Here is a description of the issue I am having with Launch Servicing ( LS ), starting from the beginning when I attended XXXX XXXXXXXX XXXX XXXX XXXX and first signed my Income Share Agreement ( ISA ). To summarize the issue, LS has been in violation of my XXXX contract for refusal to accept a school-related deferment, XXXX has since sent my loan to a debt collection agency while LS is still requesting payments, and I want my loan to be removed from debt collection and returned to its proper state of deferment. My course at XXXX began in XXXX of XXXX and I signed an XXXX, the terms of which stated that I would be able to defer payment if I was in an institute of higher learning at least half-time, if I was unemployed and looking for work, or if I was making less than $ XXXX a year at my job. My course at XXXX was over in XXXX of XXXX, and my XXXX agreement would go into effect 3 months later. Although my issue today is with LS, my first issue began with XXXX when they failed to offer the career assistance and guidance that was promised to me at the beginning of the program. All the members of my course had an issue with our assigned Career Counselor who would, for example, fall asleep during our meetings, and eventually he left XXXX and was replaced by someone else. I was never contacted by anyone at XXXX after he left and found out about the new career counselor from my classmates. They claimed to be able to match people with jobs through their corporate partnerships upon completion of the program and I found this to be factually untrue. It is because of this failure on their part that I decided to go back to college in the first place. In the spring of XXXX I was contacted by the loan servicing company XXXX to begin payments or deferments. I first submitted a deferment on the basis of being unemployed and looking for work by sending information about jobs I had applied for. That summer, I enrolled in the XXXX XXXX of XXXX XXXX ( XXXX ) full-time, and that is when I first began submitting school-based deferments to Vemo every 3 months by sending them pictures of my registration information. This went on until the summer of XXXX when I was informed via email that Launch Servicing would be taking over my XXXX from XXXX. I first contacted LS in XXXX of XXXX asking them how to submit a school-based deferment. They responded by saying I couldnt do that, so I went to look at my contract and verify that this was an explicitly stated valid form of deferment, which it is. The most relevant sections of the contract would be the one titled Deferment and Default which says, " Your account will be placed in a deferment if, after you leave the program, ( i ) you have enrolled at least half-time in higher education or training [ ... ] '' and Section 7 part c - Deferment Period Criteria which says, " At least half-time enrollment ( as defined by your institution ) in Higher Education or Training and making satisfactory academic or training progress in the program ''. LS would not allow me to communicate via email and has forced me to send all communication through their online portal. When I quoted the Deferment section of my contract, at first I thought they were finally understanding so I sent them the same type of school document I had been sending to XXXX, but they said that because I am not enrolled in a XXXX XXXX school that it doesnt count. I am wondering if they are getting that from a different section of my contract which stated that payments wouldnt begin until 3 months after I was no longer enrolled at XXXX, because that is very clearly not what the section on Deferment says. I was quite frustrated with these responses so in XXXX of XXXX I decided to call them hoping that would help clarify the issue, but when I asked about school-based deferments the woman on the phone said they dont do that, even when I told her it was in direct violation of my contract which she also said she did not have access to. After this call I first contacted your organization to determine what I would have to do to file a complaint and I have been gathering the appropriate information since then. I emailed LS again asking them to send me a copy of my contract, and instead they sent a copy of my Final Disclosure which was a different document entirely. This is what the Final Disclosure says about school deferments, which is much more vague than the contract, When you return to school or when your monthly earned income is less than {$3300.00} ( equivalent to $ XXXX ), your account will be placed in a deferment status, and you will not make payments for every month your income is below this threshold. It took them weeks to send me the signed copy of my contract. I once again pointed out the relevant sections and they are still sticking to their false claim that I have to be enrolled in a XXXX XXXX XXXX. On XX/XX/XXXX of XXXX I received a letter from XXXX XXXX XXXX XXXX XXXX saying that XXXX had sent my loan to them. I wasnt terribly surprised by this as XXXX had been requesting payments for months while refusing to apply my deferment. What I am surprised by is that XXXX has continued to request payments to my online account after the debt collection letter was sent. My online account is still open as of today, XX/XX/XXXX, and the last request for payment was XX/XX/XXXX. Their last response to me through the portal was XX/XX/XXXX which is also after the day the debt collection letter was sent, so they have been in communication with me via email and their online portal without telling me this debt was in default. I suppose they are now expecting me to pay it twice. Because of this I also likely will have to file a separate complaint against XXXX for attempting to collect a debt while also requesting regular payments on it from a loan servicer. To be clear, I qualify for deferment both because I am in school and because I have a job where I make less than $ XXXX but I am not submitting documentation of that mainly because this company is in clear violation of my contract and has refused to cooperate with me, so I refuse to cooperate with them as long as that continues. Additionally I would like to note that until I got my job in XXXX of XXXX, my only available method of deferment would have been school-related as I was not applying to jobs frequently enough to use that method either. That is my main concern as to the effect this contract violation could have on others in similar situations to my own. Included in this complaint are my original XXXX contract with XXXX, my Final Disclosure with XXXX, the school-related document I sent LS, the letter from XXXX Associates XXXX XXXX e-statement from LS dated XX/XX/XXXX, and all my communications with LS via email and their online account portal from XXXX to XXXX of XXXX. Finally, I just want to express the emotional toll this has taken on me in the last few months. I didnt even have time to submit this complaint until now because I was working and taking my final exams. This fall I have been dealing with my own health issues and family health issues on top of it all. I am currently in battle with another loan company which I will be filing a separate complaint against for similarly illegal activities. My credit score is down over XXXX points because of both of these companies. All I want is for this to be over, for my loan to return back to its school-related deferment status, so I can go back to focusing on school and work, and for Launch Servicing to be held accountable for their actions so no one else ever has to deal with this again.

