The purpose of this email is to request that you investigate Geneva Financial , LLC regarding the processing of a conventional loan that I applied for and was supposed to close on yesterday, Friday, XX/XX/2020. The corporate address for Geneva Financial , LLC, is XXXX XXXX XXXX XXXX XXXX XXXX, XXXX, AZ XXXX, its NMLS # is XXXX, its BK # is XXXX, and its MA Lender # is XXXX, but this matter specifically concerns its XXXX branch. For background, I locked my interest rate at 2.625 % with XXXX XXXX ( NMLS # XXXX ) for a conventional loan on XX/XX/2020, but he is now attempting to anticipatorily repudiate that agreement and change the terms of my loan agreement unilaterally despite the effective loan estimate dated XX/XX/2020, that is still in place. There are a number of material differences between what's on the XXXX for the conventional loan, which is still binding until XX/XX/2020, has a XXXX interest rate, whereas the new rate that XXXX XXXX ( NMLS # XXXX ) offered was 3.625 % with a cost of " XXXX point ( investment prop hit ) plus fees total cost is {$9600.00} '' that he sent to me via email on XX/XX/2020. It should be noted that XXXX XXXX ( NMLS # XXXX ) was responsible for my VA refinance dated XX/XX/2020, yet he pushed me to try to pursue a VA home loan even though I had made it clear that I didn't intend to move from my current XXXX. This fact is reflected in the loan estimate dated XX/XX/2020. In addition, as further evidence of my intention to rent the subject of this mortgage application ( Loan ID Number XXXX ), I have also attached a copy of the signed lease agreement to rent XXXX XXXX, which I have always maintained would be the property would be an investment property, not my primary residence or owner-occupied property. On XX/XX/2020, XX/XX/2020, XX/XX/2020, and XX/XX/2020, I requested that Geneva Financial, honor the terms of the XX/XX/2020, loan estimate, which mandates a 2.625 % interest rate and estimated {$22000.00} estimated cash to close by contacting XXXX XXXX ( NMLS # XXXX ) branch manager for his office, and presumed supervisor, XXXX XXXX ( NMLS # XXXX ). As I intend to finalize this contract and move forward with the purchase of the property located at XXXX XXXX XXXX, XXXX XXXX, XXXX XXXX, CA XXXX, I requested that XXXX XXXX ( NMLS # XXXX ) and XXXX XXXX ( NMLS # XXXX ), inform me if Geneva Financial , LLC, would adhere to the terms as stated in the loan estimate dated XX/XX/2020, and not the terms that he cited to in his XX/XX/2020, email addressed to me, but neither man provided a clear answer nor did they take action to complete the transaction in a timely manner in accordance with the Loan Estimate terms from the XX/XX/2020, agreement. Please contact me as Geneva Financial , LLC, failed to perform and the closing date for the property located at XXXX XXXX XXXX, XXXX XXXX, XXXX XXXX, CA XXXX, passed yesterday on XX/XX/2020. Nevertheless, I fully intend to complete the transaction with another loan officer and lender, but would like for the actions of XXXX XXXX ( NMLS # XXXX ), XXXX XXXX ( NMLS # XXXX ), and Geneva Financial , LLC, at-large to be investigated for potential mortgage fraud and unscrupulous business practices. I would also like to discuss possible legal action related to XXXX XXXX XXXX ( NMLS # XXXX ) flagrant breach of contract and unilateral change of material terms, which I don't accept and would only proceed with under duress and/or coercion. I want to state unequivocally for the record that I never agreed to the terms of XXXX XXXX XXXX ( NMLS # XXXX ) XX/XX/2020, email, yet I felt pressured to move forward with his change of terms provided in his email dated XX/XX/2020, as well as to engage in mortgage fraud by falsely stating that I would be using XXXX XXXX as my primary residence even though XXXX XXXX ( NMLS # XXXX ) knew that I just refinanced my current condo under my VA XXXX loan entitlement at XXXX XXXX in the same building on XX/XX/2020, and I wasn't planning to move to XXXX XXXX after purchase.

