XX/XX/XXXX After consulting with my Attorney XXXX XXXX ( Texas Bar Number : XXXX ) for the last 3 months ( as of XX/XX/XXXX ), disappointedly, he then felt that he could not adequately represent me in filing of my appeal to the Supreme Court which is in correlation to my Wrongful Eviction process. I am seeking mercy of the High Court regarding the " Wrongful Eviction '' executed by Kondaur tragically affecting myself and my family. Kondaur who has an overwhelming negative reputation and numerous of complaints with the CFPB association ( which Ive filled ), are responsible for myself and my family being Homeless and about to lose what is left of my personal possessions through storage. Even though they habitually violate Mortgage Servicing Regulations they continue to affect folks like me. Someone merely trying to maintain a healthy living lifestyle for my children and family, ( The American Dream ) an opportunity awarded to everyone who engages the process. My Modification had been approved through XXXX for 13 months. I was advised by XXXX to begin to make my payments to Kondaur, whom accepted the payments. However, after the new payment was applied for {$1.00}, XXXX, via my bank check mail but it was returned at least 3 times. Soon their process to Foreclose resumed leading to the Wrongful EVICTION. After Kondaur knowingly caused the initial default by sending my payment back after accepting {$790.00} with the agreement with XXXX, then Kondaur reneged on the Modification they have agreed on XX/XX/XXXX. Following months of antagonizing missed court dates by Kondour, ultimately, they succeeded in what they set out to do, steal my home. The day of the actual horrifying Eviction, I returned to court to get the judges signature, on the already stamped Documents, which the court clerks said it was sufficient. However, it was not enough for Kondaur. It was that day XX/XX/XXXX following, filing several documents, including a Motion to Stay ; as I attempted to have the Judge sign it, the Constable showed up, and gave my elderly mom 5 minutes to gather my things and get out. FIVE MINUTES, after 10 years, and a more than {$22000.00} down Payment and thousands of dollars invested? This should never have happened. Due to a lay off, and a struggling economy, I was getting close to fulfilling my career goal as a full-time educator with XXXX XXXX in XXXX XXXX with specialization in XXXX. Obviously, Kondaur was only concerned about fulfilling their profits of stealing someones home who has worked hard to bill and keep for their family. *The fact is that Kondaur was so anxious to 'Evict, ' they did not respect the date of the Court Hearing, which would have preceded the Eviction. Instead they Evicted and then went to court. Prior to this they ignored previous court dates. This travesty played out like a 'horror movie. ' It 's as if I was watching my life crumbling before my eyes, while I stood by being tortured, watching helplessly. The Constable told us to Leave the premises, as they half packed, half loaded, and half threw my life long Possessions on the Yard of my home, minus missing valuables. Less than a block away we sat in our vehicles. We could see the large black bags, and other items piled on top one another. After a few hours less than 5 hours to be exact, they shut down. At first, I thought well " at least everything is out. '' What a deception that was. Later, I passed that way to pick up my Kids from the neighbors, and saw XXXX XXXX, XXXX XXXX, ( after 2 weeks I was allowed in the kitchen ) ; it was then I realized that nothing ' worthwhile ever came from the kitchen. I had almost every type of major utensil and appliance one might have that took years to accumulate. All lost, stolen!! With an exception of a few raggedy pots. *During the Eviction, Keys were neatly stacked on the table, ( to give the appearance of all is okay ), but my moms wallet was left laying wide open on the kitchen counter Still inside the house, Drivers License, found on the Ground. Later, we rented a huge truck, and spent over a week watching 'XXXX XXXX ' load, destroy and crush valuable furnishings, ( Too much to carry with us, with nowhere to go ). Absolutely debilitating to watch. At a distance I thought all my things were out. It was only then I assessed the situation, realizing that much of my Valuables were missing from jewelry to appliance, etc. *Later I saw XXXX XXXX there, getting ready for repairs and refurbishing, and the same woman, XXXX , who did the 'home evaluation ' a in XX/XX/XXXX. I never got that Report as I have request through Kondaur Capital, they stated what report- we do not have and Evaluation Report. Her crew was Carefully wrapping, and salvaging my expensive Kitchen Utensils that were worth hundreds to thousands of dollars. Their claim, they were taking it to the Dump? ( Why wrap them I ask )? I was mortified and further humiliated. As bad as EVICTION is, why not put All the folks stuff out and let them have a chance to salvage it, rather than recoup it for their personal, or business use. To put the icing on the cake. XXXX XXXX of XXXX XXXX, put a sign in the yard for sale while the property is under legal pursuit with my insurance company. I lost so much, Jewelry, Collectables, furnishing