Launch Servicing LLC is attempting to collect money from me on an illegal contract, a financial product called an Income Share Agreement ( ISA or ISAs ). I entered into this contract on XX/XX/2020, but have since discovered that my ISA is considered void and unenforceable under Indiana state law ( and most state laws ). I have been advised to file this complaint due to the fact that " servicing void and unenforceable ISAs is an unfair, deceptive, and abusive act or practice, '' and that " servicing void and unenforceable ISAs violates state consumer protection and student loan servicing laws. '' I am also filing complaints against XXXX XXXX and XXXX XXXX, the other two parties involved who devised and issued these ISAs. These ISAs are in violation of several state and federal laws, and as such, are void and unenforceable under Indiana law where XXXX XXXX is headquartered. Specifically, Indiana Code 24-4.5-3-502 requires lenders to obtain proper licensure and Indiana Code 24-4.5-5-202 states that a contract or obligation that violates this chapter is void and unenforceable. Neither XXXX XXXX nor XXXX XXXX had lending licenses while they were issuing these private education loans. As such, I am requesting that a formal investigation be opened into XXXX XXXX and Launch Servicing LLCs operations in the state of Indiana, and that all affected students be released from these unenforceable and fraudulent private student loans. Id also like to note that while XXXX XXXX is referenced in this request, they no longer appear to be in business, presumably due to lawsuits brought against them for furbishing ISAs. The material facts are as follows : XXXX XXXX is a covered person under XXXX2 U.S.C. 5481 and the ISAs they employed are considered private education loans under 12 C.F.R. 1026.46 ( b ) ( 5 ). The ISAs they devised and distributed with XXXX XXXX did not include the required disclosures outlined in 12 C.F.R. 1026.46 ( b ) ( 5 ), and also included an illegal prepayment penalty in violation of 15 U.S.C. 1650 ( e ). XXXX XXXX misrepresented the nature of these ISAs in their marketing and business practices, and was not a properly licensed lender when the loan contract was signed, violating XXXXC 24-4.5-3-502 and several provisions under IC 24-2.5-10-1 ( a ). Furthermore, they did not secure a self-certification form as required by 12 C.F.R 1026.48 ( e ) and provided a private education loan that did not conform to federal consumer financial laws. I was a student of XXXX XXXX in XXXX and would never have signed up in the first place had I known the extent to which they intentionally skirted consumer protection and usury laws. I was misled by their representations that the ISA was not a student loan and would not affect my credit. The contract for this loan states in bold print that, THIS IS NOT A LOAN OR CREDIT and THIS INCOME SHARE AGREEMENT IS NOT A LOAN OR CREDIT. THIS AGREEMENT IS NOT AN ASSIGNMENT OF WAGES. The agreement and marketing materials stated that there was a {$100.00} commitment fee, with {$0.00} tuition and a repayment of 13 % of my income for 48 months. However, the ISA included a funded amount equal to the tuition, with a prepayment penalty equal to what the contract calls a payment cap. Despite the contract stating that it was not a loan or credit product, my credit report shows an account from Launch Servicing LLC categorized as either student loan or education loan depending on the agency. This is a violation of 12 U.S.C. 5481, 12 U.S.C. 5536, and 15 U.S.C. 1650 ( e ), which renders the contract void and unenforceable under Indiana law, specifically IC 24-4.5-5-202. Launch Servicing does appear to have the proper lending licensure in Indiana, but is still in violation of IC 24-2.5-10-1 ( a ) and IC 24-4.5-5-202 ( 2 ) for servicing void and unenforceable ISAs, and creating the deceptive impression that a debt is owed. Several courts have already endorsed the position that servicing loans that are void or unenforceable under state law is an unfair and abusive act. I find it unacceptable that XXXX XXXX, XXXX XXXX, and Launch Servicing LLC have engaged in such fraudulent and delusory practices towards vulnerable segments of the population. I would appreciate your prompt attention to this matter and look forward to a resolution that will release me and my fellow students from these usurious and fraudulent loans. The following is a ( likely incomplete ) list of the statutes violated : - Indiana Code 24-4.5-3-106 - Definition of a loan Indiana Code 24-4.5-3-502 - Indiana Code 24-4.5-5-202 - Indiana Code 23-2.5-10-1 - 12 U.S.C. 5481 - 12 U.S.C. 5536 - 15 U.S.C. 1650 ( e ) - 12 C.F.R. 1026.46 ( b ) ( 5 ) - 12 C.F.R 1026.48 ( e )

