We are FEDERALLY PROTECTED CONSULMERS. Our credits report ( s ) AND file ( s ) have erroneous reporting from ALL Consumer Reporting Bureaus/Agencies/Companies/Public Reporting companies/Consumer Data Mining Companies/Consumer Credit Bureaus , et al . We have been advised that CREDIT REPORTING is a form of collection strategy and we DEMAND that ALL credit reporting CEASE IMMEDIATELY, ALL Consumer Reporting Bureaus/Agencies/Companies/Public Reporting companies/Consumer Data Mining Companies/Consumer Credit Bureaus , et al and acting CEOs/Presidents , et al are in direct violation of 15 USC 1692 e ( 8 ). In response to Global Payments Check Services Global Payments Check Services continues to deflect blame for their misrepresentation of facts with respect to what they claim are truthful assertions. The fact is that what I experienced in reality compared to what they claim happens as a result of their supposed " Terms and Conditions '' couldn't be further from truthful. The statements in their response below delves into mischaracterization of their own processes and seems to belittle consumers by thinking that people will just assume what is in their " Terms and Conditions '' instead of outright listing out verbatim what will happen as a result of returned checks with respect to fees. Global Payments has been red flagged by my bank and no further transactions will ever occur with this company. Global Payments Check Services has wrongfully accused me of malice as to what they've used against me as described in their response, specifically routed towards me when they claim that my statements are " malicious and defamatory ''. I take offense to the abusive language they've used against me. The frivolous and libelous nature of these statements expands into false statements and outright fabrication. As a result, I am now a victim of injury from this company. Respectfully, I will not contact the company 's Counsel as I am now being injured and harmed through words by the company as they attempt to conceal any ounce of the situation and use aggressiveness against consumers for questioning motives. Global Payments Check Services has offended me on multiple occasions, over the phone from employees who would start raising their voices and yelling to the inappropriate and unprofessional conduct as to how they operate on a business level. Any further declarations that will offend me shall be given to my attorney. I encourage any CFPB agents to carefully read these Terms and Conditions from this website. Respectfully, in Paragraph 9 through Paragraph 9.5 Titled " Payment Transactions and Payment Fraud '', there is not ONE SINGLE ENTRY OR CALLOUT to what the total cost of the Fee will be in the event of a returned payment. This company is not looking at the Terms and Conditions that were provided by the PA Lottery through Global Payment 's subdivision " Gaming Services ''. Instead, they are trying to find any source of BS to make their case sound legitimate. I can assure you ( and this is my opinion ), it is extremely fishy and I intend to get to the bottom of it! In first complaint, Mr. XXXX asserted that the debt was not owed by him ( see XXXX ). A timely response was provided with supporting documentation to evidence our position in this matter and has been the case in each instance where the consumer has raised a new allegation or concern. Nonetheless, we shall attempt again to address each and every concern raised by Mr. XXXX in this most recent complaint. Mr. XXXX asserts, This company 's Terms and Conditions do not include details of what they charge for return fees. This is an objectively false statement. The terms and conditions to be a patron in our VIP Preferred Program detail considerations regarding a dishonored ACH/check which was authorized by a patron. Paragraph Six of the terms and conditions of the VIP Preferred Program reflects, 6. ACH AUTHORIZATION You authorize Global Payments to initiate debit and credit entries to the checking accounts at the depository financial institutions for which you have provided information. The debit for a transaction can post at your financial institutions within twenty-four ( 24 ) hours from the time you initiate a transaction. You further authorize all transactions at any gaming establishments that participate in the VIP Preferred Network to be debited from any of your designated checking accounts. Your authorization will remain in effect until Global Payments has received written notification by you of its termination and up to thirty ( 30 ) days has been allowed to process the request. You understand that checks or debits returned unpaid by your financial institutions are subject to a returned check fee of XXXX U.S. dollars ( {$15.00} ) or the maximum amount allowed by state law which also may be debited electronically from any of your accounts or collected using a bank draft drawn from any of your accounts. The representatives become aggressive over the phone making my client to feel uncomfortable. We deny these statements to be a truthful or accurate representation of our interactions with Mr. XXXX nor have we communicated with any third-party with whom he identifies as, my client. My Social Security Number ( SSN ) was involved in a data breach that occurred on or before XXXX of XXXX, extending until XXXX. This breach affected individuals who underwent background checks and applied for jobs, leading to the appearance of numbers on my record. I did not provide consent for these accounts to be opened, and I lacked an understanding of credit and its mechanisms during that time. Consequently, I did not establish any credit relationships with the companies involved. I urgently request the removal of these erroneous entries from my credit report once and for all. The repercussions of these inaccuracies have been far-reaching and abnormal. Unfamiliar inquiries have appeared, accounts that I neither authorized nor opened have been added, and I've faced denials and disrespect due to these discrepancies. The errors in my credit report are extensive and profoundly incorrect. The account by XXXX was deemed fraudulent and removed, yet XXXX XXXX persists in reporting the