and other Valuables. This careless Barbaric Act could have been prevented. but they wanted the house from the moment XXXX XXXX, left the picture. They ignored the XXXX form the presented to me for forgiveness, never responded to the un-explainable lack of application of over {$30000.00} plus the {$22000.00} of which I received no credit. They claimed they ca n't find it, during this terrible process, many of my important Documents were either lost or destroyed by Rain, which did occur before we could get them off the premises to Storage. My Family and I have suffered so much, monetarily, emotionally, and physically. Not only can my kids no longer walk to and from the school bus stop, while I either walk, or watch them board the School Bus for the short ride to school. My son will lose his place in XXXX XXXX, ' the teachers, and familiar programs in place ; even though he has been progressing. This un-Godly act has placed undue hardships and pain on my/our lives. It is our plea that these people answer a call to justice for treating their clients so inhumanely, while engaging in illegal acts according to the Mortgage Servicing Rules and Regulations. Personally, I feel they 'stole ' my Property and sabotaged my documents to prevent perfect evidence from resurfacing. While further humiliating my family. In conclusion : Kondaur Capital, the mortgage company defaulted on an agreement that was made to XXXX ( previous lender ), and myself the homeowner. They simply did not want me in the home-period after they paid off XXXX. Consequently, they did not show up to defend themselves when ( the case XXXX went to District Court ) , that was a violation within itself. XXXX XXXX XXXX XXXX of the US XXXX District Court, asked after an hour in court, " Where is Kondaur Capital ''?! He stated they should be here, and released the case back to Bankruptcy Court ( file to prevent foreclosure-due to Kondaur Capital refusal to adhere to the modification agreement ). Kondaur claims they got the property back in Foreclosure. How could that be when the property has not been mandated back to XXXX XXXX XXXX District Court while it was still in the hands of XXXX XXXX XXXX court for several months. I attended the Foreclosure and stopped it due to the judge was reviewing the case to sign in my behalf. However, the Judge did not sign due to it had not been mandated back to District Court, XXXX XXXX XXXX as of XX/XX/XXXX. XXXX XXXX of XXXX XXXX XXXX stated they were not going to Foreclose on XX/XX/XXXX at XXXX XXXX. However, Kondaur stated it was rewarded back to them (? ). Yes- Kondaur needs to be sued and the Realtor ( which played the role in mod and eviction ), as well as a few others. I also, believe that money and damages can be rewarded for their sabotaging and viscous behavior. What is clearly more important to me is that the Supreme Court needs to know what has happened to my family is currently happening to many others. The problem is that most people do not have the strength to fight back or have the know-how. However-We DO!! To add salt to my womb. Kondaur Capital sends me a letter dated XX/XX/XXXX, stating that I can save my home through loss mitigation options. Please view the attachments. Sincerely, XXXX

To whom this may concern, My name is XXXX XXXX. My husband, XXXX XXXX and myself have lived in this house for the last 30 years and we are now terrified that Kondaur Capital is foreclosing on our house strictly for monetary gain without properly considering us for any kind of foreclosure alternatives. Our nightmare began in XXXX, when my husband lost his job and ended up in retirement as a result. Because of the loss of income, we got behind on our mortgage payments so we attempted to get a modification with XXXX. We went round & round with them for about 6 months getting nowhere. During that time my grandmother passed and willed me XXXX dollars. We decided to pay down the mortgage with XXXX so we would be current and our balance & monthly payments would go down. Within weeks of giving them a check for XXXX, they sold or transferred the mortgage to Kondaur Capital. We soon contacted Kondaur Capital explaining what had transpired with XXXX. Even though we had given XXXX XXXX, Kondaur told us we were still 6 mos. behind on our payments? How could that be after paying all that money that I had inherited? We started the modification process all over again with Kondaur. We sent in a complete modification package and began following up every week. Each time we would call we starting getting conflicting information about whether they had it or not ; some told us that the package was incomplete, phone calls were not being returned, etc. Violation of The Real Estate Settlement Procedures Act ( Regulation X ) XXXX Loss mitigation procedures. The Consumer Financial Protection Bureau established rules to " protect mortgage borrowers from costly surprises and runarounds by their servicers. '' We started to get the feeling that Kondaur was intentionally giving us the runaround ; potentially setting our mortgage up for foreclosure. Why else would they keep asking for the same documentation over & over ; some days they had what they needed the next time they did n't? XXXX ( b ) Receipt of Loss Mitigation application - " A servicer shall exercise reasonable diligence in obtaining documents and information to complete a loss mitigation application. '' One day while checking on status of our modification I was told that we had become too delinquent on payments and they were not going to be able to help us and we were going in foreclosure. Are you kidding? When we started this with XXXX we were only 1 month behind and now, through no fault of ours, we 're too far behind? We were told not to make payments while in the review process for a modification. XXXX ( g ) Dual Tracking is prohibited. " Servicers can not start a foreclosure proceeding if a borrower has already submitted a complete application for a loan modification or other alternative to foreclosure. XXXX Early intervention requirements for certain borrowers - I do n't feel that Kondaur has ever provided us with a " Fair Review Process '' for a modification, as required under the Dodd-Frank Wall Street Reform & Consumer Protection Act. " CFPB 's mortgage servicing rules ensure that borrowers in trouble get a fair process to avoid foreclosure '', " borrowers should n't be surprised by the start of a foreclosure proceeding until they have had time to explore all available options ''. We now have a pre-foreclosure court date, XXXX XXXX, XXXX because we strongly feel Kondaur intentionally mishandled, mismanaged & steered this mortgage into foreclosure for no other reason than greed and monetary gain because of our substantial positive equity position. Because of where I work, I will also lose my job of 22 years if we are foreclosed on because of public perception. We are praying for someone to intervene and help save our house. Please help us!!! After the financial crisis, both of us loss our positions and was shortened if yearly income of at least 35000 from of both of our incomes. This was in XXXX. I had XXXX XXXX XXXX in XX/XX/XXXX. My husband loss tens of thousands in his retirement funds ; we had to withdraw slowly as no one could find better paying jobs or sell our property since we knew we could not afford the loan. We had our properties up for sale through a local real estate agent in XX/XX/XXXX. Banks were not lending, and we couldnt sell unless we gave it away. We sent XXXX to XXXX out of 401K and they still sent foreclosure papers to us. We were in the middle of filling out paperwork to get a modification loan or sell property, etc., but the cover sheet of the XXXX XXXX paperwork had that the property included two adjacent lots that the loan did not. XXXX XXXX did not show up or follow up in XXXX with our attorney response to the error, nor did our loan originator quicken loans show up or answe to the XXXX mediation meeting. XXXX XXXX still works for XXXX and we had discussed that we were not going through with the loan if the extra lots were going to be included in the loan. So the closing attorney made sure property description was correct and scratched out with an x and circled the lots XXXX and XXXX and had us initial that line. At the mediation meeting. XXXX attorneys showed where one line was missed st the very top of one page out if? How many in a binder that the papers folded over the top. XXXX would not give XXXX XXXX if SC Help any information as to how much XXXX would accept to cover the loan. The SCHELP money was XXXX to help South Carolinians save their homes. Which XXXX from XXXX at 2 percent and some 401k money would have saved our home. But XXXX at the mediation meeting in XXXX said they would unclaim the lots, give us XXXX and take our house. No was our answer. They did the bankruptcy thing after asking them and filling out modification apps with them also with no response. XXXX ended up with our loan and took a modification app from us and sent back that they would go down about 30.00 on the monthly payment. Which was XXXX. XXXX then supposedly turned over to Kondaur your, never heard if and really never heard if XXXX XXXX XXXX. We through requests from a XXXX XXXX with Kondaur sent in modification apps a couple of times with no response and then SC Help til us they could still hel us and due to our flooding the money was now XXXX to come off of what we would owe the mortgage company. Kondaur would not respond for us to get help. In XX/XX/XXXX, Kondaur, XXXX XXXX sent a realtor to our house that it had to be inspected before knowing about helping us with our house. The guy came, we rushed with the next modification app, the attorneys for them said they would unclaim the lots but wanted the house. Wanted to change our FHA non deficiency loan to a personal deficiency loan. Said the total we owed was about XXXX The lots that XXXX and XXXX could have told the truth that the lots were never included in the house loan would have ended in XX/XX/XXXX. But eight years later with XXXX never paid the property in the house much less the lots. XXXX did pay insurance and taxes. We have all tax receipts and end of year mortgage statements. They show us always paying the two lots. We have gone through anxiety of being told we were losing our home and We could have been able to pay with SC Help. If not., a home by our mortgage company within our budget at a low interest rate that president Obama said Americans were suppose to get.

