I am an XXXX ( race ), XXXX ( gender ) that is over the age of XXXX ( age ) both now and at the time of the XXXX XXXX XXXX ( XXXX, XXXX ) having a permanent XXXX ( XXXX ) ( degenerative XXXX XXXX and XXXX ). Go Financial ( XXXX called Respondent/Respondents ) are individual and joint creditors within the meaning of the XXXX, XXXX XXXX. XXXX ( XXXX ), and Regulation B, XXXX XXXX XXXX ( XXXX ). Respondents were and at all times knew or should have known their subjective illegal terms and conditions of the auto loan and underwriting process and usury high interest rates of XXXX XXXX are deceptive, discriminatory and illegal predatory business practices. The unlawful and discriminatory practices began on XX/XX/XXXX continues to this day. The unlawful and discriminatory practices are ongoing and punitive. Consequently, I believe I was targeted by the Respondents as an XXXX XXXX over the age of XXXX ( XXXX ) and based on my XXXX, vulnerable credit rating, XXXX XXXX XXXX. I was greatly XXXX financially by being illegally assessed a XXXX XXXX interest rate and been force to purchase an extended warranty which resulted in a loss of monthly income that interfered with my ability to eat, pay my bills or live at or above poverty level. Respondents were made aware of my XXXX during the underwriting process when I was asked about my retirement pension being a XXXX pension and when I was asked to provide a copy of my pension which clearly indicates XXXX pension. In addition and specifically, Respondents engaged in discriminatory, deceptive, fraudulent, white collar predatory loan practices when XXXX : ( XXXX ) From XXXX of XXXX to present, Respondents operated with deceptive, misleading and discriminatory practice when they required me to review and sign all documents online without time to view each page and terms and consequence of the contract with the assistance of an attorney and with time for clear thought and understanding. The print was not of a font or tangible for me to clearly read or understand the terms. The online application and underwriting process was clearly designed to not allow the target protected consumers to see, read, or understand the terms. The online application and sales process, purposefully, did not allow me time to consult with an attorney. ( XXXX ) From XXXX of XXXX to present, Respondents fraudulently and deceptively targeted me and others as a low socio-economically distressed XXXX XXXX XXXX XXXX XXXXXXXX with a XXXX XXXX XXXX on a fixed income. Specifically, XXXX, Go Financial and XXXX sent me false and misleading advertisements alleging Playing games with your interest rate is what dealerships do, and we don't roll like that at XXXX ( email dated XX/XX/XXXX ) and using terms like SIMPLE INTEREST RETAIL INSTALLMENT CONTRACT. Their practices violated and harmed me and the Federal Trade Commission Act ( " XXXX '' ) and the Uniform Deceptive Trade Practices XXXX. ( XXXX ) From XX/XX/XXXX to XXXX, Respondents bonded me to illegal and deceptive high interest rate auto loan of 17.99 % when the law states auto loans should not exceed 16 % interest rate. Even after I complained, Respondents did not refund the excess and did not reduce my interest rates to come in compliance with the law ; ( XXXX ) From XX/XX/XXXX to Present, Respondents were aware that my finances and creditworthiness was not strong enough to bear an illegal interest rate of XXXX XXXX and the Respondents knew or should have known that I had little to no savings, urgent credit needs and limited options. ( XXXX ) From XX/XX/XXXX to XXXX, Respondents also forced and/or coerced me into an extended warranty with XXXX at XXXX XXXX XXXX XXXX, TX XXXX XXXX ( XXXX ) XXXX. My warranty loan number is/was XXXX. This further marked up the loan price and generated more illegal interests for the Respondents ; ( XXXX ) From XX/XX/XXXX to Present, Respondents engaged in a pattern and practice of discrimination in their credit transactions, underwriting and XXXX XXXX interest rates on the basis of my XXXX ( XXXX ), XXXX ( XXXX XXXX ), XXXX ( XXXX ) and XXXX ( XXXX XXXX XXXX and thoracic aneurysm ) in violation of XXXX. ( XXXX ) I complained throughout the course of the loan period. However, the Respondents were unyielded and failed to self correct by refunding that portion of the interest rates that exceeds law and by failing to adjust interest rates to lawful rates. On or about XX/XX/XXXX, I complained of the deception, fraud, theft and illegal high interest rates. I stated it was having a disparate impact on me and requested a print out of my payments. In response, by email, auto loan bill being too high with noncompetitive rates. In conclusion, the Respondents XXXX ) Made false and deceptive representation in their emails and on the title of sales contract Simple Interest Contract and throughout the life of the loan to me, specifically, to target me as a XXXX XXXX XXXX, low income, credit vulnerable XXXX, XXXX with a XXXX ; XXXX ) Respondents, knowingly, made reckless underwriting questionnaires and decisions, false and misleading advertisements and XXXX and XXXX loan XXXX high interest rates of XXXX XXXX and did so with indifference as to the laws, ethics, the harm and injury to me ; XXXX ) Respondents sole purpose to mislead and misrepresent their auto loans and interest rates was to specifically to profile me and other people of protected races, ages, genders and XXXX who were not financially strong or credit worthy ; the intent was to defraud for their profit ; XXXX ) I, to my financial and medical hardship and detriment, relied on the Respondents misrepresentations and had the right to rely on it, and XXXX ) Yet, I suffered greatly with compensable injury solely as a result of the Respondents fraud, schemes, misrepresentation, discrimination and illegal business practices. XXXX ) Respondents deceptive, unethical, coercive, fraudulent and misleading loan practices that specifically targeted me based on my XXXX XXXX XXXX XXXX and XXXX resulted in having a discriminatory disparate impact on me causing me undue XXXX, exacerbating my health and causing severe financial XXXX.

