Gordon, Aylworth & Tami, P.C., on behalf of XXXX XXXX XXXX XXXX sent me a summons and complaint that they were suing me for {$590.00} for a XXXX XXXX account I had never opened nor authorized. I did not ever receive any communications from XXXX XXXX, XXXX XXXX, or Gordon, Aylworth & Tami, P.C., and had no knowledge regarding the fraudulent account, until I was handed the summons at my door on XX/XX/XXXX. I filed an appearance and an answer to the complaint, denying that the debt is mine and that I was a victim of identity theft. According to the papers sent by the attorney, there is a statement of charges totaling approximately {$220.00}, which were not made by me. I have not received any documentation with my signature either, showing that I opened or authorized the alleged account with XXXX XXXX. I was only sent generic copies of papers from XXXX XXXX and papers from various firms, including XXXX XXXX, with a data file account blacked out, but nothing that specifically states or validates that they purchased an alleged account with my name, or were authorized to collect on alleged account. ( which they would have been fraudulently collecting on, since I did not open or authorize any account under my name! ) The account, per the documents I was sent, was opened in XX/XX/XXXX, and was closed in XX/XX/XXXX. In XX/XX/XXXX I was contacted by USPS and also had contact with the IRS, regarding someone attempting to change my address to an address in XXXX. As I had not known about nor heard about this debt, which is not mine, until a little under a month ago, I feel my rights as a consumer have been blatantly violated, because I had not received any prior communication or notification regarding the fraudulent debt from XXXX XXXX, or XXXX XXXX, until I received the summons at my door, that I was being sued, on XX/XX/XXXX. So, from XX/XX/XXXX to XX/XX/XXXX, I had no knowledge of the account, nor communication from the aforementioned companies, that would have enabled me to properly dispute the account and charges in a timely manner. On XX/XX/2020, Sunday at XXXX an intimidating, XXXX man showed up at my door.He had no identification and was wearing plain clothes. He stated he was from XXXX XXXX. ( Not GAT ) I told him through the door to leave the mail in floor in front of my door. I have attached what he left on my door mat. Misrepresented Court Documentation Please note : The man left a loose packet of papers. There was no envelope.The paperwork says Summons. There is no summons number. There is no notice to appear report date, time, or location. The packet is missing a page ( s ) as noted by the remnants of a page ( s ) still being attached to the stapler on the left side of the paper. The document is in different fonts and sizes. Apparently, this case was filed on XX/XX/XXXX.The response ( see attached ) to my first letter states that I must respond before XX/XX/2020. How could this case be filed in court prior to the required response date? Also, it is XX/XX/2020. I have not received a response to my second certified correspondence ( sent in XXXX ) asking to resolve this amount for 15 % of the amount you are asking, due to me being non-renewed at my job. I also shared that the original debt bought by your client was due to Hurricane Harvey. My family and I had to relocate and I ended up filing for unemployment. The documentation that you previously provided does not justify the amount that you are stating that I owe. The amount that you are seeking is inflated considerably. I do not have the money you seek. I am asking that you cease communication with me or send official Court Correspondence. The packet you sent ( with pages missing ) did not provide me any documentation regarding the court report date or time to appear. It is missing a summons number, which will make it hard for the court to identify the case. If I fail to appear a warrant will be issued for my arrest.

On Saturday, XX/XX/XXXX, an intimidating man with large knuckles appeared at my home and I was hesitant to open the door but eventually did as he was walking to his car. He claimed to be a process server but did not provide me with any kind of identification or business card for me to verify this information. He handed me a packet which claimed to be an electronically filed court case from the " DISTRICT COURT OF THE STATE OF WASHINGTON FOR XXXX COUNTY XXXX DIVISION - XXXX COURTHOUSE '' .I did not sign to receive it. I called the phone number on the packet which lead me to Gordon, Alyworth, & Tami, P.C. Attorneys at Law where I spoke to a person named XXXX ( I may be mistaken, he only gave it once and it was very brief ). During the call I asked many questioned to clarify what this packet was about and what my options were. XXXX (? ) was very quick to give me the run around regarding options and at one point explicitly said " I did not tell you that option because I did not think you had any money '' which I took great offense to. Upon hearing that, I made sure to reiterate the things XXXX was telling me as well as ask if that were all the options for next steps possible. Initially XXXX only presented me with 2 options, but by the end of the 16 minute call, I had 3-4 options. Later on, I personally visited the county clerk website to see if such case existed and there was no such case against me. After consulting with an attorney I have also found that the packet that was delivered to me had no signature from the county clerk, no reference number, no court date, and no case number. Its contents were : the appearance of a summons, a copy of XXXX XXXX XXXX XXXX WA business license, and a " case information cover sheet '' allegedly from the XXXX county district court house