To whom it may concern, Our original servicer had been XXXX. We were asked to submit a modification package and we did that in XXXX of XXXX. After I sent the package off I called to make sure they had a complete package. I was told had that time that our package was indeed complete and we would get there decision in writing. We waited and called asking what the status was and each time we were told it was still in underwriting. XX/XX/XXXX someone came to our home and posted foreclosure papers. We were shocked since we were still awaiting a decision from XXXX. We called XXXX at that time and asked them about our modification package. We weren't really given any explanation. It was almost like they knew that someone had dropped the ball and they didn't know what to say. A woman by the name of XXXX called us late XXXX around XXXX XXXX and asked if we could re submit payroll and they were going to try to figure something out. We resubmitted payroll stubs we waited. we got a letter denying our modification for reasons that did not make sense. They said that we did not see our hardship ending anytime soon and that was not true.My husband was working we wanted to pay our mortgage. We submitted an appeal and we were waiting to hear back from XXXX and they sold our loan to XXXX XXXX at the end of XX/XX/XXXX. We immediately called XXXX XXXX asking what we needed to do. We were told to submit another complete package. We did that and we waited on the 30th day we got a letter stating that they sold our loan to Kondaur Capital. We call Kondaur Capital immediately. We were told for one entire month that our file had not transferred over completely. Once they got our entire file we asked what we should do. They told us to submit of modification package.We have had sale dates on our home since XXXX of XXXX. We have had to file bankruptcy to stop the sales. Our house had a sell date just last week we began calling Kondaur leaving messages and emails our representative XXXX XXXX would not call us back.Finally my husband called Kondaurs main number and told them he wasn't going to hang up until someone could tell him what the status of our loan modification was. our house was up for auction the next day.XXXX finally got on phone he said he been busy. When we asked about our modification he said that they had decided the night before not to approve it. That was on XX/XX/XXXX today is XX/XX/XXXX and we still have not been sent anything with why we were denied. We went and filed a skeletal chapter XXXX to stop sale. This is crazy. We want to pay our mortgage. My husband is back working making more than enough to pay. Why wont they give us the chance. Wont it cost them more to care for home and then have to sale it. We will continue to fight. We understand we are at fault but we have been trying to rectify this situation for several years now. The longer it takes the more behind we get.Please we just want someone to listen to us.This has been our home for 18 years we want to pay for it.

in XX/XX/2007 both my wife and I lost our jobs at the same time. We had a mortgage with XXXX XXXX, who sold it to a company in California, XXXX. We hired a lawyer ( XXXX ) to mitigate for us, and paid him {$2000.00}. All he did was send some letters to the XXXX, He the n advised us, that this friend of his was interested in looking at our house. A gentleman showed up at our house, and said that he already purchased our mortgage from XXXX and, said that he was willing to make us pay interest only payments with a 7 % interest rate. being in that situation and fearing to be homeless we agreed. this gentleman kept on promising if we can get someone to refinance he would do it. meanwhile House prices declined and this gentleman wanted to much money for the property. No one would lend us for the price he was asking. At his mortgage rate we were falling further behind, Plus I was laid off again, and Hired another lawyer ( XXXX ) to see what he can do. After taking a partial payment of {$500.00} this man was impossible to get a hold of. We just gave up on him. The gentleman who purchased our mortgage filed for a foreclosure and we hired XXXX XXXX XXXX XXXX of New York and paid then {$3500.00} ( a great sacrifice on our part ). This law firm advised me to start a Bankruptcy claim to stop the sheriff sale, but offered no help doing it but said that the clerks at the bankruptcy court would help. I did my best and when I went back to the bankruptcy court the secretary said that the paperwork was good and I should wait for a court date. one week later a received a letter from the court with my court date listed. A week before my court date, I called the bankruptcy court again to see what I should bring with me. It was then that I found out that my case was dismissed because of missing documents and was also told that the lawyers of XXXX XXXX XXXX was already informed and that it went on a sheriff sale and my deed was now under XXXX XXXX XXXX and I lost my house. I meanwhile was never informed and did not know anything until I made that call. Know my fate rest under this XXXX who have already threatened to send the sheriff to remove me from the property. We are still trying to work with this XXXX to see if we can come to some sort of agreement, But thanks to the bad advice of the lawyers and law firm it is doubt full. I served this great country for 10 years in the XXXX and was willing to lay my life down if needed. Always paid my taxes and tried to be as honest as I could. So many promises out there to help, but all scams ( all set up to help people with good greadit only ) and no one does anything about it. This letter will probably not resolve nothing, but at least I had a chance to vent. Sincerely a disappointed and let down citizen of what 's called the greatest country in the world