collection stemming from it. * XXXX XXXX XXXX : Contact : ( XXXX ) XXXX ; Address : XXXX XXXX XXXX, XXXX XXXX, TX XXXX ; Account # XXXX ; Owed : {$13000.00} ; Opened : XX/XX/XXXX ; and Account # XXXX ; Owed : {$12000.00} ; Opened : XX/XX/XXXX. I only had a checking account with them, not credit cards or loans. Negative checking account information should be reported to XXXX XXXX, not my credit report. It's worth noting that a breach detailed in an article XXXX XXXX XXXX XXXX ) is responsible for over 21.5 million stolen identities, as discussed. XX/XX/2021 My bank account information was used to write four " E-checks '' to XXXX XXXX XXXX, totaling {$200.00}. XX/XX/XXXXXX/XX/212021 After checking my account transactions, I noticed the four E-checks to XXXX XXXX and immediately called my bank, XXXX XXXX XXXX. I reported these transactions as fraudulent and after looking into the claim, they determined that the transactions were, in fact, fraudulent. XX/XX/2021 I received the first set of letters from Global Payments Checks Services, LLC - a debt collector attempting to collect these fraudulent debts. ( Attachments - 04, 05, 06, 07 ). Shortly thereafter, I responded with a written letter explaining the situation and made it abundantly clear that these were not my debts and they were reported as fraudulent. I also asked for communications to cease. ( Attachment - XX/XX/2021 ). XX/XX/2021 ( estimated ) I received one letter threatening that they were going to report me to three major credit bureaus unless I paid the debts in full. ( Attachment - Threats ). I was offended by this letter - not only did they disregard my letter notifying them of a dispute, but they threatened to report these fraudulent transactions to my credit bureaus. I responded with a clear and direct letter restating that I disputed these debts and that if they continued to act without regard to the appropriate standard of conduct, I would proceed with legal proceedings. ( Attachment - XX/XX/XXXX ). XX/XX/2021 I received four separate letters in the mail - all of which stated that the debts have not been made ( and the threatening language was removed ) and yet again, failed to address my previous two notifications of a dispute. ( Attachment - 04 ( 2 ) - all others were the same ). They continue to send communications to me, despite expressly being told to cease such actions, and these most recent letters AGAIN failed to address the dispute. Rather, they simply demanded payment without regard to the fraud that occurred. I sent a written response dated XX/XX/2021 as that would be the next business day, but the letter is already in the mailbox at my local post office. ( Attachment - XX/XX/XXXX ). The basis of this complaint is that Global Payments Checks Services, LLC is failing to uphold the rules regulating debt collections. They continue to send letters despite being asked, but above all, they threatened to submit reports to credit bureaus for debts than I did not know of nor consent to. They stated that I should " carefully consider the consequences of this action, '' which to me, has an unpleasant tone. Additionally, they're charging unlawful service fees, specifically {$35.00} per transaction which is contrary to PA statutes. Lastly, they failed to address my dispute at all, let alone discuss it in order to reach a resolution. They refuse to acknowledge my written disputes notices, let alone attempt to work together to solve the problem. The methods used by Global Payments Checks Services, LLC are predatory aiming to elicit fear amongst those who they contact to collect a debt and their actions are contrary and in violation of these rules set to protect debtors. The attachments, taken together, make it clear that they're woefully failing to uphold the standard established by the regulatory agencies.

Company : Global Payments Check Services, XXXX - XXXX XXXX XXXX XXXX, IL XXXX / re : acct # XXXX I reached out to this company Mid XX/XX/XXXX regarding a returned check. The amount owed is {$770.00}, and they offered a settlement of {$650.00} but had to be paid that day to avoid a third party collection. I advised that I had taken an unpaid medical leave of absence from work, and advised that I could not pay the entire amount in one lump sum, but would like to set up a payment plan. I offered to make a small " good faith '' payment that same day with a debit card. they declined and said they could not take any payment if it was not the payment in full or the settlement amount, and that they could not set up any kind of payment plan. I expressed very clearly that I was very concerned that this would get sent to a third party agency and would be reported to the credit bureaus. again they advised that they could not do anything unless payment was made in full and they would not accept any partial payment. today ( XX/XX/XXXX ) I received two letters. The first is an undated letter from this company advising that the account has been sent to a third party collection agency and that the account has now been reported to the credit bureaus. The second letter is dated XX/XX/XXXX, and is from the collection agency advising that they have received the account and an attempt to collect. My issue is that the " undated '' letter was the first letter that I received advising of any legal action. additionally I am very concerned that the company was not willing to set up a payment plan - when I clearly expressed that I was able to pay a reasonable amount per month to avoid the account going to collections and being reported to the credit bureaus. I am very frustrated because I have had medical issues that sometimes prevent me from going to work, and I explained all of this, but they were still not willing to set up a payment plan, or even take a small partial payment just to show that I am willing to pay. Now my credit is going to be adversely affected, which is a VERY BIG deal to me because I have spend the last 5 years cleaning it up. I have NO LATES on all of my active accounts and only XXXX late on an old closed credit card. If this item gets reported to my credit reports, it is going to severely hurt my score and all the progress I have made.