We had found the perfect home for us when we visited XXXX XX/XX/2019 and made an offer. The sellers accepted our offer and we were put into contact with a loan officer who works for Geneva Financial XXXX XXXX. Things were going well at first, documents were provided as XXXX XXXX had asked for them. We officially moved to XXXX XX/XX/2019 and lived in a studio while our home was in escrow. Our home in XXXX was also on the market. We continued to provide documents to XXXX XXXX for the VA loan that we went with. Our home in XXXX sold and closed early XX/XX/2019. We had informed XXXX XXXX that we were putting $ XXXX down on to this new home as a down payment. We had been informed by XXXX XXXX that our home here in XXXX would close the follow day, not to worry as he had it covered. XXXX XXXX did not complete the loan as promised, he did not lock in our rate with the VA, he did not get the appraisal out on time. It would take him hours to days to respond to text messages from us. He would make every excuse in the book not to get back to us. We finally had to get his boss XXXX XXXX one of the 2 branch managers of Geneva Financial involved to get things done. Thinking this would be handled and we would be able to close on time. We explained the situation and how this loan should of not taken this long to close. XXXX XXXX insured us he would handle this and it would be completed in a timely manner. Almost 2 weeks had passed and we finally got the green light to go to title to sign our papers to close. My husband and I arrived to sign our paperwork, upon reviewing it within 5 minutes of sitting down they were WRONG. They wanted almost {$2000.00} more on the day of signing by check. XXXX XXXX was contacted and was asked to make this right for us as it should not take this long and have these many problems to close a home. XXXX XXXX stated legally he can not do anything but change the documents to add the $ XXXX into the sales price of the home and issue the CD all over again. My husband & I asked for his fees to be reduced, as this should of been caught way before the day of closing. He again stated he will not do that legally. His hands were tied and he made it quite clear it will not happen. He resubmits the CD same day. We review the new paperwork at XXXX and again it is wrong, the $ XXXX we wired as a down payment was now reduced to {$29000.00} and the house payment had increased. He rudely asked if he should cut us a check for the difference in the amount of {$6.00}. XXXX XXXX was again called and his response was that the VA will not allow odd numbers and there are a lot of moving parts on this loan. LIES as we have had a VA loan in XXXX. Again he was asked to reduce his fees not the federal fees but his broker fees to make this right with us. Again he refused and would not do this. XXXX XXXX is NOT an upstanding business individual. He is a disgrace to this company and to his church. If this is how he treats people at work and in is church stay away he is toxic. He does NOT have your best interest at heart. He is all about the Money. He even overcharged for a credit report. He had the nerve to text me the day of signing our paperwork stating that he knows I am frustrated but we could be good friends if I could get past this. No I do NOT need friends like this in my life. I DO NOT RECOMMEND ANYONE TO DO BUSINESS WITH GENEVA FINANCIAL. They will not get things done in a timely manner unless you have months to wait.

