ON XX/XX/XXXX I RECEIVED A PHONE CALL FROM A REPRESENTATIVE WHO DID NOT IDENTIFIED HERSELF AND DID NOT WANT TO IDENTIFY THE COMPANY NAME. THIS PERSON INFORMED ME THAT I OWED A BALANCE OF OVER {$11000.00} FROM A GYM MEMBERSHIP FROM XXXX. THIS PERSON PROVIDED INFORMATION WITHOUT VERIFYING MY IDENTITY FIRST. ALSO, STARTED THREATENING ME THAT IF THE BALANCE WAS NOT PAID BEFORE XXXX XXXX THE SAME DAY, THEY WOULD SUE ME AND GARNISH MY ACCOUNTS. ADDITIONALLY, THIS PERSON ASKED ME TO NOT HANG UP UNTIL I COULD MAKE THE PAYMENT BY PHONE. UNTIL THIS POINT, I STILL HADN'T RECEIVED INFORMATION OF THE COMPANY THAT WAS REQUIRING PAYMENT. I ALSO AKSED IF THEY COULD SEND ME ALL INFORMATION AVAILABLE BECAUSE I WAS NOT SURE OF THE VALIDITY OF THE DEBT. THIS PERSON SENT VIA XXXX MESSAGE A PHOTO OF MY FORMER ID AND A COPY OF THE GYM MEMBERSHIP AND AGREEMENT WHICH WAS NOT UNDER MY NAME I WAS JUST THE " BUYER '' NOT THE GYM MEMBER. THOSE PICTURES WERE SENT ALONG WITH THE BANK INFORMATION WHERE I SHOULD MAKE A DEPOSIT. THE MINI MIRANDA WAS NOT PROVIDED NOR THE EXACT AMOUNT OF THE DEBT, THEY OVERSHADOWED MY RIGHTS TO VALIDATE THIS DEBT WITH THEIR THREATENING COLLECTION TACTICS AND MISINFORMATION. SINCE I WAS WORRIED AND DO NOT KNOW ABOUT THESE KIND OF PROCEDURES, I CALLED AND AUTHORIZED A REPRESENTATIVE TO CALL AND RECEIVE INFORMATION. MY AUTHORIZED PERSON SPOKE WITH XXXX XXXX AT XXXX ( PUERTO RICO 'S AREA CODE ) WHO AT FIRST DID NOT WANT TO IDENTIFY HIMSELF OR WHERE WE WERE CALLING, AFTER EXPLAINING AND DEMANDING MORE INFORMATION, THIS EMPLOYEE SAID THAT THEY WERE A COLLECTION AGENCY LOCATED IN XXXX, FL AND OPERATING UNDER THE NAME GENESYS NATIONAL RECOVERY. WE ASKED IF THEY WERE LICENSED TO COLLECT IN PUERTO RICO AND THEY RESPONDED YES. WE ALSO ASKED WHICK ATTORNEY DID THEY REFER THESE ACCOUNTS TO AND HE DID NOT PROVIDE THE INFORMATION UNTIL A WHILE LATER. HE MENTIONED ATTORNEYS XXXX XXXX AND XXXX XXXX XXXX. HE CONTINUED THREATENING WITH PURSUING LEGAL ACTION IF THEY ACCOUNT WAS NOT PAID AND KEPT MENTIONING XXXX XXXX WHO WAS THE PERSON THAT ACQUIRED THE GYM MEMBERSHIP. I REQUESTED ALL DOCUMENTS AVAILABLE TO BE SENT TO XXXX AND WE ENDED THE CALL BECAUSE THE AGENT INSISTED THAT WE SHOULD READ THE CONTRACT TO UNDERSTAND ITS TERMS AND CONDITIONS. WE ENDED THE CALL INFORMING THAT WE WOULD SEND A CEASE AND DESIST REQUEST AS WELL AS A DISPUTE BECAUSE THE SIGNATURE ON THE AGREEMENT IS NOT MINE AS WELL AS THE GYM MEMBERSHIP. I HAVE NEVER BEEN NOTIFIED BY THIS COMPANY REGARDING THIS DEBT ALTHOUGH THEY SEEM TO HAVE ALL MY DEMOGRAPHIC INFORMATION UP TO DATE. TODAY, XX/XX/XXXX WE RECEIVED VIA EMAIL, AS REQUESTED, A COLLECTION LETTER WITH TODAY 'S DATE WITH A TEXAS ADDRESS ALONG WITH THE SAME AGREEMENT SENT YESTERDAY AND A DOCUMENT SIGNED BY A CEO AUTHORIZING THIS COMPANY TO COLLECT A DEBT WHICH DOES NOT SEEM OFFICIAL AND DOES NOT REPRESENT A COPY FROM THE COLLECTION LICENSE PROVIDED BY DACO ( CONSUMER AFFAIRS DEPARTMENT IN PUERTO RICO ). ALSO, THEY HAVE BEEN CALLING ALL NUMBERS NON-STOP THROUGH DIALER SYSTEMS AFTER I'VE REQUESTED TO STOP ALL CALLS. THEY ARE ALSO REFUSING TO CONTACT MY AUTHORIZED REPRESENTATIVE ALTHOUGH I HAVE ALREADY REQUESTED THAT ALL COMMUNICATIONS MUST BE DIRECTED TO HER. I CAN NOT BELIEVE THERE ARE STILL COMPANIES THAT MAKE BUSINESS THIS WAY, THREATENING CONSUMERS AND MISREPRESENTING THEMSELVES AS WELL AS PROVIDING ERRONEOUS INFORMATION.