XX/XX/XXXX The details of this complaint are as follows : RE : Used XXXX XXXX XXXX XXXX XXXX, XXXX XXXX Less than six months after I began making payments on the above-named vehicle, I experienced a number of issues requiring repair. I made such repairs at my own expense ( including one major repair ), although I had purchased a warranty from the dealership 's Vehicle Protection Plan. Within the next 3 months, I notice that antifreeze was gradually leaking out of the radiator. Later learned after getting a quote from XXXX XXXX ( XXXX XXXX XXXX XXXX, XXXX, IN XXXX ) a water pump was needed to remedy the leaking radiator problem. Then, about 9 months after the purchase date, the car needed to be jump-started over a period of about a week, then, no longer started, even when a new battery was installed. Total estimated repair cost of these two items, about {$1000.00}. Acquiring the monies needed for the two repairs has proven to be extremely challenging. As of this writing, concern over other possible issues ( car is parked outside of garage or other shelter ) along with lack of available funds for the diagnosed repairs, are reasons behind the longevity of the non-use of the vehicle. The car has been inoperable for more than 23 months as of today, XX/XX/XXXX. Meanwhile, the dealership was closed by a federal agency in XX/XX/XXXX. During my research, I discovered many customers have complained about XXXX XXXX. According to the XXXX XXXX, " XXXX XXXX abused processes in place that would allow citizens with subprime credit to get back on their feet through legitimate vehicle sales. ( See : XXXX : XXXX ). In XXXX, a customer shared this experience : I brought the vehicle to my mechanic for a second opinion before completing the purchase. I was told that the damages to this car would exceed {$5000.00} in parts and labor before being road-ready or safe. In XXXX, another customer wrote : This dealership, ( XXXX XXXX ) is selling vehicles that have serious mechanical issues. They are also selling fraudulent warranties with the vehicle. ( See : XXXX : XXXX and http : XXXX and XXXX XXXX XXXXXXXX ) The car dealership did business using the name XXXX XXXX and was located at XXXX XXXX XXXX XXXX, XXXX, IN XXXX. I continue to pay close to $ XXXX to a 3rd party entity. As a result of the fraudulent activities, other consumers who purchased vehicles from this dealership had their debts forgiven, told that they had no further outstanding payments. They were given their titles when the car dealership was closed down by the federal agency ; I did not have my remaining payments forgiven. I am currently earning substantially less than I was from the time I purchased the car until about 6 months ago, paying {$370.00} for a car I ca n't drive without paying about {$1000.00} to repair is an extreme hardship. As recently as XXXX of this year, I contacted Go Financial ( www.gofinancial.com ), the lending agency, to see if they would lower my payment after having paid on the loan for 2 years. They denied my request. I currently owe about 16 more months worth of payments. I do not currently own another car ( for about 4 months ) and am experiencing difficulty in getting another vehicle to drive in part due to the outstanding loan I have with Go Financial. This situation has required me to find ways of getting to work, etc. that have become extremely taxing and time-consuming.

