Around or about XXXX of XXXX I applied to purchase a XXXXXXXX XXXX XXXX I was financed by a company by the name of GFS II AKA/DBA GATEWAY FINANCIAL to complete this transaction. I paid A cash down Payment of {$1000.00} and despite me being the original creditor and upholding my end of the contract GATEWAY FINANCIAL Repossessed and sold said property belonging rightfully to me. Since said transaction occurred GFS has been reporting to the Credit bureaus that the account is delinquent and has a {$24000.00} balance with original amount being {$10000.00} and charged off. Notice, it is a fact, affiant is aware, in accordance with 15 U.S.Code 1662 ( b ) it is illegal to require a downpayment in conjunction with any extension of consumer credit unless the downpayment is in that specific amount for every transaction. I the affiant have reason to believe and do so believe, the down payment amount was unique to my transaction and therefore illegal to require as part of the transaction and thus should be remitted by { COMPANY NAME } if it was paid or not required by { COMPANY NAME } to avoid violation of 15 U.S.Code 1662 ( b ) and be liable to double the finance charge under 15 U.S.Code 1640 ( a ) ( 2 ) ( A ) ( i ). According to 15 U.S. Code 1602 ( f ) It is a fact, I affiant am aware, the term credit means the right granted by I, the original creditor, to a debtor GSW to defer payment of the debt or to GATEWAY FINANCIAL SOLUTIONS to incur debt or a loan from the US Treasury and defer its payment. This makes GSF a borrower or solicitor who induced me to the treasury window to receive funds unbeknownst to I, at the time of the transaction. I, the affiant, came to extend credit and not receive a loan from the U.S. treasury. The contract I received, as a result, was an unsolicited advertisement described in 48 U.S.C 227 ( a ) ( 5 ) by GATEWAY FINANCIAL and lack of willful full disclosure was the fraud of execution in conjunction with fraud of inducement brought forth by GFS. In conjunction pursuant to 15 U.S. Code 1602 ( g ) creditor refers only to a person, meaning not the organization but only a natural person, meaning I, the affiant and the consumer, who regularly extends consumer credit, in connection with loans, sales, property or services payable by agreement which a finance charge may or may not be required or the natural person whom the debt arising from the consumer credit transaction which may be payable on the face of the evidence of indebtedness such as a contract or by agreement. Pursuant to 15 U.S. Code 1602 ( i ) a consumer in reference to a credit transaction is the party whom credit is extended from is a natural person and the subject of the consumer credit transaction is primarily for personal, family, or household purposes. Whereas I am fully aware that when I deposited the Promissory note with GFS, the original bookkeeping entry showed an increase in the amount of the asset credited on the asset side of its books and a corresponding increase equal to the value of the asset on the liability side of its books. This would show that GFS received my signed promise to repay as an asset, thus monetizing ( securitizing the note ) my signature and creating on its books a liability in the form of a demand deposit or other demand liability of the bank. I am also fully aware Securitization is the process by which promissory notes are turned into securities or bonds and then sold to investors. The purpose is to provide a large supply of money to lenders for originating loans and to provide investments for bond holders. The procedure for selling the notes is to create a situation whereby tax laws are observed, and whereby the issuing entities and the lender are protected from either entity going into bankruptcy. In order to achieve this bankruptcy remoteness, numerous True Sales of the loans occur, in which the loans are sold and transferred to different parties during securitization. I am fully aware that a True Sale of the loan would be a circumstance whereby one party owed the note and then sold it to another party. An offer would be made, accepted, and compensation given to the seller in return for the note. The note would be transferred, and the security agreement assigned to the buyers of the Note, with an assignment or transfer made every step of the way, and furthermore, each note would be endorsed to the next party by the previous assignee or transferee of record. I am fully aware that Auto loans have been and are being bundled into auto loan asset backed securities and sold