On XX/XX/XXXX, an FHA Insured house that was sold in a Pre Foreclosure Sale accepted by GMFS Mortgage Company. The house was sold " as-is '' due to Surchargeable flood damage as defined by FHA. Although the legal closing disclosure used by the closing agent, Attorney XXXX XXXX. is a HUD-1 Settlement Statement, flood insurance claim funds in the amount of {$81000.00} that were being held in a restricted escrow account for the borrowers were not disclosed on this document. However, the mortgage company has claimed to apply those funds to eliminate outstanding debt after the application of the PFS sales proceeds which legally satisfy all outstanding debt if full. Although my initial attempts to deal with this issue with the mortgage company focused on FHA Non-compliance for how they justified keeping the funds towards indebtedness that legally no longer exists, I now recognize how not having this transaction disclosed on the HUD-1 Settlement Statement is the key issue that keeps the money hidden from FHA compliance reviews. The concern for fraud is further increased as this also creates the appearance of us corroborating the absence of the money by signing the settle statement to the best of our knowledge as well as if we had accepted their multiple attempts to convince us that we voluntarily agreed to forfeit or relinquish the funds although we knowingly did not and have maintained our efforts for since XX/XX/XXXX to have the {$81000.00} that is rightfully ours released to us. In addition to this non-compliance of closing disclosure in our PFS, there are several other concerns we have come to understand through further research of the FHA Handbook that are not compliant with FHA or other federal policies including : 1 ) inaccurate figures on our 1098 and 1099-C federal tax documents that have complicated the timely filing of our XXXX income taxes because the mortgage company has claimed they would only address the issues with " qualified '' written requests as if my previous phone calls and emails to them did not warrant their attention to the matter of potential errors on federal tax documents that they prepared. 2 ) unnecessary delay in our initial application for mortgage relief options that originally began XX/XX/XXXX under a previous servicer and which we believe has been intentionally muddled given our situation of both the financial hardship due to reduction of income that began in XX/XX/XXXX and the natural disaster hardship that subsequently occurred XX/XX/XXXX. 3 ) confusion regarding necessary measures to protect the mortgagees interest in the property or prevent insurance fraud by homeowners after the flood that did not contradict their FHA required assistance to help borrowers recover from disasters as their responsibility for Surchargeable damage to properties in the case of defaults. 4 ) the wrongful filing of a foreclosure lawsuit in XX/XX/XXXX and initiation of Sheriffs seizure and sale although we had accepted the contingent approval to participate in a PFS and engaged a real estate agent on XX/XX/XXXX which we were told would pause and/or prevent further foreclosure activities ; as well as a motion to appoint curator to locate and notify us of legal foreclosure action on XX/XX/XXXX although we were in ongoing contact with the mortgage company for the current PFS. The additional steps I have taken the resolve this issue since XX/XX/XXXX include : 1 ) Phone and email correspondence with GMFS executives and multiple and repeated phone transfers between departments of XXXX XXXX XXXX such as Executive Services, Customer Service, Loss Draft, Loss Mitigation, Retention, Short Sale, Short Sale Liquidation, High Risk Resolution, Consumer Escalations, and Customer Resolution. 2 ) A complaint filed with the Louisiana Office of Financial Institutions on XX/XX/XXXX who concluded that the have to defer final determination of FHA compliance to the HUD OIG ; although they simultaneously stated an opinion in agreement with GMFS 's justification that could presumably deflate the confidence of our complaint for non-compliance on GMFS 's part. 3 ) Calls to the HUD National Servicing Center ( on XX/XX/XXXX and again on XX/XX/XXXX ) as well as the FHA Resource Center ( on XX/XX/XXXX ). I then submitted a hotline report for suspected fraud with the HUD OIG on XX/XX/XXXX which was given a ticket # XXXX. HUD has not concluded whether or not GMFS was non-compliant in this matter although I was advised that a different agency would have to handle the matter including either FEMA because they issued the flood insurance funds ( although FHA Handbook policies determine how a mortgage handles insurance funds regardless of the insurance company or agency ) and the CFPB because RESPA covers the escrow matter ( although this is not the closing disclosure/servicing of an escrow account to pay taxes or insurance premiums from ongoing mortgage payments but it is the dispute over the application of insurance funds held in escrow according to FHA policies after a PFS closing pays the account in full ). 4 ) Inquiries to the closing agent about this matter including : ( a ) the day of the closing when I expressing confusion and frustration with the mortgage company handling the funds although to the best of my knowledge, I did not know they should have been disclosed on the settlement statement ; ( b ) emails in XX/XX/XXXX seeking advice and clarification of their representation of our interest in possible civil litigation or criminal investigation of the mortgage company ; ( c ) follow-up on the public filing of legal documents regarding the cancellation of the mortgage and a motion by GMFSs attorneys to withdraw the foreclosure and sheriff sale seizure ; and ( d ) a direct inquiry to address the inaccurate HUD-1 Settlement Statement approved by his office that does not disclose the transaction of the mortgage company applying held insurance funds to debt that no longer legally exists by the terms of the PFS paying it in full. 5 ) On XX/XX/XXXX, I submitted a follow-up hotline report to the HUD OIG with clarification and emphasis on the non-compliant HUD-1 Settlement Statement as the alleged fraudulent document that enables the mortgage company to possibly hide its action from a HUD compliance review of our FHA mortgage. Having heard no response as of XX/XX/XXXX, I have prepared this complaint to the CFPB.