I should not owe this company anything! I am currently a XXXX XXXX student. I applied for a XXXX XXXX XXXX to fund school, but I was denied for adverse credit. In order to appeal, I needed to settle the claim I had in collections as well as take care of any other loans that I had that were past due. The account that was in collections was from Launch Servicing , LLC. They turned my loan over to Turnstile Capital Management who turned it over to XXXX XXXX XXXX. I paid over {$3800.00} to settle the claim. That was money I didnt not have that I raised. I knew I did not want the other loan from Launch Servicing , LLC to be sent to collections also. I called on XXXX XXXX to figure out what I needed to do to make my account current. I spoke with XXXX at Launch Servicing. I knew the balance on my account. I only needed to confirm that paying the balance would make me current. XXXX let me know that I didnt need to pay. Instead, she told me that I could place my loan in forbearance and start payments in XXXX of this year. She let me know that all I needed to do was fill out a postponement request form that takes 5 days to process. She guaranteed I would be approved. She also told me she would look into getting me a letter saying I was current since I let her know I needed a letter to attach with my appeal. Launch Servicing let me know that they record all their conversations. On the phone you will hear me asking what I need to do to make my account current, and her constantly telling me that no payment is necessary. She practically begged me to do the postponement form. I relied on what she said which is why I moved forward with the form instead of payment. At the end of the 5 days, instead of my account being current like XXXX and I discussed, I found that my account had been reported to the same collections company. Have you heard of that? A company who tells you not to pay then reports you when you dont? Me either! I called back on XX/XX/2022, and Launch Servicing let me know that theres nothing they can do because my account has been reported to collections. They let me know that the associate who told me this would be dealt with because that shouldnt have even been an option for me. Do they think thats enough? That information wouldve been nice to know, especially because when I called my account hadnt yet been reported. I tried to speak with XXXX and I couldnt be transferred. I asked to speak to a supervisor or manager but I couldnt be transferred to them either. I kept hearing Theyre going to tell you the same thing Im telling you. I asked to speak to one anyway and I was told I would hear something in 24-48 hrs ( Im assuming business days ) and Ive heard nothing! I kept being referred to collections for them to answer my questions but because it was just reported it is not showing in there system yet. I then called yesterday, XX/XX/2022, and I found out that, of course, XXXX no longer works there. I am truly disappointed in how things went. I may have to sit out a year of XXXX school and worry about how to pay this new collection bill because an associate answered the phone and gave me the wrong information. I called to pay, and I will not be held accountable for XXXX actions. I need my account bought out of collections and settled. I thought I could trust someone who works there and someone who the company trusts enough to answer the phone. I guess not! So far it seems like Launch Servicing is saying sorry for the mistake, but youre on your own. They DO NOT care! This is my life and my credit. Please listen to those recorded conversations! This is not my fault! This is not fair! This is on Launch Servicing! This debt is now on my credit and it should not be! I have already paid this company thousands of dollars and I will not again, especially because the reason they have it is not my fault.

During XXXX of my semesters art XXXX University - XXXX XXXX I entered into an agreement called " XXXX '' to help pay for tuition that was presented to me by the university. The idea of XXXX was a self-sufficient XXXX XXXX based fund that alumni who previously were in the program would help to pay for other students tuition. This was labeled as not a " loan or credit '' on the information website and that it would be allowing you to help contribute to other students education process in return for helping your own. The loan was presented to me as a " contingent debt '' when in hindsight it was a XXXX private loan that was advertised to us. Through my research I have discovered that XXXXXXXX was seemingly funded through hedge funds and XXXX XXXX with the help of XXXX XXXX XXXX XXXX high-cost income based private loans that are avoiding the label of being branded a " private loan ''. This is shown by the loan also not need to be paid if the recipient is unemployed. Beyond this the amounts that are charged for the repayment of the loan are extremely astronomical. During the years XXXX & XXXX at XXXX University, I received funds from XXXX for {$8600.00} & {$15000.00} respectively. These private loans now hold a repayment amount of {$19000.00} & {$34000.00} for a total of {$54000.00}. The difference between the initial {$24000.00} has nearly doubled with the payoff amount. This is unacceptable considering how this XXXX XXXX was presented to me and how it has failed to truly identify itself as such. ( The attached documents show more information relating to the loans ) I feel as if I was mistreated and wronged by XXXX when trying to better myself with a higher education. I feel as though I have been cheated and lied to about the nature of these private loans and what is backing them. Through my research I have found a variety of articles and other individuals who are experiencing the same issues. This situation seemed at first to be something bright and exciting, but has turned into lies and almost a Ponzi scheme for hedge funds / wall streets to trick high earners from a prestigious school into receiving high-cost private loans that do not follow private loan guidelines, for instance there is no payoff amount for the entire loan due to the fact XXXX hides behind the idea this loan is a " contingent debt '' when in fact it is a true to life private loan and has even been classified as such in the standards of the XXXX. of XXXX. To add to the suspicion of bad loan policies and mistreatment of students through this program, XXXX has closed this option of funding for the past two years with no intention to bring it back after only a few short years in use under XXXX XXXX. This to me is a eye opener for the fishy loan tactics and misinformation that has been spread regarding the program during its time in use. This program to me had the ability to be a good thing to help people like me get a wonderful education, but that did not end up being the case. This program has seemingly betrayed the students of XXXX and anyone that was misfortunate enough to enter such a rigged and cheated system. This ISA should be abolished at XXXX and across universities in the country until it is better understood and managed properly for students. This compliant is fully directed at XXXX University, XXXX, and Launch servicing. Here are some links to stories that have popped over the last year relating to the issues that are apparent with the XXXXXXXX program. XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXXXXXX? XXXX & XXXX & XXXX

XXXX XXXX XXXX XXXX Correspondence : XXXX XXXX XXXX XXXX XXXX, SD XXXX This a long and involved issue that began in XX/XX/2018 with this merchant. I filed a Chapter XXXX Bankruptcy in XX/XX/2018. That merchant launch servicing has consistently reported that account in various different statuses to the credit bureaus. I have filed countless disputes with each credit bureau because the merchant is not reporting the information correctly. I was never notified by the merchant in writing, by phone or email ( especially email, because I moved to California at one point ) concerning the status of the account. As a result I was not able to determine the status of the account and the true debt that was associated with this contract. Due to it being litigated in a Bankruptcy the status and nature of the account balance was never truly understood until the date of discharge, at which point the creditor was notified that I did in fact owe them a fractional portion of the debt. Nevertheless the reporting was not ever maintained or reported correctly during the Bankruptcy period or after the date of discharge. I have attached screenshots from each Bureau detailing the reporting that is kept for this account. One account is reporting null information, one is reporting that the account has been late and over 120 days late for over a year when this is not the case and another account is reporting that the account was late until the date of discharge. The XXXX score is significantly lower than my other scores and this is impacting my ability to get housing with housing providers in California who are referring to my XXXX report. I have sent countless emails to this creditor and have had conversations with this creditor on numerous occasions, only to be sent some kind of response that does not address what I am discussing with this merchant credit agency. I recently notified this creditor that if they did not correct this information I would report this information to the FTC and sue them for breach and trespass consistent with the Fair Credit Reporting Act. I am being impacted negatively by this reporting as I have stated. I am attempting to purchase a home and get housing in the midst of a pandemic and this reporting is not accurate or fair to me as a consumer. This is my final attempt to resolve this issue outside of a court room where I will seek specific performance and an injunction consistent with their reporting behavior, causing for a rebuke in their abilities to report by and through credit agencies as well as obliterating an records of this merchants relationship with me as a consumer. I have been very patient and they have consistently failed to address my requests and have continued to be incompetent and inept in handling this issue.