to the public as solid, income-producing debt investments similar to corporate bonds. Theyre marketed as secure products offering above-average interest. But while a bond may be backed by an issuing companys income and assets, these auto loan assets backed securities products are backed solely by a pool of auto loans. The loans are bundled, and the rights to receive the payments generated by the loans are sold to investors. The investors receive a monthly payment of principal ( to repay the borrowed money ) and interest, or coupon, which is the interest rate paid on the bonds. Since the note has been securitized and given to a trust to provide a stream of income for investors ( me ), it follows that the Note will be voluntarily destroyed by bifurcation and any depositors will be paid. As a matter of law, where the payee and the owner of the promissory note have voluntarily destroyed the same, he can not recover judgment against the maker either upon the note itself or upon the debt, which was the consideration for which the note was given. See, e.g., Booth v. Smith, 3 Woods, 19 XXXX XXXX XXXX XXXX XXXX XXXX. Term XXXX ). Once converted and sold, it is impossible for a promissory note and Security Agreement to ever be whole again existing as a negotiable instrument. That is to say, once converted into a stock/security ( or securitized ), that act of conversion impairs the validity and enforceability of a promissory note. It is destroyed and ceases to be a secure asset or negotiable instrument tied to any collateral or debt obligation. In essence, the note is destroyed and thereby, under multiple rulings, is nullified, and the underlying evidence and legality of the debt obligation secured by the note is voided whether or not the obligation has been paid. See e.g. District of Columbia v. XXXX, 130 U.S. 655 ( 1889 ), State Street Trust Co. V. Muskogee Electric Traction Co. 204 ( 1953 ) The Security is/are not backed by the Security agreement because when the note is bifurcated from the Security Agreement or otherwise voluntarily destroyed at the time of conversion to securities, the security agreement is either satisfied or nullified. There are no other eventualities. Notice, it is a fact, affiant is aware, whoever willingly and knowingly gives, false, inaccurate or fails to provide information which is required to disclose, or fails to comply with any requirement under the consumer credit protection title will be held to criminal liability pursuant to 15 U.S. Code 1611 with fines up to {$5000.00}, one year imprisonment or both.

This complaint pertains to Gateway Financial Solutions Cause No. XXXX Plaintiff Gateway Financial Solutions XXXX represented by XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX Phone : ( XXXX ) XXXX Gateway Financial Solutions XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX In XXXX XXXX XXXX, Gateway Financial XXXX interrogitoris to my personal bank account, XXXX XXXX XXXX XXXX XXXX XXXX XXXX responded and withheld funds from my personal account in the amount of {$160.00}. My current account balance at that time was only {$180.00}. The amount seized was in excess of the 10 % monthly amount allowed based on prior judgement for garnishment of my wages. Gateway Financial requested that these funds be withheld from my account prior to the supplemental proceeding which I was court ordered to appear. On XX/XX/2022 I appeared in court and submitted exemption for my personal bank account XXXX XXXXXXXX XXXX. The XXXX entered and order confirming the exemption of my personal bank account XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX was released as a garnishee defendant. Order was forwarded to XXXX XXXX Bank and my funds were released back to me. Since that date Gateway Financial did not have any other order from the Court stating that XXXX XXXX XXXX was to be listed as a Garnishee defendant in this matter. XX/XX/2022 XXXX was issued for Garnishment of my wages from Contracted employer XXXX XXXX. The order of XX/XX/2022 only listed XXXX XXXX named as XXXX. Gateway Financial voluntarily and intentionally provided the order dated XX/XX/2022 to XXXX XXXX XXXX in an attempt to withhold funds from my account in violation of the FDCPA subsection 808 ( 6 ) A by taking a non judicial action and withholding funds from my personal bank account. Gateway financial had no present right to posession of the the contents of my bank account which the attempted to claim as collateral by forwarding the order from XX/XX/2022 which was not meant for XXXX XXXX