I signed a contract with XXXX XXXX XXXX on XX/XX/XXXX. The contract was for 36 months and it was checked with a NON-RENEWAL AGREEMENT. After the 3 years, in XX/XX/XXXX, I was done with the gym and thought that was the end of it. But XXXX XXXX XXXX wanted to keep charging me alleging that it was a 48 month contract. After sending evidence proving them wrong they stopped calling to harrass me. But 2 years later, in XXXX, I got harassing calls from Genesys Recovery debt collector. I explained to them that they were mistaken and that my case had been resolved and that I paid my 3 years as stated in the contract. But they kept on harassing me over the phone and never gave me written notifications that I demanded from them so that I could see what prove they had that I owed XXXX XXXX XXXX any money. They stopped calling again after I sent a copy of my contract, again, to XXXX XXXX XXXX. On XXXX I began to get calls, once again, from Genesys Recovery employees. The last call I got was on XX/XX/XXXX, it was from a men stating that he was and employee from the Department Of Justice saying that I had been sued by Genesys Recovery for breach of contract. It was very strange that this person called me on a Saturday from a cellphone and didn't give me his name. I thought to myself that this wasn't the correct procedure to inform a lawsuit. When the men asked me my postal address I hanged up because it became obvious it was a scam. I called the Department of Justice on XX/XX/XXXX to inform them of this situation, that someone was impersonating a public government employee and they also verified that it was all lie and that there wasnt any lawsuit against me. The lady told me a government official would never call anyone to inform a lawsuit. I hope others can benefit from my experience and that the CFPB can help in this matter.

My XXXX XXXX contract number : XXXX The gym, XXXX XXXX, continued to charge my credit card after hurricane Mara hit XXXX XXXX on XX/XX/XXXX ; a hurricane category 4 that caused widespread destruction and left the island without electricity. After the gym reopened in XXXX they stopped charging my credit card, causing my account to be delinquent. The credit card company had not blocked the charges ; XXXX just stopped charging my account and eventually referred me to a collection agency. It seems that indeed I was wrongfully reported to the credit agencies because even though on XX/XX/18 I made the payment for the months that XXXX said I owed, I received calls from the collection agency on XX/XX/XXXX and XX/XX/XXXX. On those 2 occasions I informed the person that I did not owe anything to XXXX and, after checking, they admitted that I was right. On XX/XX/XXXX I received 2 calls from that agency ; the first one was to check if I was at home because I was going to receive a subpoena to seize assets for the outstanding balance with XXXX, and the second one was to say that they made a mistake. On that call I forbid them to ever call me again. On XX/XX/XXXX I sent an email asking for the name and address of their collection agency. I am still waiting for the information. On XX/XX/XXXX, my lawyer sent XXXX management a letter via email requesting the same information reply has been received. Included below are : the contract with XXXX, the emails relating to requests of information, and the ones that indicate the name and postal address of the gym and the telephone number of XXXX XXXX XXXX.