In two previous complaints to the CFPB on XX/XX/XXXX and XX/XX/XXXX, GMFS has avoided directly addressing specific matters of FHA/HUD handbook policies and credit reporting practices related to our concern for disaster fraud involved in the Pre-Forclosure Sale of our house on XX/XX/XXXX, and as reported to the National Center for Disaster Fraud on XX/XX/XXXX. As we explained to the NCDF concerning FHA policies : " GMFS has claimed a right according to its typical policies for conventional loans to apply the funds towards an unsatisfied balance not covered by the proceeds of the PFS ; however, that is not compliant with FHA policies for an FHA insured loan. Although our home was purchased in XX/XX/XXXX through an FHA program, GMFS initially refused to acknowledge that FHA policies supersede any other policies that are otherwise legal and valid according to state or federal laws, and specifically more stringent than typical laws for conventional loans in order to protect the publics interests in government subsidized and/or administered programs. They have since only acknowledged the FHA policy that states the mortgage company must deduct the cost of Sur-chargeable damage from a PFS mortgage insurance claim to mitigate their losses. However, this policy does not state the mortgagee has a right to directly seize money from a borrower that other FHA policies state are rightfully owed to the borrower. This is vigilante justice by the mortgage company if they circumvent due process and litigation against us to demonstrate a civil liability or criminal conduct entitling them to recoup damages from us in this situation, especially given the burden imposed by the FHA policies as well as the inconvenient facts of their role in intentionally or unintentionally contributing to their own financial losses in this matter that they seek to attribute to the borrower. '' Futhermore, GMFS has most recently avoided addressing their credit reporting practices in our complaint of credit reporting errors concerning the use of forbearances after a flood disaster in XX/XX/XXXX and after our initial application for homeowners assistance according to FHA loss mitigation policies in XX/XX/XXXX. As noted in our CFPB complaint : " In following the payment history as reported by GMFS and its sub-servicers, many items after XX/XX/XXXX do not align with the facts that : ( 1 ) we had a loss of income financial hardship beginning XX/XX/XXXX causing the first 30 day Past Due in XX/XX/XXXX ; ( 2 ) then had the flood disaster on XX/XX/XXXX after which we agreed to two different three-month disaster forbearances from XX/XX/XXXX to XX/XX/XXXX ; and ( 3 ) ultimately made our initial application for a homeowner assistance program to avoid foreclosure on XX/XX/XXXX. Given much of the confusion that was created for this application process by GMFS, XXXX, and XXXX, it is concerning to see that they reported no data for 10 months and 180 days Past Due for 5 months for the time between XX/XX/XXXX and XX/XX/XXXX during which we were told the application for the loss mitigation process had to be delayed or restarted. '' Given that history as reported to credit bureaus, a change in servicing company in XX/XX/XXXX is even more concerning for disaster fraud cover up and delay tactics, even if the change in servicing companies was properly done according to applicable laws and credit reporting practices such as a federal requirement to pause reporting 60 days.