I have a car loan through Go Financial Services in which I had been making payments on the car loan as well as staying in communication regarding any late payments. In XX/XX/2017 I made a payment of {$500.00}, {$210.00} above my normal car payment in an effort to help get caught up from a past due payment. Due to some financial difficulty, I unfortunately missed my XXXX and XXXX Payment. I called into the office on XX/XX/XXXX and was told my account had been charged off. I did not receive any correspondence or communication of any kind prior to that stating that my account was in the process of being charged off nor did I receive a charge off date. The representative in management I spoke with was a female and I explained to her that I was calling into make a payment on the car loan and that is when she stated the account was charged off and it would be {$1000.00} to pull the car out of the charge off phase and keep the car from being repossessed. This was quit disturbing being that I had no idea that the account was in this status. I told her I did n't have XXXX but had XXXX that I could pay today and asked if there was any way they could work with me to get the remaining balance paid off. She stated you can make the payment but it would n't take it out of charge off status or keep it from being repossessed. There has been no repossess notice sent out nor could she confirm one. She suggested that I see what I could come up with in addition to the {$300.00} and give them a call back today. My wife and I called and spoke to XXXX ext. XXXX today another manager in the same department who confirmed the call from yesterday and stated I would have to pay XXXX to bring the account out of the charge off department and stop the repossession request. He also stated that they would then place the account back into a repayment plan but there would be no grace period on the repayment, and should I miss XXXX payment they would reinstate the repossession on the car. I asked was there any way if I where able to pay {$500.00} on the fee today could they work with me to take care of the rest. He said no. This was disheartening being that I never received any correspondence relating a charge off pending on the loan and called in 3 days after the car was charged off. According to XXXX the car loan was charged off on Friday, XX/XX/XXXX. I shared my concern with XXXX and asked if there was a supervisor that I could speak with that might be able to help me further and he said no, and that he and the young lady I spoke with yesterday where the only XXXX individuals managing the department, there was no one else. How disappointing that they have no grace to work with individuals who are trying to present options to take care of the fee they where requesting, he stated I understand but we have policy 's that we have to go by. I asked for his information and stated that I would have to contact him back.

The issue is that my SUV ( XXXX XXXX XX/XX/XXXX, XXXX XXXX with XXXX # XXXX ), was wrecked on XX/XX/2016 and was declared a total loss. This was paid, mostly by the insurance company of the person that crashed into me. {$11000.00} was paid on XX/XX/2016 by XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, and the other part was paid by my GAP insurance. They made a payment of {$950.00} on XX/XX/2016, of which {$460.00} was for the cancelation of the warranty and {$480.00} was for the cancelation of the repairs. The grand total was {$12000.00}, which they received ; however, to this day the account [ is still open ] and they continue to charge interest as well as other fees without any reason at all. They have yet to apply the credit to pay it off and send us the surplus, which is {$780.00}. My wife and I have contacted the finance [ department ] [ unintelligible ] on countless occasions with no success since the people that assist us indicate that they can only provide the information that is in the system, namely, that the account is delinquent 65 days and that it is affecting my credit. They also indicated that they had XXXX unintelligible spelling, perhaps declined XXXX the payment. I dont understand why, since I contacted XXXX and they advised me that the check had been cashed by GO Financial. They have received the money but even so they keep raising the amount and will not apply the awarded amount to the balance of the account, which is affecting my credit. The balance on the XXXX was {$11000.00}, and they were paid {$12000.00}, which means there was an excess payment of {$780.00} that belongs to me, but I have not received it since they have not handled the account in a legal way. To date they have raised the amount of my account to {$11000.00} without any reason, because they have the money and are affecting my credit, just so they can keep all the money. The situation is extremely important and worrisome, since they are affecting my credit and I need a vehicle. I cant purchase another XXXX till they pay off the account, send me my excess payment of {$780.00} and clear my credit. Now this situation is affecting me emotionally.