I began a membership on a local gym. I had visited the gym just a couple of times before I was forced to stop due to work. I had requested a cancellation in XXXX, but because of health and work reasons I did not follow up. They would still debit the monthly payment right up to XXXX of this year when I had to change my debit card. After a couple of months, in XXXX, they contacted me about the debt. They said that it could affect my XXXX XXXX, and even called XXXX of the contacts I had provided. I told them that I was not prepared to pay the full amount, almost {$600.00} at that moment, but, if we could reach an agreement, in about 30 days I would be able to cancel the debt. They said that it would be referred to a collections company. At the moment, I thought that it would be better since I could come to an agreement with the collections company. On XX/XX/XXXX I received a call from XXXX at Genesys Financial, who began the conversation saying that he was calling to ask for my legal representation information because a legal process would be beginning against me because of the debt. I felt threatened. He did not inform me if the call was being recorded or not. He then continued to say that I had refused to pay the debt when I specifically told the person that had called before that the payment would be made in 30 days. He informed me that the debt now was {$1100.00} approx, and that I had until tomorrow, XX/XX/XXXX at XXXX to make the payment. He sent information regarding his company, but the company 's name on one of the documents does not match.

The debt collector contacted me by phone, on XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX and XX/XX/XXXX and didnt identified the debt. On the last message whom ever called used bad XXXX words and this is unacceptable. Previous calls were in XXXX, XXXX and XXXX to the extent they contacted my girlfriend which had nothing to do with it and provided her information regarding the debt collection and also threaten with legal actions. On XX/XX/XXXX XXXX XXXX Account Consultant from Genesys National Recovery , Inc . XXXX XXXX XXXX XXXX, XXXX XXXX City, TX XXXX Direct Phone : ( XXXX ) XXXX Office Phone : ( XXXX ) XXXX sent an email stating I owed {$590.00} from XXXX XXXX in XXXX, XXXX. When I had previously already stated in XXXX that based on XXXX reasons I could no longer attend and based on the XX/XX/XXXX XXXX XXXX situation it was a health risk to attend. The Government of XXXX XXXX since XX/XX/XXXX has all these facilities closed additionally there is a class action law suit against XXXX contracts In XX/XX/XXXX I came to an agreement to satisfy such debt so they stoped harassing with taking me to Jail, law suits, garnishments and legal actions. Since XX/XX/XXXX Ive been emailing the collection company to stop harassment and disputing the debt. They have not answered as well they did not answer a previous complaint for similar reasons with this same Consumer Finance Agency. They have not responded to my dispute email and I have sent them over 4 disputes to the same emails they have previously written to me.

On Thursday XX/XX/XXXX of 2023 a representative from Genesys National Recovery called my XXXX mother 's phone regarding a debt with XXXX XXXX. I enlisted in the gym due to an offer i got because of my previous employer, after i ended my working relationship i tried to cancel membership to no avail. In the call that was recorded by my parent, you can hear the representative letting a third person ( my mother ) that was listed as an in case of emergency contact, that i owed a debt for XXXX dollars and that they were going to seize my salary for the total amount of XXXX dollars, that included lawyer fees. They are breaking the law and the fdcpa by telling an un authorized third party about a debt not pertaining to them. Also, they called her repeated times today untill she picked up, about 4-5 times, my mother have health and XXXX issues that aggravate due to stress. This company have my number and my email and they only contacted me once to settle debt in full. I told them i was unable to pay full and wanted to pay in installments. They said it was not an option. They also told my mother that i refused to negotiate. Please make this type of debt collecting stop, its affecting my mother 's and my mental health.