Based on the credit reports for XXXX XXXX XXXX from XX/XX/XXXX, the mortgage company GMFS has reported our FHA loan as two different entries creating the appearance of two past due mortgages and double negative impact on our credit scores and worthiness. Furthermore, monthly status reports made for each align with other questionable and possibly fraudulent events concerning non-compliance with HUD policies that we have taken several steps to address with this company including a complaint to the CFPB on XX/XX/XXXX and my latest report of disaster fraud to the National Center for Disaster Fraud on XX/XX/XXXX. All three of our credit reports show two mortgage accounts opening in XX/XX/XXXX, with one for GMFS , LLC ( Acct. no. XXXX ) and the other with some combination of XXXX XXXX XXXX ( XXXX ) and GMFS ( Acct. no. XXXX ) including " XXXX/GMFS '' ( XXXX ), " XXXX/GMFS, LLC '' ( XXXX ), or " GMFS SVCD BY XXXX XXXX XXXX '' ( XXXX ). However, the payment history status on all three reports for Acct. XXXX covers XX/XX/XXXX to XX/XX/XXXX while Acct. XXXX only covers XX/XX/XXXX to the PFS pay-off in XX/XX/XXXX. All three reports also indicate Acct. XXXX was closed, transferred, or sold in XX/XX/XXXX. However, we were told XXXX just has a new sub-servicing company, XXXX, to replace its previous company, XXXX. As we do not believe a change in sub-servicing companies by a mortgage company requires reporting a new credit account to reporting agencies, we are concerned that such an error was yet another move in the attempt to cover up the non-compliance matters involved in improperly keeping funds to which the mortgage company is not legally entitled. In following the payment history as reported by GMFS and its sub-servicers, many items after XX/XX/XXXX do not align with the facts that : ( 1 ) we had a loss of income financial hardship beginning XX/XX/XXXX causing the first 30 day Past Due in XX/XX/XXXX ; ( 2 ) then had the flood disaster on XX/XX/XXXX after which we agreed to two different three-month disaster forbearances from XX/XX/XXXX to XX/XX/XXXX ; and ( 3 ) ultimately made our initial application for a homeowner assistance program to avoid foreclosure on XX/XX/XXXX. Given much of the confusion that was created for this application process by GMFS, XXXX, and XXXX, it is concerning to see that they reported no data for 10 months and 180 days Past Due for 5 months for the time between XX/XX/XXXX and XX/XX/XXXX during which we were told the application for the loss mitigation process had to be delayed or restarted. We also do not understand how XXXX begins servicing with 3 months of no data reported and then 180 days past due through the PFS in XX/XX/XXXX. As we have now learned how the servicing of FHA loans should have occurred, we also see how not reporting data and misrepresenting a change in sub-servicer on our credit report would allow the mortgage company more time to exploit our situation and muddle the HUD review process for compliance.

We have refinanced out loan ( # XXXX ) leaving GMFS on XX/XX/2017 ( funded on XX/XX/2017 ). Since then we continue to get the run-around regarding the refund of our escrow account from the prior mortgage company - GMFS. An example of this is them telling us 1 ) your loan was sold to another company XXXX ... after we chased that rabbit trail we discovered this was not true, 2 ) you owe us a balance to replenish your negative escrow account, 3 ) looks like we owe you about {$200.00}, 4 ) the notes show that we paid your taxes to XXXX twice and now we have to wait 15 days for it to be refunded ( {$2600.00} ) ... ound and round we 've gone with misinformation being provided. No one calls us back when they say they will. No one can provide us with a statement or summary of our Escrows. Additionally, we 're disputing the payoff that was generated on XXXX for our refinance. They claim an initial loan balance of {$580000.00} + interest thru XX/XX/XXXX of {$6600.00} ( our P & I payment is only ~ $ 3k, thus this clearly does not account for our payment made on XX/XX/XXXX for {$4300.00} ), but they wo n't acknowledge this + advance {$2600.00} ( pmt made to cty for taxes that were not due ) + a few misc fees = total payoff of {$590000.00}. They wo n't acknowledge that our payment was n't applied appropriately and thus they owe us that payment back for {$4300.00}. The most frustrating piece of the whole situation is we ca n't speak with anyone that has any information. We are only allowed to speak to Cust Service, who then sends an email to the " Client Management Dept '' who apparently wield all the knowledge and information. They will respond to our request by sending and email back to Cust Service who will then reach back out to us. However, we have been calling almost daily for nearly 2 weeks and have yet to receive a call back. Then today during our call, the Cust Service Supervisor advised that she had to provide them 48 hours and therefore we likely would n't receive a response back until XXXX, but " probably XXXX ''. Today is XXXX. XX/XX/XXXX. Unfortunately, because we are continuously receiving misinformation, we 're not getting return calls as promised, we 're not able to speak directly with anyone who can provide us with accurate information, and their not able to acknowledge the amount owed to us or provide us a timeline on when we will receive our money, we feel it necessary to file a complaint with the CFBP. Please help us advance movement on this, so we can get a resolution and move on.

