For the purpose of this complaint : The Lender is XXXX XXXX XXXX, and the Real Estate Company is XXXX XXXX Owned by Council Member XXXX XXXX of XXXX XXXX. It is my belief that XXXX XXXX XXXX, and XXXX XXXX acted in concert to defraud me. XXXX XXXX XXXX and XXXX XXXX are friends according to XXXX XXXX. On XX/XX/XXXX XXXX XXXX XXXX of XXXX XXXX became my real estate agent. It was communicated to XXXX XXXX that we did not have any monies to do major repairs and we did not want a home that exceeded {$370000.00} price point. XXXX stated on numerous occasions that repairs would be minimal because it was an FHA loan. On XX/XX/XXXX XXXX XXXX XXXX. sent a Public Notary so that my husband and I could sign some escrow papers. However, that notary lady did not bring final documentation to my home it was given to XXXX XXXX XXXX of XXXX XXXX who then acted as a notary and had us signed the document at the late hours of the night on XX/XX/XXXX. I was given the keys to what is my home, and escrow had finally closed, but that happiness was short lived. On XX/XX/XXXX around XXXX my husband and I were given a yellow paper by my selling agent that read " Pre-sale Inspection & Correction List '' I asked my Agent XXXX XXXX what is this? He replied oh nothing just minor repairs but nothing to be alarmed about. On XX/XX/XXXX my husband called my brother who suggested that we go to the City of XXXX Building and Safety and speak to the inspector and find out what this all meant. The inspector that was assigned to my home was not in the office. I then asked the inspector at the counter questions regarding purchases of home. I then told the inspector at the help desk that I had just purchased a home in XXXX on XXXX XXXX XXXX. and we were given that yellow paper that same day that escrow closed. The Inspector stated, not according to my records no agent has been here to request a release from the City of XXXX and that yellow correction paper should had been given to you prior to closing escrow so that repairs could have been made then the inspector goes back and inspect your home to make sure repairs are completed and sign off on them. Then we showed him the Pre-Inspections Correction list that was issued by Inspector XXXX and he said we should just wait and that XXXX XXXX should be in shortly. Inspector XXXX walks in we show him Pre-Inspection & Correction List paper and the City inspector stated, the home needs a new roof because the roof is beat up and the roof has more than 2-layers, bathroom sink needed to be moved ( demolish, move pipes, new sink ) as to not obstruct entry to bathroom, the kitchen and bathroom all needed GFCIs. Inspector XXXX, also stated that my selling agent XXXX XXXX should have been there inquiring about permits and corrections prior to having closed escrow. Inspector XXXX, also stated that, previous owners updated windows and they did meet code or standards and that no one took out permits for cabinets either. XXXX XXXX also said that, I needed to hire a contractor ASAP and begin working on repairs or the City of XXXX would put a " lien on my property. I called my agent and he said that he would call seller and ask for help for roof and that he did not know anything about roof, windows, or sink needing to be moved. I called my agent XXXX XXXX at XXXX XXXX XXXX, in XXXX XXXX and told him I could n't afford the repairs he said he contact seller. I then spoke to my lender at Golden Empire XXXX XXXX and he stated " we 're going to help. I also asked if it was customary for FHA to approve loans with so many repairs and that I felt we were defrauded. On XX/XX/XXXX I XXXX XXXX called XXXX XXXX XXXX of XXXX XXXX XXXX XXXX and asked him, how is it possible that a home with so many needed repairs could have been approved by FHA.I also found some irregularities such as underwriting, loan origination , county reserve taxes ( does that mean I do n't pay taxes? ) and document prep fees in his invoicing and his response was that they used the paper in XXXX office. I then told him that I would be filing a complaint with the CFPB, CALBRE, BBB, Attorney General Office, and NAR. I XXXX XXXX also contacted XXXX XXXX ( Manager ) Via Phone on XX/XX/XXXX with XXXX XXXX XXXX about some irregularities on the billing and that I needed some answers as to how and why this loan was approved through FHA with repairs exceeding {$15000.00}. She stated that in her system the home Listing did not show any needed repairs and that she XXXX XXXX, was forwarding the information to her attorney. Today XX/XX/XXXXI received a called from XXXX XXXX, Chief Executive Compliance officer of XXXX XXXX XXXX and he stated the he wanted copies of all documentation. I have been in contact with XXXX XXXXXXXX at XXXX XXXX XXXX, and have notified him that FHA has put a warning in their system with regards to this loan. XXXX XXXX XXXX at XXXX XXXX XXXX, should have pulled the loan on XX/XX/XXXX due to the fact that his clients were defrauded by his friend at XXXX XXXX and he was made aware.