XXXX as XXXX defendant as they were not listed on the order. At this time Gateway has not filed for any supplemental proceeding attempting to reinstate XXXXXXXX XXXX XXXX as a XXXX defendant and therefore no right to seize assets in my personal bank account. On or about XX/XX/2022 my card declined. I called XXXX XXXX XXXX and was informed that the was a legal hold on my account in the amount {$410.00}. This left my account balance in the negative and overdrafted. I attempted to call the XXXX XXXX XXXX department but they were closed due to the XXXX and were closed also Monday XX/XX/2022. Thus leaving the contents of my bank account inaccessible to me for multiple days during the course of a XXXX XXXX I spoke with XXXX XXXX from XXXX XXXX XXXX department to verify these facts. It was confirmed that they had received an order from Gateway One Financial XXXX XXXX and that the order was not distributed by the court. The XXXX XXXX XXXX XXXX XXXX as the XXXX. Gateway Financial knew or should have known that the XXXX XXXX XXXX was not listed on the Order from XX/XX/2022 and that previous order entered on XX/XX/2022 released and exempted XXXX XXXXXXXX XXXX as a Garnishee thereby prohibiting Gateway Financial from attempting to contact or withhold assets from my bank XXXX XXXX XXXX XXXX XXXX XXXX released my funds back on XX/XX/2022 after we spoke and brought to their attention that they were not listed as garnishee on the XX/XX/2022 XXXX that had been sent to them by Gateway Financial. The preponderance of the evidence shows that Gateway Financial attempted to disable or retain posession of the contents of my bank account by sending an order to an already exempt and released XXXX. I financed a vehicle through Gateway Financial back in XXXX of XXXX - since then, I have maintained an excellent payment history with them ( per the attachments below ) - never more than 1 day late. In XXXX of XXXX, I lost my job and my wife lost hers due to illness, which left us both completely out of work. Upon obtaining my vehicle, ( in which, I was rushed into signing documents and got caught in a loan that is ridiculously upside down from the very beginning ) I was told by my salesman XXXX, that if anything ever happened to just reach out to them directly and they'll be flexible with me ... ..almost 4 years later ... this was NOT the case. It has been a living horror story with XXXX XXXX XXXX. I was able to notify and remain in good standing with all of our other creditors EXCEPT Gateway Financial. After falling on financial hardship due to loss of employment, In XXXX, I notified Gateway Financial of what happened to me and my wife - begging them for a lowered payment to try to maintain my vehicle or find out if there was any options to keep a negative impact from ruining my credit. They count the payments late but consider each month two payments because they are bi-weekly payments now versus monthly. I was in contact with XXXX XXXX ( senior account representative ) who always treated me poorly as if my financial hardship affected him directly. After speaking to him, many days I ended the phone call in tears due to the nastiness I experienced with this company. I reiterated over and over about how I've maintained an immaculate payment history with them and begged for options to avoid my vehicle being repossessed ... .after being lied to and declined for no probable cause, my vehicle was repossessed in early XXXX. After the repossession, I made contact with XXXX XXXX once again and as normal - he was very nasty to me. About 2 weeks went by without transportation, and I finally decided to call to see if there was some way of obtaining my vehicle back. Again, I spoke with XXXX XXXX and he LIED to me and advised that if I paid {$300.00} before XX/XX/XXXX - I would be able to avoid the impact of having a repossession hit my credit report and be able to hold my vehicle from going to auction. After that, I would then make payment arrangements to get my vehicle back. THIS WAS A COMPLETE LIE!!!! I have attached the proof as well. I never got my vehicle back ( it was sold ) and the payment arrangements did not stop the impact to my credit report. Gateway Financial also LIED about sending me out proper paperwork in a timely fashion, these people sent me paperwork on setting up a lowered monthly payment AFTER my vehicle was repossessed. I never received it, and I have several calls to them on a recorded line demanding my paperwork in a timely fashion. This has hurt my ability to obtain credit or move forward.