I am a XXXX XXXX ( XXXX ) that was affected by the government shutdown from XX/XX/XXXX-XX/XX/XXXX. On XX/XX/XXXX I contacted my mortgage company, GMFS servicing loans to inquire about any forbearance options that they may be offering federal employees because I didn't have the resources at that time to pay XXXX mortgage. I figured that I was still within 30 days before any negative reporting to the credit bureau so let me call to see what options I may have. The representative informed me that they are offering a 3 month payment plan for XXXX XXXX. She went on to inform me that due to it being a Friday, my forbearance would be processed on XX/XX/XXXX. So on XX/XX/XXXX the mortgage company called me seeking payment. I explained to him that I should be in forbearance. He looked through the system and confirmed that he saw that I was in forbearance. On XX/XX/XXXX XXXX 's delinquency hit my credit report. At this point I am livid because I spoke with two reps who assured me that I was in forbearance until the end of XX/XX/XXXX. So I called GMFS on XX/XX/XXXX and the case worker stated " Oh yea you need to write us a letter indicating the amount that you agree to pay and sign and date it ''. This was the first time I ever heard of that. Had the representative on XX/XX/XXXX and XX/XX/XXXX informed me of this, I would have taken care of that. To summarize my issue, there were several occasions that the company failed to provide accurate information. The information provided was misleading and misinforming, but I am the only one that is being affected by their errors. I contacted GMFS escalation dept. on XX/XX/XXXX and explained the issue. He stated that he will pull the call and if the rep did provide inaccurate information he will have the negative credit reporting reversed. He informed me that he would contact me within 48 business hours. It is now about 55 business hours and I still haven't received a call. If you are able to review my credit reports you can see that this is the only company I have had issues with. I have a car loan, unsecured loan, student loans, and several credit cards and none of these accounts have ever reported me as being late/delinquent. Prior to this issue, my credit score was around XXXX. Since then it has dropped to XXXX. I am requesting that the XXXX delinquency be reversed and any months following until the forbearance/90 day payment plan is over.

My husband got a VA loan with GMFS Lending. My husband is self employed and had a big decline in his income. We contacted GMFS immediately and they sent us a packet to be completed and sent back with documents that they requested. We did exactly what we were told. Within 30 days we received a letter stating that we were missing documents that we had proof was faxed. So we resend the missing documents and called to see if they have received them. We were told that it takes 2 days for the information to be uploaded into the system. When we would call back in 2 days were told that all documents were received and was headed to the underwriter putting foreclosure on hold. Later we received a letter denial stating that my husband did not have enough money to afford the home. Evidently we did not fill out the packet correctly so we had to start the process all over again. We have been play this game since XX/XX/XXXX and finally we were served foreclosure papers and a sale date of XX/XX/XXXX We were shocked because we were under the impression that our paper work was under review. On XX/XX/XXXX I called GMFS and spoke to XXXX ID # XXXX to inquire about what was going on. At that time XXXX informed us that he did not see a sale date or any papers for foreclosure. but he will send an email to loss mitigation inquiring about our modification. When we did not hear anything from GMFS we called again. Again we were told that they did not see a sale date. I explained to them that I was holding the papers in my hands, we were served. We were told to disregard that because their computer does not show that any papers were served or a sale date. We have been calling GMFS every 2 days or so to check the status and was told that our paperwork was received but they did not know why it has not been sent to the underwriter. We were told to call back in 2 days. We called back and was told the same thing and that they were going to escalate to management. We called back in 2 more days and was told the same thing. Today is XX/XX/XXXX my husband called GMFS and was told that the paper work was not sent to the underwriter and did not know why but they were going to escalate it to another manager to call back in 2 days. We have been playing this game too long. We are not looking to live here for free we want this resolved so we can sleep at night.