In 2019, I had signed up for an online XXXX XXXX XXXX and was going to pay for said coure utilizing a loan from a company called Launch Servicing ; however, prior to even starting this XXXX XXXX XXXX, I ended up CANCELING my enrollment due to the fact that the school repeatedly failed to send me the proper course materials that would be needed to successfully work on and complete this course. I then conducted extended research on this " school '' and found through many other student reviews that this school was a scam and MANY people have had extensive problems with this school. Honestly, it has been so long that I do not even remember the name of the school, but what I DO know for a FACT is that I did NOT take this course, did not even begin it, and immediately CANCELED my enrollment and CANCELED my financing through Launch Servicing. Fast forward to just a few months ago, I was examing my consumer credit reports and disocvered a collection account from Launch Servicing, claiming that I owe {$3600.00}. This is ENTIRELY INCORRECT. I EXPLICITLY CANCELED MY ENROLLMENT AND CANCELED MY LOAN PRIOR TO EVEN BEGINNING THIS COURSE! I immediately contacted Launch Servicing via email and did not receive any sort of response. Finally, after an ENTIRE MONTH of emailing these people, I received a response from Launch Servicing, claiming that I DID NOT cancel my enrollment in this course. This is ABSOLUTELY FALSE. I never even STARTED this course and CONTACTED BOTH LAUNCH AND THE SCHOOL TO CANCEL BOTH MY ENROLLMENT AND MY FINANCING. Therefore, Launch Servicing is SLANDERING and ASSAULTING my good credit with this ENTIRELY FALSE information, claiming that I owe them nearly {$4000.00} for a course that I NEVER EVEN TOOK. To make matters EVEN WORSE, since contacting these people, I am now receiving MULTIPLE HARASSING PHONE CALLS PER DAY as well as letters via mail from a collection agency by the name of XXXX XXXX out of XXXX, DE. So, not only is my credit being slandered by Launch Servicing, but their collection agency is now constantly harassing me and blowing up my phone multiple times per day. I will NOT stand for this behavior and I will NOT allow my otherwise SPOTLESS credit reports to be tarnished by LIES. For the sake of context, I have conducted further research on Launch Servicing and found that they are currently being sued by another indivudal for their unscurpulous debt collection practices, which may be found via this link : XXXX XXXX XXXXXXXX

Launch Servicing , LLC is slandering my credit reports, claiming that I owe several thousands of dollars on a student loan THAT I NEVER TOOK OUT. I had APPLIED for a student loan with this company nearly 3 years ago for a XXXX XXXX XXXX XXXX course that I WAS going to take and I was approved for said loan ; however, there were MANY red flags about the online school that I was planning to enroll in, the most concerning of which was that I discovered they did NOT have the proper XXXX accreditation that was needed. Had I not completed a course that was XXXX accredited, I would not have been able to obtain employment as a XXXX XXXX. Therefore, I immediately CANCELED my enrollment in this course and NEVER TOOK IT. However, for the past 2 years, Launch Servicing , LLC has been falsely reporting to the credit bureaus every single month that I have not paid them and they continue to tack on illegal fees to inflate the balance. Launch Servicing is in direct violation of the Consumer Credit Protection Act, the Fair Credit Reporting Act, and the Fair Debt Collection Practices Act. They have been made fully aware that I DO NOT owe this debt, yet every month, this company is repeatedly communicating incorrect and defamatory information to third parties, including, but not limited to XXXX, XXXX, and XXXX. This false reporting has reduced my once excellent XXXX score of XXXX to XXXX and it continues to drop as a result of these incorrect missed payments being reported monthly. As a result of these blatantly reckless, wanton, and intentional acts, I have suffered and continue to suffer general and specific damages in that I am unable to obtain new credit and I was even turned down for a job that required a credit check as a direct result of this incorrect reporting. There are MANY complaints against Launch Servicing , LLC relating to credit reporting/collections and even a lawsuit that was filed against Launch Servicing this year in XXXX, XXXX XXXX Launch Servicing , LLC et al ( https : XXXX ). I am now demanding the immediate and complete removal of this account from my credit reports. If your company XXXX Launch Servicing , LLC ) fails to comply, you will be required to appear in a court of law and I will be allowed to seek monetary damages from your company.