After XXXX XXXX XXXX ( dealership ) assigned interest in the retail installment contract I initially agreed to, Gateway Financial Solutions created a new contract without disclosing to me what it entailed, modified the numbers, and used this contract unlawfully to create an account in my name unbeknownst to me. I never understood the full entailment of this new contract and they took unreasonable advantage of my lack of understanding. They insisted and influenced me to execute a contract I had never agreed to. Not only just that, but they seized my property and sold it with all the belongings to me in it. They also have been unlawfully producing and transferring my personal information to credit reporting agencies without my consent on behalf of this account they fraudulently created. First I contacted the dealership, which conveniently ( sarcasm ) has gone out of business or have changed their contact information so much I could not find them. So I contacted Gateway to validate the information, where did they get this information ; they sent me payment history, my original credit application, and a retail installment contract that APPEARS to be the same contract assigned to them from the dealership. However when comparing the contract to MY original contract it is obvious that this contract that is on file with them has been fraudulently furnished. My signature is omitted in areas, the XXXX contract omitted, the itemization of the amount financed is totally different, what happened? I contact them over the phone, I sent them documents enclosed in this complaint and they didn't have much to tell me but I wanted them to block and remove this account from my credit report immediately ( this happened yesterday XX/XX/23 ). Gateway Financials ' agents ( specifically, XXXX XXXX told me that they didn't have a GAP contract submitted to them so I should go to the dealership for that ... well I contacted the XXXX people who have records of this still existing GAP contract for my vehicle because I paid for it and on it the assignee is indeed Gateway Financial. Weird. I come to the CFPB because this has caused so much damages to my credit worthiness, in fact, I JUST got denied for a simple XXXX XXXX credit card because of what they are fraudulently reporting against me on my credit report. This has happened more than once and I'm sure to several other people, I had to move to a new city, get a new job, and I still don't have a car! My auto payment was shot up and you'll see the deception in the documents because the cash price of this vehicle was XXXX dollars but on the contract it says over XXXX XXXX dollars, I was told this jump was because my credit but that's XXXX. Over XXXX XXXX dollars totally unaccounted for. This is totally unfair as a consumer and GOOD people get taken advantage of every day.

As of today XX/XX/2021, my affidavit remains unrebutted. Therefore, it remains a fact that the debt from the beginning is fraudulent. Gateway financial solutions is still in possession of my vehicle and have stolen from an address they did not have on file which is a violation and refuse to give it back at this point. Ive had to retrieve my items out of my vehicle just in case anything ends up stolen during this process, which was stressful and inconvenient. This is my 2nd complaint regarding the debt in question. On OXX/XX/2021, I spoke with XXXX an agent and supervisor with the company, she confirmed for me that they abide by the Truth in Lending Act, I then asked her if she was aware of the proper and lawful way to respond when a consumer sends a request for validation according to the law, she claims not to be aware, or could not remember. I asked her to reply to my affidavit with the requested documents, she exclaimed that she was not obligated to do that admitting that they have in fact not addressed all of my request. Its a fact that FDCPA has clear laws on what a debt collector is to do when the debt is challenged. Since the company refuses to send the proper documents requested, they were to stop all debt collection acts until the matter is resolved. They have decided to ignore my request, ignore the law, and continue with collection. Late XXXX Gateway Financial Solutions stole my vehicle AFTER I sent an affidavit and notice to validate the debt. They continue to respond in a dismissive manner. They have threatened to sell my vehicle on XX/XX/21completely disregarding the fact that I, in all my rights as a federally protected consumer have launched an investigation. l will not sit back and allow anyone or company to take advantage of and scam me, no matter how common this scheme may be. I asked in good faith, they ignored in dishonor. As of today XX/XX/2021, my affidavit remains unrebutted and stands as truth. It is my unalienable right and my right as a consumer to rescind any contract if there is evidence of fraud pursuant to 15 USC 1635. There has been no contract in place since XX/XX/XXXX when my initial affidavit was sent. Any power of attorney given has since been revoked. Since the company was not willing to provide me with the bilateral contract, which is lawfully binding and enforceable, proves one does not exist in fact XXXX confirmed that when I spoke with her on XX/XX/21. The unilateral contract that was in place proves that my signature and personal information was used to retrieve the credit that paid for my vehicle. I unknowingly gave the company my information to do so after being made to believe that I was receiving a loan from Gateway Financial Solutions or affiliates.

My truck was repossessed while I was in the hospital. I was in contact via email with a representative who was made aware of the situation. Upon logging in, it appears that my principal balance has not budged and I have had the loan for over a year. My {$400.00} a month is going straight to fees and interest. This is highway robbery. I have now investigated the finance company further and recognized that others have been victim to this company. They are a subprime loan company in the business of financing cars for higher than they are worth and then repossessing them as soon as they can. They then turn around and auction the car and garnish wages of the customer for the remaining balance ( well over what the car is worth ). XXXX XXXX XXXX and Gateway financial are in the business of ripping off desperate customers who have to get a vehicle right away for work purposes and are mislead. The truth in lending is not honest. I knew when XXXX at XXXX XXXX was having us quickly sign the paperwork that I should have had him slow down. He just verbally summarized each page we signed and I had no idea what I was getting into. I thought the payment was {$170.00} a month ( which would be fair for a used base XXXX XXXX that has been beat and wo n't run for longer than another year if that ). That must have been one of the pages that he literally summarized ( as they were closing at the time ) and flipped the page quickly. I had no idea I was signing for a 5 year loan of {$380.00} a month for this junk of a truck. I am under water in the truck and my finances. I tried to make it happen once I found out the actual monthly payment, but obviously I got a month behind and they just repossessed it even though I was in contact and informed her that I just had XXXX and was in the hospital. This financial institution combined with XXXX XXXX XXXX needs to be thoroughly investigated in regards to their loans. I did n't even think they were allowed to give a loan for more than the blue book value? I am so confused and feeling scammed. I tried to get through it and feel completely bullied and lied to. Now my fiance does not have a truck for work to even make the payments!!! I do n't know what we are going to do.