On Friday, XX/XX/XXXX, I emailed my mortgagor ( GMFS ) because, without written notification, escrow analysis or warning, I was told verbally over the phone that my mortgage was increasing by $ XXXX month. Five days later, I still hadn't received a response. I resubmitted my question, and received an email from GMFS telling me to call the servicer, who I had already had spoken with over the phone, and who couldn't provide me with any additional information as to the increased mortgage amount. My mortgage is now due in one week, and I still haven't received updated information or an escrow analysis. I've included the contents of the email in its entirety below. On Fri, XX/XX/2018 at XXXXXXXX XXXX, XXXX XXXX XXXX wrote to XXXX : Yesterday I received a call from a representative who said he was from GMFS. It turned out that he was actually employed with XXXX XXXX XXXX. During our call, which was to notify me of a change in servicers, the representative mentioned that my next payment should be made to their company, and listed an amount that is {$500.00} above what I am currently paying ( and which is due in less than two weeks ). 1 ) Please send me an escrow analysis immediately. 2 ) Please provide for me in writing information as to whether GMFS is affiliated with XXXX XXXX XXXX, beyond the contractual agreement of servicer and mortgagor. 3 ) Finally, if the updated loan statement amount shared by the representative during our call is accurate, I want to apprise you that I plan to file a complaint with the CFPB. This payment is less than two weeks out from due, and I have yet to receive a loan statement, escrow analysis, or any other information providing me with adequate notification of a pending significant increase, or the nature of the increase. I realize that Federal law bars late fees during the 60 day period following the effective date of transfer, but the complete lack of notification of such an increase is inexcusable and creates significant hardship on the homeowners that GMFS serves. On XX/XX/2019 at XXXX. I submitted a request to change the checking account that I use for ACH for my FHA mortgage that is being serviced by GMFS. The conformation that I received stated that the change would go in to effect on XX/XX/2019, Since I was told the change wouldn't not go through until XXXX, I made the XXXX payment manually to avoid being late on my mortgage. On XX/XX/2019 both the manual payment I made, and the ACH that wasn't suppose to begin until XXXX, posted to my checking account. I called GMFS immediately, and they informed me that there was nothing they could do, although they could see from their records why the double payment occurred. I was told that a supervisor would contact me by end of the work day. After not receiving the promised follow up call, I called them again, and again I was told that the supervisor was " busy '' and to prevent the issue from going any further they would cancel any future ACH withdrawals for my account, and make my next due date XX/XX/2019. This would have corrected the issue, so I took no further action. Today XX/XX/2019 another charge was taken from my checking account, despite being told that all transactions of this sort would be canceled. I again immediately called GMFS, and they told me that there was no record of the ACH being canceled, and there was nothing further they could do for me, other than cancel future ACH transfers from being taken out. So, on two separate occasions GMFS erroneously withdrew a payment from my account. Both times I was told there was little to nothing they could do. Their errors are putting unnecessary strain on me financially. Its sad that a company that a company that we are suppose to trust with servicing our mortgage cant take proper action to rectify this situation that was only caused by their own incompetence.

My wife and myself prequalified for a mortgage to buy a second home and/or a real estate investment property. We were prequalified by the following company ; XXXX XXXX XXXX XXXX XXXX XXXX, XXXX XXXX XXXX, LA XXXX XXXX XXXX XXXX Direct XXXX Cell XXXX Toll Free We made an offer on a condominium thru a local real estate company. A closing date was set but issues with the offer caused us to withdraw our offer and we did not go to closing nor did we sign any closing documents. From what we have been told XXXX XXXX XXXX sold our would-be mortgage to the following company ; XXXX XXXX XXXX XXXX XXXX, XXXX XXXX XXXX XXXX, LA XXXX XXXX XXXX XXXX Direct Note that we never went to closing and never signed any closing documents. Sometime around XXXX XXXX, 2017 we received notification that a new account had been added to our credit report. Further research found the credit bureaus showed we had opened a mortgage with XXXX XXXX for the condominium we never closed on and we owed {$100000.00} for the loan. Then last week we received a letter from GMFS that we had not provided insurance for the property and that GMFS would purchase insurance for us and charge us accordingly. At the same time our Credit history shows this load and lowered our credit score negatively impacting our personal finances. We have been in contact with Entrafund and GMFS trying to get it cleared up on our credit reporting but to date nothing has been done. Between identity theft and mortgage fraud someone in this chain of events has violated a FCC law and should be held accountable. GMFS should not be able to open a mortgage loan without our consent. Please advise.