I am having trouble with XXXX XXXX XXXX servicer. It recently transferred from XXXX to Launch Servicing. In early XXXX I sent in my XXXX tax information for reconciliation for them to update my payment. They then claimed I owe over {$5000.00} in reconciliation and it was due immediately. The amount for that reconciliation does not make sense what so ever. I was in deferment through XX/XX/XXXX according to XXXX. I have email proof of XXXX telling me that. In the XXXX it states that deferment period will just be added on to the end of the time. There was under {$100.00} difference a month from what I was paying to what the reconciled income is. And that should have been from XXXX through XX/XX/XXXX. My first phone call with them was the last week of XXXX. The person was not able to help me other than saying a supervisor would review it. I then messaged them on XX/XX/XXXX. I shared with them my concerns about the reconciliation and also how when I used the numbers they provided to calculate my payment it appeared they were overcharging me. They never responded to that message. I then called again on XXXX and was told that my account was being reviewed and that a supervisor would be calling me in a few days. I never received that call, and I was never sent a message. I then messaged them on XX/XX/XXXX asking about what was going on. I did not receive a response until the XX/XX/XXXX and all it said was that updated proof of income would be required no matter the outcome. They have my updated income from my tax documents. As of today, XX/XX/XXXX, I still have not heard from a supervisor. I continue to receive delinquent payment letters. I had two " spam '' calls over the past two weeks, that after I looked up the number, I realized it was Launch. I assume it was just automated telling me about the delinquency because no messages were left. Overall this XXXX XXXX program was misleading and promoted totally differently that what it actually was. I understand the obligation to the payments I must make, but I need to have this reconciliation thing figured out. Launch Servicing appears to me in no rush to assist me and is more than willing to just sent me delinquency letters and tank my credit score.

I signed up to be the cosigner for a loan, servicer Launch Servicing LLC ( on behalf of XXXX XXXX ), for career training for the primary borrower. The primary borrower declared bankruptcy this year prior to the first payment of the loan coming due. The account was listed as in default in XXXX of 2022 but when asked about this Launch stated that this was an error, the loan was in fact NOT in default and the status returned to deferment. I received a notice dated XX/XX/2022 stating that since the primary borrowers bankruptcy was discharged I would now be solely responsible for the loan. It should be noted that this is the last correspondence I received from Launch and any further contact has been initiated by me. I was aware that this was the case so I was logging in the check the status periodically in preparation of the first payments due date. I checked in early XXXX and saw that the balance was showing as {$0.00}. I called in to inquire as to why that is and was told that the lender had decided to discharge the loan. I was not given a chance to make payments per the agreement I signed ( all cosigner related documentation attached ). They have not given me the opportunity to fulfill my obligation to pay and have reported the account as charged off on my credit report unfairly. I contacted Launch and requested they reopen the account, allow me to make the payments and remove the report from my credit report. They have refused to reopen the account and claim that the report is just. The survivability clause in the credit agreement states that the original agreement stands even in the event of primary borrowers bankruptcy making this report unfair as they stole my ability to make the required payments. Launch has stated that it is XXXX 's policy to charge off the account in the event of primary borrower 's bankruptcy but this is not stated in any of the loan documents that I or the primary borrower signed. They have violated the initial agreement. Proof showing that the account was never in actual default attached despite their claims when I call in that the account was in default at one time

This complaint is directed against three companies listed below, - Stilt ( XXXX XXXX XXXX, XXXX XXXX, XXXX XXXX CA XXXX ) - XXXX - XXXX Both of my credit reports with XXXX and XXXX currently include a personal loan with XXXX. In both cases, the last update was received in XX/XX/XXXX. The account shows in both cases as paid on time and open. This is incorrect in two ways. Firstly, payments were made on time in XX/XX/XXXX, XX/XX/XXXX, and XX/XX/XXXX. XXXX has not reported those payments to any credit bureau as of XX/XX/XXXX. Secondly, on XX/XX/XXXX, XXXX sent me an email detailing that servicing would be transferred to XXXX XXXX on XX/XX/XXXX. This email is attached. In XX/XX/XXXX, I began making payments to XXXX XXXX and that company has correctly reported those payments XXXX and XXXX ( not XXXX ). As a result, my XXXX report incorrectly shows me as having an open personal loan with XXXX and an open personal loan with XXXX XXXX. My XXXX report shows me as having an open loan with XXXX. In XX/XX/XXXX, I opened disputes with both XXXX and XXXX, detailing the above information. Both companies claimed to have conducted investigations and both found that my dispute was not merited. They both certified that my credit reports are accurate and that XXXX had verified that the information is correct. This is simply not true and contradicts the email that XXXX sent me in XX/XX/XXXX. It is the case that either XXXX has not provided a truthful response to XXXX and XXXX and/or that both of these credit bureaus did not conduct a bona fide investigation. In particular, how could either of these two credit bureaus be satisfied that the information is accurate? If indeed my account with XXXX is open and paid on time, how could it concurrently be the case that no payments have been reported since XX/XX/XXXX? This is contradictory and suggests that XXXX and XXXX did not perform a good-faith investigation.