My parents who live in another state received a voicemail on XX/XX/XXXX stating that they were about to pursue legal action against me if I did not contact them right away. This would be their last attempt. I called them that day and the lady would not disclose the company she worked for right away until I gave her my case number. She asked me if I owned a vehicle in 2015. I said yes but I had not seen anything on my credit regarding the vehicle in 7 years. She proceeded to talk very fast about pursuing legal action and having to go to court if I did not pay that day. I have never been in this situation and was very scared she said I owed an amount that I was not familiar with or sure of if it was correct for a vehicle I only had for two months. It was constantly in shop for repairs. Was a complete lemon and surrendered it to dealership right away. She gave me the option to pay half of the debt and they wouldnt make me pay the rest or else I would have to make payments for the next two years. I didnt have anyone to discuss the matter with in the moment and I panicked and said I didnt have the money to pay a lump sum now so I will have to make payments. She made me sign a document and charged me {$50.00} that day. {$200.00} a few days later and then they just charged me {$250.00} on the XXXX of XXXX. I then explained the situation to my boyfriend who had been out of the country for some time and I called back the debt collector, XXXX XXXX XXXX XXXX XXXX ). The lady was extremely rude, aggressive and threatening to me and refused to let me speak to their supervisor. She said she will put this on my credit immediately if I dont pay her. I was just trying to get more information on the company because I could not find anything online about them. No one would give me the address of the company, the full name of the women I spoke to or the name of the supervisor. I also tried to collect their professional license number and no one knew and has not answered my calls. I will be calling the authorities and reporting this company as well.

Continuation of previous complaint : Go Financial has sent correspondence to my disputes and complaints with the credit bureaus, BBB, and CFPB. The information they sent continues to show proof of several violations and discrepancies with this invalidated debt. Go Financial states on the Redemption and reinstate form that the vehicle was repossessed on XX/XX/16, however they state on another document that it was repossessed on XX/XX/16. The notice that they are required to send me per NC law about the sell of the vehicle is dated XX/XX/16 and XX/XX/16 on another document. This notice was never received by me which suggests that it was possibly forged to serve this purpose. Per NC law they are required to notify me of the date, time and place of the sell of the vehicle if it was sold at an auction. Their letter states that I was notified that the vehicle will be sold at anytime within 10 days of the letter at a private sale, but continues to read that it was actually sold at an auction in which they never notified me of the date, time, or location -- the location on their documents only notify me of where the vehicle was being stored. Their failure to provide this information conflicts with NC State Law which decides what a creditor can and cant do. ( NCGS ) On the explanation of deficiency they lists that I owe XXXX without fees, but they are reporting a different amount on my credit report which they have never sent me a breakdown reflecting the new charges. I find this company to be in violation of my rights under the FCRA. They have failed at providing me with accurate, clear, or validated information. Even with so many discrepancies they continue to report as accurate on my credit reports after investigation. With so many discrepancies directly from them, there is no way to validate what is accurate. They have also violated the laws of NC by being unable to provide any receipts or verifiable information that they notified me specifically about the sale of the vehicle to provide me with an opportunity to attend the sale.

My vehicle was repossessed last Saturday XXXX. Full disclosure, this is the second repossession and the first was in XXXX XXXX. I redeemed the vehicle shortly after and have made every payment ( sometimes early ) which means I am NOT in default. According to my contract, my payments are due on the XXXX of each month. XXXX, XXXX, XXXX, and XXXX have all been paid. XXXX will be due soon. I am not understanding why my vehicle is gone. Let 's say I was in default, which according to my recent payment history i am not, according to my attorney, Go Financial illegally and wrongfully repossessed my vehicle. Below you will find the act according to Louisiana Law. Effective XXXX XXXX, XXXX, Louisiana 's Act 191 ( " Additional Default Remedies Act '' ) and Act 814 ( " Notice of Repossession '' ) permit a " secured party '' or " a lessor '' to take possession of collateral without judicial process provided : 1. ) the Security Agreement, or lease, contains the following specific wording : " Louisiana law permits repossession of motor vehicles without judicial process '', 2. ) prior to taking possession, a notice of intent is sent to all debtors, in writing, containing the specific wording : " Louisiana law permits repossession of motor vehicles without further notice or judicial process '', 3. ) a " payment '' default exceeding 30 days ( monthly installment contracts ) or 60 days ( weekly or bi-weekly contracts ) I never received a notice letter of intent. Because I was not 30 days behind. Nor can Go Financial show where I was 30 days behind. In addition, after the vehicle was taken, I contacted Go Financial. They gave me the recovery company info. After speaking with them, they asked if I would mind if I could meet up with the driver to sign a self-help vehicle surrender form which obviously needed to be signed beforehand. I am also in the process of filing a suit because I have lost a significant contract with a client worth $ XXXX. Lastly, I am requesting correspondence via email.

