I obtained a copy of my credit reports and discovered an account under XXXX XXXX pertaining to a collection. I sent my first letter ( XXXX/XXXX/XXXX ) disputing this account and also requesting validation. They responded but did not provide a valid signature. I sent another letter on ( XXXX/XXXX/XXXX ) again requesting validation, however ; again they responded but without a valid signature. According to federal law, XXXX XXXX XXXX is required by federal law to place a " notice of dispute '' on my account within 30 days of my dispute, which they did not. I also requested validation, made pursuant to the Fair Debt Collection Practices Act. Please note that I am requesting " validation '' ; that is competent evidence bearing my signature, showing that I have ( or ever had ) some contractual obligation to pay them. The company sent me some papers showing my name typed in, which is not a signature. Anyone can type a name, so please send me proof of a signature that shows validation. I have retained a copy of their signature and date of receipts, as well as time-stamped copies of my credit reports, showing that they have violated the Fair Credit Reporting Act, Section 623 ( a ) ( 3 ) by not placing the disclosure within the required 30-day period. The listed item is entirely inaccurate and incomplete, and represents a very serious error in their reporting. Additionally, they have broken federal law by not placing the notice of dispute onto my credit reports within the time required by law. I am maintaining a careful record of my communications with them for the purpose of filing a complaint with the FTC and the Attorney Generals office, should they continue in their non-compliance of federal laws under the Fair Credit Reporting Act. I further remind them that they may be liable for their willful non-compliance, as per FCRA 623 ( a ) ( 3 ) - Responsibilities of furnishers of information to consumer reporting agencies [ 15 U.S.C. 1681s-2 ] Duty to provide notice of dispute. If the completeness or accuracy of any information furnished by any person to any consumer reporting agency is disputed to such person by a consumer, the person may not furnish the information to any consumer reporting agency without notice that such information is disputed by the consumer.

This debt is placed in collections on my credit report under XXXX XXXX, they say I owe them {$560.00}. As I never signed a legally binding contract with that collection agency. I disputed this debt with all 3 credit bureaus and wrote the address listed on my credit report asking them to validate the debt with them by sending a contract. They have since then, sent me emails, sent a contract and are now calling and leaving voicemails on my phone. I have since then responded and asked that they only communicate thru US mail, as debt collectors are very aggressive and rude people. I then got another repeated email from this company as soon as I hang up the phone. ( shown in the proof ). They sent a contract thru the mail, which has an e-signature on it, they say I signed for, and address that I do not live at and a social security number with X 's followed by 4 number in which they claim is my social and the original contract that I signed. The contract also says that I agreed to pay XXXX XXXX XXXX and or their successors ( which I am assuming are them ). When I try to look over the original contract in my email, I see that they have disabled the original link with the ORIGINAL contract on it. This contract also says that I agreed to pay the state of DELAWARE, this collection agency is out of XXXX, CA. I reside in North Carolina. I owe no one in California. I am asking for the original contract, an authentication or proof that the alleged e-signature is in fact mine. As I am not obligated to pay back money under a FORGED/edited contract. I feel as though I am being manipulated into paying a credit company that I have not signed a contract with. They are threating to take legal action against me, but have disabled the link showing the original contract so that I no longer have access and have instead sent me a typed up contract. They keep saying that I had 30 days to respond to the original debt notice sent but they don't even have my correct address on the alleged loan contract. They only have my current address because I wrote them FIRST.

I called the company on XX/XX/2018 to work out payment arrangements. After finding out the original creditor went out of business and merged with XXXX XXXX XXXX I call to work out a payment plan. After going through the verification process they told me my agent was a woman named XXXX. After speaking with XXXX I informed her that I could make a payment of {$50.00} and start to make monthly payments to satisfy the debt. She informed me that they could not make payment arrangements or partial payments and the debt needed to be satisfied in full or she would turn me over to her legal team and that it could have negative impact to my credit. She then stated that they would need to do an asset verification on me to see where they could transfer the debt to another one of my accounts that has nothing to do with this debt. At this time I got off the phone with the lady, due to the statements she was making.

In XXXX of XXXX I filed for a chapter XXXX bankruptcy which included Just Military Loans as a creditor. Just Military Loans continued to email me asking for payment and harassing me even with an automatic stay in place and after my attorney sent them the paperwork. Instead of updating the account with " included in bankrupty, closed, {$0.00} balance '', they sent the account to collections. The collections company XXXX XXXX XXXX has put a collections account on my credit report further ruining it when they should not have received the account in the first place. I contacted XXXX asking them to remove the account and they said they will not. My attorneys have contacted them showing the account was included in bankruptcy but I am continuing to receive letters demanding payment. I want this account removed from my credit report.

XXXX XXXX XXXX is reporting a collection account to all credit bureaus as a collection account that 's in the status as open, it 's also reporting a high balance and a balance owing and the balance goes up each month ... How is this possible when the account is supposedly a closed collection account. Instead of updating the account with " included in bankrupty, closed, { {$0.00} } balance '', they sent the account to collections. The collections comp any XXXX XXXX XXXX has put a collections account on my credit report further ruining it when they should not have received the account in the first place. I contacted XXXX asking them to re move the account and they said they will not. The account was included in bankruptcy but I am continuing to receive letters demanding payment. I had some financial difficulties and decided to apply for a loan through Just Military Loans. Now I know it is my responsibilty to read everything and that I am responsible for my debts, but I do not feel it is right to charge 80 % interest rate on any loan. I know that throught the SCRA I could reduce it to 6 % if i accured the loan before active duty, but even after you enter Active Duty I believe there should be a cap on the interest rate a company can charge you. This should go for any consumer loan company.

XXXX XXXX states in a letter that i opened an account with Just MIlitary Loans in XXXX of XXXX . I have not been a part of the MIlitary since XXXX XXXX i do not have any knowledge of a loan with XXXX XXXX or Just MIlitary. I have dispute this account numerous times and have asked for account verification. I do not have a contract with XXXX XXXX and i do not have any knowledge of an account with Just MIlitary.

Just Military Loans referred their debt to a collection agency who listed the debt as a collection on my credit. This date was listed in a Ch XXXX Bankruptcy prior to this. Just Military Loans was named in XXXX NC XXXX XXXX Bankruptcy and they allowed XXXX XXXX XXXX to buy account and list on my credit report. They have not removed the item after multiple attempts to remove it.

This company refuses to provide proof of credit validation. They harass me numerous times during the day. I have sent validation letters in : XX/XX/XXXX XX/XX/XXXX They still insist I pay for this account. This is fraud.
