On XX/XX/2019, I made a moving reservation with XXXX XXXX XXXX XXXX XXXX. I was told in a recorded call that if I cancelled my move, I would not receive a refund, and I agreed. I signed an estimate that listed all of my items and gave a price by weight to move my things that I was told was binding-it would be honored as long as I didnt change my inventory. As my things were in a storage unit already, I knew my inventory would not change. I emailed and clarified again that I would be charged by weight, not by cubic feet, and was assured by XXXX XXXX XXXX XXXX that they would find a mover who would move my stuff for me with pick-up on either XX/XX/XXXX, XXXX, or XXXX, and all charges would be based solely on weight, not cubic feet. // On the day of the move ( XX/XX/XXXX ), the mover provided by the broker arrived at my storage unit and said he would not honor the binding estimate because he wouldn't charge by weight, only cubic feet. He offered to write a new estimate, but the new estimate would require that I pay an additional $ 300-500 immediately, and additional costs would be due upon delivery. I called XXXX XXXX XXXX XXXX, and they said the mover needed to charge by weight, but when I called XXXX XXXX XXXX XXXX, they would not help me resolve the issue of the mover claiming he would not honor the estimate or charge by weight. XXXX XXXX XXXX XXXX told me I had 30 minutes to allow the mover to move my things or the driver would leave. The mover also spoke with them and told them that he needed a new estimate and additional funds, despite the original binding estimate being accurate and written to charge by weight. They refused to do anything to resolve the situation, refused to provide another mover who would honor the estimate and charge by weight, and refused to help me in any further way, including not answering any further calls. // The mover suggested I call my bank and ask about recovering the funds I had paid because he could not do the job as written ( in other words, he was refusing to provide the service ), and this was a frequent occurrence when he was sent on jobs for this moving broker ( meaning that the broker knew this was a problem with this moving company, and did not find or provide a mover who was able to do the movewhich was the exact service I had paid them to provide and the entire basis of the contract I had with them ). The mover told me that if Id used a credit card, I should have no issue getting my funds back, but since it was a debit card transaction, it would depend on my bank. I called First Bank in XXXX XXXX, and spoke with XXXX XXXX. I explained the situation, and the mover explained on speaker phone to both of us that he couldnt honor an estimate based on weight, and was refusing/unable to provide the services the estimate and deposit were for. XXXX told me that if services were not provided, I would not have to pay the charge and I should file a dispute that would recover the funds I had spent. // I tried repeatedly to contact XXXX XXXX XXXX XXXX, and they would not answer my calls or return my messages. So I sent XXXX all of the documentation she requested ( per her request I sent them electronically through email ) : a link to the binding estimate I had signed ( I was unable to do more than screenshots as my computer was packed for the move and I was on my phone, and XXXX didnt want screenshots ), a written statement about what had happened, and the emails between myself and the company agreeing the move would be charged by weight. // More than a week later, I received a letter from First Bank saying a provisional credit had been placed in my account, and I would be notified upon final resolution before a date in XXXX. On XX/XX/XXXX, I received a letter from Glacier Family of Banks stating that the bank had competed their investigation, and the bank did not find an error had occurred. The letter told me that the credit would be reversed from my account in 2 days, on XX/XX/XXXX. // I immediately called XXXX XXXX XXXX the dispute specialist who signed the letter, and was told that she did not find fraud had occurred because I had cancelled my move. I explained that I did not cancel, the mover had refused the job and left. The broker had refused to work with me or return my calls, and I had been unable to get the service that had been guaranteed to me ( the service I paid for was that the broker would provide a mover who would honor the estimate as written and move my things before XX/XX/XXXX as long as my inventory hadnt changed ). XXXX said that regardless of what happened, the bank 's decision was final. When I asked why the dispute had been filed as a cancellation when the issue was that services werent provided, XXXX just repeated that because the cancellation policy was posted on the brokers website, the claim had been denied. After speaking to someone with knowledge of the dispute process, I called XXXX back and again asked why when this wasnt filed as a services not provided dispute, and XXXX told me she didnt know. She then claimed that the entire decision was solely XXXX XXXX and she couldn't do anything but pass along their ruling, and she was bound by the bank policy for reversal of credit. // Ultimately I was told in three separate phone calls with two different employees ( XXXX XXXX with Glacier Bank and XXXX XXXX with First Bank ) that pre-arbitration was not an option, and I had absolutely no way of appealing the decision made by XXXX XXXX despite the decision being based on the erroneous dispute claim about cancellation. Additionally, the letter I received from Glacier Family of Banks states, You have the right to request documentation concerning the information the Glacier Family of Banks relied upon in making our determination. In all three phone conversations, I asked XXXX and XXXX to send me all the documentation for my case so I could understand why pre-arbitration wasnt an option, and why this had been filed as a cancellation rather than services not provided. I asked repeatedly for the communications from XXXX XXXXnd was told me there were absolutely no written communications in any form, and my file only contained the denial letter and a 2-page fax from XXXX XXXX XXXX XXXX claiming to have ( but not providing any documentation of ) proof that I had cancelled my move prior to them attempting to send a mover, and there was nothing further she could send me. // According to XXXX manual called XXXX XXXX XXXX XXXX XXXX, Glacier Bank would have been able to make a pre-arbitration attempt if they could provide new documentation or informationwhich would have included clarifying the dispute as services not provided rather than cancellation. The dispute stage process also says that the issuer-my bank-has to certify that they contacted me to review the Compelling Evidence and can provide an explanation of why the cardholder ( me ) continued to dispute the transaction. I was never, ever contacted to review the Compelling Evidence ; Ive still never seen the compelling evidence, and despite this provision, Glacier Bank is refusing to follow XXXX XXXX XXXX and proceed to pre-arbitration. The table goes on to say that, if the Acquirer has not met the requirements specified in the XXXX XXXX ( which their compelling evidence absolutely did not ), then the issuer should file for arbitration. Again, Glacier Bank refused to do this, and denied me the right to fully dispute the transactions and recover my funds. // I believe First Bank misfiled my initial dispute as a cancellation dispute rather than a services not provided dispute, did not follow the procedure required by XXXX after that, and rather than correcting their error and informing me of the process in a timely manner, they delayed until the deadlines for pre-arbitration had passed. I believe that First Bank only realized they had completely messed up the filing and did not follow the process for pre-arbitration when I contacted them, and rather than own their mistake and make it right, they instead cut off all communication, have not sent me any of the paperwork or documentation related to this dispute, and will not answer my phone calls or return my phone messages, voicemails, or online attempts at communication. // ( Update to add : since this issue has continued, XXXX XXXX XXXX XXXX have sent a claim to the XXXX stating that the funds were returned to me through the dispute, and have not been returned to them with the settling of the claim, despite the full amount having been debited from my account a month ago. XXXX XXXX also stated in their XXXX response that I did NOT cancel, and they did not provide the services, which makes the evidence they submitted to XXXX an outright lie, and further supports my case for continuing or reopening the dispute, since the facts are agreed on both sides : the services were not provided, and I did NOT cancel as Glacier Bank claims. XXXX XXXX also argued that I had signed a binding contract, however, XXXX XXXX states in their XXXX Response that I did NOT sign a contract, only an estimate, and so the bank 's claim that there was a contractual issue preventing them from disputing my claim is also completely false and has deprived me of almost {$XXXX} from a valid dispute for a month ).