XX/XX/2020 To Whom It May Concern, I was never given notice before being garnished from my check by XXXX on behalf of Gordon, Aylworth, & Tami PC. for 10-11 % of my weekly net pay. ( Case ID : XXXX ) I am XXXX and this has caused a hardship for me. I can not pay my rent now. I was not notified about a judgement or given any opportunity to present my income and explain my hardship and show my bills. I need this to stop immediately. I need to know what the debt is and who it is from. If it is legitimate, I can only afford to pay {$5.00} per week at most. I need legal assistance. This is an unfair and predatory debt collection practice. It cant legal. Its definitely unethical. I can not believe that they are allowed to garnish my pay without explaining anything to me or giving me any prior notice. Please assist me with getting this resolved and legal and regulatory guidance. Update : Today, I just found out that it was from a XXXX XXXX. I haven't been able to review the account history to know if it was mine. I had a XXXX XXXX card in XXXX. I'm told that I was sued by XXXX XXXX and I live in XXXX now. I really didn't know anything about the situation that was happening to my friend. I guess this was an old credit card debt from years ago. First I heard of this situation was this last XXXX XXXX. She told me that this lawyer/ collection office ( XXXX XXXX XXXX XXXX XXXX has sued her and is garnishing her account. Which she is on SSD support to help her survive. She is paranoid XXXX. They already have a judgement she said on her account and started taking money out. This is when I heard of what is happening. She asked if I could use one of my credit cards to pay them off so I have money for my needs from my XXXX. I said finally ok. I had her call to pay the full amount. She asked them for some kind of discount it's paid today in full. They said no. Oh, I don't know anything about the above situation but something just doesn't sound right I told her. This is where my complaint originated. I received my XXXX XXXX bill and this company processed the payment as a wire transfer. I looked up their payment process and it states on checks/ debit card they might do a wire transfer. So, I tried to help a friend and pay her bill and get charged a wire transfer fee of {$81.00} and interest of {$8.00}. Total of {$90.00}.

It appears that one collection agency is attempting to collect for another collection agency, XXXX XXXX XXXX XXXX XXXX I have never personally borrowed from or have owed money to XXXX XXXX, only to credit cards which are not being named in the suit. I do n't even recognize the name XXXX XXXX. It has been over 15 years since the last time I made a payment to the true creditors in question, yet the attorneys and collectors of Gordon , Aylworth & Tami , P.C . continue to serve me with writs of garnishment, even though the Statute of Limitations has long since passed. As I and my family are living below the poverty level as it is, it would be impossible for me to repay this debt they ask for anyway. Knowing that the Statute of Limitations has long passed, I consider myself to be naturally bankrupt, as I can not afford to pay for the services of actually filing. They say I owe {$15000.00}, though they never mention the name ( s ) of the original creditor ( s ), nor acknowledge that they have been hounding me for over 15 years. Please advise me and help me in any way you can to maintain my rights under the State of Oregon 's Statute of Limitations laws.

I have been accused of oweing a debt that is not owed. The debt is also outside of statute of limitations for collection.The creditor is XXXX XXXX. XXXX XXXX has numerous other law firms attempting to collect the same debt for them. All of the law firms are hired and maintained by XXXX XXXX. The first company to contact me was XXXX XXXX XXXX XXXX . I recieved a letter from them attempting to collect a debt. I sent XXXX XXXX XXXX XXXX a certified letter return reciept. The letter was an order to cease and desist dated XX/XX/XXXX. XXXX XXXX which is a member of XXXX XXXX signed for and recieved the certified letter on XX/XX/XXXX. XXXX XXXX has now been notified twice to cease and desist and they have ignored all attempts to get them to stop. They keep assigning the account to another law firm who is a member of their colleciton agency. All of the attempts are from members of XXXX XXXX. In the last two months I have recieved calls from an attorney 's office called Gordon, Aylworth + Tami P.C. They call but do not leave any messages. The latest call came from number XXXX on XX/XX/XXXX at XXXX. The call before that came in XX/XX/XXXX from the same number.

