I received an employment offer from XXXX XXXX cable in XXXX XXXX on XX/XX/2016 pending a consumer background report investigation which was subsequently performed by General Information Services ( GIS ) based out of XXXX, XXXX. I then received an adverse action letter from GIS followed by an email from XXXX XXXX informing me the offer had been rescinded due to criminal conviction information reported by GIS. GIS reported criminal convictions to XXXX XXXX that antedated or preceded the report by more than 7 years which is a violation of XXXX Law, specifically XXXX Business and Commerce Code Chapter 20.05 which states : Sec. 20.05. REPORTING OF INFORMATION PROHIBITED. ( a ) Except as provided by Subsection ( b ), a consumer reporting agency may not furnish a consumer report containing information related to : ( 4 ) a record of arrest, indictment, or conviction of a crime in which the date of disposition, release, or parole predates the consumer report by more than seven years ; ( b ) A consumer reporting agency may furnish a consumer report that contains information described by Subsection ( a ) if the information is provided in connection with : ( 1 ) a credit transaction with a principal amount that is or may reasonably be expected to be {$150000.00} or more ; ( 2 ) the underwriting of life insurance for a face amount that is or may reasonably be expected to be {$150000.00} or more ; or ( 3 ) the employment of a consumer at an annual salary that is or may reasonably be expected to be {$75000.00} or more. ( b-1 ) A consumer reporting agency may furnish to a person a consumer report that contains information described by Subsection ( a ) if the information is needed by the person to avoid a violation of 18 U.S.C. Section 1033. The salary offered to me for this position as a Call Center Customer Retention Rep was {$13.00} per hour or {$28000.00} annually. I want to file a compliant that my FCRA rights were violated by GIS by the reporting of criminal convictions to XXXX XXXX cable that were in fact, older than 7 years, which directly led to my employment offer being rescinded, and caused harm to me.

On XXXX XXXX, 2017 I applied for a XXXX XXXX position with XXXX XXXX XXXX XXXX XXXX in XXXX, Utah and told the HR Manager that I did have XXXX XXXX from 9 years ago. On XXXX XXXX, 2017 I received my background report from GSI ( General Information Services ) and on the report they had listed my charge as XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX ( on page 3 ) which is the correct charge but on page 2 under grading results they had grouped it with XXXX XXXX. I immediately filled out the dispute form stating that no where in my record was there anything close to XXXX. On XXXX XXXX, 2017 I spoke with XXXX XXXX about the dispute and she told me that there was nothing GSI could do about the grading results, she said that XXXX groups like charges together. I told her that the charges were n't even in the same category and that I wanted it removed immediately, to me this is defamation of character. She basically told me that it did n't matter that I and XXXX 's were the only ones that would see this, I still told her that this was unacceptable and that it was sent on GSI 's company letterhead and so therefore I would hold GSI responsible. On XXXX XXXX, 2017 I received another letter from GSI stating that they had not changed anything on my report. I can understand not getting the job due to the charge but I refuse to have my charge grouped in with anything like XXXX. I feel that if they did this to me they are doing this to others and it 's not right. I have contacted several agencies and they agreed that I needed to file a complaint. I sent all of my court papers to GSI in my dispute letter and feel that they are responsible of a gross injustice by grouping the charges where they are so different. I believe that they should be held legally responsible for defamation of character and they need to be investigated for false reporting and should n't be allowed to group such different charges together. I take ownership of my past but refuse to have anyone accuse me of something such as XXXX XXXX

I was hired by XXXX and two days after being hired, and doing work for XXXX, was told I had to be sent home because I had apparently falsified something on my application. I was provided a copy of my consumer report from GIS, the company that runs the reports for potential employees, and discovered XXXX issues : Another person 's name, " XXXX XXXX '' was under my SSN, and also my criminal history was being held against me as being falsified for not supplying any information ( their online application did not ask me to submit my criminal history, just to consent to a background check, and on my consumer report this is listed as " not provided / non-applicable '' ). I was told I had 5 days to dispute these findings, but was notified by XXXX that I was already terminated based on these findings before any disputes were even reviewed. I faxed GIS a dispute form with a copy of proof of identity ( my Social security card ), and mentioned several times the application process never requested my criminal history ( all of which was disclosed at the interview anyway ). It has now been 5 days, and I have not heard back from them and I still do not have a clear answer from either GIS or XXXX as to what was " falsified '' on my application, so my attempt to prove or disprove anything within the report is speculative at best. I have faxed, called, and emailed both companies at several levels, and still received no explanation for what they believe was falsified, and have been told multiple times that I am already terminated because of information found in my Consumer Report provided by GIS, despite the review process not even being completed yet. This is against my rights under the FCRA.