We recently applied for a home loan through Mountain West Bank on our primary residence which we own free-and-clear. We are seeking a loan of $ XXXX, and the property is appraised at $ XXXX, making the loan a 60 % LTV first mortgage. The loan would pay off ALL existing debt, including all tax debt, credit cards and vehicle loans, as well as the underlying lien on an adjacent 40 acre parcel of land we own which is currently valued at $ XXXX. ( Two immediately adjacent 20 acre parcels have sold within the last month for approximately $ XXXX each, in spite of the current state of the economy. ) We meet all of Mountain West 's credit requirements and DTI requirements and had been approved by underwriting for the loan. However, somehow Mt West wasn't aware of a private note of $ XXXX we have on the adjacent 40 acre parcel. When Mountain West discovered that we own the 40 acre adjacent parcel and intended to pay off the balance of the private note with the loan proceeds, their credit committee immediately changed the terms of our loan to encumber the primary residence PLUS the $ XXXX adjacent 40 acres. ( The loan of $ XXXX was already going to be secured by our primary residence and was only 60 % LTV of that parcel alone. ) We believe Mountain West 's new requirement of demanding $ XXXX worth of real estate as security for a $ XXXX loan is most certainly Predatory Lending. We meet all their DTI, LTV, and credit requirements WITHOUT adding additional real estate assets to the loan, and using the proceeds to pay off the land loan did not change our financial outlook in any way. In fact, it improved it. However, Mountain West saw an opportunity to take advantage of our situation, knowing that we were depending on that loan to satisfy a balloon payment on the land that is due in 3 months. This is profoundly disturbing, especially at a time when our country is dealing with the Covid19 pandemic. In spite of everything that is currently happening in the economy, my employment has been guaranteed by my employer and our industry is considered essential, as we XXXX XXXX XXXX to XXXX and numerous other essential businesses. There is no concern with regard to my ability to repay the debt and it is undeniable that the loan would only increase our credit-worthiness, leaving us 100 % debt-free aside from the 1st mortgage, PLUS providing 5 months worth of cash reserves. We are firmly convinced that Mt West 's new demand is unduly burdensome,100 % unnecessary and out-of-the-ordinary due to the fact that we meet all of Mountain West 's lending guidelines. We would greatly appreciate your assistance in reviewing this claim ASAP. Thank you.