After working unsuccessfully with my mortgage company, GMFS, to resolve an unexpected increase on my monthly bill, I filed a complaint with the CFPB. The response from the Chief Compliance Officer at GMFS was inaccurate. When I called SXXXX XXXX XXXX, the GMFS partner servicing my loan, to try and resolve the issue that way, I was provided with more completely inaccurate information. 1 ) In the attached response from GMFS Chief Compliance Officer, a monthly increase of {$270.00} is noted. The actual monthly increase is {$470.00}. The previous monthly billing statements were for {$1200.00}. The attached billing statement provided to me via CFPB complaint response is for {$1700.00}. Further, when I called XXXX XXXX XXXX to inquire, today they told me over the phone that my XX/XX/XXXX statement is for {$1200.00}. 2 ) My local property taxes have increased by {$1000.00} annually. Even with a XX/XX/XXXX escrow shortfall of {$600.00} and XX/XX/XXXX escrow projections to account for the {$1000.00} increase, that should not equal {$470.00} per month for 12 months. 3 ) The attached CFPB complaint response letter shows an increase in my mortgage insurance. I have repeatedly requested -- in writing and via telephone -- for documentation from GMFS and XXXX XXXX XXXX showing why mortgage insurance is required. This loan closed previous toXX/XX/XXXX I have greater than 22 % equity in my home, and all payments have been made on time. I do not believe GMFS should be charging me mortgage insurance at all, and would definitely want documentation to substantiate an increase.

I received a call from my home owners insurance that my premium was not paid as of XXXX XXXX, XXXX. I called my GMFS to convey the need to pay the premium that was due on XXXX XXXX, XXXX. GMFS said that is was mailed out to be paid. Three days later, the insurance called me again and said no funds/check was received. I call GMFS back and they said they paid it to my XXXX XXXX ( XXXX insurance company ). I contacted XXXX and they said because I no longer have an account with them, the check will be sent back to GMFS. I call GMFS back and disclosed that information. Asked if they can cancel the check and reissue another XXXX to the proper insurance company. They said no they could not. So GMFS rep said he was going to make some calls to locate the check. On XXXX XXXX, XXXX I paid my mortgage and realize the insurance was not paid. The due amount was over XXXX and my mortgage is only XXXX. I paid the amount due still not knowing what happened to the escrow funds for this purpose. I called again to for more clarification on XXXX XXXX, XXXX and still no lead way on the escrow. Fortunately it was paid because XXXX suffered a major tornado storm on Tuesday XXXX XXXX, XXXX. I called today ( XXXX XXXX, XXXX ) to speak with the supervisor because no one knows where the escrow funds are and my account is out over XXXX dollars. The manager XXXX XXXX approach was unprofessional,. rude and a brush off. He said he was going to look into it and call me back in 24 hours. I have been waiting already almost two weeks. Today

XX/XX/XXXX-Letter sent requesting PMI coverage cancelation. XX/XX/XXXX-Response saying my loan didn't qualify due to LTV ratio and length of loan, but I could pay {$4600.00} to reach my qualifying LTV and they would cancel. As of XX/XX/XXXX, I started paying additional principal to reach LTV. I paid approximately {$10000.00} in principal for XX/XX/XXXX and XX/XX/XXXX, in excess of {$20000.00} and well above the {$4600.00} they said I needed to pay. XX/XX/XXXX-XXXX to XXXX at customer care to confirm that my PMI would be canceled XX/XX/XXXX as specified in my PMI disclosure form from my closing on XX/XX/XXXX. He said I can send a letter requesting this even though the disclosure states it will automatically terminate. He states that my LTV is above 80 %. XX/XX/XXXX-Spoke with XXXX ( not a supervisor as I requested ) She states that my LTV is at 74.61 % and the PMI should be canceled but I need to send a letter. XX/XX/XXXX- Spoke with XXXX and he insisted I have to send a letter and pay for an appraisal since I've paid extra principal!! He confirmed that my LTV ratio is at 74.61 %. I have sent numerous letters and I have a PMI disclosure document that states it will be automatically terminated onXX/XX/XXXX as long as we are current on payments ... .we 've NEVER been late and we have excellent credit, scores are in the 800 's.