To : Kondaur Capital Corporation XXXX XXXX XXXX XXXX XXXX XXXX XXXX, CA XXXX From : XXXX XXXX XXXX XXXX XXXX XXXX, NY XXXX RE : XXXX XXXX XXXX XXXX, NY XXXX Re : Error Resolution Notice under 12 C.F.R. 1024.35 Mortgage Loan Number : XXXX I am writing to request Correction of the Error described below in regard to the mortgage on my property at XXXX XXXX XXXX XXXX, NY XXXX. On XX/XX/XXXX XXXX XXXX XXXX transferred this loan to XXXX. The loan balance was {$300000.00}. After a legal arbitration between XXXX XXXX, XXXX XXXXXXXX XXXX and me, all settlements were made. It was then order by the court to have the mortgage reinstated. This was not done. Instead, XXXX took some payments up to XX/XX/XXXX then stop. On XX/XX/XXXX, the loan was then transfer to XXXX XXXX with a mortgage balance of {$290000.00}. On XX/XX/XXXX XXXX XXXX XXXX registered this loan with the credit bureau in the amount of {$350000.00}. This amount is incorrect and the charges added on are fraudulent. As per my records, payment was stopped by XXXX on XX/XX/XXXX. Therefore, the amount owed to the loan is {$54000.00}. This is the sum of 26 months of payments which when settled will consist of Principal, Interest and Escrow. Payment Errors : Your company rejected all payments made on XX/XX/XXXX. Please explain why this was so. Your company padded my mortgage balance with fraudulent charges and is still asking for {$84000.00} to reinstate my mortgage loan. Your company keeps adding on a charge call Property Inspection Fees in the amount of {$1000.00} per month. There is not property inspection fee as such. Your company asked for $ XXXXXXXXPlease provides me with a detail break down of how this amount came about. Escrow Errors : My monthly payment is {$2000.00} which included Principal and Interest, real estate taxes and Insurance. Therefore why are you asking for Escrow advances? Your company did not pay the insurance for XXXX, XXXX and XXXXyet it is included in the amount asking to reinstate the loan. I paid this insurance directly to the company. I have been notified by N Y XXXX XXXX XXXX XXXX and the Hazard Insurance Company regarding payments that your company failed to pay the following expenses from my escrow account. Fee Errors : Your company incorrectly imposed a Property Inspection Fee on the mortgage since XX/XX/XXXX. Please provide me with a copy of such a monthly inspection report. Payoff Errors : Your company failed to provide an accurate mortgage outstanding balance to reinstate the mortgage. Please provide me with a detail break down of my outstanding balance. After a mishap by my Property Insurance Agent who mistakenly did not report to my lender a copy of a valid Insurance binder as proof of my home owner 's insurance coverage, a force placed insurance was applied to my mortgage loan. The forced placed caused an escrow shortage which the servicer attempted to cure by increasing my monthly mortgage payment amount. This new mortgage payment amount proved to be a hardship to me which caused me to fall behind on my mortgage payments. After some months of trying to request a correction of the error. I was offer a Forbearance Plan by Kondaur Capital Corporation. However, in their effort to assist they made a fatal error that may cause me to lose my home. Attached is the letter written and dated XXXX XXXX, 2014 offering the Forbearance Agreement and the executed Forbearance Agreement. The problem is that the agreement directed for the commencement of the agreement initial payment to be paid by XXXX XXXX, 2014. This was a fatal flaw in the agreement. It provided only two ( 2 ) days. The letter was not received by the borrower thru the XXXX mail until the XXXX of XXXX, 2014. Nevertheless, the Borrower XXXX XXXX signed the agreement and mailed all XXXX of the required payments dated XXXX XXXX, 2014 to Kondaur Capital Corporation in advance in good faith ( proof is attached ). The Borrower subsequently received notice from Kondaur Capital Corporation that the Forbearance Agreement was cancelled because she paid the amount due after the required date of XXXX XXXX, 2014 as per the agreement. Months and months of trying to get someone at Kondaur Capital Corporation to acknowledge and correct their error went unanswered. To further exasperate this matter, Kondaur Capital Corportion refused to return the XXXX XXXX XXXX XXXX payments. Kondaur has since refued to work with me to correct their error and began foreclosure proceedings. To make matters worst, they transferred my the servicing and rights to my mortgage to XXXX XXXX XXXX XXXX in XXXX Florida. This new entity will not negotiate with me, will not cooperate to bring my mortgage current. In fact, XXXX XXXX XXXX XXXX is a XXXX real estate investment company whos objective is to accertain non-performing loans in the hopes of foreclosing on dismayed homeowners and reselling their homes at a higher profit. They make no bones about what they are doing. When you call their office at XXXX, they answer the phone inquiring " what property are you interested in purchasing and would you like a showing ''.