Hello, I am the owner of single family residence XXXX XXXX XXXX, XXXX XXXX, CA XXXX recently purchased on XX/XX/XXXX loan number with GEM is : XXXX While in the process of purchasing the property GEM Provided an internal appraisal which appraised at asking price which seemed peculiar because I thought you needed to have a third party to do an appraisal -- I did not put down the full 20 % down. PMI was added to the mortgage payment at a cost of around {$200.00} per month. Since purchasing the property I have remodeled and upgraded the inside of the entire house, adding safety, efficiency, modernization and green improvements that make it more valuable than when I bought it. I have been in contact with GEM Mortgage ( GEM ) because, given the increased values with comparable sales owning the property for more than a year with no derogatory marks on my account -- I pay the mortgage on time with automatic payment. I bought a XXXX from an outside source with a report that the value is worth {$720000.00} last year. The property now qualifies to have the PMI removed since the value of the house and those around me have gone up in value and now equity exceeds threshold for requiring PMI. In XX/XX/XXXX I asked GEM to remove the PMI and they said I need to obtain a Broker Price Opinion ( XXXX ). GEM through email said they will have XXXX XXXX at XXXX XXXX XXXX XXXX XXXX XXXX to conduct the XXXX. I was contacted by XXXX to schedule a viewing of the property and send her a list of the XXXX done to the property. I sent the XXXX spreadsheet I made to her multiple times to her email ( XXXX ), because she said she did not receive it. I also had a colleague send the spreadsheet to her and I also sent the same spreadsheet to GEM as well. Upon arrival for the in person BPO with my colleague XXXX had no XXXX spreadsheet stating she did not receive the expense sheet and she will do a quick walkthrough. I requested from GEM a detailed explanation from XXXX. In the report she did not consider all the work that has been done to the property. I did a complete remodel of the entire house including both bathrooms which she did not mention. XXXX I got a letter stating that GEM concluded that based off the XXXX that the valve of the house did not qualify removal of PMI. I requested that I get a detailed explanation of their valuation since it came in so low. On famous websites like XXXX, XXXX the average value of the home comes in at {$770000.00}. I also recently applied for a HELOC for the property and I have a quote done with a BPO with a value of my home at {$780000.00} -- which I have. I have my credit card statement reports and receipts for all the materials I have bought, a summary of all the labor I have done and supplied both XXXX and GEM with details of the remodeled house between XX/XX/XXXX through XXXX XXXX. With the value of the house and the improvements I have made I qualify to have the PMI removed. If GEM would like another XXXX issued I would like it to be an outside 3rd party to do the XXXX and move the process along to get removal of the PMI I HAVE MORE PHOTOS OF THE PROPERTY IF YOU NEED MORE PLEASE CONTACT ME Thank you, XXXX

Hello, I am the owner of single family residence recently purchased on XX/XX/2022. I did not put down the full 20 % down. PMI was added to the mortgage payment at a cost of {$1000.00} per month. I have been in contact with GEM Mortgage ( GEM ) because, given the increased values with comparable sales, the property now qualifies to have the PMI removed since the value of the house and those around me have gone up in value and now equity exceeds threshold for requiring PMI. On XX/XX/2022 GEM asked me to obtain a Broker Price Opinion ( BPO ). I contacted a local third party Broker and after I received document, provided the BPO to GEM on XX/XX/2022. On XX/XX/2022 I called and emailed GEM to confirm they received the BPO document. Their representative now said I need to have one of the GEM representatives prepare a BPO at a cost of {$150.00} that I submitted on XX/XX/2022. The intention, as told by GEM is the process for going through with the cancellation of the PMI. I was told the BPO should take a couple of days. Today on XX/XX/2022 GEM is estimating it could take 3-4 weeks to eliminate PMI. This seems like lengthy amount of time to eliminate an expensive requirement and I would like to understand why, in the age of computers, and proof in hand, PMI would be so complex to remove from a mortgage. I have given GEM my credit card statement reports and receipts for all the materials I have bought, a summary of all the labor I have done and supplied them with photos of the remodeled house between XX/XX/2022 and XXXX XXXX. It is my perception that GEM is intentionally lengthening the process to get more of the PMI money as possible. I have all the email responses from GEM Mortgage. I am asking for investigation into the delay to remove PMI from my loan, and to confirm that it will be removed at the earliest possible time. Thank you, XXXX