I recorded the conversation with the lady that told me i can pay half and they will give me time next thing i know the repo man was knocking on my door coming to my job i was leaving the doctors appointment getting my check up from whre i had XXXX and i even explain to him showed him that i had the money to get caught up on my payments and he said well please called them and try to work something out i want take the car this time the next day after speaking with again trying to work something out they wanted me to come up with XXXX in 24 hours thats the only way i was able to keep the car and then i try reaching out to this company they tell me sorry its under new management they dont see my account but still reporting it to the agency

I had purchased a auto from at the time a company called go financial I took possession of the car XX/XX/XXXX the car was repossessed on may XXXX. These company during the process was very deceptive with the terms i have been disputing this auto with Go financial since XXXX they refuse to remove the item from my consumer reports which is illegal. If you check my reports now they have my car being taken repossessed in XX/XX/XXXX, but XX/XX/XXXX the company list the car as charge off. They never shared any information with my after car was sent to be sold. The company now is bridgecrest. This company is violating many of my rights as a consumer, and has stopped me from being able to have a fair consumer report. Before the repo i had a deferment with company, and still was repossessed the abusive practices that were used during the duration of our consumer credit transaction are illegal to share my information with other consumer reporting agencies is in infringement of my privacy. I am so upset as a consumer to know that these practices actually take place everyday with hard working consumers i demand that this company takes action immediately and remove this auto from report. I am the original creditor that extended the credit to this corporation to make this process possible there are many federal laws that i was use to make sure that justice is served pursuant to 15 usc 1681a ( 2 ) ( b ) any authorization or approval of a specific extension of credit directly or indirectly by the issuer of a credit card or similar device " should be excluded from all consumer reports. My Credit card as a consumer is my social security number that i used to make this transaction. I demand that this company remove this account from my account, and compensate me for the violations. for violating my privacy, and most important for the unethical practices.

I was coming home earlier this month maybe around the XX/XX/XXXX or XX/XX/XXXXand was greeted at my garage door by a repo man. He stated that he was here to take my car. I told him I paid my payment on XX/XX/XXXX and that I did n't have another payment due until XX/XX/XXXX. He stated that he had been instructed to pick up my vehicle and that he would be calling the cops if I did n't give it to him. I told him to call the Police and we could wait together. I asked him to leave my property ( he was in my garage ) and he declined. I advised that I would be calling the cops if he did n't get off my property. The man got in his truck and sat on the side of my house for about 15mins. The Police that he claimed to have called never showed up. The next morning, I called Go Financial they stated that they had been instructed by XXXX not to accept my payments. I was confused because XXXX is a dealership and Go Financial is my finance company. Go Financial told me I would need to speak to XXXX and I was then transferred. XXXX stated that there was a problem with the payment for downpayment. I advised them that due to death in my family there was an oversight. I offered to pay and they declined. They told me I could n't make any sort of a payment on the account with Go Financial. I asked for a supervisor and was told the same. I called back on XX/XX/XXXX and asked for a supervisor and asked if I could make the payment. I re-explained the situation and was told no. I asked them why they were forcing me into default and they stated that they would need my van. I told them I have worked hard on my credit and I did n't want a repo and that I would like to pay. They declined again. To date they still will not accept my payment and they are forcing me into default. I am willing and capable of making payment but they will not take it.