Me and my family flooded XXXX of 2016 in Louisiana. Me and wife started contacting our lenders to see if we could defer some of our payments to the end of our loans since we did n't have floor insurance and most of the expenses was going to come out our pockets. My mortgage company was glad to help with and promising us the payments that we missed would be put on the back of the loan. After one year later and three sets of paper work we had to send in and countless phone calls we finally got our modification paper. XXXX XXXX dollars and two years was added to the loan. When I question them about the add the balance they could only give me assumptions of where the add was coming from and denied me the paper work showing the add. If I would have known the headache and the fact of not knowing I was going to lose our home that we are raising our XXXX children in. Do n't trust GMFS mortgage company or XXXX. After losing all my belongings I was thinking I was going to lose my house too. We thought at the time that it was a blessing but turned into a nightmare.

THIS IS A PROBLEM WITH XXXX XXXX XXXX XXXX. My loan was made and closed in XXXX with the first payment due on XX/XX/XXXX. I made this payment and then the loan was sold to XXXXXXXX XXXX for servicing. I paid the payments to XXXX electronically until XX/XX/XXXX. At this time, the loan was sold again. This time to GMFS. During the transfer to GMFS, a payment was credited to XXXX in XX/XX/XXXX, but did not catch up in the transfer process. GMFS asked for the proof the payments were made and this information ( Bank Statements showing the withdrawals ) for every payment on the account was provided on XX/XX/XXXX. Today, XX/XX/XXXX, I was told they are still researching the missing payment and will not correct any negative credit reporting until they complete their research. I feel like this is a very simple fix and GMFS has not and is not doing its due diligence to protect the integrity of the consumer. GMFS provides the absolute WORST Customer service of any servicing provider I have dealt with in over 40 years.

I had been sending weekly payments to the mortgage company which basically were one quarter of the monthly payment. The mortgage company accepted these for many months, reconciling at the end of each month and applying the funds to the mortgage. This last month they started to send the checks back and requesting a full payment. I would deposit the check and then re-schedule the payment again. After receiving all these payments and returning them, they sent a past due notice with finance charges. Today I receive a notice that they will take action to collect a debt. All the while receiving and returning my funds. 1. They are violating the law regarding no penalty for prepayment, since my weekly payments added up to an amount greater then my monthly payment and 2 ) I am being singled out by someone internally who wants to make a point. Actions to collect funds should be sent to those who default, not a citizen who has been making payments that were previusly accepted to this point.

Due to the circumstances that are fairly attributed to the actions of GMFS in a XX/XX/2018 Pre-Foreclosure Sale, we were legally entitled to {$81000.00} in insurance proceeds according to FHA Handbook guidelines. Furthermore, GMFS was left ineligible for mortgage insurance claims with the FHA to mitigate their losses on a damaged house. Therefore, we believe GMFS engaged in fraudulent means to circumvent compliance with FHA/HUD policies and accurate reporting to credit bureaus in order to recoup their losses with disaster related insurance funds by not releasing those fund to us. If GMFS was justly entitled to those funds due to our fault in the matter, there would be no need to avoid the transparency of due process through legal action against us to recoup the funds after releasing the funds to us to be in compliance with FHA/HUD policies, and even avoid committing disaster related fraud.

My home was flooded last XXXX 2016. I contacted my mortgage company - GMFS - and asked if I could get a deferment on my loan payment. They told me that they would give me 3 months ( XXXX, XXXX, XXXX ) where I would not have to make a payment and my next payment would be due on XXXX/XXXX/2016. They said that those 3 months would be tacked to the end of my mortgage. I received a letter from GMFS recently where they stated that I owe them payments for XXXX, XXXX, and XXXX 2016 plus my payment for XXXX 2016 totaling {$4900.00} and that this payment was due now. They threatened foreclosure so I paid the amount they asked for. I believe this to be wrong on their part but I paid the money to keep my home. If they had told me this up front I would have just continued to make my regular payments. I truly believe they lied to me or that their company representatives are grossly incompetent.