Please find attached a screen shot of the response from First Security Bank regarding my complaint against them of inaccurate payment reporting. It is noteworthy that not only has FSB not provided an actual bank statement, and instead simply felt their word against mine is sufficient proof of their inaccurate reporting but also, they conveniently failed to include all of my payments leading up to the XXXX payment in question. Also find attached my bank statement of payments I have made since XX/XX/XXXX. As is obvious, I paid ahead {$500.00} on XX/XX/XXXX and I paid ahead another {$500.00} on XX/XX/XXXX. That's 20 months ahead. My monthly payments are {$50.00} per month and my payment is due every month on the XXXX of the month. Although I paid ahead, I still continued to make payments every month thereafter. I challenge FSB to provide an actual bank statement to prove their false claim. The statement I am providing is an actual statement generated by First Security Bank. I can assure FSB the next step will be to contact my Attorney and seek damages through civil court. FSB RESPONSE esponded STATUS Company responded on XX/XX/XXXX RESPONSE TYPE Closed with explanation XXXX 's Response Dear XXXX XXXX, In response to the late payment on your Overdraft Protection Line of Credit ending in XXXX, resulting in a 30 day late reporting on your credit bureau, the payment made on XX/XX/XXXX, was in fact over 30 days past the due date of XX/XX/XXXX. The following is a quick snapshot showing the recent due dates and payment dates for your Overdraft Protection Line of Credit : Due XX/XX/XXXX Paid XX/XX/XXXX Due XX/XX/XXXX Paid XX/XX/XXXX Due XX/XX/XXXX Paid XX/XX/XXXX You can see your payment due dates are not always on the XXXX of the month, as you stated in your XX/XX/XXXX and XX/XX/XXXX email correspondence with XXXX XXXX, the XXXX on your account. He explained that your payment made on XX/XX/XXXX satisfied the XXXX payment that was due XX/XX/XXXX. The next payment made was on XX/XX/XXXX, which satisfied the XXXX payment that was due XX/XX/XXXX. The payment made XX/XX/XXXX was due XX/XX/XXXX, which is just shy of being 30 days late. Unfortunately, we are not able to reverse the credit bureau reporting because the payment was in fact over 30 days past due. First Security Bank/Glacier Bank Loan Mortgaging Service/XXXX XXXX XXXX After we purchased our first home we have had many problems with our mortgage. The first came in 2021 when we received notice that our property taxes were delinquent. We contacted the bank and they came back to us saying they had miscalculated our mortgage payment and lowered it from {$1700.00} to {$1500.00}. They also let us know they would be issuing a refund check from our escrow. We also later found out that the reason why it had not been paid in the first place was because XXXX XXXX XXXX had the wrong parcel number on our loan. Again in 2021 we received another letter stating our taxes were delinquent and a lien was to be placed on our home if not paid. After contacting the bank we received a call that " they weren't sure why it wasn't paid, but someone was hand delivering the check that day. '' This month we received a statement that our mortgage payment was going up from {$1500.00} to {$2200.00}. It said our escrow account was almost {$5000.00} in deficit and they were going to take those payments over a 12 month period. Upon contacting the bank they said that seemed unusually high and would look into it. They ended up finding an error, but did not say what it was. Our payment is now down to {$1900.00}. They said we never paid for the taxes on our home just the property. We have looked into this and according the the county treasurer and department of revenue all our taxes have been paid and are up to date. If we owe taxes on the house, it seems like this would've came up much sooner than a month before we are supposed to pay this new amount. It feels like someone at the bank made a mistake and we are now paying for that to cover them.