We were sold by XXXX to a servicer called XXXX in XXXX. That servicer joined another company and changed its name to XXXX XXXX. in XXXX. This is when our troubles began. XXXX/XXXX stated that they would be starting an escrow account for us because they alleged we had not paid property taxes. We should proof that these taxes were already paid and the company persisted anyway and started and escrow account increasing my mortgage by {$400.00} then added insurance ( forced placed ) which increased our mortgage by another {$200.00}. The company has refused to remove the escrow even after proof of their error was delivered to them as requested. Soon we could not make out mortgage payments. A QWR was sent to the lender and it was found that the note which is the basis of our mortgage was a forgery dating back to XXXX. XXXX XXXX then made forged documents claiming they were the servicer in XXXX when in fact the company did not have anything to do with us until XXXX when they partnered with XXXX and took over our loan. They have since sold the loan to XXXX XXXX in XX/XX/XXXX. We did a QWR to them also and not more than two weeks after receiving the documents and learning of the fraud the sold the loan to Konduar Corporation. I have sent this company a QWR request and found that XXXX XXXX has just within the past week submitted an assignment of the mortgage to KONDUAR claim ownership of the loan. I was notified that a debt that was incurred for personal family and household use- which i recently found out is an already prepaid item - had been charged off thus the company had been paid. I began received notices from XXXX companies stating that I owed them a debt - HOW DID THEY GET MY INFORMATION i never contracted with them, I never provided my information to them, I never gave my express permission for them to have my information. However, acting in honor, i requested information to prove the claim that i owed them anything and to prove that there had even been full disclosure and a meeting of the minds to create a contract - after 30 days of non response i sent them a cease and desist letter with a second opportunity for them to provide the info- they not only IGNORED MY REQUEST FOR INFORMATION but notified me that their response to my cease and desist notice was being sent through the United States Postal Service. Upon receipt of their certified mail response, it contained a threat - " notice of default and intent to accelerate and foreclose '' and " a notice of right to cure '' and were both manipulative and threatening and violates my rights under the consumer protection laws and violates Regulation Z. My affidavit and notice to cease and desist and request for debt validation and information request were never even addressed and no information was provided by them to prove their claim. They appear to be attempting to retaliate against me by asking them to abide by the law. They are trying to manipulate with to enter into a contract with them by manipulation and threats. I even went as far as to inform them that just in case this debt for personal household and family use were proven to be valid, I told them that all payments were being held in an escrow account so that they would know that I was acting in honor. They are still trying to contract with me even after i informed that I do not consent and rescind any known or unknown contracts that were not fully disclosed and agreed upon that may have been mistakenly or inadvertently established between us.