I have a car loan with GO Financial, which I had set up on auto pay. I paid my bill early using their XXXX service. The transaction went fine and my card was debited the correct amount. Upon returning to my account page, it told me the payment succeeded and that my account wo n't be charged again until XX/XX/XXXX. This morning, I find that is not the truth. They debited my checking account for the car payment a second time. You can see on my account page that this is the case. I called this morning to let them know they had billed me a second time and to ask they refund the second payment. The gentleman on the phone acknowledged he saw the two payments. He offered to apply the second payment to XXXX or as an additional payment. I told him that I wanted it refunded to me. I was then told that it would take three weeks to process my refund. When I asked for a tracking number, I was placed on hold for nearly ten minutes. The agent came back on the line now saying that I needed to provide bank statements showing that the payment had been debited, and would not give me a tracking number for my refund request. I asked to speak to the supervisor, and she told me that I needed to prove the money was debited from my account -- even though their website clearly shows both transactions.

I bought a car from XXXX, and GoFinancial is the lender. I received delivery of the car in XXXX 2015, got plates and had no problem with the car. XX/XX/2015 I moved to XXXX from XXXX. I went to the DMV and filled out the necessary paperwork to have my license plate transferred. To have the plates transferred GoFinancial must send proof of title to the State of XXXX. XXXX will not accept electronic proof of title. GoFinancial has failed to provide proof of title to the state of XXXX for a year now. I am paying for a car that I can not drive, because I can not get a license plate for it. I have been working with the title department of GoFinancial for about the last 6 months. When I call they tell me they have to order a copy of the title from the bank, and that that takes a few weeks. I say ok and wait. When I call back they never have any record of ordering the title. The last time I talked to them they told me the tile " appears to have been lost ''. I have asked them to take the car back and they told me that would negatively effect my credit and I would be responsible for any negative equity the car may have. This has become a rather urgent matter. The responses from Go Financial have been most unacceptable and attempts to simply blow me off or to minimize this serious personal credit impacting issue. I notified them many, many, many times that the vehicle that I purchased was a lemmon. It was not only unsafe to operate, but I was completely ripped off on the predatory interest rate. I was PROMISED that they were " working on it ''. Rather, while I was led to believe that they were working to find solutions to re-capitalize the loan, adjust the rate to a fair and reasonable rate. Go Financial authorized a fraudulent loan in my name from a XXXX XXXX which at the time was my ex husband. I disputed the information with all three credit bureaus about this creditor on my credit report. I wanted to trade my car in with XXXX. They gave me an offer, but later called me to inform me that they did not have a warehouse in XXXX yet, and I would have to trade it with someone else. They assured me ( on the phone ) that I could refinance my loan with their loan servicer after I put down the large payment from my trade-in and make a few payments. I got a car with a loan from GoFinancial in 2016 for about 16,000 roughly, and ended up surrendering the car a few months later because the transmission was going out. It seemed smooth, I signed a document that said I would n't pay anything if it sold for less than what I owed at the auction and that I would get money if someone bought it for more than I had left to pay. Thought it was all good an clear then I look on my credit report and its on both and its also on my husbands saying we owed 5,000 roughly so I call GoFinancial with the paper I had signed and they are telling me its invalid and they cant help me, so then I try to report a dispute with both of the credit bureaus and they do nothing as well. I entered into a car loan with GoFinancial and was never provided with any information about how they processed payments. I made my first payment over the phone and was give the option to pay using my credit card for a nominal fee ( I think it was {$4.00} ) which I agreed to. After processing the payment I looked at my credit card statement and GoFinancial had submitted the payment through XXXX XXXX and my credit card company had processed the charge as a cash advance charging me a {$15.00} fee and daily interest on the amount of the charge. I recently received an auto loan from subprime lender GoFinancial XX/XX/XXXX. I wish to make a formal compliant against this finance company that I previously got a loan for XXXX years ago. I have be struggling with this loan company and they just don't want to help me. I have been making payments as I can and I check before my car was repossessed just recently I was just 30 days past due. Normally I would get a letter in the mail stating to pay by such an such date other wise we can legally or something take the property. I was told by a GoFinanical rep at the company that by law only 5 late payments can be removed and that they would be removed & that hasn't taken place.