I receive child support from Montana XXXX XXXX XXXX which can not be levied from my bank account. A judgement was entered for a past medical bill even though I am in the process of filing for XXXX XXXX XXXX and have retained an attorney, have provided the attorney 's name and contact information and completed the credit counseling my account was still levied and my child support was still taken twice. My bank did not audit my funds to to see if the funds were eligible for garnishment even though I informed them the first time that they were not and did this immediately. They must hold the funds for five days and they refused to correct it either time. they took every cent in my account including all child support and medical reimbursement. They had all documentation because they received the direct deposit from XXXX XXXX XXXX and they have not responded to requests to correct this and have said they have no intention to correct it. I still have not been returned the child support which I rely on to support my daughter. This is through Valley bank of Helena. I talked to XXXX XXXX who is the Vice President and the Fraud department and all of them have refused to correct it and have cleared my bank account out completely without any recourse for me. I have had to miss close to 40 hours of work in an attempt to correct this and my bank account remains overdrawn, my daughter was pulled out of childcare without notice and I could not even buy groceries. These funds are protected by law and they took them without the right to do so on two separate occasions which have caused me significant hardship and caused me to even miss a house payment.

This requirement results disparte low income residents of the City of XXXX, Montana access to federal assistance programs ( XXXX ). Im a Protected Class citizen Guardian of XXXX XXXX XXXX XXXX XXXX. I am very concerned about my child 's lead paint exposure. My application to the City oXXXX XXXX submitted XX/XX/2020 was denied based on the imposed requirement implemented by Western Security Bank and City of XXXX The Federal Housing Program is made unavailable to low income residents and results disparate from access to Federal Housing Rehabilitation program assistance. Disparate impact on our community and direct impact forcing blight and homelessness. Federal Assistance programs were adopted to serve low income persons ; which Western Security Bank and CIty of XXXX have created their own set of rules to avoid assisting our low income population housing needs, thus no Fair Housing can be found. I needed a Federal Assistance XXXX XXXX LOAN to remove lead paint, repair windows and fix a water leak. Western Security Bank and City of XXXX violated my rights and held the program above me, as if almighty. My application was denied 3 times including board member and city council voting. Its a group thing. Included the attached you will find City of XXXX recommendation to City Council proves privacy in communications violations and false statements.

Foothills Bank in XXXX XXXX, refused to open two separate totally free checking accounts for two separate people. They required an occupation, and when I told them I was an XXXX, and they acted like I didnt have a real job. They immediately said, if I XXXX XXXX, is your business going to pop-up?. The banking manager was so rude and undermining to my occupation and insisted I was lying. The bank manager also asked where I was moving to, and if I didnt give her the new address, I wasnt going to be able to open an account. The bank manager was even saying that she called my phone number and it didnt go through so did I give them a fake phone number? I gave her the same number and she called my phone again and this time it went through and rang. At the end of the process to get an account, I was harrassed if I had family in the area and a lot of personal questions that have XXXX bearing on opening a checking account ad advertised. At the very end, the manager said she was going to call my phone again because it didnt go through, even though in the office she called it and it rang. Again, the experience was very odd. I was very polite and professional, but the bank manager seemed off. There was another person with me, opening an account, and the same treatment was given. At the end the bank manager said that they didnt want to open an account based on lack of information, but all the information requested was given.

I have a bank account at First Security Bank of Missoula, a division of Glacier Bankcorp. I have funds deposited in my account. An unrelated individual uses the same institution. This individual and I agreed that we would settle an obligation by transferring money from my account at FSB to their account at FSB. I went into my local branch today and asked the bank to transfer the funds from my account to the other person 's account. The bank took money from my account and placed it into the other person 's account using the name/account number I provided to the bank. I next asked for a receipt or some form of documentation that the money had been removed from my account. The bank refused to give me a receipt. I would like a receipt.

RE : XXXX XXXX XXXX XXXXXXXX XXXX Bank is reporting me as 30 days past due in XX/XX/2022. Not only have I not been 30 days past due, I usually past ahead. I have discussed this with the Vice President as well as the credit reporting officer and they refuse to remove the past due reporting even though I have proven to them that I was not past due.