I have 2 mortgages with GMFS. I have had one mortgage for nearly 4 years. My bank allows me to pay bills through their site, and I paid my mortgage with the same address for years. My bank and mortgage company are different companies. Last month, GMFS notified me that my loan has been purchased by XXXX XXXX XXXX but its still GMFS. The lender has not technically changed. But they failed to receive my payment that I had sent to the same address for GMFS for years. So, I changed the address. Now my payments have been returned because its not made to XXXX XXXX XXXX but its coming from a GMFS letterhead. Its still GMFS. Its not like I was sending payments to XXXX or XXXX XXXX This is ridiculous. I believe its deceptive banking which causes unnecessary confusion to cause customers like myself who have paid on time every time to incur expenses. This needs to be investigated.

Please help! My home was sold in a foreclosure auction on XXXX XXXX,, 2016. We were notified on the day after XXXX XXXX by the person whom purchased our home from the investor. My husband and I were not notified that our home was in the foreclosure process. The Mortgage company stated on XXXX XXXX that we were 9 months behind on our mortgage payment. We mailed them via Money order and currently having them tracked down to find out where they were cashed or if they were just lost in the mail. However the mortgage company also stated that they sent certified letters notifying us. However, we do not have any of them either. XXXX My 1st question is does the mortgage company or the trustee have to post the auction in a PUBLIC newspaper? as well as the home owner to be notified ( served ) paperwork prior to the sale. GMFS contacted me by phone offering a forbearance as a " courtesy '' on XXXX/XXXX/16 They gave false information about the terms of the forbearance. They stated that a 3 month forbearance would be made up at the end of the 30 year loan. that the loan would change from 30 year duration, to 30 years and 3 months. They also stated that my credit score would not be affected, there would be no delinquency issues, including late fees or interest fees. When the 3 month period was almost over, I contacted them and they stated that the previous information given on XXXX/XXXX/16 was not true, and that all 3 monthly payments were now due at one time, on top of my XXXX payment. These practices are unethical, untruthful, and disgraceful and the company should be held accountable by offering restoration and reversing the damage that they have caused.

I had set up a recurring payment from my bank to my mortgage processor, GMFS, who subsqeuently changed the amount of payment required. While continuing to accept and cash my checks, they stopped crediting my payments to my account because they were " short payments '' and they " ca n't accept '' short payments. Though they claimed to have sent me letters and called me, no calls were received, and no letters to the effect that payments were short, were received. When I called to follow up, I asked if they had been calling, they claimed that they had been ( to my cell phone number, none of which were ever received ), and they had been in in fact, calling an erroneous number XXXX. I also logged into their account management interface several times and was never alerted to any problems with my account during this period.

GMFS issued XXXX separate escrow payments to our parish taxes both in the same amount of {$1000.00} on the same day. So a total of {$2000.00} was deducted from our escrow account. Immediately we contacted GMFS to notify them that they needed to correct the issue. They stated that a stop payment was placed on one of those checks and that they would refund the {$1000.00} to our escrow account within 30 days. They have not returned the {$1000.00} to or escrow account and have adjusted our mortgage payment higher than our contract dated on XXXX/XXXX/2016. Our escrow balance should be {$1900.00} and instead it is $ XXXX They have not resolved the issue and I would like to file a formal complaint.

Since I purchased my home in 2012, I have paid PMI. The value of my home has increased significantly and I am now currently around 67 % LTV which would qualify me to have my PMI removed. I called my mortgage company to get this started and the person on the other end of the phone told me he was sending me a packet in the mail to sign and return to get the reappraisal started. After not receiving it, i called and was then told that they can not remove the PMI. After much research, I CAN remove the PMI with a reappraisal but my mortgage company will not do this.

Loan has been sold multiple times. All payments have been made but current servicing company ( GMFS ) claims did not receive payment from previous company ( XXXX ). GMFS does not have sufficient staff working in their loss mitigation department. Each time I call, I am told that they are having abnormally high call volume and always have to wait over half an hour to speak with anyone in the loss mitigation department. This is endlessly frustrating and a massive burden for GMFS borrowers. They should either hire more employees in the department or stop servicing more loans than they can handle.