I received court documantation in regaurds to a vehicle that was sold to me stating that I am being sued for the balance of the vehicle after contacting the financial institution for a voluntary repossession when the vehicle having multiple issues from purchase finally broke down completely. My initial complaints weren't submitted to Gateways Financial 's representatives but to the dealer and to my salesman. It wasn't until later, after I'd gotten nowhere with the salesman as we couldn't agree on a time and date because of my work schedule and my at the time pregnant misses and our appointments that I expressed my displeasure with the representatives of the company by way of phine and email on how I'd been sold an unfit vehicle that had not been given it's multi-point inspection after being told by my salesman it had to ensure it's safety before the vehicle was sold. After performing my own inspection of the vehicle when winter finally broke and was able to do so is when I dicovered the issues that could have left me or my family seriously injured or deceased. Pertaining to the outer tie rod ends as they control steering. When one fails, the tire, if it's the front driver side slams extreme left, the front passenger side slams extreme right pulling the car in that direction and if not acted against immediately meaning would either send the vehicle and it's occupants ( myself or my XXXX lady ) into oncoming traffic or into a ditch, tree, embankment, etc. at 55 miles an hour as all main roads leading to towns are posted at that speed limit. I also submitted my at the time address of which the vehicle was located for pick up after the fuel pump expired expressing to the representatives that after all that had transpired up to the fuel pump failing that with a XXXX an at the time XXXX year old and my misses being out of work for 6 weeks recovering from a XXXX XXXX that I wouldn't be able to continue financially with repairs and a payment. Even after Gateway 's attempt to refinance me at a lower rate it still would not have been possible to pay for repairs, car payment, housing costs amd utilities with all that was going on..

FACTS INVOLVING THE REPOSSESSION The XXXXXXXX XXXX state that on XX/XX/2023 they made a partial payment to Gateway Financial in the amount of {$310.00}. Their required monthly payment was {$590.00}. At the time XXXX XXXX made an arrangement to pay the remaining {$280.00} and any late fees associated on Thursday XX/XX/2023. Gateway Financial continued to call repeatedly requesting payment and XXXX XXXX reminded them of the verbal agreement made on XX/XX/2023. XX/XX/2023 XXXX XXXX parked our car in front of our residence. XX/XX/XXXX, Thursday XXXX, XXXX XXXX went outside and noticed our vehicle was gone. XXXX XXXX contacted XXXX XXXX XXXX 's office and was advised our vehicle had been repossessed. They provided Me. XXXX with the location of the vehicle. XXXX XXXX went to see the vehicle and noticed severe damage to the vehicle and one or more flat tires. It was parked in the back of a business covered in mud. The car had been damaged in the repossession to the point that it is not able to be driven from the lot. Before the repossession the vehicle had no damage and did not have flat tires. Both parties state the following A verbal agreement was made for a payment to be made on XX/XX/2023. A partial payment was made on XX/XX/2023 in the amount of {$310.00} Gateway Financial continued to contact XXXX XXXX after making the verbal agreement and never once warned of scheduled repossession. Gateway Financial repossessed the vehicle on XX/XX/2023 in the early XXXX Gateway Financial sent a letter to both XXXX and XXXX XXXX that never disclosed the amount to get the vehicle back or location. Gateway Financial failed to protect the consumer from substantial loss. Gateway Financial engaged in unfair, deceptive and abusive acts when reposessing vehichle. Gateway Financial never sent default letter and chance to being current as required by state law for reposession Damages severely decreased value leaving large amount due on consumer Gateway took veh after being 17 days late on a half payment ALL DOCUMENTS PROVING FACTS AVAILABLE