To whom it may concern, I have a complain against a mortgage company/lender ( XXXX XXXX XXXX XXXX XXXX ) that I started a home buying process with as well as the XXXX mortgage company ( XXXXXXXX XXXX XXXX which pulled my credit without authorization. The lender provided me an inaccurate preapproval. Which stated I had been pre approved for a mortgage so, I completed the process and paid a {$7000.00} earnest payment to the seller .... which I was fully aware was only refundable within 3 days period. I was not concerned due to the fact I was " preapproved ''. I've come to find out that the pre approval was not valid or I should say the preapproval amount was not correct which put me in a dilemma because based on the pre-approval I was advised of I completed the paperwork with the builder and also provided to earnest payment. I was confident that this lender had provided the accurate information which is why I moved forward and as well why the seller moved forward with me completing the documents. Days later after the lender was unresponsive I found out this lender moved on to a new company as well as running my credit XXXX weeks later from the initial pull, which I did not agree to. I did not sign any documentation with the new company, so that illegal. I had to call her to find this out after seeing my credit was run via a credit alert. She then advised, oh I forgot to tell you I'm with a new company. I didn't agree with moving on with her nor did I agree with her running my credit again XXXX weeks after initially pulling it. I had no idea this lady was moving she never advised me again I had to contact her to find out she was with the new mortgage company. I then proceeded to follow up with the initial company asking them if I could continue with them since I was already preapproved they were totally unaware that she was leaving the company at that time. Moving forward the seller tried to assist me with getting Approvals through different lenders to no avail, which now at this point because I was missed advised I'm at a loss. The XXXX new lenders were not able to finance me which I totally understand but now because of all the errors and misinformation from the initial lender, I'm losing out on my earnest payment???!!! I completely understand that the seller has no obligation to refund my earnest payment but the lender created this mess and I want my money refunded. I've contacted the initial mortgage and spoke with XXXX in servicing and the branch manager XXXX XXXX advising them of what the agent has done. The branch manager advised they were aware she was making mistakes stating this is XXXX of the reasons she is no longer with the company and they advise they would try to help as best they can. He also provided me the direct contact of the President if the company XXXX XXXX... this is a formal complaint against this agent XXXX XXXX and company XXXX XXXX and XXXX XXXX. This has been a horrible experience, XXXX lenders later to be told they have no idea how she got me preapproved?? Basically the earnest payment would have never been made if she didn't give this inaccurate information to me and the seller. Now I'm out of a large amount of money because this agent did not know what she was doing! Thank you.

Geneva financial created alleged money that was advanced on behalf of me from thin air by bookkeeping entry. They willfully and maliciously led me to believe they gave me a loan, in which I receive no alleged money.They did not disclose to me that my signature allowed them to create the money on my behalf. The money created never went into my account, nor did they disclose to me when they acquired the money through monetizing the note ( promissory note ). They led me to believe they were acting in good faith with clean hands and the alleged loan documents were lawful binding contracts. I was unlearned an unaware a novice to the laws and operation of the bank and real estate industry and this company took advantage of this fact to fraudulently deceive me. The alleged loan document contract is ultra vires, void by not meeting the lawful requirements of a contract, to wit : 1 A 'meeting of the minds ' did not occur ( full disclosure of the facts involved in the operation of the contract. 2. no valuable consideration was exchanged, on this note promises were made however I did give and ambiguous signature, they in return never signed, there was no risk or liability on their part, because no money was loaned. I am not liable by my signature as well. They did knowingly create fraud against me the proof which is on the the Summaries of transaction box 22 it clearly states " Total paid for by the borrower '' proving the home is already paid off by my signature but this company keeps sending documents through the mail misleading me to believe i still have an outstanding debt obligation.They too are threatening foreclosure action even though their first lien is past the 120 day STATUE OF LIMITATION .U.S.C.78c Section 10 violation of Regulation Z, violation of the code of federal regulation 12 CFR 226.23 and 12 U.S.C 226.23 Appendix H have all been violated which gives me right of rescission. Geneva Financial never disclose their note is a security. In selling my security to XXXX XXXX where is my portion of the dividends? Where is the interest from the money they are making through UCC 8-102. I have rights to the funding source which was my signature. They are not allowed to hold a note period. Nor or they allowed to loan their own money or depositors money, so where is the money coming from they loan me? They got the money from my credit. The security agreement was done in constructive fraud, and violates every disclosure requirements. Signing a note for me is fraud / lack of full disclosure and identity theft. Base off documents they made money off my credit 3 times, however it could be more. There was no disclosure stipulating the utilities left in the house, I was told all utilities left in the house belonged to me. A fridge, washer and dryer were stolen from the home which throws off all their loan calculations by XXXX dollars.

