On XX/XX/XXXX, a minor child damaged a gas line that was incorrectly installed on a property that I was renting. The utility company repaired the line. The utility company demanded that I pay for repairs. I refused because the gas line was incorrectly installed and because I did not damage the line. The utility company referred their alleged tort to a collection agency. The collection agency sued me in small claims court. The court dismissed the case because in Oregon a plaintiff must sue the responsible party ( the minor ) and then add the parent as a defendant if the child 's actions were " intentional '' or " willfully negligent '' ( ORE 30.765 ( 3 ) ). On XX/XX/XXXX, the judge ruled in my favor, dismissed the case on the grounds that the collection agency failed to name the child as a defendant, and instructed the collection agency to pay my court costs. As of today, the collection company still has not paid the court costs. Instead, the collection agency falsely reported the alleged tort as an unpaid debt to the consumer credit reporting agencies. My credit score dropped. My interest rates went up. I have been unable to purchase a home or to get a business loan as a result. I consulted several lawyers who all confirmed that an alleged tort does not qualify as a " claim '' under Oregon law ( ORS 697.005 ) and that collection agencies can not solicit a claim for any amount that does not meet that definition. In a XX/XX/XXXX letter to me, the utility company 's claims manager acknowledged that the matter is not a " claim '' but rather a tort and and defined a tort as " a wrongful act, not including a breach of a contract or trust, that results in injury to another 's person, property, reputation, or the like .... '' in his letter. Through much correspondence, I warned the collection agency and its lawyer that the Fair Credit Reporting Act 's Section 1681o grants actual damages, lawyer 's fees, court costs, and punitive damages to consumers when a collection agency willfully reports false information. Still, they continue to report the item as an uncollected debt. I have requested that XXXX, XXXX, and XXXX remove the item from my credit report three times, most recently today.

Today I was notified of a writ of garnishment by XXXX XXXX XXXX of XXXX Or. XXXX. I had just paid off and completed a garnishment so was confused as to why this was being garnished again as I do know that at the time of the original garnishment all fees need to be applied. When I contacted them I asked them about the debt. They informed me that the garnishment was from the remaining balance of a prior garnishment in 2001. ( this would be 17 years of interest on a small amount ). When asked why when I called previously to discuss the other garnishment and asked if there was any outstanding amounts owed I was told no. During the conversation with the representative when asked about consumer rights was informed that its optional for them to follow those guides. The Fair debt collection act and oregon law states 7 yrs and 10 yrs respective to collect on a debt. This is not the first time this has occured as the previous garnishment was also from over ten years ago. Additionally, when I pushed for the information on this 2001 garnishment I was informed that it was to far back to look up what the debt was for.

They have attempted to contact my partner by phone multiple times and the first time discussed my debt information with her directly without my written permission ( which they require ). They have called her five times over the last 5 months to get payment for my debt, a few of them she missed because she was at work. The number they have been calling, which I submitted, is not my phone number. They have also only sent me a couple letters since they acquired my debt sometime last year before they took legal action against me. I did inform them, months ago, that I would have the money to pay in full when I got my tax return. I was not aware that they were not allowed to contact others for my debt until recently. Because of this improper communication/ miscommunication, I feel that their current legal action is unfair regarding the timing. I'm attaching a screenshot of the call log/history from this company.

There is XXXX judgements on my credit report which have been paid in full. This judgement was paid in full a little over a month ago and is still not showing the judgement released, but again the company itself is showing account paid in full. This is preventing me from obtaining a home loan and I have asked the companies personally to take care of this issue previously. I was told that I needed to dispute with on my credit report and I have done that twice now and the judgements are still not showing released. I have took the time and taken care of this debt and I would appreciate the companies compliance in regards to releasing the judgements on record.