I have a buyer that upon looking for homes with his realtor he came across a property he liked and was ready to submit an offer for. Upon the realtor contacting the listing agent she was informed that in order for her clients offer to be presented to the seller " they must cross-qualify with agents lender ''. Please see below of a snippet of the XXXX listing Private Remarks : PRIVATE REMARKS : Submit all offers to : XXXX with copy of DU Approval including FICOS, Proof of Funds and copy of prequalification letter. Please call agent before submitting the offer. Buyers to get cross qualified with sellers lender : XXXX XXXX @ XXXX XXXX. Contact number is XXXX XXXX or email XXXX XXXX Buyers/Buyers agent to do their due diligence and investigations regarding property. Upon reviewing this my buyers agent called me to request a cross qualification with the other lender instructed on the XXXX private remarks. I advised it is illegal and a violation to share private financial information of the borrower 's to 3rd parties. Requiring buyers to submit a DU Approval, copy of credit report and proof of funds is a definite violation of consumer finance laws. I contacted the lender immediately and explained the type of loan program my borrowers were obtaining from my financial institution. ( generic information such as product description, LTV requirements, etc ) No private information of the borrower was shared. However mortgage officer, XXXX XXXX, from XXXX XXXX, still requested I send her copy of paystubs, copy of credit report and proof of funds ... " so she can do her due diligence '' To finish it off she requested all this information to be sent to her personal email address : XXXX not even a company email was used.

XX/XX/XXXX : I contacted XXXX XXXX regarding a refinance, I was upfront about previous late payments. XXXX told me to make all payments on time for 1 year then apply. XX/XX/XXXX I made ALL payments on time for 1 year, contacted XXXX XXXX, started the process for a refinance and filled out all paperwork, including credit application. XXXX ran my credit and I sent XXXX my bank statements. XX/XX/XXXX XXXX sent me an email asking if I have any reserves besides my current money in the bank. I responded clearly no and asked clearly if that was a problem. XXXX clearly responded in writing " No, you're good! '' XX/XX/XXXX XXXX stated the time to close would be 2-3 weeks. XX/XX/XXXX XXXX sent me an email telling me I do not qualify for the loan because I do not have more cash reserves despite clearly telling telling me it is not an issue on XX/XX/XXXX. She offers to try to do a FHA loan ( which she gets to take fees ) and then in 6 months switch again to a no FHA loan ( which she would get fees again ). XX/XX/XXXX I told her I feel this is bait and switch, she knew my payment history, and had all of my financial information now she is offering to process 2 loans in 6 months. I felt it was unethical of her. She clearly told me that reserves were not and issue. XXXX responds telling me it was my payment history that is making that requirement. XX/XX/XXXX I responded to her telling her she was aware of my payment history and my reserves more than 30 days ago and there was no issue, to then bring it up as an issue and offer me to pay TWICE because she was not honest and up front I felt is unethical. XX/XX/XXXX I made a complaint with the BBB and wrote company executives for Golden Empire Mortgage. No response.