Maybe the CFPB has some authority here. The credit card processor for my small business has adopted XXXX noncompliance fee policies and procedures that are causing harm to the small business community. Hopefully I can upload the full explanation, but in short, my card processor, Global Payments Inc., charged my small business {$16000.00} in punitive non compliance fees. These fees amounted to over 5 % of card receipts at one location, and .8 % of card receipt across 8 locations. The fees have no relationship to any meaningful measure of risk, like card receipts, customer volume, my companies polices and procedures, it's legal structure, or whether my company even retains customer cardholder information. To put the size of the fees into perspective, the XXXX XXXX XXXX permitted processors to charge a fee of XXXX of transaction volume for debit card processing, inclusive of XXXX XXXX 's for fraud loss, and .01 % per transaction for fraud prevention costs. Global Payments PCI non compliance fees alone are four times than the total fee for processing a debit card payment. The fees are XXXX times higher than the risk related fees allowed by the XXXX XXXX XXXX for debit card processing. Global Payments charges duplicative fees, one for being non compliant, and one for not completing the compliance process. Moreover, consider this example, XXXX 's fee structure is such that my small business, with it's annual {$1.00} XXXX in credit card receipts, pays penalty fees that are 8 times higher than a company with {$400.00} XXXX in annual credit card receipts but a single merchant number. XXXX gave little warning of it's fee policy, listing it in small print in it's XX/XX/XXXX statements. It initiated charges in XXXX of XXXX. If they had XXXX small business customers, and charged them the same way they charged my company, XXXX would generate {$130.00} XXXX in revenue a month, or {$1.00} XXXX a year. These fees are a tremendous disincentive to XXXX to support it's small business customers to help them become PCI compliant. I wrote to global check services regarding the extensive fraud that has occurred under my name and disputing the demand for payment that I continue to get from this company, and their response was to send information that I dont know how to get. They are requesting {$500.00} from me for online gambling for a XXXX casino account that I dont have. This money should have never taken because my accounts were closed back in XXXX. Stop closing valid complaints. Global Payments Check Services LLC is acting under malicious intent for deliberately burying certain clauses in the " Terms and Conditions '' on the PA XXXX 's website. I'm suspicious of their company due to various incidents which have taken place in the last month. After 1 transaction was returned due to insufficient funds, the company attempted to take the {$40.00} Principal that was owed and also the {$30.00} fee they charged, both which were successful on a second attempt. However, on XX/XX/2020, I received a letter in the mail from the company alleging that I owed {$70.00}. I called the company and a representative claimed that it's their policy to auto send a letter after a payment is returned once. Yet, they have every intention of resubmitting it a second time. The reason for the " letter '' is because and I quote " We don't know if it will clear a second time. '' The company consistently deflects any responsibility for 1 ) Wasting paper because of what they call a policy, and 2 ) Maintaining Consumer Data in their own database to which was not explicitly made clear other than vague references throughout the Terms and Conditions. I got a call on XX/XX/2022 from XXXX from a woman who said she was from a debt collection agency. She told me that my checking account payment was not cleared by XXXX XXXX and that I owe {$32.00}. I asked her who she was and why she was calling me and that my account was perfectly fine. She hung up on me. I called the number right back and spoke to someone else. This is a response to Global Payment Check Services : Mr. XXXX VIP Preferred Check Cashing account with our service has been closed as per case number XXXX. The account was closed due to the consumer 's refusal to acknowledge and agree to the terms of service. Unfortunately, without agreed upon terms of service, service can not be provided. This is in no way a reflection of the consumers complaint history, but a decision based solely on the grounds of Mr. XXXX refusal to accept the terms of the service that we provide which he initially consented to in transacting. Response : After further review, it has been determined that the Terms and Conditions that Global Payment Check Services references are completely inaccurate with respect to what has been stated verbally over the phone during phone conversations with their staff. Aside from what has been stated, the Terms and Conditions are vague, without recourse, and are not infallible. My rights as a consumer making a valid complaint precludes any Financial Agency or Organization handling Billing Inquiries by themselves or through a Third Party Agency from legally banning me, and putting a clause in any Terms and Conditions which would appear to neutralize a company from any litigation, goes against