This complaint is against XXXX XXXX. I had a 15yr interest only mortgage which was coming due in early XX/XX/XXXX. I contacted XXXX in writing for a refinance or modification. This request was sent in XX/XX/2007. We were contacted by a XXXX Loan processor XXXX XXXX ( please see letter dated XX/XX/XXXX ) requesting contact to discuss my approval for modification. I did contact XXXX via telephone and made arrangement for a meeting at a local XXXX office in XXXX XXXXr ( XXXX XXXX XXXX in XXXX XXXX NJ ) .The telephone conversation was around XX/XX/XXXX. The date for the meeting was to be determined. Then on a letter dated XX/XX/XXXX we received a letter denying the modification. I made a inquiry as to why, the response was I had a bankruptcy and the mortgage was not reaffirmed. I told XXXX my bankruptcy was filed in XX/XX/XXXX and discharged in XX/XX/XXXX. My bankruptcy was filed according all the duties and responsibilties of USC 1996 Chapter XXXX and reaffirmed in compliance to section 524c and 524d. XXXX XXXX and all my creditors were contacted. From that point on we were sent payment stubs for voluntary ( as if I was still in the bankruptcy process ) payment.This is clearly a violation of my rights.Also XXXX miss-stated payments, wrong reporting to a credit bureau. Trying to explain this to XXXX fell on deaf ears. I was told they can do ( sent voluntary payment coupons ) anytime they want! The reason why I am logging this complaint is my home is currently in sheriff sale. To whom it may concern, I am writing this letter in regards of a recent credit check that I submitted and received. I am very concerned regarding an Adverse Account that was created by KONDAUR CAPITAL CORPORATE. This is a former mortgage loan I had in 2013. According to the credit check history, it shows a XXXX day past due payment for KONDUAR CAPITAL CORPORATE. I highly disagree with this information and its accuracy. I have paid on time since the loan commenced on XXXX of 2013, with the exception of the last month ( XXXX 2013 ) due to the loan was in the process of refinancing with a different mortgage company. The last payment was due on XXXX XXXX, 2013 and with a grace period to XXXX XXXX, 2013. The entire loan including the month of XXXX was ultimately paid off in full on XXXX XXXX, 2013. The pay off included a late fee of {$30.00} dollars was added to the invoice of XXXX and was also included in the payoff that was sent by the company that was refinancing my loan. In addition, all payments sent to KONDUAR CAPITAL CORPORATE was sent from XXXX XXXX XXXX XXXX a program that is directly enrolled to my bank account. This account has been sending the stipulated funds to KONDAUR CAPITAL CORPORATE on time. It should be noted, the original lender was XXXX and it transitioned to KONDAUR CAPITAL CORPORATE. Not sure if that had anything to do with it but according to my statements, all payments were made and received on time accept for the aforementioned month. There should be not derogatory information of a XXXX day past due from KONDAUR CAPITAL CORPORATE. I was current at the time of Hurricane Irma which we were declared on XX/XX/XXXX. On XX/XX/XXXX XXXX XXXX ( previous servicer ) put us on a 6 month FEMA disaster forbearance ( I am including a copy of the agreement ). At the end of the forbearance XXXX put us on another 6 month FEMA disaster forbearance starting on XXXX, XXXX ( a copy of the agreement is included ). This was granted because our damage wasnt significant enough to meet the deductible of the insurance to make a claim. The insurance company raised the deductible due to the hurricane to 5 % of the total value of the home instead of the {$1000.00} normal deductible. The deductible was then {$7000.00} so the forbearance was our only means of assistance to pay for the recovery. At that time we had a XXXX XXXX loan who promised to do a streamline disaster modification at the end. Then on XX/XX/XXXX we were hit by Hurricane Michael. XXXX was trying to find out from XXXX XXXX whether to do another forbearance or go ahead and do the modification. Because this was a complex issue with the second disaster they were waiting on XXXX XXXX for the guidance on what to do. On XX/XX/XXXX we received notice of a service transfer to XXXX finance so we were told the wait until we arrived at the new servicer to do the next forbearance or modification. Then on XX/XX/XXXX we received notice we would be transferred to Kondour capital starting XX/XX/XXXX who has refused to honor the previous commitments and agreements made by the previous servicer. How can you foreclose on a house that has not been mandated to back to XXXX XXXX County- while it is in federal court? On X/XX/17, I purchased a property from XXXX. Shortly, thereafter, I was called by a representative from Kondaur Capital Corp. stating they held a senior loan on the property ( taken out by XXXX XXXX, deceased ) that I purchased and demanded I complete a payoff to prevent foreclosure of his mortgage. ( Neither me or my corporation have any contractual obligation for those debts. ) During our email conversation, I instructed both both the representative, XXXX XXXX, and the main office that I only wished to be contacted in writing to the address listed on the state of Florida 's Division of Corporation for my corporation. However, they continue to email