On a call with Launch Servicing prior to XX/XX/2022 I was told by a representative that my payment was still needed from XXXX. I initially called Launch servicing to complain about there lack of communication and clarity on my new loan, but all was fine. On this call I was ready to pay for my previous and upcoming payment, but out of time convenience I asked the agent if I can the next day. Paying on this phone call was no issue and my bank statements/ available liquidity on file during this call would prove this to be true. Unfortunately, the Launch Servicing agent told me it was no issue of me paying the next day, assuring me I would get no late payment on my report as long as it was done by then. Even doubling down explaining that they would grant me a 1 time removal of generosity if the system was to flag me. The next day I placed the payment and was hit with a late payment on my report ( my first ever late payment and my credit dropped nearly XXXX points over night. I was XXXX years old with a huge focus on building my credit and have done everything for this to never happen ). When I called Launch Servicing the next day they told me they ended their " 1 time removal of generosity '', the day before being the last day, also the day I first spoke with them and was given the reassurance. This is unaccepetable and unfair to me quite frankly and I have everything documented that proves the negligence toward me as a first time borrower that has never had a late payment. I have been back and forth with them now for 8 months and neither XXXX or Launch Servicing seems to care about the situation. Please help this is my first, only, and a false late payment which affects my credit greatly. On XX/XX/2022, I contacted Launch Servicing to initiate a Natural Disaster Forbearance for the California Coastal Wildfires ( per FEMA ). After speaking to another representative on XX/XX/2022, I was advised on a recorded call that a bank statement would be sufficient to prove my relocation back to California after a short stint in another state for work which I immediately provided via the online portal. At this time, I also advised this agent that the disaster affected my employment, not my residence ( landscaping, which takes us to multiple locations throughout XXXX and XXXX counties ), and was advised that this would acceptable. The following day today, XX/XX/2022 I was advised via email the need for a copy of my Drivers ID instead of the aforementioned bank statement, which was previously advised and promised would be sufficient to process the Natural Disaster forbearance. Launch Servicing has by far been the most difficult Servicer to deal with, and has continuously provided me false promises regarding my loans and financials, and has caused me ongoing and severe medical distress. At this time, I have sent all the documentation that I will be sending to Launch Servicing, as previously advised. Further, Launch Servicing claims that my loans are owned by XXXX XXXX an entity that the Borrower is unable to reach directly, while these matters continue to violate the rights of Borrowers struggling with repayment due to hardships or in my case, a Natural Disaster and wildfire in California as FEMA declared in XXXX, XXXX. This matter remains time urgent, and at this time I am requesting immediate phone contact from XXXX XXXX Executive Management and the urgent placement of my loans into a XXXX l-day Natural Disaster forbearance as previously advised and promised by Launch Servicing staff on XX/XX/2022.

In XXXX of XXXX originally applied for and received a loan of XXXX dollars from XXXX XXXX ( XXXX XXXX. No. : XXXX XXXX ( XXXX ) a company whose loan products seem to now be owned by XXXX XXXX ( XXXX XXXX XXXX ). On XX/XX/XXXX, Launch Servicing LLC ( launchservicing.com also known as XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX 1 ) assumed servicing of the loan. I have since paid the balance down to XXXX dollars ( as of XX/XX/XXXX ). However, on my XXXX credit report it still shows a balance of XXXX dollars dating from XX/XX/XXXX under lender name of " XXXX ''. A few days ago, I contacted XXXX repeatedly and even filed a dispute resolution request online with them. XXXX then rejected the request and upheld the false balance entry, citing the fact that the lender maintained the balance is correct. ( I do not know if they spoke to XXXX, XXXX XXXX or Launchservicing ) to make this determination. I then contacted XXXX XXXX via phone, who refused to help in any way, giving me the phone number for launchservicing.com. I called launchservicing.com and they said it is XXXX 's responsibility to report the loan correctly, not theirs and that they ( Launchservicing ) had been reporting for me monthly ( a claim that is false as there is, as of XX/XX/XXXX XXXX PST no entry for Launchservicing.com on my XXXX credit report ). In sum, launchservicing.com puts the responsibility on XXXX and vice versa. XXXX defers to the " lender '' - I do not even know who they spoke to or who the " lender '' is at this point. In any case, my credit score is unfairly and materially adversely affected by the false balance appearing.

Hi and how are you doing? Im not sure who to take this to anymore, but Ive disputed this account several times with both the original creditor and the credit reporting agencies accordingly and Ive attached everything to support my dispute. However, I continue to received a pre-template letter sent to me that its been verified and it REMAINS. How is it possible that this was verified if you continue to report incomplete, inconsistent, inaccurate, and unverifiable information on this account and a thorough and in-dept investigation. Ive disputed and I havent received anything as such, but it continues to be reported in violation of the consumer laws. Continues to report wrong balance, incorrect date of first delinquency, wrong date of last active, inconsistent payment status, high balance and actual balance is questionable, etc. I believe that section 609 of FCRA also allows me to ask for detail information about the account and how you indeed investigated and your detail process. Im extremely upset and shocked about the way this charge-off account is reporting on my credit report which continues to report with incomplete, inconsistent and unverifiable Info. How can you honestly say that you verified as it being accurate? This was NOT verified! I am requesting this investigation under the authorization of the Fair Credit Reporting Act Section 623. ( a ) ( 8 ) ability of consumer to dispute information directly with the furnisher. What I am disputing : The account you have reported to the three credit bureaus. My basis for this dispute is that I have no knowledge of this account.

We recently had our credit pulled and found out that I had " installment '' /student loans through XXXX that I had never been aware of. I have been paying a company called " Launch Servicing '' since XXXX who had claimed to be my loan servicer for my student loans. I contacted XXXX on XX/XX/XXXXXXXX to find out what these loan amounts were and if they were truly loans in my name. In speaking with XXXX I was informed that they were the current loan servicer on all of my student loans and had been since the original change of servicer from " XXXX XXXX '' back in XXXX. I was then informed that " Launch Servicing '' was a known scam and that I should immediately begin to file claims with XXXXUS Department of Education , and our banks as well as try and contact Launch Servicing to attempt to get a refund. Launch Servicing has been unresponsive to my calls and I've only received an automated message back in response to the email I sent also on XX/XX/XXXX. Records through Launch Servicing 's web site show I have paid a total of {$5100.00} to them. I am still trying to reach a banker at my bank to get a final amount that has " actually '' been paid to Launch Servicing. According to XXXX there has not been any payments made on my student loans since my income driven repayment plan was put in place, so I am not sure where this {$5100.00} has gone, because it has not been applied to my student loan balance. I did ask Launch Servicing to explain where my payments have been applied, but again, I have been unable to reach someone with Launch Servicing.

