee in the amount of {$170.00} from my bank. I called them again and asked why they were continuing to charge my account. The branch manager said that due to the fact that the charges were not a bank error, they would not be refunding the overdraft fees. I explained to her the impact that the total of {$350.00} in fees was having on my account and tried to persuade her to reconsider. She adamantly refused, stating not only would she continue to charge the fees, but that she was obligated to. She began to argue the validity of my claim that the charges were not authorized. I have reviewed the answer Great Western Bank ( GWB ) claiming they did not have a record of the property address with it actually XXXX XXXX XXXX XXXX XXXX XXXX but the address on the Note is XXXX XXXX XXXX XXXX NE XXXX, which because this was a new subdivision right off XXXX XXXX it was listed wrong, however the legal description is XXXX XXXX, XXXX XXXX XXXX, a Subdivision as Surveyed, Platted and Recorded in XXXX County, Nebraska. The Deed of Trust can only be recorded by a party that has a financial interest in the loan which as GWB sold the loan to XXXX XXXX XXXX ( XXXX ) on XX/XX/XXXX, their financial interest ended that day. XXXX XXXX up and the documentation proves the facts. Nebraska Statute 76-238 instructs that the Deed not enforceable until it is delivered and recorded. GWB by law needed to have had the Deed of Trust delivered and record before XX/XX/XXXX, anything after that point GWB does not have the right to try and correct the error that was not caught until XX/XX/XXXX, when the loan was accepted into the XXXX XXXX XXXX XXXX. XXXX is not and never has been approved to do business in the State of NE. NE Statute 21-20,168 demands that Foreign corporation apply and receive a certificate of authority. XXXX used the position of mortgage servicer to have a " Forged '' title created, however, they were caught and confess that they were not the owner of the debt when I made the OCC obtain the Note from XXXX. Great Western Bank. On XX/XX/XXXX, I authorized a payment for the morning of XX/XX/XXXX for {$100.00} to be paid to my credit card from my checkings account. They posted the payment on XX/XX/XXXX. They never credited the amount to my credit card, but took the money out of my account, over drafted and charged me, and put the {$100.00} back in my account. If they had charged me on the authorized date, the payment wouldnt have been overdrafted. Secondly, my bank account is not allowed to go negative for any sort of payment. And then, on XX/XX/XXXX, somebody reauthorized that exact same payment. I did not authorize the payment a second time. They once again over drafted me and charged me for it and then returned the {$100.00} never at any point crediting it towards the account it was supposedly paying. In total, they charged my account at least {$150.00} in overdrafts and return fees for one payment that did not get posted on the Authorized date, and then got reauthorized by someone to overdraft and charge me more. They are literally robbing me and not only am I out the {$100.00} that I need to pay my credit card company, they affected my credit score significantly by delaying and not processing the transaction correctly and then recharging me unauthorized.

I have twice tried to make a change to one of my accounts with Great Western Bank. I need to change my money market account ending in XXXX to their " Basic Savings '' savings account. A couple of months ago I need a one-time transaction to pay my premium to a phone insurance company called XXXX XXXX XXXX.This is the only interaction I've ever had with this company as my phone insurance is deducted for my phone company and not the actual insurance company. I have a health savings card through my employer. I had ordered some vitamins online, two products, and have the receipts for {$4.00} each. Two issues that have not been reported correctly. Great Western Bank has reported late payments several years ago because multiple payments made at one time were credited to my account as one payment. XXXX Hospital XXXX has reported a collection account on a balance resulting from XXXX XXXX Co taking several months to pay entire bill. A collection referral is indicated but there was never any contact or collection activity pursued since the hospital was aware of the yearly deductible being met and the insurance company finalized the claim in three months.