I wanted to refinance my home mortgage and after some shopping around I decided to apply with XXXX XXXX at XXXX XXXX XXXX XXXX XXXX XXXX XXXX. He started the process and I provided him with all financial documents he asked for. He quoted me 30 years fixed at 2.50 % with XXXX cost to the borrower. I asked him to lock the rate for me, but he told me not to worry and that he'll guarantee the rate. I told him every time I refinanced they lock the rate for me, he again said not to worry. I do have email communication from him and below are what he told me in the email : " Regarding the lock, we wait until the underwriters have verified your information before locking technically. However, I stick to my quotes and will honor the rate I gave you initially. '' Here is another email he sent me telling me why they don't lock the rate and telling me at the end I will get the 2.50 % rate : " The reason is that because we lock for a shorter period of time, we are able to give lower rates to our borrowers. It is part of why we have some of the lowest rates in the state. On top of that, because of COVID, the notaries are charging more and giving us less time to schedule so we have to wait until everything is ready before we schedule with them and all has to be done within 21 days of locking. So there are many reasons, but in the end it benefits you the most. You still get your 2.5 % either way, it is just a matter of waiting until the right time. Let me know if you have any more questions. Thanks. '' After all that the rates did go up and he wasn't able to keep his promise and I had to cancel my mortgage refinance application. This is very unfair and I think they should be penalized for what they did.

On XX/XX/XXXX I was pre-approved for a mortgage loan with the company name Signature Home Lending. They let me know by phone the loan amount of {$330000.00} and interest rate of 3.5 % because of excellent credit score. I never received the Loan Estimate, but I trusted them to keep their promise. Later on, I changed my mind, and instead of buying a primary house I wanted to buy a house for investment. My agent called the lender to let them know the changes, and also to let them know I would need a lower amount ( {$130000.00} ). On XX/XX/XXXX I received by email the confirmation of the new pre-approval for the {$130000.00} with neither interest rate nor Loan Estimate. When I finally found the right house and my offer was accepted, I contacted the senior lender XXXX XXXX XXXX on XX/XX/XXXX to ask if the interest rate would be the same since she never called me to let me know otherwise. Her answer was that ofcourse the interest was going to be higher. I asked her how much higher. The next day we got in contact again, and she told me the interest would be 4.25 %, but when she finally showed me the Loan Estimate I could notice she was changing for points to lower the interest that she never mentioned, and I never agreed to pay. Now what I thought it was a good deal is became a 4.625 % interest loan. I tried to get a lower interest by changing from 30 years loan to a 15 years loan, but she gave me the same 4.625 %. My complaints are she never told me she was selling me points intead of negotiating the interest, she gave me the Loan Estimate until almost closing which is against the law. Not to mention the HIGHER interest.

During the mortgage loan application for my house ( first time buying a home ), the Loan Officer at Golden Empire Mortgage, XXXX XXXX, promised me to exclude the loan origination fee in the amount of {$2400.00}. I was rushed to sign all the loan documents by the notary, and was told that XXXX was going to go over all the details with me later the same day. Nobody disclosed to me that I would have 3 days to go over all the details, and that I had the right to cancel the loan if there was anything wrong with it. When I realized that the fee of {$2400.00} was not removed, and I asked XXXX XXXX about it, this was her response : " Oh shoot, I forgot.. do you want me to redo the whole loan, which will take another 30 days or so? ". Again at any moment she told me that I had 3 days from the day I signed the loan papers to either cancel or adjust any discrepancy. I was really disappointed with the dishonesty and the lack of respect to me as a consumer/client. If I knew I had 3 days to go over the details of the loan and fix any errors or discrepancy in any money amount, I would have totally argue/fight to have that amount adjusted/removed from the loan. I thought that once the papers were signed that was it I could not go back or fix anything. I could not redo the whole loan, as she suggested and wait another 30 days because I had already given the 30 days notice to my previous landlord, so I had to move into the new home within the next couple of weeks. I will never ever recommend GEM mortgage to anyone, especially this particular loan officer.

We are the seller. Purchasing agreement was signed by the buyer on XXXX. XXXX XXXX ( XXXX, NMLS License # CA-CA-DOC XXXX ) with the GEM mortgage ( XXXX, NMLS ID # XXXX ) started working on this loan on XXXX. As of today on XXXX, the FHA loan is still not approved. The lender was still working on the verification of employment ( VOE ) on XXXX. No timely communications from XXXX to seller 's realtor and broker even till this date ( XXXX ). Compliance officer XXXX with the GEM mortgage was contacted on XXXX regarding my concern that XXXX was not processing the loan properly. I spoke to XXXX on XXXX regarding this subject matter. Received an update today XXXX but I disagree with the finding that XXXX said that he did communicate with seller 's realtor. The issue is not about communicating or not. The issue is that there was insufficient and untimeliness in updating the status of the loan. To blame the 108-day escrow non-closure on COVID-19, FHA loan processing time, seller 's realtor 's personal issues, buyer 's issues, ... etc does not satisfy any reasonable buyer/seller 's expectation of a " normal '' real estate transaction.