Date : of emails of debt collection, threats of law suit increase debts and degradation of credit to credit bureaus. XX/XX/XXXX ; XX/XX/XXXX ; XX/XX/XXXX ( 4 emails ) XX/XX/XXXX By phone : Since XX/XX/XXXX up to now to many calls at different hours early morning and even night, to my phone and even my girlfriend and they gave her false information. Threats to send police, law suits, etc ... They started with amounts of {$1500.00} then agreed to half but made if paid in full. Made a payment to cancel the account for an amount of {$550.00}, but received a letter stating the debt was canceled for {$450.00} leaving a {$100.00} balance positive. Today I received another email from the collector stating I still owe {$590.00}. Since COVID19 XXXX Ive not been able to generate income because I can no longer work. This was a gym which I stoped attending cause of Health reasons and the contract was until XX/XX/XXXX to my understanding they extended to XX/XX/XXXX. The calls come from FL area code XXXX, from TX and PR. To my understanding I made an agreement on the account paid over the amount agreed and still now they are coming back.

I enrolled in the XXXX gym in XXXX. For XX/XX/XXXX, request by phone that I be unsubscribed from the membership. In XXXX I requested it again and they charged me nothing until XX/XX/XXXX without me going to the gym {$43.00} every month plus the membership of {$44.00}. Several times I called and to have the membership canceled and nothing. I closed the option in my account for debit and in XX/XX/XXXX, without sending a letter or anything, they call me from a Genesis Collection Agency and they tell me that they are going to seize me and damage my credit for not paying something that I have not used. I explained and requested the investigation of my case and nothing has continued calling without solving my request. I need help, They want me to go to the gym in times of pandemic and they want to force me and I don't want to go. Last week I got a call from the gym saying that if I sign a new 2 year contract, they will eliminate my debt at the collection agency. Please help me, I'm desperate. Thank I include a certified letter that I sent to the gym and the collection agency and never received a response.

this XXXX XXXX claims I did not cancel properly my contract, which I did in XXXX, and now with no information I am being notified that I'm being sued unless I pay {$4500.00} or they will report my credit which is fine at the moment, nothing was ever there from them, in my credit report, and they will cancel my pay and take anything and everything they can from me. they claim to have a contract, that they send me a copy, but I canceled them in writing in XXXX, aparently they miss placed it and now after 21 years they want to me to pay. my computer was hack minuites before the call. I do not have any evidence of cancelation due to the time that has gone by. I notified a lawyer on line and she suggested to contact you, please help

In the month of XXXX, the company Genesys National Recovery contacted me through XXXX XXXX asking me where I was since he was going to serve me with a legal summons. of a letter that several indicated that I owed {$490.00}, at that moment they told me that if I did not pay him XXXX they would summon me for a legal case. pay that amount in several installments within 45 days. On XX/XX/XXXX they write me again indicating that I owe XXXX dollars from the same gym. I told him that I had already paid him and I had no more money. After that they call me during my working hours and they have made 5 call attempts in 4 minutes. my financial and mental situation has been affected by harassment from Genesys Nationals Recovery.

The debt collector called my coworkers, whom numbers was provided due to a referral documented I fill out at the gym. These numbers were referrals so they would also assist to the gym, it was not for them to collect a debt and they gave personal information to my coworkers about my debt. I told them that they were harassing my coworkers.told them not to call nor text them again.

Genesys-XXXX XXXXXXXX XXXX for XXXX calls multiple times per day ( up to nine times ) and sometimes less than five minutes apart. They call seven date per week and from fake numbers with many different area codes.I have a debt management plan thorough XXXX XXXX XXXX and they have been paying this debt since XXXX of XXXX and the payments have all posted to my account.