My auto loan was financed though GATEWAY FINANCIAL out of XXXX, MI. My monthly payment was approximately $ XXXX/month. Around the summer of 2018 I unfortunately fell about a month behind on my car payment due to my employer eliminating my job. In the process of looking and interviewing for new jobs, I was making phone calls and leaving messages regarding my situation with XXXX at Gateway. No one from Gateway would return my calls. I then started emailing Gateway ( and XXXX ). And yet again, nobody from GATEWAY were willing to return my call or emails. This went on for about a month and a half. In XX/XX/2018 I sold my house. At that time I left messages and emails with XXXX explaining to him that I was going to be paying the car off once I closed on my residence but GATEWAY still repossessed my vehicle. In the mean time I left several phone messages with gateway explaining to them, that due to the fact that nobody wanted to return my calls or emails I was voluntarily allowing the vehicle to be repossessed. Later I received a letter stating they were going to take my vehicle to the auction for sale. This letter was received around 6 days before the vehicle was scheduled to be taken to auction. As I understand it, under state law I am allowed more time than 6 days to pay the vehicle off or rectify th problem. This did not happen ... .the vehicle went to auction and was sold for less then what was owed. This is when GATEWAY FINANCIAL started harassing me for the remaining amount of money owed on the vehicle. The amount they were asking for was more then the original amount owed. I made every effort to try and reconcile the situation but again, nobody would return my emails or phone messages. Now GATEWAY FINANCIAL is threatening to take my state of michigan income tax return for the outstanding amount owed?. I have disputed this with the 3 major credit reporting bureaus as well. And now when the covid -19 situation, things have not gotten any better. Please help. Thank You.

XX/XX/XXXX XXXX I had purchased a XXXX XXXX XXXX they picked the car out for me first of all. I purchased their insurance witch had a 7 day warranty on it. I had problems with XXXX and XXXX at XXXX in regards to collection efforts and unfair practices. XXXX released private/confidential information on my mother 's voice mail box regarding my account. XXXX has been less than cooperative in assisting me with getting my account on track. I was making additional payment amounts higher than the regular payment. They don't go by month, they go by days and count payments bi-weekly versus monthly as most companies do. This company is like a pay day loan when it comes to auto loans. I wish I had known all of this prior to getting involved in this loan. I was pressured at the dealership and rushed to signing papers that I was unable to read quick enough ( dealership scheduled signing right before close and rushed me through ). We have had job losses ( other signer who drives the vehicle ) and they have acted as a payday loan on this loan. This is where they are earning their money. They don't care about the customer keeping their vehicle. They are quick to repossess to earn more money. They repossessed the truck last night following my CFPB complaint last week on the breach of privacy and unfair collection practices last week. This should be considered and viewed as retaliation for my complaint as I even put in the complaint that I will be paying the loan on XX/XX/23 with my yearly bonus from my company. I had previously faced some hard times financially, and was in dire need of a vehicle. I was forced to finance through Gateway Financial Solutions, as they were the only lender willing to work with me. Because this lender deals with high risk borrowers, my interest rate was less than appealing by a long shot, but I felt that this was the only option available to me. I have since made a large progress on my credit and financial status, and feel that I should be allowed to clear up the matter with this lender. I have asked to be provided a " buy out '' option, and have not been offered anything. I have always made my payments on time, and they are slowly bringing the principal balance down. But the bulk of the bi-weekly payments ( due to the high risk that I previously was XXXX primarily get applied to interest. I am requesting assistance with this matter because I feel that the lender is not providing ethical service to me, by not allowing me to avoid the large amount of interest that will accrue due to the remaining time of the loan. This is striking as a predatory lending scenario simply because they targeted a vulnerable customer, and are profiting on my misfortune. This type of business practice should not be allowed. After my initial evaluation that was discussed over the phone with Gateway Financial 's representatives it was concluded that there were multiple suspension issues including inner and outter the rod end that reached the end of there life span, bad CV axles, bent rims, check engine diagnostics ran representing codes explaining that the intake and exhaust valve actuators weren't performing correctly or bad as a result of timing advancing because of the wear of the timing chain or set resulting in its advancement and the final result of which I was unable to continue payments was the fuel pump quitting completely leaving my pregnant lady and son stranded 30 minutes from our home.