I previously took out an educational loan to pay for my college from XXXX XXXX. They are now Launch Servicing LLC. I only have one loan from this lender. Recently, I went to look at my credit score since I am a senior about to graduate. On my credit report, there are two reported duplicate loans from this lender even though I only have one. When I called to inquire about this to the company, they stated that they changed from XXXX XXXX to Launch Servicing LLC and this caused many people to have duplicate loans show up on their reports. One loan is listed under Ascent, one is listed under Launch. They told me that if I filed a dispute with the credit bureau, they would confirm that the dispute is valid and take off the duplicate loan so only one is listed. However, the dispute I filed was denied. I refiled the dispute and called Launch again demanding the duplicate loan to be taken off because it is bringing my credit score down XXXX points. Now I have to wait to see if the second dispute is approved, but overall they have done nothing to help me resolve this issue and because of their mistake, my credit score is lower. I do not recommend taking out a loan from this company, they are very unreliable and won't work with you to resolve issues like this. Attached is the loan payoff letter for the one and only loan I have from this company.

This has been going on now for about 2 years. I asked for information about billing and coding and that when the calls started. At the time I was on a wait list to get into the XXXX program. when I finally decided to get into the program, I was told I could do the program at my own pace. XXXX did not tell me anything else about fundamentals. So I write a email to the school about taking something I don't need. Also I didn't even get a chance to even start classes. So this is my whole issues. Why am going to pay for a class that I did not even take. They sent books and that was it. I only have a responsibility to pay for the books that's it. I have tried to contact XXXX and Launch and all I do is get the run around about who i can talk to about the loan. I have even asked for contact of a Ombudsman on each side and no one has given me any information. At this point that account is on my credit report and has my XXXXredit score in the dumps, just because of this one account. I feel this is a scam because they never give you any precise information to solve my problem. I need help to get them off my credit report and they need to be investigated. I had to block them form calling me everyday.

Launch Servicing has been reporting a alleged debt on credit report. I never received notification stating that they would be placing this debt on my credit report and my right to ask for validation. I sent this certified mail I received my return receipt on XX/XX/22 that this company signed and received my request. I sent this certified mail as well I received my return receipt on XX/XX/22 that this company signed and received my request. Here we are XX/XX/22 and I have yet to receive my request theres no creditor listed on this account that has been placed my credit report which is a violation. I also have reason to believe that they are reporting a duplicate account on my XXXX credit report under the company name XXXX which is another violation. Both accounts show the same account number, open date, amount owed, and the same exact company address.

I have asked all three credit bureaus to verify this alleged debt they claim I owe and that is damaging my credit profile via mail. The bureaus responded with verified I also disputed this account directly with the collector showing the inaccurate reporting that they have given the credit bureaus, and also sent a debt validation letter that they have not responded to. I am well of my consumer rights and they are being violated at this point this collector sent me a letter stating to show them the inaccurate reporting which I replied with a investigation letter pointing out the multiple inaccuracies with a copy of my credit report and highlighted everything inaccurate and ask them to investigate and remove this account from my credit report. They then responded back to me stating that my dispute is a duplicate and to provide them with the inaccurate information again which I sent the first time. This account hasn't been verified after my request and after me reporting out all the inaccuracies in the reporting. The law states all accounts have to be verifiable and 100 % accurate.

XXXX XXXX XXXX XXXX XXXX XXXX XXXX, FL XXXX DOB XX/XX/XXXX SS # XXXX Dated : XX/XX/XXXX RE : Account Number XXXX To Whom It May Concern, On or about XXXX of XXXX, someone applied for student loan using my personal information from XXXX XXXX XXXX, XXXX. I have since requested validation for the loan and so far have received none. XXXX XXXX XXXX, then sold the loan to Launch Services, LLC, who place the loan amount of {$2500.00} on my credit report. Since Launch Services, LLC placed the unauthorized debt on my credit file, my credit have fell below XXXX. I have requested for validation of the loan. I am requesting copies of Identification, Social Security card and Copies of documents with my signatures attached. Under the FDCPA, you have the right to debt validation. This means a consumer can demand that a creditor reporting information to the credit bureaus prove the account is really your responsibility and that the balances are accurate. Also, a debt collector must also prove they have a legal right to collect the debt. This matter needs to get resolve immediately.

Dear CFPB, I am having a major issue with Launch Servicing. I have sent many disputes out regarding inaccurate information on my report but they have not fixed the issue. Today I called them to see how I can get this removed from my report and they did not want to help me. I attached a copy of my report showing different balances reporting across all 3 report. Including an attachment directly from their website showing a completely different balance. Can you please investigate this for me? It is causing emotional distress. If you look at my report this account is also reporting as 120 and 180 days late but also shows as a delinquent account for many years. I don't understand how its reporting as open and late. I am also going to file a complaint with the state attorneys office if this company doesnt delete this account because as mentioned I have filed several disputes already and they are still violating the FCRA XXXX I'm sure they are aware that they are violating my consumer rights. Thank you in advance for investigating this matter. Please see attachment

Launch Servicing is trying to collect amounts from me that are unfounded. I originally started paying the debt from another servicing company and could only pay a certain amount monthly which was a fair amount totaling around {$2500.00} from XX/XX/XXXX to XX/XX/XXXX. Launch Servicing then came with the amount totaling over {$20000.00} as well as false claims of me never paying saying I was behind in my payments when I paid in good faith every month. I am being harassed to pay for something I don't even have a clue as to where they are getting the information from. Apparently the previous servicing company didnt like the amount I paid month to month and turned the debt over to Launch after they lied about everything. I uploaded documents showing what I paid previously and it wasn't acknowledged but I rather was harrassed and told more information was needed when the facts are plain to see I paid in good faith previously the account didn't reflect how much I paid just an outrageous amount and no details as to where they were getting it from.