Back in mid XXXX of 2015 my listing went under contract. The buyer agent had sold me on the broker with Geneva Financial, a XXXX XXXX XXXX # XXXX, would be able to accomplish the deal. As the transaction proceeded, the bank who I represented agreed to do repairs to the roof for financing purposes. The finance broker agreed to pay for the buyer repairs. He the broker said he would build it into the loan. I verbally said, OK and he proceeded to have a firm enter and do work in the amount of {$3500.00}. Originally we were to close on XXXX/XXXX/15, and it was then extended to XXXX/XXXX/15 from broker request to finish up. Well it was still not meeting that close date as his people were not done or he had to anticipate other factors. I do remember the turning point was when his camp all of a sudden said they were ready to close and needed an addendum putting the XXXX vendor repair costs on the seller side to be approved. My asset manager said no way, that we had only approved for the roof. Well from that point on it got dragged out until I called the CEO of Geneva Financial and reported him. He made changes and we closed in one week. The bad behavior was his stalling tactics keep all parties with no direction for over three weeks. Well fell out of contract due to his in action. Also rude treatment of the buyer agent pitting her against the buyer who she had worked with for over 2 years. Also the escrow officer had to know the status and he 'd never return phone calls. Absolute rude, fowl language along with no follow up to anyone in the actual parties to successfully close. Buyers agent has XXXX or XXXX other deals with this guy so he 's treating her badly as he knows he can control the way the financing goes with them. I will never use nor recommend this broker to anyone and he should be investigated for the behavior alone. To end the buyer had over 30 days to wait because of his stalling tactics. I accused him early on that he was holding hostage the loan for his own benefit thinking someone would pay the {$3500.00} that he had some idea would go on the other side of Hud statement and no one would detect, what an XXXX. Completely unprofessional in that he 's not truthful, lies and abusive.

I applied with Geneva financial in XX/XX/2020 when Covid hit. When housing market fell due to Covid I no longer qualified for loan, however when it began to open back up I was able to qualify and was eventually approved for FHA loan. I received approval through AUS system and underwriting. Loan officer XXXX XXXX said I could close XX/XX/XXXX. However, this was moved to XXXX due to incomplete paperwork. I was then told I could close in XXXX and that my file was completely normal but paperwork was again missing because I had to apply for new FHA case number and get a 2nd appraisal done. After that was completed, I was told I could close but XXXX DPA paperwork was not completed. As a result of disorganization of loan officer XXXX XXXX, XXXX XXXX, and, processor XXXX XXXX, I was never able to close. I believe this was racial discrimination becsuse my file was perfectly fine after the market opened back up in XXXX and I received approval from XXXX along with closing disclosures. There is no reason why it was XXXX and I still was not able to close other than they were purposely delaying the loan because I was a minority. I want this marked on XXXX XXXX 's file as racial discrimination and lack of organization. I chose not to disclose my race for this very fact, however they put it on my application anyway without my permission.

Started a refinance with Geneva Financial on XX/XX/2015 with XXXX XXXX, received Good Faith Estimaterate of XXXX. Due to internal company policies, XXXX had to hand me off on XX/XX/2015 to another loan XXXX XXXX XXXX ( Branch Mgr/Senior Mtg Originator ). On XX/XX/2015 received another XXXX XXXX XXXX loan rate of 4.250. These were the last papers I signed. On XX/XX/2015 I received ANOTHER Good Faith Estimate loan rate of 4.625, within days of closing. To get this far I had to back date documents per XXXX 's instructions, and DO to the extremely lengthy time frame, I needed to get a XXXX home appraisal at a cost of {$450.00}. I did not close on the loan do to the high interest rate, and in checking the average loan rates as of today ( XXXX/XXXX/15 ) are 4.125 - 4.250.

We were assured that we could apply for a loan and that the application process would be simple. The mortgage company misled us and requested voluminous documents without disclosing that the application process would be extremely burdensome. I complained multiple times to the mortgage company, but they have deferred to their underwriter who keeps creating new requests. These delays are going to cause us to incur a late payment penalty with our current mortgage because we believed the mortgage company was that a decision would be made after we complied with prior requests for documents.

I was an independent contractor for this company. I discontinued my relationship because they didn't offer what was advertised and demonstrated misleading, and in my opinion, unsound contractual/managerial tactics. In addition, the marketing platform they provided via XXXX Search misinterpreted my services and was suggestive in nature. I sent an e-mail to their marketing department to remove my name from XXXX XXXX, but it was not completely done.

The loan officer threatened to disqualify the buyer if I issued a cure notice. Loan doc 's were not at title 3 days prior to the close of escrow date. Clearly a breach of the purchase contract. I was protecting my seller.