me to threaten me with foreclosure and to pressure me into accepting their offer for {$3000.00} in exchange for my deed in lieu of foreclosure for a property that I have over {$70000.00} invested in. Because I have consistently declined that offer and have stated that there would never be an acceptance of such an offer, continued emails to make such an offer are harassment, which is illegal. We sent the application documents to XXXX XXXX at Koundar Capitol and their counsel starting in XX/XX/XXXX. Each time, they denied the application in less than a week. They cited that they could not create an affordable payment each time and did not explain how this came to be. We sent another application and Notice of Error to Koundar in XX/XX/XXXX with updated income and expense information, explaining that there was a change in income and expenses, making their ability to pay an affordable loan payment more possible. Just as before, in less than a week, we received correspondence that they could not come to a term with an affordable payment. We have called the assigned SPOC, XXXX XXXX, XXXX times in three months, sent her over XXXX emails, and copied these emails to XXXX other individuals at Koundar Capitol. There has been no response aside from the canned letters with no detailed explanation. The last application we sent was XX/XX/XXXX and we received notice of denial dated XX/XX/XXXX, which is only two business days later. The whole purpose of the suit is due to wrongful foreclosure on XXXX XXXX, 2015. We have challenged Kondaur the proof of the matter, they refused to show up for Federal Court to prove themselves to be right in the First place. This was discussed on several occasions. They could not provide to us any evidence. Therefore, they did show up for Federal Court, nor did they respond to XXXX because Kondaur did not have any proof their only proof is to evaded in every way. The fact that Kondaur breach the loan modification and forbearance plan is evident enough. This case should not have escalated to this status. All Kondaur had to do was to continue the modification that was set forth by XXXX and continue to accept my payments {$1100.00}.. We disagree with the opinion of the court, we had requested a mediation and trial in person. Further documents will be filed as suggested.

Please refer to my previously filed complaint # XXXX after subsequently learning that my old mortgage company, XXXX XXXX sold my loan to GITSIT. I completed a short sale XX/XX/2016. Mortgage was paid in full, yet the accounts still appears on my credit report as delinquent. I've contacted all 3 credit bureaus about removing the accounts numerous of times. My request have been ignored. Can you please assist me? I feel like I'm being treated unfairly. My last attempt to remove these items cause my credit score to drop. This is odd to me because, my credit utilization lower than it has been in months. and my payment history is at 100 %. Even though I 'm eligible and can afford it, Kondaur Capital Corporation only offered me an unafforable payment arrangement. I received a letter on XXXX XXXX XXXX telling me that I was denied a payment arrangement because the payments that they want me to make are " unaffordable ''. They want me to pay my {$33000.00} in arrears over 12 months plus make my regular monthly mortgage payment of {$1400.00} which would total approximately a {$4100.00} monthly payment. Since XX/XX/XXXX I have been requesting a mortgage modification. The holder of my original mortgage was XXXX in Fl. After the federal government shut there office down, my mortgage was acquired by XXXX XXXX XXXX for over 4 years they never provided any paper work stating how and why they have my mortgage. I completed every request from XXXX to complete the documents for a modification with no success. Then I received notice that XXXX Mortgage is my new holder of my mortgage. Now, XXXX claim to have my mortgage. What are my rights? What documents am I suppose to receive from the mortgage that is true and legal. Is this legal?

KONDAUR CAPITAL CORP, is attempting to foreclosure on my property with a fraudulent robo signed document. XXXX XXXX sent someone to drive by my home, man started taken pictures and asked me if he could come in my house. Told him no he wanted me to call his boss.XXXX XXXX. In XXXX I was contacted by a GIT SIT SOLUTIONS stating they are the new loan servicer. Later they contacted me stating they are not only the Lender, but also the servicer. They stated they the alleged loan was transferred from XXXX XXXX XXXX XXXX XXXX XXXX. I have never had a contract with nor given consent to XXXX XXXX XXXX. I originally had XXXX XXXX as my mortgage company and I was on a forebearance with them because I was struggling in paying my mortgage every month so as of XX/XX/2023 XXXX XXXX sold my mortgage to Get Sit Solutions. Around the second or third week of XXXX Get Sit Solutions contacted me to let me know that they took over my mortgage from XXXX XXXX and I mentioned to them that I was on a forebearance plan and was I able to continue to be on the forebearance plan and I was told no because they did not offer it.

Kondaur Capital has not been reporting my payment history with the XXXX. I have reached out to Kondaur on numerous occasions and even followed their advice to create a dispute with XXXX.