On XX/XX/2019, I returned by mail with receipt the written interrogatories that the company sent me. Included in that was my sworn statement that I was NOT employed and that I was receiving Social Security XXXX On XX/XX/2019, I received a notice of garnishment from the attorney that is the subject of this dispute. I called and talked to XXXX and then to XXXX, explaining that I had not worked for the company listed for almost a decade and that the ownership had changed. XXXX told me that he had information that I was currently employed by the company. I said I would like a copy of that information as I had just made a sworn statement that I was not employed. I asked if they intended to take me to court for perjury since they claimed to have proof that I was employed and XXXX said No. I live in a small town and I don't think that this debt collector should be able to contact people that I previously worked for and issue garnishments for wages, which is informing people, that are NOT my employer, that I owe a debt.

On XX/XX/XXXX I made the decision to file Chapter XXXX bankruptcy. On XX/XX/XXXX, I retained the law offices of XXXX as my bankruptcy attorney. On XX/XX/XXXX, I called Gordon, Aylworth and Tamis office at XXXX PST and spoke with XXXX . I informed her that I was filing bankruptcy and had retained XXXX and that any further communications with me would need to go through my attorney. Today, XX/XX/XXXX I came home from being out to find that the XXXX County Sheriffs department had left a card on my door advising they are attempting to serve me for the above civil case. This is a blantant disregard of my rights under the FDCPA as once they were notified I have an attorney, all communications should be through my attorney.

XXXX XXXX XXXX, attorney for XXXX XXXX XXXX, applied a line item to my already discharged bankruptcy for {$14000.00} in fees for himself. The bankruptcy was discharged in XXXX, XXXX. XXXX XXXX XXXX did n't even acquire the mortgage previously held by XXXX until XX/XX/XXXX. The amount for attorney fees was applied in XXXX or later. There is no date on the entry. On the bankruptcy documents, the attorney 's name is spelled wrong, as XXXX, but the word County is also spelled wrong. The address in XXXX, OR is where XXXX XXXX practices. I only discovered this addition to the bankruptcy records after a short sale failed in XX/XX/XXXX. This house was supposed to be foreclosed on in XX/XX/XXXX. I do n't know what the attorney fees are for, only that he was working for XXXX XXXX XXXX. XX/XX/2020 I received a letter, from Gordon Aylworth & Tami P.C saying I owed XXXX XXXX XXXX. I calleXXXX XXXX XXXX to verify any accounts with them because I have not worked with XXXX XXXX for any accts, loans, cards etc whatsoever. The letter wasn't certified so it was a red flag. I called XXXX XXXX customer care line and they transferred me to the fraud department, there was no accts, listed so he transferred me to the collections department to see if there was any collection accounts in my name. Nothing came up. He then asked me who was the collection agency that sent the letter, I told him and the XXXX XXXX personnel said that Gordon, Aylworth and Tami PC are not even an agency they work with to collect debt. I was garnished by a collection agency that I did n't even have a chance to answer their claim against me. I received notice from my employer just before the XXXX garnishment on my paycheck when I checked on the debt, it 's with XXXX companies I did n't have an account with. I received first communication from Gordon, Alyworth & Tami, P.C. via process server with a summons and complaint on XX/XX/2023. I responded to the complaint on XX/XX/2023 along with a request for debt validation via certified mail and I filed my answer to complaint with the XXXX XXXX District court on the same day. It has been 2 months and and I never received a response to my validation request. It is now XX/XX/XXXX and I received 2 documents in the mail, Plaintiff 's request for admission and Request for production of documents. So basically, they sent my information to third parties who were never authorized or allowed to have my financial information, and I had never worked for. I do owe the debt, but the contesting means is due to how they went about business, as well as the fact they went to a court without any notification at all and just showed up with a garnishment. And now their lawfirm XXXX XXXX, and XXXX XXXX. has the case, for which they deliberately refused to accept payment over the phone even when I had the entire balance in whole at the time. The caller violated FCC regulations by " installing '' a voice mail when I have a unknown number human test in place to preventing access to voice mails without announcing their name to a machine. This process will show a missed number so XXXX can block the unknown number. Unfortunately, they used an illegal tactic to bypass calling and leave a voice mail directly. Debt in the amount of approximately {$3400.00} was owed to a law firm called Gordon, Aylworth & Tami ( XXXX, Oregon ). This was for consumer debt. I called and negotiated a settlement of {$3100.00}. I paid the law firm {$3100.00}. I received a letter saying the debt was paid in full. Six months later, they are trying to file a Writ of Garnishment for the debt. They went to court and obtained a judgment against me, did not properly serve me and are now trying to take my wages.