On XX/XX/2018 i applied for a job at XXXX XXXX as an XXXX XXXX XXXX out of XXXX TX. On XX/XX/XXXX, i was given a verbal job offer from a hiring manager on condition of passing a XXXX screening and background check. I received an email from General Information Services asking that I provide my driver license number and social security number. A week later, I received an email from General Information Services requesting I sent a copy of my foreign passport from XXXX. I then received a form asking for my consent to run an international background check. The form asked for me to provide my XXXX National ID number. It is unclear what led GIS to believe i was in possession of a foreign passport and national ID number ( other than for discriminatory reasons ). I provided all requested documents and was told it would be investigated. I called several times to check on the status of my report, as international background checks are known to take some time. Each time I was told they had no information and were not required to provide me what they had. Eventually, on XX/XX/XXXX, I called the office of GIS and requested that I receive a copy of my report as it had taken more than 30 days and I was no longer interested in employment at XXXX because I was told I could not start if the background check was not finished. I was told a report would be sent to me and subsequently one was never sent, This is a violation of the FCRA and it is my fervent belief that I was discriminated against because of my religion and ethnic origin that I was forced to provide extra documents.

I applied for employment with the XXXX XXXX company and was offered a position. They conducted a background check and credit report, which I agreed to. The company that provided the report is GIS. The only thing that showed up on that report was a criminal charge that was in public record. I have not been convicted of anything, as this is still an ongoing case. I spoke to the manager at the XXXX XXXX location that I was offered the position at and they informed me that, due to that charge showing up on that report, they were retracting their offer for employment. I contacted GIS to discuss this matter and they told me as long as it is public record they can report anything, regardless of conviction status. Also, the arrest date in the report is incorrect. I have been completely honest with XXXX XXXX throughout the entire hiring process. I disclosed all charges that I had been convicted of, which is all that was legally required of me according to my attorney. This report essentially makes me appear dishonest. Also, in the section on the report titled " Social Security Validation and Death Master Index Check '', the company reported that my Social Security number was issued between XXXX and XXXX. It was actually issued in XXXX. This report is riddled with inaccuracies and I consider it detrimental to my future employment opportunities with XXXX XXXX or any company that uses GIS for credit/background reporting. I have a child on the way soon. I can not afford for this type of mistake to hinder my financial future.

Hi, i had two police traffict tickets for XXXX XXXX XXXX XXXX XXXX XXXX : the first ticket was inXX/XX/XXXX or XX/XX/XXXX and the second police ticket was at the end of XX/XX/XXXX or beggining of XX/XX/XXXX. Now i received a letter from the company i applyed to work with that my criminal record it is still available or funtioning from XX/XX/XXXX until XX/XX/XXXX and the criminal report does not specify that was a XXXX or XXXX XXXX XXXX XXXX XXXX XXXX. The job fair that i attended was organized by the career source of XXXX XXXX where i was attending since XX/XX/XXXX because i am receiving economy monetary support of XXXX dollars monthly, but had many bad experiences while speaking with the persons that work at this office call : the career source of XXXX XXXX locate in the city of XXXX. My first infraction ticket was in XXXX XXXX, XXXX, in XX/XX/XXXX or XX/XX/XXXX and the second ticket was in XXXX, XXXX. And in the paper report says that both tickets are name as XXXX and XXXX. I think that one of the tickets was a XXXX and not a XXXX. If you can help me with this criminal recorf that i have that i was denied employment offering by the XXXX XXXX XXXX and the work interview was inside of one of the offices of the career source of XXXX XXXX that are suppuso to help you find work but in my personal opinion it is a waste of time because they let private companies do whateber they want with persons trying to find a stable work. General Information Services ( GIS ) furnished a background report on me and submitted information to an employer that I applied with. The information that the reporting agency submitted is not supposed to be sent to the employer due to the fact that the state I live in has restrictions on what the agency can and can not report. On the background report, the agency submitted information that is past seven years but the state of Texas does not allow agencies to report information beyond seven years if the job pays less than {$75000.00} annually. Here is the Business and Commerce Code for the state of Texas XXXX : XXXX # XXXX Other research that I have found on this issue : XXXX The use of older cases Whereas the FCRA does not allow the use of any non-convictions older than seven years, several states go further and ban the use of any case older than seven years, even in instances when there was a conviction. XXXX states place restrictions on the reporting of ANY case information older than seven years. These types of restrictions are found in the following states : California, Colorado, Kansas , Maryland, Massachusetts ( additional limitations are put on the reporting of misdemeanor offenses ), Montana, Nevada XXXX New Hampshire, New York , Texas and Washington. ( indicates exceptions based on salary. )

Was offered a position by insurance offices of XXXX On XX/XX/XXXX. Was sent a request for background screening authorization, potential employer requested I sign an authorization for consumer background check. However the 3rd party company listed was accufacts. After a week, I contacted accufacts who stated they had no relationship with XXXX, and after a search on the internet found out this company was used. GIS did not contact to get my consent for background screening. What is worse the former potential employer has escalated a series of adverse actions based on this report. Contacted this agency who has apparently been working on the report since XX/XX/XXXX. Start date pushed back twice, so I escalated my concern to a supervisor named XXXX in XXXX who committed to sending the report to XXXX on XX/XX/XXXX. That did not happen. The employer sent threat disguised as an offer letter stating that I would be released based on the approval of a background check. 16 days. It presented an unacceptable hiring condition cost me my employer, and have now contacted an attorney to see how to protect my rights.