Towards the end of 2022 I got a notification that my loan servicer, launch servicing LLC would be acquired by ascent. I had no mind of it until I saw my credit report and the account that I originally had taken out with launch had doubled into now 2 separate accounts. Now I have a {$17000.00} debt that is falsely under my name. I've contacted launch servicing, now Ascent, to change remove this and they told me that the credit bureaus will need to remove it, the credit bureau told me they need a letter from ascent. I've contacted ascent twice on this matter and they refuse to write me a letter stating their own incorrect information on my personal account and finances that is now effecting my life. Launch/Ascent has refused to provide any documentation, but has admitted to this falsehood on my account and credit. This has caused my credit score to lower, my debt being ~50 % higher then it should be, and refinancing and purchasing opportunities have become extremely difficult. Please help, thank you

Launch Servicing LLC is reporting that I took out a Student Loan. I did not. what they are reporting is a shared income agreement that I made with XXXX XXXX. This is not a Student Loan but they are reporting it as if I borrowed money and I did not. I agreed to pay XXXX XXXX some of my income but only if I make over a certain amount per year and I do not make that much per year so I do not owe anything at the moment. I never borrowed any money. It says right on the top of the contract " THIS IS NOT A LOAN OR CREDIT '' but they are reporting as though it is. I attempted to dispute this with the credit bureaus but they said that to reporting party certified it was accurate. That is not an investigation at all. I did send them the contract that said this is not a loan or credit but they seem to ignore that factor and they still have it reporting under Student Loan. Since this is not credit or a loan its does not fall under the same consumer laws. It should be removed.

I have a student loan with the XXXX XXXX of Philadelphia. This school no longer exist and they have a pending lawsuit for fraudulent transactions. My mom and I did not know that we signed for private student loans and this has been a disaster. The lender I use to have that serviced the loan was XXXX XXXX XXXX and now the loan was sold to another company called Launch Servicing. I was able to go on an income based plan with the old lender, which was helpful. This new company Launch Servicing refuses to put my me on a income based plan when I specifically told them I can not afford the payments. Ive asked them if I can reach the lender directly to work something out, and they refuse to give me the number. They said the lender doesnt offer any other plan besides interest only plans. This is a tough time and I cant understand why I have to pay for a loan with a school that is now closed for fraud. There should be a better option for me to make my payments.

I have two loans that went into repayment with Launch Servicing , LLC. I contacted the company to request a forbearance for both loans. I was granted a forbearance for both loans. I received an emailed letter from Lauch Servicing, LLC stating that the forbearance/postponement date for loan ending with XXXX begins on XX/XX/XXXX and ends on XX/XX/XXXX, with the next payment date due on XX/XX/XXXX. The second loan ending with XXXX stated that the forbearance/postponement date begins on XX/XX/XXXX and ends on XX/XX/XXXX, with the next payment date due on XX/XX/XXXX. However, when I checked my credit report, it had a negative mark for a late payment even thought I was granted a forbearance/postponement for the dates/periods stated above. I contacted Launch Servicing , LLC and was told that they are not able to remove the negative reporting, but I can dispute it with the credit bureaus.

XX/XX/XXXX I enrolled in a XXXX XXXX class through a private lender XXXX. I became delinquent in paying my monthly payments and it was submitted to a third party collection - XXXX XXXX. I agreed to a six month payment plan of {$310.00} with XXXX XXXX to pay account off, which I have since XX/XX/XXXX until current. I have one last payment in XXXX, however, Launch isn't reporting my on time payments accurately to the credit reporting agencies. Launch is reporting that I am 13 months behind, when my delinquency began in XX/XX/XXXX and my on time payments started XXXX XXXX until current. Launch reps stated that for each on time payment posted, that payment goes towards the months that I was behind. But it would never show any current on time payment, because technically the account is still behind. This reporting practice has drastically effected my credit score.

I did the math and there is no way I underpaid by that much. I have called Launch Servicing 3 times, and talked to 3 different people in the past day. Nobody is willing to help. I have tried to explain my situation, how I did the math and how it didn't add up, but they could care less. They are acting like they could never make a mistake and I'm crazy for saying that it is not adding up at all. They refuse to tell me where they got that number from. The only thing I have gotten any of them to say about it is why one of the people I talked to " feels '' about why I am getting charged that much.

They charged me the wrong amount. I have called them multiple times trying to get it figured out, but they have not. I was told it would be figured out by my next payment, which is tomorrow. They still have no clue what is going on, and when I call them, they claim that they are still trying to figure it out. I have been told multiple times I would get a call back in a specific time frame, yet I have not received one call back from them. When I call, they are not understanding about my situation at all and are frankly quite rude and dont even seem interested in solving the issue.

Attempted to develop an alternative repayment method during a call in XX/XX/2022. Was told they could help become current on my loans starting the first week of XX/XX/2022 for a payment in the {$97.00} range ( specific amount unsure at this time ). Launch Servicing said they would send out information to me regarding this repayment plan. I received no such information. When I asked for this information they told me there was no plan in place and I was ineligible. This is totally inaccurate and has/will affect my ability to secure housing and student loans for my graduate program. I believe they acted in bad faith and were deceptive in their practice. I verbally agreed to the alternative repayment plan discussed but they are not holding up their end of the agreement.

I have reason to believe that the loan servicer has increased the interest rate of the loan, additionally, there seems to be inconsistencies in the monthly calculations on applying the interest and principal. Request this matter be looked into.

I see multiple 30-150 days late marks which is a clear violation of my right under the FCRA. The company has never responded to any of my attempts to obtain any proof or documentation that will prove this account is being reported accurately.