Consumer Rights. I opened an account with the XXXX XXXX, who uses Global Payments Inc to process deposits. I added my bank account and was denied the ability to make ACH deposits into my account. Upon contacting Global Payments Inc, I was informed that they, illegally, ran a credit check without my permission. Again, there was no request anywhere for my permission to run a credit check. There was nowhere that informed me that one would be run either. I was not seeking credit of any kind, but rather simply adding my own personal bank account for ACH transfers. The Fair Credit Reporting Act ( FCRA ) strictly prohibits pulling a consumer 's credit for an impermissible purpose as Global Payments Inc has done here. Furthermore, Global Payments Inc informed me that my request to add my bank was denied based on said credit check. As I have a credit score of XXXX with all 3 credit agencies, I was very curious as to the reasons I would be denied based on a credit check. I inquired as to why I was denied and was told they would not give me that information. The Equal Credit Opportunity Act ( ECOA ) mandates that lenders that deny credit to their applicants must state their reason for the rejection. Again, Global Payments Inc, outright refused to provide the reason for denial. I then asked for their legal mailing address for the purpose of filing a complaint with the CFPB and was initially denied that information as well. This company is violating the law, repeatedly, and then trying to conceal their identity from the government agency that regulates their industry. The company who handles the PA XXXX payments is claiming that they are entitled to take a {$30.00} return fee if the Payment for XXXX services is returned. However, they attempt taking the payment multiple times if it's returned within a few days each time. This to me ( and others ) is a scam. This company should be shut down immediately and PA XXXX should be forced to process payments independently. The company is also alleging that this is in the terms and conditions on the PA XXXX website, however, these terms and conditions never mention that this company is contractually taking these payments. Per the phone conversations with " Global Payments '', they claim that the Terms and Conditions articulate that a return fee will occur in the event that a payment is returned to them. Upon re-analyzing these Terms and Conditions, I've found that to be outright deception. I did request a short term advance through Global Payments System at XXXX XXXX XXXX, however they never disclosed that they can report to the credit bureaus nor provided a timeline to pay before their company will submit as a collection to the credit bureau. On XX/XX/2021 I attempted to set up a {$30.00} online payment with XXXX I made a typo in my account number and when I tried to fix it, the site wouldn't let me backspace and instead submitted it with the wrong account number. I tried to cancel it, I deleted the wrong info and put in a new account number, but instead of deleting the wrong one it created a second payment. I immediately contacted their online chat and tried to get it resolved, to no avail. After XXXX minutes with their chat person their answer was that they couldn't cancel a " successful '' transaction. I told them it was not successful because it was the wrong account number, but they refused to do anything about it. I emailed their customer service but they also did nothing. I contacted my bank and all they would tell me they couldn't do anything. Global Payment Check Services responded and told me that they will take the necessary steps to immediately cease further contact for collections purposes and will submit the chargeback and dispute to the merchant. On XXXX someone fraudulently started online gambling accounts at XXXX and made XXXX withdrawals for a total of XXXX from my bank account. I immediately noticed it and contacted the casino and my bank. I also filled a complaint with the Pennsylvania XXXX XXXX XXXX who has reached out to the casino who verified the account was fraud and I am not liable for the debit anymore. I was told by the PA XXXX XXXX XXXX to contact the debt collection company and they will verify with the casino I am not liable for the debit and it will be removed. A police report was also filed on XX/XX/XXXX with the XXXX XXXX Police department for Identity theft.

I played the XXXX XXXX on XX/XX/2022 I used ACH checks they bounced in my bank account. They dont have a fee listed nor a Debt collector listed. This debt collector Global Payment Check Services has charged my checking account 75 times since XX/XX/2022. They have written different checks for different amounts. All XXXX times has bounced creating a balance of {$1900.00}. I have contacted XXXX XXXXXXXX, XXXX XXXX and my bank ( XXXX ) and being told this is legal. I have been trying to contact these companies about the fraudulent activity that keeps being reported on my credit report. I have sent numerous validation request demanding a contract with my signature stating that I agreed to do business with these companies, and have yet to hear from anyone. On XX/XX/2021 I requested my anual free report, but Global Payments Check Services LLC, Attention FACT ACT support department.