On XX/XX/XXXX I terminated from the XXXX XXXX for receiving a further investigation report saying I was arrested for battery in XXXX in XXXX XXXX. Less then a week prior I received a letter from General Information Services saying after a deeper look into my background they found XXXX XXXX XX/XX/XXXX was XXXX for XXXX. They failed to verify my legal middle name which is used all over the report showing I was never arrested. They did not verify a place of birth a social security number. I was told I had to dispute the background report with the reporting company to get my job back. I did enter a dispute and received their response on XX/XX/XXXX. Stating they called the XXXX County, NV Justice Court and confirmed the information in their initial report needs to be updated and they removed that case from my background report. I notified the XXXX XXXX and the said they didn't have to hire me back because I was in my probationary period. That I could not have my job back. I would have to reapply if there is an open position in my area and start all over again. I am now unemployed.

I have tried to establish a new business relationship with the USPS ( Postmaster wants me back anyhow ) yet every time for the past year now I have been refused ( 8 times, after copying social security number, driver 's license, and tax forms ) because XXXX keeps popping up a warrant ( that doesn't appear on my report ) that doesn't exist since XX/XX/XXXX. See attached criminal background check. I 've been unemployed for almost 8 months, and FINALLY have some VERY GOOD opportunities/leads, but if these outdated charges appear on my background check, I 'm certain, I will discounted for employment. Details : There are " XXXX '' XXXX XXXX listed in detail from XXXX County, FL in XX/XX/XXXX and XX/XX/XXXX that were dismissed and gone ( I thought ), but they show up, loud and clear. There is also and admission of XXXX XXXX XXXX in Colorado, but nothing showed up on the search - PLEASE, PLEASE REMOVE THAT FROM PUBLIC RECORD. All of this will likely hinder my chances of employment, that were disposed, and should be removed due to the statute of limitations ( as I understand it = 7 years ). I received from the company GIS a copy of a background check made on behalf of XXXX XXXX XXXX. They stated in the report with this words, a issue o authenticity of my social security. " XXX-xxx-xxxx May have a issued as part of the SSA Randomization program. Please work with candidate to validate Authenticity '' As per our conversation they GIS and XXXX XXXX XXXX wanted me to send them my SS card to prove its authenticity. Because the report issuer its supposed to find the right information before issue any report, I denied to send them the requested SS card. I dispute the issue asking them to go to the proper authorities to validate the authenticity of the document. Adding to them the following, that if something is wrong with the card, I would not be the correct source to provided such a sensitive information. They close the dispute and nothing was resolved. I call them so many times and they said that it was close and period.

After a month I received a copy of the background check with very vauge information of a warrant for petty theft in XXXX. I immediately call GIS to dispute the accusations. I have NEVER been to XXXX. So I know for a fact my identity has been stolen. I asked a rep. XXXX was there anything I can or do to help in clearing my name and she tells me NO. I then get a call from a XXXX XXXX who called and left no msg. And she asked 'did i forget about the warrant '. I hope she was not trained to accuse people of a crime that they did n't do. She says she called the XXXX police dept. And I needed to be fingerprinted. And that she already contacted XXXX basically closing the dispute before I was able to get fingerprinted, so she can meet her 30 day time period of closing a dispute. I am trying to get a job at XXXX and they recently pulled a Motor Vehicle Report on me which I have approved of. The report is stating my licence was revoked/suspended. Neither one is true. I XXXX XXXX to XXXX from XXXX back in 2014. My vehicle was in transit by a boat through the military. When I got to XXXX I was told I had to drop XXXX insurance and get XXXX plates and insurance. After applying for XXXX XXXX XXXX I was notified my consideration would not go further due to findings of driving abstract furnished by GIS included was a copy of that report. There were six negative mark 's. I disputed all but one. Three days later I received in the mail, the results of the investigation. This contained a driving abstract three times worse, containing outdated, more than fifteen years, information multiple offense 's inaccurately along with a statement claiming that I declined the disputed. A misdemeanor charge I have out of Illinois is being reported as a felony on a background check. The Company GIS/ XXXX XXXX told me today XX/XX/2019 that on XX/XX/2019 they spoke to a Circuit clerk out of XXXX XXXX Illinois and were told that the charge was a felony which is a false. Ive spoke to the clerk three times this week and and they have stated that it is a class a misdemeanor and also send me Docket information and other reports Pertaining to my case that states it as well. Ive disputed this two times.

I contacted General Information Services to verify and validate the information that they have on record as it was incomplete or nonexistent. General information Services failed to provide the signed agreement between me and the original accuser that contained ANY facts that matched what they had in their database system. They did not change the status nor did they provide me with relief for the damages that they caused me.

My background report in my criminal history is wrong I have never been convicted of any felony at this time nor have I ever. And it claims i am guilty of two XXXX in the first and 6 pending?? GSI needs to understand the negligence on their part and understand this is someone's life they are reporting not nothing less and they hold it in their hands when we dont get a job or loose a job cause of them..

Background check reports a warrant for my arrest. At the time it was accurate, but I have corrected the issue with CERTIFIED forms that the case is dismissed. This report is still keeping me from being hired form jobs. I would like it to be corrected. The companies involved is GIS, and the USPS HR department.