In XX/XX/XXXX the engine on this car went out. I took the car to the dealership to see what it would cost for a new engine and they told me {$3500.00}. At that the time the car wasn't even worth that amount so I knew I wasn't going to pay that for a new engine. However I continued to make payments on this car until XX/XX/XXXX. I then was able to purchase a new vehicle. It was at this point I stopped making payments on the account and informed gateway that I wanted to do a voluntary repossession because the cars engine went out. My reasoning for filing this complaint is simply because I believe that I was intentionally sold a lemon vehicle. Within a month of me having the car the engine started to fail. The following complaint is against Gateway Financial Services at XXXX, MI for not sold a car in a commercially reasonable manner. I bought a XXXX Chrysler Voyage with approximated XXXX miles with auto lease from Gateway Financial Services in XXXX, XXXX. Having a financial hardship during XX/XX/XXXX-XX/XX/XXXX, I decided to voluntary surrender the car with Gateway Financial Services. At that time, I could not afford to make payments to the car. I surrender the car with XXXX miles in good conditions at XXXX, XXXX. The outstanding balance was {$8600.00} at XXXX, XXXX. After surrendered the car, I received a letter to notify me a deficiency balance for {$8500.00} because the car was sold by only {$510.00}. This is really suspicious since the car value was at least XXXX times more, and it represents 5 % of the outstanding balance at XXXX, XXXX. However, the problems do n't stop there because the company, Gateway Financial Services, sue me through the XXXX district court of the State of Michigan this XX/XX/XXXX for a value of {$13000.00}, where the balance was {$10000.00} and the interest accrued was for a value of {$3600.00}. Unfortunately, I was transitioning my home, and I could not object the garnishment on time. On XX/XX/XXXX I sent Gateway Financial Solutions an affidavit requesting proof under penalty of perjury that they are in fact the true creditor, and not an elaborate scheme. I have reasons to believe that Gateway Financial Solutions obtained payment for my vehicle by way of selling the promissory note I affixed with my signature on XX/XX/XXXX when the transaction was initiated. I requested documents proving the funds that paid the dealership for my vehicle in fact came from their own reserves. Its required under 10 Maxims of Law that a lien or claim can be satisfied only through rebuttal by counter affidavit point by point, that which Gateway financial solutions failed to do. Instead they sent a letter that adressed only 1 of my concerns. They provided the contract in question, which I did not request, and their license to do buisness in Maryland, which I did request. As of tofday XX/XX/XXXX my affidavit remains unrebutted. Some time between the night of Monday XX/XX/XXXX or the morning of Tuesday XX/XX/XXXX gateway financial solutions repossesed my vehicle despite being required to stop all debt collection activities until this matter is resolved, violating 15 U.S Code 1692c. On XX/XX/XXXX I recieved a letter threatning to sale my vehicle if payments to this alleged debt is not made by XX/XX/XXXX which is a violation of 15 U.S Code 1692d ( 4 ). Today is the 3rd time XXXX at Gateway Financial has contacted my family/friends without attempting to call me first. I have repeated asked that I be contacted first on my cell and at least give me an attempt to answer her call prior to contacting my family. I consider this harassment. In addition, I have repeatedly advised them that I will be getting a bonus on XX/XX/XXXX. They count the payments late but consider each month two payments because they are bi-weekly payments now versus monthly. I have paid well over what the truck is worth and still owe triple what it is worth. I got locked into this loan by a shady dealership (XXXX). I was rushed into signing documents and got caught in a loan that is ridiculously upside down from the very beginning. But I am taking ownership and paying it. I have gotten in a few situations financially with job losses of my fiancé and it has been a nightmare trying to deal with them through it. I had a truck loan that was repossessed unlawfully. The company turned around and sold the truck for way under what the truck was worth but continue to bill me for the remainder of the loan which is predominantly interest as this is a subprime auto loan. I have an attorney and they were notified that I was filing bankruptcy so they hurried to file suit. I became unemployed on XX/XX/2021. In XXXX, I fell behind in paying my car payment.