I received a statement from " XXXX '' who bought the loan from " XXXX '', The company who originated the loan, stating that we had a shortage in our impound account in the amount of {$820.00}, and that the amount originally figured was incorrect and that our mortgage payments would now increase an additional {$100.00} a month to correct this mistake. I was very clear to the XXXX loan representative to insure that the impound account also included the " XXXX XXXX '' taxes and she assured me it was included. Well, it was n't as now we not only have to pay the shortage amount, but also have a higher monthly payment now. We 're both XXXX on a fixed income and when calling XXXX XXXX from XXXX, he wanted to pass the blame to escrow and the title company. XXXX originated the loan and are licensed to insure that the loan amount included all the required taxes and they failed to do this.

I applied for a mortgage with two different lenders. I decided to go forward with the one who I felt was more ethical, honest and giving me the better deal. The first guy got upset ( he actually told me that it 's upsetting, because they did a lot of work, but even after he initially quoted me an insulting interest rate, I still gave him a chance ). At any rate, I felt like he was not being upfront & honest, so I cancelled the deal with him. I had, however, already paid for my appraisal ( I actually paid {$500.00}, but the cost of the appraisal was only {$450.00} ). I formally requested my appraisal in XML, which I had to threaten him with with filing a complaint with the CFPB & only then did he finally send it, but he has refused to send an appraisal transfer letter an XXXX Compliance Certificate and the XXXX Cert. It looks like classic slow-play from a scorned lender.

I first started working with him back in XXXX because he said that my husband and I would qualify for the XXXX program. This was a complete lie. XXXX knew that I was working with other lenders, so he sold us on the product that we never qualified for. He waited a week before we were going to close on the house to tell us that we did not qualify, and that we had to come in the double the amount at closing and go with a product at a higher interest rate. This is a bait and switch. Not only is this unethical it is illegal under the Unfair or Deceptive Act and Practices. XXXX XXXX also tried to have us lie on the loan documents for the XXXX program. After he realized that my husband and I made too much money her called me and told to send him additional names because my household size needed to be bigger.Another issue I had with XXXX was in regards to the appraisal

Completed a mortgage refi with current lender. After closing lender called asking for updated loss payee 1 additional day due to loss payee effective date was 1 day after closing. Lender did not contact insurance agent. Agent was called and updated requested. Lender force placed coverage for 1 day at {$5.00} and did not issue credit. the insurance was always in effect with no claims or losses and error was lenders. Lender has now modified payment to recover coverage. Insurance has been in pace for 10 years with the same coverage. Double coverage is abuse of the consumer and basic common sense would dictate that obtaining coverage for a lender error to cover nothing is predatory. I insist the {$5.00} be credited and adjustments made

my loan processor sent me a letter saying they did not pay supplemental tax bill from my escrow account. That I now need to pay the property taxes plus interest and penalties. I was not watching for property taxes because I had done an escrow account and taxes were to be paid from that account by my loan servicer I believe what happened is when I purchased the home the original property tax bills were paid by my loan servicer. But in California another bill is sent because of the increase in assessment amount based on the purchase price of the home. I refinanced about 6 months after closing. My servicer some how missed the supplemental bill and is now wanting me to cover the taxes and late charges.

I refinanced with XXXX and their parent company Golden Empire Mortgage. It was made clear to me there would be no points. Later, they added thousands of dollars in points buried in the documentation.They did n't contact me by letter, email or phone. I 'm not a professional so it slipped past me especially since I was told there would be no points. The added fees were hard for someone like me to spot or even look for as a result. I consider this bad business practice and a dishonest way to handle the process. I would like they way it was handled investigated.
